Responsibilities of the
EXCAVATOR
From the MOCS Excavator Manual
The person or supervisor doing the actual excavation is considered to be the “Excavator” and is responsible for the following: • Excavators are responsible to provide accurate information. Accurate dig site information is essential to prevent damages. Correct contact information is necessary. • The excavator must excavate in a careful and prudent manner. • Excavators must notify MOCS at least three and not more than ten working days in advance cky of the excavation. • In the event the owner/operator fails to respond, the excavator must request a second notice, a “No Response” ticket. It is important that you specify by name which utility did not respond. To place a “No Response”, notify the center by calling 1-800-DIG-RITE OR 811. Provide the ticket number of the original locate request, identify which member has not responded, and MOCS will send a “No Response” message to that member. Upon receiving the “No Response”, utilities are required to respond by marking or making contact with the excavator within two hours. If the “No Response” notification is made before 2 pm, the marking shall be completed that working day. If the notification is made after 2 pm, the marking is to be completed no later than 10 am the next working day. • If work has not started within 10 days of the locate request start date and time, a “Remark” must be submitted.
• If the excavator discovers the facility was incorrectly located, the excavator must notify the call center and request an “Incorrect”ticket. • If an underground facility is damaged or dislocated, the excavator must notify MOCS and request a “Dig Up” notification. • If the damage involves pipeline or natural gas facilities that results in a release of hazardous liquid or gas, both 911 and the MOCS call center must be notified. • lt is illegal for the excavator to conceal or attempt to conceal damage or to make repairs unless authorized by the owner. Emergency temporary repairs may be made only to sewer lines, without prior authorization. • Excavators shall exercise reasonable care not to unnecessarily disturb or obliterate markings provided for location of underground facilities. • Excavators must hand dig within the “Approximate Location” when best practices and circumstances permit. • Must call 911 when damage occurs to facilities resulting in a release of hazardous liquids. • Must use the extended start date and time process only through MOCS and only when the process is initiated by the utilities. • Excavators shall not make repeated unnecessary requests for remarking. If determined to be unnecessary, the excavator may be liable for the cost of those remarks. • Excavator must confirm utility response before starting any excavation.

April is Safe Digging Month Safe Digging Month is a nationwide effort to encourage all stakeholders to promote the safe digging message. April is when digging activity peaks in Missouri and across the nation. Safe Digging Month serves as a reminder that participating in the one call system is an essential part of safe excavation. Confirming Utility Response Before ever driving to the dig site to begin work, excavators can confirm utility response to their locate request.
Enforcement by the
State Attorney General’s Office Actions by the State Attorney General’s Office Continue! Civil Penalties Being Issued to Excavators and Utilities. Enforcement of the Underground Damage Prevention law has resulted in fines and warning letters by the AG’s office. In the first quarter of 2017, 34 warning letters and civil penalties have been issued to those failing to comply with the Missouri Damage Prevention law.
Missouri law requires utilities to status their response to an excavator’s locate request. “Ticket Check” is an application that allows a utility to send a documented response on each locate request to the excavator. Using Ticket Check, each utility will status every locate request they receive. Once a ticket has been responded to, the utility communicates their response through the Ticket Check system, and the status of their locate is emailed or faxed to the excavator using the contact information they have provided. The excavator can also view the ticket through Ticket Search on the MOCS website or can also call 573636-1555 to check the statuses. If all the utilities listed on the locate request have not been statused by the start date and time on the ticket, the excavator is required to place a “No Response” through MOCS for those specific utilities. This system will eliminate much of the confusion in determining if a locate has or has not been completed.
