MNLA Landscape Awards 2019

Call for Entries

On October 1, MNLA opens its online entry portal and begins receiving entries for the 2019 Landscape Awards program. Go to www.MNLA.biz/landscapeawards to find the entry portal link. Full entry rules are posted on the entry form.

If you’re not familiar with this program, you may not know that... It’s all online. The application process, judging, and viewing of winning entries — all of this is done online via software designed specifically for awards programs. You can start an entry, save your work, and return to it later as needed. It’s a learning opportunity. All entries and notes from the judges will be available during Northern Green (nonwinning entries will be anonymously displayed). You get a second chance. If an entry is incomplete or incorrect, entrants will have one opportunity to amend their submission and resubmit their materials. Plus, if you’re not a winner this year, you are eligible to enter the same project in future years. There are no categories. Entrants don’t have to choose where their project fits, and entries are not judged against each other; every entry is judged solely on its own merits. A winning project is a huge boost to your marketing. Each winner receives a plaque, a ticket to the Green Industry Awards Celebration, a crest to display in print and for posting on their website, and other marketing materials. Plus, SPACES Magazine will feature the winning projects in an editorial package in their spring edition, including a feature story on the Judges’ Choice project.

Judging Reminders • Entries are judged anonymously. Judges do not know who submitted the projects. • The size and cost of a project are not part of the criteria for judging. • In any given year, ALL entries could win awards, or NO entries could win an award. Entries are not judged against each other; rather each entry is evaluated by judges who must determine whether an entry meets or exceeds the standards of excellence.

Meetings, Meetings Everywhere It’s hard to be everything to everyone everywhere, but it’s our job to represent members the best we can on regulatory and legislative issues as they arise.

As MNLA President Scott Frampton mentioned in his article last month, regulatory issues are certainly at the top of the list of things keeping members up at night. This month, I thought I’d highlight some of the committees, advisory groups, and coalitions where the Minnesota Nursery & Landscape Association has a presence on your behalf. Did you know that during the past year alone, MNLA has staff or volunteers who participated in or attended meetings of the following groups to represent green industry interests… • Legislative Water Commission • Minnesota Business Immigration Coalition

• Midwest Invasive Plants Network • MDA Advisory Group on Plant Hardiness • Tree Care Registry Advisory Group • Minnesota Grown Advisory Committee • Smart Salting Coalition I’m positive there are groups and meetings I missed in this list. But, hopefully this gives you an idea of the breadth of topics on which the association tries to stay alert. In addition to attending meetings of these groups and providing input/feedback, during the past few weeks we have also been:

• Minnesota Invasive Species Advisory Council

• Monitoring Electronic Logging Device (ELD) regulations for agricultural drivers,

• Minnesota Nursery & Landscape Regulatory Advisory Committee

• Forming a group to provide input on sales tax issues, and

Annual flower variety trials for the University of Minnesota are conducted at the West Central Research and Outreach Center (WCROC) Horticulture Display Garden in Morris, Minn. The purpose of the trial program is to evaluate the performance of annual flowers based on regional conditions for west central Minnesota. All annual flowers on trial are landscaped into an impressive pubic display garden, which is visited by thousands each year. Through the annual flower trials, our hope is to educate and inspire consumers to create even more beautiful and successful gardens.

n addition to the annual flower trials, the WCROC Horticulture Display Garden also serves as an All-America Selections (AAS) Display and Trial Garden. An AAS Display Garden introduces AAS Winners to the public, while an AAS Trial Ground has AAS entries planted side-by-side to allow comparisons for evaluation by an AAS trial judge. In 2018, nearly 400 cultivars were trialed through the U of MN annual flower variety trial. As part of the evaluation criteria, cultivars are rated based on their unique characteristics, exceptional performance, color, and vigor under regional conditions. Once the final evaluations are completed, only the top rated annual flowers are considered for the distinction of being called a “Top Ten Performing Annual.” The Horticulture Display Garden is open daily from dawn until dusk; admission is free. Voted as the “Best Public Display Garden in Minnesota” by WCCO, the Horticulture Display Garden is truly a gem in the Upper Midwest. was trialed in a hanging basket, grown in full sun and offered striking bright orange blooms during the growing season. With a uniform compact plant habit, Sunstanding Orange Aurora earned four excellent plant ratings during our evaluation season.

 New Guinea Impatiens Sunstanding Orange Aurora

proved to be a magnet for pollinators by attracting hummingbirds, bees, and butterflies. Rockin’™ Deep Purple is a fantastic annual with rich black to purple flowers and excellent for use as a garden background with a height of 30” to 40”. A real eye catcher, this Salvia was also voted as one of our top “Consumer Favorites” of 2018.

has dazzling purple flowers that bloomed all season long in a filtered-sun area of our garden. Grown in a container, Summer Wave® Large Violet had the most vigorous trailing habit of the Torenia’s we trialed in 2018 which earned its excellent plant rating throughout the growing season.

had the highest horticultural rating as compared to the other trialed verbena this growing season. It received this high rating because of its continued season-long high flower numbers and its bold grape color. Firehouse™ Grape grew well in both the garden and a container with no evidence of powdery mildew disease.

 Verbena Firehouse™ Grape

is a former AAS winner for its superior garden performance. Orchid Halo produced huge, bright purple blossoms with a wide white eye, creating a striking look in our full sun garden location. While Vinca don’t typically like to be wet in any stage of growth, this variety rebounded extremely well after excessive early summer rains to become one of our top ten annual flowers.

Pesticide Recertification Workshop

This workshop meets the Minnesota Department of Agriculture (MDA) Commercial Pesticide Applicator Requirements for Category A (Core) and Category E (Turf and Ornamentals). Recertification for optional Categories F (Aquatics) and P (Vertebrate Pest) will also be offered as part of this workshop. Licensed applicators with Categories A and E who last attended a recertification workshop in 2017, and newly-licensed pesticide applicators in 2018, must attend an MDA-approved workshop by 12/31/2019. By attending the Pesticide Recertification track and completing the on-site attendance documentation, applicators will obtain recertification credit. For applicators to receive credit for Category F or Category P, they must attend the entire Pesticide Recertification track (Category A, E, and F or P) and complete on-site attendance documentation.

NCMA Certification: Segmental Retaining Walls Installer Course – Level I/Basic

Category F or P: 7:30–9:00 a.m. Categories A and E: 9:15 a.m. – 4:00 p.m.

Instructed by Dale Buker, County Materials, an NCMA Certified instructor This one-day Segmental Retaining Wall (SRW) Installer Course teaches installers fundamental SRW installation guidelines, material and system component properties, soils and compaction, the effect of water, and site practices. Those who successfully complete the classroom training and pass a written examination become certified as a Certified SRW Installer (CSRWI). This credential is highly valued by consumers and the program includes a wealth of valuable course information and reference material that attendees take back to work for implementation as moneysaving and profit-making ideas. 8:30 a.m. – 4:00 p.m.

Weather and the Urban Landscape Presented by Lee Frelich, University of Minnesota; Dominic Petrella, University of Minnesota; John Ball, South Dakota State University; and Sven Sundgaard As landscape managers, we have very little control over the impact weather has on the landscapes we manage. The weather seems to get more severe with each passing year, anything from increased rainfall rates in the summer, to extreme dryness in the fall, to the much-maligned polar vortex. The only real tool we have is to better educate ourselves on how such events impact the plants we manage. This class will discuss how turfgrass and trees react to drought, heat, and winter-related stresses. Presenters will provide ways to help manage our plants during strange and stressful weather patterns.

Daniel Tal is a registered landscape architect with over 18 years of experience and a 3D modeling and visualization expert. Jim Huston

James R. Huston, MBA, CPE, has over thirty-five years of diverse business management experience and holds an MBA degree in finance. He is also a member of the American Society of Professional Estimators. He is a Certified Professional Landscape Estimator and he is one of only two such CPLE’s in the world.

As a Captain in the U.S. Marine Corps, he held positions in finance, aviation supply inventory management and procurement. After his tour of duty, he became a senior production control analyst for the Electronics Division of General Dynamics. Since 1987, he has been a management consultant to the green industry. Early in his career, he was in charge of the consulting division for Charles Vander Kooi and Associates, Inc.; and in 1989 he formed J. R. Huston Consulting, Inc. Huston has written seven books and developed five software programs for the green industry.

Steve Uzzell is an internationally renowned photographer and inspirational speaker. Ted is a member and past president of the Lake Superior Chapter of the American Society of Training and Development located in Duluth, MN. hen it comes to the boom-and-bust cycles of nut production, trees know exactly what they are doing. Trees with large seeds, such as oaks and walnuts show great variability in seed production year to year, often rhythmically. Acorn production can vary from none, to over 50,000 per year. A common term for those good years is “a big mast year.” Masting can only happen when there are sufficient food reserves in the tree. With such effort it is perhaps not surprising that there are rarely two mast years in a row. The tree must rebuild its food reserves ready for the next big year. Besides how much food can be accumulated in a tree, the biggest variable is the weather. A late season frost can prevent acorns from forming or kill them outright, even if the tree has ample reserves. Masting occurs in those trees with large seeds that are carried away by mammals or birds to eat or store in the ground, sometimes to be forgotten. Acorns are eagerly sought after by boar, bear, deer, turkeys, squirrels, and chipmunks because they contain up to 50% oil and starch. Masting swamps the seed eaters with more seed than they can consume, hopefully leading to a few surviving to germinate. In lean years, whole forests can be picked clean, down to the last morsel, so hardly any seedlings sprout. So that’s why trees have decided if they don’t bloom every year, then the herbivores cannot count on them. The next generation is kept in check because over the winter the animals must endure little food and many will not survive. If the weather destroys a nut crop one year, this leads to a mast year and more seeds surviving predators to form the next generation. This leads to selection of those plants most sensitive to the disruptive weather event, resulting in future masting and survival of our little tree.

There is still hope that Congress will include the H-2B returning worker exemption provision in the federal budget for Fiscal Year 2019. This will provide much needed relief to H-2B employers.

he H-2B nonagricultural temporary visa program allows employers to sponsor foreign workers if they can document the need is temporary (peakload, seasonal, intermittent, or one-time occurrence) and there is a shortage of U.S. workers to fill the position(s). It is the only work visa for U.S. employers to sponsor foreign national workers for positions which do not require at least a Bachelor’s degree or equivalent. Congress’ continued failure to address the need for additional H-2B visa numbers resulted in one of the most tumultuous years for the H-2B program in 2018. On January 1, 2018, the Department of Labor received approximately 4,498 H-2B applications requesting 81,008 H-2B workers. This was more than three times the number of applications received on January 1, 2017 and more than two and one-half times greater than the 33,000 visas allotted for the second half of the fiscal year. Under the current law, there are only 66,000 H-2B visas per fiscal year, with 33,000 allocated for the first half of the fiscal year on October 1 and the remaining 33,000 allocated for the second half of the fiscal year on April 1. Due to the surge in H-2B filings on January 1, 2018, DOL implemented new processing procedures. In order to provide an equal chance to all employers with certified applications of getting the 33,000 visa numbers, it did not release any H-2B certifications for applications filed on January 1 until February 20, 2018. Adding further drama to the H-2B process, the United States Citizenship and Immigration Services (USCIS) implemented a visa lottery for the first time ever for H-2B visa numbers. It was no longer first come first served. It now came down to luck. Similar to 2017, Congress released an additional 15,000 visas due to the gross shortage of H-2B visa numbers. It was still not enough and many employers were left with another year of labor shortages. What Lies Ahead for the H-2B Program in 2019?

Unless Congress takes drastic actions in late 2018, the surge of filings in 2018 is expected to occur again on January 1, 2019. It is not clear how DOL and USCIS will respond to the expected spike in filings in 2019 and the number of applications will be greater than 2018. Employers must be ready to file their applications on January 1 at midnight Eastern time for a chance of obtaining an H-2B visa number if their date of need is April 1. DOL confirmed on June 3, 2018 that it will sequentially assign H-2B applications to analysts based on the calendar date and time on which the applications are received (i.e., receipt date and time). Moreover, receipt time will be measured to the millisecond for each application. It is imperative to get an H-2B application filed as soon as permitted under the law to be in the front of the queue.

It is clear that U.S. employees need more than 66,000 H-2B visas per fiscal year. Until there are serious immigration changes, the “returning worker exemption,” which would exclude individuals who previously held H-2B status, from being counted under the H-2B cap, will bring much needed relief to employers. H-2B employers and stakeholders must continue to focus on advocating their congressional representatives for additional H-2B visa numbers and the inclusion of the returning worker exemption in future budget bills. H-2B Filing Tips

Employers have a one in four chance of getting their H-2B petition chosen in 2019 if the number of applications remains the same as 2018. There is no room for errors or delays due to the intense competition for H-2B visa numbers. Below are five filing tips: 1. The H-2B Job Description: Draft the job description (duties,

requirements, and offered wage) and collect supporting documentation to establish temporary need. If temporary need cannot be established, the employer may want to reconsider the immigration strategy. 2. Prevailing Wage Requirement: File the ETA 9141, Prevail-

ing Wage Request no later than November: the DOL issues its wage surveys at the end of June/early July each year. The wage data is valid for one year. Employers should file the prevailing wage request no later than November if they are filing their H-2B applications on January 1. It takes about 30 days for DOL to issue the prevailing wage determination. By filing early, an employer can have time to resubmit a request or challenge a determination if the wage determination is too high. 3. File 90 Days Before the First Date of Need: Employers can

file 75 to 90 days before the first date of need. In light of the shortage of H-2B visas, it is important to file as soon as permitted under the law to allow for unplanned delays at the DOL, USCIS, or U.S. consulate. If an employer is filing for an April 1 start date, file at 12:00 am Eastern Time no matter what part of the country the employer is located. 4. Prepare I-129 While the H-2B Application is Pending with DOL: Prepare the Form I-129 petition before the ETA 9142B H-2B Temporary Labor Certification is certified. The key to

Snow removal isn’t a 9–5 job. Workers may be seasonal or temporary, and hours can fluctuate greatly across weeks. Do you need to worry about paying overtime? Yes, you do. Assuming your workers are employees and not independent contractors, employees must generally be paid overtime pursuant to the federal Fair Labor Standards Act (FLSA). The only exception is if an employee can be classified as overtime-exempt. Complying with overtime laws and getting the exemptions right is critical to risk management for small businesses, because faulty overtime policies can lead to costly lawsuits brought by current or former employees. Keep reading to figure out the most common rules for overtime and which employees don’t require overtime pay rates.

For employees who perform manual labor (shoveling, driving vehicles, etc.), overtime pay is straightforward. For every hour over 40 worked in a given week, employees should be paid 1.5 times their pay rate. For these purposes, the best practice is to pay that employee on an hourly, rather than salary, basis. Note the following rules: Hours can’t be averaged across multiple weeks. An employer’s “work week” doesn’t have to start on Sunday or Monday; it just has to contain seven consecutive 24-hour periods. Part-time, seasonal, and temporary employees should be paid overtime if they work 40+ hours in a given week. Independent contractors aren’t eligible for overtime pay. Employees who perform office work: SOME exemptions

However, employees with primarily-discretionary functions, like accountants or HR managers, or who rely on advanced training, like engineers, may be exempt from the federal FLSA’s overtime requirements. Here are the main criteria for the most frequentlyused overtime exemptions under current DOL rules: • Managerial exemption: These are employees who (1) primarily manage the company or one of its customarily-recognized departments or subdivisions; (2) manage at least two full-time employees (or the FTE equivalent); and (3) make at least $455 weekly ($23,660 for a fullyear worker). • Administrative exemption: These are employees (1) who primarily perform office or non-manual work directly related to the management or general business operations of the employer or the employer’s customers; (2) whose job includes the exercise of discretion and independent judgment regarding significant matters; and (3) who make at least $455 weekly ($23,660 for a full-year worker). • Professional exemption: These are employees who primarily perform work that requires (1) advanced knowledge in a field of science or learning or (2) invention, imagination, originality, or talent in a recognized field of artistic or creative endeavor; and (3) who make at least $455 weekly ($23,660 for a full-year worker). Additional criteria and exemptions for less-common situations are located in the U.S. Code of Federal Regulations, Chapter 29, Section 541. Note that the administrative exemption doesn’t apply to office employees who don’t have a lot of discretion

If the primary duty falls within an FLSA overtime exemption, that employee doesn’t need to be paid overtime. If not, the employee must be paid overtime.
