CAGAYAN de Oro City––The Philippines is fast losing its stature as the leader in global marine Biodiversity that will surely impact on the Filipinos health, social and economic life because of climate change, ocean pollution and overfishing, the international environmental group Greenpeace said Thursday.

Vince Cinches, oceans campaigner for Greenpeace Southeast Asia, said that if government will not act fast enough, Filipino communities that rely on the rich marine ecosystems for food will go hungry. If the Aquino administration does not act fast enough to mitigate the problem, some 1.2 million jobs in the fishing, tourism and the food sectors will be directly affected by poor oceans management, Greenpeace said in a statement. “We are an archipelagic nation. Soon, we will become the epicenter of global marine adversity if our government agencies refuse to acknowledge and address the crisis at sea,” said Vince Cinches, Oceans Campaigner for Greenpeace Southeast Asia. Illegal mining operations stopped By AL JACINTO of Mindanao Daily News PAGADIAN City––Authorities on Wednesday shut down dozens of illegal mining operations in the southern province of Zamboanga del Sur, enforcing a long-due government order to halt all forms of destructive mining practice in the area. The operations, which started on Tuesday, targeted small-scale miners who are members of the Monte de Oro Small Scale Miners Association operating in Balabag Hill in Bayog town, where the TVI Resource Development (Phils.) Inc. also operates. A police convoy, briefly halted by a roadside explosion in the town, swooped down in Balabag and dismantled dozens of rod mills and other structures used by illegal miners. Cops nab cop, wife for drugs By Ben D. Arche of Mindanao Daily News DAVAO City––Police officers of the Sta. Police Station here arrested a policeman and his wife in a buy-bust operation in Barangay 21-C Poblacion this city the other day. The suspect identified as Senior Police Officer (SPO) 1 Abdulgani Baiting Abduhasad, 54, married and resident of Purok 78 Riverside, Barangay 21-C Poblacion is detailed at the Sta. Cruz Municipal Police Office in Davao del Sur. Chief Inspector Ceazar Cabuhat, Sta. Ana police chief said they were able to arrest the suspect and wife, Leonida Orbeta Abduhasad, 54 years old after receiving a report from a confidential informant. During the buy-bust, Cabuhat said a man handed over a sachet of shabu to the police officer pretending as buyer. Later, they identified the man as SPO1 Abduhasad, he added. Recovered from Abduhasad was a sachet of shabu worth P500 and another 11 sachets worth P60,000 from the wife. Senior Superintendent Ronald Dela Rosa, Davao City Police Office (DCPO) director, confirmed that the suspect is a member of the Philippine National Police (PNP). Dela Rosa said the suspect was under his command being the director of the Davao del Sur Provincial Police Office (DSPPO) before. The suspect denied having knowledge with the activity of his wife. But the arresting officers tagged the suspect as the one who gave the prohibited item. Charges for violation of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002 are now being readied against the couple.

‘Mindanao peace pact will eradicate kidnapping, extortion’ By Rene V. Carbayas ISABELA City, Basilan––The successful implementation of the peace framework agreement between the government and the Moro Islamic Liberation Front (MILF) would result in the normalization of the peace and order situation in conflict-affected areas in Mindanao and will lead to the eradication of such notorious crimes as kidnapping, banditry and extortion, ARMM officials said. In a statement, Police Chief Superintendent Mario Avenio,

head of the ARMM Police Regional Office, said the successful implementation of GPH-MILF Framework Agreement was “the key to a much-improved security situation in the region, paving the way for stability and progress.” With the peace framework agreement, Avenio said he expects the police to intensify the campaign to implement legal orders such as arrest warrants issued by the courts against criminal elements like kidnappers, extortionists and bandits. “The police will pursue its legal offensives against individuals

who disrupt the peace, order, and tranquility without considering the hapless civilians victimized by their dastardly acts,” Avenio added. The official added that the implementation of the peace framework agreement would impact in the peace and order conditions in key Mindanao areas notorious for kidnapping and extortion activities “These kidnappers and other criminals thrive in areas where there is conflict between the military and rebel forces. They take advantage of the situation in

pursuit of their criminal activities,” said one police official who requested anonymity. “We hope that once the peace and order situation in these areas are normalized with the elimination of kidnapping, extortion and plain banditry, we can do away with those negative travel advisories from foreign countries that is giving Mindanao a bad image here and abroad,” the official said. He added that with peace coming to Mindanao, “we expect better law enforcement to follow as well as better tourism opportunities and eventually, economic

prosperity.” For his part, ARRM Regional Governor Mujiv Hataman said the breakthrough in the 15-yearold peace negotiations with the MILF “only indicates that the Bangsamoro people will soon harvest the seed of a lasting peace in Mindanao.” “The reforms that are being undertaken in ARMM are geared towards helping the government and the MILF eradicate, if not ease, the problem on corruption, poverty and unstable peace and order,” he said. Duterte-Carpio said that it would be better to legalize prostitution so that sex workers would not be in hiding anymore. In Davao City, the mayor said HIV cases did not come from female sex workers but from overseas workers or men who were sexually involved with other men. Duterte-Carpio said the city health office in partnership with a non-government organization had already extended social services to female commercial sex workers. “Our prostitutes were monitored and we have a partner NGO with city health office which conducts regular check-up on them and orient them about safe sex,” the mayor said.

Comelec bars 15 more party-list groups in the May 2013 elections

THE Commission on Elections (Comelec) has barred 15 party-list groups, including the Kapatiran ng mga Nakakulong na Walang Sala (KAKUSA), from participating in the May 2013 polls. “We are canceling their accreditation, therefore, they can no longer participate in the 2013 party-list elections,” said Comelec Chairman Sixto Brillantes. In its report entitled “Sex Work and the Law in Asia and the Pacific,” the United Nations urged the Philippines and other Asian countries to decriminalize sex-related jobs. “The legal recognition of sex work as an occupation enables sex workers to claim benefits, to form or join unions and to access work-related banking, insurance, transport, and pension schemes,” the report posted on Yahoo News said. The report added that when decriminalized, the sex industry could now be subject to general laws regarding the health and safety of the workplace without discrimination.

The ceremonies were held at the Chinese Cemetery here in the city, morning of October 22, this year. According to Police Supt. Martin M. Gamba, PRO-13 chief information officer, the skeletal remains were earlier exhumed from mass graves in Nasipit,

Agusan del Norte on June 15, 2006; Barangays Taligaman, Pinamanculan and Libertad, this city, on June 21, 2006, February 12, 2012 and August 30, 2012 respectively. On April 3, this year, more skeletal remains were recovered inside a cave in Brgy. Poblacion, Bacuag, Surigao del Norte. Only those of 15-year old Sonny Boy Plaza and 38-year old Olong Mantilogco were identified, through forensic anthropological examinations conducted by RCLO-13.

Zamboanga to raise electric rates despite long, pestering power outages By AL JACINTO of Mindanao Daily News ZAMBOANGA City––Zamboanga, touted as one of the highly-urbanized cities in the Philippines, is now suffering from pestering power outages and despite this problem, the local power cooperative is pursuing a new hike in electricity charges. Residents have been complaining of long hours of blackout almost several times every day and that this has been going on for weeks now. The power outages also damaged many of their appliances. The Zamboanga City Electric Cooperative has blamed the lack of sufficient power supply in Mindanao as the cause of the blackout. It said this is aggravated by the maintenance shutdown of the coal-fired power plant run by Steag State Power in Misamis Oriental province. Just this year, the Zamboanga City Electric Cooperative also inked a deal with Aboitiz Power’s Therma Marine Incorporated (TMI) for additional 18 MW (megawatts) of electricity and putting the burden of

paying P37 million to the consumers. TMI, which operates power barges in Mindanao, is also supplying electricity to other areas in Mindanao due to power curtailment imposed by the National Grid Corporation of the Philippines, which is owned by tycoon Henry Sy Jr. The Aboitiz Group has been involved in the Philippine electricity industry the past seven decades. It said it would allocate P35 billion more for Mindanao to increase power capacity in the region which is suffering from electricity shortage. But residents in Davao where Aboitiz Power plans to put up coal-fired power plants are strongly protesting because of the pollution brought about by this facility. Mindanao needs about 1,597 MW daily and its current power output is below 1,200 MW. In Zamboanga City, the daily power consumption is about 100 MW and the Zamboanga City Electric Cooperative gets a little over half of its total requirements. With the power outages

in Zamboanga, the Conal Holdings Corporation now is putting up a 100 MW coal-fired power plant, despite strong opposition from many residents in the village of Talisayan where it plans to operate. Conal Holdings has already signed a memorandum of agreement with the Zamboanga City Freeport and Economic Zone for the fossil fuel power station. And the coal-fired power plant was even granted a so-called “no-objection” resolution by the Zamboanga City Council, although

a few council members have rejected the project because of pollution and its effect to the environment. Last year, the head of the Zamboanga City Electric Cooperative was sacked by the National Electrification Administration (NEA) over anomalous transactions involving millions of pesos in funding. Many of its incumbent and former board directors were also removed and disqualified from holding any position in rural electric cooperatives in the country. Those accused denied all

allegations against them and said all their transactions were legal and sanctioned by the NEA which had denied it. Local business and civil groups, and politicians questioned the extravagant spending of the power firm despite its ballooning debts which reached over P1 billion. NEA installed Engineer Jesus Castro as Project Supervisor to oversee the operation of the cooperative, but he was also removed due to alleged anomalies. Communist rebel leaders said the power crisis in Mindanao is a “grandiose show” to deceive the people and force them to accept the privatization of power plants and the construction of dirty coal-fired power plants. “ The current power plants on the island are capable of producing enough electricity for all of Mindanao’s regions. The power plants are purposely not being operated at full capacity to create an artificial power shortage,” said Jorge Madlos, of the National Democratic Front. Madlos was referring to

the state-run hydropower and geothermal plants. “In Mindanao, the Alcantara, Dominguez and Aboitiz families exploited the situation to expand their power generation enterprises in the last two decades. Now, Henry Sy is using the same scheme to slowly buy out private and governmentowned power plants and monopolize control over the island’s energy sector. Since the energy sector is deregulated, Sy can raise power rates whenever he wants after he gains possession of the island’s power plants,” he said. “The monopolization of the island’s energy sector will further raise power rates and cause more suffering to the people of Mindanao. At present, power rates are already high due to profithungry independent power producers and the imposition of the Value-Added Tax.” The state-run Power Sector Assets and Liabilities Management Corporation said it was planning to privatize the Agus and Pulangi hydropower plants in Mindanao for reasons that the government cannot afford its maintenance.

CEB launches three more domestic routes from Western Visayas THE Philippines’ largest national flag carrier, Cebu Pacific Air (PSE:CEB) continues its domestic expansion in the 2nd half of 2012, with three new domestic routes launched from Western Visayas. Last October 25, 2012, CEB launched direct thrice weekly flights from Bacolod to Cagayan de Oro, and direct four times weekly flights from Iloilo to General Santos. On October 26, 2012, the airline will also launch thrice weekly Iloilo to Puerto Princesa flights. Both services from Iloilo will utilize an A319 aircraft, while the Bacolod-Cagayan de Oro service will utilize an ATR 72-500 aircraft. “CEB launched a total of 10 domestic routes from August to October, greatly increasing connectivity within the Philippines and enabling even more Filipinos to travel

by air. These three routes signify our commitment to increase accessibility to and from the Western Visayas region,” said CEB VP for Marketing and Distribution Candice Iyog. Iloilo, in particular, will be designated as one of CEB’s operational hubs on November 8, 2012, when the airline launches direct flights from Iloilo to Hong Kong and Singapore. FINALLY, the government is trying to do something about cybercrime. We’ve put up long enough with our emails being hacked, with porn popping up the monitor while our children are doing their homework, with so much blind hatred assailing the good and the innocent in our midst. It’s about time law and order was imposed on cyberspace! Holding on to Republic Act 10175 (popularly known as cybercrime law), we will clean our information highways, jail the criminals and Tweet happily ever after. Really? Can one law from Malacañang do it? No. Not without infringing on some basic human rights—thus the uproar against it even before the ink in Noynoy’s signature is dry. Cybercrime is monstrous, bigger than any nation on earth; stronger, even, than all nations combined. Criminal activity in cyberspace is abetted by a casually regulated digital infrastructure. Even the nation that thinks of itself as the most powerful on earth—for all its swagger over its scientific and technological superiority—cannot protect itself from operations and intrusions by rival nations. How then do we expect this ill-timed and dubiously conceived decree from a coconut republic to put a cyber monster down? What makes it look even more laughable is the budget to implement the Act: a puny 50 million pesos annually. Heller! Anybody there? Fifty million is loose change compared to RH Bill’s 13.7 billion! Clearly, the government does not know the enemy. RA 10175 says it will train enforcers—a cyber army carved out of the PNP? Both here and abroad, communication and information networks are mostly privately owned—how will the law deal with conflicting issues? What policies, processes and technology will be developed? How can the quantum of penalties be imposed? To persecute criminals in a universe where information travels at the speed of light, there are no automatic solutions. Does the government think it’s as easy as putting a delinquent across its lap and giving him a good spanking? Yes, I am judging its competence because it cannot even address the garbage disposal problem in its own backyard, or deal fairly but firmly with squatters—how can it equip itself against virtually anonymous netizens?

What would be the best remedy to protect the rights of aggrieved individuals but imposed sanctions through cyber laws? Libel in cyber laws should be specific. In other words, the complainant must secure and thread of printed conversations or chats as documentary documents in filing the case in court. Better rooms for Catmon pupils Cleofe Rollan, a Grade 2 teacher, cannot help but recall how her classroom in Panalipan Elementary School in Catmon, Cebu looked like before––dilapidated walls and capiz windows and termite-infested interiors. After all, she studied in the same school and spent her first grade in the same room, where she currently conducts her classes. Now, she can put all her worries about poor classroom conditions to rest, as her classroom is part of the two-classroom building refurbished through the School Rehabilitation Program of the Ramon Aboitiz Foundation Inc. (RAFI). The 1940 Gonzalestype school building was formally turned over in a simple ceremony last October 11. The SRP is one of the programs under RAFI’s Education focus area, which aims to improve the quality of education by providing learners and teachers with safe and conducive learning environment. The project adopts a collaborative strategy among RAFI; the Department of Education (DepEd); the LGU of Catmon; Parents,

Boosting public goods and services provision can curb corruption THE Philippines should efficiently provide public goods and services and create a business-friendly environment in an effort to stamp out corruption. Dr. Ronald Mendoza, executive director of the Asian Institute of Management (AIM) Policy Center and associate professor of economics, made this recommendation based on results of the 2009 AIM Enterprise Survey Data indicating that more corruption was reported by firms if they were located in cities with very poor business environments. The survey, which was implemented in the second quarter of 2009, covered about 1,740 firms in 29 cities in the country. “Results suggest that corruption affects Philippine SMEs (small and medium enterprises) in a very pernicious way,” he said in a forum recently organized by the Philippine Institute for Development Studies. Inc., told the regional newspaper Mindanao Examiner. The Zamboanga del Sur provincial government and the Mines and Geosciences Bureau of the Department of Environment and Natural Resources have previously ordered a stop to all hazardous and illegal mining operations in Balabag, especially those involving the Monte de Oro Small Scale Miners Association, but the unabated illegal mining activities still continue. The Monte de Oro Small Scale Miners Association insisted its operation is legal and even applied for a permit so its members can continue their activities, but the Provincial Mineral Regulatory Board also issued a resolution denying the group’s application to mine. Illegal miners have been operating in Balabag for more than a decade now and were largely blamed for the destruction of the mountain and environmental pollution in the town. In July, a private security guard shot Godofredo Jungoy, Jr. dead an illegal miner Wilbert Catampungan who was trying to smuggle chemicals and fuel inside an area where

the TVI operates. The company said the security guard was only defending himself after he had been attacked and mauled by a gang of mine workers. Greenpeace has long called on the government’s attention to help avert a fish crisis. Earlier this year, the Bureau of Fisheries and Aquatic Resources (BFAR) revealed that ten out of 13 fishing grounds in the country are heavily exploited due to illegal and unregulated fishing activities. Greenpeace is working to support fishing communities in the Philippines, particularly in places like Ticao Pass and Donsol which are home to vulnerable species such as whalesharks and manta rays. “We are in deep trouble. Remember the 7th Commandment— Thou shalt not steal— and the 10th, Thou shall not covet they neighbor’s goods. And what of gossip-mongering, forwarding uncharitable tweets (like when celebrities stage verbal battles in social media), fabricating and spreading black propaganda against political enemies? Think Thou shall not bear false witness against your neighbor—8th Commandment. These could even escalate to a crime against the 5th Commandment—Thou shall not kill—if the libel (or the bullying) is bad enough it leads to the fatal heart attack or suicide of the victim. Character assassination is cyberspace murder. Wh at C om m and me nt do pornographers and porn consumers violate? The

6th—You shall not commit adultery—and the 9th—Thou shall not covet thy neighbor’s wife. Even merely viewing porn while abusing yourself can already make you in a sense an adulterer. (Even if porn performer or consumer weren’t married, they still be committing fornication, s omething which in due time will likely mature to adultery). S o t here—C ommandments 5-10 violated. And all because our consciences have become so numb we take for granted the first four. The self and created goods have become gods. God’s name has been reduced to a meaningless interjection. The Lord’s Day simply means more hours spent on the internet. And the wisdom of our forefathers (and mothers) is dishonored by our sheer disobedience. Why was RA 10175 promulgated in the first place? The government is fighting the enemy by shooting at its weapons. Nothing beats a disciplined populace to make laws effective, even unnecessary, with every citizen policing himself. All cybercrimes are self-abuse at the bottom line. Hammer into the consciousness of our kindergarteners that God is present within them, and in due time we will have adults who will not abuse themselves nor cause others to do the same. And that’s the truth.

An attack of any kind is like a tsunami—it can swallow a whole barangay and before you can capture the culprit, it’s back to the sea. And how, pray tell, can you prove the presence of malice in an offender, if you can identify the offender at all? And if offenders are captured and found guilty, where will you jail them, even if only 0.1 percent of the 30 million internet users in the Philippines were convicted? The only merit I see in the cybercrime law is that it creates greater public awareness to the evil present in the technology information revolution, thanks to the noise coming from netizens who raise hell over their freedom of expression/speech. RA 10175 is but the beginning of a hoped-for solution, a solution that may never come
