Open Fences Best of 2011 Making the 2011 rounds at the usual set of horse shows, classics and events around the country, Open Fences added several stops to its networking roster. The year began with buyer education events at the Holland & Holland Gun Room in New York City and at Griffin & Howe, firearm manufacturers, in Greenwich, Connecticut. Summer was further distinguished by attendance at the EPIC Game Fair in Atlanta, Georgia and the Country Land and Business Association’s (CLA) Game Fair at Blenheim Palace in Oxfordshire, England. Over the course of travel, several goods and services around the country kept showing up on the radar and so in spirit of the“Best of 2011,”we decided to write a send up to a few favorites goods and services recommended for discerning purveyors of fine living, good horses and time honored craftsmanship.

RICHARD CASTELOW www.richardcastelow.com Richard Castelow’s road to becoming a Master Saddler could easily be chronicled on the silver screen. He joined the Household Cavalry Mounted Regiment at age fifteen and by the age of twenty, was selected to join the Household Cavalry Saddle shop in Knightsbridge, London. After rigorous teaching and training under four different master saddlers, undergoing a sum total process similar in scope to gaining a PhD, Castelow was certified a Master Saddler in 1988. Quickly gaining an outstanding reputation, he was appointed as the first ever Master Saddler to Queen Elizabeth II, based at the Royal Mews, Buckingham Palace. After four years with the Royal Household, Castelow moved to the United States to use his knowledge and expertise for the benefit of American riders:“What I’ve done is I’ve taken the unique parts of French and German saddles to create an American saddle that is unique to the American market,” comments Castelow. Why bamboo?
Lebeau-Courally is one of Belgium’s oldest small gun making firms, founded 1865 in Liege, Belgium by partners Auguste Lebeau and Ferdinand Courally. The firm only produces approximately 25 guns and rifles a year. Each firearm is manufactured one at a time, completely by hand and according to client specifications, using traditional methods and the highest standards.
In the mid 1800’s the hexagonal bamboo fly rod was developed and popularized by eastern anglers of the fledgling United States. The simple, sturdy construction of varnished bamboo creates a rod that is a true lifetime investment. Riley) work focuses on impressions of both animal and human forms. “I like to call my work narrative portraiture, because my work is always of an individual, a personality—whether it comes in a human or animal form.”Her goal is to capture the essence of a moment. Her talent lies in the ability to reveal a personality, an individual or a portrait within the lines of a sculpture. David Light had the chance to spend time with Maureen in Atlanta this past summer and commented,“We had a great time…I love how her sculptures seem to have movement. She has a true gift.” As a child, Riley learned the sporting life from her granddad and sculpture from his best friend Walter Midener. She states, “I have little interest in putting out slick shiny, pieces; rather, I let my energy be revealed in the surfaces.”Her work is included in many private collections internationally and she has had exhibitions throughout the United States and in Europe including, the Safari Club, the Smithsonian Institute and international exhibitions in both Milan and Portofino, Italy.

THE ENVIRONMENT & THE 2012 ELECTION It is safe to say that few Americans are looking forward with anticipation
to the coming Presidential election season. If 2012 copies 2011, the contest will be expensive, extended, controversial and down-right nasty. Most people wish they had a magical TV clicker and could fast forward to November 7, 2012, the day after the election, right now. No such providential solution is possible, however. We all are pre-destined to endure a savage political contest certain to be as nasty as any this country ever has endured, and this country has endured a number of epic presidential contests lacking in civil discourse and reasoned discussion of major issues of vital national importance. So far it appears 2012 will rival the worst of its predecessors in nastiness and lack of logical debate. Political paralysis in Washington, D.C. in the year leading up to any presidential election, here 2012, happens each time without fail. In the present circumstances, almost uniquely, there already has been one year of political paralysis, 2011. The Executive and Legislative fracas known as the budget reconciliation and reduction exercise has been such a failure as to tarnish everyone, Republicans and Democrats alike, involved in any major way. As a result, the pre-election governmental paralysis already is well under way. Rarely has the legislative process been as deadlocked as it is now. Whichever party gains ascendancy next November, the proverbial light at the end of the tunnel is faint at best and far, far away distance-wise.

The environment itself finds itself firmly ensconced in this potentially lethal quicksand. Twenty or thirty other policy areas, domestic and international, are equally as dysfunctional, but the Environment will serve readily as a poster child for politically induced dysfunction now gripping our entire nation. Let us take five such major examples; global warming; fossil fuels; alternative energy solutions; nuclear power; and water-related challenges. When the definitive political history of the environment finally is written, 2011 will be cited as the year in which the solid phalanx of Democratic Party support for rigid regulation of this planet’s natural resources finally shattered. Why? Democrats in both houses looked at the polls and abandoned Obama in droves, especially on environmental issues. The White House heard loud and clear. Its response was to undercut its favorite enforcement tool, the Environmental Protection Agency, especially as to its corporate whipping tool, strict smog regulations. “Not until after the election”was the message that alarmed the EPA and Obama’s liberal, ideological base. For now, at least, Carbon Emission Targets were to be shown a seat at the back of the room. Immediately after upsetting his followers, Obama as often was his wont, scurried back to the center on the question of shale oil.Years of negotiations with Canada to establish a pipeline from its north through central United Volume 2 . Number 4
States to the Gulf of Mexico finally was ready to be signed. When added to recent discoveries of huge domestic crude oil deposits in the Dakotas, the outlooks for domestic oil production never have appeared rosier. Then, out of the blue, Obama listened to his smog decision enraged liberal supporters and refused to sign the treaty with Canada, observing archly that it needed more study, say until 2013. Canada shrugged and immediately opened negotiations with China. Our loss!

The German plan to end nuclear power usage over the next decade and the move toward the same in France speak to the opposite, as do the summer tornados, wildfires and earthquakes, including symbolically $25 million or so earthquake-related damage to the National Cathedral in Washington D.C., speak to the opposite. In late November 2011, still another 5.9 on the Richter scale earthquake was registered in the Fukushima area, this time without further damage.
With the oil supply question so clouded and the European economies and the Middle East political situation becoming more ominous day by day, it would seem, searches for acceptable domestic energy solutions intensified and narrowed. The three leading alternatives at present are wind, solar and natural gas “fracking”. Each has been acclaimed as a potential saviour. Nevertheless at least up until now, each one has displayed big feet of clay. Regulators are placing substantial roadblocks to the use of wind turbines offshore, especially in Nantucket Sound. China, India and Western Europe are undercutting costs, crippling US solar production. The emerging Solyndra scandal involving many Obama supporters will freeze US government R&D as to solar. Finally, the debate surrounding the safety of the "fracking" method of natural gas production remains— especially as to methane content affecting drinking water supplies.
When we consider that more than 300 million people drink water in this country every day, it is remarkable how far we have come so far in the 163 years since the first drinking water conduit was placed underground in Boston, Massachusetts by its Water Department in 1848. In addition there is a nascent movement among conservationist to ban fluoride in drinking water. Finally and most depressingly, China is showing signs of making progress in desalinization, still one more area of technical progress where the United States used to be the world technological leader. Here, as much as anywhere, is the result when successive administrations have not enacted a comprehensive energy policy. Every which way 2012 is certain to be a rough, rough year.

Don’t Cash Out When Selling Your Property.
There May Be A Better Option.
By David Fisher When selling a property, there are 4 traditional ways to receive the proceeds. They are to cash out, a 1031 exchange, owner financing and an installment sale. Each may have its appropriate situation but all 4 options have potential pitfalls. For example, when cashing out on a property, taxes must be paid almost immediately. Those taxes can include the capital gains tax, state taxes where applicable and the possibility of depreciation recapture. In addition, showing a large capital gain might trigger the alternative minimum tax on a federal return and with the growing desperation of government at all levels to find ways to increase taxation, there could be other kinds of taxation down the road. Taxes could remove anywhere from roughly 15% to 30-35% of the proceeds and reduce the opportunity to generate a nice return on the hard work and sacrifices made to create those proceeds. A 1031 exchange is another option when selling property but there are pitfalls in an exchange as well. An appropriate replacement property may not be identified in 45 days or a loan may not be approved which would cause the exchange to fail. If that occurs, the failed exchange becomes immediately taxable and the seller now has the problems mentioned above when cashing out. Another option when selling a property is to participate in owner financing. Owner financing provides an income stream for the seller for a predetermined number of years. However, at some point, the buyer may decide to pay off the property earlier and that may create the loss of the future cash flow as well as a taxable event sooner than the seller had planned. An installment sale also provides pitfalls because the new owner may have a change in circumstances

during the installment period and may decide/be forced to give back the property. Then the seller has to start the selling process again to resell the property and it may be necessary to make costly improvements to the returned property. As we all know, recent health care legislation has mandated the hiring of 16,000 new IRS agents. When one of those agents comes knocking on your door, it will not be to take you to lunch. It will be to take you to the cleaners so it is incumbent upon each of us to take whatever actions we can to protect our assets from erosion caused by taxation at various levels of government. All 4 of the selling options can result in immediate taxation but there is a 5th option that may be the answer to deferring taxation on a long term basis without being caught in the quicksand of the Internal Revenue Code. Once you’re caught in the quicksand, you’re not getting out. Unless your name is Frank Wallingham and you’re following The Hallelujah Trail. That 5th option is the Deferred Sales Trust. The Deferred Sales Trust (DST) is a great opportunity that can enhance all of the options a seller has to receive proceeds. The DST is a legal entity that allows the seller to defer capital gains and other taxation on the sale of highly appreciated real estate for as long as the seller would like. Basically, the DST is an installment sale contract with an intermediary with the additional feature of freeing up funds for the benefit of the client and all investments in the trust are client driven. Real estate properties can include land, ranches, farms, investment Volume 2 . Number 4
properties, commercial properties, a primary residence or a vacation home. Crops, livestock, timber or a business can also be sold in the trust. Here is how the DST can elevate the other 4 options when the owner sells his property. First, instead of cashing out and paying 15%-30% immediately in taxes, defer those taxes by using the DST. The proceeds can still be invested within the trust in the same manner that the seller would have invested outside the trust. However because the taxes are deferred, the seller is able to leverage the entire amount of proceeds to provide a larger cash flow from the trust. For example, $1,000,000 of proceeds in the trust invested @ 6% generates a $60,000 a year in taxable income. After tax proceeds of $800,000 invested outside the trust invested @ 6% generates $48,000 a year in taxable income. Why wouldn’t someone want to invest using the trust rather than cashing out? The next option is a 1031 and as many are painfully aware, not all exchanges are completed for some of the reasons given above and that causes an immediate taxable event. A top notch qualified intermediary can provide the proper wording to the client that will allow the QI to send proceeds to the DST should for whatever reason, the exchange cannot be completed. Thus, the DST provides a Plan B and since the seller does not have constructive receipt of the proceeds, they are not immediately taxable. But it gets better. The seller still has the opportunity to buy more real estate. Because there is no longer an exchange, the seller no longer has to jump through the IRC 1031 regulations and can now buy whatever property he would like whenever he likes. But it could get even better. When looking for financing, the proceeds in the trust might be used as collateral rather than the new property which might encourage the lender to give you a better interest rate. So, let’s assume that the trust generates a 6% return and the interest rate on the loan is 4%. The income from the trust should be more than enough to service the debt service on the new property AND the trust owner still receives 2% from the trust. Everyone wins except for our favorite Uncle…Sam. As far as owner financing and an installment sale is concerned, the DST solves the concerns associated with both and is probably a better alternative in almost every case. The only time that a DST probably would not work with an installment sale or owner financing is if the buyer doesn’t have the ability to buy the property outright. The late Winston Churchill once said“I like pigs. Dogs look up to us. Cats look down at us. Pigs treat us as equals.”That has nothing to do with a deferred sales trust. I just happen to like the quote but his next quote does. He said “To build may have to be the slow and laborious task of years. To destroy can be the thoughtless act of a single day.”There are numerous opportunities to use a Deferred Sales Trust to enhance a property owner’s circumstances and avoid that thoughtless destructive act of not deferring certain taxes when possible. Consider this. A couple has owned a property for a number of years and would now like to sell their property and move several hundred miles to be close to the grandkids. In this case a 1031 is not appropriate and to make matters worse, their CPA has determined that there will be $500,000 in taxes which is giving the couple second thoughts. Enter the DST. The DST allows the sale to be made, proceeds to forwarded to the trust, no constructive receipt to the couple, all capital gains, state taxes and depreciation recapture deferred to a later date, investments made OpenFences.com
inside the trust to generate a larger income flow AND the couple can now make the move to be close to the grandkids and take revenge on their kids by spoiling the grandkids endlessly. In another example, if you want to consider a 1031 exchange but are concerned about finding a replacement property, the DST can provide a Plan B and remove the problem of jumping through all of the IRS obstacles in having a successful exchange. Another problem created by the past downturn in the real estate market is that many property owners now find themselves owning a property with high debt and little basis. Consider the example of a property with a $5 million offer to the owner but with a debt of $4 million and little basis in the property. The owner would like to sell but in doing so, all the proceeds from the sale would go to eliminating the $4 million in debt, paying $1 million in taxes and that doesn’t include realtor commissions and any other applicable fees. The DST can be introduced into the situation and by doing so, can allow the property owner to sell the property, defer taxes and maintain a much more favorable financial situation for himself and his family. There are countless other opportunities afforded by the use of the Deferred Sales Trust but consider this one final thought. There is a wonderful trait found in most successful landowners and that is their desire to give back. This giving quite often will include the gift of land in a will. In many cases such as a land trust or nonprofit dealing with land, the gift of land will stay intact when the organization receives the gift. However in many cases, once the gift of land is received by the nonprofit, it will be sold for

cash. Consider the advantage of using the DST in a charitable situation where property will be given in a will where the property is going to be sold immediately. If I said the following, would you be interested. “Mr. Client, if I can show you how both you and the charity will be better off if you sell the property now rather than waiting until you die to give the property to charity would you be interested in discussing the idea?”The DST creates a win-win for everyone and not only will the gift be larger because the charity will usually discount the property value for a quick sale when received from the will but you will also be able to guarantee the value gift regardless of what the future economy brings. A famous Hollywood actor once said, “I’m proud to be paying taxes in the United States. The only thing is-I could be just as proud for half the money.”All he had to do was call me.
