According to the court’s decision, Tillah invalidated over 5,000 votes of Abdurahman due to massive fraud. The Court also took reliance on the findings of the NBI during the examination of pertinent election documents. The technical examination is one legal process allowed by law to protect the sanctity of ballots and mandate of the electorate. In this process, the NBI takes charge of the examination of documents being the only agency possessing expertise on the matter. In her six-page decision dated October 5, Tillah invalidated Abdurahman’s proclamation on the ground of “massive fraud, anomalies and other irregularities” in 23 clustered precincts. “The proclamation of protestee Wasilah Abdurahman is hereby held invalid, annulled and set aside on the ground of massive fraud, anomalies and other electoral irregularities in the 23 clustered precincts. Protestant Benzar Tambut is hereby declared as the legally and duly elected mayor in the municipality of Simunul being the winning candidate with the highest number of plurality of valid votes cast,” Tillah said. “Protestee Wasilah Abdurahman is hereby ordered to vacate her position and to cease and desist from further discharging the duties and functions officially vested in the office of the municipal mayor of Simunul which are now conferred in favor of protestant Benzar Tambut, who is hereby ordered to act, perform and discharge the duties and responsibilities and all incidents pertaining thereto,” she added. Municipal authorities were also ordered to enforce and implement and assist in the implementation of the court’s order. Tambut and his supporters praised the decision of the court. Persona non Grata But the Provincial Board presided by Vice Governor Michael Ahaja, in a resolution approved by its members on October 16, declared Tillah “persona non grata” and saying she was found to be remised of her duties as an officer of the court

Response Reacting to the resolution declaring her unwelcome in Tawi-Tawi, Tillah said: “This resolution is clear evidence that ignorance resonates in the provincial administration. They who did not witness court proceedings arrogated unto themselves judicial power and seeks ouster of a judge who only followed the law. Lawlessness and ignorance should not characterize each Tawi-Tawian. This is a disservice to the community.” Tillah further said that courts should be respected as a co-equal branch in a Republican government and that executive and legislative branches should work in their own jurisdictions. “Only courts have the power to try and decide electoral protests subject to appeals process, including issuance of temporary restraining orders. Ours is a government of laws and not of men. Just because a court decision is not to one’s liking is not license for the other branches of government to cast aspersion, hence eroding confidence on the judicial system otherwise people will just take the law into their own hands. This does not augur well for a stable government and a stable community because the three branches (Legislative, Executive and Judicial) belong to one entity - the Republic of the Philippines,” she said. Abdurahman petitioned the Commission on Elections to issue a temporary restraining order that would hold in abeyance Tillah’s order unseating her as mayor. In filing the petition, Abdurahman called on the court to stop her electoral opponent Tambut from taking over. Abdurahman said this will also enable her camp to file a petition for reconsideration. The poll body said Abdurahman filed a notice of appeal on October 15. The status of the case (EAC No. 012-2020) said: “Notice dated October 29 inquiring the trial court if the notice of appeal was given due course and that the records thereof were transmitted to the Commission in accordance with Section 4, Rule 22 of the 1993 Comelec Rules of Procedure.” (Mindanao Examiner)

High Taxes, Debts Since Duterte won the presidency in 2016, he hiked taxes with his TRAIN law and borrowed monies from international creditors, including China, to fund his ambitious infrastructure projects, among others, across the country. The proposed P4.5-trillion 2021 National Budget showed the government’s outstanding debt will increase to P10.16 trillion by end of the year from P7.73 trillion in 2019. The government’s outstanding debt stood at P9,615.03 billion as of August 2020. The domestic debt amounted to P6,713.02 billion or 7.3% higher compared to the previous month due to the net issuance of domestic government securities. And the domestic borrowing for the year amounted to P2,500.35 billion as of August. In May, CNN Philippines reported the Philippines’ total debt load has grown to 8.89 trillion because the government borrowed aggressively to fund programs aimed at easing the effects of the coronavirus pandemic. In the same period, the Bureau of the Treasury reported that total loans moved closer to 9 trillion, growing by 12.3 percent or 975.2 billion compared to May 2019. The figure also increased from April’s 8.6 trillion. The spike in debts is due to increased reliance on raising money through

bond issuances as well as foreign loans as the Philippines had to secure additional funds to support Covid-19 response measures, given a sharp drop in tax collections during the weeks under lockdown. Two-thirds of the debt burden was borrowed locally, amounting to 6.03 trillion which is 14.8 percent higher than a year ago. The Bureau of the Treasury was forced to issue more Treasury bonds and bills as it sought to pad the government’s cash for emergency purchases and benefits as the country saw coronavirus infections climb. Treasury note issuances have climbed to 5.73 trillion, up by a tenth from last year and by 3.1 percent compared to April. Foreign sources accounted for 32 percent of the total loans at 2.86 trillion as of end-May. The figure rose by 7.4 percent from the year before, representing the series of loans secured from four development finance agencies abroad to bolster local funding. As a developing economy, the Philippines spends more than what it can collect in funding so that it can begin new and high-impact projects – in this case, the coronavirus response, with cases surging to more than 37,000 as of end-June. The Department of Finance earlier said that public debt will not go beyond 50 percent of the size of the Philippine economy to make these loans manageable to settle. It is looking to borrow 436.9 billion from foreign sources to support government spending for coronavirus response measures. Is North Cotabato’s QR link safe?

ILIGAN CITY – The local government received two sets of GeneXpert machines from the Department of Health (DOH) and the Philippine Business and Social Program (PBSB) that will be used to test TB, HIV and even Covid-19. The machines were turned-over to Barangays Hinaplanon and Tomas Cabili to diagnose residents from the east and west side of the city. Jhun Ronald Gilbolingo, DOH Region 10’s TB (tuberculosis) technical staff and a PBSP member, said the GeneXpert machine can test four sputum samples at a time, and results will come out after 2 hours. “Mao ni siya’y latest nato nga machine na maka-detect sa atuang TB. Aside from TB detection and resistance pattern determination to rifampicin, the GeneXpert machine could also be used for assessing the viral load of the Human Immunodeficiency Virus (HIV) and Covid-19 testing. “This is the same machine that our Northern Mindanao Medical Center is using to identify Covid-19 positive patients, however, we need a laboratory that is accredited to level 2 biosafety to allow this procedure,” he said. Considering the economic and social adversities brought by the Covid-19 pandemic to the city, Vice Mayor Jemar Veracruz weighs TB as serious as Covid-19 when it comes to its infectiousness.

“While our campaign against Covid-19 will continue, we should not forget other campaigns, like the campaign against TB. It’s equally serious. We see the gravity of seriousness that the disease could bring to our people. Therefore, we should also take this as important,” Veracruz explained. Veracruz shared that TB data given by the World Health Organization showed that every second someone is infected with TB, and every 10 seconds someone dies of TB. Furthermore, the vice mayor calls on residents to take advantage of the provision of this technology for earlier TB detection and medication in the two barangays. “The lab that we have, the GeneXpert machines that we have are ready, our people are ready, and our city health personnel are ready to attend to them,” Veracruz said. NORTH COTABATO – Aside from Davao City which is implementing a mandatory “Safe Davao QR” for an effective Covid-19 contact tracing, the province of North Cotabato also has its own version of digital contact tracing app. So far, over 127,000 people have registered in the province through this link: r12-ccts.ph, according to the Facebook page of Gov. Nancy Catamco. It said: “This link is safe, virus-free and adfree. Its SSL Certification is still pending and we are working on it already. This is applicable to Android and personal computers. This is NOT applicable to IOS.” However, when the link is accessed on a computer, this warning shows: Your connection is not private Attackers might be trying to steal your information from r12-ccts.ph (for example, passwords, messages, or credit cards).

This CCTS system is also applicable to Region 12 (Cotabato, South Cotabato, Sultan Kudarat and Sarangani Provinces, and General Santos and Cotabato Cities). Kidapawan City is a component city under Cotabato Province.” The QR Code does not remove the requirement for a medical certificate and travel authority for non-exempted APORs or “Authorized Persons Outside Residence” upon entering the borders of North Cotabato. But the number of DQR registrants may even exceed the 600,000 total of those who availed FM passes as the DQR application is per individual and

not limited to two members-only per household, which was the case with FM pass. ‘Sugbo Negosyo’ helps Cebuano entrepreneurs CEBU – Nearly 18,000 Cebuano entrepreneurs have submitted their application for the Sugbo Negosyo, the micro-enterprise assistance program of the Cebu Provincial Government. The application forms will then undergo another level of screening and evaluation by the Offices of the Vice Governor and the Provincial Board (PB) members. They will identify who will qualify for the program based on potential success and classification of business, whether existing or start-up. Sugbo Negosyo is another pilot program of Gov. Gwendolyn Garcia which focuses on helping micro, small, and medium enterprises bounce back after being inactive for the past seven months because of the Covid-19 pandemic. Through this program, Cebuano entrepreneurs who were greatly affected by the pandemic will be given the opportunity to start their own business, make their own products or reboot their business operations. Based on the guidelines, the applications will be categorized as Category A which will receive

assistance through raw materials and supplies worth P50,000, Category B receiving P20,000 assistance and Category C P10,000. Category A or Negosyong Padayonon is intended for established micro enterprise that need recovery assistance and enhancement. Category B or Produktong Sugbuanon is for new and existing micro-enterprise engaged in manufacturing or processing while Category C or “Mga Serbisyo ug Gagmay’ng Patigayon” for new and existing micro-entrepreneurs engaged in trading and services. Garcia told the staff of the PB offices that they will also need to categorize the types of businesses and their needs to facilitate product

matching with suppliers. At least 30 suppliers have already committed to participate in the program in a meeting with the governor early this month.
