A week of sporting success

Swinging fundraiser Fairfield House brought back the glory days over the weekend, hosting a Turntable Tea Party that attracted around 80 people. The event was a fundraiser for the historic house and featured DJ Tunesifter, aka Martin Emo pictured above, playing a collection of vinyl classics from funk, soul, reggae and old school hip hop. Dressing up in frocks and dapper suits was recommended by organiser Shanine Hermeson

and Fairfield House manager Catherine Brosnahan says the crowd really got into the spirit of it, raising $1800. “We had beautiful vintage tea cups for sale and people could buy them and get a cocktail or old wine to have in it. There was dancing till quite late. No one wanted to go home.” Its success means there will be another Turntable Tea Party this summer, says Catherine.

It’s been a good week to be a Nelson sports fan. The region bagged two national titles, watched one of its young rising stars win the top women’s football club title and who could forget the Tasman Makos thrilling defeat of the three time defending ITM Cup rugby champions, on Friday night. On top of that the Tasman Titans rugby league team beat the West Coast in its first game of the season. The good times started on Friday night when 6000 people went along to Trafalgar Park to watch the Makos upset Canterbury 25-22, in a thrilling finish. Then on Saturday the Titans overpowered West Coast 42-22 in Greymouth, ASB Nelson Pines beat Sparta in the final of the volleyball nationals at the Trafalgar Centre and the Nelson Sparks women’s basketball team won

the national tournament in Dunedin. Nelson Suburbs football club celebrated 50 years on Saturday but couldn’t get the win it so wanted in the Mainland League. However two Nelson footballers did well on a national level over the weekend. Emily Jensen, playing for Three Kings United won the ASB Women’s Knockout Cup, the women’s version of the Chatham Cup, and Jeremy Brockie scored four goals for the Wellington Phoenix in its pre-season game in India. Nigel Muir, chief executive of Sport Tasman, says it has been a great few days for the sporting region and he hopes the good times continue as dozens of local secondary school teams head off for tournament week this weekend and the Makos have a crack at the Ranfurly Shield in Taranaki on Saturday.

Christmas has come four months early for teenage singing sensation Hana Tava with the 13 year old set to perform in front of 100,000 people at Coca Cola Christmas in the Park Christchurch. Hana was one of more than 200 performers auditioning for a spot at Christmas in the Park. She sang ‘All I want for Christmas is you’, and the judges were impressed, putting her through to the next round of auditions. Earlier this month there was a meeting with the Christmas in the Park organisers, which confirmed she would sing ‘Santa Claus is coming to town’ as the opening number on the night, with two other performers. But the downside for Hana,

who is the lead singer of high school band Fire Without Permit, is that her fellow band members will have to watch from their television screens after they initially entered together to cement the role. “Jacob [King] from the band put us forward, but they asked if they could have me instead,” says Hana. “But they’ve been really supportive. When I told the band I was into the auditions they knew that I would make it.” Hana says she will be nervous but will have her entire family in Christchurch supporting her. Because she is singing the opening number, it was likely Hana’s performance would also be screened live on television. Coca Cola Christmas in the Park Christchurch will be held at Hagley Park on November 24.

Marina users asked to sign new contracts Users of the Nelson Marina are being asked to sign new contracts to tighten up rules around debt collection, but Nelson City Council says it’s just a procedure and there has not been a problem around overdue accounts. Chief financial officer at NCC, Nikki Harrison, says the new contract is just standard and has nothing to do with the

change in management a few months ago. Debt collection was the reason cited for the change but Nikki says it hasn’t been a major concern. Currently around $7000 is more than three months overdue, with $1.1million collected annually. “It isn’t really a problem, part of the new contracts is part of the wider changes around the marina.

But if people are well and truly overdue with their debt we have the ability to send it to a credit agency with them incurring the fees, not us,” she says. She says that some councillors also have a view that there shouldn’t be any overdue debt at the marina because there is a waiting list for people to get a berth down there.

Daffodils in full bloom The Nelson office of the Cancer Society has become heaven for daffodil lovers as it prepares for its annual appeal this Friday. Thousands of daffodils have been dropped off to the office from farms and gardens all over the region and volunteers are assisting in preparing them for Daffodil Day. Cancer Society manager

Linda Lucre says they will be out in force on Friday. “Don’t forget your loose change because this is big day for us, raising money for cancer research and support for those with cancer in our community.” Volunteers will have collection stalls in Nelson, Stoke, Tahunanui and Richmond.

Film festival comes to Nelson The annual NZ International Film Festival returns to the Suter Cinema from Wednesday with Beasts of the Southern Wild confirmed as the opening night film. “Opening with Sundance hit, Beasts of the Southern Wild, NZIFF gives Nelson movie lovers the chance to sample the best of international cinema hot on the heels of the world’s most prestigious Film Festival – and in many cases months ahead of festival audiences in London, New York, and Rome,” says festival director Bill Gosden Beasts of the Southern Wild won the Grand Jury prize (Dramatic) at Sundance and the Camera d’Or (Best First Film) at Cannes earlier this year. Organisers of the festival are hoping for strong local support for the international programme which will make use of the State Cinema’s digital projection technology which is being installed at the Suter. The NZIFF will screen from August 29 and run to September 16 at Suter Cinema.

From My Desk Before heading off to Fashion Island this morning, I took a quiet moment to stand out on my deck and take in the gorgeous morning. My garden is waking from its winter hibernation and camellia, rhododendrons and spring flowers are blooming with colour reminding me of an artist’s palette. Monarch butterflies are frolicking around the trees and the birds are singing songs to one another. A perfect start to my day.

Cupcakes help SPCA

Cupcakes of all colours and sizes were being sold all over town yesterday as part of SPCA’s annual Cupcake Day. Thousands of people and businesses took part in the nationwide event, with all proceeds going back to SPCA centres across the country. Countdown on St Vincent St, Queen St Pharmacy, ANZ Bank, BNZ Bank and the SPCA Op Shop were just a few of the many businesses and stalls across Nelson.

In total SPCA have 47 centres across New Zealand, with over 60,000 animals coming and going throughout the year that means a lot of attention, time and resources are needed. All of that requires a significant amount of money and the Cupcake Day is a chance for New Zealanders to give back to their local SPCA. The funds raised from yesterday will go towards helping local SPCA centres across the nation.

Free clothes for local families

Local families will have the chance to get some free baby clothes this Friday as part of a event organised by Nelson Plunket. The day will be an opportunity for families to come along and get some clothes suitable for newborns to 3 year olds that have been donated to Plunket. Organiser Debbie Harvey, pictured right, says they will also be providing free bowls of soup and bread for those that come along, thanks to some local compaines, Fresh Connection, Hoddy’s Orchard and Quality Bakers. The event is being held at the Victory Community Centre this Friday, August 31, from 11am to 1pm. For more information call 539 5200.

Heading in to the centre I stop at a few of the stores for a catch up with the teams and even here it is like winter has all but disappeared. The stores have bright spring colours gracing the windows, the phoenix palms are alive with birds and the atmosphere at Fashion Island is energized, awaiting the new day to begin. Spring dresses, pastel jeans, must have summer shoes, beautiful Italian tops, a lunch with a friend-spring definitely is in the air. I look forward to your visit and seeing you here at Fashion Island.

Lioness club takes on new cause Nelson Lioness Club is back doing what it does best, hoping to fundraise $30,000 to go towards installing Go Zone gym equipment around the Tahunanui beach area. On Saturday afternoon the lionesses held a ‘Coffee, cake and curio’s afternoon where they invited local home business owners to take part. Lois Aitkenhead, the event’s coordinator, said the afternoon was just a little fun in the hope of raising some money and awareness. “It’s all very low key and all the people here today are going to give us ten per cent of their sales and other than that we’re only making our money from the coffee and cakes but we’re

hoping the communication with other groups and people will be the thing that will carry our fundraising forward,” says Lois. So far they have raised $16,000 and hope to raise the extra $14,000 by Christmas and are hoping to start installing some equipment as soon as possible, pending council approval.

• Five container vessels, two over 200m long, a car carrier, twenty large fishing vessel movements about the port, the dredge completed her maintenance programme for 2012 and departed for Westport, two vessels for the slipway all kept the port busy this week. • I guess it’s all about perception. Perhaps if you work for a government department you might believe you can’t drown therefore there is no need to wear a life jacket. The DoC operators who were sighted heading toward the boulder bank in a small inflatable were definitely not of the medical variety. They were easily identified however by the branding they wear. Now perhaps these individuals all did have a lifejacket standing by in their little craft however my spotter suggests there wouldn’t have been room for them. Not that I am suggesting overloading was part of this display of... or that they were doing anything illegal. • Nor would I go so far as to suggest a complete lack of freeboard means they were simply lucky to make their destination let alone the return journey. • Anyway, anyone responsible for the wellbeing of our flora and fauna would be far more responsible than to put to sea without wearing a lifejacket, wouldn’t they?

WHAT HAPPENS WHEN YOU DIE? Things to consider regarding relationship property and the inevitable. Most of us are fortunate enough to have a meaningful relationship with a life partner or spouse at some point. The complications of contemporary relationships and progressive laws in New Zealand mean that everyone should have an understanding of the principles of relationship property and estate law. It can get messy if you don’t structure your affairs properly. OPTIONS ON DEATH UNDER THE PROPERTY RELATIONSHIPS ACT

Regardless of what you write into your will, your spouse or partner (and sometimes your ex-spouse or partner) will have the option to choose either their entitlement under the will (or as administered if you pass away intestate) or under the Property Relationships Act. These options are called “Option A” and “Option B.” If he or she chooses Option A then the Family Court may have a hearing to determine the scope of the relationship property and the surviving partner’s entitlement. The Act creates a presumption that property owned by the deceased is relationship property (unless successfully challenged). Where there is an Option A election, the surviving spouse/partner will not usually be entitled to any jointly owned property by survivorship. Where he/ she chooses Option B the jointly owned property passes to the survivor and he or she also benefits under the will. If there is property that you do not wish to be subject to an Option A election steps can be taken to achieve this. This can be done with an agreement contracting out of the Property Relationships Act recording the property as separate property or by transferring that property to a trust and immediately gifting the debt off. The contracting out agreement will need independent advice. A contracting out agreement can be a very important tool in succession planning. While it takes a bit of discussion and thought, it’s much smarter and easier to do this before you marry or end up in a qualifying relationship.

THINGS TO CONSIDER WITH YOUR WILL

If you have your affairs in place so that you decrease the likelihood of an Option A election you might think that you can be reasonably assured your estate will be distributed in accordance with your will. It’s not quite as simple as this. Despite it being your will, the law allows certain people to apply to the Court if they are not provided for. These include your spouse/partner, children, grandchildren, and in certain circumstances your parents and step-children.

MORAL DUTIES

The first duty is to provide for your spouse/partner. You also have to provide for children, though not necessarily equally. Lawyers often talk of percentages of estates when attempting to safeguard against a claim for breach of moral duty. Ten to twenty percent of an estate per child seems to be accepted by the Courts as discharging this duty although it is up to the discretion of the Judge and depends significantly on the size of the estate. Things become particularly complicated where there are children of previous relationships and new spouses/partners (and even new

children). Imagine how complicated it can then get if in addition your ex-partner or ex-spouse also has an ability to elect under the Property Relationships Act! The best way to ensure that your will is not disputed is to provide for those people that you have a duty to. This will minimise the likelihood of a court hearing once you pass away. If you are not likely to have an estate that is subject to a Property Relationships Act election and simply have moral obligations to children and grandchildren then there is a way to avoid providing for those to whom you are morally obliged, if you are adamant that you do not want them to benefit from your estate. That is by gifting either directly to the intended beneficiary while you are still alive or by gifting the property you do not want forming part of your estate to a trust. Once that is done it is not readily reversible. Great caution should be exercised before such a decision is made.

Other Considerations: Life Interests can be a useful mechanism to ensure that everyone is happy if you pass away. Take for instance if you enter a new relationship later in life with no intention of having children, have adult children from an earlier relationship, own your own home going into the relationship which makes up the bulk of your estate, have not contracted out of the Act, and your new partner has not contributed to the purchase of the home that you are living in. In this scenario the house you are living in will have become the “family home” and be classified as relationship property. You want your estate to be divided equally amongst your children. Your partner can elect Option A and lawfully take 50% of your estate. You could provide your new partner with a life-interest in the property, the property then passing to your children when your partner passes away. This may be more appealing to them than selling up the property, taking half of it, and finding a new but more modest home to purchase. It may persuade them not to elect Option A. It will not prevent them from making that election but may cause them to stop and think seriously about Option B.

Conclusion

Estate and succession planning is increasingly complicated by changes in the law (most recently the abolition of gift duty). It is best to get thorough and sound advice when considering how to structure things.

Richmond cycleway expanding The new coastal link from Nelson to Mapua will be one of the most scenic cycle rides in the entire country according to project manager Stuart Hughes. Three separate contractors have been announced to begin work on completing the Nelson to Mapua segment of the Nelson-Tasman Great Taste Cycle Trail by Christmas. The current work will occur between Richmond and Mapua with a purpose built suspension bridge to be constructed across the Waimea River in the coming months.

This particular segment of the trail will not be open to the public until after an official opening ceremony. A temporary bypass route will go across Queen St for a couple of months due to a “no construction” period in the resource consent while bird nesting occurs. Stuart says the timing of the Nelson to Mapua link should be ready for “when the masses” are here during summer. “It’s going to be tremendous. It’s going to be one of the most scenic in New Zealand. The great thing about it is it varies all the way.”

News from NelsoN Host lioN’s DeN Welcome to the August edition of The Lion’s Den – the fortnightly activities and message forum of Nelson Host Lions Club. The club is made up of men and women who share a concern for the wellbeing of others and value their community. For nearly 50 years the club has been meeting and supporting community events and interests. Some of our projects include the Lions Playground at Tahunanui, the fire station at Founder’s Park and the annual Nelson Host Lions and Southpine Golf Tournament. This year’s tournament will be held over the weekend of November 17-18. We would like to thank the applicants for funding (now closed) and will shortly be announcing the successful community organisations. Applications will open again July 2013. We are currently running a fertilizer drive with both liquid and dry product available for $5 and $10 respectively. Look out for the forms in your mail box. We also produce candy floss at a very reasonable rate for sale at school fairs etc. Various activities have recently been attended by club members. This included an address by one member detailing the journey of his family to New Zealand from Russia via Siberia, Australia and the Murchison goldfields. Nelson Host Lions meet for a meal and socializing every first and third Tuesday of the month at the Ocean Lodge. We invite anyone along who would like to share in the activities of the club and has an interest in helping others. Always remember, rest is rust. azing things

Brothers ready for global success Andrew Board Nelson brothers Andrew and Chris Rodley started their time lapse camera business when they were amazed with how poor the quality of a security camera they bought online from the United States was. Ten years later they are ready to return to the US and show them how it’s done. Chris and Andrew designed the Snapit HD cameras, enlisted the help of their dad, who was handy with a soldering iron, and got to work, cobbling together a world-class time lapse camera with parts from various places. That technology has seen them working with the biggest construction companies, government departments and tourism operators in the country, as well as supplying the technology for TV3’s weather department. All pay a weekly fee to have access to the information the cameras produce. The cameras are live so users can go on their website and view the cameras in real time. Users can also control which way the 360 degrees cameras point. The time lapse side of the cameras takes photos every ten minutes and records it. When they are put together over the course of an hour, a day or a year they provide quite startling images of how an area can change. But what started as a bit of fun, an exciting way to burn off their creative juices has this year turned into what could be one of Nelson’s most exciting tech companies. Recently it recorded 76,000 viewers in just one day looking at its camera at Lake Rotoiti and is now ready to launch overseas. Chris, a former Nelson College teacher and now chief executive of Snapit HD, launched their new generation cameras in Las Vegas earlier this year where one of the top designers of the i-Pad described their technology as “phenomenal”. Monday, August 20 At 2.30pm a 15 year old girl was arrested for assaulting a person with a blunt instrument and speaking in a threatening way after an incident at Vickerman St in Port Nelson. At around 8pm there was a report of male assaulting female at a Torlesse St address. Just before 6pm there was a report of a person acting suspiciously on Washington Rd. There was a report of a stolen bicycle from the Beach Café in Tahunanui at around 3.30pm. At 8.30pm there was a report of theft from a car parked in Muritai St. Just before 11pm, a 62 year old woman was arrested for resisting police, refusing to accompany an officer and refusing an officer's request for a blood specimen. Tuesday, August 21 At 8.30am there was a report of common assault and wilful trespass at Songer St. At 2.30pm, there was a report of common assault on the corner of Alfred and Tipahi Sts in Stoke. At 8am police received a report of criminal harassment from a Waimea Rd address. At 12noon police responded to a call of domestic dispute at Green St. Wednesday, August 22 There was a report of common assault on Brook St at 1pm. On Allan St there was a report of a burglary during the day. A motor vehicle was taken and later found on Tennyson Cres in Stoke. There were two reports of shoplifting on St Vincent St at 10.30am, with a third shoplifting case reported on Toi Toi St an hour earlier. At 6pm police were alerted to a report of wilful damage at Isel Park Gardens. Thursday, August 23 On Brook St, at 12.30am, there was a dual report of common assault in a domestic dispute. At Nile St there was a report of a burglary at 3.15pm. Friday, August 24 At 11.50pm there were two breaches of the liquor ban incidents in Buxton car park. There were two reports of shoplifting on St Vincent St, the first at 2pm and the second at 7pm. At 11.34pm, a 22 year old man was arrested for driving in a dangerous manner. Saturday, August 25 At 2am an 18 year old man and a 19 year old man were arrested for fighting in a public place after an incident at Buxton car park. In the early hours of Saturday morning there were four breaches of the liquor ban, all in or around Bridge St. Sunday, August 26 There were five reports of assault in the early hours of Sunday morning, two at Bridge St, one on Hardy St, one at Karaka St and one on Parkers Rd. Also on Bridge St at 2.45am there was a report of wilful damage and resisting police. At 12.26pm there was a report of shoplifting on Trafalgar St.

Stars of the future in full flight at Nelson netball

Although the netball season is drawing to a close there is still fun to be had for the Future Ferns. Nelson netball development officer, Trish Lowe is busy co-ordinating the final weeks of the season. Fun Ferns (or as Trish affectionately calls them – my babies) is for 4 – 8 year olds and meets at Saxton Stadium on Tuesday afternoons. The players are put into groups according to their age and along with helpers they work through a standard list of skills and drills. Once those are mastered, the drills are then expanded accordingly. They had their final this week with special activities organised by Marie Holland of Sport Tasman and were awarded certificates. Future Ferns is the next step up, with Year 4 and 5 being put through their paces at Saxton Courts on Wednesday afternoons. The teams take part in skills and drills as part of their warm up, which is followed by a game of two 12 minute periods. Trish supplies the coaches with the skills and

drills hand-outs and along with her invaluable helper, Jane Gass is on hand to offer any advice. One-on-one sessions for coaches also happen regularly throughout the season. Once the players reach Year 6 they get to play “Saturday netball” when they have a normal warm up and play four 10 minute quarters. And like everyone knows, to play netball you need umpires. Trish has an enthusiastic group of young players who turn up to umpire, often having to fit it in around playing their own game. This year 16 players have been selected to play as a curtain raiser to the Premier Grade final next Thursday. Trish asked for nominations from coaches then had the difficult job of selecting the final 16. They have been training hard under Trish’s guidance over the past four weeks for their big game and are as keen as mustard to play at Saxton Stadium. Broadgreen Intermediate’s Caitlin Reid and Tehya Wilson along with Catherine Evaga of Waimea Intermediate are promising umpires who will control the game.

ASB Nelson Pine has created history, coming back after losing two sets to claim its first ever VNZ Club Championship – doing it all in front of a packed Trafalgar Centre on Saturday night. Nelson Pine captain and setter Patrick Shone says the win was a “dream” for the Colin Redpath-coached squad. The 2012 team included many former stars of the Nelson secondary school scene who had left the region to pursue further study. Patrick highlighted the impact

playing in front of friends and family had on the side. “We’ve managed to put a programme together where we can have those players from Wellington join with us, who are originally from Nelson,” he says. “That was one of the factors that made it the ultimate win, having those ex local players back playing in front of their friends and family.” The tournament final was an organisers’ dream with the hometown side facing defending champions Sparta. Jacks gunning for perfection Jacks OPD Richmond is one game away from the perfect season – they have gone through the regular season unbeaten and hope that form continues in the club netball championship game this Thursday. Jacks has without a doubt been the in-form team throughout the season, and while they may not have always put out a consistent four quarters they usually gain a pass mark from coach, Robyn Leonard. Jacks have a wealth of experience within their ranks and have cool heads if the going gets tough. Jacks OPD booked their berth for Thursday’s final with a convincing 61-32 win over an un-

der-strength Richmond. Richmond had another chance on Saturday however the fast finishing Waimea College got up to take the game 49-45 to deny the defending champions the opportunity. While Waimea’s focus may be firmly set towards the South Island Secondary Schools Tournament in Dunedin next week they have unfinished business in the elite competition in the final on Thursday night. The winner? Odds on favourite has to be Jacks however don’t discount the talent and youthful enthusiasm of the other green team. The game will be played at 7pm with Future Ferns curtain raiser at 6pm.

Freak accident ends hopes for nationals Phillip Rollo A Nayland College football player could have died had he played the final national secondary schools qualifier last month. Bjorn van Ginkel, a centre back in his final year of secondary school, was struck in the abdomen twice by an oncoming kick during a first division match for his club side QSP Richmond Athletic, rupturing his spleen and causing internal bleeding. The 17 year old hit the ground in agony following the second shot. When the pain continued, he was taken to hospital by the father of one of his opponents. But a long wait in A&E resulted in misdiagnosis. Bjorn was told he was just suffering from muscle pain and sent home. Three days later and the young football player had not been to school. He couldn’t even leave his bed, because of the pain. So he decided to visit the local GP, who signed off a letter that he must undergo a CT scan at Nelson Hospital. The CT scan showed that, Bjorn – who was contemplating kitting up for the school’s must win nationals qualifier against Nelson College the next day despite the pain – had ruptured his spleen and another

strike to the abdomen could have killed him. “If I had played in that game I could have died. I was bleeding internally and if I had done anything else it could have got way worse, it could have ruptured the whole thing,” he says. “If I had played another game and anything had hit me there I would have died.” The three month recovery process is a patient one. Bjorn will miss the final rounds of the Nelson Pine Industries first division and also his last chance at winning the Lotto Premier New Zealand Secondary Schools Football Championship, having been a reserve in the squad that finished second place in 2010. Other than running on a treadmill, all physical activity will be off-limits. “It will heal itself at my age but I had to get heaps of vaccinations so I don’t get sick. I’m definitely out for nationals. I’ve played my last game for Nayland, so that sucks," he says. Bjorn will now assist the coaching set up for the school’s nationals campaign but is hoping to return to the football pitch for the South Island Under-19 Championship in October, which is being held in Christchurch.

Josh Mead of Hampden St School is the king amongst 20 different sporting disciplines, after he kicked, ran and threw his way to the Sportsperson Award at Bridge Valley Adventure Centre’s Sportopia. Sportopia was contested by year five and six students from Auckland Point School, Hampden St School, Nelson Central School and Tapawera Area School.

All contestants competed in an array of different codes, rewarding the most versatile athletes. Sports varied between rugby league, kiwi tag, cage football, table tennis, chess, darts and many others. Each sport was played for 30 minutes, before teams and individuals moved onto the next challenge. Sportopia went for three days with students being based at Bridge Valley for its entirety.

The Stirling Sports Supreme Team Award was won by three schools, Hampden St, Nelson Central and Tapawera while Auckland Point picked up the Sportsmanship Award. Titans down West Coast The Tasman Titans put on a strong display in the second half to romp home 42-22 in the rugby league stronghold of the West Coast on Saturday. Playing its first game of the season, Tasman got better as the game went on, scoring 30 second half points after leading just 14-12 at half time. Sam Hedges was in terrific form in the centres, with big defence smashing the confidence from the West Coast attack. Callum Smith and James Vailanu were also stand outs, with the much smaller West Coast forward pack struggling to contain them. Try scorers for Tasman were Simon Walker, Jesse Walker, Kaiapa Paul, Hayden Smith, James Vailanu, Sam Hedges and Ngatote Samuels with Hayden Smith kicking six conversions and a penalty. The Titans next game is against Canterbury at Trafalgar Park on September 8.
