BEFORE THE GODLY: RELIGIOUS ARBITRATION AND THE AMERICAN LEGAL SYSTEM: A HIGH HOLIDAY PROGRAM

Imagine your reaction if your case was before a U.S. court, and the judge said “I render judgment in favor of the opposing side, because that is what God wants.” You would no doubt be apoplectic. After all, the secularity of our judiciary is an essential component of that famous American project: in Thomas Jefferson’s words, the “building of a wall of separation between Church and State.” And yet, every day, U.S. courts enforce arbitration agreements and awards reached by expressly religious tribunals. Why does the American legal system tolerate faith-based arbitration? Should it continue to do so? What are the risks and benefits? Join us as attorney Shai Silverman explores the strange world of faith-based arbitration, a uniquely religious space in an otherwise secular legal landscape. Together we will also share a traditional High Holiday feast of matzo ball soup, brisket, tzimmis and honey cake. RSVP by Monday, September 11 to Rachel Ruth at 897-0143 or rachel@nojcc.org.
