Semi driver injured trying to avoid deer By Marione Martin A semi driver coming upon several deer in the road swerved to avoid a collision. Instead he ended up in an overturned vehicle. The wreck occurred Sunday morning at 6:45 a.m. in Alfalfa County 2 miles east of Burlington on SH-11. According to an Oklahoma Highway Patrol report, Richard Leroy Manley, 58, of Fowler, Kan., was driving a 2007 Peterbilt truck west on SH-11

when he swerved left to avoid striking three or four deer in the roadway. The semi departed the roadway to the left for 434 feet and then came back onto the surface of the roadway causing the vehicle to overturn on the driver’s side. The vehicle then slid into the south ditch where it came to rest. Manley was transported by Alfalfa County EMS to Share Medical Center in Alva and then airlifted to St. Francis Hospital in Wichita, Kan., where he

was admitted for trunk internal and arm injuries and listed in stable condition. The semi was carrying cattle, which escaped following the wreck. One deputy from Alfalfa County was injured during the cattle round-up. He was treated at Share Medical Center and released. Trooper Jonathan Cotner investigated the wreck, assisted by Trooper Gene Goodson and the Alfalfa County Sheriff’s Office.

Man charged with possession of meth By Marione Martin Someone reported reckless driving in the early morning hours of Sunday, Nov. 17, heading into Cherokee. According to documents on file, Cherokee Police Officer Christopher Horstman went to the south end of town but did not see the vehicle. He asked Alfalfa County dispatch to contact the reporting party. Shortly after, he was told the vehicle had turned off on Ohio. Horstman drove north on Ohio and saw a vehicle matching the description parked crooked in the parking lot at the Chaparral Apartments on Cherokee Street. He passed the still running vehicle to check the tag and found it matched the one reported. He drove up the road and parked to observe the vehicle. Horstman said he saw a man come from the apartments, approach the vehicle and then walk away. Soon after two men approached the vehicle and went back into the apartments. passenger got out and went to the suspect vehicle then returned and the vehicle left. The suspect vehicle attempted to back up and drive away but almost hit a parked car so Horstman pulled in behind it. The officer saw a woman walking from the apartment toward the vehicle who turned around and walked back inside as he pulled up. When Horstman walked up to the vehicle he saw a female passenger messing with something in the backseat. The driver was extremely nervous. The driver gave Horstman an ID card but said he did not have a driver’s license. He was identified as John Cornelius Smith, 30. His passenger was identified as Laura Kay Elizabeth Stamper. Horstman asked each of the two if there was any illegal substance in the vehicle, and both said there was not. Stamper said the vehicle belonged to her

brother. She gave permission for Horstman to search the vehicle. Horstman found a bag tucked under the front seat containing five bags. One of the bags had three small bags of a crystallike substance that field tested positive for methamphetamine. Horstman placed Smith and Stamper under arrest and called Police Chief Minson for backup. They continued the search, finding a marijuana grinder, a pack of ZigZags, a single razor blade, more bags containing little baggies, six cell phones, two digital scales, and a tattoo set including a tattoo gun. Smith took full responsibility for the items including the meth, paraphernalia and tattoo set. Stamper was released, and the vehicle was towed. Smith has been charged with unlawful possession of controlled dangerous substance, a felony.

By Marione Martin A truck driver was apparently reluctant to return a truck to his employer after being fired. He is now facing charges in Alfalfa County. According to court records, on Sept. 16 Alfalfa County Reserve Deputy Sheriff TJ Rockenbaugh said he was assisting a business in Byron involving the termination of one of their truck drivers, Kenny Johnson, 50. Rockenbaugh told the sheriff’s office that Johnson refused to give back the semi he had been driving until he received compensation for his work. The owner, Susan Holland, had agreed to pay Johnson when he turned in his tickets so they knew how much to pay him. Rocken-

baugh said Johnson then told him he misplaced the keys to the truck. Rockenbaugh logged the description of the truck, a black Kenworth with a Minnesota license and a belly dump trailer. On Sept. 17 about 7:20 a.m. an employee, Jesse Johnson, notified Rockenbaugh that the truck was missing along with Johnson. Rockenbaugh contacted Alfalfa County Deputy Sheriff Blake Trekell who talked to Jesse Johnson. He said the owner was in another state on harvest. She had called and fired Kenny Johnson with Jesse Johnson and another employee present. They were able to obtain some of the company property from Kenny Johnson

in Perkins, but the next morning, Sept. 17, they found the truck and Kenny missing. Several attempts were made to contact Kenny but all calls went to voice mail. Jesse Johnson found the tracking device from the truck nearby on the ground. Around 2 p.m. Kenny Johnson contacted one of the parties and said he left the truck parked south of Perkins on Highway 177 with some construction equipment. A deputy from Payne County located the truck and removed the keys until the owners were able to retrieve it. Kenny Johnson has been charged with unauthorized use of a motor vehicle, a felony, and a warrant has been issued for his arrest.

Familiarize yourself with lottery laws

By Lynn L. Martin I walked into a local store last week and noticed that they had a “sales promotion” that would likely constitute an illegal lottery. I thought about saying something to the owner, but didn’t. Now, I can’t even remember which store. It might be helpful to review Oklahoma law on the topic. If you don’t want to read further, just understand that an individual or a merchant in Oklahoma cannot start their own lottery. The legal test defining a lottery has three elements: prize, chance and consideration (some form of payment.) Merchants can give FREE tickets for a drawing, but those tickets cannot be tied to a purchase. Here’s an example of something not free. If a restaurant has a sign that says, “Drop your cash-register receipt for your meal into the box, and we’ll later draw a winner for a free meal.” That is illegal because money had to be paid (the first meal) in order to participate. On the other hand, if the sign said, “Feel free to register on this blank piece of paper and drop it in the box for a chance for a free meal,” this would be okay, if it were available to all people who walked in off the street and did not

require any kind of purchase. You might wonder why a newspaper publisher is giving legal advise on this topic. It is because we go to conventions where we are told it is illegal for a newspaper (or any other advertising organization) to sell ads for an illegal lottery. We can be fined or go to jail just as quickly as the outfit hosting the lottery. In 2010, the Oklahoma legislature loosened the laws on lotteries ... except for individuals and merchants. This has produced a lot of local lotteries and it is easy to see why a merchant or an individual could be lulled into breaking the law because everybody seems to be doing lotteries. The law was loosened so Chambers of Commerce and Community Chests on military bases might conduct a lottery. Also, the following can conduct local lotteries (following is a cut and paste of the Oklahoma law): (1) a church, (2) a public or private school accredited by the State Department of Education or registered by the State Board of Education for purposes of participating in federal programs, (3) a student group or organization affiliated with a public or private school qualified pursuant to division (2) of this subparagraph, (4) a parent-teacher association or organization affiliated with a public or private school qualified pursuant to division (2) of this subparagraph,

(5) fire departments, (6) police departments, (7) organizations that are exempt from taxation pursuant to the provisions of subsection (c) of Section 501 of the United States Internal Revenue Code, as amended, 26 U.S.C., Section 501(c) et seq., or (8) an “organization” as such term is defined in paragraph 20 of Section 402 of Title 3A of the Oklahoma Statutes. (see included wording following this section.*) Finally here is the section of the law that says don’t do it. Title 21: Section 1053 – Penalty for Preparing Any Lottery Any person who contrives, prepares, sets up, proposes or draws any lottery shall be guilty of a felony punishable by a fine equal to double the amount of the whole sum or value for which such lottery was made, and if such amount cannot be ascertained, then by imprisonment in the State Penitentiary not exceeding two (2) years or by imprisonment in a county jail not exceeding one (1) year, or by a fine of Two Thousand Five Hundred Dollars ($2,500.00), or by both such fine and imprisonment. b. Any raffle conducted by a qualified organization shall be conducted by members of the qualified organization without compensation to any member. The organization shall not hire or contract with any person or business association, corporation, partnership, limited partnership or limited liability company to conduct a raffle, to sell raffle tickets or to solicit contributions in connection with a raffle on behalf of the organization. Here’s the part about newspapers or advertising firms: Title 21: Section 1056 – Advertising or Publishing Lottery – Misdemeanor Every person who, by writing or printing, by circulars or letters, or in any other way advertises or publishes any account of any lottery stating when or where the same is to be or has been drawn, or what are the prizes or any of them therein, or the price of a ticket or of any share or interest or where it may be obtained, or in any way aiding or assisting the same, or adapted to induce persons to adventure therein, is guilty of a misdemeanor.

She was president of Household Executives, secretary of the Tulip Garden Club, member of the 20th Century Club, member of Ladies of the Moose organization, and member of the Democratic Party of Woods County. In addition, she served on a committee for the Oklahoma Cooperative Extension Service. Johnette coordinated many blood drives for the Methodist church. Johnette was preceded in death by her parents and brother Harold. She is survived by her husband Rex, son Scott, brother Edward Scribner and his wife Claudia of Oklahoma City and James Scribner of Alva, brother-in-law Steve Beagley and wife Carolyn, granddaughters Brandy and Allyson, and many other relatives and friends. In lieu of flowers donations may be made to the Alva First United Methodist Church.

Katherine French Johnson, daughter of the late Gradus and Bessie Johnson, was born May 14, 1927, near Granite and passed away Nov. 25, 2013, at Alva at the age of 86 years, 6 months and 11 days. She was baptized at Granite Church of Christ and graduated from Granite High School, attended Harding College, graduated cum laude from Southwestern State College in Weatherford with a BS in education and Southeastern State College in Durant with a MS in education, NTE certification. She started teaching in 1966 and taught in Altus, Rattan and Mid-Del schools retiring in 1986. On April 17, 1949, she was united in marriage to Doyle Wendell Boyd in Granite. To this union were born four children: Doyle Mark, John Pat, Kevin French and Keron Kay. She lived and worshiped in Granite, Sayre, Medford, Vinita, Moore, Seiling, Clinton, Cordell, Altus, Del City, Antlers and Oklahoma City where Doyle passed in 1976. On Sept. 4, 1993, she was united in marriage to James Howard Scott and lived in Del City and Palm Springs, Calif., and traveled extensively until his death on Oct. 25, 2002. She moved to Alva in September 2008, and lived a healthy and independent life and was active in church, fam-

Johnette was raised in Alva and graduated from Alva High School with the class of 1966. Miss Scribner married Rex Beagley on Feb. 19, 1966, and resided in Alva with their son Scott. She graduated from Northwestern Oklahoma State University in 1970 and attended medical technology school at Mercy Hospital in Oklahoma City where she and Rex moved following graduation. She worked as a registered medical technologist in Oklahoma City and in 1985 she and her husband opened Mustang Parts of Oklahoma. They retired in 2008 and returned to Alva to farm and ranch. He worked at Ritter’s Body Shop for 32 years where he worked as a painter until his retirement in 2010. He enjoyed painting and fishing, and loved to work in his yard and on his home. He loved spending time with his grandkids. He was preceded in death by his parents, Norman “Hopper” and Ruby Perks; his brother, Bobby Joe Perks; and his brother-in-law, Bud Swallow. Richard is survived by his wife Debbie of Alva; four children, Ricky Russell and wife Brandi of Cherokee, Dana Price and husband Doug of Freedom, Bobby Nichols and wife Carolyn of Alva, and Shelly Bridgewater and husband Ross

Pastime Inc. is holding a ball to raise funds to restore the indoor theatre in Medicine Lodge, Kan. What better way to get things rolling on than to have a Christmas Country Ball? The Nov. 30 event featuring the Aaron Taffas Band will be at the Heritage Center, Highway 160 East, Medicine Lodge, Kan. Come show off your two-step from 8 p.m. to 9 p.m. while listening to oldies and then kick up your heels with Aaron from 9 p.m. to midnight. Four decorated Christmas trees, each with its own theme – K-State, KU, old fashioned and fishing/hunting – will be auctioned off. Other smaller items will also be auctioned off at a silent auction held during the Christmas Country Ball. Some of the items are $1,000 off a complete kitchen remodel, $500 off a complete bathroom remodel, smoked hams and turkeys, yard art, Christmas wreaths (real) and more. Hors d’oeuvres will

By Lynn L. Martin The Alfalfa County commissioners accepted a recommendation from Dusty Bittle to solicit bids for seven air-conditioning units for the fairgrounds project. Eight heating/air-conditioning units will have to be moved to accommodate the construction. Seven of the eight are over 40 years old and the recommendation was that it would be unwise to re-install the aging units. The commissioners all agreed that modern units will be much more efficient and will likely reduce the sizable power bill at the fairgrounds, Alfalfa Electric Cooperative provided a quote of about $9,400 apiece. Specifications will be determined and the bids will be due for opening on Dec. 9. The commissioners also approved soliciting bids for pickup trucks for each district. Specs will be determined later. The commissioners accepted a bid of $232,097 for a John Deere loader. Hobby Lobby Get to know the Waynoka FFA secretary founder applauds Supreme Court review By Colton Budy Maria Wilcox is the 2013-2014 secretary for the Waynoka FFA chapter. She is the granddaughter of Bill and Marilyn Beatty. She has two brothers: Tyerell and Timothy. She is active in basketball, FCCLA, FCA and FFA. After high school she plans to attend college at Northwestern Oklahoma State University and major in business management. Wicox has been a member of FFA for four years. She has participated in the food science and technology team and given speeches. Some of her goals for FFA this year are to acquire more members and have more members participate in more FFA activities.

OKLAHOMA CITY (AP) — The founder of Hobby Lobby says he is encouraged that the U.S. Supreme Court has decided to take up the company’s lawsuit over the new health care law’s provision on insurance for contraceptives. The U.S. Supreme Court said Tuesday that it would hear arguments from the Oklahoma City-based company as well as a Pennsylvania company. The for-profit companies say they should not have to cover contraceptives that violate their religious beliefs. The court said the cases will be combined for arguments, probably in late March. A decision should come by late June. Hobby Lobby founder David Green says that business owners should not have to choose between violating their faith and violating the law. Attorney General Scott Pruitt says called the Supreme Court review “a victory” for Hobby Lobby.
