A LOCAL LEADER OF AN INDIGENOUS PEOPLE GROUP opposed to a palm oil plantation was shot dead by suspected state agents in San Nicolas, Puntod, Cagayan de Oro City on October 3. At around 3 in the afternoon, Gilbert Paborada, 47, chairman of Pangalasag (Indigenous Shield), was about to alight from a motorela (public tricycle) when he was shot at by two motorcycle-riding men, according to the initial data gathered by the Rural Missionaries of the Philippines (RMP)-Northern Mindanao Region (NMR). Video footage proof of BIR’s extortion DAVAO City––A businessman-inventor insisted that a video footage could prove that he was a victim of extortion by a Bureau of Internal Revenue (BIR) legal officer assigned at the regional office here. “There was indeed a crime of bribery extortion. The BIR lawyer personally accepted the money he asked from me. Actual video footage can prove it,” Edgar Delibo, also known as Dok Ed, said as his response to allegations that the reported bribe money was just planted. He said lawyer Roderick Orallo was the one who invited him to be at the Apo View Hotel on September 27, 2012 and to bring the P50,000 compromise money to settle the case the BIR filed against him. Delibo said that the other issues raised against me and the company will be answered squarely in a proper forum. I will reveal more vital information during the trial,” he said, adding he was already expecting the filing of counter cases like perjury and others as a form of revenge against him. Delibo said his being an expert in alternative medicine was not only conferred to him overnight. “I have legitimately undergone studies as Doctor of Ministry in Alternative Medicine at the Open Seminary, USA, and even in Chinese Alternative Medicine at Zhongfang Red Cross International in China,” he explained after he was accused of making it appear to be equipped with medical knowledge in alternative medicine. Delibo said he also never claimed to be a medical doctor because he was reportedly proud to be an alternative medicine doctor. He said as a businessman, he was reportedly legally operating, running his business with updated permits from the Department of Trade and Industry (DTI), BIR and local government units (LGUs). “As to my inventions, I have secured appropriate licenses from the Food and Drugs Administration,” he said. The BIR legal officer denied the accusations of Delibo. On Tuesday, the BIR exec was out on bail. Regional Trial Court (RTC) Branch 16 Judge Emmanuel Carpio granted the petition for bail filed by lawyer Caesar Europa, one of the counsels of the accused lawyer on Friday, September 28. The court allowed BIR lawyer Roderick Orallo to post a P100,000 bail, the maximum for robbery extortion as provided by DOJ Circular No. 89 (The 2000 Bond Guide).

Solar energy eyed in 12 far-flung villages COTABATO City––The Maguindanao government will soon provide solar-powered street lights to dozens of far-flung villages in the province with Hill 224 in Datu Unsay town as the first beneficiary. Two 31-watt solar street lights at Hill 224 was installed to provide power to the Teduraydominated area for up to 12 hours, said Engineer Abdul Asim of the provincial engineering office. The solar lighting project in the village is in preparation for the construction of a school building in the area upon the order of Maguindanao Governor Esmael “Toto” Mangudadatu. Asim said other villages which will soon have solar-powered lighting are Barangays Poblacion, South Upi; Pura in Datu Blah Sinsuat; Poblacion, Sibuto and Baka in Datu Odin Sinsuat; Poblacion Barira, Poblacion Buldon; Bongo island in Parang; Poblacion in mother and Northern Kabuntalan; and in Salman, Ampatuan.

Black and White Movement defends its Party List Applic THE CIVIL society group Black and White Movement has defended its camp from a leftist group’s appeal that urged the Movement to withdraw its application for accreditation as a Regional Political Party participating in the 2013 Party List election. “You do not have to be a leftist to qualify in the Party List system and fight for the marginalized,” the Black and White Movement said in a statement expressing its right to participate in the election. This came in the heels of Kontra Daya’s claim that Black and White Movement’s close alliance with President Noynoy Aquino makes a mockery of the party list system. Kontra Daya is led by Fr. Joe Dizon, a close associate of the Bayan coalition and Bayan Muna Party

List, a group critical of the Aquino government. The Black and White Movement also stood up for its nominees like Leah Navarro, who currently sits as a Movie and Television Classification Board (MTRCB) member and the group’s first nominee, by stressing that her position which is soon to end on September 30 will not be a conflict with the group’s application for accreditation. “We have meticulously complied with the requirements for a Regional Political Party [at the National Capital Region] participating in the Party List system. All of our nominees belong to the sectors being represented. And none of them are former politicians. None of them are associated with any business interest or political

clan,” the group said. Women, youth, and urban poor are the sectors specifically identified by the Party List law as marginalized. Since its inception in 2005 as a civil society group, the Black and White Movement has always worked with the urban poor sector in performing mass actions against the excesses of the GMA regime. It is a strong advocate of women’s rights and issues and it teams up with its youth counterpart Black and White Youth Movement for the social development of the younger generation. “If elected, we are committed to sponsor and support legislation that will protect and advance the interests of the sectors we represent,” the civil society group added.

In a meeting hosted by Bangko Sentral ng Pilipinas, USAID recently got together with BPI-Globe BanKo, G-Xchange, and Smart Communications to push further the frontiers of mobile banking. This will be through the implementation of the Scaling Innovations in Mobile Money (SIMM) Project. O’Neill stressed that mobile technology, of which the Philippines is a trailblazer, is actually “a safe and stable way to create a new financial system.” Over the past few years, the USAID has worked extensively with mobile network operators Globe and Smart. It is planning to expand cooperation to deepen financial inclusion in the country through technological innovations. The USAID noted that while most mobile banking deployments around the world provide a new delivery channel to existing bank clients, transformative models like the SIMM Project aspire to integrate unbanked populations into the formal financial sector. According to the USAID, financial services provide the means for the poor and the unbanked to build assets, better withstand shocks, and participate more broadly in the formal economy.

Capitol workers accused Moreno of cash advancing funds intended for salaries and wages that could be one of the reasons of delays in payment of payroll money. Judging from yesterday’s fanfare, Moreno could have spent a lot. For instance, a truckload from Gitagum was moving its way to Cagayan de Oro just as Moreno was filing his certificate of candidacy at the local election office. Despite their frustration, Capitol workers are happy of seeing Moreno go. They have long wanted Moreno to be out of provincial Capitol. Since Moreno has filed his certificate of candidacy to run for Mayor in Cagayan de Oro, Capitol expects Moreno to resign. Nonetheless, some are suspecting Moreno to hold on to his post until elections day. They contend that Moreno would exploit the resources of Capitol to his advantage in mounting election campaign in Cagayan de Oro. Whether Moreno could be liable that would lead to disqualification to run for an elective post in this instant case is a $64 question. Being with the Liberal Party, Moreno believed he has the backing of the administration in whatever he does. In the end, the people of Cagayan de Oro will judge him after all. KORONADAL City -- Some 250 police officers across Soccsksargen Region are undergoing Special Counter Insurgency Operations Unit Training (SCOUT), said PInsp. Benjamin Mauricio Jr. chief information officer of the Police Regional Office (PRO– 12). The 45-day “rigid and tough training” is being conducted by the Regional Special Training Unit 12. “This training is the toughest and most difficult a police officer could go through,” but on the contrary, it is the best training they could experience because it teaches every basic detail in internal security operations.” Scout trainees, he explained, will be taught first aid, rope courses, immediate action drills, water/seaborne tactics, terrain modeling, close quarter battle, survival, field training exercises and community immersion. Besides training officers to become physically fit and mentally awake, the course also aims to strengthen respect and loyalty to the organization, sharpen the mind; strengthen camaraderie, and build harmonious relationship among fellow police officers as well as the community. Mauricio added the training is in line with Police Director General Nicanor Bartolome’s 10-point Action Plan. “Scout trainees are also trained to make and build close relationship with the community. Cop faces rape raps By BEN D. ARCHE DAVAO City––A police officer of the Davao City Police Office (DCPO) is now facing charges for allegedly molesting his housemaid Monday afternoon inside his residence in Talomo District this city. The suspect, Senior Police Officer (SPO) 1 Adonis Imbestro, 37, married and detailed at Toril Police Station was the subject of rape complaint lodged by his 17 year-old house help, identified only as “gurl.” According to the victim in her complaint, the suspect entered her room after she took a bath and forced her to submit using his superior strength. DCPO chief SSupt. Ronald dela Rosa immediately ordered the arrest of the suspect following the filing of the complaint. Police operatives nabbed the suspect and confiscated his issued firearms on Tuesday evening. The suspect is now detained at the DCPO detention cell. P/SInsp. Arcely Yaun, DCPO Women and Children Protection Desk chief, said the suspect will be facing several charges for violation of Republic Act 8353 or the AntiRape Law and Republic Act 7610 known as the Special Protection of Children Against Abuse, Exploitation and Discrimination Act. Yaun, who prepared the charges against suspect, added that SPO1 Imbestro will also be charged administratively before the Internal Affairs Service (JAS) of the Philippine National Police.

Another concern she would look into is infrastructure development, including the building of a sports complex. Darimbang has announced that a request sent to the Technical Education and Skills Development Authority for scholarships has been approved recently. For his part, De la Rosa said he will “put the city in order.” He elaborated that by that he means everything should be in their proper places, including sidewalk and ambulant vendors as well as garbage. because decriminalizing libel will be a much easier process than amending the Cybercrime Law at this stage, to remove on-line libel. Sotto proposed two things along these lines: lawmakers must pass the law decriminalizing libel now, or, he, Sotto, himself will proposed a law removing libel as an offense under the Revised Penal Code. Either way, this would mean a major victory for press freedom and free speech, both in the traditional media, and in the Internet. Now, let us see where all these will lead to in the days to come. -oooL I B E L V I O L AT E S FREE PRESS AND FREE SPEECH: I really do not understand why the Revised Penal Code carries with it a provision penalizing as a crime libelous utterances. And I really do not understand why nobody questioned this anomaly in the law. Why anomaly? Simply because while the Constitution guarantees free speech and freedom of the press, a much lesser law---the Revised Penal Code---rules otherwise. In any given legal system such as that obtaining in the Philippines, the Constitution occupies the highest position among existing laws, such that anything that contravenes any Constitutional provision is declared null and void. Surely, the libel provisions of the penal code contravenes the Constitution, but nobody has questioned that. With the brouhaha generated by the passage of the Cybercrime Law, the time has come for libel to be decriminalized. And it is significant that this is happening not because of the work of former newsmen or mediamen who became lawmakers who, quite oddly, chose to ignore this basic anomaly involving the press. Members of the Boy Scout of the Philippines helped rescue some guests of the hotel. No casualty was reported in the fire which damage placed at P17 million. Police believed that the absence of security guard made it possible for the suspect to sneak in and set the station on fire. The law is pretty vague on these matters, but the punishments are on the other hand very specific and heavy” Reyes said. “With admissions coming from lawmakers that the law is flawed, we are confident that the people’s opposition will succeed. We urge the Supreme Court to give due course to all the petitions filed and will be filed against the draconian cybercrime law,” Reyes said. E-martial law In the House of Representatives, moves against the cybercrime law are also being made. On October 1, Kabataan Partylist Rep. Raymond Palatino filed House Bill 6613 seeking to repeal several contentious provisions in the new law. Bayan Muna Rep. Teddy Casiño stands as the bill’s co-author. Palatino said the insertion of provisions regarding online libel and vague sections on data collection and sanctions make it essentially an online censorship law. HB 6613 seeks to repeal Sections 4(c)4, 5, 6, 7 and the whole Chapter 4 of RA 10175. According to Palatino, Section 4(c)4, 5, and 6 of RA 10175 relate to online libel, and are unconstitutional due its vagueness. Chapter IV, in the meantime, is also unconstitutional for violating constitutional due process. “The new law is thus a threat to the constitutional freedoms of the press and expression. The relative freedom of publication utilized by online critics of government policies shall now be curtailed,”

Palatino said. “Once the session resumes on October 8, our primary agenda will be to pass this repeal bill. We cannot let e-Martial Law be enacted,” Palatino said. The youth lawmaker has joined several other groups in filing petitions for TRO against RA 10175. He is among the petitioners in the motion filed by Kabataan Partylist also on October 2. Other petitioners include ACT Teachers Partylist Rep. Antonio Tinio, Anakbayan National Chair Vencer Crisostomo, Philippine Collegian Editor-inChief Katherine Elona, and Dean Roland Tolentino of the UP College of Mass Communication. They are seeking the issuance of the writs of prohibition and mandamus against the executive secretary and the secretary of the Department of Justice, and for the exercise of judicial review to assail the constitutionality of the cybercrime law. He was dead on the spot. The gunmen on board a white motocross-type motorcycle quickly sped away. “We believe that Paborada was killed because of his stance against A. Brown Company’s palm oil plantation,” Jomorito Goaynon, chairman of Kalumbay, a regional organization of indigenous peoples in Northern Mindanao, told Bulatlat.com in a phone interview. Paborada’s organization Pangalasag has been resisting the expansion of the palm oil plantation of A. Brown Company in the villages of Bagocboc and Tingalan in Opol, Misamis Oriental. Pangalasag said the company did not secure their free, prior and informed consent (FPIC) before encroaching on their ancestral domain. In a fact-finding mission in May, the group said, A. Brown grabbed their lands, destroyed their crops and forced them to leave. “We view this as an attack against the indigenous people’s right to land and to self-determination,” Goaynon said, adding that Paborada defended the rights of his fellow Higaonon tribe. Threatened Paborada had been warned against opposing the palm oil plantation. The Kalumbay leader also said Opol Mayor Dexter Yasay, in a dialogue with Pangalasag on June 4, publicly accused Paborada of being a member of the New People’s Army (NPA). The NPA is the armed wing of the Communist Party of the Philippines (CPP). The local government is vocal in its support to A. Brown. In an interview by Bulatlat. com in May this year, Paborada related how A. Brown’s security guards pointed their guns at him, telling him to leave the land. Since March 2011, Paborada left Bagocboc and had relocated to Puntod in Cagayan de Oro City to evade threats to his life. He earned a living by opening a small store. He still frequented Bagocboc village to lead community-based campaigns of Pangalasag. On the day of the killing, Paborada just came from Bagocboc. He is survived by his wife and their seven-year-old child. Looking through one’s lens MY SEVERAL READINGS ON MACROECONOMICS OF LABOR MARKETS REVEAL ONE REALITY, that is, the need for more studies that will address basically all sectors of the society. For instance, the study conducted by Sergiy Stetsenko of the University of Pennsylvania (2010) shows the change in behavior of fertility rate at business cycle frequencies in the United States between the 1970s and 1990s and it further shows how the cyclical and secular properties of fertility can be used to distinguish among several proposed theories that account for the rise in labor force participation of married mothers. Another study by Marion Warmuth (2007) deals with managing the aging workforce and it discusses the challenges arising from it. It shows that the prejudices and discrimination attached to older employees such as being resistant to new approaches or new technologies and being less productive can be managed through changing the mindset of employers and the company culture. It also supports findings of a survey of a research institute that elderly are able to mange difficult situations through their routine and experience and up-to-date knowledge and education. So what is the bottom line? What I want to put across in this article is the realization that while it is true that the National Statistics Office is periodically conducting the Labor Force Survey, there is a corresponding

It is not enough to obtain LFS data that gives number of employed, unemployed, or underemployed, it is also vital to see through one’s lens the perspectives and consequences of a given situation and given set of data through research. What is this Labor Force Survey (LFS)? The LFS aims to provide a quantitative framework for the preparation of plans and formulation of policies affecting the labor market. Specifically, the survey is designed to provide statistics on levels and trends of employment, unemployment and underemployment for the country, as a whole, and for each of the administrative regions, including provinces and key cities. The LFS has undergone changes in its questionnaire design starting in July 1987 where modifications in the concepts and definitions for measuring labor force and employment characteristics were adopted. The design is based on a past week reference period and new concept of availability and looking for work is adopted. With regard the concept, the Labor Force or Economically Active

Translating this set of data into figures, we would be looking at an estimated 63.1 million population aged 15 years and over with an employment rate of 93.0 per cent (almost the same with the 92.9 percent in July 2011), unemployment rate of 7.0 per cent and an underemployment rate of 22.7 per cent. ADB: World market harmed if RP stops importing rice MANILA, Philippines - The Philippines’ goal of attaining rice self-sufficiency in 2013 year may cause harm to the international rice market and cause price shocks, according to a working paper released by the Asian Development Bank (ADB). If this happens, this would be the second time the Philippines affects global rice prices in recent history after being cited as one of the main reasons for the world rice price crisis in 2008. In a paper released on Thursday, August 30, the Manila-based multilateral institution noted that the Philippines is one of the 3 biggest rice importers in the world. The other top global importers are Nigeria and Indonesia. “Net importing countries have pursued self-sufficiency in rice that is likely to insure them against the risk of trade disruptions. However, the self-sufficiency strategy raises the cost of rice security in the region,” the ADB said in paper titled “Enhancing ASEAN’s Resiliency to Extreme Rice Price Volatility.” Regional rice index Meantime, the ADB recommended that rice importing countries lower their self-sufficiency targets in exchange for commitments from exporting countries to stay away from unilateral export restrictions. Fu r t her, i n a not her paper titled “Commodities Exchange: Options for Addressing Price Risk and Volatility in Rice,” the ADB said that to calm world rice price volatility, Asian countries could establish a regional rice index and commodities exchange. The ADB suggested financial instruments, like futures and options, could be traded on existing commodities exchanges in Hong Kong, China, or Singapore. “Top exporters such as India, Thailand, and Vietnam could also establish domestic commodities exchanges, allowing farmers to obtain a better price by selling their most popular local rice grades directly on the market, rather than through a middleman,” the paper read. The road to rice selfsufficiency The local price of rice, the most politically sensitive

among crops in the Philippines, rose close to 40% in 2008, when global supply was threatened, exposing the vulnerability of the Philippines to the world market. The Arroyo government’s moves then to secure deals with Vietnam, a rice exporter, sent world prices soaring. The Aquino government has since pursued a rice selfsufficiency policy, which has a timetable as follows: The Philippines has been citing the self-sufficiency program in rice and overall growth in the crops subsector as the main growth drivers in attaining agriculture growth of 4.3% to 5.3% in the medium term. Agriculture Secretary Proceso J. Alcala has remained firm on efforts to attain 100% rice self sufficiency. He said the government has enough funds to spend for its self sufficiency bid. The Philippines imported 500,000 MT of milled rice for 2012. Alcala said it is possible that the country will import “a minimal volume” of milled rice next year. The DA is optimistic that it can produce 20.04 million metric tons (MMT) of palay and 8.75 MMT of corn in 2013 with a bigger budget approved by the Department of Budget and Management (DBM). During a recent hearing on the DA’s budget for next year, Agriculture Secretary Proceso J. Alcala said the P74.1 billlion being proposed by the department to Congress will boost its efforts to produce more staples. - Rappler.com

tional program for every CSN through the establishment of SPED Centers and provide vital support mechanisms. Rep. Su s a n Yap (2nd District, Tarlac), principal author of the bill, said the SPED Centers shall function as the resource center for the implementation of inclusive education that will accept all kinds of hildren on regular schools. “The establishment of a SPED center in each school division and at least three SPED centers in big school divisions will ensure nationwide access of the CSNs to basic education through the formal system and other alternative delivery services in education and later facilitate integration with mainstream education,” Yap said. Yap said the Center shall assist, facilitate, and monitor the transfer and admission of qualified children with disabilities to post-secondary or tertiary education institutions. “These SPED Centers in regular schools shall ensure that CSN fully develop their abilities, talents, interests and all aspects of their development to become more responsible for their lives and more effective partners in all the

affairs of the state,” Yap said. The bill defines children with special needs as those who are gifted or are fast learners and those who are disabled, impaired or andicapped and in need of special education as well as services for rehabilitation. Under the measure, each SPED center shall have specialized teachers who can handle children and youth with special needs including but not limited to those with visual or hearing impairment, autism, learning disabilities, behavioral problems, multiple disabilities, mental retardation/handicap and mental giftedness. An assistant principal for each SPED center shall administer and super vise the alternative educational programs, early intervention programs, monitoring, supervision, and provision of technical assistance, training and enhancement programs to SPED personnel, referral and placement procedures, and oversee the other components of the special education. Other members of administrative core and placement committee of the PED unit are an educational psychologist or psychometrician, physi-

cal therapist, occupational therapist, speech and language therapist/speech correction teacher, and one education supervisor. The measure shall enhance the right of teachers and support personnel to professional advancement through adequate remuneration, scholarship and training grants and other incentives. The Act also mandates full continuum of educational services by the Department of Education (DepEd) to those CSN below school age through regular home visits, consultations, day care activities and any other proper medium or program. The measure also provides financial assistance to the economically marginalized but deserving CSN at the elementary and secondary levels; ensures adequate and free medical assistance and intervention programs for CSN; and grants incentives to private institutions catering to the needs of CSN. The local government units shall be responsible for the provision of CSN-friendly sites and counterpart funds for training and seminars of parents and teachers in their respective localities.

The iButterfly Hunt digital marketing campaign, on the other hand, which was held from May 5 to June 30, 2012, had 64 exciting offers to shoppers in 8 SM malls. This successful campaign had 39,545 total downloads, 17,401 butterflies caught, and an average redemption rate of 13%. Through its Global Awards Program, the ICSC has recognized and honored the shopping center industry’s most cutting edge properties, innovative solutions, and creative marketing trends, as well outstanding examples of design and development throughout the world.
