Women’s group Gabriela and Catholic Bishops may have opposing stands when it comes to the Reproductive Health (RH) bill, but they are united when it comes to the issue of prostitution and its proposed legalization: both are against it. The United Nations, in a recent report it released titled “Sex Work and the Law in Asia and the Pacific,” said the Philippines and other Asian countries should legalize prostitution. This, the UN said, so that sex workers can be given access to basic rights. It also said that the decriminalization of the sex trade will help control the spread of sexually transmitted infections, particularly HIV. The UN’s study examines how the criminalization of prostitution has affected the lives of sex workers

across Asia and worsened the HIV epidemic. It surveyed sex workers in 48 countries across Asia to determine how prostitution laws affect the safety and health of prostitutes and their families. According to the UN, legal recognition of sex work as an occupation enables sex workers to claim benefits, to form or join unions and to access work-related banking, insurance, transport and pension schemes. It also said that when placed in decriminalized contexts, “the sex industry can be subject to the same general laws regarding workplace health and safety and anti-discrimination protections as other industries.” The UN said the legalization of prostitution takes the form of repealing of laws that criminalize sex

work, being clients to sex workers or engaging in activities associated with sex work. In the case of the Philippines, the report said Filipino sex workers remain highly vulnerable to STIs including HIV, as well as sexual and physical abuse due to stigma. This, the UN report said, despite the introduction and implementation of laws that seek to prevent HIV and protect infected patients from discrimination. Under Philippine law, sex work as well as businesses engaged in sex are illegal. These stand to be penalized by up to 30 days of imprisonment for the first offense, while repeat offenders stand to be imprisoned for up to six months. For all the attempts of the UN trade | page 10

Law enforcers to secure public on All Souls Day COTABATO City––Law enforcers in South Cotabato’s on Sunday ensured the safety of the public during the observance of All Saints’ and All Souls’ Days this week.

In Cotabato City, police director Senior Supt. Danny Reyes has ordered all four police stations to guarantee that the surroundings of public and private cemeteries are free from snatchers, robbers among others. Station 2 police are securing the public and Chinese cemeteries in Sinsuat Avenue while those from police station 1 will secure the Catholic cemetery. Reyes also ordered police visibility and put up assistance desks in all cemeteries. Likewise, traffic police will be deployed in all roads leading to cemeteries. Foot and mobile patrols

will be deployed starting October 31 in all first districts of Christian dominated towns of North Cotabato’s Pigcawayan, Libungan, Aleosan, Alamada and Midsayap. Colonel Roy Galido, chief of the army’s 40th Infantry Battalion, said soldiers will be deployed starting middle of next week to assist the police in maintaining law and order. Soldiers and police will be deployed in bus terminals and other public terminals to ensure safety of arriving individuals from other provinces to visit the grave of their loved ones.

3 Marines, 2 Abu Sayaff killed in Patikul firefight CAMP SIONGCO, Maguindanao/ Zamboanga City --Three Marines and two Abu Sayyaf (ASG)rebels were killed during a clash in Barangay Bakong, Patikul, Sulu on Sunday morning prompting the Western Mindanao Command (Westmincom) to launch an air, sea and ground assaults against the armed group. The firefight also left 10 other soldiers wounded, said newly designated Westmincom chief Maj. Gen. Rey Ardo. Ardo said that elements of 6th Marine Battalion Landing Team were conducting search operations for kidnap victims earlier sighted in the village of Bakong when they were fired upon by ASG men headed by “Tahil Sali” and “Radullah Sahiron” at around 6:30 a.m. Although outnumbered, the platoon fought back while the number of the rebels reportedly mounted while the shooting raged on. Two MG-520 attack helicopters were deployed at mid-morning to assist ground troops and naval forces in the shores of Patikul, a known lair of the ASG.

The helicopter gunships took turns in pounding ASG positions in the thickly forested portion of Patikul. Ardo said the Westmincom withheld the identities of the fallen Marines until their next of kin are informed. Westmincom spokesman Lt. Col. Randolph Cabangbang said one of the two slain ASG rebels was identified only as a certain Kaisar. Cabangbang did not identify the kidnap victims sighted in Barangay Bakong, Patikul, but among those believed to be in the hands of the Abu Sayyaf are Australian adventurer Warren Rodwell, 57, and wildlife photographers Ewold Horn, 52, from Holland, and Lorenzo Vinciguerre, 47, from Switzerland. Rodwell was kidnapped last December from his home in Ipil, Zamboanga Sibugay while Horn and Vinciguerre were kidnapped in February this year in Panglima Sugala, Tawi-Tawi. There were no updates on the fate of the hostages.

The occasion is a fitting tribute to dedicate our prayers to those who perished in the tragedy that Typhoon Sendong brought almost a year ago. We find the significant of the solemn observance to reminisce the memories of the departed knowing that they are now happy in the hands of the Creator.

Benefits for mentors, election staff get nod PUBLIC school teachers and election staff rendering services on elections days can now claim insurance and other benefits should anything happened to them while on duty. The House of Representatives has approved on third and final reading a bill granting free insurance coverage to teachers and other members of every board of election inspectors assigned during elections. House Bill 6528 also provides free insurance coverage for members of the Special Board of Election Inspectors (BEI), the Board of Election Tellers and their support staff assigned to various tasks that would ensure the conduct of fair and honest elections in the country. The bill grants a minimum of P200,000 death benefit to beneficiaries and free hospitalization until full recovery for

those who might suffer injuries or sick while on election duty. The bill also covers members of the Armed Forces of the Philippines and the Philippine National Police assigned as Board of Election Inspectors. A-Teacher Rep. Julieta R. Cortuna was the original author of the bill under House Bill No. 3710 that provides that the insurance coverage shall commence from the time the insured is exposed to any election-related risk. The bill also states that the coverage of election-related activities shall not be limited to the acquisition of election paraphernalia. The coverage terminates upon proper turnover of all election paraphernalia to the appropriate receiving officer or until any election-related risks are no longer present.

the ‘rebels’ fled, dragging along with them their dead and wounded comrades. Both military units belong to the 75th Infantry Battalion, Philippine Army, under Lt. Col. Aside from enjoying eternal bliss, we are also glad that the spirits of our departed loved ones are also happy of what we are now. They are jubilant seeing their survivors finally moving on with hopes of a brighter future. These, as more than 5,000 survivors of Typhoon Sendong now owned permanent homes. In spite of the tragedy, Cagayanons are grateful that the city government never left them in the dark. It is unfortunate ‘though that some vested individuals and groups are using Typhoon Sendong to pursue their political ends. We cannot but despise politicians employing all it takes to deceive us to gain support and sympathy. We cannot but be repulsed by individuals and groups who covetously project themselves as impeccable citizens. On the other hand, the people of Cagayan de Oro are fortunate to know beforehand the hypocrisy of politicians who are exploiting the tragedy of Typhoon Sendong. The commemoration of the days of the dead is timely for us to petition the spirits of our departed to madden politicians who tried to deceive us in times of distress. Let us petition our departed to spare our widows and orphans from devious politicians who want to grab power at the expense of their tragic deaths. It is, therefore, our fervent prayers that our departed intercedes in our behalf to enlighten politicians who are trying to wedge a conflict among us. We pray that the spirits of our loved ones and those who perished in the tragedy of Typhoon Sendong will drive away the evils in politicians who are sowing discomfort and disunity among us, Cagayanons. THE Supreme Court Monday stopped the anti-graft court Sandiganbayan from implementing the warrant of arrest it issued against former President Gloria Macapagal-Arroyo and her co-accused in the P366-million plunder case involving the alleged misuse of confidential/ intelligence funds from the Philippine Charity Sweepstakes Office. “The court issues a TRO, as prayed for, enjoining the Sandiganbayan from implementing its assailed resolution dated Oct 3, 2012 which directed the issuance of warrant of arrest against petitioner, among others,” the SC Third Division said in a two-page resolution. SC Acting Public Information Office Chief and Spokesperson Atty. Maria Victoria Gleoresty Guerra said the SC issued a temporary restraining order against the implementation of the Oct. 3, 2012 resolution issued by the Sandiganbayan finding

probable cause against Arroyo, former PCSO general manager Rosario Uriarte; former PCSO chairman Sergio Valencia, former PCSO directors Manuel Morato, Raymundo Roquero, Jose Taruc V and Ma. PUP to form Institute of Islamic Studies THE Polytechnic University of the Philippines (PUP) will establish an Institute of Islamic Studies to transform PUP into an epistemic community, a statement from the university said. “By establishing an Institute for Islamic Studies here in PUP, we are now given a chance to further study the history, beliefs, customs, traditions, aspirations and noble causes of our Muslim brothers and sisters. Throughout the centuries, Islam has been perceived and portrayed in different ways. Much has been said about this great faith, but many have yet to discover its fundamental precepts and doctrines,” PUP President Emanuel De Guzman said. De Guzman said the plan to create the institute emerged during the debates on the Bangsamoro Framework, an agreement between the current government and the Moro Islamic Liberation Front “to establish a new political entity and end the decades-old armed conflict in Mindanao.” “We are all for a real, just and lasting peace. We hope that the Bangsamoro Framework will provide the answers to the fundamental questions raised by our Muslim brothers and sisters regarding peace, justice and development. PRO-13 chief calls for optimization of anti-crime efforts CAMP Rafael Rodriguez, Libertad, Butuan City––“With the advancement of technology and the sophistication of how crimes are being committed nowadays, there is a need to optimize all possible means to minimize, if not to eradicate the commission of crimes in the community.” This was the gist of the message of Police Chief Supt. Carmelo E. Valmoria, Police Regional Office (PRO-13) director, during the ground breaking of

the proposed sub-station of the Tubay Municipal Police Station in Doña Rosario, Tubay, Agusan del Norte, October 24 this year. He recalled that decades ago, police stations were made of inferior materials, making them and their personnel vulnerable to enemy hostilities or to forces of nature, with only a few police stations built across the country. “Nevertheless, the PNP has found the best ways to face

this predicament with constant support from government,” he observed. Regional Director Valmoria was grateful for the unwavering support of other government agencies, local government units and even private individuals towards the realization of advocacies for the people of Caraga. “With all humility, we are proud to say that the PNP has gained its momentum in im-

Seven Communist rebels attacked the poultry farm of businessman Onyx Go after he refused to provide “protection money” to the NPA’s Mindanao Regional Party Committee. Army Capt. Alberto

Caber, 1st ID spokesperson, said the NPA had been attempting to extort P65,000 every month from Go who owns the poultry farm in Barangay Dalaon, Molave, Zamboanga del Sur. The farm’s loss was estimated at P4.5 million. The poultry farm owner reportedly received a phone call supposedly from the NPA and warned him of more attacks if he will continue to ignore the NPA demands of protection money.

KORONADAL City––Early this year, the provincial government of South Cotabato, in partnership with the national headquarters of Philippine Red Cross (PRC), has turned over a rescue ambulance to PRC – South Cotabato Chapter, but the initiative was not fully completed. At the launching of the Barangay Disaster Action Team (BDAT) and Red Cross 143 here last October 20, the donation was finally completed with the LGU giving its contribution to the project. Gov. Arthur Y. Pingoy Jr. handed a check amounting to P896,860.42 to PRC Chair and Chief Executive Officer Richard Gordon, who was here as guest of honor durin the local chapter election of officers. Gov. Pingoy explained, the amount constituted South Cotabato government’s counterpart for the purchase of the vehicle. The other half, he said, was charged against the Priority Development Assistance Fund (PDAF) of then Sen. Gordon. The governor said, the partnership began in a conversation with the senator inside a plane where he asked him “how we could avail of an ambulance. “Right there, he committed to give us one. A few months after, the rescue ambulance was delivered to us, even before we could pay our counterpart, which is 50 percent of the vehicle’s cost,” Gov. Pingoy recalled. PRC-South Cotabato chapter Administrator Dixie Villar confirmed the vehicle is their first rescue ambulance. It is a Ford Ranger complete with tools and equipment that volunteers can use in times of calamities, accidents, and disasters. At the event, the provincial government and PRC also distributed first aid kits -- with medical supplies, stethoscope, sphygmomanometer, forceps and other tools – to 199 barangays in the province. I was in Pagadian City, capital of Zamboanga Del Sur over the weekend to attend a Jaycee International Senators’ Annual Convention and Elections. Ms. Guia Gomez was Guest of Honor. Still the charming and beautiful and incumbent Mayor of San Juan, she came to represent her son, Congressman JV Ejercito Estrada who could not make it as he was advised by his doctors to take a total rest. Congresswoman Auring Cerilles played host to her. My visit was timely as I was able to get it direct “from the horse’s mouth” how Gov. Tony Cerilles, took the ball into his hands and raided, dismantled and drove away hundreds of illegal miners in a gold rush area within his province. Last week, a composite team of the LGU, DENR, MGB, police, AFP, NBI etc swooped down on Sitio Balabag, Bayog town in the Zambo Sur province, about one hour and a half land trip out of Pagadian. They dismantled CIP plants, ball mills and structures and facilities of the illegal miners who had been operating with impunity for many, many years. Portals of big tunnels were collapsed and closed using backhoes. The team was implementing the “cease and desist order” issued by the local MGB with the concurrence of the LGU. A land mine exploded earlier during the first day as the team was heading towards the target area but that did not stop and deter them from proceeding with their mission. Demolition teams, acetylene cutters, big hammers, mechanized tools like backhoes, etc. went into action. The government contingent was so massive that there was no resistance at all on site. Perhaps, they were not ready or expecting such drastic action. No one has done this before, in recent memory. When other illegal small scale miners saw the

TWO things make our hands full these days. One is the deadline of the registration of voters. Two, is the observance of the All Souls Day. The Commission on Election has set Oct. 31 as the deadline in the registration of voters – without extension. Port areas and bus terminals are also teeming with passengers trying to catch up the last trip. Passengers are going home to their provinces to Cris Diaz pay respect to their departed. The All Souls Day is on Nov. 1. In both occasions, two things had taken place. Would-be-registered voters lined-up by the hundreds at the Comelec. People also queue at port areas and bus terminals. At the Comelec, Chairman Sixto Brillantes admonished registrants for beating the deadline. ‘The Comelec accepts registration of voters two years before the election, why only now,’ Brillantes asked. The Comelec should not buy arguments that registrants are too busy in failing to register earlier. Truth is, majority of late registrants are recruits of politicians running for elective posts. For the past days, known politicians are hauling would-be-registered voters. In Cagayan de Oro City, a private vehicle of a politician was loaded with passengers who were heading for the Comelec. The hauling of would-be-registrants went on for several days. The politician is running for an elective post next year for the city’s first district. Where those would-beregistrants came from was not known. Whether the politician-candidate commits electioneering laws is another thing, too. What was obvious was that the vehicle used in hauling those registrants belonged to him. Is it not hard to prove ‘electioneering’ with the mere of vehicles in commuting would-be-registered voters? Well, it depends on how complainants would prove it. In the meantime, let us have a peaceful observance of the All Souls Day. So let’s watch more closely the aftermath of this. This is not the end of the story yet! Gov. Tony who once served as DENR Secretary during President Estrada’s administration showed us the way. He showed us how an LGU head should have the “balls” to bite the bullet to deal decisively with illegal small scale miners who pollute and devastate the environment, defy the laws and operate with impunity like “untouchables”. And to think that other politicians facing an approaching elections would rather “play safe” and not displease a sector that does not only deliver voters but also provide campaign slush

funds! Gov. Tony’s mantra, as national president of the JCI senate organization, is “YES to responsible and sustainable mining, NO to illegal mining”. And he means AND DOES what he says! But all told, Gov. Tony could not have done this single-handedly. He got the cooperation of the agencies and the national government. This shows it can be done if there is “political will” in various levels. The next concern is: who’s going to clean up the mess left in the environment after all those years of devastation and criminal neglect? We can’t rest on those accomplishments until those substances and wastes are removed. And those responsible be made accountable. *******

CONTINUITY --- During the Annual Elections of the JCI Senate in Pagadian over the weekend, the new President-elect Hermin Arceo has committed to continue Pres. Tony’s advocacy. JCI Vice President for Mindanao Bic Bic Garcia from General Santos City was a moving force in this pioneering work. ***** WE FAILED --- I recall that during my work in Mindanao in the past administration, we miserably failed in effectively grappling with the problem. In fact, the small scale miners (SSMs) in Diwalwal were more organized -- and determined -- to fight and resist government moves. In one occasion, the Diwalwal miners occupied a main bridge in the main highway, placed the coffin of a dead miner in the

middle of the bridge and for hours paralyzed traffic, causing a monstrous traffic jam for all vehicles heading north to Luzon and south. It was their dramatic show of defiance to government. I was tasked to handle the crisis at that time and eventually succeeded in convincing the protesters, led by Barangay Captain Franco Tito of Mt. Diwata, to lift the macabre blockade. This only succeeded when I called in the AFP’s Armored Personnel Carrier (APC), backed by fully armed soldiers and policemen and gave instructions to smash anyone and anything blocking the way, even running over the coffin if needed. They hurriedly cleared the area. But that was only palliative. No decisive and long term effort was done to enforce the law in the mining area in the uplands.

***** COMPREHENSIVE APPROACH --- This is not to say however that we do not take into account the realities. Thousands of poor miners labor and toil and even gamble life and limb to eke out a livelihood. Thousands come in hordes and descend on gold rush areas hoping to hit some breakthrough in their already miserable lives. They must be the ones to be taken into account FIRST AND FOREMOST. And it has to be a total inclusive approach, with no one excluded in the solution. I know this is the hard part. But whatever it is, we cannot allow the present situation in our gold rush areas almost everywhere in Mindanao to remain as they are. Something has to give. As what happened in Zambo de sur over the last few days.

(SM Prime), the Philippines’ leading shopping mall developer and operator, posted a 15 percent increase in consolidated net income for the first nine months of 2012, amounting to P7.40 billion from P6.41 billion during the same period in 2011. Gabriela Women’s Party Representative Luz Ilagan said the UN’s recommendation will not in anyway ensure the protection of Filipino women, children and men forced to engage in the flesh trade. “Legalization will not guarantee protection against sexually transmitted infection and HIV,” she said. Ilagan said it has been their experience working with prostituted women in Davao City through Talikala to help ensure protection from infection and HIV. This is done by increasing women’s awareness and education as well as ensuring women’s access to health services. She said that instead of legalizing prostitution, Congress should enact legislation to decriminalize it by introducing amendments to the Revised Penal Code. On the contrary, Davao City Mayor Sara DuterteCarpio is backing the UN proposal saying it will provide sex workers better access to basic rights––and that legalizing prostitution will help control the spread of sexually transmitted disease. Duterte-Carpio said sex workers will no longer be hiding once prostitution will be legalized. She belied reports that HIV cases started from a sex workers in Davao City. She explained that the HIV cases came from overseas workers, or men who are sexually involved with other men. The city health office in partnership with a nongovernment organization had already extended social services to female commercial sex workers, said the mayor. She said: “Our prostitutes were monitored and we have a partner nongovernment organization with city health office which conducts regular check-up on them and orient them about safe sex.” “Our present laws seek to penalize only the women engaged in prostitution. Prostituted women are treated as criminals rather than victims of poverty and gender inequality. Our laws do not penalize pimps, bar owners and operators or those who pay to use and abuse these women. Prostitution is a highly organized exploitative system. L e g a l i z at i on wou l d only give pimps, owners of prostitution dens and their customers the leverage to further exploit women as well as children and minors,” she said. Women are driven to prostitution not because it is a profitable, but because they are desperate and forced into it because of extreme poverty, unemployment and even human trafficking,” it said. The women’s advocacy group said legalizing prostitution will make the existence of syndicates of human trafficking, white slavery and child abuse, justifiable. “This would further corrupt our society with the view of women as sex objects. In a patriarchal society like the Philippines women are treated as lesser beings. They are oppressed and denied equal opportunities,” it said. “The oldest profession is not a profession at all; it is a cultural practice that should be abolished in the country.” Gabriela-ST coordinator Nonie Entena in a statement also said that prostitutes are not criminals. “They are victims of economic and gender inequality. They are unable to access the resources and services we have in the country, legalizing it will only justify the existence of such trade which will go further on more legal grounds on abusing women,” she said. Protect victims of prostitution In July 2011, GWP filed House Bill 4934, ‘An Act Repealing Articles 202 and 341 of the Revised Penal Code, and Instituting a System of

Protection for Victims of Prostitution’ precisely to address this issue. To date however, there has been no affirmative action on the bill by the House of Representatives. GWP Rep. Emmi De Jesus said the issue of prostitution should be approached in its entirety. “The government must cancel policies that reinforce the system of prostitution. Legal efforts should be directed against establishments, pimps and customers and all those who profit from prostitution, not against women and children victims of prostitution. Also, it’s important that policies and programs that will address the situation of the victims of prostitution and will protect them must be developed,” she said. As for President Aquino, Malacañang has already distanced itself from the issue, saying that it is something for Congress to address. Deputy presidential spokesperson Abigail Valte said the Palace has no comment on the issue because it is primarily addressed to legislators. “This is a decriminalization issue,” she said. PSCC chief Magno Adalin said police authorities will man all help-desks mounted in public and private cemeteries to address problems during the celebration. Nacaya, author of the Traffic Code, requested the committee to facilitate the implementation of the ordinance, which establishes a corresponding route code for every PUJ route in the city using the descriptive virtues of a good citizen. Nacaya said this supports the declaration of Cagayan de Oro as a City of Character under Resolution No. 4496-99 and Resolution No. 7676-2006. “What we are trying to do is to inculcate the virtues that we would like to see in the city,” he added. According to the councilor, PUJs can select from among the virtues listed under Resolution No 76762006. The resolution urges all city-based government and private institutions, organizations, associations and business establishments to adopt any of these virtues. Nacaya believes that the move will put an end to negative branding of PUJ routes like Patag Liner to “Patay” Liner, as routes will be known by the virtues they carry. Through this, he added, students and the public will be able to identify the routes according to the virtues adopted. Nacaya cited that this is a step towards positive changes in the city. “If we will not begin anything to change attitudes, wala ta maabot,” he cited. LANDMARK The committee also tasked the RTA to consult the transport group, coordinate with the City Tourism Office and City Tourism Board relative to the posting of landmarks that each route will pass by, which is also provided for in the traffic code. Councilor Nacaya said those plying the Cugman route can have a sticker or picture that will enable the public to know that it is where Malasag Park is located. Cloud Atlas: A tale of birth, death and re-birth

Cloud Atlas by directors Tom Tykwer, Lana Wachowski, and Andy Wachowski is a cinematic Odyssey based on a novel by British author David Mitchell. The story centers on six stories from the 1800s up to our distant future. The concept of the eternal soul links the vignettes as the characters of one story are reborn into another. From the travails of a young American in the mid19th century on a vessel crossing the Pacific to a female clone who rises up against oppression in a futuristic society, Cloud Atlas is a grand tale about lessons learned from previous lives. Lana Wachowski wrote and co-directed the film. “We started looking at the way the stories connected. We were immediately drawn to this concept what if the villain of one story is actually the hero of another story played by the same actor,” she said. To achieve this, each actor plays multiple roles. Tom Hanks is one of the leads. “On one page, you go from 1851 to 1974 to you know, dystopian future,” he said. The challenge was great says Halle Berry who has significant film presence and interprets six characters. “Each one of those characters, the soul evolved in order to have the strength

The cast also includes Jim Broadbent, Hugh Grant and Hugo Weaving, who is famous for his role as the sinister Agent Smith in The Matrix. Once again, Weaving represents pure evil. His goal is to tempt and stall the evolution of the soul. This $100 million production offers costumes and sets that highlight the film’s different eras. “The breadth, the scope, the vast amount of time and space the movie covers. Some buildings are just doors and windows and other buildings are great architecture,” said Hanks. But the film lacks the depth it promises. The stories meander and there are too many characters. After three hours we are lost between the past, the present and the future.
