ESTATE PLANNING FOR CANADIANS What You Need to Know By Julie Achtermeier

While it may be an unpleasant topic to broach with loved ones, every Canadian should take time to plan their estate in the event of their death. Losing a loved one is traumatic, but it is even more traumatic to pick up the pieces once they’re gone, especially if they haven’t done any planning. Planning ahead can alleviate a great deal of stress for your family. Here are some key areas to start with: LEAVE A WILL A will is a legal document that provides instructions as to how you want your estate to be divided once you pass on. It includes what you own and what you owe. Although you are not legally required to prepare a will, without one your family may lose control of how the estate is to be divided among surviving family. The province or territory you live in will have its own laws as to how to manage your estate after you’re gone. It’s always a good idea to seek professional legal counsel when creating a will. A lawyer has the expertise to ensure documents are prepared and witnessed properly. The costs for a basic will are only a few hundred dollars and well worth the investment. During the

creation of your will, ensure you have named an executor or estate representative. This is the person who will manage your estate after you’re gone. You may name anyone as your executor, and you may name more than one person - for example, if you have more than one child, you may want to make all children joint executors. Along with naming an executor of your estate, you should also appoint an executor to make medical decisions on your behalf, should you become disabled or incapacitated. Once your will is created, review it often. Ensure it reflects your current wishes, especially after a significant life event like having a child or losing a spouse.


PRE-PLAN YOUR FUNERAL To ease the burden of funeral planning for loved ones, you can plan your funeral while you are still in good health, and pre-pay for your funeral service. Funerals can be very stressful and expensive. Preparing and pre-paying for your funeral will ensure that your loved ones aren’t responsible for this expense and also gives you control to decide what sort of funeral you would like. The laws about funerals differ by province, territory and municipality so be sure to understand the requirements in your area. GIVE MONETARY GIFTS OR TRANSFER PROPERTY BEFORE DEATH In

Canada, cash given to children, grandchildren or any other relative or friend while you’re still alive will not be taxed. It is not reportable and does not show up on tax returns as it is not considered income. If the gift is property, the giver could be liable for tax on capital gains if the property has appreciated in value, such as in the case of a family cottage. Capital gains do not apply if you transfer ownership to a spouse or common-law partner. There are also some potential tax-savings opportunities if you’re a parent in a high tax bracket who passes down non-registered assets to a child to pay down a mortgage or make an RRSP contribution.

BUY LIFE INSURANCE If you have a spouse, children or any other dependents, you need life insurance. In the event of your death, your income stops but dependents will still need to pay bills, rent or a mortgage and living expenses. Think of life insurance as your income to keep the family stable for many years after you’re gone. Early in your adult life is the most critical time to buy life insurance as this is when most adults tend to have a higher mortgage, childcare costs or significant debt. To be left with nothing in the event of the unexpected death of a loved one would be devastating. Contact an insurance broker to determine whether you need term insurance or permanent insurance, or a combination of both. Term insurance has a guaranteed premium for a set term (10 or 20 years). After the term has expired, the premium typically goes up. As time goes on, your need for term insurance will decrease, and you can choose not to renew your policy. Permanent insurance has a fixed premium forever but is more expensive. Talk to an insurance broker to find out about the costs of each type of insurance.

In today’s real estate climate, it’s becoming more common for potential buyers to forgo the home inspection to make their offer more appealing to the seller. The reality is, you may get the house, but you could also be inheriting a whole host of expensive problems. When you don’t ask for a home inspection, you’re relying on the seller to disclose any issues. But, a seller will not always be honest about problems that could potentially affect the sale of their home. The best way to get an honest, informed opinion about the house you are buying, is to ask for a home inspection. Here are some thoughts to consider when deciding whether to include a home inspection request in your offer.


PROS

According to Pillar to Post Home Inspectors, 80% of all real estate deals are conditional on a home inspection. Asking for an inspection is still the popular choice across the country. Getting a home inspection will help identify any potential pitfalls of the home you’re about to buy. An inspector will evaluate the interior and exterior of the home and check for problems with electrical wiring, plumbing, chimneys and flues, roofs and eavestroughs, whether there are signs of mould, and look at the foundation. It’s important to take the inspection report seriously and consider any findings in your final decision, especially if you are buying an older home. And keep in mind that finding problems on the home inspection doesn’t mean you need to back out of your initial offer. It can help you budget for repairs, and in some cases, may affect the final selling price. If a seller is aware of problems with the home, they may be more willing to accept a lesser offer. If you do opt for a home inspection, ensure you are hiring a professional who is licensed and qualified. Ask them about their experience and qualifications, and don’t be afraid to ask questions throughout the inspection, or if you have questions about the inspection report.

If the home you are bidding on is considering multiple bids, asking for a home inspection may cost you the deal if the other buyers have not requested one. In the end, you need to decide whether taking a gamble is worth the risk. If you are not able to afford any maintenance once you move in, you may not want to take the chance of inheriting problems by not asking for a home inspection. If you are prepared to spend money on upgrades or repairs, be prepared to set a budget and put in your offer “as is.” And getting a home inspection is no guarantee that all problems will be uncovered. While inspectors are very thorough, they can’t look behind walls, or under floors, so it is possible there could be problems the inspectors’ miss.
