Quake leaves 71 people missing; 48 died, 52 hurt MORE than 1,000 government troopers Tuesday shifted to disaster response from security mode as the military sent all its air, land and sea assets in the Visayas region to find many missing persons who were victims of Monday’s magnitude 6.9 earthquake.

MILF lashes at Misuari COTABATO City––The Moro Islamic Liberation Front (MILF) on Tuesday lambasted the Moro National Liberation Front (MNLF) for declaring that thousands of MILF guerillas have left and joined the MNLF. Khaled Musa, MILF information deputy, said Nur Misuari, chair of a faction of the MNLF, was creating division among Bangsamoro people.

Misuari served as regional governor of the Autonomous Region in Muslim Mindanao from 1996 to 2001. He led a bloody revolt in Sulu shortly before the 2001 regional polls and fled to Malaysia and eventually arrested there.

Military hunts retired army general CAMP Panacan, Davao City-- Military authorities here have joined efforts in hunting retired Major General Jovito Palparan Jr. who has an arrest warrant for kidnapping and serious illegal detention relative to the 2006 abduction and disappearance of two University of the Philippines students.

Lt. Colonel Lyndon Paniza, spokesperson of the 10th Infantry Division, said all soldiers are duty bound to arrest Palparan once he is seen on site anywhere in Davao Region.

He said the headquarters of the Armed Forces of the Philippines (AFP) in Camp Aguinaldo has issued an order for the arrest of Palparan.

Paniza said even AFP chief Lieutenant General Jessie Dellosa articulated that he does not tolerate lawless elements within the

ranks of the military.

Paniza advised Palparan to face the justice system with the arrest warrant issued for his immediate arrest.

“We have to effect his arrest given that it has legal basis. Even ordinary residents can even invoke citizen’s arrest once they see Palparan in public,” Paniza said.

He vehemently denied that a battalion under the 10th ID is coddling Palparan.

Paniza said many soldiers also sympathize with Palparan who served the military for several years.

He said Palparan never achieved the rank of Major General without experiencing the rigors of soldiery.

‘No habitation policy’ to be imposed in Misor

A LAWMAKER has asked the Mines and Geosciences Bureau (MGB) of the Department of Environment and Natural Resources (DENR) to submit to the Sangguniang Panlalawigan the comprehensive list of “hazardous zones” in the province of Misamis Oriental.

Provincial Board Member Jimmy Caiña with colleagues Jesus Jardin and Benedict Lagbas, in a resolution, urged the MGB to submit to the Sangguniang Panlalawigan list of hazardous zones so the provincial government will be able to implement the “no habitation policy.”

Caiña explained that the resolution that he and two of his colleagues authored formed part of their condembation of the recent tropical storm Sendong.

“Resolved to request, as this body hereby requests the MGB-10 through its regional director to furnish in aid of legislation, the Sangguniang Panlalawigan of this province, copy of the declared hazardous zones or areas declared to be a no habitation to ensure at

all times the safety and security of the citizenry,” said the lawmakers in their resolution.

Caiña said that the unexpected and shattering effect of typhoon Sendong that claimed thousands of lives in the City of Cagayan de Oro and Iligan on December 17 last year is a message that no one could ever fail to remember.

He said: “This time, we are asking MGB to furnish us the list of the declared hazardous zones so we can do something to disallow our constituents to live in.”

“The criticism and condemnation as to who are to be held accountable for the many deaths of the typhoon Sendong cannot and will not erase the dreadful history,” Caiña said.

He said that the Sangguniang Bayans, Panglungsod and Barangays of the province as legislative and quasi-executive front liners in their respective municipalities and cities are in the best position to enact or adopt legislation discouraging the building of houses in these declared hazardous zones.

Comelec urged to implement electoral reforms in Armm INTERIOR and Local Government Secretary Jesse M. Robredo has asked the Commission on Elections (Comelec) to implement soon several electoral reforms, including new registration of voters, in line with the administration’s desire and call for transparency and direction in the Autonomous Region in Muslim Mindanao (ARMM).

Aside from new registration of voters, the DILG chief suggested to the poll body a review of assignments of elections officers involved in past election malpractices; provision for mechanism where cases in pursuit of the reforms should be filed; and conduct of voters’ education.

“In line with the needed reforms (at ARMM), the DILG, as one of the catalysts in the reform agenda program of President Aquino III, would like to respectfully request the Commission, under your able stewardship, to initiate or cause the introduction of schemes necessary to achieve the reforms intended,” Robredo

told Comelec chairman Sixto Brillantes in a letter dated January 26, 2012.

The DILG chief explained there is an urgency for the Comelec to implement the electoral reforms at ARMM because time is running short as the poll body and the region barely has only one year to prepare for the synchronized mid-term elections in May next year.

In his letter, Robredo said the conduct of a new registration of voters is necessary as this will reflect and assure a more truthful participation in the electoral exercises in the ARMM. “The need for a new round of registration is brought by the desire of the President to rid the area of vestiges and illegal operations institutionalized by the former administration that resulted to massive fraud and large-scale disenfranchisement of many bona fide and legitimate voters,” he said.

On the call for a review of assignments of poll body officers involved in past elec-

tion malpractices, Robredo said something must be done, including reshuffling them to ensure honesty and integrity in future ARMM elections.

“We will find it difficult to generate success if the same unscrupulous election officers will be allowed to remain in their posts,” he explained.

The DILG chief added that it is also important to provide for mechanism where cases in pursuit of electoral reforms can be filed to ensure facility in prosecuting cases in ARMM; and to educate the electorate in the region to boost their level of awareness and develop their values on the importance of uncompromised votes.

“Voters education at the ARMM is also a must as this would also address their basic rights, duties and obligations in every election, and letting them go of their old practices of selling votes and lending participation to corrupt practices that prevailed in the past during elections in

the region,” Robredo said.

Reports said the Comelec would need a P300 million budget to implement the much needed electoral reforms at ARMM. Maguindanao Gov. Ismael “Toto” Mangudadatu estimated that it would need at least P75 million, or P25 million each for the

five ARMM provinces, to implement it.

President Aquino has appointed last December former Anak Mindanao party-list Rep. Mujiv Hataman as officer-in-charge governor of ARMM which is composed of Maguindanao, Lanao del Sur, Basilan, Tawi-Tawi and

Sulu.

Last October, the President announced the allotment of P8.59 billion, out of the P72 billion “stimulus fund,” as ARMM transition and investment support fund to stimulate social and economic development in the highly-impoverished region.

‘Sendong’ victims now dwell in army bunkers

THE Department of Social Welfare and Development yesterday said that 101 family-survivors of Typhoon Sendong are now occupying 12 bunkhouses in their permanent relocation site at Xavier University-Ecoville in Lumbia, Cagayan de Oro City.

DSWD Secretary Dinky Soliman said that 40 families had already transferred to the relocation site during Pres. Aquino visit in Cagayan de Oro last month.

She said that 61 other families joined the initial evacuees on February 1 while an additional 19 families are moving to the XUEcoville site soon.

Soliman said that latrines, bathing, kitchen areas and lighting fixtures are also included in the bunkhouses built by the army’s 52nd Engineering Brigade.

According to Soliman, families now temporarily housed at the West City Central and City Central Schools will move to Calaanan tent city starting February 10 to 15.

She said the number of families for transfer to Calaanan depends on the number of tents vacated by families now occupying but are moving to the ‘core shelter’ unit under construction in the area.

At least, 501 families are still at the West City Central School and another 171 families at the City Central School.

Comelec sets resumption of Armm voters’ registration on March 5 MARAWI City, Lanao del Sur––The Commission on Elections (COMELEC) has resolved to resume the system of continuing registration of voters and validation of registration records in the Autonomous Region in Muslim Mindanao (ARMM) on March 5, 2012.

The resolution provides for the resumption of voters’ registration in ARMM

to give the Commission sufficient time for the conduct of pre-election activities and other preparations in connection with the May 13, 2013 elections.

Earlier, the COMELEC deferred the registration in the autonomous region because of the pending case questioning the legality of Republic Act 10153

on the synchronization of the ARMM elections with the May 13, 2013 National and Local Elections and in anticipation of the conduct of the ARMM elections at a later date.

The voters listing was originally scheduled to start on October 1, 2011 to October 31, 2012.

istration, Yasin said the activities to be conducted from March 5 to October 31 also include validation of voters registration records or the taking of the biometrics such as pictures, signatures, and thumbmarks of registered voters whose biometrics were not taken during the previous registrations due

to defective computers or peripherals.

He said the rules and regulations on the system of continuing registration of voters and validation of registration records of the deferred COMELEC Resolution No. 9271 promulgated last August 12, 2011 shall now apply.

Butuan garbage collection plunges from 95 to 18 tons

BUTUAN City––Daily garbage collection here has plunged from 95 tons to 18 tons, a report from the city mayor’s office said.

Ruth Jugao, chairperson of the city government’s Clean Ground Zero Waste program, said the previous daily waste and garbage collection of 95 tons 70

percent of which came from the public markets, “is now down” to 18 tons.

Jugao explained that since the local government has employed the Verme Composting Method in the city’s 86 barangays, the daily garbage take has been substantially reduced.

The system uses degrad-

able garbage to propagate earthworms for the production of organic fertilizer, she said.

She noted that the Verme Composting Method appeared to have solved the garbage problem here.

Jugao thanked the public and barangay officials for their cooperation and support to the city government’s Clean Ground Zero Waste program.

CARAGA Region––The 15th Caraga Regional Athletic Meet kicks off tomorrow, February 9, at the sprawling Democrito O. Plaza Sr. Sports Complex in Patin-ay, Prosperidad, Agusan Sur. Regional Director Abner Caga of the Philippine Information Agency (PIA-13) told Mindanao Daily (MD), the grand opening last Sunday saw the turn-over of the 2011 Athletic Meet banner by Surigao Norte Provincial Administrator Primolito Plaza to this year’s host province, represented by Agusan Sur Gov. Adolph Edward Plaza.

To show action in the week-long sportsfest are some 3,000 elementary and secondary athletes from different divisions of the Department of Education (DepEd) in Caraga Region.

How to have it all

Jibber Jabber with Ace Fredrian Xavier Busico BEAUTIFU lawns, spacious homes, and happy families: these are the hallmark of a dream neighborhood. But if you look beneath the veneer of gracious living, you will see a battle raging, a battle for control. You will see combatants everywhere engaged in skirmishes and people fighting fiercely to have dominion over the world around them.

A person in authority wants to have control; a control over his employees and his surroundings. Government officials want control over peace and order.

The Battle of control is also evident in marriage.

Take for example, the husband controlling the wife’s expenses to prevent the latter from draining the gravy well. Another would be a wife controlling the finances of the husband to prevent it from going to the mistress.

In the relationship setting, the girlfriend would send out signals to thwart the boyfriend from cheating. Control is also palpable in family, where the parents would do extreme measures to discipline the child. Control also exists in religion. Elders would attack other religion, brainwash the innocent, or threaten them just to control them and not to leave the home club. The battle of control exists almost anywhere and it is a constant struggle.

Some people would sleep at night telling themselves they do not have control issues but unfortunately, they could not for they are too busy figuring out how to bend people to their will.

There are those who try to control destiny but destiny end up controlling them. Failure comes when we are not able to control things. There are even people who fear losing control of situations and worse, losing their sanity. We all need to have control over many things: life, love, finances, work, and many others. Some people feel comfort the moment they are able to have control.

Control is a challenge and is a monumental task.

Control is extraordinary when people employ tactics to obtain it. Some rely on deception while others engage in outright trickery. Then there are those who resort to extortion because we know that to lose control, is to put our fate in the hands of others. Until the next Jibber Jabber.

Before Fitzgerald himself died years later, he carefully wrote his will and instructions on how his riches were to be handled.

He wanted an auction

They were worth millions of dollars, so many rich people from all over Europe came to the auction.

Among all the valuable paintings, however, was 1 cheap, poor quality painting by an unknown local artist.

It was a painting of Fitzgerald’s only son.

Fitzgerald had ordered that this painting of his son be sold first before any of the other expensive paintings.

Yet, because it was of such poor quality no one wanted to buy it.

Finally, an old servant of Fitzgerald who had known the son and loved him offered to buy the ugly painting for only a couple of dollars.

Then, before they continued to sell all the expensive, valuable paintings, the lawyer read out loud from Fitzgerald’s will. Fitzgerald had written: “Whoever buys the painting of my son also

gets everything else that I own. The auction is now over.” That old servant who truly loved Fitzgerald’s son got everything! All of Fitzgerald’s valuable art, money, houses, land, the servant got it all!

Remember, God said that if we love and live for Jesus Christ, God’s only Son, then we also will become God’s children and have all that God has to give us.

But you and I must choose to love Jesus and live His way every day, instead of our own way.

Jesus said that’s the only way you and I can have it all.

So why not become God’s son or daughter today?

Simply ask Jesus to take full charge of your heart and way of living, for the rest of your life.

Just Think a Minute.

The vanishing species DISASTER preparedness is a new subject. In the early 50s’ earthquake and fire drills are strangers. What most people learned of then were drills on putting off factory and company fires.

Earthquake drills were never heard of then. Perhaps, a decade after the war, bomb drills were more popular at that time.

Today, earthquake and fire drills are common. Schools, manufacturing Cris Diaz companies, public and private offices are now required to learn the basic on various drills. It is time to include typhoon drill, too.

All these drills are design to save lives and limbs of humans in times of disasters, calamities (man made or natural) and all other forms of tragedy.

Nevertheless, learning the basic on these drills are not enough. One should have equipment to compliment all these things. While these (combined preparedness of equipment, training and expertise) can help reduce casualties in times of disaster, it does not assure anyone to survive.

Why it is only now that we find these all sorts of drills necessary? Have planet Earth became dangerous that human survival arrived at an edge of extinction?

Willard Wells, a theoretical physicist, has developed a statistical model that he believes ‘predicts with unprecedented accuracy not just how humanity will collapse, but when’.

Wells theory is base on three models, businesses, stage productions, and the human race. He argued that

these models ‘lacks a finite lifespan, and each is made up of members who can prolong the institution even after its individuals die.’

Wells went on to explain that nature has its own way of preserving and destroying itself – including the human species.

‘Self-extinction will soon be a feasible scientific outcome, thanks to advances in genetic engineering, robots and other technologies,’ Wells explained in a talk in the Atkinson Hall at the University of California San Diego about three years ago.

While Wells doomsday skepticism of the survival of 4 billion Earth people could be likened to the ‘Great Flood’ that cleanse the scams of Earth, two things are familiarly attached to his theories.

One, the global population that exploded since the 1950s and, two, the advancement in technology and scientific invention at an unprecedented height had jeopardized Earth’s natural capability to nurture survival.

How far can Earth hold the largest population is not a question. What really gives us something to think about is the capability of the planet Earth to maintain its natural balance.

Talking about natural balance, we inevitably direct our thoughts to natural calamities, disasters and catastrophes as the principal culprits.

No, these are not the culprits. These natural calamities are natural designs to maintain Earth load. Extracting deaths of thousands of people in natural disasters is coefficient with the number of population in ‘zero ground.’

House to investigate P80M overprice in oil spill equipment plus possible ghost purchases of lighthouse spare parts

Special court for estate settlements, House Bill up in the making A lawmaker has filed a bill designating specific Regional Trial Courts in the country to act as a special court to attend to estate settlement cases.

“The proposed Estate Settlement Court (ESC) shall focus on and specialize in all cases of settlement of the estate of deceased persons. Thus, all estate settlement cases shall be concentrated in one RTC branch,” Rep. Arthur Defensor, Jr. (3rd district, Iloilo).

Defensor said the bill would achieve the needed undivided attention and focused expertise for the speedy and efficient disposition of estate settlement cases.

House Bill 5705, to be known as an “An Act Es-

tablishing Estate Settlement Courts, granting them exclusive original jurisdiction over cases for settlement of the Estate of deceased persons,” seeks to amend Batas Pambansa 129, otherwise known as an Act Reorganizing the Judiciary, which was enacted into law on August 14, 1981.

“Capital in the form of property are tied-up in long winding estate settlement cases, during which period of pending resolution becomes a dormant asset which otherwise could have been used to generate income and employment,” Defensor said.

Defensor said the bill seeks the immediate release of property to commercial circulation, making them

available for business transaction, with the ultimate intent of generating income, which, in turn, would be subject to taxation and help stimulate economic activity.

“Early settlement would also spur business activities and employment and generate more income for government in the form of taxes,” Defensor said.

In cases where the city is the capital of the province, the Estate Settlement Court shall be established in the municipality, which has the highest population, the bill provides.

Defensor said the ESCs shall exercise original jurisdiction to hear and decide all cases of settlement of estates of deceased persons,

regardless of the gross value of the estate.

The bill provides that decisions and orders of the ESCs shall be appealed in the same manner as appeals from the ordinary Regional Trial Courts.

Furthermore, the Supreme Court shall promulgate the necessary rules for the transfer of cases to the ESCs during the transition period, and for the effective implementation of the proposed law.

Defensor said the bill will complement with another measure entitled, “An Act granting Amnesty in Estate Tax,” which is intended to encourage the settlement of estates, by the grant of amnesty in estate tax.

CAGAYAN DE ORO CITY -- The Home Development Mutua l Fund, other wise known as the Pag-IBIG Fund, is condoning penalties of delinquent and unregistered employers from January 2 to June 30, 2012 under its penalty condonation program.

The program covers unregistered and delinquent employers, as well as employers who have Pag-IBIG coverable employees but have not collected membership contributions from them, said Juliano S. Banghal, Pag-IBIG Fund Cagayan de Oro branch manager.

He said employers who collected membership contributions and/or short-term loan amortizations from their employees but failed to remit the same to the Fund are disqualified from this condonation.

Similarly, employers who have previously availed of any penalty condonation offered by the Fund are also excluded from the coverage.

According to Banghal, the penalty condonation program seeks to protect the interest of Pag-IBIG members and provide employers practicable means to settle their membership contribution arrears.

It also seeks to compel unregistered and delinquent employers to register their employees to the Fund and provide them access to the benefits they deserve.

Those who want to apply for the program are required to submit an application for penalty condonation; list of employees with unremitted contributions; affidavit of undertakings; photocopies of payroll; and certified true copy of applicable proof of business existence such as business permit/mayor’s permit, Department of Trade and Industry (DTI) Certificate of Registration for sole proprietorship, Securities and Exchange Commission (SEC)

Certificate of Partnership or Incorporation for partnership/ corporation/trade association, Cooperative Development Authority (CDA) Certificate of Cooperative for cooperatives, and SSS certificate of membership.

Employers with approved

penalty condonation applications shall have penalties on their membership contribution arrears condoned. Said membership contribution arrears shall include employer counterpart contributions and dividends that should have been earned by these

contributions.

Pag-IBIG to condone delinquent, unregistered employers; not recividists

The House Committee on Good Government and Public Accountability has officially taken on the investigation on more than a billion pesos worth of lighthouse spare parts and oil spill equipment acquired by the previous administration and said to be excessive, overpriced and illegal.

In its hearing this morning, the Committee agreed to acquire jurisdiction over House Resolution 1640 authored by Bayan Muna Rep. Teddy Casiño.

The lawmaker said the DOTC’s purchase of P719,562,860 worth of lighthouse spare parts and P319,000,000 worth of oil spill equipment in 2009 was “excessive, irregular and illegal” and should be investigated

by Congress for possible malfeasance and misfeasance.

He revealed that P319M worth of Marine Environmental Protection Equipment (MEPE) alone appeared to be overpriced by P77,319,500.00 as observed by the COA in its March 22, 2011 Audit Observation Memorandum. “From a unit price of P48,386,100 per lot as provided by the Coast Guard, the approved budget for the contract ballooned to P63,850,000 per lot. The DOTC eventually purchased only five instead

of eight sets of MEPE. He said the Committee will also be looking into the prices of the other items that may have been overpriced by 40-50%.

Yesterday, in a vist to the DOTC stockroom in Ortigas Ave., Casiño confirmed that P260M worth of lighthouse spare parts remained unopened and unused for the last two years, proof, he said, that the Department had purchased too much for the needs of the Coast Guard.

“It seems that the DOTC bought so much equipment for the Coast Guard to handle. Sobrasobra na, napakamahal pa,” he stressed.

ONB’s 2011 record income jacks up networth to P 2.5 Billion ONB ’11 net comprehensive income hits P 428 Million for a record 38 % increase over previous year. With this record income, the widest and most modern rural bank’s networth or net capital reached P 2.5 Billion now exceeding the P 2.4 Billion minimum capital required of commercial banks. “ONB will not convert to KB status principally because of the lower 3 % legal reserves required by BSP from RBs as against the 21 % legal reserves for KBs” says Alex V. Buenaventura, ONB president.

The main contributor to ONB’s record net comprehensive income is the 72 % increase in loan portfolio from P 6 Billion in 2010 to P 10.4 Billion by end 2011. The biggest portfolio increase was realized from Mindanao government teachers under the DepEd-APDS Salary Loan Program. As of end 2011, ONB’s exposure to 48,467 DepEd teachers reached P 5.9 Billion for a whopping 109 % increase over 2010.

Earlier, Degamo aired his appeal for Malacanang’s assistance in rehabilitating public infrastructure damaged by the earthquake.

“We’re still recovering from onslaught of storm ‘Sendong’ last December so I’m appealing for help as the earthquake’s infrastructure damage is already affecting our economic activities,” he said.

He said the earthquake totally damaged three bridges in the province, making movement and access there difficult.

CAGAYAN de Oro City–– The Senate Committee on Climate Change and the Asia-Pacific Institute for Green Development will be holding a Regional Workshop for Effective Disaster Risk Reduction and Climate Change Adaptation on February 24, 2012 at the Provincial Capitol, Cagayan de Oro City.

The regional work-

shop intends to facilitate the translation of national policies and plans on climate change and disaster risk reduction into local plans, and the full implementation of the same towards more effective risk governance at the local level.

Specifically, it aims to discuss the alarming impact of disaster and climate change, present the Climate

Change Act, Disaster Risk Reduction Act, the National Disaster Risk Reduction and Management Plan (NDRRMP), and the National Climate Change Action Plan (NCCAP) as guidance on the preparation of the local plans.

The workshop also hopes to promote the integration of disaster risk reduction (DRR) and climate change

adaptation (CCA) into the local development plans and link local government units (LGUs), potential donors, national government agencies (NGAs), non-government organizations, and research institutions in the implementation of potential DRR and CCA strategies.

Meanwhile, the discussions during the workshop will focus on three

themes, namely, Disaster and Climate Change: Science, Impacts, and Policies; Integrating DRR and CCA in Local Plans; and Resources for DRR and CCA. Representatives from the LGUs, NGAs, NGOs, the academe, youth, media, private sector, and other stakeholders are expected to participate in this regional workshop. PIA-10
