Editor’s Letter Boy, am I glad to see the end of 2016! It has certainly been an unforgettable year, chock full of valuable life lessons and more than its fair share of challenges.The unexpected has reigned supreme globally, what with BRExit, Donald Trump emerging as US President Elect, the continued rise of the dollar against the naira, and Linda Ikeji Social. PROTECTING YOUR BRAND IN NIGERIA he online Business Dictionary defines a brand as any “unique design, sign, symbol, words, or a combination of these, employed in creating an image that identifies a product and differentiates it from competitors.” Broadly speaking, this discussion falls under the category of intellectual property rights which includes copyrights, patents and trademarks.

Copyrights are proprietary rights an owner has over intellectual works. The Copyright Act lists out eligible items for copyright to include literary works, artistic works, musical works, cinematographic films, sound recording and broadcasts. Patents are rights that grant exclusive and proprietary rights to inventors over their inventions. The Patents and Designs Act provides that inventions should be new, resulting from an inventive activity, and capable of industrial application, or constitutes an improvement upon patented invention as well as meeting with the requirements of newness,

A trademark is any device, word or a combination of words, or symbols that indicates the source of ownership of a product or service. The Trade Marks Act defines a mark to include a device, brand, heading, label, ticket, name signature, word, letter, numeral, or any combination thereof. It is this definition that aligns most with the definition of a brand, and both terms are often used interchangeably. The underlining requirement for any of these rights to inure on a person's brand is that such brand must be original. It must proceed from and pertain solely to the person claiming it. What is Brand Protection? traddling the business arena today are a lot of SMEs, start-ups, budding and burgeoning businesses that have not bothered to protect the brand they promote. If a brand for a company is like a reputation for a person, how then can brands be protected like people protect their reputations?
In today's milieu, given the fast-pacedness of technology and the internet over markets and global trade relations, perhaps the most disturbing and debilitating impact of the internet is the crime of cyber squatting. Wikipedia defines cyber squatting as using a domain name with bad faith intent to profit from the goodwill of a trademark belonging to someone else. It could also be for criminal purposes.
The concept of brand protection basically entails using legal means to guard against unauthorized use and abuse of a brand for criminal purposes or profit making.
Thankfully, the National Assembly has risen to the challenge as well by enacting, in 2015, the CyberCrimes (Prohibition, Prevention, etc) Act. The Act defines the offence and stipulates a penalty of N5,000,000.00 (Five Million Naira), or (2) two years imprisonment, or both.

Before a person or organization can protect its brand, however, such brand must have been registered in the name of that person/organization. It is also worthy of note that the owner of a brand is the first person that registers the brand. In 2015, American Shoe giants New Balance Athletic Shoe Inc. was ordered to pay Y98,000,000.00 (Ninety Eight Million Yuan) to a Chinese businessman for infringing on his character mark. The facts are that New Balance had been promoting its shoes in China using “Xin Bai Lun�- the character in dispute- without complying with the legal requirement for registration of character marks and exclusivity of the brand name. Mr. Zhou, a Chinese businessman complied with the requirement much after New Balance has established its presence in the Chinese markets. He sued for infringement of his character mark and protection of his brand integrity, and the court found in his favour. It follows the legal principle of first-in-time.

Despite all of these legal interventions at curbing brand abuse, all over the world there continues to be a surge in global counterfeiting and criminal weakening of brands integrity by unscrupulous elements. The story in Nigeria would definitely present a sorrier, grimmer case. We cannot really quantify, in statistical terms, the impact of this malaise on businesses, but it is surely huge. And it did not start today. What, then, are the reasons for this nonchalance towards brand protection in Nigeria? Why don't Nigerians flock the Federal Ministry of Investment, Trade and Industry and parastatals empowered with the responsibility of registering brands, just like they queue up at the Corporate Affairs Commission everyday to register business names and incorporate companies?
BUSINESS I. Lack of Orientation: The average Nigerian is hardly orientated about legislations and rules applicable in the country. For instance, cyber squatters and counterfeiters would be more hesitant if they are aware that a jail term awaits them plus a fine of N5 million. The government has a huge role to play in educating and sensitizing the general public by hosting symposiums and seminars.passivity, and treat our businesses with more concern. ii. Fear of Cost: Upon orientation and exposure to applicable laws regulating matters of this kind, the next major concern for the average Nigerian is the pecuniary implications. And this is a germane fear, as sometimes, the cost of complying with all the requirements and procedures of the law could be financially over-demanding for the start-up SMEs. While advocating for a review of costs in registration of brands to stimulate business and economic growth and activity, it is pertinent to mention that at the end of day, the cost of complying with the legal requirements far outweighs the cost of non-compliance. iii. General apathy/passivity coupled with a belief that these things are of no moment in Nigeria. It is the general Nigerian malaise; the ability to trivialize important things until it finally ends up in litigation. The Nigerian legal arena is indeed rife with suits bothering on the tort of passing off of one's goods/brands. Most of the times, as we see, it is as a result of this apathy/passivity. In conclusion, we all have at some point, purchased goods innocently believing we were purchasing a registered brand only to subsequently discover, to our utmost dismay, that we have bought a counterfeit of the brand we wanted. Indeed, from soaps to mobile phones, to creams to groceries, to clothes, you just name it: we have all patronized “Aba-made” or “Chinko” counterfeiters, knowing or unknowingly. The impact of this has been sweeping. Systech, an online brand protection company recently came up with statistics showing how global counterfeiting and brand cloning is costing companies worldwide over an excess of $100 billion and threatening the overall security of consumers in an unprecedented scale. It is a call to take more seriously, the things that matter in our businesses. There are currently anticounterfeiting apps that help in brand security and protection. They notify brand owners of likely encroachment on their brands, notify intending users of the existence of a brand and suggest likely options for use and registration, and perform a host of functions ranging from policing to informing and protecting about brands. Nigerians should embrace them, as the world has become a globalized village regulated by technology. There is really nothing to be worried about registering a brand or trademark, and we should rise beyond apathy and passivity, and treat our businesses with more concern.

That is what I was created to do. The concept of competition is often so intimidating for new business owners that it stifles you, paralysing your efforts even before they fully begin to show. SPOTLIGHT y journey into fashion began in 2012. I was an intern at the Lagos Fashion and Design Week. At the time, I wasn't decided on the particular area of fashion to work in, but each time I wo re s a n d a l s , I go t s eve r a l compliments. I remember just sitting one day, and seeing pictures of sandals in my mind's eye. So I took a sketch pad and sketched out what I saw. I decided to begin making sandals for friends and family, as a means of survival. My first collection showed in the 2015 edition of the Nigeria Student Fashion Week. The collection was sponsored solely by my mum. She's my biggest supporter. No matter what you wear, you're never fully dressed until you have good shoes on. Hence, Maliko was created to help spice up outfits, because I saw that the creative use of leather is limitless. And I feel like it's this aspect of fashion that hasn't really been explored in Nigeria. Bottom-line, Maliko was created to make fashion statements with leather.We're a brand of trendy leather works, using locally available materials to create day to day fashionable pieces such as sandals, shoes, wallets, clutches, rings, bags, belts, etc. I understand that Maliko is a brand, and I treat it as such. Creating a winning brand is not an easy task more especially a brand that can stand the test of time.We're constantly releasing collections that are unique and never before seen in the industry, as well as being actively involved in fashion weeks. My most formidable weapon is sheer creativity, not to mention superior quality materials, which gives us an edge above our competitors. As Creative Director, I pay very detailed attention to the quality and finishing of our pieces.

I had to define the brand when I started getting inspiration about how and what should be done with the brand. I noticed that from every sandal or bag I see, I drew inspiration from them.

Also Maliko became no longer a mere survival mechanism but a brand, when I released my first collection and I received great remarks. We have been able to properly and effectively use the social media platforms in building and also to increase the interaction between our brand and our customer. Fashion is serious business and not a popularity contest. When you're not making money from it, it means you aren't doing some things right. Just like other businesses grow to making tons of millions, everyone involved in lifestyle businesses should aim for that too. I dream of becoming a voice in the fashion industry, using my platform to promote and encourage made-in-Nigeria products. I have learnt to follow my heart regardless of what people or even the economy says. For instance, I study Pharmacology and lots of people really do not understand my passion for fashion, despite my education
in Science. Some of these people eventually see my pieces on the runway and they are amazed. I have had people come to me and say, “Are these products made in Nigeria?� And I would say yes! It makes me proud when they tell me these are the kind of products that will sell in international stores. If I could preach the gospel of entrepreneurship most especially to young people, I would say that it is not a crime to start quite small. Consistency in work pays. Lots of people do not want to start small. I started very small. I was not financially assisted by anyone or organization but I was consistent in creating the brand I wanted. My best advice to entrepreneurs is this: Forget about making mistakes, just do it.

ON CONDOLENCES.NG Let me first say that we pulled that idea from a basket of ideas, so there's more innovation where that came from. That said, Nigeria in my opinion is ripe for innovation because as a country, we're still pretty low on the ladder of civilisation. Anyone who is well travelled is not a stranger to the level of development that obtains outside the country. There is a wide gap between what obtains abroad and what obtains here at home. So it makes sense to try to help our country rise further up the ladder of civilization. Take for instance, sustainable energy. It's as much a part of society as life, entertainment, sports, music, etc. Nobody wants to die, so nobody thinks of death as a social concept that requires innovation. So bereavement is not planned for of course until it takes place. But there's no reason why there can be no innovation in bereavement services. Like I said, it is us, preparing for the future that we know Nigeria will soon catch up on. Our services are in categories. There is the online self-service which is free. Then there is also the premium service where a few charges apply because of manpower that is involved. In a few months, Condolences NG will be one year old.

Innovative thinking is not key in our society. While some societies are particular about their technological strength, we are more about internet fads and social media. I
believe Nigeria will be well again.This is why I decided to return to Nigeria after my MBA and give back to my country, even if it was just by employing one person in a country that has given my parents so much. When you hire one person, you're helping that family. A lot of young people are sacrificing for Nigeria, the sacrifice is in progress already. There are people who could have left but didn't. I think the young people are not being as announced as they should. I believe I can do more, but I am already sacrificing for this country and I do not consider myself a lone ranger in that area. My contribution to nation building will be in the area of employment, empowerment and the ultimate alleviation of unemployment. There is a level of thinking that you will never achieve as a human being, if you don't explore the higher realm. This is what distinguishes your efforts. God at the beginning, in the middle, and at the end.

agree that successful businesses are born in a recession. Like Condolences.NG is born in a recession. Recession or not, people will die. This is why it's a service will be here for a long time. There's a recession, but people must eat, so certain services thrive, regardless of the recession.The idea is to identify a social gap that you can bridge, or you are meeting a need. The problem is we don't have innovation as a sub culture so mediocrity is celebrated. The cancer we must fight is mediocrity. We must do this by challenging the status quo, thinking outside the box and encouraging an environment in which innovation can thrive.
ON FAITH AND PERSONALITY
I
enjoy the interpretation of information for social value. I sift information, process it and extract value out of it. Call me a value extractor and disseminator. This requires solitude and the ability to think outside the box, which I quite enjoy. I am a man first, before my faith. My faith is a conscious decision, exclusive of my person. But I must say that there is nothing that I have achieved outside God. The place of God for anyone who did not create themselves should be unshakeable. God is not in this dimension so anyone who must excel must be able to tap into what exists outside this dimension. Take for instance the idea for Condolences NG. It came via inspiration that is outside this dimension.

One of the early adopters of the Nigerian Social Media space, she is the founder of OloriSuperGal, a lifestyle and entertainment website; Media Exposure, a digital marketing firm; and Travel Africa Story, a travel curator platform for travellers in Africa and beyond. How did you go from a degreein Accounting
to owning an entertainment blog?
I
would say that blogging chose me. I was passionate about the online space, starting with Twitter and then on to other social media platforms. I worked in paid employment first as a personal assistant to popular Nigerian comedian and MC, Gbenga Adeyinka at Laff Matazz between 2008 and 2009 and later as social media manager at Black House Media (BHM) between 2011 and 2012. It was whilst transitioning between both roles, that I created the OloriSuperGal blog on Google's Blogger platform in 2010 and eventually moved it to a selfhosted domain in 2012. When I started in 2008, it looked like I didn't have a job. Not many people were bloggers in those days.Today, what started out as a passion is a full-fledged business that employs 5 staff and has given birth to other businesses. The digital media industry is huge. It is taking over several big job titles, and there's no limit to the potentials of new media in Nigeria.

How have you stayed relevant in your field,
now that everybody is blogging?
I
'll tell you. I believe in building capacity. Building capacity is important to being and staying relevant in any field of endeavour, not just blogging. To do this, I got a Certificate in Media Enterprise from the School of Media and Communications, Pan Atlantic University, Nigeria. I have also participated in leadership and enterprise training organized by Daystar Christian Centre and The Future Project. As far as my brand is concerned, we never compromise on delivery.This has maintained our clients' confidence in us.
Tell us about the journey so far, and your several achievements.
I
t's been most fulfilling I must say, but isn't that the case when you're pursuing your passion? The brand has gone from just me to employing several people. In 2014 I also began to train aspiring bloggers. The influence has grown and I'm thankful. Tosin Ajibade is an avid public speaker, and has graced several platforms including Social Media Week Lagos, The Red Summit, Leading Ladies Africa, Rise Networks, MTV Base Africa Master Class and Digital Entertainment Africa Conference.
Several speaking engagements have resulted from the influence you've built, tell us about that.

y first public speaking gig was in 2011, and since then there have been several other platforms. It started out with me just telling my story. I guess it was inspirational enough to be told and retold over time.

The New Media Conference is one of your babies.
How did the idea come for that?
I
thought there was a need for the gathering of digital media strategists, content curators, digital agencies, tech bloggers, geeks and other key stakeholders with the aim of improving marketing and advertising standards in the Nigerian online/digital media space. We decided to call it the New Media Conference.The first edition was held in May 2015 and plans are in motion for the 2017 edition. An amazon in her own right, Olori Tosin is passionate about socioeconomic empowerment and addressing important social courses, including the campaign against gender based violence and awareness drive about Vitiligo. She served as a coordinator of the "Walk Against Rape" project, from in 2010 till 2014. She also actively canvassed for financial support lending her online social assets to help raise funds for the treatment of a breast cancer victim under the "Save Debbie Project".The OSG brand also helped create major online awareness during the World Vitiligo Day 2015. In the course of working with over 300 corporate and individual client brands since inception, Tosin has garnered several accolades, including being named on two of YNaija's prominent lists in 2015: “Nigeria's 1 0 0 M o s t I n s p i r i n g Wo m e n (#YWomen100)” and "100 Most Influential Nigerians on Twitter 2015". In 2014, Tosin was nominated for the ELOY Blogger of the Year award as well as at the Social Media Africa Awards. The previous year the OSG had been nominated for “ELOY Online Media of the Year” award. or me, it wasn't always books. I tell a lot of stories on my Facebook wall. I ran a blog for a year. But when the stories get longer, you begin to think book. It's never going to be just books for me, though. I intend to tell my stories through visual means—films mainly. I already have a stash of screenplays and series for that. Recently, I published an e-book titled “Living in Gidi”, and just as the name reads, it's about Lagos, from the eyes of a keen observer. It is a collection of short, witty stories about life in Lagos. It follows the accounts on the streets, providing insight into this intrigue that is a city, and is written with a lot less seriousness than the city connotes. The street photos in the pages help project the images the stories are trying to paint. I was inspired to write it because I lived these experiences—most of them. I thought it would be interesting to an alien, and nostalgic (at least) to Gidi denizens. I also wanted to make people laugh. The response to the book has been pretty good…

didn't always know I'd be a writer, I thought I'd be a scientist. In my next life, I'd be a scientist. Back in school, I loved all those science subjects and did absolutely well in them. But that was a dream too big from where I came from. I began
taking writing seriously after NYSC, and without a job to tie m e d o w n , Facebook Notes provided an avenue to publish my thoughts for free. When people began giving me nods for stuff I wrote, I wrote some more. I was
only playing, but they were praising the work. I did have other jobs. I dabbled into music production, website design, marketing. Now, it's just writingstory telling and screenwriting-and working in film productions.

Meet The Author The When Well, I happened on writing sometime in 2014, although I had done a bit of what could be termed writing before then. I didn't decide it would be my career, because I was and still am a fashion entrepreneur. I did work with a telecommunications company for six years, after which I resigned in 2009 to become an entrepreneur.
The Why It was in 2014 that it came to me that I'd be writing and the first person I told was my aunt, Mimi AdeOdiachi. I told her, I would be writing 4 books – a series, and I told her the titles of all four books. I'm sure she must have wondered how I would go from fashion to writing, but that's how books come, suddenly and without warning. You know, you are a sum total of your experiences till date. So that informed the writing of books.
The How I wouldn't say my writing is influenced by any author, even though I really love John Grisham and I've read his books more than any other author. But my writing took on my natural way of communicating.
ABOUT SON OF MY FATHER. SON OF MY FATHER is the first book in the four-part series, titled The Son Series. Dad, Very Rev. Solomon Adebayo Olukuade on the event of his 80th birthday in 2015. I figured a two-page tribute wouldn't do for the kind of life my dad has lived, so Son of My Father came to be. Being the first, the response has been quite encouraging and the society is really warming up to the idea of the book: reinforcing the need for good fathers. The book carries potent messages on qualities of a good father and raising great sons.The myriad of problems in the world today could be traced to the absence of good fathers in the home. The presence of great fathers in a child's life goes a long way in the outcome of that child. And once the home front is taken care of, the society will be better for it.

Protect Against Cancer These days, it seems like everything causes cancer, but that isn't the case when wine is involved. Wine contains ingredients that help to kill off the Big C.The phenols that help to keep the heart healthy also help to keep the cells healthy. They slow down the cancerous cell growth, especially when it comes to breast and prostate cancer. Liver cancer cells can also be slowed and prevented from further growth through the antioxidants in wine. The antioxidants fight against the free radicals in the body, which cause dead and damaged cells to form abnormally. The School of Dentistry at the University of Missouri has also found that oral cancer can be prevented through drinking wine, especially red. It is worth pointing out that too much can also be damaging to the teeth, and red wine can lead to staining.

This is one of the reasons why you need to drink it in moderation. The good news is the oral cancer is fought off by the antioxidants, especially resveratrol and quercetin. Ovarian cancer is also something that can be fought against through the drinking of wine. Australian researchers have found that a glass a day keeps women free from ovarian cancer,
reducing the risk by 50% compared to non-drinkers. Researchers at the University of Hawaii have also found the same thing, and the antioxidants have been praised for this benefit. Some studies have even found that the red wine can kill ovarian cells. This was done in a test tube, but it shows the potential benefits in the body.
Boost Your Bone and Teeth Health

ighting against cancer cells isn't the only way your teeth and bones will be protected.Wine also helps to reduce the risk of osteoporosis, which is when the bones thin and is usually related to age.The body struggles to absorb calcium, weakening the structure of the bones and teeth. When you drink wine, you can absorb more calcium to keep the structures thicker and able to handle more. This benefit has been noted when you drink between 11g and 29g per day. The American Journal of Clinical Nutrition published a study where 500 elderly women had their bone mineral density tested.
