LAPEÑA WARNS SMUGGLERS ANEW By LITO ESPIRITU

CUSTOMS COMMISSIONER Isidro S. Lapeña has sternly warned that more cases will be filed by the Bureau of Customs against importers, brokers, and other unscrupulous individuals involved in the smuggling of agricultural products and other commodities into the country. Lapeña issued the warning following the July 6 filing of five criminal charges against the consignees and licensed customs brokers involved in the illegal importation of more than P11 million worth of onions which arrived at the Manila International Container Port in April this year. The accused are facing charges for violation of Sections 1400 and 1401 of Republic Act No. 10863 otherwise known as the

Customs Modernization and Tariff Act in relation to Republic Act No. 10845 otherwise known as “AntiAgricultural Smuggling Act of 2016”. Among the respondents of the criminal complaints are: Joseph Martin E. Arriesgado, sole proprietor of EAJM Enterprises, Manilou A. Hernandez, sole proprietor of Buensuceso Enterprise and its licensed customs broker Lorenz V. Mangaliman, and Arvin V. Tugadi, sole

proprietor of Epitome International Trading. The cases stemmed from the joint spot checking of 6×40’ reefer containers in Manila International Container Port spearheaded by Commissioner Lapeña and Secretary Manny Piñol of the Department of Agriculture, wherein the subject containers declared as fresh apples were found to contain fresh onions. The Bureau has likewise filed a criminal complaint against the owner of Marid Industrial Marketing, Mark David G. Villanueva, and its licensed customs broker Carme Ann S. Rollon, for the unlawful importation of P26, 650, 393.70 worth of cigarettes, originally declared as industrial artificial fur texture, in clear violation of Sections 1401 and 1403 in relation to Section 1400 of the CMTA.

Bongbong cries foul over PET employees’ ‘outing’ with Robredo’s revisor FORMER senator Ferdinand “Bongbong” Marcos Jr has asked the Supreme Court (SC) to investigate a swimming party in Laguna attended by 20 employees of the Presidential Electoral Tribunal (PET) and a ballot revisor of Vice President Leni Robredo. Through his lawyers George Garcia and Vic Rodriguez, Marcos filed with the SC on July 9 a manifestation of grave concern with extreme urgent motion to investigate.

Marcos said the PET staff’s vacation trip with a Robredo revisor is a violation of the Code of Conduct for Court Personnel and the Canon of Judicial Ethics. The former senator said that on June 22, Robredo’s revisor Osmundo Abuyuan went to 3J’s Resort in Pansol, Calamba, Laguna, with 20 PET employees who are conducting the ongoing recount for the electoral protest Marcos filed against Robredo.

Marcos expressed apprehension that the swimming party could be a “conspiracy” between Abuyuan and the PET staff. But Robredo’s legal counsel Romulo Macalintal brushed off the incident, saying he does not find anything anomolous in the swimming party.

SMPHI’s lease has a term of 25 years and is renewable for another 25 years, while the rental rate was pegged at P30 per square meter per month. The proposal also entailed an initial investment of P3 billion. Hanif claimed the KBG Complex and the expropriation if six privatelyowned properties should not have been leased since the complex is protected under Proclamation Numbers 936, series of 1997, and 683, series of 2004. The Ombudsman dismissed this accusation, saying all properties can be the subject of lease agreements under SMPHI’s proposal that was later placed for a Swiss Challenge, or an invitation for third parties to match or exceed the offer. The Ombudsman, however, found fault against the respondents when they failed to follow the 60-day prescribed period from the publica-

tion of invitations to bid to awarding of the lease contract. This period is provided under Republic Act No. 6957, or the law authorizing the financing, construction, operation and maintenance of government infrastructure projects. Investigators found that SBAC recommended the issuance of a notice of award in favor of SMPHI on October 30, 2014, or only 10 days after the last invitation to submit bids was published. SMPHI formally secured the lease contract on November 12, 2014. “They acted with manifest partiality, evident bad faith or gross negligence by failing to follow the prescribed period under the law with the clear intent to deny other prospective project proponents of making a better offer or proposal, and as a result, their act gave unwarranted benefit advantage, preference or benefit to SMPHI,” the Ombudsman said.
