A GLOBAL CIVIL SOCIETY NETWORK has joined the local human rights group Karapatan in urging the Aquino administration to end extrajudicial killings. In a statement, CIVICUS: World Alliance for Citizen Participation and Karapatan called on the government to carry out fair and independent investigations into all cases of extrajudicial killings and disappearances. Since President Benigno Aquino III assumed office, Karapatan documented 99 victims of extrajudicial killings and 11 cases of enforced disappearances. Majority of the victims are farmers, indigenous peoples and activists advocating for land rights and

environmental protection. The group also reported that at least 385 political prisoners continue to languish in prisons as “a result of exercising the key civil society freedoms – freedom of expression, association and assembly.” “The rate at which human rights defenders are being killed in the Philippines is shocking,” says Mandeep Tiwana, policy and advocacy Manager at CIVICUS. “If the government is serious about its stated commitment to end rights violations, GROUPS/PAGE 11

Raid at mayor’s house yields cache of firearms By BEN D. ARCHE, Regional editor-Davao

DIGOS City––Operatives from the Regional Police Office and the Davao del Sur Provincial Police Office (DSPPO) swooped down the house of Mayor Jimmy Joyce of Jose Abad Santos town in the Second District of Davao del Sur Thursday afternoon. Recovered during the raid were two M16 Armalite rifles, two M16 Baby Armalite rifl es, one Ingram assault rifle, one 9mm pistol, one rifle grenade, one Colt MK .45 pistol and assorted ammunitions and magazines. Th e raiding team also recovered one AK47 assault rifle, one Tavor assault rifle, one M16 Bushmaster rifle, one cal. 40 pistol, scope and rifle, and assorted ammunitions and magazines in the bedroom of Mayor Joyce. Police Superintendent Leonardo Felonia of Region 11 Intelligence Unit,

Chief Inspector Michael John Mangahis of Region 11 Police Special Action Force, and Police Superintendent Quirubin Manalang led the group of the raiding authorities. The raid came following the search warrant issued on July 25 by Executive Judge Marino Dela Cruz Jr. of the National Capital Region RTC Branch 22 in Manila for violation of Republic Act 8294. Arrested were Mayor Joyce, Ronnie Pandamon, Hernan Miguel, Flor Arquillano, boroy Tilo and two members of Civil Secutity Unit (CSU) identified as Arnel Dionesio and Victorino Venancio. The suspects and the recovered firearms are now under the custody of the Davao del Sur Police Office. Last week, Davao del Sur Governor Douglas Ra. Cagas urged the police and

the military to dismantle private armed groups in the province. Cagas believed that these groups were backed up by politicians in preparations for the coming elections in 2013. DSPPO chief Superintendent Ronaldo Llanera and Army’s 39 Infantry Battalion (IB) commander Lt. Col. Norman Zuniega vowed to heed the call of Cagas to avert the proliferation of loose firearms in the province. In 2010 elections, the Commission on Elections (Comelec) placed Davao del Sur under its control following a bloody gunfight between the security forces of contending politicians. Cagas is eyeing to bring this issue to Malacañang, as he cited the order of President Aquino earlier to disband the private armed security groups of politicians.

Terrorized tribal folks in M’balay head back home MALAYBALAY City––The 35-family Matigsalog folk who fled their terrorized barangay Dao in San Fernando, Bukidnon had returned home Wednesday aboard trucks provided by government. The Lumads came down from the mountains five months ago and encamped since then in front of the capitol building for fear of their lives from armed groups terrorizing their village. The tribe evacuated after the killing of Dao punong

barangay, Jimmy Liguyon, some five months earlier by suspect Butsoy Salusad, also a native and said to head a brigand armed group in the area. Liguyon reportedly refused repeated small-scale miners to operate in their farming village for its destructive effects to their farms. The court has issued a warrant of arrest against Butsoy who remained scotfree. The lumads of the Matigsalog tribe feared that unless Butsoy and his

armed would are neutralize, more killing would take place in their villages which prompted them to evacuate to Malaybalay proper. Local government authorities pledge that law enforcers would hunt down Butsoy and his armed group should anything happened once they ‘lumads’ returned to their farming village in Dao. Grenade exploded at Catholic Church in Sulu ZAMBOANGA City––An unidentified suspect lobbed a fragmentation grenade that exploded on the rooftop of a Catholic Church in the island province of Sulu, a military official disclosed Thursday. There was no injury or casualty in the grenade throwing incident that took place early Wednesday evening, Lt. Col. Randolph Cabangbang,

spokesperson of the army’s Western Mindanao Command said. Initial investigation showed that an unknown suspect tossed the grenade on the roof of the Mount Carmel Cathedral Church located along General Arolas Street in Jolo, Sulu past 6:00 in the evening Wednesday. Recovered from the explo-

sion site were the grenade’s safety lever and several pieces of shrapnel, Cabangbang said. Authorities had tightened security measures at the church’s premises. He said no group or individual has claimed responsibility over the grenade attack. The police now conduct a thorough investigation of the incident.

MARAWI City––Two soldiers were gunned down inside the office of the Land Transportation Office (LTO) in Barangay Matampay here at around 10 in the morning on July 30. The victims who were shot to death while attending to LTO clients were identified as Private First Class Mark Anthony L. Tancio and Private First Class Darwin S. Lorenzo, all residents of Cagayan de Oro. Tancio and Lorenzo succumbed to multiple bullet wounds. The two unidentified suspects who were armed with .9mm and .45 pistol immediately fled after taking the two m16 rifles of the victims. Witnesses said the suspects fled riding on a dirtywhite vehicle with no license plate number. Senior Police Officer 1 Ali G. Rangiris, a police investigator, said that he is still trying to establish the motive behind the fatal shooting incident. Rangiris said the bodies of the victims will be subjected to autopsy before their bodies will be sent home to their respective families. BUTUAN City––The 21st Mindanao Business Conference (MinBizCon) highlights the promotion of transparency in governance, according to City Councilor Ryan Anthony Culima, who chairs the Committee on Trade and

GENERAL Santos City––Greenpeace Southeast Asia, along with two foreign fishing experts, visited this Tuna Capital of the Philippines to campaign for sustainable fishing practices. Specifically, Greenpeace is advocating for the pole and line method of catching tuna to address its declining population in Philippine seas. “We are running out of fish and time. For a country known for marine biodiversity, there are very few fish left to catch,” said Oceans Campaigner Vince Cinches of Greenpeace Southeast Asia. Mr. Cinches cited the importation of fish from other Asian countries as a “clear sign that our seas have now collapsed and the local fishing industry, particularly the livelihoods of small scale fishermen, at risk.” To prevent what he described as an imminent fish shortage, Greenpeace met with officials of the FISHERS/PAGE 11

The backstage art of dirty politics LOCAL political parties are now realigning forces to form formidable tickets in preparation for the 2013 mid-term election next year. As usual, the local political front is free for all. This means, that while being aligned with national political parties (administration party or not) its bearing in the local front is insignificant. In other words, local political tickets are, actually, the driving force of national candidates. This is in contrast to the Cris Diaz idea that national political parties dictate and create stronger political bets in the local front. In some sense, aligning with national political parties creates an impression of a powerhouse ticket in the local political arena. However, such impression is superficial. The significant of aligning with national political parties boils down only with perceived privileges. Among these privileges are allowing local party ticket to hire and deploy watchers in polling places and getting copies of election returns. Still, many believed that an alliance with the administration’s political party in the national level creates an advantage. The usual notion is that the administration would provide election money for its local counterparts. This contention is farthest from the truth. The advantage really is that local political parties identified with the administration could ask deployment of the armed forces to serve their political interest. In many instances, military and police commanders in areas perceived to be sympathetic to local oppositions are relieved of post before elections. Assigned military and police officers are under instruction to serve as protectors of administration’s political allies. Although this allegation is hard to prove, the perception is common anywhere in the country. It is part of power play, so to speak. As usual, those who enjoy the blessings of the powerthat-be exercise the grandeur of bullying political oppositions in any form - in every corner. Traditionally, the filing of charges of imagined and recycled corruptions against those opposing the political status quo pollute graft courts. The motive is obvious because administration candidates believed they could twist the arms of courts to decide in their favor. Definitely, those POLITICS/PAGE 11

Banking history Third of four parts FOR the last two days, we have been examining the history of banking in the Philippines. In this article, we will focus on the development of financial and legal reforms in the country. The Bangko Sentral ng Pilipinas’ “The General Banking Law Annotated: Book 2” identified the year 1949 as “a turning point in the monetary history of the Philippines” It marked the beginning of the country’s “post-independence monetary history” with the 1948 enactment of the Charter of the Central Bank of the Philippinessetting into motion the operation of the country’s monetary authority. It would also be important to note that the General Banking Act (GBA) became effective on the same day that the Central Bank started its operations

Speaking Out IGNACIO BUNYE on January 3, 1949. For the first time, explicit rules and regulations governing bank organization and operations were laid down. The GBA prescribed rules covering the establishment of domestic banks, the licensing of foreign banks, and the powers of banking institutions, branches and agencies of foreign banks. Another major banking statute, the Rural Banks Act, was enacted in 1952. Two years later, the Agricultural and Industrial Bank merged with the Reconstruction and Rehabilitation Fund to form the Development Bank of the Philippines (DBP).

During this period, the Central Bank was actively engaged in the establishment of development banks. It also provided rural banks with 100% counterpart financing for equity and access to rediscounting facility at highly subsidized terms. Another major piece of legislation enacted under the Philippine Republic was the Law on Secrecy of Bank Deposits, which discouraged private hoarding by encouraging the public to deposit their money in banking institutions. By the 1960s, the ability of banks to mobilize funds via deposit accounts

was constrained primarily by relatively low yields of these instruments. This was because of regulations imposed upon traditional deposit accounts, including the reserve requirement, ceilings on interest rates, and taxes. In response to the growing corporate demand for funds, a small number of non-bank financial institutions started trading shortterm instruments of banks. The banks followed suit by issuing unregulated shortdated instruments such as repurchase agreements, certificates of assignment, certificates of participation, and dealer promissory notes-collectively known as deposit substitutes. It was during this time that the trust fund management services were first offered by commercial banks. Another significant law, which created the BANKING/PAGE 11

BPI bares operating results for Q1 THE Bank of the Philippine Islands (BPI) reported a net income of P9.4 billion for the first half of the year, 52% higher than the P6.2 billion realized in the same period last year. This translated to a 21% Return on Equity and a 2.3% Return on Assets. Net income for the second quarter was P3.6 billion, 8% higher than a year ago due to the 9.4% increase in net interest income but tempered by the higher tax line. Both non interest income and operating expenses were relatively flat against the same quarter last year. For the fi rst semester, the signifi cant growth in profits was mainly driven by the 24% improvement in revenues. Net interest income rose by 9% while non-interest income surged by 51%. Improvement in net interest income was due to the combined effect of a P32 billion increase in average asset base and a 14 bps improvement in net spreads. Non-interest income was boosted by the extraordinary level of trading gains

in portfolio, asset quality continued to improve with net 30-day NPL ratio at 1.4% from last year’s 1.8%. Reserve cove r was 140.7% Total intermediated funds amounted to P1.46 trillion as the Bank’s total de-

posits stood at P734 billion with growth coming largely from low cost deposits. Assets under management was P730 billion, a 15% growth from last year. BPI’s market capitalization was P265 billion at end of June and remains the largest among domestic banks. Its Basel 2 Capital Adequacy Ratio (CAR) was 14.5%. Mr. Gil A. Buenaventura, Senior Executive Vice President and Chief Operating Officer of BPI commented, “We are happy to see that loan growth has remained resilient though slightly below the first quarter performance. We expect challenges going forward especially on our net interest margin with the recent cut in the BSP overnight borrowing rate. We will however try to seize opportunities given the continued domestic economic growth, notwithstanding the impact of the Eurozone slowdown. At this point in time, we are on track with our target of delivering a sustainable 15% return on equity.”

rights violations, then it must withdraw the state of impunity that exists for military officials and members of government sponsored militias.” The group said that even as Aquino has promised to resolve cases of extrajudicial executions and other violations of human rights, “genuine reform to ensure the protection of civil society members continues to be lacking.” They noted that the Aquino administration continues to implement Executive Order 546, which allows the use of paramilitary forces and private militias for its counterinsurgency program Oplan Bayanihan. The groups expressed alarm over the killing of two prominent civil society activists and the detention of an advocate for indigenous peoples’ rights. On July 3, Willem Geertman, executive director of CSO Alay Bayan-Luzon Inc., a citizen’s disaster response group in Central Luzon, was murdered in his office compound. Days earlier, on June 30, Romualdo Palispis, chair of the human rights organization Justice and Peace Action Group in Aurora, was gunned down in front of his home. He said the principle of judicial controversy, the issue of illegality or irregularity, if any, of the search warrant issued by Judge Escatron should have been settled in court that issued it, in due deference to the principle of judicial courtesy, and not before the Office of the City Prosecutor in a summary proceeding without giving the complainant the opportunity to respond. The resolution was made obviously avoiding the required judicial proceeding in questioning it and summarily defied a lawful order by annulling it without complying with the proper procedure under the rules, he said. He described the prosecutor’s dismissal of the charge as “an apparent miscarriage of justice, a mockery of the law and a biggest block for the police to enforce the law” against illegal firearms and private armed groups. The new luxury model (known as ‘K9’ in the domestic market) went on sale in Korea in early May, and features a host of high-tech comfort and safety features, many of them never seen before on a Kia. “Derived from the English words ‘core’ and ‘quality’, the name of our new flagship sedan hints at the attributes at the very heart of the vehicle,â€? commented Thomas Oh, Kia’s Executive Vice President & COO of the International Business Division. “The word ‘Quoris’ conveys solidity, luxury and high-technology, all resonating together as a chorus. “Our decision to give this striking new sedan an unconventional name means it will stand out even further from the established crowd, driving Kia sales in what is a new segment of the global automotive market for Kia,â€? adds Mr. Oh. Innovative ‘active’ safety technologies The Kia Quoris will feature an array of high-tech driving assistance and active safety features. “Quoris adopts a number of intelligent safety technologies never before

seen on a Kia, in order to deliver maximum driver comfort and safety,� comments Chang-Ki Kang, Senior Vice President of Kia’s Namyang R&D Center. “The Quoris can cruise at a desired speed, maintain a pre-determined ‘safe’ distance from the vehicle in front, and even come to a complete stop if necessary. Quoris can also detect and warn the driver of approaching potential hazards using innovative audio, visual and haptic alerts. “Our new flagship sedan possesses remarkable abilities to monitor and detect changing traffic conditions, and is constantly processing information, immediately deciding the right course of action and precisely executing vehicle movement controls as necessary,� concludes Kang. Advanced Smart Cruise Control (ASCC) The Quoris employs Kia’s first radar-based Advanced Smart Cruise Control (ASCC). Located in the right side of the front bumper, the radar system constantly monitors the road ahead, up to a range of 174 meters. With ASCC activated, the Quoris monitors traffic conditions and speed in order to maintain a predetermined safe distance from the vehicle ahead. The driver can easily adjust this

Kia has won three design awards in the Automotive Brand Contest 2012, the latest of a series of honors for the Korean brand’s design team headed by Chief Design Officer, Peter Schreyer. The new Kia cee’d – launched in June 2012 – triumphed in the exterior category and also received an honorary special mention for exceptional innovation in the interior category. In addition, the high profile jury selected the Kia GT as the winner of the concept award. The Automotive Brand Contest 2012 award presentation ceremony will be held at the Paris Motor Show on Automotive Designers’ Night, 27 September 2012 .

CERATO COMPACT SEDAN

The all-new version of Kia’s global best-selling model, the Cerato compact sedan (also known as Forte in some countries), is scheduled to go on sale during the first quarter of 2013 at Kia dealerships in many overseas markets. Longer, lower and wider than the current car, with an extended wheelbase, the next generation Cerato will be manufactured with an all-new bodyshell structure.

distance by choosing from four options (52, 40, 32 or 25 meters at a speed of 90 km/h) using a button on the steering wheel. The Quoris will also automatically come to a complete stop, if necessary. When the stop is less than three seconds and traffic ahead moves off, the Quoris automatically moves forward, resuming the journey. For a stop longer than three seconds, the driver has to manually restart the vehicle by pressing the accelerator or pushing the resume button. Advanced Vehicle Safety Management (AVSM) The ASCC is linked to the rest of the vehicle controls by the Quoris’ Advanced Vehicle Safety Management (AVSM). Integrating the control of various vehicle monitoring systems, including the Electronic Stability Control (ESC), seatbelt mechanisms and multiple warning systems, the AVSM can alert the driver, pre-pressurize the braking system and activate the Pre-Safe Belt (PSB) system, depending on the anticipated level of a collision risk. Detecting a risk of a

collision, AVSM warns the driver in three stages via a loud audible alarm, a visual warning on both the Head Up Display (HUD) and TFT LCD cluster and a haptic signal on the seatbelt. Stage 1. At a low level of collision risk, a visual warning appears on the LCD cluster and HUD. Stage 2. At a higher level of collision risk, in addition to the visual warning, an audio warning signal is sent out and the haptic seatbelt is activated via an electric motor, sending strong vibrations through the driver’s seatbelt. Stage 3. When a collision is imminent, the AVSM automatically applies the brakes to reduce the impact speed. The electric motor and pre-tensioners of the PSB system are also activated to retract the seatbelt and hold occupants closer to their seats, ensuring maximum occupant protection and minimizing abrasions caused by contact with the airbags. KIA RACING

The birthplace of U.S. auto racing, Indianapolis Motor Speedway (IMS), is the site for Round Eight of the 2012 Continental Tire Sports Car Challenge (CTSCC). Kia Racing’s Infinity Audio Forte Koups take to the Brickyard for the first time, and Kia Motors becomes the first Korean automaker to take the green flag at the legendary 103-year-old racetrack. Co-pilots of the No. 10 Infinity Audio Forte Koup, Nic JÜnsson and Andy Lally, look to bounce back after a challenging race at Watkins Glen in Round Seven and regain the points lead in the Street Tuner (ST) class.

KIA MOTORS AMERICA

Kia Motors America (KMA) is the fastest-growing car company in the U.S. and two of its best-selling vehicles – the Optima and Soul – were awarded the highest ranking scores in their respective segments within the J.D. Power

features two radar scanners located in each of the outer corners of the rear bumper. Each is capable of detecting objects up to 70 meters away from the rear, and four meters from each side. Activated at vehicle speeds above 30 kph, BSD gives the driver a warning when a vehicle comes into the blind spot zone – an area approximately four meters wide along each side of the Quoris and extending more than six meters from the rear bumper. Compared with sonicbased BSD systems, Quoris’ radar-based BSD gives a longer detection range, which is also exploited by the Lane Change Assistance (LCA) system. LCA alerts the driver to vehicles approaching from the rear at high speeds from up to 70 meters away. If the system also considers the speed of approach to be a potential hazard – specifically if it calculates that a collision would occur within 4.5 seconds if no avoiding action is taken – it will illuminate a warning triangle graphic in the left or right door mirror glass

and activate a warning signal on the HUD. If the driver does not react to this visual ‘alert’, an audible warning is also sounded. Both the BSD and LCA systems can be deactivated by the driver, if required. Lane Departure Warning System While radars boast a superior ability to detect objects at long distances, cameras are used in Quoris to recognize the shape of closer objects such as lane markings. A forward-facing video camera is at the heart of the new sedan’s Lane Departure Warning System (LDWS). It monitors the car’s position in relation to lane markings and triggers a warning in case of unintended lane departures at speeds above 60 kph. Around View Monitor system Four cameras on each side of Quoris are used to create its class-leading Around View Monitor (AVM) system, which provides maximum convenience and safety during parking and low-speed maneuvering. Unlike the majority of competitors’ AVM systems with a field-of-view of less than a 270-degrees, the Quoris’ system offers a true 360-degree all-around view in eight different viewing modes, displayed on the Audio Video Navigation (AVN) monitor. Continuously synthesizing images from four cameras, the AVM provides a virtual ‘top’ view in motion, so the driver can easily have a full grasp of all his or her surroundings, maximizing safety for the car occupants as well as pedestrians. The AVM system automatically deactivates at speeds above 20 km/h.

Kia Motors will introduce the next generation Cerato compact sedan later this year in its home market of Korea under a new name – ‘K3’ (domestic market only). Also known as Forte in some countries, the Cerato was Kia’s global best-seller in 2011 with more than 445,000 units delivered.
