BY MELANIE BUCK Polk County has yet again suffered from torrential flooding rains that passed through the county on Saturday night into Sunday bringing more water to an already saturated area. More than eight inches of rainfall has been reported in multiple locations across the county and according to Polk County Judge Brandon Ellison, “the first five inches came very quickly on Saturday night.” Ellison was out and about by 4 a.m. Sunday surveying damages left behind by the floodwaters. “The biggest damage came CONTINUED ON PAGE 5
City Council Approves Near $2.5 Million Budget for 2016 BY MELANIE BUCK The 2016 budget for the City of Mena was approved at the Mena City Council meeting that was held on Tuesday, December 8. Monthly reports from city offices were heard as well as passing two new resolutions and an ordinance. Mena’s City Council approved a budget for their general fund of $2,499,573 in estimated revenues and $2,481,589 in estimated expenditures. BY MELANIE BUCK The Polk County Election Commission met for a meeting on Thursday, December 10 to discuss the reopening of polling stations in the south part of the county. Vandervoort and Grannis polling stations have been closed during several of the most recent elections due to not having enough volunteers to fill the positions required to remain open. $2.5 Million Budget (CONT. FROM FRONT PAGE)
more than $1.3 million from the City Sales Tax, $340,000 from County Sales Tax, $305,000 in Franchise Tax, $95,000 in State Turnback money, and $95,000 in Property Tax. The Street Fund includes an estimated $1.7 million in revenue, including $400,000 for overlay and $100,000 for sidewalk projects. Materials for overlay and the sidewalk projects are estimated to cost $615,000 in 2016. Kevin Wolfenbarger was announced as the new Code Enforcement Officer for the City. Mena Mayor George McKee said Wolfenbarger has a master electrician degree and has grown up around construction his entire life. “He’s going to be a real asset to the City. He’s really digging into things. I’m impressed with his good people skills,” said McKee. Fire Chief John Puckett said his department responded to 15 calls in the month of November, which included one fire, two motor vehicle accidents, one car fire, six airport standbys, and four service calls. Puckett also said they had one person retire from the Fire Department, Mr. JC McMillan. Chief of Police Brandon Martin said his officers worked 25 accidents in November and made ten arrests. Councilmember Terri Neugent, who also serves the A&P Commission, gave the A&P report. For several months the A&P Commission has been working to resolve various issues with collecting the required A&P tax from businesses that serve prepared food and/ or provide lodging. Several businesses have been in arrears for months and according to Neugent, there have been several new establishments open in recent months who may not be aware that they are required to pay the tax. City Attorney Patrick McDaniel has been working on a letter to send to both those in arrears and those that haven’t paid at all. Advertising has also begun in local news outlets to insure that those due to pay, will have knowledge of the tax. City Council approved Resolution 1322 that designates percentages for funding District Court operations for the City of Mena, Polk County, and the Town of Grannis for the 2016 fiscal year. The percentages were distributed as follows: Mena 27%, Grannis 17%, and Polk County 56%. With the judges’ salaries added in, (an amount that comes from a different source), the percentages were distributed as: Mena 35%, Grannis 6%, and Polk County 59%. Resolution 1323 was also approved that will allow City Clerk/Treasurer Linda Rexroad to destroy outdated records and supporting documents that are no longer needed. A salary adjustment for full-time City employees was approved by the Council and Andy Anderson was appointed to serve on the Mena Airport Commission until February 26, 2018. The next Mena City Council meeting will be held on Tuesday, January 12, 2016 at 6 p.m. in Mena City Hall.

Rural Fire Depts. Respond to Acorn Fire

BY MELANIE BUCK Firefighters responded to a call just after 2 p.m. Wednesday, December 9th, where a large shed was in full blaze on Treasure Lane, just north of Acorn. The subject at the residence said he was burning leaves when the fire got out of hand and caught the nearby shed on fire. Firefighters from Acorn, Ink, and Cherry Hill Fire Departments, along with Polk County Sheriff’s Deputies and Polk County Emergency Management responded to the fire. Firefighters were able to keep the fire from spreading to a nearby home; however, the shed was a complete loss. While firefighters were still mopping up on that fire call, the Potter Volunteer Fire Department was called to a report of a grass fire on the side of Hwy. 71 South, on Iron Mountain where a small area was on fire. No cause of that fire has been determined. At the time, officials said that the area was dry and with high wind gusts occurring that day the fire danger was increased.

Author to Hold Book Signing at Mena Walmart

One Vehicle Accident Snaps Utility Pole BY MELANIE BUCK A one-vehicle accident occurred on Highway 71 across from Sonic in Mena on Thursday, December 10th, just before 8 a.m. The driver of the vehicle, 37 yearold Melynda Philpot of Mena, stated she had a seizure, which caused her vehicle to leave the roadway. Upon leaving the roadway to the right, the 1996 Ford Taurus crashed into a telephone box and utility pole. The telephone box was estimated to have $500 in damages and the utility pole snapped near the bottom, causing the pole to have to be replaced. Mena Police Department and local EMS services responded to the accident. Philpot was transported to Mena Regional Health System with unknown injuries. An eight-year old passenger was also in the vehicle and was listed on the report with possible injuries.

Saturday night. Just about every bridge in the County was under water at that point. Although they didn’t all get damaged, there was high debris around all of them,” Ellison said. He also said although the Mountain Fork area suffered some damage, most of the damage occurred from Hatfield to the southern portion of the County. An early estimate of the damages is around $150,000 in total and Ellison said there wasn’t enough to file for a disaster declaration or assistance. “It won’t be the most expensive projects, but a lot of smaller ones add up and it will take time to get them all fixed.” Ellison expected all roads to be opened by Monday evening, with exception of two, Polk Roads 22 and 274. Polk Road 22 had the most amount of damage in the county. Two pipes that were 7-8 feet in diameter were filled with debris causing the road to “blow out”, sending a large section of the road downstream in pieces. The road will be impassable for quite some time. Also, the approach to a bridge on Polk Road 274 needs work, causing it to remain closed until further notice. Ellison said other than those two roads, “everything else should be open and they may be rough but the other roads are passable.” Some of the fall road projects the County was working on have been delayed due to this flood and the flooding that occurred during Thanksgiving. Three county roads were set as resurfacing projects but will not be complete until spring. The center section of Polk 41 needs more drainage work in addition to resurfacing. Polk Roads 45 and 46 have also been delayed on resurfacing. However, Ellison said the roads and the work that has already been completed, “stood up beautifully to these recent floods.” “We’ve been through this scenario a lot, especially recently. We know the drill and we’ll get it all fixed back as quick as we can,” said Ellison. Polk County Sheriffs Deputies and Hatfield Volunteer Fire Department rescued one person after their vehicle was swept away by floodwaters on a county road. As always, during heavy rains and floods there is no way to tell if the road or bridge is still intact, remember to turn around, don’t drowned.

HCI Receives Blue & You Grant
Healthy Connections, Inc. has been awarded a grant for 2016 in the amount of $144,052.00 to offer dental care for up to 200 patients without dental insurance. Arkansas Blue Cross and Blue Shield established the Blue & You Foundation in 2001 as a charitable foundation to promote better health in Arkansas. The Blue & You Foundation awards grants annually to non-profit or governmental organizations and programs that positively affect the health of Arkansans. In its 14 years of operation, the Blue & You Foundation has awarded $24 million to 766 health improvement programs in Arkansas. “Our grant this year went to programs across the state that address such issues as nutrition and exercise, dental health, and medical professional education,” said Patrick O’Sullivan, Executive Director of Blue & You Foundation. The Foundation recently awarded a total of $2,942,858 in grants to 40 health improvement programs in Arkansas. From walking trails, to food pantries, to training first responders, the Blue & You Foundation for a Healthier Arkansas touches the lives of many Arkansans.

Toy Ride and Telethon Brings Many Gifts for Local Children
BY MELANIE BUCK RMCC and the local Marine Corps League Detachment 1261 and A.B.A.T.E. held their annual Toys for Tots Telethon that raised money and toys to help insure Polk County children have something under the tree for Christmas. The telethon is held each year at Rich Mountain Community College and is broadcast on local cable channel 19. For entertainment throughout the event, The Junior Ouachita Strings performed as well the Mena High School Drama department. MHS Drama played some of the musical selections from their recently completed show, A Christmas Carol. Norm and Opel Morgan, Chris Gregory, George Murphy, Don Squires, June Lee, Pat McCool, Gene Newton, and Erma Keener also provided music. Robby Burt and Rudi Timmerman were the Masters of Ceremony and both Santa Clause and Smoky the Bear made special appearances. “We raised well over $1000 and several thousand in toys including five brand new bicycles donated by ABATE,” said Timmerman. George O’Daniel, Coordinator for Toys for Tots in Polk County and a portion of Montgomery County, said the annual telethon has been ongoing for at least six years. O’Daniel said in total, they raised $1800 in monetary donations in addition to approximately $1,500 in toys. “We usually raise around $20,000 worth of toys each year by the time all the money and toys are donated locally and the National Toys for Tots donates as well,” explained O’Daniel, who also said there are many organizations and individuals in the county that support the program each year. Toys for Tots is a national program organized by the U.S. Marine Corps in 1947. Annually, the Marines average giving more than 15 million toys to more than 6.3 million less fortunate children all across the United States. O’Daniel said that 97% of all funds raised in Polk County, stay in Polk County. The remaining 3% is used for advertisement and promotional materials such as the collection boxes and flyers. “Everyone seemed to enjoy the entertainment and presentations and we had a good telethon. Every penny collected counts and it all really helps. We couldn’t do it without the entire community participating. We just really thank everyone in the community for helping us,” said O’Daniel. Toys and donations will continue to be accepted until December 23rd. Coats for Kids Available at Bear State Bank
BY MELANIE BUCK Bear State Bank has been spearheading the Coats For Kids Program in Polk County for more than twenty years and has launched their 2015 coat drive and giveaway. “We are happy to help the children and families in Polk County stay warm in the winter by providing gently worn and new coats through this wonderful program,” said Vice President Jennifer Maechler. At the beginning of October each of the three Mena locations and the Cove branch of Bear State Bank place Coats For Kids receptacles in their lobbies. “We rely on our generous Polk County residents to donate coats of all sizes towards our program; without the support of our community this program would not have survived twenty plus years,” Maechler said. “We let the community know about the program by word of mouth, through advertising in the paper, and by email; to our schools, churches, and other local organizations. We are fortunate that local groups, such as the Lioness Club, support our program and donate to it. This helps us dry clean the coats and purchase any we may need.” If anyone knows of a child in need of a coat, call Bear State Bank Main Branch at 479394-3552 or any of their smaller branch locations and “we will find a coat for them,” said Maechler. Also, parents, teachers, counselors, or anyone, can come to the main bank and pick out a coat, or coats. Maechler added, “In the past we have had great support from our schools and we are happy to pick out coats and deliver them as well.” Last year there were over 250 coats provided to Polk County children and young adults through the annual Coats for Kids program. “We are happy to help our families and keep them warm,” said Maechler.

Students answered oral questions on geography and were involved in the first round in the 28th annual National Geographic Bee. Austin McEntire, an eighth grade student at Mena Middle School won first place and will have a chance at a $50,000 scholarship. Thousands of schools around the United States and in the five U.S. territories are participating in the 2016 Bee. The school champions, including Austin McEntire will take an online test; up to 100 of the top scorers on that test in each state will then be eligible to compete in their state Bee on April 1, 2016. The National Geographic Society will provide an all- expenses-paid trip to Washington, D.C., for state champions to participate in the Bee national championship rounds May 22-25, 2016. The first-place national winner will receive a $50,000 college scholarship, a lifetime membership in the Society including a subscription to National Geographic magazine and a trip to the Galapagos Islands, courtesy of Lindblad Expeditions and National Geographic. James LeRoy Atkins, age 58, of Mena, Arkansas passed away Sunday, December 13, 2015 at the Mena Regional Health System. He was born on Sunday, July 7, 1957 to Albert Carl and Arnetha Cole Atkins in Oroville, California. James had his outlook on life and saw people for who they were. He was a great guitar player and really enjoyed making music. Some of his country music heroes were Merle Haggard, Hank Williams, Johnny Cash and many more. James loved his family and spending time with them. He and his wife, Terrie, always wanted to retire to a cabin in the woods. James was a loving husband, son, father, brother, grandfather, uncle and friend and will be missed by all who knew him. He is preceded him in death by his father and his brother, Max Atkins. James is survived by his wife, Terrie Atkins of Mena; his mother, Arnetha Atkins of Ozark; son, Kenneth Siler of Mena; three daughters, Amy Winger of Mena, Jamie Moore of California, and Arletta Barcenas of Celina, Texas; one brother, Andy Atkins of Vian, Oklahoma; four sisters, Fay Wilhite of Chula, Arkansas, Carlene Canada of Lubbock, Texas, Sharon Wright of Bedford, Oregon and Rena Haynes of Texarkana, Arkansas; his grandchildren, Alex Tabor, Cameron Tabor, Christian Siler, Latonia, Heidi Siler, Michelle Barcenas and Lorenzo Barcenas; several nieces and nephews and a host of other relatives and friends. loved her family and church family, and enjoyed spending time with them, especially her greatgrandchildren. She loved to cook for her family and friends, and enjoyed flower gardening. Her faithful companion was her dog, Alma, which she adored. Marie was a loving and kind mother, grandmother, great-grandmother, sister, and friend to all who knew her. She will be dearly missed. Albert B. Burger, age 85, of Mena, passed away Monday, December 07, 2015 in Mena, Arkansas. Albert was born in Billings, Missouri, on March 22, 1930 to the late Ernest Burger and the late Theresa Schatz Burger. He was lovingly married to Lola A. Oldham Burger and worked as a USDA Food Inspector by profession and a member of the AFGE Union. Mr. Burger proudly served his country in the United States Navy. He was a member of the St. Agnes Catholic Church and enjoyed being a member of the Knights of Columbus. Albert loved and enjoyed gardening, being known to have a “green thumb”. He enjoyed his John Deere tractor and working as carpenter. He was well known for being a history buff. Albert loved to travel seeing friends, family and enjoying the sights of Arkansas and other places, even if only for a day trip. He was a loving and kind husband, father, grandfather, brother uncle and friend to all who knew him. He will be missed dearly by all. Education Reform Bill with Boozman’s Amendment Headed to President’s Desk
State Finds a Way to Move Highway Projects Forward
BY state senator larry teague LITTLE ROCK – When Congress approved a federal highway funding bill, it was good news not only for the Arkansas Highway and Transportation Department but also for those in numerous states across the country. The measure guarantees federal transportation funding levels for the next five years, so state highway departments can budget for long-term projects. Over the past year Arkansas highway officials had to postpone hundreds of millions of dollars worth of highway projects because of uncertainty about federal funding. Traditionally, federal highway bills have set funding levels for multi-year periods, but for the past decade or so Congress had been approving patchwork funding bills. Some were for only a few months. For the past year Arkansas highway officials have been monitoring the state’s cash flow to make sure federal funding was sufficient to complete projects scheduled for bidding. During the first half of 2015 they decided to postpone 87 projects worth an estimated $411 million because of uncertainties about federal funding. However, in September the state was able to move forward on 30 of the 87 postponed projects. The director of the Arkansas highway department said his agency was happy about Congressional passage of the highway funding bill because it removes uncertainty for five years. Many highways in Arkansas are maintained and improved with a combination of federal and state funds, with federal money amounting to 80 percent of the payment for some road projects. Now that Congress has acted, it is up to the states to provide matching funds. If Arkansas comes up with matching funds we could increase our share of federal funding by about $50 million a year for the next five years. The governor has said he would outline his plan for state highway funding early next year. He appointed a working group last year to develop funding options. Its recommendations would generate $160 million a year, of which 15 percent would be distributed to cities and 15 percent to counties for local road and bridge projects. The budgets of highway departments throughout the country have suffered because of a decline in purchasing power from one of their major sources of revenue – the motor fuels taxes levied on gasoline and diesel. That’s because cars and trucks have steadily improved in fuel efficiency, and are getting many more miles per gallon than they used to. For example, since 1993 the amount of motor fuels tax revenue collected by Arkansas has increased by 16 percent for gasoline and 22 percent for diesel. Over the same period, the cost of highway construction has gone up 181 percent. According to highway officials, the “shrinking” of the motor fuels tax dollar means that now Arkansas can afford 70 percent less in overlay and 59 percent less in widening of highways than it could in 1993. The trend is expected to continue because consumers want better gas mileage. Automobile manufacturers now produce and market hybrid vehicles and 20 years ago they were still mostly in the planning and development state. The governor’s working group on highway funding listed several alternatives to motor fuels taxes as possible sources of new revenue for highways.

Amendment aims at integrating career & technical education with academic curricula & teacher professional development BY u.S. senator john boozman WASHINGTON – The U.S. Senate passed a bipartisan, comprehensive reauthorization of the Elementary and Secondary Education Act (ESEA) today that included an amendment authored by Senator John Boozman (R-AR) that focuses on career and technical education. The conference report for the reauthorization bill, the Every Child Achieves Act, passed the Senate by a vote of 85-12 and will be sent to the President to be signed into law. “As a former school board member, I understand that education decisions should be handled at the state and local level. A one-size-fits-all policy forced on our schools from Washington is not effective. This bill is a good step toward expanding state and local control over education,” Boozman said. When the Senate first considered this legislation, Boozman offered an amendment that aims to improve career and technical education programs and it remained in the conference report. “The lack of real-world learning opportunities in our high schools is one reason students drop out. We need to be preparing young Americans for opportunities in the workforce and that will keep more of them in school,” Boozman said. Boozman’s amendment integrates rigorous academic coursework with career and technical education (CTE) and real-world skills based on industry needs and contexts. “Several states are already successfully implementing CTE curriculum that is grounded in problem-based learning developed with business and industry. This is an effort to capture the best practices some states have in place so we can increase graduation rates and prepare career ready students by partnering with industry,” Boozman said, pointing to effective programs in place in New York, Pennsylvania, Connecticut, Illinois, Florida and California. Boozman’s amendment focuses on science, technology, engineering and mathematics (STEM) education without authorizing new funds or programs. “Developing coursework to provide the appropriate training for today’s jobs allows students to find employment that matches their skills and provides businesses the workforce they need to operate. Arkansas economic officials say education is the key to future prosperity in our state. Programs that promote STEM help create a pipeline for the future and should be an integral component of our education policy,” Boozman said. In keeping with the bill’s focus on state and local control, Boozman’s amendment does not force states to partner with industries to have CTE programs.

If you are an artist, this is the time to go through your studio and gather up those things you have not used in a couple of years and bring them in on Wednesday, December 30, from 10 am to 4 pm—you have a chance to get reimbursed for some of what you spent on them and someone else finds just what he needs for inspiration at a bargain. Not an artist, but you inherited Aunt Susie’s studio? Go through and decide what is usable (no dried-up paint or distressed brushes, please!) and bring it in. Throughout the month of January, the collection will be on sale. Maybe this is just the time for you to spread your wings a bit and start the new year by exploring pastels or charcoal drawing or watercolor. If you’ve never tried your hand at creating art, you’re missing a lot of fun. Pick up whatever looks interesting and join other artists at the gallery on Tuesday Art Day from 11 am to 2 pm. by kim hughes Perhaps the National Heart, Lung and Blood Institute said it best. “Many people don’t realize just how much sugar and calories we drink in a day.” When the holidays roll around, the calories skyrocket and the portions get more generous. The reason holiday drinks matter is threefold: • One, drinks often contain a surprising number of calories. Studies indicate that beverage calories do not help people feel full. • Two, weight gain goes up around the holidays. Every calorie counts when people want to maintain their weight. • Three, holiday beverages tend to be very high in sugar, fat and calories. And if they are high in alcohol, then people often lose track of what they are eating too. Carbonated, sugar-sweetened soft drinks are the single biggest source of calories in the American diet … and noncarbonated, sugarsweetened soft drinks (fruit drinks, aides, ice teas) add even more calories. Too many calories equal weight gain. Just 100 extra calories a day can add up to about a 10-pound weight gain in one year. How do you know if a food or drink has added sugar? Check the ingredient list on food labels and look for these words: high-fructose corn syrup, fructose, fruit juice concentrate, honey, sugar, syrup, corn syrup, sucrose and dextrose. Healthful Alternatives: Instead of reaching for that big glass of eggnog, try these festive holiday alternatives… • Flavored waters. Pep up your water with slices of fresh fruit, some berries, or a few springs of mint or basil. This works well with sparkling water too! • Tea. Warm up with tasty hot tea – just skip the sugar. You can add fruits or herbs to teas as well. Try black, herbal, and green teas to find a flavor profile that works for you. • Cocoa. Make your cocoa with skim milk and nonfat cream. Garnish with cocoa powder, cinnamon, and/or nutmeg. • Fresh fruit smoothies. Combine ice and fresh fruit, then blend it up! By following these simple guidelines this may be the first year you don’t gain those extra holiday pounds! Wouldn’t that be great?

Sheila Johnson - Teaching the ‘Art’ of Art
BY JACLYN ROSE After she was married and had children, Sheila Johnson began attending college at Henderson State University in order to gain her Bachelor’s Degree in Education with an emphasis in Art and Spanish. “I thought teaching would be a good career to have while raising my children. I could have the same holidays and breaks as they did. I went to work as a teacher’s aide and had not thought about teaching, but I fell in love with the kids,” explained Johnson. After graduating with her degree, Johnson went to teach both art and Spanish in Umpire and her hometown of Wickes, before moving to Mena High School where she taught art for 23 years. In 2014, she moved back south to Cossatot River School District where she now teaches art at both Wickes Elementary, and Vandervoort Elementary. Johnson believes that not every artist has natural talent, but that art is a skill that can be taught and developed. Though she was not born with an innate artistic ability, she has become a great artist. “I always tell my students that art isn’t everything, but everything is art. Anyone can learn to do art, just like in math you start with one plus one, not calculus, and it is the same with art. You start at the bottom and develop. Most think that if they are not naturally talented they can’t do it, but they can learn. I took classes at Rich Mountain Community College and found that I enjoyed art, and art teachers were needed at the time,” Johnson explained. Johnson has two children, Jerry Johnson and Jana Richardson, and six grandchildren. “Having grandchildren, I now do a lot of running to baseball and softball games,” said Johnson with a laugh. “I enjoy them very much. My daughter, Jana, is my principal at Vandervoort Elementary School, which is great. I have been very blessed with good jobs and amazing people to work with, Mena was a very good place to work and very supportive, as were Wickes and Umpire. Moving back to Wickes has also allowed me to be close to my 90 year old mother. I was nervous to move to elementary students but I spend half of the day at Wickes and half of the day at Vandervoort and it has been good.” From April 17 until June 1 of 2016, Johnson will have an art show displaying her work at the Mena Art Gallery in downtown Mena. Johnson is honoring all of her previous students by allowing them to add a puzzle piece to her show. “I wanted to showcase my students because I learned so much from them. They are an awesome bunch. The puzzle pieces are available to purchase at Union Bank for $5 and they can be decorated in any way the student wants to. I would like them back by March 1, 2016 so that I can have the time to display them,” explained Johnson. Some of the personal art on display at the gallery will be available for purchase. “Kids are awesome. Everyone acts like the younger generation is a mess but they are a great group of kids that have value and integrity. Art is in everything we use every day, even though we don’t think about it, a lot of kids are good at art and they can excel in that area, when they can’t in others,” Johnson said.

BY JACLYN ROSE First Financial Bank was opened in El Dorado, Arkansas in 1934 and is a locally owned bank that has a Board of Directors with roots in their hometown. They are a completely Arkansas owned bank. Moments From America’s History The Bill of Rights
BY JEFF OLSON When the U.S. Constitution was signed on September 17, 1787, it had no “Bill of Rights.” Some delegates, including George Mason, refused to sign the Constitution because they thought that it would provide for a central government with too much power. Having authored the Virginia Bill of Rights in 1776, Mason spearheaded the movement at the Convention for a bill to be added to provide specific protection for states and individuals. On September 12th, Mason said he wished “the plan had been prefaced with a bill of rights. It would give great quiet to the people.” Elbridge Gerry made a motion for preparation of such a bill and Mason seconded him. Eight of the state constitutions included bills of rights, so some at the Convention, including Roger Sherman, thought repeating such in the federal constitution was redundant and thus unnecessary and he stated as much. Luther Martin of Maryland thought that the lack of a bill of rights was deliberate and scandalous, and left the Convention. Upon a vote, ten states to none voted against adding a bill of rights to the Constitution. However, as we know now, this would not be the end of it. After the Constitution was published in colonial newspapers, opponents of it wasted no time in stating their cases. None were more vocal and effective than the Antifederalists, and nothing contributed to their anti-constitution sentiment more than the lack of a bill of rights. The newspapers were to be flooded with letters and articles on the subject, signed under the pen names of Brutus, Sydney, Agrippa, Cato, Candidus, and Old Whig. Other notable Americans, such as Thomas Jefferson, were indignant at the omission of a bill of rights. On the other side, Alexander Hamilton later stated, “Why declare that things shall not be done which there is no power [in Congress] to do? James Wilson said, “Enumerate all the rights of men? I am sure that no gentlemen in the late Convention would have attempted such a thing.” In December 1787, states began ratifying the Constitution with Delaware being the first and New Hampshire the ninth state, putting the Constitution into effect in June 1788. However, it was not certain if the Constitution would be generally accepted until the important states of New York and Virginia had ratified it. On the promise that amendments protecting individual liberties would be added to the Constitution, these states eventually did ratify it - in part due to the Federalist [Papers]. George Mason is most responsible for the Bill of Rights, while James Madison led the new Congress in proposing the amendments. He suggested 15, and Congress accepted 12 of them. On September 25, 1789, those amendments were submitted for approval by the states in accordance with Article 5 of the Constitution. In a little over two years, the states ratified 10 of the amendments and the Bill of Rights became a vital part of the U.S. Constitution on December 15, 1791. According to noted legal historian and author Daniel Dreisbach, “The Bill of Rights was charged with a dual purpose: to guarantee to the individual that the federal government would not encroach upon his/her civil liberties, and to guarantee to the states that the federal government would not usurp (override) the states’ power over civil liberties.” The concept of a bill of rights was not original with the Founders of 1787, as its genealogy goes back many years prior. The transcendent and enduring principles undergirding the Bill of Rights were originally codified in such documents as the Magna Carta (1215), the people’s Petition of Rights (1628), and the English Bill of Rights (1689). It is unfortunate, and one of the great travesties of American constitutional history, that the Bill of Rights has undergone such a total revision in interpretation, purpose and scope. The pivotal point came in 1947, in the case of Everson versus Board of Education, when the Supreme Court coupled the 1st and 14th amendments. The 14th amendment (1868) was designed to “constitutionalize” the Civil Rights Act of 1866. By extending the Due Process Clause of the 14th Amendment to the 1st Amendment, the Court nationalized the Bill of Rights - in effect prohibiting future religious expression and activities in schools and public affairs of states and local communities. This was a major judicial paradigm shift, which essentially extended federal jurisdiction over powers originally reserved to the individual states in order to bring them under federal control.

Mena Middle School EAST had the privilege of participating in a video conference with Major Beau Stricklin. He spoke to Mena EAST students earlier in the school year as part of their Veteran’s project. Since his first visit, he has moved to Stuttgart, Germany where he is stationed with the Army. The students were excited to visit with him about his time so far in Germany. Mr. Stricklin shared with the students about his trip to Germany, the time change there, the scenery of the area he lives in, their currency, the weather, transportation, along with different places outside of Germany he has visited in his short amount of time there. Mr. Stricklin’s son, Elvis, was able to sit in during our conference too. The students gained new knowledge about Germany while visiting with one of their former guest veterans.

The following information was received from Polk County law enforcement agencies. The charges against those arrested are allegations and the cases are still pending in the courts. Individuals charged and whose names appear in this column may submit documentation to us at a later date that the charges have been dismissed or that they have been found innocent and we will include that information in this space in a timely manner. Mena Police Department December 6, 2015 Melissa Turpin, 41, of Mena was cited for theft of mislaid or lost property. December 7, 2015 Report was made of someone kicking in the door of a local residence. Case is pending further investigation and interview of suspects. Officers responded to a call regarding a suspicious person. The individual was advised to stay away from the area in question. Robert Earl Jones, 31, of Mena was arrested on an outstanding warrant for failure-to-comply with an order of the court. December 8, 2015 A local man reported that a neighbor is harassing and threatening him. Case is pending interview of suspect. Officers responded to a call at a local apartment regarding a domestic argument. The call was made by neighbors who said the couple was very loud and they were bothering others. When officers attempted to locate the couple, they had left the residence. Case is pending location and interview of suspects. Lannie G. Kiersey, 46, of Mena was charged with possession of an instrument of crime after officers were dispatched to a local convenience store. Ashley Nicole Fowler, 27, of Mena was arrested and charged with two counts of theft of property (shoplifting) after officers were contacted by employees at a local retail store. December 9, 2015 A local business owner reported that a money order had been stolen from his desk. Case is pending further investigation and interview of suspect. Officers responded to a noise complaint at a local apartment complex. The suspects were cautioned to stop the loud

December 11, 2015 Daniel May, 20, of Mena was arrested on a bench warrant for Battery III. Amanda R. White, 36, of Mena was arrested on an outstanding warrant for probation violation. Jennifer Williams, 44, of Mena was arrested on an outstanding warrant for failure-to-pay fines and court costs. Torrey Shane Drager, 23, of Mena was charged with DWI (2nd offense), speeding, and not wearing a seat belt. The arrest followed a traffic stop. December 12, 2015 Jared Whitaker, 21, of Mena was arrested on an outstanding warrant for failure to pay fines and court costs. Charles Grahn, 47, of Mena was arrested on two outstanding warrants. Kevin Grahn, 21, of Mena was arrested on an outstanding warrant. Officers worked 11 accidents. Polk County Sheriff’s Department December 7, 2015 Report from complainant on Polk 295 in Hatfield of the break-in and theft of a television and speakers, valued at $650.00. Arrested was Rocky R. Rhinehart, 36, of Hatfield, on Charges of Residential Burglary, Theft and Criminal Mischief 1st Degree. Report from complainant on Polk 129 near the Rocky community of identity fraud, totaling losses at $959.00. Information has been provided to the Prosecuting Attorney’s Office for further consideration. Arrested by an officer with the Grannis Police Department was Kristian D. Manley, 28, of Wickes, on a Warrant for Residential Burglary, Theft and Theft of Property. December 8, 2015 Report from complainant on Polk 55 in the Nunley community of an unauthorized person in their home. Complainant refused to press charges. Report from Mena Regional Health System of a gunshot victim. Investigation determined that it was accidental and self-inflicted. Victim was transported to a Fort Smith hospital. Report of a vehicle washed off into a creek on Polk 31 near Cove. Deputies responded, rescued the individual from the top of their vehicle. Report of a disturbance on Wispy Lane near Mena. Deputy responded. Arrested was Jeremy M. Youngdahl, 39, of Cove, on a Warrant for Failure to Comply with a Court Order. Arrested by an officer with the Grannis Police Department was Donald W. Aaron, 56, of Cove, on Charges of DWI and two counts of Endangering the Welfare of a Minor 2nd Degree. Arrested by an officer with the Grannis Police Department was Randy D.
