has been a tough year in South Africa. A recent recession and other economic upheaval have led to a climate of uncertainty across the board. To further complicate matters - in the first quarter of 2017 both the manufacturing and trade industries did not perform particularly well. It may seem dismal but as 2017 charges ahead and 2018 looms on the horizon, new opportunities are rearing their heads both within South Africa, which has managed to recover from the technical recession, and in Africa as a whole. According to the Africa Trade Administration, sub-Saharan Africa is one of the fastest growing regions in the world, with even more steady growth predicted in the future. But how do businesses capitalise in Africa? This is my first year compiling and editing Hardware Africa and admittedly I am new to the hardware industry. Yet, what I’ve found is so clear in interacting with the companies featured in this publication and compiling their stories is that innovation is the key. All the companies we’ve featured are innovators in their respective niches. As Steve Jobs once said, ‘Innovation distinguishes a leader and a follower’. In trying times it is those who take risks and strategise creatively that succeed. It’s a common reaction for businesses to batten down the hatches against the ominous storm of a bad economy by cutting all advertising and marketing. Yet marketing experts strongly believe that this would be a big mistake. In times of uncertainty, presenting a

stable, consistent and trustworthy brand to the market is critical. Storms don’t last forever and people seek comfort in what they know. Deciding to take your product beyond South Africa’s borders or thinking about developing something new to fill a gap in the market can be scary and is full of risk. TRADE IN AFRICA: protecting your intellectual property rights
African trade is currently experiencing growth. More and more goods are being exported into Africa, creating a competitive market. With a competitive market comes the risk of imitation and threats to companies’ intellectual property rights. How clued up are you on trademarks and patents? Have you secured adequate licensing and distribution agreements in order to export your products throughout Africa? Carla Collett, senior associate at Webber Wentzel Attorneys unpacks the ins and outs of intellectual property rights when trading in Africa.
F
or the second time in history, the African continent has become a focal point for global expansion. As a result, valuable goods, services and intellectual property are being exported into Africa. With this expansion comes increased demand, competition and the risk of imitation. It is therefore crucial intellectual property rights are adequately protected before embarking on any expansion strategy. Any intellectual property expansion strategy must be structured to optimally protect intellectual property rights and brand value.
TRADEMARK, DESIGN AND PATENT REGISTRATIONS These rights are territorial and must be separately applied for in each jurisdiction in which an organisation trades or plans to trade in the future. It is important to note that many African territories do not protect common law rights, which essentially means that without the registration of trademarks in these territories, brands cannot be protected from infringement by third parties. There are two regional intellectual property offices operating in Africa, these being the African Regional Intellectual Property Organisation (ARIPO) and the African Intellectual Property Organisation (OAPI). An ARIPO registration facilitates the central filing of trademarks, designs or patents in any or all of the designated member states. Although a single application is filed to cover more than one designated member state,

the registration which results is essentially a national registration in each designated member state. An OAPI trademark, design or patent registration extends automatically to all 17 member states. The protection of trade marks in strategic territories and territories which form part of retail distribution routes is also a useful mechanism in the fight against counterfeiting, an ever present reality when trading on the African continent.
to successfully compete in the African market, it is advisable to consider a holistic expansion strategy before scrambling into Africa. HA
DOMAIN NAME REGISTRATIONS As a defensive brand strategy, a separate country code or generic top level domain name should be obtained in each jurisdiction of interest. Domain names are granted on a first come first serve basis and the registration process is relatively quick and inexpensive.
LICENCING OR DISTRIBUTION ARRANGEMENTS There are numerous ways to distribute products or services throughout Africa. An important element, which is often overlooked is the manner in which intellectual property ownership, use and enforcement is governed between the relevant parties. It is therefore prudent to secure licencing and/or distribution arrangements prior to conducting a full scale roll out of an African expansion strategy. In conclusion, there are many considerations to keep in mind in relation to the protection and exploitation of intellectual property rights in Africa. Therefore, in order

Make your business
WORK IN AFRICA Trade in Africa is burgeoning and many companies are trying to cash in on this growing market with novel and lucrative business opportunities. However, it must be noted that while trading in Africa may be exciting, it does come with some unique challenges. Werner Slabbert, managing director of Eco Log Homes, a luxury timber frame and log construction company based in South Africa, has been delivering hand-crafted timber homes to national and international markets for 17 years. From experience, he explains the unique challenges of trading in Africa and gives tips on how to weather them.
I
n the recently published World Bank Global Outlook report, which measures economic growth in nearly 200 countries by calculating year-on-year percentage change in gross domestic profit (GDP), Ethiopia and Ghana ranked second and third respectively in the growth forecast section. Hardly suprising then that businesses are eager to make headway in these markets. However, it is not uncommon to hear of business ventures into Africa deviating entirely from plan and ending in disappointment and severe financial losses instead of making the profits they originally anticipated. Eco Log Homes has a history of building in South Africa and throughout Africa. But according to Slabbert things have not always gone to plan. ‘While we have successfully completed many projects in Africa outside of South Africa’s borders, we’ve learned some hard lessons along the road,’ he says.
GET TO KNOW YOUR CLIENT Once you are well prepared to do business in Africa and have a prospective client, meet with them at your offices in South Africa first, Slabbert advises. ‘We always insist on this initial meeting taking place at our premises, not only to demonstrate our legitimacy and dedication to the project, but because this is also a good litmus test to gauge how serious the client is about investing in the right supplier. You may also have to work with agents who source suppliers for their clients, in both instances, make sure they are serious about doing business with you.’ Slabbert adds, ‘Get as much information as you can about the prospective client, their agent and the project they have in mind upfront and always insist on trade references. As much as a legitimate company would want to check your references, you need to do the same. In our experience, once
the basics have been covered, a legitimate company will have no problem flying you to the construction site/s and covering all your travel expenses.’
CONTRACTS AND LOGISTICS Be sure to cover all bases and legitimise your business dealings with contractual agreements. This applies to doing business anywhere in the world, not just Africa and is good practice in general. ‘Set up your contract to state that your client is to take the risk for any out-of-country expenses, and from a construction perspective, have them arrange all material transport, visas, food, accommodation and travel. They will know the local laws and have local connections, which positions them as being able to make these arrangements far easier, more accurately and cost-effectively than you can,’ Slabbert says. DON’T BE GREEDY There is a popular misconception that enormous profits are to be made when venturing into a landscape of perceived high risk. ‘High risk does not automatically equate to high rewards,’ Slabbert explains. ‘Be humble and courteous in your venture, but be smart and protect yourself against currency fluctuations. ‘We like to keep our projects ZAR-based so that we don’t have to worry about this risk and we always engage the services of a company like Credit Guarantee, for example, who offer products that can protect you and your venture specifically against the risks of doing business in Africa.’

Top Tips for doing business in Africa: • Meet your client in South Africa first, research them and conduct thorough trade reference checks • Travel to see the proposed project site at the client’s expense • Do not invest in a client that does not have the budget to afford your product or services • Protect yourself against currency fluctuations and work in South Africa where possible • Enlist the services of Credit Guarantee or similar to protect your project financially • Always let the client take risk for any out-of-country expenses • Have the client arrange local transport and logistics • Always send more material than necessary on a construction project • Make sure you have air evacuation cover for your staff • Vaccinate appropriately and timeously • Be aware of requirements of shipping and take necessary precautions to guard against risk • Do not engage in bribery, there is always an alternative. material than is necessary, because it is not always possible to find the materials or tools required at a local hardware store or outlet. Some countries do have the convenience of having a branch of a well known chain store but they may not necessarily carry the same stock as their South African branches. ‘Remember, if you use shipping containers, you need to calculate the volume and weights so that you don’t overload the containers. The containers also need to be balanced, with weight distributed as evenly as possible, so there isn’t too much weight applied to

one wheel of the truck carrying the load. Keep in mind, your material is at risk of being damaged should the need arise for the shipping company to repack everything,’ Slabbert cautions.
RISK COVER Before sending any staff to site, ensure air evacuation cover is in place for all company staff. Find out what vaccinations will be necessary for the trip and how long in advance these need to be administered to take full effect.
Another difficult issue that can be experienced while doing business in Africa is bribery. Many companies, including Eco Log Homes, have a zero-tolerance approach to this and have found creative ways in which to continue conducting business without having to resort to engaging in irregular activities. Slabbert says, in his experience, most bribery is concentrated at border posts making access to the destination, especially with materials, a challenge if one is not prepared to pay up. By involving the client in the local logistics of the project, the problem of bribery can be bypassed and supplier, contractor and the client can rest easy in the knowledge of having conducted business above board. Slabbert concludes, ‘While our advice for conducting business in Africa is particular to our business of timber and log construction, it can be applied to conducting any type of business in Africa. The continent and its people have so much to offer and it is a great pleasure for us to be able to make our mark, profitably, outside of South Africa’s borders. Anyone with a great business or business idea from which the African market can benefit can do much the same.’ HA

How to attract
SHOPPERS’ attention when and where it matters most A recent study suggests 70 percent of shoppers’ purchase decisions are made in-store, meaning that eye-catching and informative packaging play a large role in how shoppers’ decisions are made. hy shoppers decide to buy a particular brand or product is a question every manufacturer, marketer and retailer would love answered. We’re often told shopping is not rational and most shoppers make instant decisions subconsciously. Although many consumers research brands online before heading to the store, latest statistics by the OgilvyAction Study 2017 show that 70 percent of shoppers’ purchase decisions are actually made instore, and 28 percent of shoppers will decide which product to buy while standing in front of the shelves, even though they may have had another brand in mind before entering the retail space. The study cites as many as one in 10 shoppers will switch brands in store if your brand does not stand out or is difficult to find. A spunge for
GUNGE
Pratley, the company famous for having the only South African product on the moon, has just launched the latest addition to its range of eco-friendly clean-up products. Gunge Spunge is an exciting new spill clean-up solution.

stablished in 1948 by George “Monty” Pratley, the Pratley group of companies rests on a foundation of research and innovation. The group has filed over 350 patents worldwide. It is involved in mining and minerals analysis as well as the manufacturing and marketing of brand leading electrical and adhesive products to global markets. Pratley actively mines two minerals called Perlite and Clinoptilolite (zeolite) at a unique deposit in South Africa. The ores

are processed using exclusively developed proprietary technology to produce ecofriendly and energy-saving mineral based products for applications such as: ultralightweight concrete screeds; thermally insulating plasters; pollution control; water treatment; swimming pool or pond filtration; and farming. Interestingly, Clinoptilolite was actually used to clean up the Chernobyl, Three Mile Island and Fukushima nuclear disasters. Pratley is also famous for having the only South African product on the moon.

Are you absolutely sure
YOU’RE INSURED? Years of faithful insurance premiums can prove valueless in the absence of a Certificate of Conformity (CoC). Insurance companies will not pay if you cannot present a valid CoC when making a claim.

A
vast majority of South African citizens are moving toward the use of gas appliances due to the increasing cost of electricity and possible outages. However, most users are unaware of the specific regulations and safety standards with which they must comply when getting gas equipment installed in their households. Overlooking these regulations can be detrimental in many ways. According to the Pressure Equipment Regulations (PER), all natural gas and liquefied petroleum gas appliances and equipment should meet the specified standards to ensure safety. These regulations set out the requirements regarding the design, manufacture, operation, repair, modification, maintenance, inspection and testing of pressure equipment. In terms of the Occupational Health and Safety Act 1993, the PER also requires persons handling the installation of any gas systems to undergo specific training and to be registered

with the South African Qualification and Certification Committee – Gas (SAQCC Gas). The registered gas practitioner must issue a Certificate of Conformity for any equipment they install.
WHAT IS A COC? A Certificate of Conformity (CoC) for gas installations is a legal document, which must be obtained whenever a gas system is installed, modified or repaired and should be retained for possible future requirement. Only registered practitioners may issue a CoC and a complete list of these practitioners can be found on the SAQCC website.
COC AND INSURANCE Most people don’t know about the importance of holding a CoC for every gas installation on their properties, this includes air conditioning and refrigeration units - the importance is generally realised when it is too late. It is usual for people to get insurance cover
for their properties and assets, yet, it is a staggering truth that owners could be paying insurance premiums for years and end up receiving no cover in the occurrence of an incident or accident involving gas. Should there be no valid Certificate of Conformity, many insurance companies will not accept liability for costs of damage caused to property or assets. The loss and damage suffered by an owner/user due to a gas installation for which a valid CoC has not been issued, falls entirely on the owner. Regardless of cost of reparation, the insurance will most likely not cover it. ‘The majority of insurance companies would require this certificate to prove that the installation was safe and had been serviced regularly,’ Lanice Steward, managing director of Knight Frank Anne Porter says. Seeing a gap in the market for quality hand tools at the dawn of the 21st Century, VCP Industries has grown from strength to strength since then. 17 years later the company distributes its numerous lines beyond South Africa’s borders. VCP Industries was established in 2000 and is a family-owned business. According to Donavan Stephens of VCP Industries, the company started out on a very small scale but it didn’t take long before it realised there was a demand for its products. ‘We started to upsize and provide our customers with quality hand tools and products at the right price,’ Stephens explains. ‘VCP is where it is today because we meet the demand in the marketplace.’ VCP proudly stocks the brand Camco Quality Hand Tools, which has gained popularity and demand across the market. VCP’s agreement with Camco includes merchandising stands as well as branding material. VCP also distributes beyond South Africa’s

borders into Africa. Stephens explains that some of the challenges of tool distribution are to always be fully stocked and up to date with products that are popular in the industry. This requires keeping abreast of trends and new product launches to ensure clients have access to the latest products. In addition, VCP also makes sure its stock holding is high in order to supply all its customers on time. VCP constantly tries to improve its lines. Stephens mentions that one of VCP’s biggest challenges in distributing beyond South Africa is making sure it gets stock to its clients on time. Yet the company has managed to successfully provide clients with an excellent turnaround time from when the order is placed to when the delivery arrives. Some of VCP’s most popular lines are its cutting discs and hand tools. Stephens explains, ‘Cutting discs are a bestseller because they are a consumable that everyone needs. The reason clients buy them from VCP is that we only stock the best quality but price them affordably.
‘As for our hand tools, we started the business supplying primarily hand tools and have been supplying them for many years since then. We are committed to supplying quality hand tools so we’ve never disappointed a client.’ SO, WHAT DOES THE FUTURE HOLD FOR VCP INDUSTRIES? ‘We’re expanding our lines and have currently become a distributor of Stanley products. Studying the market and keeping up to date with the latest trends has led to the success of South African based company, Shock Proof Investments. The company has been especially adept at spotting gaps in the market and a decade ago it diversified even further to include a new company called Design & Connectors.

stablished in 2004, Shock Proof Investments was a response to a gap in the South African market for anti-split nail plates for the timber treatment industry. Since starting just six years ago, Kwikbuild Cement has become a well-known name and a formidable competitor in the cement industry. How did this relatively young company manage to become so successful and what are its plans for the future? n August 2011 the very first bag of Kwikbuild cement was produced. Since then Kwikbuild Cement has grown into a formidable competitor in the cement industry.
HOW DID KWIKBUILD DO IT? The strategy of the company’s partners has always been to re-invest in the business and as such its plant has been modified and upgraded significantly since inception. With Kwikbuild’s state-of-the-art bagging and packaging equipment, the company now has a production facility capable of producing approximately 220 000 tons of product per annum.
RANGE OF PRODUCTS Kwikbuild produces a range of products that include Kwikbuild Cement General Purpose
Cement, Kwikroad Road Stabilisation Cement, Kwiktile six hour, 12 hour, 18 hour and 24 hour tile adhesives, as well as the full supporting range of products: Kwikgrout; Kwikflex; Kwikbond; and Kwikcoat. The company also imports a gypsum based multipurpose finishing plaster from Onat Gyps in Turkey, which it calls Kwiklite. All cement products fall under the SABS specification of CEM V/A (S-V) 32.5N in accordance with SANS 50197 – 1:2013 and the Kwiklite carries the EN Standard of TS EN 13279-1-B4. As part of this huge regeneration strategy, a number of old, dilapidated high rise buildings are being completely stripped and converted into living apartments in areas such as Braamfontein, Joubert Park, Yeoville and Doornfontein.
THE CHALLENGE Marley was initially involved in the project to convert a 17-storey building from copper to Pro-fit. The success of this project led them to secure a contract for the next building to be renovated, a 29-storey behemoth that would serve over 450 living apartments.

Providing hot and cold water to the upper floors of high rise buildings like this is a fundamental requirement and the main challenge for plumbing system engineers who must consider many variables such as available municipal water pressure, flow demand, pipe and valve materials, riser locations, pressure regulating stations, not to mention economics and even acoustics.
A WINNING SYSTEM FOR HIGH-RISE BUILDINGS For the project, Pro-fit was used as part of a fusion PPR (Polypropylene Random) plastic piping system to supply water throughout the building. GREEN with environmentally-friendly paints Being environmentally-friendly has become a hot topic in recent years. People are thinking green about everything from food to clothing and now even the paint on their walls. Consumers are increasingly looking for non-toxic paints that don’t harm the environment.
W
HAT ARE NON-TOXIC PAINTS?
According to the United States Environment Protection Agency (EPA) paints and finishes are among the leading causes of indoor air pollution. Paints and finishes release low level toxic emissions into the air for years after application. The source of these toxins is a variety of volatile organic compounds (VOCs), which until recently, were essential to the performance of the paint.
WHAT ARE CONSUMERS LOOKING FOR? Consumer demand has led to the development of low-VOC and zero-VOC paints and finishes. In South Africa, most leading paint manufacturers have added an ecofriendly, low or no VOC range to their product offering. NON-TOXIC PAINT STRIPPERS Most paint strippers are caustic, they work by melting the paint. Consumers are now looking for biodegradable paint strippers, that are water-soluble and non-caustic. The active ingredient in non-caustic paint strippers is N-Methylpyrrolidone (NMP), an organic solvent. Rather than burning or melting, the compound chemically changes the paint itself, softening it for easy removal. NMP could still potentially be harmful to human health but unfortunately, the toxic effects of NMP on humans has not yet been well studied. These paint strippers are generally more expensive than their traditional counterparts and they take longer to work.
LESS TOXIC, MORE EFFICIENT PAINTING With more and more research being published on environmentally-friendly products consumers are becoming more

research-savvy. Environmentally-conscious consumers will likely scrutinise paint tin labels and product literature relating to: • VOC content – using a product with the lowest VOC content will yield the lowest overall health risk • Solids content – Solids, or pigments, can range in concentration from 25 percent to 45 percent by volume. The higher the percent solids, the less volatiles in the paint
Consumers are also going to be a lot more conscious of buying the right amount of paint for the job so that there is no unnecessary wastage. They will reuse turpentine and paint thinners for the same reason and to reduce their environmental footprint. HA
