Dine

how you wish

Gourmet buffet or table service, flexible mealtimes, live cooking demonstrations

The chance to enjoy good food in relaxed surroundings is always one of the pleasures of any holiday, and dining aboard your A-ROSA vessel is no exception. For 2023 and 2024, there’s even greater emphasis on a varied range of high-quality dishes served in the ships’ stylish surroundings.

Mealtimes, from breakfast to dinner, are flexibility itself, with generous opening hours at the gourmet buffet and

‘live-cooking’ stations hosted by the ship’s skilled chefs, ensuring freshly prepared dishes, and plenty of healthy options from which to choose.

Awake each day in anticipation of the excitement to come, and whether you’re an early riser or someone who likes to take things a little slower – perhaps heading for a stroll on the sun deck or even ashore, if your ship is tied up alongside – the excellent breakfast buffet awaits you.

10

At lunchtime, whether you’re sailing or returning from a morning ashore, make your unhurried way to the dining room, where once again the chefs will have prepared delicious, fresh choices to enjoy. Perhaps there’s a regional speciality to sample, dependent upon where you find yourself, adding to the pleasure of the day.

On especially sunny days, you can swap the dining room for the sun deck, where a barbecue and grill offer opportunities to enjoy al fresco meals as you take in the passing scenery.

When evening comes, and the day’s activities have drawn to a close, perhaps enjoy a cocktail in the bar, before heading to the dining room where the evening meal awaits. Take your time over dinner, whether a gourmet buffet or table-served experience, and perhaps end the evening back in the lounge, where there’s light entertainment to enjoy.

If your ship is in port for the evening, the flexibility in the dining room comes into its own, meaning that you can grab a bite before heading ashore to sample the atmosphere in a colourful shore-side town or village, or alternatively enjoy a pre-dinner drink ashore before returning to the ship – the choices, as ever, are yours.

Later, join fellow passengers in the comfortable lounge, where a little light entertainment, including one or two concerts on 7-night cruises and longer – sometimes by local artists who come aboard – add to the pleasure of each enjoyable evening. Throughout each wonderful day, life aboard your A-ROSA vessel unfolds at your chosen pace…

Life in the great outdoors

One of the most striking features of all A-ROSA ships is the vast sun deck, the focus of outdoor life aboard ship on many a sunny day and balmy evening, and which significantly adds to the pleasure of your cruise.

From an early morning stretch or stroll to a late-night turn under the stars, the sun deck waits to welcome you. Running from ‘stem to stern’, it serves as a working

home to the ship’s captain as he navigates his way up or downstream – and a well-equipped, multi-faceted outdoor relaxation, recreation and dining area for holiday-making passengers. Take in elevated, all-round views of the rivers’ passing scenery, watch the crew at work as the ship ties up in the latest port of call, and enjoy all the joys of the open air, whether at play or in lazy indulgence. Once again, the choices are yours!

16

Recreation, outdoor dining and  stunning scenery

Equipped with plenty of sun loungers, a shaded area for when it gets too warm, and a pool or plunge pool in which to cool off, as well as a variety of deck games, including a putting green, shuffleboard court or giant chess set, the sun deck is the perfect place for total relaxation. To enjoy a little exercise from time to time there will be classes or yoga sessions to join – or some gentle competition with fellow passengers, if you have the energy or inclination that is! The beauty of life aboard ship is that you can do as much or as little as you wish.

As well as all the fun activities, fine days bring the delicious aromas of the deck barbecue, bringing the chance to enjoy al fresco lunch or dinner prepared by the chef, accompanied by a drink from the bar. Whether you’re watching the ever-changing scenery, taking an afternoon siesta, curled up with a book in a quieter corner, enjoying a cocktail with new-found friends as the sun sets on another beautiful day, or even, on balmy summer evenings, simply enjoying a seat under the stars, this is the life – A-ROSAstyle!

Introducing Travel for Good

Exploring the world with care and consideration

To travel responsibly and for good is to travel with care and consideration for not only the local people of the places that we visit, but also the planet.

We would like to introduce our new Travel for Good hub – an online space dedicated to sharing our journey and the steps that we’re taking to offset our global impact.

At Newmarket Holidays, our mission is to enrich lives and improve wellbeing through travel, and while there’s still a long way to go, we believe that we have a responsibility to be transparent about what we’re already doing and the areas where we could improve.

We’re excited to take you along with us as we expand our partnerships, showcase our positive impacts tours, highlight our projects and programmes, share our inhouse sustainability and wellbeing efforts, and provide you with tips on how to be a responsible traveller.

what it means to us...

I’m really pleased with our first steps on this journey. We all know that there are areas where the travel industry has work to do to become truly sustainable, but I think it sometimes gets a bit lost that the industry does do a lot of good, whether that be through the hundreds of millions of people it employs all around the world to the redistribution of global wealth, and the benefits it offers our customers.

Rainforest, Borneo
24

what it means to us...

My personal favourite positive impacts tour would be Costa Rica – Wildlife, Rainforest & Caribbean Beach. I have a lot of respect for Costa Rica – it’s a country that has consistently shown great care and devotion to preserving its land, flora, fauna, and culture. There’s no doubt that it’s one of the most predominant leaders in the world for sustainable tourism.

Our community, environmental and social impacts

Our Travel for Good initiatives ensure that we only work with hotels and on-the-ground suppliers that adhere to our standards and comply with applicable, international and local laws and regulations.

Our positive impacts tours

From visiting the sites of wildlife conservation projects in South Africa to supporting community projects in the villages of Cambodia, our curated collection of positive impacts tours will benefit you as a traveller as well as the people and places that you see.

Our partnership with Just a Drop

We’re incredibly excited to have partnered with Just a Drop to have a real, tangible, and sustainable impact through the construction of a latrine block at a local school in Nicaragua, Central America.

Our carbon-offsetting efforts

To understand and offset our carbon footprint with regard to our printed assets, we’ve partnered with an environmental consultant to help us identify where and how best to reduce our carbon footprint, as well as the communication provider Media Group, which allows us to support the World Land Trust conservation charity.

Our in-house sustainability and wellbeing efforts

Beyond the doors at Newmarket Holidays HQ, we’re constantly striving to improve and take positive steps towards bettering our sustainability and wellbeing efforts within the company. We have trained in-house mental health First Aiders, as well as a gardening team, who meet at lunchtimes.

Our top 10 responsible travel tips

We’ve gathered some helpful tips for you to protect, empower and positively impact the people you meet and the destinations you meander around on your adventures. Take a look on our Travel for Good hub to find out more!

The Romantic Rhine & the Meandering Moselle

The mighty Rhine, one of the world’s great waterways, flows from its source high in the Swiss Alps, through Germany and into the Netherlands, where it spills into the North Sea. En route, it passes great cities like Strasbourg, Speyer and Mainz, then the classic Rhine Valley landscape of vineyards, castles and picturebook villages. Flowing through the famous Rhine Gorge, beneath the mythical Lorelei, the Rhine meets

the Moselle at Koblenz, with its imposing fortress. The smaller river plies its meandering course from ancient Trier, past a host of idyllic wine-villages, before joining its neighbour, which heads north in wide sweeps past Cologne’s twin-towers, and on past the bridges at Arnhem and Nijmegen into the windmill-dotted Dutch countryside, and the historic maritime cities of Rotterdam and Amsterdam.

The fairy-tale Rhine of myth and legend, of historic cities fringed by ripening vineyards and dramatic gorges, together with the picture-perfect vineyard clad Moselle.

Selected Ports of Call

The Rhine Gorge – UNESCO  World Heritage site

In the heart of the classic, picture-book ‘Romantic’ Rhine, the dramatic 65-miles of the Gorge, topped by the fabled Lorelei – the steep cliff from which sirens were said to have lured sailors to their fate – is dotted with pristine towns and villages.

Koblenz, Germany

Beautifully set at the confluence of the Rhine and meandering Moselle, opposite the imposing ramparts of the Ehrenbreitstein fortress, Koblenz boasts a delightful riverside promenade dotted with bars and cafés, and a colourful, historic Altstadt, or old town.

Mainz, Germany

This once-powerful city, the largest in the Rhineland-Palatinate, was hometown of Johannes Gutenburg, the father of the printing press. Don’t miss the vast cathedral, the Gutenberg Museum, honouring the city’s most famous son, and the delightful half-timbered Altstadt.

Trier, Germany

The UNESCO -protected city of Trier, on the Moselle, is famous for its collection of wellpreserved Roman sites, which include an amphitheatre, Emperor Constantine’s throne room, and Germany’s oldest bridge.

Strasbourg, France

Flower-strewn Alsace capital and European parliament seat, Strasbourg boasts the ancient Petite France quarter, a maze of narrow streets and medieval buildings, criss-crossed by canals and watched over by the Gothic masterpiece of Notre Dame Cathedral.

Basel, Switzerland

Switzerland’s ‘gateway to the world’ boasts a bustling Altstadt of cafés and pubs. The magnificent Münster, which overlooks the Rhine, has some wonderful cloisters that open out onto a terrace offering stupendous views of the river and the Black Forest beyond.

Bernkastel-Kues, Germany

Perched on opposing banks of the Moselle, the idyllic twin towns of Bernkastel–Kues are characterised by medieval half-timbered buildings and winding, narrow alleyways lined with cafés and restaurants. Both towns are surrounded by a patchwork of picturesque vineyards.

The ‘Golden River’ Douro

Rising in Spain, the Douro marks the border with Portugal’s neighbour, then turns west to flow for 200 kilometres before spilling into the Atlantic. En route, it passes through a scenic countryside of vineyards and port quintas, somnolent villages and ancient towns, before passing underneath Porto’s famous bridges.

The river has only been fully navigable since the 1980s’ construction of a dam and lock system, and the enjoyment of your cruise is enhanced by the knowledge that you are still amongst a relatively privileged few to have viewed the Douro Valley from the river.

Selected Ports of Call

Porto, Portugal

Built on granite bluffs high above the river, near where it spills into the Atlantic, Porto is full of fascination, with its rambling, UNESCO -listed Ribeira district and its neighbouring port wine centre of Vila Nova de Gaia on the opposite bank, linked by several vertigo-inducing bridges.

Régua, Portugal

This bustling riverside town, which marks the western gateway to the port-wine producing area, where vineyards have lined the river and covered the hillsides for over two thousand years, is also gateway to exquisite Lamego, with its achingly beautiful Igreja de Nossa Senora dos Remédios shrine.

Pinhão, Portugal

This tiny, picture-book village lies on a bend in the river at the scenic heart of the wine-growing area, surrounded by rolling hills covered in vines. It boasts an exquisite railway station with tiles depicting harvest-time, and is close to several important wine estates.

Barca d’Alva, Portugal

Almost at the Spanish border, which lies less than a mile away, this tiny hamlet is famed for its almond trees and, thanks to the lack of light pollution, its stunning starlit nights. Take an optional shore excursion to beautiful Salamanca from here.

Vega de Terrón, Spain

At the point where the Douro, now the Spanish Duero, turns north, this sleepy port town is a mix of both countries, as languid as the river’s waters at this point. Lying opposite much fought-after hilltop village Figueira de Castel Rodrigo, Vega de Terrón marks the easternmost point of the cruise, before you turn downstream once more.

Idyllic towns and villages exuding rustic Gallic charm, great cities that bear witness to the potency and architectural legacies of Burgundian dukes, conquering Romans or all-powerful medieval popes, and rolling vineyard-covered hills that testify to wine-producing fame, ensure that a holiday here is full of fascination and delight. The Saône, which rises in the high Vosges to

the north, flows through the hills of Burgundy to historic Lyon, where it joins the larger Rhône, one of Europe’s most important arteries, for the onward journey into Provence and to the Mediterranean. This very special corner of the world is brought to life each day as your ship sails on from one delightful port of call to the next, with both rivers full of fascination.

The two richly contrasting and historic regions of Burgundy and Provence, through which the languid River Saône and the mighty River Rhône make their scenic journeys south, are amongst the most alluring and enchanting of all France.

Selected Ports of Call

Arles, France

Once the capital of Roman Gaul, and boasting superbly preserved remains – baths, a chariot racetrack and the famed Les Arènes arena, home to Spanish-style bullfights – Arles was inspiration to Van Gogh and Gauguin, and today exudes Southern Gallic charm.

Avignon, France

The fabled ‘City of the Popes’, one of Europe’s best-preserved medieval strongholds, is dominated by the monumental Palais des Papes, and is an engaging, bustling city, centred on the Place d’Horloge, which is lined with cafés and market stalls – the perfect spot from which to watch the world go by. Don’t miss the crumbling remains of the Pont St-Bénézet, the ‘pont d’Avignon’ of the famous French folk song.

Burgundy, France

The vineyards of the Côte d’Or, Côte de Nuit and the Côte de Beaune, birthplace of some of the world’s most celebrated wines, lie close to historic Beaune and its stunning medieval Hôtel Dieu.

Chalon-Sur-Saône, France

This historic Côte d’Or town boasts a beautiful medieval quarter, a fascinating wine museum and another dedicated to local Joseph Niepe, the inventor of photography.

Lyon, France

France’s UNESCO -listed second city, for centuries the wealthy centre of the silk trade, and now a prosperous gateway to both the Alps and sun-kissed Provence, lies at the rivers’ meeting point, where the Rhône turns south towards the Mediterranean.

Mâcon, France

Famed wine-producing town Mâcon, on the banks of the Saône, boasts a lively, cafélined promenade.

The Beautiful Seine Valley

The great, meandering artery that winds its lazy way from one of the world’s great cities through some of the most enticing, most bucolic countryside of all France, continuing a 480-mile journey that takes it from the country’s southeast corner to the river’s estuary at Le Havre, is another wonderful waterway upon which to enjoy an A-ROSA cruise. Sit back and enjoy a holiday

spent gently sailing through a pastoral, richly forested region that is dotted with idyllic towns and villages, ancient ruins and historic cities that include the restored medieval gem of Rouen and Giverny-gateway Vernon, discover a land of cidre, calvados and ripe, soft cheeses, and of course crown it all with an exploration of France’s glorious capital.

France’s most famous river, synonymous with the country’s glorious capital, is gateway to the ‘City of Light’ and Normandy’s stunning scenery.

Loudspeaker announcements can be heard on deck and in the cabins (via on-board TV) and are mainly made prior to shore excursions and important events and for special points of interest along the river.

Bars

Each of the A-ROSA ships offers an indoor bar/ lounge bar and outdoor bar and lounge. The locations of these will differ from vessel to vessel (see individual deck plans) and the provision of the outdoor facilities is weather-dependent. Opening hours will be found in the Daily Programme in your cabin.

Bathrobes

Bathrobes are available upon request from your cabin steward/ess, if they are not placed in the cabin already.

Bicycles/Biking

For more information on the cycling excursions, please contact the on-board SPA-ROSA

department or ask at reception. Unfortunately, it is not possible to take your own bikes on the cruise.

Clothing

On-board and during the shore excursions, you can wear what you like. Dress code is comfortable and casual. Please remember to bring warmer clothes for the evenings out on deck. For the shore excursions, we recommend you bring sturdy shoes. For the restaurant we recommend smart casual dress.

Concierge Service

Our reception team will be available to fulfil your individual requirements (e.g. reservation of tickets for cultural experiences or special excursions, organisation of transfers). On A-ROSA FLORA and SILVA all suite guests may use our new butler service. We are available 24 hours for any request.

Connecting Doors

On A-ROSA AQUA, VIVA, FLORA and SILVA, every deck has at least two cabins with connecting doors and A-ROSA SENA on deck 3. These can also be used as family cabins.

For all important information and instructions, please see your A-ROSA Journal, which will be placed in your cabin each evening.

On the sun deck you will find deckchairs and a sun canopy. In the interest of all passengers, please

don’t reserve deckchairs. Woollen blankets for cooler weather on deck can be found in your cabin.

Disabled Guests and Guests in Need of Assistance

All ships have stairs and not all are equipped with passenger lifts. Therefore, not all ships are suitable for passengers with restricted mobility. A-ROSA ALVA and A-ROSA SENA are fitted with passenger lifts.

Doctor

Although there are no medical facilities aboard ship, medical treatment is available at each port of call.

Drinking Water

The water on board is drinkable.

Excursions

Almost all ports of call are starting points for interesting shore excursions. For more information, please see page 62-63. Please also make use of the on-board information event on the first evening (embarkation day): bookings can be made on board. A-ROSA is only acting as an agent for the excursions offered. The local agencies will act as tour operators to organise and accompany the excursions.

Going Ashore

In the EU, you can leave the ship as soon as we dock. In non-EU countries, you can only leave the ship after permission is granted by the local authorities. In your own interest, we request that you are back on board no later than 30 minutes before we cast off. The docking times may change at short notice. Please pay attention to announcements and information in the daily programme. Please pick up your shore pass

70 Book online: newmarketholidays.co.uk

from the front desk, before going ashore. After returning on board, please hand the pass back to the reception. The shore passes are used to check whether all guests are back on board.

Hairdryers

A hairdryer can be found in your cabin (not the bathroom) in one of the drawers near the mirror or in the wardrobe.

Itinerary

You can find the planned itinerary in the brochure. The information is subject to change. High and low water, maintenance work and waiting times at locks and bridges due to shipping traffic which may result in short-notice changes to the itinerary. In rare cases of extremely high or low water or force majeure, parts of the itinerary may have to be completed by bus or train and in individual cases overnight stays in hotels may be necessary.

Key Card

This card is your A-ROSA key and credit card. Please always carry your key with you. In case of loss, please notify the reception immediately.

Laundry

In your wardrobe, you will find laundry bags and order notes for our laundry service. This will be charged to your on-board account. Suite guests may enjoy the laundry service free of charge.

Methods of Payment

The on-board currency is Euros. During the cruise, you can use your on-board credit card on the ship, and this also acts as your cabin’s key card. At the end of the cruise, you can pay your final bill either in cash, with Maestro card or with the following credit cards: American Express, MasterCard or Visa.

Money Changing

Unfortunately, there are no on-board money changing facilities. However, bureaux de change can be found in the vicinity of our docking locations.

Mooring Area

In some towns, it is usual for the port authorities to assign several ships the same mooring area due to the large volume of shipping traffic. In such cases, the ships are moored next to each other and you may not be able to see out of your cabin properly and you may need to exit across other vessels whilst going ashore. Unfortunately, A-ROSA has no influence over this.

Pool

A heated pool can be found on the Sun Deck of the following ships: A-ROSA ALVA, DONNA, FLORA, SILVA, STELLA and the A-ROSA SENA A heated whirlpool can be found on the ships A-ROSA AQUA, VIVA and the A-ROSA SENA in the SPA outdoor area on deck 3 and the Whirlpool on A-ROSA SENA is on deck 1. The reception is open round the clock.

Your itinerary

We endeavour to follow the itinerary advertised in the brochure, although please note, due to water levels on the river and circumstances beyond our control, we may need to change the order in which the itinerary is operated, our ports of call, or our day-to-day activities. On the rare occasion this happens, the ships crew will keep you fully informed.

4 Your Cancellation

You may cancel your booking or part of it once it has been confirmed but the cancellation will only be valid if made in writing direct to the Company or by telephone to our Customer Service team and your having answered the security questions. If the cancellation results in a person travelling alone, a single room supplement is payable.

In such circumstances, we will arrange for your booking to be terminated and for you to receive a full refund. We will observe advice provided by the UK Foreign & Commonwealth Office. Dates of your holiday may be changed, prior to the due date of the balance, only once and this will incur a fee. If the matter is not then satisfactorily resolved, you must complete a written report (form available). You must then follow up any complaint in writing within 28 days of your return, including a copy of the original report form. If you fail

We cannot predict these occurrences in advance and do not accept liability if attractions are not open or available, although we will do our best to provide alternatives.

Delays

Occasionally, flights and the ship may be delayed due to circumstances beyond our control. In such cases, we will do our utmost to help you and keep you fully informed. In the event of extended overnight delays, depending upon circumstances, we will endeavour to provide accommodation. In the case of a major delay to your homeward journey, we shall endeavour to delay the departure from the ship.

Holiday extras not booked with Newmarket Holidays

We cannot be held responsible for compensation in respect of any extras which are booked (e.g. travel insurance, transport including but not limited to flights and currency) with a third party, if we subsequently cancel your holiday for whatever reason. If you book your travel insurance with us, you would receive a full refund in this circumstance.

to follow the requirement to report your complaint on board we will have been deprived of the opportunity to investigate and rectify it and this may affect your rights under this contract. We operate a strict code of conduct which also conforms to European regulations on package travel and take any complaints received seriously. However, in order to be fair to all concerned, complaints will be considered only where the above procedure has been followed.

6 Your Travelling Conditions

Where as part of the holiday you have booked your travel by air, land or sea, such travel will be subject to the terms and conditions of carriage of the airline, shipping, rail or coach company providing the transport. In most cases, the conditions will limit the carrier’s liability to you in accordance with international law. Should anyone be refused admission to the coach or ship, or to the destination country by the transport or government authority, then we are powerless to assist and cannot be held responsible. This includes any passenger who fails to advise us of any medical condition or disability. If you are prevented from travelling as a result, our responsibility for your holiday thereupon ceases. Full cancellation charges will apply and we will be under no obligation whatsoever for any refund, compensation or loss you may incur. Copies of the relevant parts of the Terms and Conditions are available on request.

Our Contract With You

1 Our Confirmation Of Reservation

When we have received your booking and deposit we will send you a Confirmation of Reservation which details exactly what is booked for you. From this moment Newmarket Holidays Ltd has accepted your booking on the terms set out in this Contract.

2 The Cruise Price

Once you have booked, we guarantee to not change the price of your holiday with us.

System Errors

We try hard to ensure that advertised prices are up to date, and reflect the price you will pay when you book. However, prices can change and errors can occasionally occur. We reserve the right to change and correct advertised prices at any time before your booking is confirmed. In the event of your Confirmation of Reservation showing an incorrect price for your holiday, the price that will prevail is the price confirmed to us by the cruise operator, as we act as a travel agent for these bookings. Accordingly you may not seek to rely on system errors with a view to obtaining a holiday at less than the correct price, and any contract entered into upon a mistake, such as a wrong costing due to system errors, is not valid or binding.

3 Data Protection

In order to confirm and process your booking, we need to collect Personal Data for all the people named on the booking. We reserve the right to process, store and share any and all of the information we collect with our suppliers as we deem necessary to fulfil the contract between us and to comply with national and international law.To find

out more about how we use and protect your Personal Data, please visit www.newmarketholidays.co.uk/privacy

4 Our Alterations

It is unlikely that we will have to make any changes to your holiday but we do plan your holiday arrangements many months in advance. Occasionally changes may be made, which we reserve the right to do at any time. Most of these changes are insignificant and we will advise you at the earliest possible date. Examples of insignificant changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation/cabin to another of the same or higher standard, changes of carriers, cancellation of an optional excursion. A significant change is one that we make to your holiday arrangements before departure that involves changing your resort area, or time of departure or return by more than twelve hours, or offering accommodation/ cabin with a lower official classification than that advertised (except the latter in the case of en route tour hotels). If a significant change becomes necessary we will inform you as soon as is reasonably possible if there is time before your departure. When a significant change occurs you will have the choice of either accepting the change of arrangements, purchasing another available holiday from us (we will refund any price difference if alternative is of lower value), or cancelling your holiday and receiving a full refund of all monies paid (we will also provide a full refund of your travel insurance premiums if you purchased insurance from us). When a significant change occurs, provided it does not arise from circumstances amounting to force majeure (see below), we will pay compensation as detailed below, based on how far ahead of departure the change is advised: Charge 15 - 28 days £10, 0 - 14 days £25

N.B. 4: We will not pay you compensation where the significant change is due to unavoidable and extraordinary circumstances, which means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport.

5 Our Cancellations

We reserve the right to cancel your holiday and in this event we will return to you all money you have paid to us or will offer you an alternative, available holiday to purchase of comparable standard. In no case, except for reasons of war etc, (see N.B. 4, above) will your holiday be cancelled after the date when your final balance becomes due.

6 Our Complaints Procedure

We can also offer you ABTA’s scheme for the resolution of disputes which is approved by the Chartered Trading Standards Institute. We can normally agree an amicable settlement of the few complaints we receive. However, if we cannot agree, disputes arising out of, or in connection with this Contract may (if the customer so wishes) be referred to ABTA. Go to www.abta.com to use ABTA’s simple procedure. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com. You can also access the European Commission Online Dispute (ODR) Resolution platform at http://ec.europa.eu/consumers/ odr/. This ODR platform is a means of notifying us of your complaint; it will not determine how your complaint should be resolved. Redress under this Scheme requires written notice requesting arbitration to be made within nine months of scheduled date of return from the holiday. Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of three times the cost of your travel arrangements. Our liability will also be limited in accordance with and/or in an identical manner to a) The contractual terms of the companies that provide the travel services that make up your package. These terms are incorporated into this booking; and b) Any relevant international convention, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, which limit the amount of and conditions under which compensation can be claimed for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of the extent of or the conditions under which compensation is to be paid under these or any conventions. Under EU law (Regulation 261/2004) you have rights in some circumstances to refunds and/ or compensation from your airline in cases of denied boarding, cancellation or delay to flights. Full details will be publicised at EU airports and available from airlines. However reimbursement in such cases will not automatically entitle you to a refund of your holiday cost from us. Your right to a refund and/or compensation from us is set out in these booking conditions. If any payments to you are due from us,

any payment made to you by the airline or any other service provider will be deducted.

If it is impossible to ensure your return as scheduled due to unavoidable and extraordinary circumstances, we will bear the cost of necessary accommodation, if possible of equivalent category, for a maximum of three nights. The limit doesn’t apply to persons with reduced mobility and any person accompanying them, pregnant women and unaccompanied minors, or persons in need of specific medical assistance, provided that you notified us of these needs at least 48 hours before the start of your holiday. N.B. 5: This entire clause does not apply to any separate contracts that you may enter into for excursions or activities whilst on holiday.

7 Our Responsibility For Your Holiday

(a) Although we have no direct control over services provided to you by independent suppliers we accept responsibility for the reasonable standard of the holiday which you book. If any part is not provided as promised, we will pay you appropriate compensation if this has affected the enjoyment of your holiday.  (b) We accept responsibility if you or any person named on the booking suffers bodily injury, illness or death due to the negligent acts and/or omissions of: (i) our employees or agents; or (ii) our suppliers or sub-contractors, servants or agents whilst acting within the scope or in the course of their employment to provide any service or arrangement forming part of the holiday that you have booked with us save that we do not accept responsibility for any air or sea carriers whose liabilities are limited by the relevant International Conventions. Any such claims will be subject to and dealt with in accordance with English Law, and will be subject to the jurisdiction of the Courts of England and Wales only unless, in the case of Court proceedings, you live in Scotland or Northern Ireland. In this case, proceedings must either be brought in the Courts of your home country or those of England and Wales. If proceedings are brought in Scotland or Northern Ireland, you may choose to have your contract and claim governed by the law of Scotland/Northern Ireland as applicable (but if you do not so choose, English law will apply). (c) We shall give you assistance in the event that you suffer illness, personal injury or death during the period of your holiday overseas arising out of an activity which does not form part either of the holiday arrangement with us or an excursion offered through us. This assistance will include advice and guidance and, at our discretion and where appropriate, financial assistance subject to our spending a maximum amount in this regard on behalf of yourself and any other person named on the booking of £5,000 in total.  (d) In the event of a claim under this clause against us by you or any person named on the booking we reserve the right to claim in your place against the person or corporation responsible for the act, default or omission giving rise to the claim and you hereby agree to assign to us all your rights under this clause and we will be subrogated to those rights and you hereby agree to assist us fully in the event that we enforce the rights which have been assigned to us or to which we are subrogated.  (e) We take the safety and security of our clients extremely seriously. If the Foreign Office advises that people should not visit a particular country, then we would act on this. However, we are sure you appreciate from press and television coverage that the political, economic and social conditions in many countries are not as stable as we are used to. Sadly crimes against both people and their property are a fact of life the world over, and when in a foreign county it is very important to be extra vigilant and avoid drawing attention to yourself by wearing expensive jewellery, carrying expensive camera equipment etc. Travellers have the same responsibility for their personal safety and that of their possessions, as they do at home. As situations in countries can change rapidly, we would suggest you may wish to visit the Foreign Office Travel Advice website at www.gov.uk/foreign-travel-advice for up to date information and advice regarding safety BEFORE BOOKING YOUR HOLIDAY. Newmarket Holidays Ltd operate to many parts of the world, some of which do not conform to British health and safety standards. We request that all our hotels comply with the local regulations applicable in their country for health and safety but we cannot guarantee that these meet British standards.

8 Travel Insurance

Because of the importance of having adequate insurance cover we make it a condition of booking on all overseas holidays that you are covered by an insurance policy that it provides health cover including cover for pre-existing medical conditions. If you elect not to take our insurance, you will be required to provide us with the alternative cover you have in place, including the name of the insurer, policy number and most importantly the telephone number of the insurer’s Emergency Assistance service. You agree to indemnify Newmarket Holidays Ltd. for any costs that arise which would otherwise have been met had Newmarket Holidays Ltd insurance been taken. Please note that, if you take out our insurance, certain claims will be subject to an excess charge and that your insurance premium will be dependent on your date of birth. We have no liability for any loss or damage to luggage inflight or in transit. Any claims of this nature should be referred directly to your insurer.

9 Financial Protection & Repatriation

In line with the EC Directive on package travel, Newmarket Holidays Ltd offers complete financial protection for all customers. Newmarket Holidays Ltd is a fully-bonded member of ABTA - The Association of British Travel Agents (membership number V7812), ensuring both your financial protection and high standards of professionalism and reliability. In the unlikely event of the company failing while you are abroad, the ABTA bond will be used to repatriate you. When you buy an ATOL protected flight inclusive holiday from us you will receive an ATOL Certificate. This lists the flight, accommodation, car hire and/or other services that are financially protected, where you can get information on what this means for you and who to contact if things go wrong. We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

10 Passport, Visa, Immigration And Health Requirements

It is your responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your Doctor as applicable. Requirements do change and you must check the up to date position in good time before departure. You must notify us regarding next of kin details and any other important information we request before you travel.

A full 10-year British passport is required for all of our holidays, and your passport must be valid for a full six months following your date of return to the UK. If you do not hold a valid 10-year British passport, please note it can take up to 12 weeks to obtain a new one. If you or any member of your party is not a British citizen or holds a non British passport, you must check passport and visa requirements with the Embassy or Consulate of the country(ies) to or through which you are intending to travel. You must ensure you have the correct travel documents in your possession before departure, failing which you will be liable for any costs, which you or we may incur as a result. Please note that, very occasionally, a last minute change may entail entering an additional country. Please note children must now have their own passport.
