AGRICULTURAL FINANCING by
A rough guess about readership demographic would have to put a majority with more than a passing interest in large tracts of land. Purposes, or dreams, for this land likely range from agriculture to conservation to timber to recreation and beyond. One of the first steps in purchasing property the size of a county includes arranging financing, and one of the best options for loans on land sometimes gets missed. Nearly 100 years ago the federal government set up a credit system to stabilize the finances of farmers, ranchers and timber stand owners. The remnants, though only loosely associated with the U.S. government, remain today one of the best options for land loans. These mortgages, now managed by a cooperative called the Farm Credit System, work for people intending to use their property for a surprising variety of uses. Because mutual trust builds a foundation for all manner of agreement, virtually every bank everywhere promises in its ad copy to build personal relationships with customers. However, how many of us can say that our experience with financial institutions has been truly personal?

says he knew exactly whom to recommend when Stewart began to get serious about the purchase. Lowe introduced Stewart and Golden, and they, “hit it right off.” It helps, says Lowe, that Golden is a rancher herself. Because one of Stewart’s goals is to smooth the eventual and inevitable change of ownership to his heirs, he had already formed a plan when he came to Lone Star. Golden waxes equally complimentary when she describes the deal. Golden says Stewart knew what he wanted from the first. She says, “He had it all lined out.” Stewart says Golden customized a loan for his family and reduced closing costs by more than eight thousand dollars. Lowe says she made sure the rates were competitive, even “under market.”
WHY AN AG BANK? All borrowers, especially ones with cash and excellent credit like Stewart, have choices these days. Most people who buy property in the U.S. use conventional banks or credit unions. And though conventional banks have plenty of customers in rural areas, too, Golden contends that her brand of banking could work for many who may not know the option exists. People who don’t automatically think of themselves as farmers or ranchers can find fiscal advantages at a bank that deals exclusively with land, whether
One story of a successful financial deal originates in Paris, Texas, and all parties say that one person in particular made all the difference. Paris is home to a Lone Star Ag Credit branch, part of the vast system of lending for rural landowners known as the Farm Credit system. When businessman Wayne Stewart found land he wanted to use in the creation of a legacy for his descendants, Lone Star Ag Credit seemed an obvious choice, in large part because of the attention Golden contends that her brand of banking could work for Credit Office President Barbara Golden devoted to many who may not know the option exists. Stewart and his family. During his varied and engaging career heading high technology and defense contractor companies, Stewart had bought his share of property. “Eight houses all over the U.S.” and an earlier purchase of a recreational parcel represented plenty of real estate closings. When he settled on the timber, wildlife, and pond-imbued 369 acres between the Red River and Paris as a legacy for his children and grandchildren, Stewart says Lone Star Ag Credit made this paper-signing the easiest ever. Golden “went out of her way to make the process simple and easy,” says Stewart. The seller’s real-estate representative, Rusty Lowe, works for Century 21 Harvey Properties. He has worked with Lone Star for many years and Lowe

the property is strictly agricultural, potentially agricultural or recreational. Although many people buying land, “may not put themselves in an ag role,” says Golden, the Farm Credit system may have a product that would benefit the buyer. Lowe agrees that when a customer buys land, borrowing from a local ag bank makes good sense. They know the business, says Lowe. Most banks “are familiar with quarter-acre lots and blocks,” he explains, an ag bank knows and “is comfortable with the value of land. He adds, “Land is not a foreign product to Farm Credit-affiliated banks.”

Because the Farm Credit system is essentially a cooperative, one of the benefits that appealed to Stewart is an annual dividend. This rebate — known as patronage — can reduce a loan payment by as much as a percentage point, says Golden. The patronage changes according to the success of the bank as a whole, says Golden, and the last few years have been “just great,” possibly indicating a growing interest in land and ranching, especially in Lone Star Ag Credit’s coverage area. That reach extends to 48 of the 254 counties in Texas, from the Red River to Arkansas, and west to Waco, according to Golden. She says, Lone Star can offer loans to customers who live in their jurisdiction, regardless of where the property is, or are buying property there, no matter where they live. LIKE FAMILY Both Lowe and Stewart credit Barbara Golden with the success of this purchase and sale. Golden demurs and says it is all part of living in a small town where everyone knows each other. Paris, population 25,000, sits at the center of Lamar County and hosts the county business and most of the commerce. “Paris is the hub,” she says. “There are only a handful of high schools in the whole county … and we all go to the same grocery stores.” Golden says even a wrong phone number can end up in a visit with someone you know.
Because Stewart wanted this land for his descendants, the conversation had to include estate planning as well as a simple sale. Golden says doing her job sometimes means that people have to share details of their lives with her when they have barely been introduced. They begin their relationship “sharing very personal information … with a complete stranger.” She describes her manner as familial. Because the community is so close-knit, she says, “We treat customers kind of like “We treat customers kind of like family, family, that’s what we do well.” that’s what we do well.”
Developed in 1916 by the federal government to offer farmers a stable credit system, the Farm Credit cooperative is now owned entirely by borrowers and investors, and the historic connection to the Federal Reserve gives the system even more gravitas.
Stewart describes Golden’s work on what will become the Stewart Generations Ranch with gratitude. “I hope you can convey my thanks to Barbara,” he says. With five grandchildren aged 5-12, Stewart plans to “train them up in the outdoors, hunting, and fishing” on this land. Lone Star Ag Credit’s shareholders, fellow borrowers, and Barbara Golden’s instincts and kindness helped make that plan a reality.

While doing so, he meets singer Jeanne Starr, played by the stunning Alexis Smith. Some guys have all the luck. In the gets the girl. movie, Clay gets the bad guys, gets his cattle back
The larger point is that Clay Hardin accomplished his goal of getting his cattle back and at the same time he also got the girl. To make this relevant to real estate, you could say that Jeanne Starr was “value added” to the transaction of getting the cattle back and that's what we will discuss in our conversation. It’s no different when buying or selling land, ranches and farms. You have to bring more to the table to benefit your clients, and we call that “value added.” For example, let’s say you want to buy cropland. Selling a property because of the federal estate tax? If you’re looking for recreational properties, restoration properties or investment properties, is full of great brokers who can bring “value added” to your real estate transaction. One “value added” opportunity that doesn't receive enough attention in a real estate transaction is what strategies are available to defer, reduce and/or eliminate taxes associated with the buying or selling of a property. Well, it’s a good thing that I’m here. Many of the farm and ranch brokers that we work with understand the “value added” brought to a transaction through these tax deferral strategies and when looking for a competent farm or ranch broker, it’s not a bad idea to find a broker who understands these strategies. It could be costly not to. Let’s take a look at some key tax deferral strategies any broker can use when buying/selling property on behalf of his/her clients. A 1031 exchange is widely recognized as the most popular tax deferral opportunity in real estate, but even a 1031 has its pitfalls. In simple terms, using Section 1031, a property owner can sell an investment property and buy another investment property of equal or greater value and not have to pay capital gains tax on the transaction if all of the requirements of Section 1031 are followed. Even then, there could be problems. Here are three of the pitfalls we deal with constantly.
