State Attorney General’s Office ---- Civil Penalties Continue Being Accessed ---Enforcement of the Underground Damage Prevention law continues to result in penalties and warning letters issued by the AG’s office. Last year, the AG’s office took action on 125 member utilities and excavators who failed to comply with the Missouri Damage Prevention law. To date, in 2016, 90 penalties have been accessed.

Over half of all Missouri One Call member utilities have ordered and placed these vehicle stickers since we started offering them last spring.

The typical first offense penalty is $1000. If those issued a penalty take and pass an on-line test and attend a MOCS safety meeting, the penalty is usually reduced to $500. The highest penalty accessed in 2015 was for $40,000. Continued enforcement of the law, aimed at both excavators and member utilities is anticipated.

MOCS Damage Prevention Display Trailer continues to roll and has been viewed by many different audiences. The trailer has been set up at several events all across the state. School programs, events at the state capitol, minor league baseball games, and association conferences are some of the venues where people can visualize what is underground. To request the trailer, call the MOCS administration office at 573-635-1818.

These numbers dictate that the strongest tool of damage prevention education lies with the participation of the Missouri One Call member utilities. One of the main responsibilities of any utility is to protect their facilities from damage. The strongest method of education takes place in the field, one-on-one, between the utility member and the excavator. Having knowledgeable employees that know the responsibilities of both their utility and the excavator and can communicate how the one call system works is the most effective way to protect your facilities. Relying completely on MOCS to educate 28,000 excavators may be asking too much. MOCS members who have taken a proactive effort to educate the excavators in their area have seen a dramatic decrease in damages to their facilities.
