Administrator contracts renewed at FISD Heaters, accounting change, copiers okayed By Roger McKenzie Freedom Public School Superintendent Danny McCuiston and his principal Brent Hill had their contracts extended through the 2013-14 school year at Monday night’s school board meeting. Hill will get a 2.5 percent raise. New heaters, a change in school accounting systems and new copiers were also approved. Encumbrances approved at the meeting included an item for $9,550 to Luckinbill, Inc., of Enid for the purchase and installation of two 200,000 BTU heaters in the ag shop building. The company will also be asked to look at and repair if possible the heater in the school’s new greenhouse. The thermostat is not working properly and some ventilation work may have to be done. McCuiston said using the new greenhouse is a priority. “It will be fixed,” he said. Board members, after hearing an explanation from the superintendent, approved his request to consolidate from three vendors to one vendor for the three accounting systems the district currently uses. The district will continue to have three accounting systems for its financial, student information and lunchroom, but starting in the next school year, they will all come from the same vendor. Currently, the district uses ADCT for its financial accounting, MAS for its student information system and K12 for its lunchroom accounting, costing about $5,700 per year. Starting in 2013-14,
the district will use MAS (Municipal Accounting Systems) for all three, at a cost of about $5,100. The move will probably save no money the first year, however, McCuiston said, since there would be some training costs. He emphasized that the switch would give the district just one vendor to deal with when problems arise, not three. Dissatisfaction with the current copiers in use by the district will be solved by changing vendors. Superintendent McCuiston said the “new” replacement copiers supplied by current vendor Dirk’s Copy Products under a contract that began in 1998 arrived with a million copies already run through them. When the current contract expires, the board approved replacing them with two new Sharp copiers from Sooner Copy Machine. The MXM453N black and white copiers will be networked and can fax and scan. McCuiston said they will allow the district to start “getting rid” of individual copiers and save money. The five year lease/purchase agreement calls for a base charge and a per copy charge and includes all supplies (except paper) and maintenance. In a typical usage month, the cost to the district would be around $351 per month. When repairs and maintenance are needed, the service person will come from Waynoka. In his monthly report, Supt. McCuiston handed out a financial position sheet to board members. Citing expenditures, income and an anticipated budget, he noted the district was in good
shape. His report listed a positive cash flow of $156,508.38, based in part on a majority of revenue having been received. He indicated, however, that the district’s $750,000 carryover from the last school year may be reduced by the end of the year. Out of about $600,000 in ad valorem taxes (with a 95 percent collection rate) just over $459,000 has already come in. The district has already received almost $700,000 from all sources through Dec. 30, 2012, out of his own estimate of $1,011,408 for his anticipated budget. He also gave a forewarning that the 2013-14 school year calendar will likely need revising. He cited increased school revenue from the state with the anticipation that the Department of Education will be requiring more instructional hours.. He said he anticipated a possible increase from the current 1080 hours of instruction to 1100 or even 1150 hours. The modification he suggested involved starting classes after the Freedom Rodeo, although he said teacher inservice could start prior to that event. Right now, starting school and then interrupting the first week of instruction with the rodeo is “disruptive for the school environment,” he said. The makeup of the new calendar will be on the agenda in the near future. McCuiston said he wanted the school board members to be thinking about it. Principal Brent Hill gave a report that noted enrollment is down from 80-77 as some students have moved to other districts. He mentioned a date conflict he is trying to resolve that will require a change in the date of the Freedom Festival from Feb. 9 to Feb. 16 or later. He listed a schedule that includes a Prom date of April 19 and graduation on May 17. Kindergarten graduation will also be held on May 23. The senior trip is set for May 25-30. He also said a book fair is in the planning stages, hopefully for sometime in March. All teachers are on schedule with their evaluations, he added. The school’s new web site is being updated and used by teachers. In other business, the board approved the consent agenda which includes minutes, activity fund expenditures and encumbrances for the General Fund and Building Fund.

Long arm of the law catches up with convicted felon By Helen Barrett Almost 20 years after his first felony charge, imprisonment and probation, Pete Ortiz, 41, finds himself behind bars again. A single felony count of failure to register as a sex offender was filed in Woods County District Court on Thursday, Jan. 24. The following day, two charges of sexual assault and sexual battery were filed in Alfalfa County involving two separate incidents in Carmen. The first charges Ortiz with sexual battery of a juvenile at her place of employment. The victim told Alfalfa County Deputy Blake Trekell that Ortiz came to the business on Jan. 20 and harassed her. On Jan. 22 Ortiz returned to the business, grabbed her, forced her into the pickup he drove, pulled her hair and kissed her on the head. The juvenile was able to pull away and attempted to return to the store. A male customer in the store confronted Ortiz and got him to leave. The victim identified Ortiz from a photo lineup of men with similar physical characteristics. After being read the Miranda warning in Woods County Jail, Ortiz admitted he couldn’t remember
what happened very well but he was sure he did talk to the girl and tried to get her in his car to smoke a cigarette. On Jan. 21 a second victim, an adult who also lives in Carmen, reported being sexually assaulted by Ortiz. The victim said Ortiz came to her house uninvited and entered the home. She told him to leave the residence. Instead of leaving, he grabbed her breast. After the victim hit Ortiz on the arm and again told him to leave, Ortiz walked out the front door to a gray, Chevy Impala and drove away. That victim also identified Ortiz from a photo lineup. Official Oklahoma On Demand Court Records reveal a lengthy list of felonies ranging from uttering bogus checks, first degree rape by instrumentation, lewd molestation and several felony DUI subsequent offences. His first charge of failure to register as a sex offender was filed in Woods County in 2004 after his conviction on sexual charges and eventual release from Department of Corrections custody in 2002. In his sworn affidavit, Deputy Adam Honeyman said he received information that Ortiz was living in the Alva area.
A new check was made with Kacey of the Sex Offender Registration Office in Oklahoma City. Kacey confirmed that Ortiz had never registered as ordered by the courts. “Well I thought I was registered,” Ortiz told the deputy during his post Miranda interview. The affidavit lists Ortiz’s criminal history as ranging from 1990 to the present charges. Deputy Honeyman requested Ortiz be charged as “after three or more previous felony convictions.” Ortiz is currently in the Woods County Jail on $50,000 bail.

Peggy Constien, superintendent of Waynoka Schools, announces resignation By Alex Cole During a special meeting held Tuesday by the board of education at Waynoka Public Schools, Superintendent Peggy Constien announced that she will be resigning at the end of June. Constien had this to say about her decision: “I was greeted with open arms when I joined the Waynoka community in 2011. Waynoka has an outstanding school system, and I have thoroughly
enjoyed working with the staff, students and parents. I have fond memories of my time spent in Waynoka and will continue my friendships with many people. This was not an easy decision, but I want what is best for our kids in school. I am not retiring, but at this time in my life it is time to move on.” Discussion regarding school safety also took place during the meeting, and Principal Michael Meriwether spoke
on the subject. He said that the school will be practicing lockdown drills where students and teachers stay in their classrooms and then slide a green card under the door to signal that they are unharmed. These drills are carried out to ensure the school’s staff and students remain as safe as possible if a dangerous situation arises.

Just after 10 a.m. Monday, the Freightliner, driven by Steven Buxton, 51, of Woodward, was traveling west in the outside lane of Oklahoma Blvd. and following a 2013 Chevrolet pickup driven by William Lansdown, 54, of Alva. The large belly-dump truck went partly off the roadway, striking the rear bumper of Lansdown’s pickup. The truck continued westbound off the roadway, striking two light poles, a telephone pole and a 2007 Honda four-wheeler owned by Gary Lehl. The Freightliner continued west, striking the residence at 130 E. Oklahoma Blvd. Buxton, driver of the truck, was transported by Alva EMS to Share Medical Center and then transferred to OU Trauma Center by Air Evac. He was listed in stable condition when admitted. Lansdown was not injured. All four lanes of traffic were closed along Oklahoma Blvd. while officers investigated the scene. The police department was assisted by Woods County Sheriff’s Department, Alva Fire and Rescue, Alva EMS, Oklahoma Highway Patrol, Oklahoma Department of Transportation and Alva Street Department.

tian Church in Alva. To their marriage two children Nancy and Lee, were born. Shortly after celebrating their 70th wedding anniversary, Dean passed away on Nov. 3, 2009. A few years after their marriage they were able to purchase a farm from John Francis, who wanted to retire and move to Waynoka. The farm they purchased had been homesteaded by Charles B. Byxbee who, in March 1906, received a land patent from Theodore Roosevelt. They lived in this early day farm house for twenty one years and then built a new house in 1964 that they still own. Marvel was a member of the Rose Valley Home Demonstration Club serving in all of the offices while a member. She managed the Rose Valley School Lunch program for several years. She also worked in the Dietary Department of the Waynoka Nursing Home serving as manager for many years. Over the years she was active in many areas of the church. She especially enjoyed the women’s fellowship group, W.O.L.F., and attending vacation Bible school for seniors. Mrs. Bixler was preceded in death by her parents; a sister, Esther Reiman; four brothers, John Parker, Harold
Parker, Robert Parker and Raymond Parker. Marvel is survived by a daughter, Nancy Bixler, of San Antonio, Texas; a son, Lee, and his wife Lyndia of Edmond, three grandchildren and their spouses, Todd and Josephine of Los Angeles, Traci and Joe Kreger of Edmond, and Tim Bixler of Copper Mountain, Colo.; four great grandchildren, Caroline and Landon Kreger of Edmond and Madeline and Dean Bixler of Los Angeles, California, a sister, Patsy and her husband Bob Wharton of Alva, a brother and his wife Virgil and Lydia Parker of Avard; and a number of nieces, nephews, other relatives and friends. Memorial contributions may be made in her memory to the First Baptist Church of Waynoka.

Ellis, was born July 15, 1929, at Waynoka and passed away Jan. 28 at his home in Alva at the age of 83 years, six months and 13 days. Bob attended several schools before graduating from high school in Phoenix, Ariz. He served a tour of duty in Korea with the United States Army where he received three purple hearts and three bronze service stars. He was united in marriage to Billie Dean Sherrill at Blackwell. They lived in Blackwell before moving to Alva in 1965. He was well known as a good salesman and entrepreneur. He actually opened the Toot-N-Tell, the first convenience store in Alva. Bob was a member of the Alva First Baptist Church and a Charter Member of the Alva Moose Lodge. He was an avid fan of the Oklahoma State University Cowboys and the Dallas Cowboys. He was probably best known for his roping skills in the rodeo and his rope tricks. He taught many young cowboys to rope. He also taught his daughter, Kim, to be an excellent barrel racer. Bob is survived by two sons, Mike Ellis of Tulsa and Rob Ellis of Chickasha; three daughters, Susan Anderson and husband Larry of Ponca City, Sher-

Gladstone “Stoney” Merritt Evans Jr. was born on July 9, 1950, to Gladstone and Bernadine Evans in Queens, N.Y., and passed from this life on Jan. 22, 2013, at Bass Hospital. As a child he was a mem-
ber for the St. Mary’s Episcopal Church in Amityville where he was confirmed at age 10. He graduated from Amityville Memorial High School in 1968. After completing high school he attended Farmersdale University until drafted into the United States Marine Corps in 1969 where he served as a office clerk while stationed in Quantico, Va. In November 1960 he met and married Shirley Heard and to this union three daughters were born. After his tour of duty was complete he and Shirley moved to New Jersey where he worked as a social worker from 1972-1973 and then became a New Jersey police officer from 1973 to 1978. He later moved to California where he worked with his brother Garrett in the printer graphics field. He then went on to drive a bus for the city of San Jose where he met Adalina “Lina” Vierra in October of 1982. After meeting Adalina, a romance occurred, they then moved to Oregon to chase their dreams and from this they were blessed with four children. In 1993 he and Lina moved to Oklahoma to be caregivers to her father. In 1999 he and Lina united in marriage. He later See Obits Page 31

became a member of the First Christian Church in Cherokee where he was a deacon. In February of 2012 he was diagnosed with lung cancer to which he fought a noble fight. Until his health failed he was a handyman for Marian Goodwin and he also drove a semi for Basic Energy. He was preceded in death by his parents. Left to cherish his memory are his wife Lina; daughters Tonya Reese (Steve), Retta Evans (Brian), Shandi Evans (Darrell), Geena Evans and Giana Evans; sons Michael Evans and Gladstone Evans III; one sister, Jana Johnson (Keitn); two brothers, Garrett Evans (Marilyn) and Lee Isabell (Pam); eleven grandchildren; so many adopted children and a host of other relatives and friends. She is survived by three daughters: Charlotte (Tom) McAnally of Nashville, Tenn., Carolyn (John) Westcote of Colchester, Conn., and Cathy (Wesley) Johnson of Cimarron, Kans.; five grandchildren; and eleven great-grandchildren. Mrs. McDaniel resided most of her adult life in Oklahoma where her husband was a United Methodist minister and farmer. Together they served United Methodist churches in Freedom, West Union, Lookout, Mutual, Kenton, Martha, Thomas, Yewed and Prairie Valley near Cherokee, Fairview and Catesby near Laverne, and Wapanucka. She had a special interest in music and evangelism. Following her husband’s death in 1982, Mrs. McDaniel continued to reside for seven years in Alva. In 1989 she moved to Nashville to be near her daughter and family. She was a member of Calvary United Methodist Church in
Nashville where a memorial service will be held at 11 a.m. Saturday, Feb. 2. Visitation with the family will be Thursday, Jan. 31, from 1p.m. to 2 p.m. at Alva First United Methodist Church. A private graveside service will be held at the Alva Municipal Cemetery. Dean Warren Spencer, son of the late Ray Newton and Mary Elizabeth (Dupy) Spencer, was born July 29, 1928, in Waynoka and passed away Jan. 25 in Enid at the age of 84 years, five months, and 27 days. Dean was preceded in death by his parents. He is survived by one son and one daughter.

January 18, 2013 10:08 a.m. Burglary at 3 miles north, 2 miles east of Amorita, send TTY to all and to Barber/Harper Co in Kansas. 3:30 p.m. Keys locked in car at 300 block of Maple in Jet, vehicle is under a shelter, advised to have one of the deputies in office go since elderly lady, deputy advised he would take care of it. 4:20 p.m. Truck running off road on Highway 64 headed east towards Jet, white truck travelling fast, running off road to pass vehicles, advised deputy, he could not catch the truck. 5:07 p.m. Disagreement in Nescatunga, respondent wanted to talk to a deputy, advised his soon to be ex-wife is throwing people off the property that he told could be there, his friend is removing items that respondent asked him to take out so he would not have to deal with her, deputy is calling the wife and advised her the man has permission to be on the property from one of the land owners. 5:18 p.m. Tearing up items at 300 block of N. Fifth in Carmen, respondent advised that an individual broke his phone and kicked the bottom of his storm door out, plus she was throwing items out of his pickup, she is in the house tearing it up he thinks, he is at her sister’s house, two deputies advised and en route, another deputy advised he was en route also, he was already in Carmen, deputy advised weapons are at the site, deputy with one white female starting mileage to another resident, deputy with prisoner in custody one white male starting mileage. 6:48 p.m. Pickup parked wrong at Fifth and Main in Carmen, blue Dodge is parked next to a fire hydrant and in the wrong direction, other cars are almost hitting it, advised deputy, they already knew about it and will take care of it. 5:20 p.m. Horses out 2 miles south and 2 miles east of McWillie, respondent wanted to know how long before someone could take possession of horses running wild, started checking to see if anyone knew who they belonged to, individual advised they were not his but he had them on his wheat since Nov. And no one was going to sell them unless it was him, they broke the fence and took off again, deputy advised he was investigating the situation and would get back with me, individual advised respondent told him he would like to put them in a pen and break them, individual advised that is fine but if they were going to be sold most of the money was

Fourth in Carmen. 12:59 p.m. Possible overdose in Jet, respondent advised that individual is overdosing, he has taken 10 trazadone and a full bottle of some kind of bi-polar medication, she needed an ambulance and first responders, advised Jet first responders and Helena Ambulance, deputy advised he is following subject out of the house and down the back alley, trooper advised he is en route to assist, deputy has subject back at house to be checked out, deputy advised that EMS is taking him to St Mary’s to have him checked out. 6:30 p.m. Two horses out at Cherokee sale barn, ACSO advised CPD to call individual, he deals with all the sale barn animals. 6:52 p.m. Cattle out in Cherokee, respondent said some of his cattle got out so if anyone calls cattle in on E. Fifth they are his and he would like for an officer to go to the FFA barn so he can use their spotlights to see if he can find his cattle, advised CPD. 7:30 p.m. Medical call to 700 block of W. Walnut in Carmen, respondent said that individual was at his house and she needed an ambulance, advised deputy and Helena Amb, respondent called back wanting to know where the officer was and the ambulance, individual had taken some meds and they are starting to kick in, deputy and Helena en route, advised Carmen Fire and Rescue, deputy advised to call OHP and that Helena is en route to St Mary’s. January 27, 2013 9:00 a.m. Medical call to Nescatunga, man on rig hurt his back and they need an ambulance immediately, they were advised not to move him at all, white truck will wait on them in Nescatunga to take to oil site, advised CPD. 12:01 p.m. Problem in Helena, respondent advised there was an older man with a few problems and he was wanting deputy to assist to get the man home to Goltry, deputy advised and en route, advised deputy to take no further action, reservist assisting Helena.
