House body to fast track passage of bill decriminalizing libel

THE House Committee on Revision of Laws is considering the early passage of a bill decriminalizing libel.

House Bill 476 authored

by Rep. Juan Edgardo Angara (Lone District, Aurora) seeks to abolish the penalty of imprisonment in libel cases, amending Republic Act 3815, otherwise known as the Revised Penal Code.

“The penalty of imprisonment in libel cases should be removed to strengthen media’s role in nation building. It is a sad reality that existing laws on libel have not been attuned to the evolving needs of the people

under a democratic system,” Angara said.

He said that while media practitioners are free to share their views publicly on issues that affect the nation and the people, they remain unprotected from the risk of imprisonment.

“While we recognize that socially-relevant issues must have room for open public debate, we do not safeguard the very people who risk their safety and career in order to report events that have escaped our critical eye,” the lawmaker said.

ZAMBOANGA City––Two motorcycle gunmen on Saturday attacked and wounded a radio broadcaster in his home in the central Philippine city of Iloilo, the media watchdog National Union of Journalists in the Philippines reported.

It said Fernando Gabio, who has a radio program in Radio Mindanao Network, survived the attack.

The gunmen escaped after the shooting and police said it is investigating the attempt on the life of the 62-year old broadcaster.

NUJP said the attack occurred at around 7 a.m. while Gabio was cleaning

his car in the garage.

“Gabio sustained a bullet wound in the right thigh.

He said he was cleaning his car when the men shot him. He tried to pull out his gun to retaliate, but the assailants sped away,” the organization said.

Nestor Burgos, NUJP chairman, said Gabio has been “hosting block-time

radio programs, especially during election periods attacking or defending politicians.”

Senior Superintendent Marietto Valerio, the city police chief, said investigators have yet to determine the motive of the attack.

He said police are looking whether the attack was connected to Gabio’s job and the killing of his cohost Neil Jimena in August 2011.

Jimena, who was also an informant of the Philippine Drug Enforcement Agency, was fatally shot in Magalona town in Negros Occidental province.

“We need people who expose anomalies and abuses, among other things,” Angara stressed.

He insisted that libel should be decriminalized in the light of protecting the right to speech and self-expression.

Under Article 355 of RA 3815, libel committed by means of writing, printing, lithography, engraving, radio, phonograph, painting, theatrical exhibition, cinematographic exhibition, or any similar means, shall be punished by prision correccional in its minimum and medium periods or a fine ranging from 200 to 6,000 pesos, or both, in addition to the civil action which may be brought by the offended party.

Under Article 356, the penalty of arresto mayor or a fine from P200 to P2,000 pesos, or both, shall be imposed upon any person who threatens another to

publish a libel concerning him or the parents, spouse, child, or other members of the family of the latter or upon anyone who shall offer to prevent the publication of such libel for a compensation or money consideration.

Meanwhile, Article 357 provides that the penalty of arresto mayor or a fine of from P20 to P2,000 pesos, or both, shall be imposed upon any reporter, editor or manager or a newspaper, daily or magazine, who shall publish facts connected with the private life of another and offensive to the honor, virtue and reputation of a person.

After the bounty-full meal, the Vice President then visited Bishop Jose Cabantan at his residence at Tilanduca Street of same city to render courtesy call.

After wards, Binay proceeded to the Capitol Grounds this city to join the populace of celebrating the annual Kaamulan Festival where he was invited guest of honor.

The Vice President enjoyed watching the street dancing and colorful floats representing the merging of the seven ethnic tribes of the province.

This is the first time that a vice president of the Philippines attended and participated in the annual celebration.

“Im very happy to visit your province (Bukidnon) to attend this momentous Kaamulan Festival and to see and meet my colleagues and friends,” the Binay said.

Memorandum of Agreement he signed last week with PNP Director General Nicanor Bartolome which kicked off the inauguration of the “Pulis Makakalikasan: 10 Milyong Puno, Pamana sa Kinabukasan”.

“Indeed, this is another convergence we are pursuing under the NGP, and this early, I can tell that it is going to be successful because of the commitment shown by PNP’s top hierarchy”, Paje said.

NOTHING BUT THE TRUTH While, we the people of Cagayan de Oro prevented the Save CDO Now Movement from deceiving us, the citizenry, we must remain vigilant.

Let us always bear in mind that there are still dozens of shadowy organizations like the Save CDO Now Movement which will always do whatever it takes to bait us in supporting their dubious causes.

We know that these shadowy organizations will always pursue their sinister plot to divide the people of Cagayan de Oro. We also know that there are despondent politicians who will always mislead the greater number of people.

These unscrupulous politicians will coerce shady groups like the Save CDO Now Movement and Mata na CDO as fronts to carry out devious plots.

Let us not compromise our vigilance. Although the people behind the shifty Save CDO Now Movement have been mortally wounded, they will not stop to harass the Cagayanons.

We expect them employing another scheme to discredit and divide the people of Cagayan de Oro. These organizations will continue to annoy us.

We know that organizations like the Save CDO Now Movement are financed by desperate politicians using taxpayers’ money.

Let us expose politicians who sow discontent among us. These politicians corrupt the minds of unwary citizens through deceit.

These politicians employ organized group, like the shady Save CDO Now Movement, Mata na CDO and other groups masquerading as professionals, to deceive us.

We, Cagayanons must stand together to resist, expose and spurn all efforts by any group, organization or politically motivated individuals and groups to divide us.

How can we stop oil companies from profiteering?

OIL companies increased pump prices again. This is the eighth oil price hike since the beginning of the year alone, amounting to a net increase of P6.75 ($0.16) per liter for gasoline and P6.50 ($0.15) for diesel. This would bring the prices of oil products in the country near its peak of P60 ($1.40) per liter in 2008 when the price per barrel of oil was at $147 and speculators were projecting (or wishing) that it would reach $200.

The following is a table, which tracked gasoline prices in the Philippine, published by www.alternat1ve.com.

The problem is between June and July 2008, when pump prices reached its peak, the price per barrel then was $147. Now WTI crude is being traded at $107.96 and Brent crude oil is at $124.17, still below its 2008 peak.

At Mean of Platts Singapore, gasoline is at $120.74 per barrel while diesel is at $129.50. So if we are to follow the formula that was being used by oil companies before, a P1-per-liter hike for every $3 per barrel increase, by the time the price per barrel goes up to $147, the price per liter of gasoline will be way past the P60.46 peak, around P5 ($0.12) more. And to think, the 2008 pump prices were already overpriced by 60 percent and the dollar to peso exchange rate was higher by $1.

Of course, oil firms claim that they are no longer using any specific formula, perhaps to hide their profiteering ways.

What is infuriating is that, as I have mentioned in my most recent analysis “The invisible hand of monopolies,” there is no concrete justification for doing so: there is neither a supply nor a demand shock. And there is no increase in production costs. Prices should

The City Executive must also address violations on anti-lettering ordinance to petty crimes. Creating a wholesome and safe urban center are manifestations of an orderly governance thereby creating confidence among local residents and visitors.

There are dozens of city ordinances that remain for implementation albeit with teeth. Emano must not hesitate implementing these ordinances. He has the right people who could execute these ordinances.

We have gone to places in the country where local government institutes strict compliance of local legislations. People who employ these ordinances are proud of their cities.

In Subic, the streets are clean. Not a thrown candy wrapper or a cigarette butt be seen anywhere. Guides always remind visitors on penalties for violators of the anti-lettering ordinances. Parking and no parking areas are strictly observed. Enforcing these ordinances is not a problem since city residents and visitors cooperate.

These things are attainable in Cagayan de Oro City, too. It only takes the Emano administration to let those ‘archived’ ordinances come to life. Emano must implement those ordinances without hesitation.

CARAGA Region––The Philippine Drug Enforcem e nt Age n c y ( P DE ACaraga) has intensified its operations in Agusan Sur over amid rep or ts that illegal drug traders are now engaging with residents of remote villages in the province.

PDEA-Caraga Director Joel Plaza said, along this particular effort they are reorganizing and strengthening the barangay, municipal and provincial D r u g Abu s e C ou n c i l s (DACs) that have become inactive for years.

He further said, they are l i ke w i s e pu rs u i ng partnership with other

stakeholders and the local organizations, “knowing that such groups will make a big difference in reducing cases of drug abuse in the province.”

He assured, however, PDEA is at the same time sustaining the fight in other parts of Caraga Region, since the drug problem could not only be confined to Agusan Sur. Only last year, PDEACaraga with the police and the militar y, have uprooted and subsequently burned several thousands of marijuana plants in the presence of the general public. “ The destructions

CAGAYAN de Oro City––The Estate Management Division (EMD) has admitted to have received reports about the so-called fake occupants at the Tent Cities in Sitio Calaanan, Brgy. Canitoan this city, but explained it cannot put on ‘hold’ status said occupants, as of yet.

Fil-Am Jessica Sanchez makes top 24 of ‘American Idol’ ANOTHER Filipino-American has made it to the top 24 of “American Idol.”

Sixteen-year-old Jessica Sanchez hurdled a grueling audition process presided over by celebrity judges Jennifer Lopez, Steven Tyler and Randy Jackson to snag a spot in the coveted Top 24.

The other contestants who made it to the top 24 are Creighton Fraker, Joshua Ledet, Reed Grimm, Heejun Han, Phil Phillips Jr., Colton Dixon, Adam Brock, Aaron Marcellus, Eben Franckewitz, Chase Likens, Jeremy Rosado, Deandre Brackensick, Jen Hirsh, Haley Johnson, Elise Testone, Erika Van Pelt, Chelsea Sorrell, Baylie Brown, Brielle Von Hugel, Hallie Day, Shannon Magrane, Hollie Cavanagh and Skylar Laine.

Jessica started singing at the age of 2, and counts Celine Dion, Mariah Carey, Christina Aguilera and Whitney Houston as her musical influences.

She said landing in the Top 24 was a dream come true. “I’ve been watching American Idol since I was five-years-old,” Sanchez said.

Host Ryan Seacrest joked that Sanchez brought her whole clan to the show.

“Your family is the biggest thing that has happened to us!” Seacrest said upon seeing the large group of people crowding around Sanchez.

“I’m doing this for myself [and]… my family,” Sanchez told Seacrest. “I’m tired of seeing my family struggle.”

Palarong Pambansa opens in Dagupan

DAGUPAN City––The Palarong Pambansa slated in Pangasinan on May 6-12, this year, will go “green” in line with the desire of the host province to make the games as environmentallyfriendly as possible.

This was disclosed by Vice Governor Jose Ferdinand Calimlim who said officials of the Department of Education (DepEd) agreed with this objective in a meeting with Pangasinan officials sometime in February.

Calimlim said during the Kapisanan ng mga Brodkaster sa Pilipinas (KBP) Forum here that in order to achieve a “Green Palaro,” the provincial government will ensure that the existing ordinance of the municipality of Lingayen, the main venue of the games, banning the use of styrofoam, plastic and other disposable materials, will be strictly enforced.

This means that athletes, coaches, DepEd officials and other delegates will be asked to bring re-usable plates and utensils to avoid the use of disposable nonbiodegradable materials.

This will also be relayed to all vendors who will be selling their products in and outside the game venue, the vice governor added.

200 riders expected to participate in 2012 Kaamulan motocross challenge MALAYBALAY City––The chairperson of this year’s Kaamulan motocross competition is expecting more than 200 riders and motor adventure enthusiasts to come together here and showcase their heart-racing stunts to more than a thousand spectators, at this city’s grandstand today (March 6, 2012).

“We are expecting more than 25 teams from the cities of Davao, Koronadal, Cagayan de Oro and even from Iloilo and Cebu as well as from Metro Manila,” said City Vice Mayor Victor P. Aldeguer, chairperson of 2012 Kaamulan Motocross.

Aldeguer said that he has personally received confirmation from team leaders and he is excited to welcome all of them to this city.

ALDEGUER that these teams showed their interest and support to this competition and I’m sure that residents and visitors of Malaybalay will be very pleased to witness a different kind of entertainment,” said vice mayor Aldeguer.

Aldeguer has already chaired the Motocross competition in the past 12 years since 2002 while he was still a city councilor.

The 2012 motocross challenge is one of the

major events of this year’s Kaamulan Festival.

The province of Bukidnon through provincial governor Alex V. Calingasan, has allocated P400, 000 for this competition.

The Kaamulan Festival recently had its soft opening on February 16. On Saturday, different contingents from the different municipalities of Bukidnon participated at the Kaamulan street dancing.

Prizes for different categories and levels are listed for the qualified rider teams. There are two tracks open, the Flat Track and the Motocross. For Pro Open, first place has a total prize amount of P5,000 while second place has P4,000 and third place will have P3,000.

Expert Open has the first place prize of P4,000 while second place has P3,000

and third place has a prize amount of P1,000. Consolation prizes of P1,000 and P500 will be given to the fourth and fifth placers, respectively.

Other categories include Intermediate Production Open, Novice Production Open, Intermediate 125 Enduro, Novice 125 Enduro.

There is also an Executive Race for the two tracks.

The Office of the City Vice Mayor coordinates with the Kababayan Riders Association for a New Cultural Harmony and Order, INC. (KARANCHO, INC.) in facilitating the competition proper.

The Kaamulan Motocross will officially open on March 6, 2012 and will have a championship race on March 7. Interested participants can have their registration on March 5.
