The 2009 Legislative Session

A lot of work was done by the Lobbyist team in preparation for the committee meeting. HB2133 passed with an 8-0 vote. This was great news and a wonderful way to start the year. I want to thank all of you for your involvement, calls, and emails on this bill. Your help got this one through the committee. The next bill the lobbyists are working on is SB1060. This bill has not been assigned to a committee as of yet due to budget. SB1060 - Right of Way (ROW) - Addition of Types and Increase of Penalties: The current ROW statute ARS.28-672 covers left turns and running red lights only. We are asking that the following be added – pulling out from intersections, merging, and moving from your lane unsafely. Penalties in the statute state that the court ‘may’ suspend a license for 90/180 days in the event that a ROW violation causes 'serious physical injury/death'. We are asking that in the event of second or subsequent violations within a 36 month period the court 'shall' suspend a license. State law also currently states that for

SB1137 - Vehicle Impound - Lacking Proper Endorsement: This is the DPS Towing bill that was recently announced. Currently, it is law that when a person is found to be driving/riding on a suspended or revoked license their vehicle is towed and kept for 30 days, or until the owner comes to the impound yard with proof of their license being reinstated and proof of ownership via registration, title, insurance, etc. This bill will revise the statute to include the towing of anyone driving / riding a vehicle without the proper endorsement (i.e. Motorcycle, Semi Truck). According to DPS and the statute, you will be given a hearing date when ticketed and towed. If you get your endorsement prior to your hearing date, you will be given the proper paperwork to get your motorcycle released to you immediately. If you cannot get your endorsement prior to your hearing

The Lobbyist team continues to spend a lot of time at the Capitol with our Legislative group as well as meeting once a month for a Lobbyist meeting. These meetings are intended to see what we can do to help on bills, pending issues, and look at new areas. We need your help. Why? Because even more powerful than the voice of your lobbyist amongst the state legislators, is the voice of their constituents. You! Our first bill that got assigned to a committee was HB2133 - Motorcycle Safety Fund and Arizona Motorcycle Safety Advisory Council (AMSAC) Sunset Extension. It was chaired and sponsored by Representative Jerry Weiers. The fund and the Council were due to Sunset (expire) in June of 2010. The reason this did not go before a "Sunset Committee" for extension is that the fund and the council are considered a program and not a state agency. As a Sunset can only be extended for a maximum of 6 years, this bill will extend the Safety Fund and Council to 2016.

The next bill that we’ve been following and working with DPS on is SB1137. The important thing on this bill that we want to get across to everyone is to make sure you have your Motorcycle Endorsement. This is a critical piece for this bill.

The 2009 Legislative Session is off and running. We continue to be very active at the Capitol with everything going on. As we all know the number one priority has been to fix the 2009 budget and then work on the 2010 budget. A lot of time has been spent by our Legislators on this.

MMA is a Motorcycle Rights Organization (MRO) comprised of motorcyclists and motorcycle enthusiasts who are concerned with the future, safety and welfare of motorcycling. MMA is a non-profit, educational organization whose members are dedicated to improving the social atmosphere, which surrounds motorcyclists, and protecting the individual freedoms of America’s citizens. From the Chairman As we go forth into the new year of 2009 I'm filled with nothing but optimism for the great things I feel/know we are going to accomplish. What fills me with such optiTwo mism? particular things have occurred over the last few weeks. First, our Board of Directors meeting in Punkin Center brought a few distracting issues to an end, and we ushered in a few new officers at the State level who are doing an incredible amount of very positive work for us all. Spinner, our new Communications officer, came to the meeting prepared. Not only did he have a very positive attitude, but a packet of information on our Arizona State Representatives and Senators and many other helpful things. As a result, each Board member was able to return to his/her District and share information that will ensure a much more direct and user-friendly way to deal with those folks who were elected to serve us and share our concerns, ideas, and positive suggestions as to how they can better serve us in the motorcycle world here in Arizona. Joe Hoodak, our new membership Chair, was welcomed by all and thanked for the outstanding job he is doing after assuming one of the most important and time consuming roles within our

organization. Talk about hitting the ground running. If there was a gold medal for grabbing a task by the horns, he would be leading the pack to win one. The best part is these two individuals are just part of the team. A team which has had many individuals step up and say they are willing to head up committees to help us all make more positive strides in protecting our rights, guarding our safety, and promoting motorcycle awareness---all goals that our MRO was set up to do many years ago. With many people stepping up to the plate, much more will be accomplished now and into the future. Also at the Board meeting, each member was asked to present a list of key issues they and their Districts considered to be worthy of and important enough to be concentrated on in this year and into the future. The lists shared many common elements, i.e. stronger ROW legislation, creating more motorcycle awareness among the driving public, and better/more universal training of all motorcyclists. Others that are also extremely important include distracted driver penalties, cell phone use while driving and, as always, protecting our right to choose whether or not we wish to wear a skid lid while riding our state's roads. The final item that has brought me great excitement and pleasure is the number of positive emailings on both our MMA Discussion list and the MMA Board list. The number and tenor of communications between members and officers is about the best I've personally seen in years, and involve a much larger number of individuals who are not only speaking their minds freely but also stepping up to make positive changes in so many different ways.

I can honestly say that if it hadn't been for Tom's incredible openminded and investigation of some issues that have plagued me over the past few months, I'm not sure what would have happened. He is one of the finest leaders and finest individuals I have ever had the pleasure to work with. My hat goes off to him constantly (so much so I have stopped wearing a hat!) Also volunteering to help with some of the Chair's responsibilities and tasks is Big Bo, DM and Board member from the Verde Valley. Bo has always been totally open and frank about his opinions (even if they are not part of the majority's) and keeps all of us informed on a regular basis of things (laws/potential laws, rider safety, fallen brothers and sisters, etc.) as almost no one else does within or organization. He is a very positive and assertive leader who will do much to help with the running of the MMA of AZ, and I'm very pleased to have him at my side. Casa Grande District All members are encouraged to attend our Beach Party scheduled for Feb 28, at the Airport Tavern, 1801 N. Pinal Ave in Casa Grande. Bring a friend along!

Chris Kite, our fearless district manager, has called for a special meeting to take place on Sunday, February 15 at 11:00. The meeting will address what this district will accomplish for Motorcycle Awareness Month in May, getting all members to attend the Freedom Beach Party the following weekend, and addressing membership issues. The secretary (me) will contact each member by phone on February 8 to remind them of the meeting.

Bob Ticer from DPS presented and discussed bill 2835-11 that will be going before the legislature this year. This bill deals with impounding motorcycles immediately if the driver does not have a motorcycle endorsement. The proposed impound time will be 30 days. The motorcycle can be released once the driver obtains their motorcycle endorsement and presents it to the court at a hearing.

Animal Cochise Dist. Mgr. MMA of AZ Grand Canyon District The Grand Canyon District salutes all of our fellow brothers and sisters in MMA! Our meeting took place on February 1 (Superbowl Sunday) at Hog's Family Restaurant at its usual time. Information concerning the recent Board of Directors meeting was disseminated to the membership. The district wishes to thank the Rim Country District for hosting us and making the meeting at Punkin Center an event to remember. Speaking only for myself, I thought that we had a very productive meeting and will always remember the party that took place later, with entertainment provided by both Big Bo and Tom Corr (Big Bo, the wearing of those panties on your face was a Kodak moment). Thanks for a great time! The Grand Canyon District is pleased to announce its very first event. Please mark your calendars for June 19-21 to help celebrate the Grand Canyon District's Fathers Day Delight event at 2Bar3 Historic Restaurant and Saloon in Flagstaff. The weekend event will have live music on Friday and Saturday nights. Biker events will occur all weekend. Free camping at the site. More information, including prices for the event, will be announced later. This is the type of event each dad wants to attend. Free camping in the cool pines, with a saloon on site, biker games/events all weekend, and live music. You folks living down south can get away to a cooler climate and the monsoons will have yet to start. Chris reported that the District's Bike Night for January was a big hit with the environmentally disabled (snow and cabin fever crew) motorcycle enthusiasts here in the snow country. He gave out lots of free gifts to a packed crowd at the Hog's Saloon. We hope everyone enjoyed themselves and that they will hurry and fill out those membership applications they were given. This District remains committed to changing the present Right-of-Way laws in this state. We have lost brothers and sisters within the past two months due to negligent cagers. It is time to stop the homicidal activity on our city streets and highways. The present ROW legislation needs to be revamped to make those guilty of ROW violations felons PERIOD. A slap on the wrist for seriously injuring or killing one of our own must stop (primarily because it is insane to get a traffic ticket issued for Failure to Yield when you're guilty of murder). Steve will address this issue again with the BOD at the next meeting in April. We look forward to having a grand visit with all of our brothers and sisters at the Freedom Beach Party! Thank you to all of you that sent emails and made calls to promote this bill. The Arizona Motorcycle Safety Advisory Council had its first meeting this year on January 15th. We had two members in attendance and here are the notes that The Wall brought back to our January Meeting: Joe Tuiteleleapaga, the GOHS Fiscal Manager, went over the budget. For FY2009 there is $91,408.89 remaining. Michael Hegarty, the GOHS Deputy Directory went over the 2008/2009 Media Campaign. There are 17 billboards across the

The GOHS will also focus some efforts of the 2009 Media Campaign here. The Motorcycle Safety Foundation discussed the need for Arizona to focus on getting all the rider education courses consistent in their curriculum and ensure that all programs are taught with the same quality. There are 21 active rider education schools in Arizona. These meetings are open to the public. The next meeting will be held on Thursday, February 26, 2009, at 10:30am. The meeting will be held at the Governor's Office of Highway Safety, 3030 N. Central Ave., Suite 1550, Phoenix, AZ. Also this month we would like to recognize “Aloha” who brought in 3 new business members! Way to go girl! We would like to welcome Denny’s in Surprise, Cycle Gear in Surprise and Guns Plus! Membership holds a lot of opportunity for the MMA. Just think… if all of the members of the MMA would recruit just one person we could double our Membership. Now THAT would be an accomplishment! So bring a friend or two to your next meeting! We would love to see you all out at Western Trails Ranch on March 28th for the 4th Annual Old Skool Biker Rally at the Ranch. This is a Great Event and they have a lot planned for the day. They are letting us have a Bike Show at the Event with all the proceeds benefiting the Ironhorse District. As we all know it has become imperative to have your Motorcycle Endorsement. You can go to the MVD and take your test and pass the riding course there or you can take a Rider Education Course in which you will be taught safety skills along with the requirements of the test and you can obtain your endorsement through them. riding courses as well with a discount to MMA members. Also this month our AWESOME paperboy Gary was taken to the hospital and spent 4 days there. He had a lot of company and they all helped the nurses keep him in line. He has curvature of the Spine and has reached the breaking point and he needs to be surgically repaired. He has been grounded from his bike and that is KILLING him… so this surgery is very important and we are all wishing him well. His number is in the back of the paper if you would like to give him a shout… he is always up for some good conversation! We want to thank Avenger and HOGQT for helping Gary get to his Dr. Appointments and thanks Avenger and Joe T. for doing the paper route this month. Until next time….. RIDE FREE ~ RIDE SAFE Michele Mansfield District Manager MMA Ironhorse District www.mma-az.org Leather District Our plans for this year are to have four events this year which are the 3-ball run, the MMA beach party, witch hunt, and our Christmas party. The Leather District MMA had its annual 3ball run. The weather was great. The turnout was great and we have a lot to be thankful for. Bob C. won first, Bob D won second, and Jerry V won third; all turned in good scores. In fact, Bob D and Jerry V were tied for second and had a shoot out for the tie breaker. Thanks go out to our hosts, Dave’s Place where the run started. They came in early for us to set up and were very cordial to us. Other stops included Wild Bill's, the 5030, Marino's and the Deli Sport's Bar which hosted the last stop and Grand finale. We also want to thank Mike F the cook for bringing some great meatballs, Italian sausage, and pasta. We owe a debt of gratitude to the folks who worked behind the scenes and at the stops. But most of all, we want to truly thank you, the motorcyclists who participated, attended and made for good fun at all the stops. We will definitely be looking forward to the Ninth Annual 3Ball Run this time next year. In the mean time, please be careful out there and we look forward to the next MMA event - the Beach Party. I would like to thank Lisa, Linda, and Gloria for taking on the communications job. They made phone calls and sent out emails for this month’s meeting. What a great job they did! If you didn’t get either a phone call or an email, contact one of the officers and we will make sure your information is up to date. During the meeting we covered all the officers’ reports, which were approved unanimously. Well, except for JC! The Board report was given and some changes at the State level were discussed. Congratulations to Tom Corr on becoming our new Vice Chairman. If the name sounds familiar, it probably does. He used to be the

owner/editor and writer extraordinaire of Thunderroads and has been a long time supporter of the MMA. For the first time, we have a Communications person at the State level. Jonathon Lucero aka “Spinner” has agreed to take on that position. He made an impressive presentation and was extremely organized for his first meeting! Congrats and thanks Spinner for taking on this new position! This past month all current members of the MMA should have gotten a letter in the mail explaining that you now have, through the MMA, a $2,000 accidental death and dismembership insurance policy. This policy is free to every MMA member. What a deal, where else could you get a $2,000.00 insurance policy and an MMA membership! If for some reason you have not received your letter, please contact me or any of the Phoenix District officers and we will get that information to you. CJ discussed the some of the current bills that have been introduced. One is the Right-of-Way bill - HB2208. Some of the things that will be included in this bill are long suspensions of licenses, specific language that describes what a ROW violation is, and a classification to include a driver without having a valid license. He also discussed the MS Fund council sunset extension bill, and the bill that specifies that if you get pulled over and don’t have a motorcycle endorsement on your license, your bike will be impounded for 30 days. For more detailed information on these and other bills, visit our MMA website and click on the legislative link. You will also find a link for the new Senate and House Rosters and for a legislative district map. If you haven’t checked out our site yet go to www.mma-az.org. It is a great site and contains a lot of great information! Some of the upcoming events that were discussed are the Motorcycle Day at the Dome on February 18 and the 17th annual Freedom Beach Party on February 21. Hopefully many of you had the chance or are planning to attend one or both of these events. The NCOM convention in May was also discussed. If you’ve never had the chance to attend an NCOM convention, try to attend at least one. There just aren’t the words to describe what it is like to attend a convention where so many people come together for one reason, to fight for our rights. In June, Arizona will host the regional Best of the West MRF convention here in Phoenix. With the convention being here in the valley it is a great opportunity for you to attend a convention and learn first hand what is happening not just at the local level but at the national level. One of the things that really impressed me when I attended this conference a couple of years ago was just how approachable and knowledgeable the speakers were! The MMA will again pay the group attendance fee this year and anyone in the MMA that wants to attend will be able to. Come to the next District meeting to find out more information! As the meeting wrapped up, the drawings were held. Darla won the membership drawing and Gary won the 50/50 drawing, congrats! Preacher said the closing prayer and the meeting adjourned. After the meeting some ideas for some fun runs were discussed. One that has been happening for a couple of months now is a titty-bar run. Every third Friday, a group meets at the 1800’s and rides to a different location. The group leaves

One day we will have the most incredible riding weather with clear blue skies, 70 degree temps and open road as far as the eye can see. The next day we will end up with 32 degree temps, clouds so low you would think that you’re in the Bay area of northern Cal, and mix of rain and snow? To make a long story short, we are all looking forward to spring soon! With spring rapidly approaching and the hopes of wonderful weather we have been working on a few pet projects. The Verde Valley District's Safety officer Michael Mooney and District manager Big-Bo have been working with the Team Advanced Rider’s out of Phoenix. What we have been working on is getting a few classes up here in the Verde Valley Area. The coordina-

tors at Team have been very cooperative and accommodating while we work to make this happen. As it stands now, they have agreed to come up here and teach some advanced courses providing we could arrange a suitable location that fits the size and safety requirements. We have found two such locations and are in negotiations with them to be able to use their property now and continually on into the future. We will keep you posted for updates and prices. Recently the Verde Valley District had the Honor of coming together one Saturday morning and riding to K&A Cycles and Accessories to present them with the MMA-AZ 10-year Award. The award recognizes their loyalty in supporting the MMA-AZ and the Verde Valley district for over ten years. The plan turned out great. Keith, the present owner of K & A Cycles has just started a new customer appreciation day. The first Saturday of every month, Keith and his staff pull out this huge custom made trailer with grills, BBQ, Smoker and griddles on it and cook burgers and dogs for the customers. This was his first Saturday doing the Customer appreciation BBQ and we all rolled in right about noon and Keith had no idea what was up. There were about 15 or so District members as well as a reporter and photographer from the Verde Independent to cover the award presentation. Keith was very happy and surprised when Bo presented the plaque to him and he vowed to remain a loyal business supporter for the MMA-AZ and the Verde Valley District. NCOM BIKER NEWS BYTES Compiled & Edited by Bill Bish, National Coalition of Motorcyclists NATIONAL MOTORCYCLE CRASH STUDY UNDERWAY Southern California motorcyclists who crash their bikes may play an unintentional role in improving motorcycle safety nationwide, as the pilot portion of the federal government's muchanticipated Motorcycle Crash Causation Study kicked off at various locations throughout Los Angeles in December. Data will be compiled from LAPD accident reports and information recorded by mechanical sensors and cameras placed at intersections until at least 27 accidents have occurred and are documented -- a milestone that will likely be reached by March. According to Doug Hecox, spokesman for the Federal Highway Administration, the Department of Transportation entity managing the pilot study, the pilot is "purely to test the methodology" that will be applied to the broader Motorcycle Crash Causation Study, which is expected to kick off in about a year in a handful of different states. Final results of which won't be available until at least 2013. Much has changed since the last such motorcycle accident study, the 1981 Hurt Report; about 11 million street bikes have been sold in the U.S. The average rider's age has increased from 27 to 41, and the overall rider population has grown to roughly 7 million. Traffic mix, driving/riding laws, and more powerful motorcycles are some other variables. FEDS DECLINE TO INCREASE TARIFFS ON EUROPEAN MOTORCYCLES U.S. trade officials have decided not to include motorcycles on their lengthy list of European products that will soon face increased tariffs in retaliation for a European Union ban on imports of hormone-fed beef from America. In public comments submitted to the Office of the U.S. Trade Representative opposing the possible 100% import duties, many motorcycle organizations, industry groups, manufacturers, dealers and others pointed to the extensive economic impact on businesses and jobs affected by such retaliatory tariffs, as well as a hardship for motorcycle enthusiasts. Also, motorcycle usage should be encouraged for fuel efficiency and easing traffic congestion and parking. MYRTLE BEACH SAYS NO TO BIKERS Myrtle Beach has launched a website and printed brochures advising visitors that from the city's perspective, the May motorcycle rallies are over. The Website bears a message from Mayor John Rhodes stating that the “Harley-Davidson Dealers Association Spring Rally and the Atlantic Beach Memorial Day Bikefest will not be held in Myrtle Beach”, and lists 15 new laws the City Council has passed to discourage bikers from coming to town. Designed by the Myrtle Beach Chamber of Commerce, the top of the site proclaims; "effective 2009, Myrtle Beach, SC will no longer host motorcycle rallies." To deter bikers, the city implemented stricter noise rules, will be enforcing a municipal helmet law, require eye protection while riding and a variety of restrictions on vendors, parties and motorcycle parking. The city passed a property tax increase to fund the anti-rally campaign.

But the Myrtle Beach Bike Week website counters this, saying that the rallies have not been cancelled. The Myrtle Beach HarleyDavidson website is still encouraging motorcyclists to come. It states that 90% of the events and most of the businesses that cater to the 500,000 bikers who come to the region during three weeks in May are in Horry County, which has not adopted any new ordinances and welcomes riders to the 69th annual event, scheduled for May 8th - 17th 2009, if the rally goes on. MAKING NOISE ABOUT NOISE Numerous communities around the country are attempting to regulate noise, and specifically loud motorcycle exhausts. Although enforceability is questionable, Gettysburg, Pennsylvania is planning a controversial new ordinance to curtail incessant noise. “How do you pull over 50 motorcycles when one is being loud?” said police chief Joe Dougherty. “It’s violating someone’s constitutional rights.” The ordinance is currently being reviewed for legal sufficiency, including enforceability. A similar law was enacted in Denver that requires motorcycle mufflers to have a factoryissued U.S. Environmental Protection Agency sound-test stamp. But some who have protested the ordinance since it took effect in July 2007 have gone as far as to take the issue to court, arguing that the ordinance is vague and unenforceable. One “victim” of the ordinance is Jeffrey Lubbert, who was pulled over on his motorcycle in August 2007 when an officer testified that he heard exhaust pipes that were “louder based on my training and experience,” according to court documents.

In the state capital of Kaduna, hundreds of motorcyclists staged protests against the crash helmet directive, storming major roads chanting war songs and causing panic and traffic jams. In Lagos, at least 2,500 violators of the directive have so far been arrested as the Federal Road Safety Commission intensified the enforcement campaign for both riders and passengers. In Osun State, the Nigerian Tribune reported that no fewer than 73 motorcycles have been impounded by the FRSC because their operators failed to abide by the use of crash helmet. The MMA Culture Of all the people I know, bikers are the ones I trust the most. My biker friends are the ones who have stood beside me when the times got tough. The loyalty that bikers have for one another is at the heart of the American Spirit. A fighting spirit aimed towards the pursuit of happiness that has been going for more than 60 years and continues to grow. Brothers and sisters of all walks of life and from all over the world coming together with people who are just like you and I, freedom seekers on a mission to find the ultimate ride. As more and more people see that bond that bikers have, the more they realize what is missing in their friendships and relationships. The biker culture is exploding all over the world and with good reason. There is a direct connection between how many bikers there are in a country and how free that country is. When I see the first biker clubs popping up in other countries, I know that freedom is taking hold there. The biker way of life seems to be a threat to some people who believe that they can make the decisions better than you can. Imagine not being able to work on your own bike or only being allowed to own one modified motorcycle in your entire life. Imagine being labeled a gang member for wearing leather. In one form or another, attacks on our freedoms have been attempted and will be attempted in the future.

This is where the Modified Motorcycle Association of Arizona comes in. We not only fight for greater freedom but for a culture of freedom. Having served as an officer in the MMA for almost four years I can bear witness to the battle that has been waged in the name of freedom and justice. All over the state of Arizona there are MMA districts working hard to make sure that the battle leans our way. The MMA district meetings are not all politics and government stuff, they are a way to meet people who think like you and love to ride like you. The understanding of freedom that can be experienced on a motorcycle is something special that can only be shared with someone else who rides. Having operated in Arizona for more than 20 years, MMA members have a great deal of experience putting on events and rides. Most districts have rides scheduled for after the monthly members meeting and are great fun. Check out your local MMA district meeting and see why we have around 1400 members across the state.
