bush by lawless elements on a military truck going inside the campus that killed 3 soldiers and injured 10 civilians. “There is no truth to the information circulating on Twitter, Facebook and social media which allege that war has allegedly broken out in Mindanao. Please refrain from sharing and posting similar information so as not to cause undue panic,” Hataman said in a statement

Army, police hunt down ambushers of soldiers in Marawi COTABATO City––The Army’s 103rd Infantry Brigade has launched a massive manhunt against a band of bandits who ambushed a military vehicle in Marawi City Wednesday night that left four soldiers dead and 10 others wounded. Three other civilians were hurt in the attack that occurred at about 9:30 p.m. near the Mindanao State University (MSU) campus in Marawi City.
“We are pursuing them, we know them pretty well,” Colonel Daniel Lucero, 10rd Infantry Brigade chief, said. According to Lucero, the attackers were possibly members of gun-for-hire or loyalists of crooked politicians who were caught trying to register fake voters. “Or they could be people who are not happy with our presence in the city or possibly those involved in drug trafficking,” Lucero said.
He said the ambushers opened fire at military personnel who were deployed around MSU campus to protect students who spoke against registration irregularities last July 9-18. ‘Habagat’ death toll rises to 19 THE National Disaster Risk Reduction and Management Council (NDRRMC) Thursday morning reported additional three deaths due to continuous heavy rains spawned by southwest monsoon (Habagat), bringing the number of dead to 19. According to NDRRMC, the new reported dead were Ricardo Rueles, 42, from Rodriguez, Rizal; Lando Montiano, 50 and Val Valenzuela, 37, both are from Naujan, Oriental Mindoro. rebel as Lyndy Dawang Balandan, 21, and a resident of Barangay Alegria, Alabel, Sarangani Province. Balandan claimed she belonged to the NPA’s Platoon Masda of Front Committee 75 of the Far South Mindanao Regional Command under certain Kumander Boyaks.
The rebel said their group has been operating in the hinterlands of Barangay Pinalpalan of Malita town, and the barangays of Datu Daligasao and San Pedro, all of Sta. Maria town in Davao del Sur. They are also operating in the barangays of Malungon Gamay and Kiapo of
Sarangani Province, she told. Balandan added she got pregnant by her comrade named as JR Blel also known as Ka AL On. In an interrogation, Army’s 1Lt. Ryan Lorejo of the 39th Infantry Battalion said the rebel wanted to live a normal life as she
is about to give birth. She feared about the health of her child if she will continue to go on hiding without enough food to eat and safety place to take shelter, the military said. The military will help the surrendered amazon in availing the government’s program for rebel returnees.

Speaking at a press conference held Wednesday in Cagayan de Oro, Zubiri said the plastics, especially the kind that is used only once, have clogged up waterways in the capital. He added that there is a bill pending that seeks to ban plastics, authored by Senator Manny Villar and which he co-authored during his time as a member of the Senate, and that this could have addressed the problem had it been passed into law. Intel officer playing dead saves own life CAMP PANACAN, Davao City-- A young intelligence officer saved his own life by playing dead despite sustaining multiple gunshot wounds. PFC John Oliver Ayuman, 24, of the army’s 10th Special Forces Regiment on Tuesday was waiting for his girlfriend
in Sition Quiabaton, in Calinan District, Davao City when armed men fired on him and tried to snatch him. Investigators suspected that the armed men were members of the rebel New People’s Army who chanced upon the soldier.
A witness told police investigators the victim was tied and grilled and was forced to admit his affiliation with the military. The suspects also searched the victims’ belongings but failed to get any identification card. The suspects also dragged the victim who
played dead due to multiple gunshot wounds prompting the suspects to leave him, police investigators said. Investigators said witnesses rushed the victim to the army’s camp hospital in Panacan, Davao City for medical treatment.
EASTERN MINDANAO COMMAND, Davao City – The military has assured the security and subsistence of more than 5,000 displaced evacuees when Moro rebels laid siege on military outposts in Maguindanao Monday dawn. The attacks in the municipal towns of Datu Unsay, Datu Saudi Ampatuan, Ampatuan, Guindolungan, Datu Abdullah Sangki and Shariff Aguak in Maguindanao were perpetrated by members of the Bangsamoro Islamic Freedom Fighters (BIFF), led by Armaril Umbra Kato. Commodore Romeo Santiago Nebres, deputy commander and spokesperson of the Eastern Mindanao Command based in this city, said a total of 5,130 families displaced, composed of 24,755 persons, “Many of them fear of being caught in the crossfire,” he said. He said of the affected people, 2,296 families or 11,480 individuals are in the 10 different evacuation centers in Maguindanao while 2,834 families or 13,275 persons are with their relatives. Nebres said the 6th Infantry Division is coordinating closely with the local government units, line agencies and the Department of Social Welfare and Development (DSWD) in the Autonomous Region in Muslim Mindanao (ARMM) for the security and subsistence for the evacuees, pending the clearing operation in the affected areas).

Kapalong town ranks highest in poverty reduction in Davao region By RUDOLF IAN G. ALAMA
DAVAO City––The Municipality of Kapalong posted the highest reduction among poverty incidence among local government units in Davao Region. Based in the 2009 Small Area Estimates which was released just this year Kapalong reduced its poverty incidence by 29.7% from the last SAE conducted in 2003. Kapalong’s 2003 poverty incidence rate was 51.2% with 2009 figures down to just 21.5%. Guesting at the Club 888 Media Forum at Marco Polo Davao yesterday (Aug. 8) National Statistical Coordination Board (NSCB) regional chief Estalla Turingan said that a number of factors contributed to the decline of poverty incidence in Kapalong among with the other most LGUs. She said that further stud-
ies could be conducted to determine the factors in the decline of poor people in the municipality. Poverty Incidence as defined by NSCB refers to the proportion of population or families with per capita income less than the per capita poverty threshold to the total number of population or families. Per capita poverty threshold in region XI is estimated at P47 a day or P17, 155 annually this includes minimum income requirement for food and non-food needs. In contrast to Kapalong, the town of Cateel posted the highest increase of poverty incidence in the region with 14.17% increase. Cateel’s poverty incidence was 39.3 in 2003 and 53.5 in 2009. Davao City ranks the least poorest local government unit in Region XI and also in Mindanao with a
poverty incidence of 13.2 this was down 1.7% from 2003’s figure of 14.9. Jose Abad Santos in Davao del Sur is the poorest local government unit in Region-XI and third poorest in the whole of Mindanao with a poverty incidence of 72.3 in 2009, however the municipality reduced its poverty incidence by 12.3% from the 2003 figure of 84.6 and is cited as among the top ten most improved local governments in terms of poverty incidence reduction in the region. The poorest local government unit in Mindanao and also in the country is the Municipality of Siayan in Zamboanga del Norte with 79.9% poverty incidence, however the municipality was able to reduce its poverty incidence as compared to 2003 figures of 97.46. Kapalong is a 1st class municipality in the province
of Davao del Norte, Philippines. According to the 2000 census, it has a population of 68,593 people in 13,843 households. History The town was founded in July 8, 1948 from the Municipal District of Tagum, which was formed in 1918. It was one of the oldest towns in Davao del Norte Province, others being Tagum, in 1941; and Panabo, in 1949, both of which are converted into cities almost 50 years later. Though the town of Talaingod emerged from the town in 1991, it is still the largest town by land area in the province of Davao del Norte. Kapalong is politically subdivided into 14 barangays. These are Semong, Florida, Gabuyan, Gupitan, Capungagan, Katipunan, Luna, Mabantao, Mamacao, Pag-asa, Maniki (Poblacion), Sampao. Sua-on, and Tiburcia.
Agusan Sur receives new medical facilities AGUSAN del Sur - The D. O. Plaza Memorial Hospital (DOPMH) has received new medical facility and supply donations, worth $438,000, from the World Medical Relief. The medical donation that included three X-ray machines, 20 hospital beds and medicines supplies were delivered, through the intervention of Agusan del Sur Governor Adolph Edward Plaza. Provincial Health Officer and Hospital Head Joel Esparagoza said, the 100-bed capacity hospital has an average admittance of 160, reason why it is presently expanding with another 50 beds to accommodate more patients.. The P75 million expansion project that started early last year is expected to help address the increasing needs of the people in this province and the neighboring areas, said Dr. Esparagoza. ISABELA City - The Department of Health (DOH) and the Pilipinas Shell Foundation Inc. (PSFI) have jointly launched the “Byaheng Kulambo” or Travelling LongLasting Insecticidal Net (LLIN), yesterday. Provincial Administrator Tahir Latip pinned the seal of the provincial government of Basilan to the symbolic “kulambo” (mosquito net), adding up to 50 local government units (LGUs), who have committed to help fight malaria. PSFI Head Eric Bel Sanico lauded the local health workers for working hard in bringing down the incidence of malaria in the province from 1,157 detected cases in 2006 to only 9 in 2011. “We have, in fact, increased the stakes of those involved in this initiative that has significantly, if not dramatically reduced the rate and level of the disease in the province,” he said. He added “reducing the disease level by single digit and eventually bringing it to zero requires more precise and exacting interventions.” For his part, Cluster Head Jackson G. Filing raps vs President Aquino sets a precedent THE article: ‘Pres. Aquino should be liable for floods,’ Aug. 9, 2012, Thurs. Mindanao Daily, reminds us only of what have taken place in Cagayan de Oro during the tragic ‘Typhoon Sendong’ last December. There is nothing to explain as reactions reaching this corner varied in context on the article’s ridiculous content. Indeed, it was ludicrous for President Aquino to face charges in connection with the occurrence of natural disaster in Cris Diaz this country. Again, we should not take that article seriously because it was impossible to charge President Aquino for failure to stop disasters - especially in Manila where the President himself resides. However, we wrote the article because of the silly initiative of some individuals in charging incumbent City Mayor Vicente ‘Dongkoy’ Emano in the aftermath of Typhoon Sendong. Some individuals, who formed themselves into different groups in Cagayan de Oro City, blamed ‘Dongkoy’ for allowing people to settle in places declared as ‘danger zone’ by the government’s environment agencies. Based on that premise, President Aquino should be liable for allowing people in Manila to settle in the capital city erstwhile considered ‘danger zone.’ If we are to assess the security of places against natural calamities, Manila is worse than anywhere in the country. Aside from being a flood prone area, some of the country’s major earthquake fault traverses along Manila’s dense capital of over 10 million people. If we are to follow strictly standard set by government agencies on secure place to inhabit, the entire metropolitan Manila should relocate to higher places. It is suggested that Manila and its neighboring provinces and cities should be relocated up in the mountain range of Sierra Madre. However, it is impossible. Now, following the thinking of nitwits, we should instead charged mayors, governors, and even the President for allowing people to stay in Manila being an unsafe place. This is not a laughing matter ‘though as some groups in Cagayan de Oro City entertain the idea that Dongkoy Emano is liable when Typhoon Sendong wrought havoc in this seaport capital. Perhaps, these people could not find concrete issues to pin Dongkoy. Better still, it would be better to charge Pres. Aquino first as a way of setting a concrete precedent. Absurd! Warning the public that soda can cause diabetes and obesity THE government is within its right to restrict behavior to protect health based on the constitutional fiat, particularly Section 15, Article II of the 1987 Constitution which provides that the State shall protect and promote the right to health of the people and instill consciousness among them, according to a lawmaker. Thus a Bill is now being filed to inform the public that soda s or softdrinks can cause diabetes and obesity. Research says a bottle of a regular 8-ounce soda is loaded with five heaping tablespoons of sugar but authorities are now saying that a can of soda contains about 10 teaspoons of sugar. “Any health provider would simply recommend that adults consume less than six teaspoons of sugar

Thus Health authorities have warned that excessive intake of soda, which some say is habituating can send one’s blood sugar shooting up,” a congressman said. Habitual soda guzzling can increase risk of type 2 diabetes, heart disease and even cancer, according to a Harvard research which reported that people who drink at least 12 ounces of soda daily are 50% more likely to develop a condition that can lead to coronary artery disease, stroke and diabetes. To disseminate information through advertisements, techniques or schemes on the promise of gain such as prizes in cash or in kind as reward for the purchase of soda, soft
drink or sweetened drink which is more that 16 ounces per bottle or container in a contest should be prohibited, The bill also prohibits the giving of samples and donations of soda products more than 16 ounces per bottle . Manufacturers should post factual health contents and nutritional claims, especially its sugar content, in the label, product’s container or bottle. It shall include an understandable message in Filipino printed on it with the words, “IMPORTANT NOTICE,” or their equivalent as its heading, the Bill stated. Also, manufacturers are required to include in the content signage in all containers or bottles of soda products or sweetened drinks the statement, “DRINKING SODA CAUSES OBESITY AND DIABETES,” the Bill
states. These are desirable measures but the government should ensure that the Department of Health (DOH) and the Department of Trade and Industry (DTI) and the DOST issue the necessary rules and regulations once an Act is implemented. The bill imposes a penalty of 6 years imprisonment or a fine of P100,000 or both against violators. To be fair, since soda production is a huge pillar of the Philippine economy, it is worthwhile that all efforts should be exhausted to really determine whether it is only soda that causes the said health risks. Why not also come out with a reliable research that other foods in the market today are also harmful and may cause the same ailments.

THE K to 12 is not the end but rather the beginning of the new tasks in our new generations, lives, hopes, aspirations, and so do to our curriculum. We are now fulfilling the step to improve the quality of education in our country. This is the call and the preparation of graduates, the learners, to face the challenges that await them. The K to 12 is a program and legacy that was made by Filipino for Filipinos. And to prepare the graduates to become competitive globally, the Department of Education (DepEd), and
the Technical Education and Skills Development Authority (Tesda) have been working hand in hand with other stakeholders. Call it an educational reform, although it is not a perfect curriculum, but I would say it was a genuine curriculum. It was implemented to help learners learn Filipino cultures, language, and traditions in the early grades. The key to 12 stresses that using and reading in the Mother Tongue and in Filipino is made easier because these languages have simple orthography. Basically, K to 12 covers kinder and 12 years of
education––six years of primary education, four years of junior high school, and two years of senior high school (SHS). The additional two years (grades 11 and 12) or SHS will allow students to choose among academic, technical–vocational, or sports and arts tracks depending on their interest, the community needs, and the results of their skills assessment. The SHS will allow mastery of core competencies for lifelong learning and preparedness for work, higher education, middlelevel skills development, or entrepreneurship. “The adoption of the
program is in response to the need to improve the competitiveness of our country’s graduates as the 10-year basic education cycle is seen as inadequate for work and higher education,” the government said on its website. It added: “In fact, overseas Filipino workers are not automatically recognized as professionals in other countries that view the 10year education program as insufficient. The Philippines is the only country in Asia and is one of only three countries in the world with a ten-year basic education cycle.” advertorial

(TVIRD) and the National Bureau of Investigation (NBI) to present before the court their evidence denying Mossma’s claims that they are being threatened, followed and harassed by TVI henchmen instead of presenting it first to the media. Mossma officials and members have an ongoing case against TVIRD officials before the Court of Appeals here, docketed as CA No.0004-WR/A-MIN. Lawyers Glocelito C. Jayma and Jarley D. SulayTrugillo denounced the T VIRD’s officials pro-

nouncement before the Manila media denying all allegations lodged against in court by the Mossma. They said the media is not the proper forum and venue to present their evidence especially since there is now an ongoing hearing on the case against TVIRD. They were referring to the report submitted by NBI agent Francis V. Senora that claimed that the TVIRD emails that detailed “Operation Bongkag” intercepted by the Mossma officials and members were “maliciously created” and “did not come from an authentic source.” Aside from the NBI report, the TVIRD also presented during its press conference in Manila last Monday (July 30) the findings of the Pacific Strategies and Assessments (PSA), an international private risk assessment and security agency. Did we see this with Thailand when they experienced their month long flood tearing industry? Maybe the President is correct about media reporting the good news. The problem with news is the news itself; what sells is disaster. “It’s more fun in the Philippines” again is contested the world over when CNN picks up footage from our local networks. While we may not be able to put a leash on social sites on the net we should at least regulate our media in promoting what can be damaging to the image of the country the DOT work so hard to uplift. Rain and flooding are common disasters shared the world over and we Filipino’s are relatively used to this. There were many signs of residents cleaning up while floods subside to maximize on the waters utilized to clean out the mud the floods brought in. This is a virtue Filipinos can be proud off – this should be dramatized and not necessarily the calamity itself. Need we have all the competing networks broadcast the same photos and footage on the disaster simultaneously? There are no answers promoted in this writing other than to bring to retrospect the action of networks. Alternative content could be talk analysis for infrastructure improvement. Engineering analysis could likewise offer innovative approaches towards infrastructure to educate the viewers. Environmental issues could likewise be discussed with empowerment to NGO’s and climate change advocators. “Pagasa” could take a pro-active stance by a deeper analysis of meteorological discoveries so the people may know they’re not necessarily sitting on their asses. The promotion of virtues would make great content to educate the masses on poor practices. Understanding the dams and their significance would also help us understand for a better comprehension rather than blame its managers for releasing waters collected or in this case overflowing. Government leadership may be able to enact noresidential zones to perennially flooded areas; after all there is no power stronger than mother earth when it unleashes its wrath. Political will while it is acceptable with a popular president may be the right time to do so. Relief distribution so long it does not dramatize the poverty it usually does would make good content. Solon says your favorite softdrink poses health risks MANILA- A legislator is pushing to regulate the sale, marketing and promotions of soda or sweetened drinks in containers over 16 ounces to fight obesity and diabetes. Rep. Magtanggol Gunigundo I (2nd District, Valenzuela City) said there is a need for government to step in with regulations to guide consumers away from potentially harmful food and drinks to stop the onslaught of obesity and diabetes in the country. Gunigundo filed House Bill 6341 or the “Soda Regulation Act of 2012,” which seeks to prohibit the sale of soda, soft drinks or sweetened drinks 16 ounces or above per bottle/container. It imposes trade regulations and stricter implementation of marketing and promotion of these products. Gunigundo said the Philippines as a decent society, which already bans smok-

Cruz in this province with the five new comers adding up to over 30 industrial companies operating in the area, according to town Mayor Joel Ray Lopez. For 2012 alone, he said two of these are the expansion projects of Hedcor, Inc. of close to P3 billion investments, the expansion of Franklin Baker Company, Sea Oil, Misubishi and an Indian Company for coconut and rice bran oil processing. Lopez however did not disclose the investments but said that these companies will be locating in their town. He said they continue to welcome industrial companies considering that many of their constituents are employed in these companies. In the 2008 survey, 2.7% Filipino adults aged 20 years and over are suffering from impaired fasting glucose, while hyperglycemia or high fasting blood sugar (FBS) level is 4.8%. The prevalence of hyperten-
sion among adults is 25%, increasing with age starting from age 40-49 years,” Gunigundo said. Gunigundo said the relationship between soft drink consumption and body weight is so strong that researchers calculate that for each additional soda consumed, the risk of obesity increases 1.6 times. Under the measure, soda manufacturers are prohibited to advertise that people buying their softdrinks would win prizes in cash or in kind. The bill provides the mandatory posting of factual health contents and nutritional claims, especially its sugar content, in the label product’s container or bottle. Davao Norte opens resort inside prison facility TAGUM City – Inmates could now avail ample time to mingle with their families, visitors including their lawyers within the newly opened Daval del Norte District Jail Inland Resort inside the provincial jail compound this city. Governor Rodolfo P. Del Rosario said the resort will boost the position of the correctional facility as haven of change and personal growth of the inmates. The inmates are now to be called as vacationers or “bakasyonistas,” the governor said. Del Rosario added the families and friends of the inmates could also occupy
several cottages which were built on top of a lagoon at the western stretch of the provincial jail. “The project is an expression of our strong commitment not merely in the promotion of the welfare of the “bakasyonistas” but more so for the advancement of jail management,” the governor said. The resort could become a pilot project of the Bureau of Jail Management and Penology (BJMP) which is now managing the facility. It would showcase the good practices instituted by the agency, Del Rosario told. Jail warden Police Sr. Inspector Ian Glenn Ocmen said the project would create an enriching environment for the inmates’ family
members and friends, and could also boost the morale and welfare of the inmates despite of being locked up. Soda Pool, Camiguin’s added tourists treat
By Jorie C. Valcorza Camiguin never runs out of surprises. Yes, this beautiful volcanic island, lying off the north east coast of Mindanao, offers another extraordinary treat to tourist. Cold and hot springs waters are common, but a pool made of soda, that's rare. Lying beneath Mount Hibok-Hibok in Barangay Bura of Catarman town is the healing and whitening waters of the soda pool. This interesting pool tastes just like the commercialized bottle soda water minus the acidity. Its water source spouts up natural carbonated water, so rich that the continued flow of the spring water bubbles surface up the pool. A dip in mineral water, with such lush vegetations around, while the majestic volcanoes watch over is breathtaking. If milk baths are supposed to be good for the skin, bathing in soda, according to the local folks, is therapeutic . Cindy Hill, an awarded freelance writer said in one of her articles, that soda springs are quite rare, and that this mineral water rises from the earth naturally carbonated, forming warm pools. She quoted some studies that reveal that this nutrient-rich water provides critical habitat to rare plants and animals, but not restricted to wildlife alone. Scientists believe that soaking in the pools or better yet drinking it will reap the health benefits of natural soda water, which is known to reduce osteoporosis, decrease cardiovascular health disease, and lower blood pressure. Mineral content of soda spring water may vary from location to location. Meanwhile, Barangay Agoho in the municipality of Mambajao is using soda water in its water system. Before the pool in Bura was developed, visitors often dropped briefly in Agoho just to try its all-free soda bath. Camiguin from the sound of its name “come again” until now remains an exciting place to visit over and over again. It can take you to its virgin forests, highest peak, great dive sites, historical landmarks, as well as, must-try foods and delicacies only the island can offer. It is only here where you might want to leave your jeans off and go shirtless all day as you take a dip on its unique varieties of water giving a rare combination of healing, cleansing, relaxin, and refreshing swim. XCCA director stars in award-winning play X
avier Center for Culture and the Arts Director Hobart Savior is part of the cast of the Integrated Performing Arts Guild’s (IPAG), “Ming Ming,” the Palanca Award-winning play by Steven PC Fernandez. “Ming Ming” is a story of three generations of a powerful Maranao family dealing with issues of
politics, family honor and family feud. As Ming Ming uncovers the secrets of her family, the audience, too, learns about peace, conflict and social reform. Savior played the role of P, Ming Ming’s resentful uncle who tries to impose his fundamentalist views on her niece and her mother. The play was staged
earlier this May at Xavier University during the soft launching of IPAG’s 35th Season. In its staging this July at the Mindanao State University – Iligan Institute of Technology, 17 out of its 19 performances were standing-room only. Since it premiered in 2004, “Ming Ming” has gained critical acclaim. It won the Palanca award in
2006. Acting in the play along with Savior were other IPAG veterans Diane Therese Clemente, Venus Tan, Jean Graciela Penola, Orwel Obach, Kenn Erwin Velasquez and Leilani Fernandez. Michael Lagura and Blesy Cece played alternating roles. The play was directed by Fernandez, himself, who

Comparing between boys and girls, statistics show that in every ten working children, six were boys while four were girls. Causing alarm to our nation planners are the findings that as young as 5 years old, statistics show an 8.2 percent of working children who belonged to the 5 to 9 years of age category, while 46.7 percent of the working children were 15 to 17 years old and 45.1 percent were 10 to 14 years old. More alarming are those identified working in hazardous work environment which registered 39.9 percent for those exposed to physical environment , 19.1 for those exposed to chemical and physical hazards and 13.7 percent for those exposed to combined chemicals, physical and biological hazards. While it is every child’s right to obtain formal education, it is sad to note that for all age groups, there is still 29.9 percent reported not attending school, and out of the three age groups (5-9,10-14,15-17), 47.3 percent among those belonging to 15-17 years old were not attending school. Between the two sexes, there were more boys than girls among the children in hazardous labor who were attending school. The root cause that triggered children to work is poverty. Those who were reported helping in own household-operated farm

Sulay-Trugillo said that during the course of the hearing at the 21st Division of the Court of Appeals Mindanao Station here, Associate Justice Ma. Luisa C. Quijano-Padilla ordered the TVIRD legal counsel and officials to present their evidence in court, especially anything that they have to debunk the claim of the Mossma officials and members. But the TVIRD legal counsel and officials stalled and did not present any evidence in court. Instead, they claimed during the hearing that TVIRD system was hacked. “They claimed that their system was hacked. So if it was hacked, then the emails are real,” said Sulay-Trugillo. “We want a copy of those reports they presented before the Manila media. They were given time to present their evidence in court since we have an ongoing hearing on the case against them here. But instead of presenting their evidence in court, they presented it to the media. We wonder why they did not present that in court,” stressed Jayma. In his letter to a national daily (not the Mirror) copy furnished to this reporter, Jayma questioned the NBI for releasing the report to the media and not to the court. He said TVIRD also did not give a copy of the NBI report to the Mossma. “The so-called NBI report was not submitted in court during the last hearing on July 19 and 20, 2012, even as the TVIRD was given time to present evidence. TVIRD did not give a copy to the petitioners on alleged NBI report during the last hearing on the writ of amparo... In other words, the so-called NBI report was released to media for some reasons. Clearly, it is my impression, the so-called NBI report is not really intended for the court to evaluate,” he said in his letter. He said the alleged “malicious” emails, as claimed by the alleged NBI report, is now a part of the public record since these emails were presented by Mossma as its evidence in its case against TVIRD. But the alleged NBI report has not been presented in court and thus is not a part of the public record. “...the purported emails dismissed as ‘malicious’ in the so-called NBI report is now a public record since it has been submitted in evidence by the petitioners in the writ of amparo case. And the court has already made initial ruling on it after it issued Temporary Protection Order (TPO) in favor of petitioners last July 24, 2012,” he explained. During the press conference, Sulay-Trugillo said that what were described in the emails and what have happened to their clients
on the ground were “not coincidence.” “The threats are real. The surveillance are real. And all the negative happenings to our clients coincided with what were described in the emails. That is not coincidence. TVIRD claimed that the emails were fabricated by our clients. If these were fabricated, why are then these emails correspond to what happened to our clients?” she asked. TVIRD and NBI officials better explain this in court and not before the media, she added. The emails were circulated late last year and early this year. Some emails contained information about alleged bribery attempts on ranking officials of the Armed Forces of the Philippines (AFP) and a plot to murder Mossma and local officials in Zamboanga del Sur. In one or two of the emails, Governor Antonio Cerilles of Zamboanga del Sur was mentioned as giving his approval to a plot to liquidate certain members of Mossma. Other emails also mentioned retired AFP Gen. Emmanuel Cayton, TVIRD director for security. But both Cerilles and Cayton denied the allegations. However, Jayma said the emails “is only one of the basis for the filing of the Writ of Amparo.” On July 13, 2012, Associate Justice Ma. Luisa C. Quijano-Padilla of the 21st Division of the Court of Appeals Mindanao Station, issued the Writ of Amparo in favor of the Mossma officials and members. The same court issued a Temporary Protection Order in favor of the Mossma on July 24, 2012. Mossma, a duly registered organization with the Securities and Exchange Commission (SEC Registration No. G1997-00247) on August 14, 1997, is composed more than 5,000 of small-scale miners, 60 percent of which are Subanen, in Sitio Balabag, Barangay Depore in Bayog, Zamboanga del Sur. Members of the group started mining in Balabag Hill, said to contain 1.37 million tons of gold and silver, in 1987.
