The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of all States that have ratified and acceded to the Rome Statute. The Philippines’ departure from the ICC came in the wake of its preliminary examination into President Rodrigo Duterte’s bloody war on drugs that had killed thousands of suspected drug pushers. The ICC probe will determine if there is reasonable basis to proceed with an investigation into charges of crimes against humanity. The Washington Post also ran a recent article which

quoted a statement from Duterte who said the decision to withdraw from the ICC was because of “baseless, unprecedented and outrageous attacks” by U.N. officials and an attempt by the ICC prosecutor to seek jurisdiction in violation of due process and presumption of innocence. It said according to the Rome Statute, a state party’s withdrawal takes effect one year after the United Nations secretary general receives written notification. The statement argued that the rule does not apply because “there appears to be fraud in entering such agreement.” A number of African countries have also announced their intention to quit the ICC, including South Africa, claiming the court is biased against Africans. The African Union passed a nonbinding resolution pushed by Kenya in 2017 urging members to withdraw. The question of whether the ICC could or would investigate Duterte has been swirling since the early months of his presidency. The Washington Post report said since Duterte was elected in 2016, an estimated 12,000 Filipinos have been killed, either shot dead in police operations with high death tolls and few witnesses or assassinated by men on motorbikes, often after being named by police. Four months into the campaign, when the death toll stood at several thousand,

ICC prosecutor Fatou Bensouda said she was “deeply concerned about these alleged killings and the fact that public statements of high officials of the Republic of the Philippines seem to condone such killings.” Duterte responded by taunting the court and the killings continued. A year ago when a Philippine lawyer delivered a complaint to the ICC accusing the president and 11 associates of crimes against humanity, Duterte shrugged off the move. The Philippines signed the Rome Statute in 2011, which means the court has jurisdiction for crimes within its mandate committed there. However, the court can only act if it is clear that local authorities have failed to investigate and prosecute crimes — and this will be the sticking point. Duterte’s former spokesman, international lawyer Harry Roque, argued that local authorities can and will investigate crimes, so there is no need — or place — for the ICC to get involved. The Philippines will “bring to bear our national criminal justice system upon those who violate our laws,” he told a gathering of ICC signatories last December. But Duterte’s government has not made public any evidence of efforts to prosecute those implicated in drug war deaths. Instead, the president has repeatedly promised to

pardon, even promote, police linked to drug war killings. Roque’s “assertion that the Philippine government has been willing and able to investigate those deaths has simply not been true,” wrote ParamPreet Singh, associate director of Human Rights Watch’s International Justice Program, in a statement published Dec. 7, 2017. “The government’s claim of its preparedness to prosecute offenders is grotesquely deceptive.” (Mindanao Examiner. Misuari denied all criminal and graft accusations against him. While Misuari is enjoying his liberty, government leaders and residents of Zamboanga City are demanding justice for the deadly siege that left over 200,000 people without homes following weeks of street battles between security and MNLF forces that killed and wounded some 300 civilians. It was the second time that MNLF forces raided Zamboanga. In November 2001, Misuari’s loyal forces also attacked Zamboanga and left dozens of civilians dead and wounded. Heavily-armed MNLF gunmen also took hostage over 100 civilians, including women and children, and used them as shield and pawn so they can escape to Basilan and Sulu provinces. In 2016, Mayor Beng Climaco banned all MNLF rallies in Zamboanga City following attempts by Misuari’s group to hold a peace caravan. “I am giving you a categorical no, you must not disturb Zamboanga anymore. If you want to come up with your rally, make it in your area, Zamboanga will not welcome a rally by MNLF, not at this time because you still have to be accountable with the killings and devastations we are suffering from,”

Climaco said. “The destruction wrought by the 2013 siege continues to linger, as internally displaced persons – both Muslims, Christians and Lumads, most of whom are those who eluded the conflicts in Sulu and Basilan – have suffered the brunt of the MNLF attack in Zamboanga,” Climaco said. Misuari signed a peace deal with Manila in September 1996 ending decades of bloody war. After the peace agreement was signed, Misuari became the governor of the Muslim autonomous region. But despite the peace accord, there was a widespread disillusionment with the weak autonomy they were granted. Under the peace agreement, Manila would have to provide a mini-Marshal Plan to spur economic development in Muslim areas in the south and livelihood and housing assistance to tens of thousands of former rebels to uplift their poor living standards. Misuari’s loyal forces and former MNLF rebels, who joined the Philippine Army following the peace accord, attacked a key military base in Sulu’s Jolo town and civilian targets in Zamboanga in an effort to stop the government from calling an election in the autonomous region where Misuari wanted to be a perpetual governor. Misuari then escaped by boat to Malaysia, where he had been arrested and deported to the Philippines and was eventually pardoned and released by then President Gloria Arroyo in exchange for MNLF support to her election bid as well as her allies in the Senate and Congress in 2004. He also ran thrice for governor in Sulu even while under detention, but lost miserably. (Mindanao Examiner)

He said police arrested 5 Filipinos and Malaysian citizens, aged between 40 and 60, in Semporna on March 11. “Four of them are suspected to have been involved in the Maute terrorist group siege of Marawi City, Philippines, in 2017. They are also suspect-

ed to have given protection to Maute terrorist elements and several Middle Eastern nationals believed to be hiding in Sabah,” he said, adding, two others are suspected to be members of the RSF involved in 2013 attacks in Lahad Datu and Semporna. He added that those arrested were also allegedly recruiting Filipinos in Sabah to join the RSF, and that two other suspects - who fled to the southern Philippines after security forces battled RSF fighters – sneaked into Sabah November last year to revive their activities in the oil-rich state. Harun said that also on March 11, the police arrested 5 Filipinos and a Filipina, aged between 23 and 63, in Tambunan.

“One of the suspects, a construction laborer, is suspected to be a member of the ASG that was involved in the attack on Marawi City. The suspect sneaked into Sabah in December last year to escape the Philippine military operations. The five others are suspected to have given shelter to ASG and Maute terrorist elements who are still free,” he said. “With these arrests, the police believe they can trace and hunt the remnants of the ASG and Maute members suspected to be hiding in the country, especially in Sabah,” he added. Just last week, Filipino Special Forces killed two pro-ISIS militants, including an Abu Sayyaf sub-leader, whose group had kidnapped 21 mostly European and Asian holidaymakers 19 years ago on the resort island of Sipadan off Sabah in Malaysia. Angah Ajid was slain during a combat operation against the notorious militant group in Upper Binuang village in Sulu’s Talipao town. The operations lasted only 10 minutes after several gunmen managed to escape the assault. The military mounted the raid and utilized the 2nd Special Forces Battalion to take down Ajid after civilians allegedly provided vital intelligence that led soldiers to an Abu Sayyaf hideout in the remote village. “Military troops followed the directions provided by residents and encountered

five Abu Sayyaf members in the area. A 10-minute gun battle ensued, yielding to the deaths of sub-commander Ajid and another militant,” said Brigadier General Divino Rey Pabayo, Jr., commander of the anti-terror Joint Task Force Sulu. Pabayo said no soldiers were harmed in the operation and lauded the Special Forces for the slaying of Ajid, who was “the last remaining Abu Sayyaf leader involved in the Sipadan kidnapping in 2000.” He said soldiers also recovered from the area one M14 rifle and an M16 automatic rifle with grenade launcher, including ammunition. He said the series of armed engagements in the province is the result of the growing support of the civilians to the military’s anti-terror campaign. “The people of Sulu are tired of the atrocities committed by the Abu Sayyaf in their communities,” Pabayo said. Government workers to receive salary hike GOVERNMENT WORKERS will soon be receiving the fourth and last tranche of their salary hike despite the delay in the passage of the proposed 2019 budget. This, after Malacañang released an executive order (EO) modifying the salary schedule for civilian government personnel and authorizing the grant of additional benefits for both civilian and military and uniformed personnel. Executive Order 76 was signed by Executive Secretary Salvador Medialdea, by authority of the President on March 15, but a copy of which was released to media only recently.

“Considering that by the end of FY 2018, the FY 2019 General Appropriations Act (GAA) is still pending with Congress, Republic Act (RA) 10964 or the ‘FY 2018 GAA’ has been deemed re-enacted beginning O1 January 2019,” the order reads. “Due to the re-enacted of the FY 2018 GAA, there is a need to identify an appropriate funding source to cover the requirements for the implementation of the fourth tranche compensation adjustment for civilian government personnel scheduled in 2019 under EO 201,” it added. Under EO 201, civilian government personnel should have received

the fourth tranche salary in the beginning of January 2019. The Department of Budget and Management will be authorized to implement or adjust the compensation corresponding to auditing rules and regulations. EO 76 shall take effect immediately upon its publication in a newspaper of general circulation. Congress has failed to reach a consensus on the proposed 2019 national budget despite meeting with the President to resolve the budget impasse last week. Locsin said the country has much to hope for, and nothing to fear from the rise of a new power. This, as it hoped for a “new world” where a state’s goal to get richer is through helping others prosper. Citing what he wrote in the Philippine-China memorandum of understanding on the Belt and Road Initiative, Locsin said there is no other country, but the new China that aspired to rise higher by helping others rise alongside her. “To put it in concrete terms, without the new China, there will be no

prospect whatsoever for the developing world to grow into emerging economies. We would still be, as throughout the second half of the last century we were, at the mercy of Western markets which, on a whim, can turn us away—as they did throughout the post- and neo-colonial period,” he said during a joint presser with State Councilor and Foreign Minister Wang Yi recently. “The emergence of a new China is creating a world where the lesser have a chance. And more than a chance: cooperation for mutual benefit instead of words,” he added. On the two countries’ cooperation, Locsin and Wang vowed to deepen Philippines-China relations. Although a lot of work remains to be done, there are “greater advantages” in the two nations’

collaboration across a wide range of areas, he said. “There is so much to look forward to and accomplish that will be of much greater value to both of us than those differences can ever be to each one,” Locsin said as he also assured the Chinese official that Manila will look after the Chinese people in the Philippines. “You have our assurance that the Philippines will look out for your people in my country as I have seen China look out for our people in yours,” Locsin said. Lahat ng kasapi ay nakibahagi sa deliberasyon kung magkano at paano gagastusin ang calamity fund sa kabila ng pagkakabalam nito. Sinabi naman ni Vice Mayor Jun Piñol, na siya ring presiding officer ng Sangguniang Panglunsod (SP), na hindi sila ang dapat sisihin sa pagkabalam sa pagpapalabas ng calamity fund dahil bago lamang umano ito inaksyunan ng tanggapan ng alkalde. Sa naturang deliberasiyon, nagpasaring si Piñol sa mga kasapi ng SP kaugnay sa paghahanda na ginagawa ng kasalukuyang administrasiyon. Bagama’t hindi naman direktang sinabi ay tinutumbok ng opisyal ang pamunuan ng alkalde na wala umanong paghahanda sa ‘hulaw’ o El Niño dahil wala itong budget para

sa development plan. Dumipensa naman dito si Councilor JivJiv Bombeo, ang may hawak ng Committee on Finance, at iginiit na may nakalatag na paghahanda ang pamahalaang lokal sa pamamagitan ng City Disaster Risk Reduction and Management Office o CDRRM. Katunayan aniya, mahigit P70 milyon ang inilaang pondo ng pamahalaan para sa Disaster at calamity fund. Una na kasing pinagtatakhan ni Mayor Joseph Evangelista ay kung bakit hindi agad inaprubahan ang rekomendasiyon ng CDRRM na ilagay sa state of Calamity ang Kidapawan. Paliwanag naman ni Piñol na binusisi sa Committee of the Whole ang nasabing rekomendasiyon bago nila ito inaprubahan. Nakita kasi ng ilang mga kasapi ng SP na 6 kilong bigas lamang ang ibibigay na tulong sa mahigit 28,000 pamilya na apektado ng tag-init. Dahil dito, ipinanukala nila ang 24 kilong bigas pero di umano ito kayang ibigay ng City Social Welfare and Development Office (CSWDO) kung kaya’t naibaba ito sa 11

kilo lamang na mas marami kumpara sa rekomendasyon umano ng tanggapan ng alkalde. Bukod dito ay mamahagi din daw ng tulong ang provincial government at ang barangay. Inaasahang sa madaling panahon ay mailalabas na ang pondo na aabot sa mahigit P18 milyon. Sinabi naman ni Konsehal Francis Palmones na dapat walang pulitiko na makikisawsaw sa pamimigay ng relief assistance lalo na ngayon nalalapit na ang halalan. Ayon naman kay Evangelista, tumatalima ito sa ruling ng Commission on Elections na hindi makikisali sa pamamahagi ng mga relief assistance at ipauubaya na lamang ito sa Red Cross at CSWDO. Pero para kay Piñol, kung sakali mang pangungunahan ni Evangelista ang pamamahagi ng relief assistance dapat ay hindi ito ikasama ng loob nila dahil normal lamang sa isang ama ng Kidapawan na tumulong sa mga naapektuhan ng kalamidad. Convergence areas for peace, development approved in North Mindanao MALAYBALAY CITY - The Regional Development Council of Northern Mindanao (RDC-X) and the Regional Peace and Order Council (RPOC-X) approved the Convergence Areas for Peace and Development (CAPDev) as the enabling program to operationalize Executive Order (EO) 70 signed by President Rodrigo Duterte. Duterte signed the EO 70 on December 4 to institutionalize the “Wholeof-Nation Approach” in attaining inclusive and sustainable peace. The CAPDev shall be the region’s banner program to address the root causes of insurgency, internal disturbances, tensions, threats, and other armed conflicts. It aims to promote the establishment of durable peace and development and empower communities in the priority focus areas through peace-building and reconciliation, socio-economic transformation, good governance, and institution building. The program also espouses a focused, coordinated, and sustained de-

livery of the government’s basic services, as well as social development packages in poor, conflict-affected and geographically isolated and disadvantaged areas in the region. It shall work within existing institutional and political arrangements, and shall be integrated with the entire development planning and implementation machinery and processes. The local governments are the frontline service providers and main implementers of the program, while the RDC-X, RPOC-X, national government agencies, civil society organizations. The private sector shall complement the efforts of the local governments. The CAPDev program shall be implemented in the following clusters: Mt. Balatucan Range, Mt. Mangabon Odiongan Complex, Saldab and Kalabugao Plains, Pantaron and Umayam Complex, Salug Valley, Gamot-Dumasilag Complex, Mt. Kitanglad Range, Mt. Kalatungan Range, West Bukidnon Plateau, Iligan-CDO Tributaries,

Mt. Malindang, Mt. Ampiro, Gadungan Mountain Range, Mt. Peurai Complex, Maigo-Tangcal-Magsaysay Tributaries, and Salvador-Nunungan Tributaries. Both councils directed the Northern Mindanao PeaceDev Coordination Group—an ad hoc committee composed of the Philippine Army’s 4th Infantry Division with its 403rd Infantry Brigade; 1st Infantry Division with its 2nd Mechanized Infantry Brigade and 10th Infantry Battalion. The Northern Mindanao PeaceDev Coordination Group also includes Balay Mindanao Foundation Inc. and Region 10 offices of the Philippine National Police, the Department of the Interior and Local Government and the National Economic and Development Authority. General Santos City is now 3rd legislative district of South Cotabato PRESIDENT RODRIGO Duterte signed into law a bill creating the lone legislative district of General Santos City in South Cotabato province. Duterte signed Republic Act 11243 on March 11 and a copy of which was released to media only recently. General Santos City is currently part of the province’s first legislative district. Under the law, “The First Legislative District of the Province of South Cotabato is hereby reapportioned in order to create the Lone Legislative District of General Santos City to commence in the next national and local elections after the effectivity of this Act.”

The legislative districts of South Cotabato will now be composed of: First Legislative District: (1) Polomolok (2) Tampakan (3) Tupi. Second Legislative District: (1) Koronadal City (2) Banga (3) Lake Sebu (4) Norala (5) Santo Niño (6) Surallah (7) Tantangan (8) T’Boli. And the Third Legislative District is now General Santos City The new law states that “the incumbent Representatives of the present First and Second Legislative Districts of the Province of South Cotabato shall continue to represent the districts until the new Representatives shall have been elected and qualified.”

Moreover, “the Commission on Elections shall issue the necessary rules and regulations to implement this Act within 30 days after its effectivity”. General Santos is classified as a highly urbanized first-class city and the 15th most populous city in the country with 594,446 inhabitants as per 2015 census, according to the Philippine Information Agency. The Act was passed by the House of Representatives on May 2, 2017, amended by the Senate on September 3, 2018 and which amendments were concurred in by the House of Representatives on January 29, 2019. Keep oceans, seas plastic-free after death of whale off Compostela Valley THE BUREAU of Fisheries and Aquatic Resources (BFAR) appealed to the public to keep the oceans and seas free from plastic and other harmful pollutants following the recent death of a Cuvier’s beaked whale off Compostela Valley province. BFAR said the demise of the whale is somehow a result of improper wastes disposal. The whale, about 15 feet long and seven feet wide, was found stranded on March 15 along the coastline of Cadunan village in Mabini town. The mammal is considered an endangered species and

world’s deepest-diving mammal. Several attempts to properly ferry the beached whale to deeper waters were made, however, despite these efforts, the mammal returned to shallow waters where its condition further deteriorated and eventually died. A necropsy was performed on the whale and BFAR said it collected tissue samples for scientific determination of other possible causes of death through a series of histopathologic tests. The initial diagnosis of death is ingestion of at least 88 pounds of

foreign objects, mostly of plastics, pending the complete result of necropsy. The animal’s remains are now undergoing preservation process and its bones will be preserved for educational exhibit purposes. Following this incident, we urge the general public and all concerned government entities to support the Malinis at Masaganang Karagatan, a holistic program of the BFAR, which would ensure that our seas and oceans are free of plastics and other harmful pollutants. Teen’s brutal slay solved! Christine Lee Silawan (FB page)

POLICE DECLARED as solved the gruesome murder of 16-year old Christine Silawan whose face was skinned to the bone in Lapu-Lapu City in Cebu province following the arrest of her teenage boyfriend. But two other accomplices were being hunted down by the National Bureau of Investigation (NBI) which is now the lead agency handling the case, according to national police spokesman Col.

Bernard Banac. Police were also helping the NBI. “There are two other suspects. This is why the PNP continue to extend support to the NBI. We are ready to provide all records to the NBI Regional Office 7 and we expect that this will yield results as soon as possible. As for now, the murder case is solved but not yet closed,” Banac said. The suspect was arrested after footage from se-

curity cameras showed the 17-year old together with Silawan before she was brutally killed which the NBI said is a “crime of passion.” “It is because of the suspect’s ties with the victim. There is extreme anger or jealousy as far as the suspect’s ties with victim is concerned. However, our investigation team won’t stop until we uncover the truth,” Banac said. The NBI has filed criminal

charges against the prime suspect in Lapu-Lapu and being a teenager, he was turned over to the Department of Social Welfare and Development. Silayan was murdered in the village of Bangkal in LapuLapu. She was stabbed many times and her oesophagus, tongue and trachea were removed, according to the authorities. (Christopher Lloyd Caliwan)
