A Nelson couple are facing bankruptcy as well as losing their rural home this week after the High Court ruled they are liable for a 2009 fire that caused damage to forestry and another home. Steve Garnett and Tracey Lynch say the past three years has been like hell and a decision in the High Court last month was the final nail in the coffin of their dream retirement. At 61, Steve has lost everything and says he’s unable to start again. They say the system has let them down and they wanted to tell their story about how they lost it all. On November 24, 2009 Steve threw some ashes that had been sitting in one of the bed and breakfast cabins on their property out onto a grassy bank. The ashes had been sitting in the cold fire for 36 hours. Two hours later two men working nearby smelt the smoke and came knocking. Steve and the two men attempted to briefly

The fire spread to neighbouring properties, burning down the home belonging to Caroline Wade and trees belonging to Nelson Forests Ltd. Steve still disputes that the ash was the cause of the fire because it was “like dust” when he threw it out. But it did start on their property and the insurers of Nelson Forests, along with the New Zealand Fire Service and the Waimea Rural Fire Committee went after Steve and Tracey for costs under Section 43 of the Forest and Rural Fires Act 1977. The couple’s property was insured but they didn’t have liability insurance on their two cabins because

Dairies say no to synthetic drugs Nelson police have begun a campaign to rid the region’s dairies of synthetic drugs, slamming them as “morally wrong” and urging locals to boycott stores that continue to sell them. The region’s community constables and Youth Aid officers started visiting dairies and other outlets known to have stocked synthetic cannabinoid products yesterday, explaining the dangers they pose and encouraging them to refrain from selling the products. Nelson Bays area commander, Inspector Steve Greally, says police have seen first-hand the devastating effects these drugs were having on young people and wanted those selling the drugs to show some responsibility. “These drugs may technically be legal, but that doesn’t make them safe. Retailers may say they are doing nothing wrong, but in my view it is morally wrong to be preying on the young people in our community and making money by selling them addictive and extremely harmful drugs. “My officers will be encouraging retailers to think about their responsibilities, not just

the store does not stock the products because they have a policy against it. “The owner runs programmes to help people to stop smoking so he is definitely against it,” he says. He says he gets constant requests for the products but is happy to turn them away. Steve says he was confident the “reputable businesses” in Nelson would take the responsible option and stop stocking the products.

Couple to be kicked off their land FROM PAGE 1 they were deemed a business, something they thought meant if their cabins burnt down they wouldn’t be insured but everything else would be. But because Steve was honest and said the ash came from one of the cabins – which is their business – they weren’t covered. If the ash that started the fire was from their own home they would have been. Last month they lost their case and were ordered to pay close to $1.5 million. The property is worth only $550,000 and $100,000 of that is mortgaged, plus they have to repay legal aid fees. They had been given until yesterday to pay but they don’t have the money so are expecting to be kicked off their land this week. It will be the end of their rural dream and say it’s an incredibly harsh punishment for something that was – at absolute worst – an accident. In another case, an 18 year old man was sentenced to 18 months in jail for arson and insurance fraud for burning down a Westport home on purpose. His associate, a 34 year old woman, received 250 hours of community work for conspiring to commit arson. Neither was fined. Steve and Tracey argue their sentence is much worse, and described it as being “wiped off the face of the earth” and say around a million dollars they invested in their property on Dry Weather Rd is now lost. They also say they were steamrolled by the system.
On legal aid, they say their one lawyer didn’t stand a chance against the might of the two top law firms working to bring them down. “The legal fees of these firms will be more than what our property is worth to them. They will get next to nothing other than ruining us,” says Tracey. Steve and Tracey’s lawyer, Rob Ord, said in a statement that the law needs a major overhaul. In his judgement, Judge Miller wrote he believed Steve to be a “decent” man but didn’t believe his testimony that his ash was cold. Steve says it’s too late for them now. They will attempt to appeal the case to the Court of Appeal, but he isn’t holding out much hope and believes that by the time you’re reading this the wheels will have started turning to have them wrenched from their land. But he wants to sound a warning to other land owners, especially those in rural areas. “We thought we were covered by insurance. We felt we did everything right to protect ourselves and can’t believe that this has led to us losing everything.” Tracey says she’s heartbroken. With tears in her eyes she asked: “When did humans became so mean, so greedy for money? “We tried to be honest, we’ve never been in trouble before and never been in a court before. All of a sudden we were being treated like criminals, like we’ve killed someone. Being upfront, honest and thinking fairness will prevail, we’ve learnt is wrong. It doesn’t work, honesty doesn’t pay, in fact

Tracey boards with a good friend in Richmond, so that she can work in the city through the week to help meet costs. But the mortgage will soon be gone, along with their dream. “I feel shattered, I don’t know what we will do. We’ve lost all motivation, all our goals and aspirations are gone. This will kill us, financially and more.” They say their major gripe is with the New Zealand Fire Service Commission and its lawyers, who they feel have been particularly aggressive, almost to the point of vindictive. “The New Zealand Fire Service, are there to save lives, save houses and
help people, not throw them out of their homes,” says Tracey. “I can’t understand why they’d spend three and a half years paying these high level law firms to ruin us and for what? Their share of $350,000 after lawyers’ fees? The whole system stinks, we had no chance and now we’re finished.” There is one last ray of hope for the couple though. Over the weekend a friend told them he has set up a fundraiser on fundanything.com, called “Save Triple Tui”. Enner Glynn school students were among 18,000 primary school pupils from around New Zealand who took a collective bite out of their apples in an attempt at a world record on Friday. The Jazz Apple Big Crunch organised by ENZA aimed to set a new world record for the most people eating apples simultaneously, while promoting a healthy eating message and fundraising for KidsCan, a children’s charitable trust. Principal Wendy Hancock says she loved the idea and jumped at the chance to get her students
involved. “I was very intrigued by the idea of setting a world record but also by the healthy eating message it sends. It’s great to be a part of something nationwide too and support Kidscan.” While it is not yet known if the record has been broken, Wendy says she was pleased the school of 320 children had taken part, regardless of the result. Seth McKnight, 10, says he had fun taking a bite out of his apple after the countdown. “It’s pretty amazing because we got a free apple and we could hear the crunch.”

Talented science student off to Europe A Nelson College student is one of five from around New Zealand who have been selected to travel to two prestigious science events in Europe. Charlie Norton was selected by the Royal Society of New Zealand to attend the prestigious London International Youth Science Forum for two weeks and then travel to Switzerland to discover the excitement of fundamental science research at CERN in Geneva. In London, Charlie will join 300 like-minded students from 60 other countries for the twoweek forum. This year the forum will explore the theme of ‘Challenging Science Boundaries’, with lecture demonstrations, specialist seminars and debates led by a team of scientists and experts. The students will also get to be a scientist for the day at CERN, exploring the mysteries of the universe with state-of-the-art equipment used by physicists at CERN – particle accelerators and detectors. They will also spend a couple of days in Paris and discover some of the world’s most famous attractions such as Notre Dame and the Eiffel Tower and visit the Louvre.

Windmill now a lighthouse? Nelsonians will be missing a familiar landmark over the next few months as the windmill at Founders park undergoes a routine maintenance check. Nelson City Council manager of community relations Angela Ricker says the maintenance has nothing to do with earthquake strengthening despite a number of buildings in the park being earmarked as possible candidates for strengthening. “It’s just routine maintenance. They take them down and they are checked to make sure they are ok, they’ll be reclad, they’ll check all the bolts for rust, then they’ll be repainted and put back up.” She says the job hasn’t been done for more than 10 years and was a huge task to undertake considering the blades could only be taken down in one piece, using a crane. While the council is hopeful that the blades will be replaced in time for the Founders book fair in June, Angela says it may take longer for the iconic windmill to get back to its former glory. Spending up 6.3% in Nelson
Figures released last week by eftpos provider Paymark, show a positive start to the year for Nelson businesses, with spending over the first four months of 2013 up 6.3 per cent on the same period in 2012. Paymark, which processes around 75 per cent of all electronic transactions in New Zealand, believes the higher national
average growth rate, of 3.9 per cent is being driven, in part, by the Canterbury recovery. Spending in Canterbury was running 6.9 per cent above year-ago levels in the first four months of 2013, up from the 5.6 per cent average of 2012. In Nelson the number of transactions was up 5.9 per cent and the total spend up to $75.7 million, an increase of 6.3 per cent.
Paymark head of sales and marketing, Paul Whiston, says the four-month trend gives a clearer picture of how spending is tracking in comparison to the monthly trends, which can be more volatile. “There have been several contributing factors impacting monthly spending over the past four months. In January we saw a high 5.1 per cent year-on-year increase,

Rockquest finalists announced The top 12 high school musical acts to contest the Nelson Smokefreerockquest final have been named, following Saturday night’s heats at the Theatre Royal. Hundreds go through mini Ecofest at Victory A mini Ecofest was held at the Victory Community Centre on Saturday with people from all over Nelson making the most of the event with a focus on sustainable living. A range of interactive demonstrations and advice on how to live well for less was available alongside hands on workshops including turning bags of rubbish that would otherwise be thrown away, into something practical. A ‘bottle stuffing’ workshop encouraged children to stuff plastic bottles with non-recyclable packaging that had been collected from local schools and to use them to create building blocks for a bench for the Victory community. Victory Community Centre programme and facilities manager, Gareth McCashin, says a lot of valuable sustainability advice and knowledge was on show at the event. “A good number of Victory people were there and they really engaged well with stallholders. It’s great to have a wellfocussed sustainability event that’s really

Warehouse to open in Richmond Confirmation that The Warehouse will be joining Kmart at a new retail complex on Queen St won’t be bad for local businesses, says the new chairman of Richmond Unlimited. It was confirmed on Friday that a new 3000sq metre store is expected to open on 186 Queen St in July next year and will be designed as a “convenient one-stop family shopping destination”, bringing “lower prices closer to home for many local residents,” says Simon Turner, The Warehouse’s general manager for operations.

They wouldn’t put one here if they thought it would just go okay.” Nathan says that The Warehouse already has a target market that should shop there no matter whether the store was opening in Richmond or not, and that local businesses should focus on their own strengths in order to succeed. “Yeah there’s a convenience now that you don’t have to drive 15km to go to town but at the end of the day those people are always going to shop there.”
Kmart had already announced its plans to open on the site, which is a Gibbons Construction development project, before the end of the year. But will that be bad for current Richmond retailers? Apparently not, according to Richmond Unlimited’s Nathan Smith. “It’s going to bring jobs to Richmond, it’s going to bring growth and it’s going to bring more people to Richmond which will filter out to the local businesses. You’ve got to see the positives here,” he says. “Money spent here stays here. Tourists that come into the town, it’s going to bring them in.

Tuesday May 7 Custodian Bob Stewart says he was absolutely chuffed with the response he received to an open day after the disused railway tunnel in the Spooner’s Range was featured in the Nelson Weekly. The tunnel was unlocked for visitors on Sunday attracting more than 500 people who were keen to walk the 1352 metre tunnel. It is now closed until October. A new choir is hoping to attract singers and even those who may not think they’re singers to its opening night this month. The new community choir has the loose name of Community Choir at the Boathouse and its teacher, Alice Robin, says she’s hoping a whole range of people will come out of the woodwork and take part. Alice has been leading community singing groups in the UK for the last seven years, including community choirs, monthly ‘Big Sings’ and a hugely popular Community Choirs Festival. She is passionate about gathering people together to celebrate connection through song
and community, and believes that anyone can take part if they want to. “Anybody who has a real urge to sing is welcome. Even if you can only sing a very limited range or you don’t think you can sing at all, you can come and try here and if you like it there’s room for you.” She believes there is room for another choir in the city and has attracted funding from the Arts Council. The opening night will be on Monday, May 20 from 7pm. The local Alzheimers society is hoping a book about Britain’s Iron Lady – who also suffered from the disease – will help raise it some money. The book, The Life of Margaret Thatcher, was released last month and is written by Thatcher’s speech writer and advisor Robin Harris. The book has received rave reviews and provides insight into what Thatcher was thinking when dealing with and to political colleagues, the tribula-
tions of the miner’s strikes and the Falklands War. Board Member of the Alzheimers Society Nelson Inc, Liam Butler, says the book sells for $37.99 at book stores and he is hoping a blind auction for the book in the Nelson Weekly will raise a few dollars for the society. Plunket’s baby sale returns
'Amazing race’ caps off youth week Sinead Ogilvie Nelson’s secondary students finished off New Zealand Youth Week with a bang on Saturday as they took part in the third annual ‘Amazing Race’. The event aims to celebrate youth in the community and provide them with a unique event that is run by youth, for youth says Nelson Youth councillor Samantha Stephens. “This is the third time the event has been held and it is becoming more and more successful. It’s a fun event provided to the youth of Nelson. It’s a great chance for us to get together, get to know each other and have a good time.” The event was open to all secondary schools with 11 teams entering from around the region. Designed to be challenging and encourage team building, each team completed a list of challenges based around the city and at the Trafalgar Pavilion, including a photo scavenger hunt, food challenges and obstacle courses. “There are a range of different challenges to make the race fun and exciting. Everyone has really enjoyed themselves and a lot have said they’ll be back again next year. It’s definitely going to get bigger.” The event was held by the Nelson Youth Council in conjunction with The Truck, Nelson City Council and the Tasman District Council.

Big crowds are expected to flock to the Plunket Baby Bonanza this Saturday, with more than 50 stalls already registered to take part in the event. The well known annual bonanza is set to be another huge hit with both mums and mothers to be gearing up for the chance to grab quality second hand baby gear at bargain prices. The event attracts hundreds of people each year says Gael Petch community services coordinator for Nelson Tasman Bays Plunket. “This is an extremely popular fundraiser and is one of the major ones we do each year. Over the years it has become a very successful event, so we are excited to have it back once more.” The event offers local people the opportunity to buy and sell secondhand
and near new children’s clothes, toys and nursery items all in one location and while the idea behind it is to fundraise and raise awareness for the local Plunket organisation, Gael says it is also an important community service. “It’s a really great way to put people who need affordable but quality items in touch with those who have plenty to pass on. It is a fun event for everyone involved.” The Plunket Baby Bonanza will be held from 9am to 12 at the Hope Hall this Saturday. Entry costs $2 with all proceeds going to Nelson Tasman Bays Plunket. Anyone who has lots of good quality pre-loved childrens items and would like to sell them at the bonanza can contact Lisa Foote on 542 4496.

Chef ready for school fundraiser
Chef Chris Fortune is coming to town, hoping to help parents feed their children vegetables and raise some money for Hampden St School in the process. Chris won New Zealand Hell's Kitchen in 2003 and now lives in Marlborough. He is coming to Nelson to host his workshop "how to get your children to eat their green snotty vegetables..." It promises to show parents how to improve their child's eating habits, money saving tricks and show them how to make nutritious and yummy lunch and dinner choices with seasonal food. The workshop is at Hampden St School Hall on Thursday, May 16, from 7pm. The cost is $10 per person or $15 for a couple. Tickets, which include drinks and nibbles, are available from the school office or by calling 021 077 7553 or emailing skmilligan@xtra.co.nz.

Chatham Cup win for College

First time entrants Nelson College are the only local team through to the second round of the ASB Chatham Cup, beating Richmond Athletic 1-0 in a rematch of last Tuesday night’s league fixture. The college side was beaten 3-1 against the Nelson Pine Industries first division leaders under lights at Jubilee Park but managed to turn the tables in the cup tie – a 10th minute Kevin Obed strike separating the two sides. A game winning slam dunk with just seconds left in over-time brought the hoop down as Erron Maxey's 100kg frame hung on it, leaving the Wellington Saints stunned and the crowd on its feet in amazement. Having erased a 14 point fourth quarter deficit, the Fico Finance Nelson Giants ended a two game losing streak in the 89-88 victory, after a tough road trip down south. And Erron, who top scored with 32 points, believes the home victory over the star-studded Saints side, which features New Zealand Breakers legend Dillion Boucher and is coached by Pero Cameron, was the perfect way to bounce back from the past two games. "It's more important to get the win after the two losses. We had a tough week of training and everyone has been focussing, we just stuck to our game plan and managed to pull it out," the former Saint says. "It's just one of these things. When I was coming down I felt everything coming down with me. I was just trying to get the ball in as hard as possible." While the Saints do not top the Bartercard NBL standings, they are still one of the competition favourites and the win highlights the Giants' potential, which has increased the self belief in the squad. "No matter whether we win or lose we believe in ourselves. We just want to put our best foot forward in every game and last week was a bump on the road. We had to bounce back and this gets us on the right track." The Giants, who now sit in third place, host the win-less Waikato Pistons at the Trafalgar Centre this Friday night. Tip off is at 7pm.

Nelson College too good for Waimea Phillip Rollo There was plenty of hype, plenty of passion and plenty of yellow cards but at the end of the day Nelson College was just too good for Waimea College in Saturday’s Press Cup fixture. Nelson now has two wins from the first two games after avoiding the potential banana skin 32-3 in front of a vocal crowd scattered along the college’s embankment. While the six cards – five of which were handed to Waimea players – might have ruined the spectacle in the final 20 minutes, the result had all but been decided by that stage and Nelson coach Bill Liddell believe all of the penalties were justified. “I think the game lost a bit of structure in the last 20 minutes with so many yellow cards but I don’t blame the referee for that. It was just ill-discipline at the break down,” he says. “We made some mistakes there too but at the end of the day they were desperate and that happens when you’re desperate.” In the leadup to the match the coaches from both teams highlighted the strong Waimea forward pack, but it was the Nelson players that had the better game around the paddock with number eight Larry Banse running through the defence with ease. “I have to be honest, when we were picking and going and running our systems I didn’t expect to see us break through as often as we did but the guys played very well.” Nelson will now take on the win-less Nayland College, who went down 41-9 to Ashburton College on the weekend. The game kicks off at Nayland College at 12noon on Saturday.

The Nelson Netball 2013 season got underway at Saxton courts in perfect weather conditions. Players were keen to get the first game under their belts and begin to acclimatise themselves with the outdoor surface. Competition was tight in Grade 3 and a blanket could practically be thrown over the six teams in the season’s opener. Prices Pharmacy White accounted for Jacks Navy 27-24, while Jacks Ale House drew 20 all with Motueka High School. The third game of the grade was a relatively close encounter between Stoke Accessman and Waimea College 10A. Stoke Accessman’s attack settled early while the mid court zone they played appeared to faze their younger opponents. Deanna Hunter and Georgia Wright combined nicely in Stoke’s shooting circle, where they received an abundance of pressure free ball from their feeders. The blue team went into the first break with a 9-6 advantage, which could have been considerably higher if they had converted more of their nine turnovers. Stoke’s zone defence created more tip and turnover ball in the second quarter. Wing defence, Tanya Popata did a power of work on the outside of the circle, which enabled her circle defenders Lanessa White and Jess Hildyard to pick up the in-

tercept ball. While Stoke looked as if they had the game under control with a 1610 lead at the major break, changes by Waimea College soon paid dividends. Libby Wehner vacated the WD bib to take up centre where she soon stamped her authority, while Ellie Gaging was calm under pressure at goal attack she netted some beautiful shots to win the quarter 8-6. Megan Stack made an impact off the bench when she made a useful contribution at wing defence. Georgia Roden came in for praise from her coaches with her improvement in training and her second half performance at goal keep. Stoke’s wing attack, Jaime Kingi had the majority of centre pass receives against her name and delivered quality ball to her shooters, hitting the circle edge for the optimum feed. Jess Hildyard, displayed great vision, reading the play well she picked up four well timed intercepts, while Lanessa White rebounded strongly to put in a commendable performance. The honours were shared in the final stanza with five apiece, however Stoke had done enough to claim the 27-23 win.

TriAlS: The South Island Moto Trials Championship is being held this weekend at 88 Valley, near Wakefield. The venue is at the world-renowned Nonstop Adventure Trials Park and the spoils will be fought for over two days of competition. Day one, on Saturday, will kick off at 10.30 and most riders are expected to have completed the course mid to late afternoon. The same applies for day two on Sunday. The event will be clearly sign posted from the 88 Valley turn off on the south side of Wakefield.

It means riders like these guys get the chance to compete against their peers from all over the world without having to pay so much to get there.” Logan says he is extremely excited to race in the event and is looking forward to taking on people from all over the world. “It will be a good experience and it will be fun racing against people from different countries.”
Glen says having the championships in New Zealand means not only “an amazing opportunity” for him but the chance to witness some of the world best BMX racing in such close proximity will be a highlight too. “It’s not very often you get the chance to see these guys race in person and the fact it’s in our own backyard is so great.” All four riders will compete in the 20 inch class with Brady also entering as a wild card in the Cruiser class. The event will be held at Auckland’s Vector Arena from 24 to 28 July.

It’s been a whirlwind adventure for the busy Vet Centre Richmond on Gladstone Rd, while services are still continuing as normal, renovations are underway after the big flood swept through town. The team would like to thank the staff, friends, builders, electricians, student volunteers, neighbours and customers who showed up on the night and following days with shovels, mops, and rolled up their sleeves to help. This enabled the clinic to open the doors by 9am the next day - and even better that none of the animals got their paws wet. The clinic cat Mogwai, being the only animal in the building was very kindly taken in by the next door neighbours. There’s been a lot of hustle and bustle at the centre in the aftermath, with builders coming in and out to fix a few things. While it’s been busy they have been kind enough to complete the work at night so as not to disturb the day to day operations
of the centre. Mogwai loves meeting and greeting clients and patients, so needless to say he is enjoying the extra attention. In-between the hive of activity a class of proud puppies has just graduated, leaving with a wealth of knowledge and their very own certificate; this now makes way for brand new classes. There is a class held every Tuesday and Thursday from 6pm to 7pm, so get in quick and secure your spot. While things are getting back to normal, the team has noticed it’s starting to cool down. With the onset of winter fast approaching, the clinic is now offering 15% off all winter beds. These are extremely cosy for all dogs or cats and really suit older pets who suffer from bad joints that get worse in chilly weather. There has been a new addition to the Vet Centre Richmond’s wildlife fund with the arrival of an abandoned kitten in the last few weeks. Remember this service any-
