The objective of the project is to include the IPs and Muslims in the Civil Registration System, thereby including them in the privileges that complement those who are registered. It was a humble contribution and vehicle in instituting change that could propel them towards the mainstream of Philippine society, while at the

ARCHE of Mindanao Daily News DAVAO City––With at least six months to go before the midterm elections in May, the Commission on Elections (Comelec) in Davao Region is now in the process of reviewing whether Davao del Sur province should be placed under the agency’s watch. During the recent Kapehan sa Dabaw at SM CityDavao, Comelec Assistant Regional Director and Lawyer Marlon Casquejo said the election in Davao del Sur has had a history of violence that should be reviewed. Casquejo said the Comelec can declare any area as under its control based on previous situations during elections upon recommendations from the Armed Forces of the Philippines (AFP). After which, Casquejo added a recommendation

his stand to protect and save Mt. Mayapay from threats of further destruction. According to Fortun, his opposition against a Congress bill several years ago to declare almost a half of Mt. Mayapay’s land area as alienable and disposable that could have opened it

to private ownership, still remains and “will always be my position.” Mt. Mayapay has an area of 18,642 hectares with an elevation of 675 meters (2,214 feet) above sea level, The lush greenery, rich forests and mini-watershed areas of this huge mountain

had deteriorated because of slash-and-burn farming, firewood gathering and quarrying. The city government in coordination with regional line agencies, non-government organizations and civic groups has launched tree-planting and reforesta-

tion campaigns to protect and save Mt. Mayapay from further denudation and damage. As the measure was approved in the House of Representatives, Fortun, as city councilor, did not waver but continued with his fight against the proposed

law. He gathered signatures expressing opposition to the bill and sought the Senate to defer action on it. Fortun, who has been a strong advocate for environmental protection, said his commitment is not only for the present but future generations as well.

BSP power to close (and open) banks is exclusive ONLY the Bangko Sentral ng Pilipinas (BSP) has the authority to decide whether or not a bank should be closed. This fact was reinforced in a recent decision issued by the Court of Appeals (CA), granting the BSP’s petition for review against an order of Davao City Regional Trial Court Judge Jaime Quitain. Judge Quitain had issued a stay order in 2006 preventing the Philippine Deposit Insurance Corporation (PDIC), by the authority of the BSP Monetary Board, from liquidating the assets of the closed All AsiaBank Corporation Inc. (AsiaBank). The BSP Monetary Board had ordered the closure of AsiaBank in 2002 and placed it under the receivership of the PDIC. PDIC subsequently submitted its recommendation to the Monetary Board to liquidate the AsiaBank after the bank’s principals repeatedly failed to submit a viable rehabili-

tation plan. In 2006, a group of depositors filed a petition for corporate rehabilitation before the Davao City RTC Branch 10, presided by Judge Quitain. AsiaBank had then assumed a different “identity.” The gist of the depositors’ proposal before the Davao City RTC: “Having forfeited its license to operate as a bank, AsiaBank would carry on not anymore as a banking entity, but as an ordinary corporation with a minimum capitalization of P300 million.” When Judge Quitain issued the stay order against the bank’s liquidation, claiming that his court had acquired jurisdiction over the petition for rehabilitation, the BSP and the PDIC filed a petition for certiorari before the Court of Appeals. “ The main issue is: Whether the Regional Trial Court has jurisdiction over the petition for corporate POWER | page 9

THINK a minute. A hotel sign in Tokyo, Japan had this rule on it: “Is forbidden to steal towels please. If you are not person to do such is please not to read sign.” Someone said that rules are like a fence around us. We need them to keep us inside so we won’t break out and hurt ourselves or others. We have rules at home, at work, at school, in sports, and for driving on the road. And if we move to another country and culture, we must learn to follow their rules. Many p e ople t hink Christians are a group of people who just try to follow strict, boring rules that are old fashioned and definitely not cool! They think Christians

So they think being a Christian is like living inside a fence or prison wall that won’t let you out to have fun and enjoy life. But that’s not true Christianity! Jesus Christ Himself said He did not come to bring more rules to build a tighter fence around us so that we become prisoners. It’s just the opposite!

Jesus said He came to set people free, so we won’t need rules to keep us honest or force us to love and forgive others. Jesus isn’t nearly as interested in rules as He’s interested in YOU. He knows that if you’ll just let Him take full charge of your heart and character every day, He can start changing your life. Then you and I won’t be like children who need a lot of rules to tell us what and what not

to do. For example, if you truly love your neighbor, then you don’t need a rule to stop you from stealing from him, since you never steal from someone you really love and care about. When God the Son changes our heart and character inside, then everything we do comes from the new person we’re becoming. Jesus’ love and power starts to set us free from being a prisoner to our selfish greed and dishonesty. So won’t you ask Jesus to forgive you for your wrong, self-centered heart? Then ask Him to start changing you, so you can enjoy the success and freedom of having Jesus’ character and life yourself, which is so much more than rules. Just Think a Minute.

The press and politics THE problem most writers encounter, especially opinion writers, is that their ideas are sometimes misunderstood. It seems they are not free to express their minds. Critiques will always make colors on their ideas. For instance, critics often misread their political writings as biased and discriminatory. That is the price of freedom of expression. ‘You cannot please everybody,’ the saying goes. Cris Diaz Even enterprising reporters are victims of this insinuation, too. It is later found out that this practice of ‘getting the wrong impression’ about writers and reporters actually originated from politicians themselves. However, one could not totally blame politicians for adopting such dangerous behavior. We said dangerous since a misinform politician is often drawn toward roguish attitude in dealing with some members of the press. In Misamis Oriental, a top provincial official has the gall of discriminating members of the press, particularly radio reporters. At one time, a radio reporter, politely asked for an interview, complained of the nasty comments of the official toward the radio station he was

representing. ‘After what you radio station have done to me, I will not allow an interview with you,’ the provincial official said. Those who heard of the reporter’s plaint were shocked of the official’s comment. Do we have this kind of elective public officials in our midst? Whether the public official is serious, his comments are simply malicious and an affront to the people of the press. Why do we have to elect these public officials? If they discriminate and are uncomfortable to comments of the press, they do not deserve the office they represent. They should remember that their office is a public trust. In other words, even if they are criticized to the maximum, they should maintain their composure and be cooperative even to people they think are indifferent to their views and aspirations. As earlier said, this attitude is not the sole creation of the politicians. On the contrary, politicians adopt this attitude since people entrusted to project their public images are the ones laying this condition. In Misamis Oriental, provincial officials create virtual animosity with members of the press because of discrimination imposed by their public affairs on practicing members of the press. PNP tracks 500,000 ‘loose firearms’ to ensure peaceful 2013 elections THE Philippine National Police is now tracking down more than half-a-million “loose firearms” nationwide as part of the efforts to keep the 2013 midterm elections peaceful and orderly as ordered by President Benigno S. Aquino III. Chief. Insp. Nelson Bautista, chief of the PNP’s Firearms and Explosives Division’s Inspection and Enforcement Section, said that as of August 2012, there were 610,156 firearms whose licenses were not renewed by their owners.

Bautista said that a total of 1,592,435 firearms are presently registered at the FED. ”The day that the firearm license expires, it may be considered as loose firearm,” Bautista said. However, Bautista stressed that the FED is giving a six-month grace period for the owner to renew his/her firearm license to avoid being charged with illegal pos-

DENR to enforce one strike policy CAGAYAN DE ORO CITY - Newly assumed DENR 10 Regional Executive Director Ruth M. Tawantawan cautioned regional officials on the full implementation of the ‘One Strike’ policy of the department, against illegal logging. Director Tawantawan said the government is serious in implementing Executive Order No. 23 signed by President Benigno S. Aquino III declaring a moratorium on the cutting and harvesting of timber in the natural and residual forests, and creating the anti-illegal logging task force. Under the “One Strike” policy of Secretary Ramon J. P. Paje, field officials caught circumventing the law will be immediately relieved from their post and appropriate charges will be filed against them after further verification of their offense. “Let us observe transparency and integrity”, Director Tawantawan said. She exhorted DENR 10 officials and employees to have zero tolerance on graft and corrupt practices. At the same time she reminded officials of the “matuwid na daan” (straight path) in delivery of service to the public. She disclosed that Undersecretary Demetrio Ignacio of the Field Operations has given her instructions to implement in the region. These instructions were discussed by Director Tawantawan during her first meeting with regional officials on October 8. As part of the implementation of Executive Order No. 23, the DENR 10 will effectively manage wood processing plants and seal the entry of illegally forest products from

the Autonomous Region in Muslim Mindanao (ARMM) and Caraga region. The agency will strictly manage, monitor and control the ports particularly in the transport of forest products in closed vans. The participants of the meeting were composed of regional directors of the Environmental Management Bureau (EMB) and Mines and Geosciences Bureau (MGB), regional technical directors, provincial and community DENR Officers, regional division chiefs and other staffs. Director Tawantawan said massive reforestation should be undertaken to mitigate disaster in the region. She further instructed the officials to be pro-active and continue to coordinate and warn local government units (LGUs) regarding disaster prone areas. On the National Greening Program (NGP), DENR 10 will implement a no compromise of quantity and quality of seedlings. All Provincial and Community Environment and Natural Resources Officers were told to accomplish their respective targets before December this year. Moreover, the officials were directed to submit their 2011 NGP accomplishment under oath before the end of October 2012. Likewise, field implementers were directed to accomplish their targets on the Comprehensive Agrarian Reform Program (CARP) – Patent Processing and Issuance before November 15, 2012. DA-10 Regional Rice Program Coordinator Juliet B. Araos stresses that the projects under the Agri-Pinoy Rice Program is an investment of the government to the farmers, who are the main actors in the development of the agricultural sector as well as in the achievement of rice self-sufficiency after the year 2013.

DA holds investment forum on rice Cagayan de Oro City – WITH the promotion of agribusiness investment as one of its marching orders, the Agribusiness and Marketing Assistance Division of the Department of Agriculture – Regional Field Office 10 (DA-10) recently led the conduct of an investment forum for the country’s staple food – rice at De Luxe Hotel, in this city. In her report on the updates and status of the rice industry within Northern Mindanao, DA-10 Regional Rice Program Coordinator Juliet B. Araos informed that region 10 has been allocated with funds, amounting to P 245 million for the year 2013. This budget, she added, is much higher compared to the current year’s budget, reaching only P 135 million. As the agency has been given the directive for the attainment of rice self-sufficiency after the year 2013, RRPC Araos explained that the DA-10 through the AgriPinoy Rice Program has pipelined projects for the 2012-2013 period, under which interventions are geared towards reaching the said target. Majority of the projects under the Program, she detailed, has been apportioned to irrigation support with a P 65-million budget, covering small scale impounding project construction and rehabilitation, small farm reservoir construction, shallow tube well rehabilitation, earth embankment service and the Integrated Rice Production Enhancement Project (IRPEP). Bulk of the Program’s resources has also gone to assistance in terms of farm mechanization and other infrastructure and postharvest facilities. Other slated projects include production support, market development, extension and training services, research and development, regulatory services and planning,

policy and advocacy program. With the numerous support that rice stakeholders can avail from the Program, RRPC Araos urged the participants, especially the ones working closely with the grassroots to facilitate the latter’s request. In particular, she noted, that the assistance that farmers should seek from the department must be viable in their respective

areas, so as to maximize the agency’s funds. Through the meeting, it was also learned that there are various windows of opportunity for rice such as research and technology, value-adding activities, market prospects, investments, among others, which were presented by a pool of experts from the Philippine Rice Research Institute (PhilRice), the

Japan aid group to intensify dev’t support for Mindanao The Japan International C ooperation Agenc y (JICA) heartily welcomes the Framework Agreement on Bangsamoro which was signed today by the Government of the Republic of the Philippines and the Moro Islamic Liberation Front (MILF) as a significant step towards lasting peace and sustainable development in conflict-affected areas in Mindanao. Japan is contributing to peace and development of the Mindanao region through: (i) the dispatch of experts to the Social and Economic Development Section of the IMT; (ii) economic cooperation projects in conflict-affected areas through the JapanBangsamoro Initiatives for Reconstruction and Development (J-BiRD); and (iii) the participation in the International Contact Group (ICG) that is providing advice by attending the peace talks as an observer. JICA has been proactively implementing the reconstruction and development projects in Mindanao through J-BiRD with the aim of enhancing the peace building in the area.

J-BiRD was launched in December 2006 aiming Japan’s commitment to the peace process support to the Conflict-Affected Areas in Mindanao (CAAM) on the occasion of commemorating the 50th anniversary of the normalization of diplomatic ties between Japan and the Philippines. To date, J-BiRD has completed several projects in CAAM. “The final comprehensive peace agreement is yet to be seen. In spite of the issues left for further negotiation, JICA is confident that both parties will work even harder to conclude the peace agreement in the very near future. Ledesma, primemover of the Interfaith Forum for Peace, Harmony and Solidarity based here, said that sincerity to attain genuine and lasting peace in Mindanao from both government and the Moro Islamic Liberation Front (MILF) is needed more than ever since the “roadmap to peace” has already been signed. He said the FAB is just “part of the whole process to attain unity and solidarity” between and among the IPs, Bangsamoro and Christian settlers in Mindanao. Saway, however, said that that tri-peoples of Mindanao have already reaffirmed their kinship, thus they are united and solid behind the FAB. Last March 8, at least 18 IP tribes and 13 Bangsamoro tribes came together in Sungko, Lantapan, Bukidnon to perform the Reaffirmation of Kinship Ritual, last done 492 years ago. The ritual reaffirmed their shared ancestry and all those who attended, including Christian settlers and visitors who witnessed the historic event, vow to respect and protect each other. The reaffirmation of kinship by the descendants of the brothers Apu Mamalu and Apu Tabunaway was witnessed by representatives of various government agencies, the MILF peace panel members and the international community. The last time the ritual took place was in Tikalaan, Talakag, Bukidnon in 1520, a year before the “discovery” of the Philippine islands by Ferdinand Magellan. Part of the ritual was the signing of a covenant on the observation of the Five Pillars of Kinship: mutual recognition and respect (kilalaha), mutual sharing of information (sayuda), cooperation (buliga), mutual protection and preservation of life (uyaga), and mutual obligation to help the needy (pagbatunbatuna). A marker commemorating the historic event was unveiled at the grounds of the School of Living Traditions of the Talaandig tribe. “This event gives us the opportunity to remind us that we are one people, we

have one goal and our struggle is also one,” stressed Abhoud Syed Lingga, a member of the MILF peace negotiating panel. “This is a very significant event because we also have a common problem regarding our land. And this will bind us together to preserve whatever remains of our homeland, our culture, political power and economic resources.” Historically, the Islamized and non-Islamized natives of Mindanao are all “descended from Apu Agbibilin and Bae Ginamayung,” said Talaandig tribal chieftain, Adolino “Datu Makapukaw Kinulintang” Saway, elder brother of Datu Migketay. Because of this reaffirmation of their kinship, the younger but more famous Saway said the IPs will no longer pursue their assertion to be represented in both peace negotiating panels. The Inter-Religious Solidarity Movement for Peace (IRSMP), meanwhile, urged everyone in Mindanao to support the FAB. “The peace talks have been an important, integral part of our social agenda for the past many years, and before us now stands the most crucial moments in our joint concern and unrelenting effort. Peace is in our hands, as we often say,” the IRSMP said in a statement. The IRSMP said that the journey in the long road to peace has just begun with the signing of the FAB. And because the road is long, perseverance is needed towards the attainment of peace. “No political agreement is perfect on paper, until we make it perfect and most of all fair and fulfilling to all by dint of our deed,” he said. “Love peace, talk peace, do peace, pray peace. Goodwill and platitudes are not enough. Peace is the highest prize, and because it is so it requires also the toughest of tasks. But with all of us working together, with the Framework Agreement showing the high way, the golden prize will soon be ours as a gift of God and reward for our tears,” IRSMP added. (Bong D. Fabe)

Quoting Republic Act No. 7653, the New Central Bank Act, the CA said that “the actions of the Monetary Board taken under this section or under Section 29 of this Act shall be final and executory, and may not be restrained or set aside by the court except on petition for certiorari on the ground that the action taken was in excess of jurisdiction or with such grave abuse of discretion as to amount to lack or excess of jurisdiction.” As for the secondary question of whether or not the revocation of AsiaBank’s banking license automatically converted it into an ordinary corporation (and subject to the regular jurisdiction of the RTC), the CA also answered no. The CA explained in its decision that assuming that the AsiaBank can reopen as an ordinary corporation, it has to comply with the following requirements first: Amend its charter or articles of incorporation and bylaws; change its purpose; and obtain prior favorable recommendation from the BSP and approval of the Securities and Exchange Commission. “Before the lower court can acquire jurisdiction over AsiaBank, it has to be converted first into an ordinary corporation by complying with the procedures laid down in the Corporation Code. Absent such compliance, AsiaBank is still a bank in the eyes of the law subject to the supervision and jurisdiction of petition BSP,” the CA said. In explaining why AsiaBank’s depositors’ position must fail, the CA cited the Philippine Veterans Bank Employees Union v. Vega case, which laid down the concept of liquidation as “diametrically opposed” or

contrary to the concept of rehabilitation. “Apparently though, the depositors are not genuinely after the restoration of AsiaBank. The petition for rehabilitation is just their strategic way to stop its liquidation and dissolution, and ultimately get their deposits still intact,” the appellate court said. The CA further pointed out: “We do commiserate with that perfectly human feeling (of grief ) that impelled this suit.
