Morgan Hill city leaders have long prided themselves on the city’s growth plan and related housing requirements—with growth measures in place since the 1970s and policies requiring residential developments to include below-market-rate homes in their plans. Now the city fears its careful planning could be put to an end if the state Housing Crisis Act of 2019 passes in the California Assembly and moves back to the Senate. The bill, introduced by state Sen. Nancy Skinner (D-Berkeley), would suspend local housing regulations for 10 years and create time limits for processing housing permits.

Hundreds of locals and visitors brought their families and met up with their friends at the June 14 kickoff concert for the Friday Night Music Series. The annual summer concert series is sponsored by the Chamber of Commerce, and continues every Friday through Aug. 30 at the Downtown Amphitheater at the Community and Cultural Center. Rocking the dance floor and lawn at the June 14 concert was headliner The Houserockers. They were preceded by opening
acts Mitchell James and Young Rhythm. Each Friday Night Music Series concert starts at 6pm with local and youth musicians filling the opening slots, followed by a headlining band that is known throughout the region (and sometimes beyond) for getting crowds of music fans out of their seats and onto the dance floor. This Friday, June 21, the headlining act will be Soul Kiss. The show lasts until 9:30pm every Friday. Food and beverages are for sale at the venue. Admission is free. Attendees are encouraged to bring lawn chairs and blankets. The Downtown Amphitheater is located at 17000 Monterey Road.

Sexual assault reports rise in Santa Clara County GILROY RESIDENTS CHARGED WITH CRIME MORE THAN MOST OTHER ZIP CODES Michael Moore Editor
Incidents of rape and sexual assault have risen in Santa Clara County over the last year, and experts think the increase is at least partially related to victims’ growing willingness to report the crimes. That’s one of the findings in the District Attorney’s annual report for 2018, which was compiled by the DA’s Crime Strategies Unit. The report also found that more Gilroy residents are charged with a crime than in almost every other ZIP code in the county, and both violent and juvenile crime are on the rise in Santa Clara County. In 2018, 1,982 Gilroy residents were charged by the DA’s office with one or more crimes, according to the report. The only neighborhood that produced more criminal defendants was downtown San Jose, where 2,052 residents were charged in 2018. The report noted a correlation between the five ZIP codes in the county representing the most defendants, and the socioeconomic factors of those neighborhoods. “Looking more closely at our defendant ZIP codes, we find that defendants most commonly reside in poorer, more dangerous and less healthy neighborhoods,” reads the report. The median household
income in Gilroy is about $90,000 (compared to about $107,000 for the county overall), with a 6 percent unemployment rate (5.7 percent in the county) and 8.4 percent of families living below the poverty line (5.6 percent in the county overall), according to the DA's report. Gilroy Mayor Roland Velasco said the number of defendants from his city says more about the quality of the Gilroy Police Department than any actual crime trends. “I think the report shows that our police officers are proactive, assertive and very busy making arrests, and that's reflected in the crime report,” Velasco said. The mayor added that the city council has approved a “pilot program bringing on two additional officers for ‘quality of life’ crimes.”
Victims more likely to report
The DA's annual report also found that while reports of sexual assaults are on the rise in Santa Clara County, authorities are encouraged that victims are seemingly more likely to report their assailant or rapist than they have in the past. “These statistics are an invaluable tool in our efforts to prevent sexual assault and other violent crimes,” DA Jeff Rosen said. “We are ever hopeful that more survivors will come forward to let their powerful voices be heard and help us protect our community.” In 2018, the DA's office filed charges for 279
sexual assault cases. These include charges of assault with intent to commit sexual act, rape, statutory rape, pimping, pandering, aggravated sexual assault, child sexual assault and other related crimes. In 2017, the number of such filings was 268. In 2016, sexual assault charge filings was up to 284. In San Jose alone, there were 615 reports of rape in 2018, according to the report. That number has been steadily increasing since 2011, and in 2017 there were 571 rapes reported in San Jose. The CSU report notes that in 2014, federal authorities updated the definition of rape to broaden the types of cases counted. That redefining of the crime accounts for some of the recent years' increase, but experts agree that victims are more likely to come forward to authorities than in previous years. Erica Elliott, sexual assault and prevention program manager of Gilroy-based Community Solutions, said rape and sexual assault used to be a “taboo topic that people were hidden from.” In recent years, however, the public discussion of sexual assault in almost all forms of media has become commonplace, bolstered by the “#metoo” movement and other efforts to support victims. Federal authorities have enacted more laws in recent years supporting victims, further encouraging survivors to talk about

Jeff Rosen their incidents, Elliott explained. “Having those conversations helps people,” Elliott said. “When I grew up, I was taught it was a stranger in a scary van. But realistically, 90 percent of sexual assaults happen by people we know and trust. It can happen to anybody. People's response to sexual assault victims has become generally a lot more positive, where I used to hear a lot more victim blaming.” Elliott added, “I think there has been an increase in people’s…understanding, which has made people feel safer to come forward, knowing that [others] won't ostracize or demean them.” Community Solutions is a non-profit that provides a variety of services for survivors of sexual assault and domestic violence. In the 2016-17 fiscal
year, Community Solutions served 131 rape and sexual assault victims in South County, Elliott said. In 2017-18, that number rose to 145 victims. Elliott further noted that advocates and law enforcement have increasingly looked into the “intersectionality” of sexual assault with other crimes, adding to authorities’ ability to record and prosecute such incidents. For example, Elliott said, “Many domestic violence survivors have also experienced sexual assault.” Other notable findings in the DA's CSU annual report for 2018 include: • Juvenile crime rose by about 25 percent in Santa Clara County, with 798 minors charged with a crime in 2018, compared to 592 in 2017. • Juvenile crimes showing the biggest increase
from 2017 to 2018 are robbery (238 charges in 2018 for a 98 percent increase) and carjacking (79 charges in 2018 for a 182 percent increase). • The DA's office prosecutes Hispanic/Latino and black/African-American residents at a higher rate than these groups are represented in the county overall. Asian/Pacific Islander residents are prosecuted at a rate lower than their percentage of the overall county's population. • Charges for violent felonies (robbery, assault with a deadly weapon, felony assault) totaled 847 in 2018, compared to 805 in 2017. In 2016, the DA’s office filed 709 charges for violent felonies. The CSU report says the increase in violent crime is “driven primarily by a marked increase in reported rapes and robberies.”

A nearby resident called police to report that a tractor had crashed on the other side of her chicken coop, and she heard a subject "moaning" on the neighboring property as though he was injured. A passing witness stopped to help and saw a juvenile male lying in the roadway. Velarde fled the scene, with an adult passenger still in the vehicle, just after the witness contacted him. The juvenile was pronounced dead at the scene when officers arrived. Velarde continued driving northbound in the southbound lanes of Monterey Road, according to police. Responding CHP officers located the Toyota, made a traffic stop at Monterey Road and Bailey Avenue and arrested Velarde. Velarde remains in custody at Santa Clara County Jail in lieu of $311,000, Borca said. His next court date is scheduled for July 17 at the Hall of Justice in San Jose.

Isael Velarde, a Gilroy resident accused of crashing a vehicle and leaving his severely injured passenger to die on the road just north of Morgan Hill on June 6, faces more than 10 years in prison for his involvement in the collision and death, according to authorities. Velarde, 18, was arraigned last week on charges of vehicular manslaughter, DUI causing injury and driving while unlicensed, Santa Clara County Deputy District Attorney Daniel Borca said. For the most serious charge—felony vehicular manslaughter—Velarde could be sentenced to 10 years, eight months in prison if convicted. The Santa Clara County Coroner's Office identified the victim of the fatal crash as

Robert Davies, a San Mateo police officer who was arrested at his Morgan Hill home June 6, is scheduled to appear in court July 8 for an arraignment on accusations that he contacted a minor for criminal, sexual purposes, according to authorities. Davies, 40, was arrested after San Jose Police investigated him for chatting about engaging in sexual activity with a social media user who posed as a 16-year-old girl, according to the San Jose Police Department. He is currently out of custody on bail, according to Santa Clara County Deputy District Attorney O'Bryan Kenney. Davies will be arraigned July 8

The social media tipster, identified by police only as a “concerned citizen,” had created a fake account on the Tinder dating app as a 19-yearold female, according to police. Shortly after Davies started chatting with the user in May, they switched to another mobile messaging app where the citizen told
Davies she was a 16-yearold girl. Davies allegedly acknowledged the account holder’s age and continued to chat with her about a potential sexual encounter, according to police. The tipster learned Davies was a San Mateo police officer, and alerted the authorities about his communications. The SJPD Covert Response Unit arrested Davies June 6 at his Morgan Hill home after serving search warrants on his mobile devices and his residence, police said. He is charged with contacting a minor to commit a felony. According to Davies' Linkedin profile, he has been an officer with the San Mateo Police Department since 2015. He has also worked for the Burlingame and Redwood City police departments. Davies served in the US Marine Corps from 2003 to 2007.

Cities pledge solutions to homeless crisis
W
ith homelessness worsening, Californians are rightly frustrated that our state, with its abundance of wealth and resources, has not made better progress in helping people get off the streets and into housing. There is plenty of blame to go around. Major contributing factors include the challenges lower- and middle-income families face finding a place they can afford. Los Angeles helped more than 21,000 homeless into permanent housing last year, but the homeless population increased because even more residents lost housing. These challenges exist statewide. More than 2.2 million extremely low-income and very low-income renter households are competing for only 664,000 affordable rental homes. • That leaves more than 1.5 million of California’s lowest-income families without access to housing. Many of these families end up homeless. • Housing affordability and homelessness are critical issues for my organization, the League of California Cities, and the cities we represent. We see firsthand in our cities the struggle of families that cannot afford housing, or homeless ones who need our support. That’s why the League supports a comprehensive package of proposals to fund homeless services and to increase housing production, particularly for low- and very low-income families. The league supported the passage of Proposition 1 in 2018, the $4 billion affordable housing bond, and Proposition 2, a $2 billion bond for supportive housing for homeless individuals. The League of California Cities also supports Gov. Gavin Newsom’s proposals to expedite the allocation of the housing bond funds, provide $650 million to

The league appreciates efforts of legislative leaders to restore more robust tax increment financing mechanisms in Senate Bill 5. This measure would create the Affordable Housing and Community Development Program and provide cities and counties the resources we need to support affordable housing. When the state abolished redevelopment in 2011, it wiped out the only source of ongoing funding available to local governments to build affordable housing. SB 5 would help fill this gap by establishing a strong partnership between the state and local governments. Specifically, SB 5 would allow cities and counties to maintain property tax increment in dedicated zones where they’ve developed a state-approved plan. SB 5 also would commit $200 million in tax increment funding annually beginning in 2020. Unlike former redevelopment, state approval is required for any investment, ensuring these investments are maximized. SB 5 would create up to 86,000 new and rehabilitated housing units over the next 10 years, targeting extremely lowincome families particularly vulnerable to homelessness. The bill also contains strong accountability provisions and state oversight. There is no single or easy solution to address homelessness, but building more affordable housing is a major part of the answer. That is why the league strongly supports Newsom’s budget proposals, which provide more resources, and SB 5 to help support the construction of more housing for low- and very low-income Californians.

From the moment Bader Lakhat’s wife, Masuma, opened her Kumon Center two years ago, he saw an impact on the community that he couldn’t ignore. In addition to watching business at the Kumon of Morgan Hill thrive, Bader observed the community’s enthusiasm in helping their children achieve academic independence and freedom—an opportunity that
may not have been present before. After working as an electrical engineer for three decades, Bader decided it was time to bring that opportunity to another local town and join his wife as a Kumon franchisee. Today, he is the proud owner of Kumon Math and Reading Center of Gilroy. “By opening this center to develop children to become better learners, I hope to enable them to teach themselves new concepts,” said Lakhat. “After seeing such great progress at my wife’s Kumon Center, I’m looking forward to having the same positive impact in Gilroy.” Kumon is a national firm that
focuses on achieving academic independence for children by instilling principles of self-learning, critical thinking and time management. Students that participate in Kumon often study years beyond their grade level and develop academic freedom With approximately four million students enrolled at nearly 25,000 centers worldwide, a Kuman statement said the company believes there are many opportunities to expand Kumon into new communities. Kumon is an after-school math and reading enrichment program that serves children in preschool through high school.
Morgan Hill Unified School District will live off a $93.8 million operating budget for the 2019-20 school year, with a total budget for all funds of about $145 million for all funds. General fund revenues for the upcoming year are about $93.6 million and expenditures are about $93.8 million, which is slightly more than the 2018-19 year, according to the adopted budget summary presented by district staff to the board of education at its June 18 meeting. Morgan Hill Unified’s budget qualifies for more than $79 million through the state’s Local Control Funding Formula, which allocates funds to school districts. The rest is made up from federal, other state and local revenues. As for 2019-20 expenditures, certificated salaries total about $38.7 million; classified salaries total about $14.5 million; and employee benefits cost about $21.2 million, according to the staff report. The average daily attendance allotment per pupil is at $7,910.79 for the 2019-20 year, according to the district report.
Along with the budget, the board also was asked to approve the district’s Local Control Accountability Plan, which outlines “the goals, services and spending plan that addresses the needs of all pupils and each significant subgroup of the district.” The LCAP is a three-year plan based on eight state and local priorities: basic conditions of learning; implementation of Common Core State Standards; parental involvement; student achievement; student engagement; school climate course access; and other student outcomes. The board was scheduled to vote on the budget June 18 after the Times’ print deadline.
District hires new head of Ed. Services
Pilar Vasquez-Vialva was introduced as MHUSD’s new assistant superintendent of education services at the June 19 board meeting. Vasquez-Vialva replaces Ramon Zavala, who announced his retirement at the end of the 2018-2019 school year. Vasquez-Vialva’s annual base salary is $184,976, with a $1,500 stipend for a master’s degree, according to the contract. The new agreement is for July 1, 2019 through June 30, 2022. Annual salary increases of 3 percent will push the base pay to $201,629 by Vasquez-Vialva’s fourth year of employment.

Gavilan College seeks 1967 alumni 100TH GALA CELEBRATION IN SEPTEMBER Scott Forstner Reporter

Gavilan College is digging deep into its roots for the upcoming 100th Centennial Gala celebration and wants to honor its Class of 1967, the last graduating class from when the community college was located in Hollister. “It’s proven extremely difficult to locate alumni as there isn’t a database with their names,” said Gavilan Joint Community College District Trustee Irma Gonzalez, who did find an old program from the 1967 commencement. “We’re hoping that perhaps someone will recognize a name of a relative or a friend and contact us.” In that 1967 class, there were 149 graduates listed on the program, with 87 earning an associate in arts degree, 29 an associate in science degree, 12 a certificate in aviation, 11 a certificate in business, and five in each cosmetology and drafting. Gonzalez, who was elected to the Gavilan board in November 2018, and her husband are both Gavilan alumni; he served on the Gavilan Student Senate during his time there. Gonzalez’s brother-in-law Raul Gonzalez was the last Associated Student Body president at Gavilan’s Hollister campus. “It’s been a long road making contact with our alumni, many who are unaware of our Gala,” said Gonzalez, who can be reached at igonzalez@gavilan. edu. The “Gavilan Through The Decades” Gala event, set for 5:30-9pm Sept. 7 at the 5055 Santa Teresa Blvd. campus in Gilroy, will allow attendees to look back at its first 100 years. Gala guests will take a
nostalgic and informative stroll through the decades of Gavilan’s history from the 1920s to today. Each decade will feature areas of academia highlighted with education tables, as well as food stations with themed food from each decade, wine stations, live music, photo booths, students in period costume, formal portraits, live auction, silent auction, strolling card magician in a tuxedo and a string quartet. “We are really looking forward to this celebration, and look forward to welcoming the community to campus for the party of the century,” said Gavilan President Kathleen Rose. Faculty member Leah Halper found and interviewed some of the early alumni, including Muriel Brem and Norma Trevino, but Gavilan is looking for more, and for artifacts (photos, class schedules, publications) from San Benito Junior College. Alumni are invited to submit information, memories, and stories at gavilan.edu/about/foundation/your-galivan-collegeexperience.php. Alumni stories will be showcased at the Centennial Gala on Sept. 7. Gavilan College was originally established in 1919 as San Benito County Junior College and operated under that title until 1963, when a new community college district was drawn that included both San Benito and southern Santa Clara Counties. A successful 1966 bond measure then funded the construction of the present main campus in Gilroy. In the spring of 1997, instructional sites were added in Hollister and Morgan Hill. Most recently, Gavilan opened its Coyote campus on Bailey Road, home to the public safety training academy and other programs such as Drone Technology.

Bill aims to address housing crisis ➝ Housing, 1
The bill's introduction was the majority party’s response to Democratic Gov. Gavin Newsom’s call in his February State of the State address for municipalities to build more affordable housing options. However, city officials in Morgan Hill worry that the Housing Crisis Act as written would cause a strain on infrastructure and put an end to years of community planning, including local voter-approved Measure S growth control restrictions. SB 330 began as a senate bill in the California Senate and has now moved to the State Assembly. There have been amendments made to the bill in the assembly, so if it’s passed in the assembly it will go back to the senate for another vote. Mayor Rich Constantine sent a letter on behalf of the city to Skinner along with copies to the Assemblymember for the 30th
District, Robert Rivas and District 17 State Sen. Bill Monning. “Morgan Hill is committed to quality marketrate and affordable housing and believes that the general concepts in the bill are worthy, although under the proposed legislation, the city would no longer be able to enforce its voter-approved growth control measure. This very measure is responsible for achieving one of every eight units in town, as permanent deed-restricted housing. Unlimited growth in Morgan Hill, which is still a developing city, places a great strain on the City’s infrastructure,” read the letter. “While we recognize the need to produce housing more quickly than what may be allowed under our current residential development control system, we are concerned about maintaining even minimal public health and safety standards if our regulatory authority (and

funds to finance infrastructure improvements) is reduced," Constantine's letter continued. "As such, the city must find a way to finance an expansion to its sewer plant to support growth. This is a $60 million project, which becomes even more difficult to fund with restrictions placed on fees.” The city is currently operating under a 2017 sewer master plan, which calls for major improvements to Morgan Hill’s sewage lines, a majority of which would be paid for by
development impact fees. The city’s growth control measure—known as Measure S—was passed with 77 percent of the vote back in 2016 and extended Morgan Hill’s Residential Development Control System to 2035. Measure S establishes an annual maximum of 215 housing allotments, and allows the council to set that number even lower at the beginning of each year’s competition for allotments. The city has enforced similar growth control ordinances in its efforts to keep
Morgan Hill’s population manageable since the 1970s. Monning has expressed his support for Skinner's bill, while Rivas said he has not yet made up his mind. The assembly committee hearings on the Housing Crisis Act of 2019 were scheduled for June 19 and July 10. If the committees endorse the bill on July 10, there will be a floor vote on Aug. 11. If the bill is passed through the assembly, then the amended version will go back to the senate for another vote. The bill is currently in the assembly’s Housing and Community Development Committee and is then scheduled to go to the Local Government Committee. In an emailed statement Monning told the Times, “While I appreciate and respect the City of Morgan Hill’s opposition to Senator Skinner’s Senate Bill (SB) 330, I joined with the region’s legislative delegation in supporting the bill because the state is in the midst of a historic
housing crisis. Low- and middle-income families throughout California are not able to find affordable housing, and SB 330 is a proposal that will remove barriers to constructing housing stock we so desperately need.” Rivas said he’s listening to constituent concerns when it comes to the bill, and said he is set to review it in the Local Government Committee of the Assembly. In a press release from Skinner’s office, Skinner said the bill is necessary. “California’s housing crisis has reached historic levels. The state ranks 49th in the nation when it comes to housing units per capita, and the housing crisis is estimated to cost the state $140 billion a year in lost economic output,” Sen. Skinner said. “The acute shortage of housing also has sent prices skyrocketing, displacing residents from their homes and deepening the state’s poverty and homelessness crises.”

Davis learned a lot in just one season of community college football, things that will help him at Redlands. For one, when given a chance to play, you better be productive. “Our running game had a system, it worked and we all understood that whoever got going early was going to stay in and finish the game,” he said. “You learn at the JC level things are a little different (and more competitive than high school). It’s still a team sport, but you have to fight for yourself to get playing time and touches. You have to earn that or otherwise you won’t get in. You have to be a little selfish, but at the same time find that balance of helping the team win while doing that.” When Davis made up his mind he was going to play community college football, it was on a one-year trial basis. “I wanted to figure out if I was going to like it playing in college, and as soon as the season started I knew I wanted to do one year and transfer,” he said. “I wanted to get in there and learn how

When Cole Davis was in his senior year at Live Oak High, he was in a similar position to literally hundreds of thousands of accomplished high school football players throughout the nation: without a scholarship offer from a four-year program. Davis, who carried a 3.7 GPA at Live Oak, could’ve said goodbye to football and start working toward his future goal, whatever that may be. However, Davis knew he was good enough—and more important, motivated—to get another opportunity to show he was a four-year college player. His hunch was correct, as Davis has signed a letter of intent to play for University of Redlands after a terrific freshman season at Cabrillo College. “I think the whole (recruiting) process was a great experience, and I’m happy with the decision I made,” he said. “I’m not too far away from home, and Redlands wins a lot, and I want to win a championship. It seemed like the place for be, and they recruited me pretty hard.” As did Arizona Christian University, which made Davis’ decision rather agonizing at times. Davis admitted he went back and forth, knowing he really couldn’t go wrong with either selection. Ultimately, the chance to stay relatively close to family was one of the decisive factors in Davis choosing Redlands. Davis cherishes family time, and during the 2018 football season Davis stayed at a cousin’s place in Aptos, so he didn’t have to
commute back and forth each day from Morgan Hill. Davis’ lone season at Cabrillo couldn’t have gone any better. On a team filled with plenty of talented playmakers, the 5-foot11, 185-pound Davis led the team in rushing with 663 yards, averaging a whopping 7.0-yards per carry. Davis’ most spectacular game performance came in the penultimate game of the season, a 30-20 win over Merced in which he rushed for 116 yards on just seven carries, including a 64-yard touchdown run. “That run was pretty crazy,” said Davis, who helped lead Cabrillo to a 7-3 record. “Our linemen were really great and opened up a hole, I was able to hit it and the DBs were too slow to catch me. … It was a good season. I don’t think Cabrillo had gone 7-3 since 1998 or something, we had great receivers, a couple of D1 bounce backs.”

I learned how hard it would be, and I hit the weights and got faster and better and showed it on the field.” Davis did just that, and he was able to put together impressive highlight video clips of him possessing speed combined with the ability to run between the tackles and hold his own physically. Since Davis already had the grades, he could transfer after just one season instead of the typical two years most players
in the community college level complete before transferring. Davis actually signed in midMay, so he was still on a high as he talked with a reporter from the Times last week. In addition to off-seaosn training, Davis has also been working at the San Jose Police Academy. “I help cadets get into the program so when they do scenarios, I’m one of the role players,” Davis said. “I like it a lot, and I think I might end up going into the academy and becoming an officer one day.”

JOSEPH “GENE” BOURDET NOVEMBER 24, 1922 – MAY 31, 2019
G
ene Bourdet, a native son of Hollister, died of natural causes on Friday, May 31st, at Sutter Memorial Hospital in Roseville, CA. Born November 24, 1922, Gene grew up on Southside with brother Len and sister Janis. The family moved into town during Gene’s high school years where he made all league in both baseball and football. Gene attended junior college in Salinas for a short time before going to Oakland to work in the shipyards. In 1943 he was drafted into the military and was sent to Bozeman, MT for training. There he met his future wife, Eileen Olson. After the war, Gene returned to Bozeman, married Eileen, and finished his education at Montana State College while playing quarterback for the Bobcats. At this time, he and Eileen began a “team” of their own (5 children over the next 13 years). His career included coaching at the high school level in both Fairfield, MT and Livingston, MT followed by a return to his alma mater in Bozeman. There he assisted in coaching both track and football. In 1958, he was appointed athletic director and head of the department for health and physical education. In 1970, Gene moved back to California where he served as athletic director for the Fresno State Bulldogs (1971-1978) and then as athletic director for the San Diego Aztecs (19791983). A heart attack in 1982 prompted Gene to eventually leave athletics. He (with Eileen) made the full circle back to Hollister in 1985 where he worked for his childhood friend, Sonny Paullus, in his real estate company at Ridgemark. For the next 30 years (Eileen passed away in 2008) they enjoyed living near sister Janis Rose and nephew David Grimes (wife Colleen) in the close knit community of Gene’s hometown. As his health declined the difficult decision was made in2015 to move to the Roseville area and live with family. Gene was a Rotarian for 48 years and a faithful member of the Immaculate Conception Church. He will be greatly missed. A service will be held at 10:30 AM on July 2nd at the Immaculate Conception Church in Tres Pinos, CA. Military honors and a reception will follow.
