A stench over trash service in Medicine Lodge By Yvonne Miller When a letter to the editor came to the Newsgram from Medicine Lodge, Kan., resident Jean Kimball, it prompted some research into the subject of trash service in that city. After the Newsgram spoke to people with opposing views, Medicine Lodge City Administrator Austin Gilley said Kimball’s letter was to be included in the council’s meeting packet Monday night. As of April 1, the City of Medicine Lodge will provide a new curbside recycling and trash service that will be operated by Nisley Brothers, Inc., of

Hutchinson, Kan. That information was in a letter sent out to all city customers. Administrator Gilley said residential trash rates were $21.65 per month and will reduce to $21 with Nisley. Medicine Lodge Mayor Bob Stutler gave some background on the subject. He said getting a private company to contract with the city for trash service has been discussed for about two years. A public forum was held on the subject Jan. 30. On Feb. 4, the council approved Ordinance No. 866, which approves Nisley’s contract with the city and was signed February 18. Gilley said when the city let bids for the trash service the only two private companies who responded were Waste Connection and Nisley. Stutler said that over 20 years ago it was agreed that any resident who was hooked up to city water service also paid a trash service fee. “That concept is nothing new,” the mayor said, adding that most municipalities operate with that policy. The mayor said the trash truck needed to be replaced and “the council voted not to go further into debt,” so did not purchase another trash truck. Also, it was a good time since a city employee who runs the trash truck was retiring. “We’ve (the council) reduced our

debt by $124,000, lowered property tax and balanced the budget and seen a budget surplus the past two years. We reversed a six-year trend of deficit spending,” Mayor Stutler said. He added this council brought the water and sewer system into compliance. Kimball Speaks for the Opposition As those reading Kimball’s letter will see, she opposes the city’s move for numerous reasons – many based on her belief they violate constitutional rights. “So many people in town thought it was about recycling. It’s about more than that,” Kimball said. If the city is no longer in the trash business, she questions why council should force Medicine Lodge residents (taxpayers) to use a specific trash service that is “for-profit,” and the city bill customers for that company. Kimball continued, “It’s not right to take a service that belongs to taxpayers and then mandate taxpayers to buy from a specific company.” Kimball added, “It boils down to the city telling you what we have to buy, who we have to buy it from and how much we have to pay.” Kimball said although there was a petition taken to city council with 395 names, “it died.” She said the council See Stench Page 14

Three longtime educators retire at Burlington School Burlington School receives Governor’s Ace Award By Yvonne Miller Some classrooms and the gym sideline at Burlington Public School will have a different look next fall as some longtime educators retire. The retirements of Diana Feely, Ragina Knedler and Randy Turney (coaching duties only) were accepted by the Burlington School Board at their March meeting last Thursday evening. President Terry Graham presided over the two-and-a-half-hour meeting with all members present, including Beth Guffy, Allison Armbruster, Aaron Smith and Roger Allen. Others present were Superintendent Glen Elliott, Principal Shane Feely and Minutes Clerk Jan Hill. For 20 years Knedler taught vocal/ band at Burlington. The board commended Knedler for her “excellent work with the music program the last 20 years.” The board thanked first grade teacher Dianna Feely for her many years of getting so many students off to a good start in their school careers. Turney will continue in his role as junior high math and history teacher. After taking the Elks boys basketball team to the state tournament this season as Area, Regional and District Champions and having the 600th win of his basketball coaching career mid-season, Turney decided it’s time to retire as a coach. The Elks ended their season at

the state quarterfinals with a record of 23-8. The board thanked Turney for his many years of a successful coaching career throughout the state, 16 of which were at Burlington. Awards for Burlington School Elliott congratulated the Burlington High School (BHS) Elks boys basketball team for winning the Class B State Academic Championship award for the fourth consecutive year. Elliott also commended the school for receiving the Governor’s Ace Award. The Governor’s Ace Award was given to school districts in which 100 percent of the seniors of the Class of 2012 met all graduation requirements, including Achieving Classroom Excellence (ACE). ACE was enacted in 2005 under Gov. Brad Henry and requires that high school seniors, beginning with the Class of 2012, prove proficiency on four of seven end-of-instruction exams before graduation. Gov. Mary Fallin and other dignitaries presented the Governor’s Ace Award to 188 school districts at a celebratory luncheon March 4 at the Oklahoma History Center. Oklahoma has 520 public school districts, of which 425 are independent school districts. More Burlington School Board Business Durham Surveying Inc. was approved to do the survey for the new

band building. Burgess Engineering and Testing, Inc. was approved to do the boring tests for the new band room. Valerie Vetter, Alfalfa County treasurer and Burlington School treasurer, attended the meeting to discuss interest rates and answer questions from the board. The board met in executive session 50 minutes before returning to open session to accept the retirements of the teachers listed above. Cheerleading sponsor Vanessa Garvie requested and received board approval to reduce the number of high school cheerleaders from six to five. The board approved continuation of teacher evaluations with the TLE for 2013-2014; encumbrances, change orders and warrants for the general, building, child nutrition and transportation bond funds; the February Activity Fund report; the ongoing vocational program for 2013-2014; and Charles Carroll for auditing of 2012-2013 fiscal fund and budget preparation for 2013-2014. Principal Feely was approved as a second signature with Jan Hill on Activity Fund expenditures for 20122013. The board discussed the 2013-14 school calendar and took no action. The superintendent reported on the upcoming new school board member workshop in Tulsa May 3-4 and the OSSBA District 2 meeting at Woodward April 18. Principal Feely Tells of Student Achievements Feely told of many student successes, including the successful end to the basketball season, the livestock shows, music contests and academic meets. Spring Break is ongoing this week March 18-22. Easter Break will be Friday, March 29, and Monday, April 1. After Easter Break upcoming events include the Seiling Music Contest for grades four through six, State Vocal and Instrumental, Prom, FFA convention and Tri-State Music Festival as well as state testing. Wessels to celebrate their From Page 6 th 60 wedding anniversary Burlington

Gerald and Ila Wessels, 1953

Ila Marlatt, originally from Ashley, and Gerald Wessels of Cherokee were married at the First Christian Church, March 21, 1953. Shortly after their marriage, Gerald (known as Chub by all his friends and relatives) served in the army being stationed most of the time in Germany. After leaving the service, the Wessels went back to live on the family homeplace 3 ½ miles west of Cherokee where they presently live. Gerald and Ila spent their whole lives in farming. Ila raised African violets and is known across Northwest Oklahoma for her sewing business. To their union five children were born. They are: Gerald and Teresa Wessels of Senoia, Ga.; David and Tina Wessels of Cherokee; Everett Wessels of Cherokee; Ado and Teresa Wessels of Derby, Kan.; and Marla and Mike Klassen of Ponca City. Gerald and Ila have eleven grandchildren and eleven greatgrandchildren. A come-and-go reception will be held at their home on Saturday, March 23. This event will be hosted by their children and grandchildren in celebration of 60 wonderful years of marriage.

The BHS Lady Elks ended their season as Area-Consolation Runners-up with a 25-6 record. Tiffany Rieger was named OGBCA All-State. Track season will begin. The junior high Academic Triads will finish up in April with a home triad including Ringwood and Timberlake. Feely said they’ve received new laptops (45) and two charging carts. The principal said they’ve ordered 25 new nexus tablets that will be used from grades PreK-3. Burlington’s RSA plan was approved by the state department and Feely said they’ll revise for next year beginning in April.

She also disagrees that a resident must pay for both water and trash service. If the resident doesn’t pay the trash portion, their water would be disconnected. Water reconnect fees are $50 the first time, $100 the second time and more thereafter, she said. Kimball said people on a fixed income can’t afford extra charges. Working for the city as clerk just over 10 years and as administrator a year and a half, Kimball said the city had saved for a partially automated trash truck. She said the truck the current council considered was fully automated and more expensive. Kimball also said she would like to know what other companies the city sent information to when requesting bids on the project. The following is the letter written by Jean Kimball; Open letter to Mayor Stutler and members of the Medicine Lodge City Council By Jean Kimball The difference between business in the private sector and business in the public sector is this: private enterprises are generally conducted by an individual, partnership or corporation, and expressly strive to make a profit whereas public enterprises are owned and operated by taxpayers in order to provide

services to their constituents and are non-profit. Thomas Jefferson said that “the greatest danger to American freedom is a government that ignores the Constitution.” Each of you took an oath to uphold the Constitution of the United States and the Constitution of the State of Kansas, which were written in order to guarantee each individual the right to life, liberty and the pursuit of happiness. Right now, I am concerned that you have taken away even more of our liberty. Liberty, as described by Webster’s dictionary, is the quality or state of being free and it includes the freedom of choice. If you haven’t already figured it out, I am referring to the recently adopted Ordinance #866, the accompanying Franchise and Contract agreement with the Nisly Brothers, and the various codified ordinances relating to provision of and charges for city utilities. In these documents, you require all water customers (that is, all residents) inside the city limits to also subscribe to the city trash service, you state that the trash service will be billed on the city’s utility statement and any bill that is not paid in full will be considered unpaid and the water service will be terminated. You have increased reconnect fees to the point that no one can afford them, and now you have given the Nisly Brothers exclusive right to provide trash pickup service in Medicine Lodge. You state that an individual can haul their own trash to the landfill if they want but will still have to pay the trash fee billed by the City on behalf of Nisly Brothers . It probably did not occur to any of you that the ordinances you have adopted promote coercion and blackmail of Medicine Lodge citizens, plain and simple. To coerce is to “1. dominate by nullifying individual will, 2. to compel to an act or choice, or 3. to enforce by force or threat.” Blackmail is “extortion by use of … threats.” Either we pay Nisly Brothers a monthly fee or we have our water disconnected. So another of our Constitutional rights is threatened; the right to life. When did our city government become a dictatorship? I realize the federal government is leaning more and more toward this mode of operation but does the government of Medicine

Lodge have to lead the way? You may think the mandate is no big deal because for the last 30 or so years, water customers have been required to use the city’s trash collection service. I was not happy when that ordinance was passed either but I accepted it because it was for the common good. The council had to make it mandatory that everyone participate so they could be assured of enough revenue to pay for the packer truck. It was a public service owned and operated by the public and for the public. That is quite different from mandating that everyone within the city limits of Medicine Lodge must purchase trash pickup service from a specific private for-profit company. Even President Obama stopped short of telling us what company we had to buy our health insurance from or how much we have to pay for it. I wonder how many other businesses in and around the area would like to have our City mandate that its citizens must patronize them and then go so far as to act as their collection agency. I expect there are quite a few. It puzzles me as to why the Council felt that Nisly Brothers even needed such a guarantee. After all, they have been doing business in Barber County for years and I know of no exclusivity or mandate imposed by the county to bolster their business. On the same note, why is this franchise any different from the telephone franchises (there are two), the electric or gas or cable franchises. I don’t believe that any of them are exclusive or mandated. Please understand, I am not knocking Nisly Brothers. Of the three options presented to the people, this was the obvious choice, financially. I just want the right to decide for myself whether I will purchase their service and I want other individuals or companies who wish to provide trash pickup services in Medicine Lodge to have the opportunity to do so. Let them compete for my business. In closing, if the city is getting out of the trash business, then let the city get completely out of the trash business. Let free enterprise prevail. Collect a franchise fee and a license fee if you must but be sure the proceeds are designated for repairing the damage to our streets from the packer trucks.

New fire truck coming to Helena Fire Department By Alex Cole The Helena Fire Department is implementing a plan to purchase a new fire truck. Alfalfa County Clerk Laneta Unruh said the department was interested in a certain truck, but it was sold. Therefore, they have decided to explore new truck options during the weekend. Another approved item on the

agenda regarded the disposal of a large amount of equipment. A total of nine radios were junked. Many pieces of machinery were sold, including a Peterbilt semi, a backhoe, a loader, three trailers, three graders, an excavator and two tractors. Also approved were minutes from the commissioners’ previous meeting,

M&O warrants for payment, blanket purchase orders and the monthly report. Fourteen road crossing permit requests were approved by the commissioners. District 1 had 10 permits, totaling $8,750. District 2 had three permits, totaling $1,500. District 3 had only one permit, costing $750. The sum of all accepted permits was $11,000.

Darrell was a devoted farmer and loved the outdoors. He always had a kind and compassionate word for everyone and was always ready to tell the good news of Jesus, whether through teaching Bible classes or personal Bible study. He was a member of the Amorita Church of Christ and the Burlington Church of Christ. He served on the Byron-Amorita Cemetery Board, the USDA Community ASC Committee and was a Burlington FFA honorary chapter member. He is survived by two sons, Rick Hankey and wife Beverly of Amorita; Dale Hankey and wife Patty of Burlington; and three grandchildren, Lindsey Callison and husband Kyle of Byron, Seth Hankey of Amorita, and Trevor Hankey of Burlington. He is also survived by two sisters, Rowena Grigg and Janet McCafferty, and a host of friends and family. Those who preceded him in death were his wife Verla Hankey, his brother Ray Dean Hankey and his parents. Memorials may be made to the Lariat Creek Christian Camp, c/o Lanman Funeral Home, 1305 S. Grand, Cherokee, OK 73728.

Church and Midway Sunday School class. He served as chairman of the deacons for two years before becoming an elder. Lawrence was an unofficial greeter who was at the church door most Sundays. He was also a member of the IOOF Lodge and the American Legion. Surviving are his brother Richard Highfill and wife Rachel of Enid, several nieces, nephews and friends. In addition to his wife he was preceded in death by his parents; two brothers, Wyatt and Robert Highfill; one sister, Clara Hill; two nephews, Armon Herbert Hill III and Richard Earl Highfill; and special friend Juanita Wessels. Memorials may be given in his memory to either the Christian Church Youth Group or the Cherokee Senior Citizens Center through Goodwin Funeral Home.

Obituaries DARRELL D. HANKEY Funeral service for Darrell D. Hankey of Amorita will be Thursday, March 21 at 10 a.m., at the Riverside Church of Christ in Burlington. Ray Hull of Waynoka and Jeffrey Keele of Burlington will officiate. Burial will be in the Byron-Amorita Cemetery under the direction of Lanman Funeral Home, Inc., of Cherokee. Viewing will be Wednesday from 10 a.m. until 5 p.m. Remembrances may be shared at www.lanmanmemorials.com. Darrell was born Aug. 9, 1932, and departed this life to be with his Lord on March 17, 2013. He was born and raised on the family farm northeast of Amorita to Floyd and Bertha Alexander Hankey. Darrell attended school at Amorita, graduating in 1950. On Nov. 14, 1953, he married Verla Smith at her parents’ home northeast of Amorita. They were united in marriage by Minister Hartsell Johnson. In 1953 Darrell was drafted into the service and left for the army on Dec. 1, 1953, which was Verla’s birthday. In May 1954, after high school graduation, she joined Darrell in Fairbanks, Alaska, where they spent their next year of marriage. In August 1955, when Rick was six weeks old, they returned from Alaska to the Amorita area to help with her dad’s farming operation. In August 1957, shortly after Darrell was dismissed from the army, Dale was born in Cherokee. Darrell lived and farmed northeast of Amorita until his retirement. In November 2011 he decided to reside at the Kiowa District Manor in Kiowa, Kan. Darrell enjoyed his time at the manor and was a wonderful friend to all the residents and staff.

LAWRENCE EARL HIGHFILL Funeral services for Lawrence Earl Highfill, 87, will be at 2 p.m. on Wednesday, March 20, at the Cherokee First Christian Church with the Rev. Tom Stanley officiating. Military honors by the U. S Navy Funeral Honors Team will be given at the church. Burial will follow in the Cherokee Municipal Cemetery under the direction of Goodwin Funeral Home of Cherokee. Lawrence was born Feb. 11, 1926, in Lambert to Charles Ellsworth and Lily Pfeifer Highfill and passed away Thursday, March 14, 2013 at the Cherokee Manor. He grew up in the Lambert community and graduated from Lambert High School in 1944. He was inducted into the U. S. Navy on June 19, 1944. He was awarded the purple heart for wounds received in action on Jan. 12, 1945, and was honorable discharged Nov. 21, 1945. He returned to Cherokee where he worked at John Hay Conoco Station and later for Alfalfa County District 2, retiring in 1988. He and Lucille Hay were married on Nov. 19, 1952, at Cherokee. She preceded him in death on June 27, 1988. He was a member of the Christian

Doris Marie, was born June 5, 1927 in Waynoka, Oklahoma. She passed away March 15, 2013 in Oklahoma City. Her dad worked on the railroad and therefore traveled and moved. Doris graduated from High School in Wellington, Kansas, another railroad center. In 1946, Doris was a new high school graduate, and Max Joachims was recently discharged from the US Navy. They met each other at an amusement park in Denver named Elich Gardens. Although Max was a native of Dacoma, Oklahoma, they had never met each other before that night. Doris married Max on October 2, 1946. They lived for a short time in Dacoma with Grandma Joachims and then moved into their first house in Alva. See Obits Page 30

Obits

Due to the social norms of the day, Doris was a stay-at-home housewife and mother. Over the years, she participated in many church and charitable capacities, and wound up traveling many miles in the Northwestern, Oklahoma, plains to attend meetings of all types to support those groups of which she was a member and/or an officer. During her life, Doris had a wide variety of interesting experiences. She worked at the Montgomery Ward office in Alva for over a year…a position she had never held before, and which she worked at while she was pregnant with her third child. She helped with the books at the Shalloup’s Packing Plant, and for awhile was the main bookkeeper. Many nights she was busy finding one penny or twenty-seven cents in order to balance the books and go home. Her year on the federal grand jury was note worthy, especially considering she didn’t even know how to put gas in the car before then. She served for twelve months on the Grand

Jury, making the trip to downtown Oklahoma City and back by herself on the back roads, and staying in a hotel room for one week or more each time. She lived in a number of houses, not just the first house, in Alva, all of their married lives, and actually built their own home near the high school and the swimming pool when their third child was five years old. In March of 2011, Doris moved to Oklahoma City and moved into an apartment at Quail Ridge Assisted Living. Over the next two years, she made a number of new friends who gradually became familiar with her style of dry wit which one staff member called “a funny kind of cranky.” She seemed to be at her happiest when she could engage someone in a friendly war of words where she steadfastly refused to smile. Therefore, her nickname, to some at least, was “Smiley.” Doris passed away at the age of 39, having been that age for a very long time. She was preceded in death by her husband Max; three siblings, Nadine, Jean-

nie and Lonnie. Doris is survived by, Brian Joachims, Norman, Oklahoma, Janice Sheffield, Fullerton, California, Gary Joachims, Edmond, Oklahoma, Billie Miles, Denver, Colorado, Brent, Bradley, Craig, Julie, Sandra, Christine, and David, Andrew, Timothy, Jennifer, CJ, Anthony, Sawyer, and Enrique. DORIS SIMMS PAUL Doris Simms Paul, 88, of Chandler, Ariz., passed away on March 8. She was born in Eureka, Kan., on Dec. 15, 1924, to Orion Orme Simms and Lucille Mitchell Simms. Doris married the love of her life, John Paul, in 1944 and they were married 66 years before John’s death in 2011. Doris is survived by two sons, one daughter, seven grandchildren, two great grandchildren, other family and friends. In lieu of flowers the family request donations be made to the Hospice of the Valley.

The Cherokee High School speech and debate team took first place sweepstakes at the 3A-and-under Northwest Regional Tournament this past weekend. Team debaters Whitney Cloyd, Hayden Clem and Josh Argraves led the Chiefs with a first place finish in Cross-Examination debate, while Drew Hoggard and Jakota West placed second in the same event. Freshman Shelby Bender landed second place in Lincoln-Douglas debate

with senior Connor McGee showing third in Lincoln-Douglas. Freshmen Avery Bagenstos and Nick Cochran secured second place in Dramatic Duet and third place in Humorous Duet. Fellow freshmen, Savanna Eshleman and Grant Wilber, took second and third respectively in Domestic Extemporaneous Speaking. Other Chiefs qualifying for the State Tournament in mid-April include Colby Locke and Austin James in Standard Oratory. James also qualified his Prose for State. Cochran will take Humorous Interpretation, making three events the freshman will take to State next month. The State Tournament will be April 11-13 on the campus of the University of Oklahoma.
