The San Benito County Board of Supervisors approved a proposal July 23 that will transform a former turkey farm and equestrian facility into a hemp processor. San Jose-based Pacific Bay Capital Group plans to construct a 275,000-square-foot San Benito Hemp Campus at 7800 Frazier Lake Road in Hollister on property owned by the Kevin Chambers Living Trust of Menlo Park. The 75-acre site is currently home to Gilroy Gaits, which offers various equestrian facilities, as well as personal storage for the owner. Located south of the Frazier Lake Airpark, the facility was originally constructed in 1988 as a turkey egg-raising farm. According to a report by county principal planner Taven M. Kinison Brown, the hemp campus would be home to facilities for hemp cultivation and hemp-derivative

More than 200 old cars sparkled in the summer sun, and kids of all ages couldn’t get enough of the colors and chrome. The free event also featured two stages of live music, raffle prizes, new car displays, bargains galore from local merchants and restaurants, and the traditional free watermelon.

High-speed internet is on its way to sections of San Benito County that currently cannot access fast broadband connections. The Federal Communications Commission announced July 18 that it
had awarded nearly $83 million in funding for new rural broadband services in California. All of the first round of funding in California was awarded to GeoLinks, a Southern California company, which is given 10 years to provide highspeed internet connections of at least 100 Mbps in nearly 11,000 locations, following a competitive
auction. The California list includes $1,504,536 to assist in the development of high-speed internet services in the Hollister area, according to the FCC. The goal is to provide broadband services to “unserved rural California homes and businesses, stemming from last year’s successful Connect America Fund Phase II auction,” the FCC said in a
statement. Providers are to begin receiving funding this month. Nationwide, the auction last fall allocated $1.488 billion in support to expand broadband to more than 700,000 unserved rural homes and small businesses over the next 10 years. The FCC has already authorized two waves of funding in May and June, and funds
from those first two waves are expanding connectivity to nearly 100,000 homes and businesses that lack service. The July 18 action, which provides funding in 23 states, brings total authorized funding to nearly $803 million, or over half of the $1.488 billion allocated through the ➝ Internet, 2

PG&E cuts its losses PG&E SAFETY MEASURES TO PREVENT FIRES COULD SHUT OFF ELECTRICITY Michael Moore
San Benito County emergency services and health officials are preparing for a potential worst-case scenario, widespread power shutoff for the rest of this summer after PG&E announced such measures might be necessary to prevent wildfires in California. Earlier this year, Northern California’s largest electric utility provider alerted the public and regulatory authorities that it may implement “public safety power shutoff ” scenarios at times of “extreme weather or wildfire conditions,” reads the PG&E website dedicated to public information about the program. During such a power shutoff, PG&E may turn off electricity for entire communities, cities or even counties in order to reduce the likelihood of live, damaged power lines igniting dry vegetation and sparking large-scale wildfires. Such power shutoffs may occur in areas where high winds and low humidity levels are expected, or where dry vegetation and other heightened risk factors are present, according to the PG&E website prepareforpowerdown.com. Public safety power shutoffs may also occur when the National Weather Service has declared a “red flag warning” in a region or community.

O’Neill added that authorities are preparing for different “scales of severity” of a power shutoff, depending on different size areas or portions of the county being affected. “It could be a huge region, but PG&E is really doing their best to keep these as small and localized as possible,” O’Neill said. Another essential community function that needs reliable electricity is that of medical services. Hazel Hawkins Memorial Hospital continuously prepares for any potential major power shutoff, regardless of the cause, said hospital spokeswoman Frankie Gallagher. “We function independently on backup generators, which are tested monthly,” Gallagher said. PG&E has enacted public safety power shutoffs twice so far this summer, both in early June, PG&E spokesman Jeff Smith said. “We’re hoping everybody is taking that to heart,” O’Neill said. “The better prepared you are for a public safety power shutoff, the better you are prepared for any type of emergency. This effort will go well beyond this fire season.”

PG&E implemented the public safety power shutoff program in response to devastating wildfires in Northern California during the 2018 season. Regulators have identified downed PG&E power lines as the cause of the Camp Fire in November in Paradise, the deadliest wildfire in the state’s history. Because such power outages, if they are enacted, could last up to several days, local officials face the burden of ensuring essential public services—notably police, fire, EMS and public works—remain operative in Hollister and San Benito County. Kevin O’Neill, San Benito County’s emergency services manager, explained that authorities have been steadily working on a plan to keep essential services running in case PG&E determines a need to shut the electricity off in the area. “Our role is coordinating between the various public safety and administrative functions of the city and county governments,” said O’Neill, whose office recently gave a presentation on these efforts to the board of supervisors. “We’ve set up coordination meetings, been talking to partners and requiring updated information on various generators to keep our infrastructure up and running.” Gas-powered generators are an essential component of ensuring the continuity of services, and a complicated aspect of that challenge is planning to have enough fuel to keep those generators running for multiple consecutive days without power, O’Neill explained. About 120 members and supporters of a new group, Preserve Our Rural Communities, spread out across the San Juan Road overpass west of San Juan Bautista during Friday evening rush hour July 19, waving signs to passing motorists, protesting any new commercial development in the area. Tractor trailers and passenger vehicles honked as they drove beneath the fenced overpass covered with dozens of protest signs topped by a large American flag. The signs were protesting a May decision of the county planning commission to create commercial zones at four intersections along Highway 101 between Aromas and San Juan Bautista. After receiving protest letters and emails, the county Board of Supervisors took the planning commission’s recommendation off its agenda this week, and is set to take up approval of the zoning changes in August. The four commercial “nodes,” as they are called, would be located along the highway at Betabel Road and Highway 129/ Searle Road in San Juan Bautista, and Rocks Ranch and 101 Livestock Market in Aromas. The properties, totaling about 326 acres, would be converted

The protest group includes residents of both Aromas and San Juan Bautista, where the city council voted in June to send a letter to San Benito supervisors opposing the project. San Juan Bautista is located about two miles east and south of the interchanges. San Juan Bautista resident Cara Vonk had told the that city’s
council that multiple additional commercial developments along the state highway would destroy the rural beauty of San Benito County. “We don’t need urban homogenization and fake Disneyland themes,” she said. Gina Paolini, a member of the citizens group, said, “The county does not have a tourism base to support the hotels.” Owners of Rocks Ranch and the Betabel RV park favor new development. Under regional commercial zoning, retail space is limited to 85,000 square feet per node, and no more than 125 hotel rooms can be built within each area. County planner Darryl Boyd
stressed that the zoning changes would not immediately result in any development. “There’s no physical development that’s actually being proposed as part of this project,” he told the planning commission in May. “This project is continuing the implementation of the 2035 General Plan.” Scott Fuller of the San Benito County Business Council said commercial development at the Highway 101 interchanges follows the already approved county General Plan. “It will bring in additional revenue,” he said. “These are not destinations that are adding traffic. This is to attract traffic that is already there.”

The developer also proposes to construct 60,000 square feet of greenhouses. The facility will also process hemp grown elsewhere in the state. “Staff views this project as an adaptive reuse of an underutilized agricultural production facility,” the report reads. “Aside from two 30,000-squarefoot liner hoop houses (or more formalized structures) to be added between existing structures on the developed property, there will virtually be no new construction, nor the impacts associated with new development and construction.” Per the development agreement, Pacific Bay Capital Group will pay 1 percent of its gross annual receipts to the county. The developer anticipates hiring 75 to 100 employees once the facility is fully built out, with a payroll between $3 million to $4 million annually, according to the report.

Tax bill could backfire
P
resident Donald Trump and the Democrats who dominate California politics are locked into a rather bizarre, symbiotic relationship. Almost daily, they fire political and legal bullets at each other across 2,728 miles of American soil, each knowing that no matter how strange the missives may appear to ordinary folks, there’s no penalty to be paid. Trump shores up his standing among his core supporters by jibing at California. And the state’s politicos, including Gov. Gavin Newsom, play to the anti-Trump sentiments of their voters. The latest incarnation of this syndrome is legislation, now awaiting Newsom’s signature, that would require any candidate for president in 2020 to release five years of income tax returns as a precondition to appearing on California’s presidential primary ballot. It’s a reaction to Trump’s refusal to reveal his income tax returns, thus defying what has become a presidential custom, albeit one not required by law. Newsom will almost certainly sign the legislation, Senate Bill 27, which cleared both legislative houses on party line votes, even though his predecessor, Jerry Brown, vetoed a similar measure two years ago. Brown had refused to reveal his own income tax returns and warned the bill “may not be constitutional” and could create “a slippery slope” precedent. “Today we require tax returns, but what would be next?” Brown wrote in his veto message. “Five years of health records? A certified birth certificate? High school report cards? And will these requirements vary depending on which political party is in power?” Brown’s point was well taken. Not only would such a law open the door to all sorts of political mischief, but it would not be confined to California. Red states–and there are more of them than blue ones–could retaliate by compelling Democratic candidates to jump through other hoops.

That said, it’s not likely to happen because federal judges are not likely to allow states to impose their own qualifications on presidential candidates beyond those contained in the US Constitution. To wit: “No person except a natural born citizen, or a citizen of the United States, at the time of adoption of this Constitution, shall be eligible to the office of president; neither shall any person be eligible to that office who shall not have attained to the age of thirty-five years, and been fourteen years a resident within the United States.” As a state Senate analysis of SB 27 pointed out, “While the courts have not ruled directly on this question, the US Supreme Court has ruled on ballot access requirements for congressional candidates and has held that states and the federal government cannot add to the qualifications of senator or congressional representatives outlined in the federal Constitution.” Sen. Mike McGuire, a Healdsburg Democrat, insists that his measure has nothing to do with personal or partisan politics and everything to do with good government. “Transparency is a nonpartisan issue,” he says. “And it’s transparency that provides the basis for accountability in government. For the past 40 years, every US president– Republicans and Democrats alike–have released their tax returns. That is, until President Trump took office.” Even if upheld by the courts, as unlikely as that seems, the measure would not damage Trump. He has no chance of winning California’s electoral votes next year and would use it to bolster the state’s image as a kooky outlier in more conventional battleground states such as Pennsylvania, Florida, Michigan and Wisconsin. Earlier this year State Sen. Anna Caballero, whose district includes San Benito County and the Central Valley, authored Senate Bill 386 to designate electricity generated at Don Pedro Reservoir as renewable. Several environmental organizations and former Senate President Pro Tem Kevin de Leon went nuts. They insisted counting hydro as renewable would discourage construction of their preferred power sources. The bill was halted even though the federal government and virtually every other state considers hydropower renewable. Like California, the state of Washington passed a law requiring carbon-free energy by 2045. Hydro supplies 65 percent of Washington’s electricity. But instead of rejecting all that clean power to fight climate change, Washington’s law says hydro should be “maximized” as “our principal renewable resource.” Groups such as the Sierra Club, which fought so hard against Caballero’s bill, were happy to call Washington’s hydropower renewable. When people in San Francisco, Los Angeles and Sacramento understand that hydropower is just as clean as solar but costs half as much to produce, they too might demand to be treated more fairly. Is the cleanest, greenest electricity in the world green enough for California? For years, the people of the northern San Joaquin Valley have been trying to get hydropower recognized for what it is: the original source of clean electricity. Our efforts have been stymied by people who feel entitled to decide what is, or isn’t, green enough. That’s why I have begun the process of modifying our state Constitution to recognize safe, abundant, carbon-free hydropower as a reliable source of renewable energy in our fight against climate change. I have authored Assembly Constitutional Amendment 17 to place this question before California’s voters. We’ve also begun the process of qualifying a ballot measure if the Legislature fails to act on ACA17. At the very least, it should start an important statewide conversation. The danger of climate change is clear. We see it in more extreme summer heat and rains that either flood or hardly fall at all. Since 2002, California has required all electricity providers to transition from polluting sources like coal and oil to strictly “renewable” sources. For-profit companies such as PG&E and public entities like Modesto, Turlock and Merced irrigation districts, which are owned by the people living within their boundaries, all must meet the same standards. Last summer,then- Gov. Jerry Brown signed Senate Bill 100, committing the state to using only carbonfree energy by 2045. An important milestone in SB 100 requires 60 percent of all California’s energy be generated from “renewable” sources by 2030. That’s where the law loses its way. It classifies solar, wind and geothermal as renewable but inexplicably excludes the most well-developed renewable energy of all: hydropower. If solar and wind power were cleaner than hydro, that might make sense. But hydro is every bit as clean as solar or wind power, and produces zero emissions. Turlock Irrigation District estimates leaving hydropower off the renewable list will cost its 100,000 customers an additional $300 million. There are two reasons for that extra cost. First, with Central Valley temperatures exceeding 100 degrees on 10, 20 or more days per year, we need more power than coastal residents to make our homes livable. • • Second, if hydropower isn’t classified as renewable then the Turlock Irrigation District, and the many other utilities that depend on hydro, will have to replace it with more expensive solar- and wind-generated power. My constitutional amendment will make state law reflect reality by recognizing hydropower as renewable. It’s common sense. It’s sound science. It will lower the electric bills of millions of Californians. Investing in other renewable energy sources shouldn’t mean ignoring the clean energy we already have. If convicted of all five charges, Kitchens faces a maximum sentence of three years, eight months in prison, Brannon said. The criminal case against Kitchens was referred to Monterey County prosecutors by the California Secretary of State’s office, Brannon added. Kitchens ran against Democrat Robert Rivas of Hollister in the November 2018 District 30 race. Rivas won handily, with Kitchens receiving 37 percent of the votes cast. The purpose of the Aug. 15 preliminary hearing is to allow the judge to determine whether the case should go to trial, based on evidence to be presented by prosecutors.

The July 16 preliminary hearing for Neil Kitchens, a former Republican candidate for state assembly District 30 accused of five felonies related to voter fraud and forgery, has been delayed until mid-August. Kitchens’ preliminary hearing in Monterey County is scheduled for Aug. 15, with a brief hearing to confirm that date on Aug. 13, according to attorneys. Kitchens, a Prunedale resident, was the GOP candidate in the November 2018 election for Assembly District 30, which includes all of San Benito County and portions of Santa Clara, Monterey and Santa Cruz counties. But Kitchens was not a resident of District 30 when he registered to vote and signed up as a candidate, according to Monterey County Chief Assistant District Attorney Berkley Brannon.
Kitchen faces five felony charges related to this alleged incorrect voter and candidate registration: two counts of voter registration fraud and three counts of procuring and offering a false or forged instrument. “The conduct is two things: registering to vote in a district where you don’t live, and filing for candidacy to run in a district where you don’t live,” Brannon said July 22. He noted that in order for a candidate to run for office in a specific district, the candidate must be registered to vote in that district. Kitchens pleaded not guilty to the charges at a June 28 arraignment at the Monterey County courthouse in Salinas. His attorney, Frank Dice, did not comment on the allegations when contacted earlier this week. Brannon said that when Kitchens filed his paperwork for the District 30 candidacy, he listed an address for a property he owns within the district that is not his primary residence. Brannon explained that the property Kitchens claimed as his residence
The San Benito County Sheriff ’s Office identified the woman as Yanelly Garcia Lobato. She was pronounced dead at the scene when paramedics arrived, according to authorities. Five of the six survivors in the two-vehicle crash suffered various injuries as a result
of the accident, reads a report from the California Highway Patrol. About 2:15am July 20, a 34-year-old Salinas man was driving a Ford F550 pickup truck on eastbound State Route 156, west of the intersection with State Route 25, according to the CHP. As the pickup approached the intersection of SR 25, the driver ran a red light, striking a 2001 Ford Crown Victoria with six occupants inside. The Crown Victoria was traveling northbound on SR 25 at the time of the collision. The driver had a green light at the intersection of SR 25 and SR 156, according to police. After the driver of the pickup failed to stop for
the red light, the vehicle struck the Crown Victoria, police said. The impact caused the Crown Victoria to spin out of control until the vehicle’s right front quarter panel collided with a signal light. Lobato, a passenger in the Crown Victoria, was pronounced dead at the scene, according to the CHP. A total of six people, including the driver, were traveling in the Crown Victoria. All were Gilroy residents, according to police. The 48-year-old male driver and another female passenger suffered major injuries and were hospitalized. The driver of the pickup suffered minor

The criminal complaints stemmed from work done in the summer of 2017 by asbestos consultant company EnviroScience, Inc., a Santa Clara County-based firm run by Hooman Sotoodeh-Khoo. Also named in the complaint is Alliance Environmental, LLC, a Los Angeles-based asbestos abatement firm hired by EnviroScience and Sotoodeh to abate any asbestos found in a portable building that had been slated for demolition at San Benito High School. The fourth defendant, Alfredo Rocha, was an employee of EnviroScience at the time. According to Hooper, the District Attorney’s Office alleged numerous

investigated by Michael Sheehan, the now-retired compliance program coordinator for the Monterey Bay Air Resources District, which enforces air quality laws and regulations in the San BenitoMonterey-Santa Cruz area, Hooper said. The district attorney expressed her appreciation to Brett Henningsen, the demolition contractor on the project, for what she called “his crucial role in refusing to demolish the portable building after noticing the presence of asbestos, and for contacting Mr. Sheehan at the air resources district to alert him to the violations.” “On behalf of the District Attorney’s Office and the people of San Benito County, I would like to commend Mr. Henningsen for notifying the air district about the asbestos issues that he witnessed,” Hooper said in a July 23 statement. “His presence of mind to recognize the asbestos danger and immediately report it not only prevented the likely release of asbestos materials, but also provided the information that prompted Mr. Sheehan’s investigation and resulted in today’s pleas.”

Two companies and two individuals entered no contest pleas July 19 to misdemeanor charges that they violated various asbestos laws in connection with the demolition of a portable building at San Benito High School, according to San Benito County District Attorney Candice Hooper.
violations of asbestos regulations by the defendants, including failure to adequately survey for asbestos, failure to notify the air district of asbestos work requiring such notification, illegal disposal of asbestos-containing hazardous waste, unlawful emission of asbestos and failure to take corrective action concerning asbestos violations. Because of the facts of the case, each defendant was charged with a different set of crimes, she said. As part of the resolution of the case, the defendants will each serve two years of probation and pay a total of approximately $170,000 in fines and costs, a portion of which will be directed to San Benito High School as a community service payment. In addition, the individual defendants will serve a combined 360 hours of community service within San Benito County and, with the exception of Alliance Environmental Group, which cooperated with the investigation, the defendants will not be permitted to conduct asbestos work within the county while on probation, Hooper said. The case was

Hooper also had praise for Matthew Carr, an environmental prosecutor who handled the case on behalf of San Benito County. Carr works as a circuit prosecutor for the California District Attorneys Association and assists smaller counties in prosecuting environmental cases. The association’s Circuit Prosecutor Project, which recently celebrated its 20th year, provides environmental prosecutors to
rural California counties where there are insufficient resources to hire prosecutors to pursue and prosecute violations of California’s environmental laws. Circuit prosecutors like Carr work under the direction of the county district attorney while prosecuting such cases, Hooper noted. “We are extremely grateful for the expertise of Mr. Carr in helping us hold accountable the defendants in this case. We may be a small county, but with the assistance of the Circuit Prosecutor Project, we will never allow ourselves
to be a dumping ground for those seeking to evade California’s environmental laws,” Hooper said. Carr said he was “very gratified to be of assistance to the people of San Benito County.” The project’s mission, he said, “is to vigorously enforce the laws which protect our air, water and natural resources and also maintain a level playing field for those businesses who abide by our laws so that they are not undercut financially by those seeking to make money by cutting corners where our environment is concerned.”

The Hollister Little League All Star teams saw their respective seasons end in the Section Tournament. The 11- and 12-and-under teams both went 0-2, while the 10-and-under squad went 1-2. All three teams had scintillating runs to win the District 9 Tournament only to see the competition best them in sectionals. One thing is for certain: the players are motivated to come back next year and finish the deal. “What I’ll remember most about this season is winning District, but also that it’s a good jumping off point for the boys to see what it takes to be at the next level,” 10s manager Celso Lopez Jr. said. “It added a little fire in their ability to compete. Section was great for the kids because they got to see the quality of play is a step up. We wanted to win at least one game in section, and we got that done.” Hollister lost its opening game to Santa Teresa 10-4 before rebounding with a 13-0 victory over Capitola Soquel. Caden Watt and Ami Lopez combined on a one-hitter, and those two pitchers served as de facto co-aces for much of the AllStar season. However, Hollister simply didn’t have the arms or firepower to compete with Cambrian Park, which eliminated Hollister in the next game 19-7 en route to winning the championship. “Our kids were excited to play Cambrian Park,” Lopez said. “Now they know how much harder they have to work for next year, and they’re excited about it. So as coaches we’re
looking forward to seeing these boys develop and progress.” The 11s team went two and out, though it was competitive until the very end. Hollister opened the Section Tournament with a 6-5 loss to Santa Teresa before seeing its season end with a 9-6 defeat to Los Gatos. “It was a little frustrating because we felt like we could’ve done better,” said 11s manager Daniel Barone, referring to the team’s costly errors and runners left on base in the latter innings against Los Gatos. “It’s easy to beat ourselves over it a little bit, but I’ll look back and have nothing but great memories of this team. Honestly, this is the best group of kids on a team I’ve ever been a part of as far as attitude and buying into everything the coaches said. No one slacked off, and I was proud of all of them. Being able to be a part of that was great and my favorite moment.” Barone also got to coach with his two best friends in Oscar Esparza and Jordan Quezada, and their three sons are best friends as well. For Barone and a majority of the kids on the team, it’s onto the travel ball season with the Seam Splitters—which Barone manages, both on the field and operationally. The team will have tryouts on Saturday at Ridgemark Park from 8:30 a.m. to 10 a.m. for the 12U team. Barone plans on putting his name into the hat to manage the Hollister Little League All Stars next season for the 12-andunder team. Many of the same kids from the 11s squad will likely have aged up to play for the 12s in 2020. This past season, Jordan Quezada was a reliable workhorse pitcher who has a “ton of potential,” Barone said. Catcher Kayden Rodriguez caught every single inning of every game, another consistent player who could be relied upon. “Kayden was a wall and beast back there,” Barone said. “I think he was the smallest guy on the team, but you think he was 10 feet

Barone praised the attitude and play of Anthony Bolin, who always had a smile on his face and was willing to learn and listen to constructive criticism. Barone’s son, Brayden, also carried himself well by competing hard in every at-bat or play. “I can say something positive about everybody because it was such a great group of kids,” Barone said. “I’m happy with how
things turned out. They make the game fun again. They’re out there laughing and carrying on, and even after they’ve just lost they have the attitude of, ‘We’re good and life goes on.’ It’s the proper perspective to have.” The Hollister 12-and-under team was an inning away from winning its opening Section game when Sunnyvale rallied for two runs in the sixth inning. Sunnyvale then exploded for 10 runs in the final couple of innings to post a 13-3 victory. Sunnyvale went on to win the tournament.

OBITUARIES DR. MAX RICHARD TARMANN March 14, 1930 - July 16, 2019

r. Max Tarmann longtime resident of the Sharon Heights area, died Tuesday the 16th of July in Belmont, CA. Max was preceded in death by his wife and best friend Augusta “Gussie” Tarmann and survived his children, Jeanmarie Derry, Mark Sr. (Bettina) and Gregory Tarmann, grandchildren Mark Jr. (Toni) and Gregory Tarmann, Shannon (Steven) Catalano, Cayla (Austin) Kline, and Mariah Derry, and great-grandchildren Jackson, Tyler and Wyatt Catalano, and Mark Tarmann Jr.
Max was born in Milwaukee, Wisconsin, and was a lifelong cheesehead. Max graduated from Marquette University and served in the United States Air Force. A distinguished dentist and avid golfer, Max was known for his sense of humor and love for playing the accordion. Max enjoyed serving the local community alongside his wife, particularly through the Catholic Church, and was a proud “Opa” to his grandchildren. Memorial Mass will be held on Tuesday the 23rd of July at 11 a.m. at The Church of The Nativity, 210 Oak Grove Avenue in Menlo Park. Burial will follow at Holy Cross Cemetery, 1100 Santa Cruz Avenue in Menlo Park.
