BLT’s ‘The Foreigner’ opens last weekend of February in Kiowa By Yvonne Miller All the hype and anticipation for Border Line Theatre’s production of “The Foreigner” is causing a surge of ticket sales. So much, in fact, the opening night dinner theatre performance Saturday, Feb. 28, sold out as of Monday. The good news for you is there are three other performances of this comedy you can attend at the Kiowa Community Building. If you want to attend the last dinner theatre performance which is Saturday, March 7, call Shirts and More in Kiowa, Kansas, today at 620-8254074. The meal is a fire-grilled filet of beef with salad, baked potato, signature green beans, bread and the BLT traditional favorite chocolate layer dessert. John David was born August 12, 1942 in Wichita Kansas, to Edith Allison (Blunk) and James B. Hendrix. He passed away on February 23, 2015 in Alva at the age of 72 year, 6 months, and 11 days. He attended school in Hardtner, Kansas and graduated with the class of 1960. From there John joined the Air Force leaving in 1964 and attended Wichita State University. In 1976 he graduated from Hutchinson Community College with an AA degree in fire science. On January 21, 1989 in Las Vegas, Nevada, he married Marsha Nuss. The combined family included three sons, James and Justin Hendrix and Kenton Nuss. Following their marriage they made their home in Hutchinson, Kansas, where John was Fire Marshall (investigating causes and origin of fires), Chief Fire Instructor at Hutchinson Community College. He retired in 1991. He began working as a private investigator for Clarence M. Kelley Associates of Kansas until his death. John and Marsha moved to Alva in 1999 to make their home. He had a love of cars and motor cycles and a special love of animals, family, friends and children. “Corky” was a member of the American Legion Riders, and served several terms as President of Kansas State Fire Fighters Association. John is survived by his wife, Marsha of the home, three sons, and their families, James of Hutchinson, Kansas and Justin of San Carlos, California and Kenton of Overland Park, Kansas, two special sons, Greg and James Smith, eight grandchildren, other relatives and

JAMES ‘JIM’ ALBERT HERREN James “Jim” Albert Herren, 88, of Arkansas City, Kansas, passed away Friday, February 20, 2015, at his sons residence. Funeral services have been scheduled for 2 p.m. Saturday, February 28, 2015, at the First Assembly of God Church in Arkansas City. Pastor James Newman and Pastor Babe Standerfer will officiate. Burial will follow in the Parker Cemetery. Friends may greet the family 6-8 p.m. Friday evening at the Rindt-Erdman Funeral Home. Jim was born October 18, 1926, to Albert and Mary May (Kirby) Herren in Ingersoll, Oklahoma. He was reared and educated in Byron where he graduated from Byron High School in 1946. On April 10, 1949, Jim married Mary Rowland in Alva. The couple made their home in Arkansas City since 1953. Jim worked for Santa Fe Railroad, Boeing, Rodeo Meats, and Binney & Smith as an electrician until his retirement in 1992. Jim had a passion for wood carving, building small machines, working on old tractors, and he enjoyed working out at the Rec Center. He was a member of the First Assembly of God Church, a member of Wood Carvers of Ark City, and a member of the Wood Turners Association. Survivors include his wife Mary of the home, children Bonnie Allen and husband Lewis; David Herren and wife Diane all of Arkansas City, Kansas; sisters Grace Terwort of Alva, Claretta Wheeler of California; and numerous grandchildren, great-grandchildren, nieces, and nephews. Jim was preceded in death by his parents, his daughter Linda, brothers Evertt, Amos, Ralph, Alvin, Sylvester, and sisters Goldie and Ruby. Principal Feely rehired by Burlington school board T.J. Rockenbach takes board seat; Lady Elks Regional Champs, advance to area tournament Friday; Elks advance to area tourney in consolation bracket Thursday By Yvonne Miller Burlington’s board of education reemployed Principal Shane Feely for the 2015-16 school year. Board members thanked Feely for all his hard work the past year. This was at the board’s monthly meeting the morning of Feb. 17. Board President Terry Graham called the meeting to order with new board member T.J. Rockenbach at the table for the first time. Alfalfa County Judge Loren Angle attended the meeting to administer the oath of office to Rockenbach. Other board members present were: Allison Armbruster, Roger Allen and Aaron Smith. Superintendent Glen Elliott, Principal Feely and minutes clerk Tamre Bohn also attended. The board held election of officers with Graham remaining as president, Aaron Smith elected vice-president and Allison Armbruster voted in as clerk. The vote on Principal Feely came after a 20-minute executive session. During that session, the board also discussed certified personnel with no vote to be taken upon return to open session. After another nearly 40-minute executive session to discuss acquisition of real estate and future building projects, the board took no action. Lady Elks and Elks Play in Area Thursday, Friday

Thursday and Friday the Burlington High School (BHS) Elks basketball teams and their fans will travel to Stroud to play in the Area Basketball Tournament. The Elks were runners-up at the Regional Basketball Tournament. Coached by Ken Jones, the Elks lost by only two heartbreaking points in the finals against Cimarron. So the BHS boys go to Area through the consolation bracket. They play Paden Thursday at 3 p.m. The Elks are 16-12 on the season. The Lady Elks are Regional Champions after easily overtaking Varnum 69-34 in the finals. Coached by Kirsten Pruett, the Lady Elks are 25-3. Friday at 6:30 p.m., they play Lomega at the Area Tournament. Burlington School Board Action Regarding the school teacherage at 510 Sixth St., the board voted to declare it surplus property to be demolished and leveled with bids to be taken and specifics to be worked out at a later date. Now that the new music/safe room is complete, the board declared the old cellar on the school playground to be demolished, filled and leveled. The board still has to get bids and work out specifics. The board approved the following encumbrances, change orders and warrants: • General fund encumbrances:

$95,583.11, change orders: $120.02, warrants: $223,173.20. • Building fund warrants: $124.25. • Child nutrition fund warrants: $6,222.07. Items receiving board approval were: the January Activity report, renewed participation in the Cooperative Education project for the 2015/16 school year, continuing the contract with Municipal Accounting Systems (MAS) for the 2015-16 school year, the contract for audit of the 2014/15 fiscal year to be conducted during the 2015/16 fiscal year from the firm of Chas. W. Carroll P.A., adopting the resolution “For the People – A Vision for Oklahoma Public Education.” Billy Joe Thomasy of Thomasy Electric in Cherokee gave a report on current and future electrical work regarding the wiring and electrical fixtures throughout the buildings and work to be done in the auditorium. For the work in the auditorium, he said a lift will be rented and the cost shared with the contractor doing the ceiling tile work. The board approved the extra expenses to be incurred for these projects. The proposed school calendar for the 2015/2016 school year was discussed, but no action taken. Jan Hill, who has been available as a financial accounting consultant to Burlington Public School, gave her notice terminating the service effective Feb. 15. Superintendent Elliott reported on the busy, upcoming stock show season. The Alfalfa County Stock was Feb. 16-18. The NW District Stock Show is March 4-9.The Oklahoma City Stock Show is March 13-22. The superintendent also reported the OSSBA District 2 meeting is Thursday, April 23, at 6:30 p.m. in Shattuck. He said new member Rockenbach will attend one of two New School Board Member Workshops, either on Friday, March 6, in Tulsa or Saturday, May 2, in

New doctor attends first Kiowa Hospital board meeting January busy month for hospital/clinic; New nursing situation reducing agency nursing expense; Talk of rural visioning program; Manor Dog Show Thursday, 10 a.m. By Yvonne Miller When the Kiowa District Hospital statistics were given, it showed that in January Dr. Paul Wilhelm saw 421 patients himself in the clinic. Needless to say, he smiled when Christie Leal, D.O., was introduced at the February board meeting. She began working at the hospital/clinic in early February. The Kiowa Hospital Board met last Thursday evening for their monthly February meeting. Board president Zack Odell called the meeting to order with members attending: Jim Parker, Chantae Simpson, Brenna May and Lori Schrock who was skyped in by computer. Hospital CEO Margaret Grismer also sat at the board table. CFO Janell Goodno attended as did Hospital/ Manor Director of Nurses (DON) Heidi Courson and Manor Administrator Kim Balding and a few members of the public. Hospital and Manor January Financials, Statistics and Comments As CFO Goodno presented statistics and financials, she said January was “a very good month” for the hospital/ clinic. The hospital had 19 total admissions for 68 total days of acute and swingbed care. Total outpatient visits were 626, which is more than any January in the past decade. The hospital’s operating statement showed net patient revenue of $334,434. Goodno noted that some expenses in January were one time for the year, such as malpractice insurance for both doctors. Insurance premiums were $15,010 in January and are typically in the $6,000 range. Total operating expenses were $429,991. That made a net loss from operations of $94,535. However, the addition of $95,333 tax revenue and other small sources of income such as memorial, rental, etc., showed the hospital in the black by $2,296 for January.

Goodno said the comparative balance sheets for the hospital and manor show the district is to receive $483,856 uncollected taxes in June. She said the district was in a “payable status” of $100,000 to Medicare on the January balance sheet. That status fluctuates monthly based on number of patients and services provided. Goodno told the board as expected accounts receivable rose some in January to $773,831. Less allowances for bad debt, the total net patient accounts receivable was $414,727. The manor’s patient census for January was 22. The manor’s net patient revenue was $113,354.Total operating revenue was $115,088. The Manor’s total operating expenses were $129,605 for a net loss from operations of $14,517. The addition of mainly tax revenue reduced the loss to $9,401. Agency nursing expense at the manor was reduced to $3,201. Last January agency cost was $12,032. Board member Simpson said to those employees responsible for the reduction, “Agency is looking good. We appreciate your efforts.” DON Courson said, “The nursing situation is going well.” For January, with the hospital in the black and the manor in the red, the result in an overall loss of $7,106 for the district. Total cash on hand in all funds is $680,925. Regarding the manor, Administrator Balding thanked the community for their help with an ongoing revitalization project to replace tile, painting, etc. She said they are trying to refurbish flower beds and some residents have ideas of what they’d like to see. Any donations for bulbs or helping plant is appreciated, Balding said. The manor plans a dog show Thursday at 10, with residents as the judges. Anyone wanting to enter can do so as long as they provide the dog’s shot records.

Balding said they had a revisit from the state surveyor. “We were cleared of all deficiencies. It was all paperwork,” she said. Other Hospital Board Business The board and Leal are working out details of the lease to her of the hospital-owned residence. The lease will be from March 1 to Feb. 28, 2016. The board approved payment of life/disability insurance on Wilhelm as chief of medical staff. The cost is $3,300. Board members again discussed their intention to research the process to have hospital board members elected in a municipal election like school board and city council. Odell said the board has the authority to change the bylaws to change the election process. The board directed CEO Grismer to research the process for them. This change will be in time for the 2016 election. The hospital’s board member election process will remain the same this year at the hospital’s annual board meeting in May. Simpson said after numerous conversations she’s had, “Making the election municipal is favored by the public.” Regarding the hospital yard, Schrock mentioned the need for someone to bail the Bermuda grass. The board plans to ask someone. Following an executive session at the end of the meeting, the board approved the monthly quality assurance report for the hospital. CEO Grismer Comments on Ambulance Service and Rural Visioning CEO Grismer said she and some other reps from KDH and the Medicine Lodge Memorial Hospital met with the Barber County commissioners regarding ambulance service billing. Because of the Affordable Care Act, ambulance service billing is now different. The discussion is how

According to court documents, on Thursday night, Feb. 12, Alfalfa County Deputy Alpha Lathrom was patrolling southbound on Highway 8 when he saw a gray Nissan Exterra traveling northbound. A radar check showed the vehicle traveling 75 mph in a 65 mph zone so Lathrom made a traffic stop. When Lathrom spoke to the driver, Traven Tisdale, and his two passengers, he detected smoke with an odor associated with marijuana coming from inside the vehicle. He also observed Tisdale had ashes on his pants and shirt. He obtained the identities of the passengers, Corrie Gholson in the front and Charles Garner in the back. Lathrom separated the three occupants and talked to each independently. Tisdale said they had

traveled to Enid and were returning home to Cherokee. He said no drugs had been present and refused to give a reason for the strong odor of marijuana. Gohlson also professed no knowledge of marijuana. However, Garner said they had been in possession of marijuana earlier that evening but they had smoked all of it and had none left. At that point, Lathrom detained both men in handcuffs. He patted down all three and found a needle containing remnants of a clear substance in Tisdale’s right front pocket. With this presence of paraphernalia, Lathrom approached the front driver’s side of the vehicle. He noticed a silver metallic cylinder that had been left in the driver’s seat. He opened it and found white crystal rocks and powder. He performed field tests that showed the presence of methamphetamine. Lathrom contacted dispatch and requested assistance, specifically a

supervisor. Cherokee Police Officer Chris Horstman, Alfalfa County Undersheriff Glenn Oister and Alfalfa County Sheriff Rick Wallace responded to assist in the search and detention. Horstman found a red and black knapsack in the rear seat which contained an open and partially consumed container of vodka and another hypodermic needle containing remnants of a clear fluid. Gholson said the knapsack belonged to Garner. Lathrom found two sets of brass knuckles and a large knife in the center console. A diamond ring with a sales receipt was also found in a bag. Tisdale said the ring belonged to the owner of the vehicle. The ring was seized for safekeeping. Tisdale, Gholson and Garner were placed under arrest and taken to the Alfalfa County Jail. Traven Michael Tisdale, 21, of Cherokee; Corrie Lynn Gholson, 20, of Cherokee; and Charles Jamel Garner, 23, of Cherokee have each been charged with felony possession of a controlled dangerous substance (CDS) and a misdemeanor of unlawful possession of paraphernalia.

Three charged with drug distribution By Marione Martin Three men were arrested on drug charges after Cherokee Police Chief Mike Andrews made a traffic stop. According to court documents, on Feb. 20 at 8:50 p.m. Chief Andrews saw a Ford pickup that had no visible tag light and an unreadable license plate. The pickup displayed no turn signals as it turned into a residence on 5th between Ohio and Oklahoma in Cherokee. Andrews initiated a traffic stop. Andrews learned the driver was Jim Stevenson with Bradford Prophet and Roger Moore as passengers in the front seat. While interviewing Prophet, Andrews asked if there were illicit substances in the vehicle and he said no. Since the vehicle was packed full of tools, trash and miscellaneous items, Andrews asked permission to search it. Prophet refused. Believing he had seen a pill bottle in the glove compartment when Prophet had retrieved the insurance form, Andrews asked him to open it again. When he did, a film container

within spilled over revealing a green leafy substance consistent with the appearance of marijuana. Andrews asked Prophet to hand it to him which he did. Inside Andrews found scrapings and a large bud with an odor of marijuana. He had the pickup occupants exit the vehicle and interviewed them separately. Cherokee Police Officer Chris Horstman arrived to assist. The two officers searched the vehicle areas accessible to the occupants. Beneath the seat they found two baggies of a green leafy substance, three pill containers holding a total of 43 pills, six unused hypodermic needles, several unused small baggies, four used pipes and a working set of digital scales. In Moore’s wallet they found four small baggies with the remnants of a white powdery substance. Chief Andrews field tested the green leafy substance which showed positive for THC (marijuana). The white powdery substance field tested positive for methamphetamine. The pills were

Goss inducted in to the auctioneers’ hall of fame On Friday, Feb. 6, the 2015 OSAA Winter Meeting kicked off with the annual competitions. This is where men and women alike compete for the opportunity to represent Oklahoma, not only at a state level, but also at the National Auctioneer Champion Contest held July 14-18, 2015, in

Addison, Texas. This year, Robert (Bob) Goss, of Carmen was inducted into the OSAA Hall of Fame. Bob Goss’s father, Robert Goss, founded Goss Real Estate and Auction in 1947. Bob Goss worked as a ringman for his father in the livestock auction business in the

1950’s. He attended Missouri Auction School in 1983, and joined his father in the auction business as a full time auctioneer. Goss Auctions specializes in real estate, personal property and farm equipment. His father was inducted into the OSAA Hall of Fame in 1993.

Timberlake FCCLA promotes a healthy lifestyle Timberlake FCCLA members believe to ensure a healthy future for our children is involvement. This year, Timberlake FCCLA members wanted to get involved in these efforts. They decided to initiate First Lady Michelle Obama’s “Let’s Move” program in their community and encourage students and their families to commit to living healthier lives. “Let’s Move” directly relates to the national FCCLA families first goal of meeting the challenge to overcome obstacles together. As FCCLA members, they were concerned about the students and families in the community and their knowledge to keep fit and stay healthy. Members took the information they have learned in their FACS I (Family and Consumer Sciences I) classes and developed programs in their school and community to help educate them on the necessities of staying healthy

in their busy everyday lives. Additionally, FLLCA members set up a booth “Just Dance” at the school carnival, sponsoring a glow run for all ages and families, and spoke about the necessity of eating right and getting plenty of exercise. They have also recorded a public service announcement for a local radio station reaching hundreds in the area. Research shows that families that eat meals together reap long-term benefits that feed the body, mind, and spirit. During FCCLA week, February 8-13, they invited a chef to show them how to prepare inexpensive healthy meals to share with their families, held a healthy snack day, and held Taco Tuesday to raise money for the Share Our Strength No Kid Hungry national organization whose main focus is to end childhood hunger in America. Oklahoma House passes measure banning texting and driving By Tim Talley OKLAHOMA CITY (AP) — The Oklahoma House on Tuesday overwhelmingly approved restrictions on texting while driving, despite concerns among the measure's strongest supporters that they don't go far enough. House members voted 96-2 for the bill, sending it to the Senate for debate and a vote. A similar bill is already pending on the Senate floor. The bill by Rep. Terry O'Donnell, R-Tulsa, would make Oklahoma the 45th state in the nation to place restrictions on texting while driving. The measure would make texting and driving a secondary traffic violation, meaning police officers would have to initiate a traffic stop for some other offense before the driver could be ticketed for texting and driving. Supporters welcomed the measure

but said texting while driving needs to be a primary traffic offense in which a law enforcement officer can initiate a traffic stop, similar to speeding and running a stop sign. "It's the best of a bad choice," said Rep. Cory Williams, D-Stillwater. Williams and other lawmakers questioned why lawmakers would not support a stronger texting and driving measure. "This bill does not empower our law enforcement officers to save one life," said Democratic Leader Scott Inman, D-Oklahoma City, who debated against the bill but voted for it. Inman said it makes no sense for a law enforcement officer to have to wait for an inattentive driver to cause a collision before he can write a ticket for testing while driving. "That has got to change. We have got to get with the times," Inman said.

O'Donnell said he was asked to author the legislation by law enforcement organizations. "They want this legislation," O'Donnell said. "It's a distraction that is at epidemic proportions in this state." The measure marks the second consecutive year O'Donnell has authored legislation to ban texting while driving in the state. Last year, a similar bill died on the House floor. A 2009 study on cellphones and distracted driving by the Virginia Tech Transportation Institute found that text messaging increased the risk of a crash or near-crash by 23 times over a driver who wasn't distracted. The National Highway Traffic Safety Administration reports that 3,328 people were killed nationwide in distraction-related crashes in 2012 and that an estimated 421,000 people were injured in crashes involving a distracted driver — a 9 percent increase from the estimated 387,000 injured in 2011. O'Donnell's bill would prohibit operating a motor vehicle while texting, emailing or using instant messaging on an electronic device while the vehicle is in motion. Texting would be allowed when a vehicle is stopped at a traffic light or railroad crossing, or for other reasons. Lawmakers adopted an amendment that names the measure after Oklahoma Highway Patrol Trooper Nicholas Dees, who was killed on Jan. 31 when a vehicle crashed into him and another trooper near the scene of a traffic accident on Interstate 40.

Kansas earthquakes worsen damage to century-old courthouse ANTHONY, Kan. (AP) — Harper County officials are grappling with how to fix a century-old courthouse that was already deteriorating before a sharp increase in earthquakes began rattling south-central Kansas. The bill just to repair the 107-year-old stairways has increased from $400,000 to $1.1 million and an insurance adjuster also has found cracks in the interior of the courthouse in Anthony. County officials attribute some of the damage to age but say the problems have worsened since the increased earthquakes began in 2013, The Hutchinson News reported (http://bit.ly/1BM6vLT ). "We think possibly some of it could be from the earthquakes," County Clerk Cheryl Adelhardt said. "We have seen

the splits and cracks get larger." The Kansas Geological Survey had recorded more than 200 earthquakes in Kansas since Jan. 1, 2013. More than 100 were recorded in Harper County, most with a 3.0 magnitude. While some environmental groups have blamed the outbreak of earthquakes on hydraulic fracturing, or fracking, used to extract oil and gas in the region, state officials are still studying the question. Rex Buchanan, interim director of the Kansas Geological Survey, testified before a Kansas House committee in January that a "working hypothesis" suggests a link between the earthquakes and the practice of injecting wastewater into underground wells, which is used in several mining processes, including hydraulic

fracturing, also known as fracking. Two bills addressing the problem have been introduced in the House Energy and Environment Committee. One enacts new regulations on drilling and wastewater disposal, while the other imposes a moratorium on fracking until drillers form a pool to pay for damages from the practice. The committee has not had a hearing on either bill and has until noon Wednesday to move the bills forward. County Commissioner Carla Pence said officials met with Kansas Corporation Commissioner Pat Apple last week to discuss the damage from the earthquakes. Apple said the KCC is working on the problem but did not have a timetable to suggest possible solutions, Pence said.

OKLAHOMA CITY (AP) — A bill allowing parents to receive cash subsidies from the state to send their children to private schools has cleared a Senate committee despite bipartisan opposition. The Senate Finance Committee voted 8-6 on Tuesday for the bill that is fiercely opposed by education groups, including those representing school boards, administrators and teachers. Republican Sen. Clark Jolley

of Edmond says his bill encourages school choice and wouldn't affect property tax revenue to schools. But it does allow 80 percent of the state-aid allocation for each child to be withheld from the local district and instead be paid to the parents in the form of a debit card. The bill now goes to the full Senate. A similar bill failed earlier this month in a House committee.

KDH can help with the billing for the southern part of Barber County. Grismer also told the board about being contacted by Via Christi in Wichita regarding rural visioning. She said Kansas has the largest number of critical access (CA) hospitals in the nation. Of 127 hospitals in Kansas, 84 are CA, she said, which is one of the highest percentages in the nation. Grismer said the idea of rural visioning is “encouraging everyone to be a part of an alliance or affiliated” groups. KDH is currently affiliated with Pratt Regional. Grismer said Via Christi wants to start a health network with a CA hospital. She said Via Christi is interested in Kiowa being a beta site in this trial program because of the 90 mile distance. This would involve “virtual care” so while a doctor in Kiowa is seeing a patient, through a camera’s eye, a specialist from a Wichita hospital could be in on the consultation. Grismer told the board there would be many questions about costs, reliability of equipment, etc. There are many things to consider. “What are our fears or hesitations,” to forming a telehealth program, Grismer said. – The next regular meeting of the Kiowa Hospital Board is Wednesday, March 25, at 7 p.m. The board set the April meeting for Monday, April 27.

Lawyer: HIV assault ruling could end all such military cases By Roxana Hegeman WICHITA, Kan. (AP) The highest U.S. military court's reversal of a Kansas airman's aggravated assault conviction for exposing multiple sex partners to HIV at swinger parties in Wichita will effectively end such prosecutions in the armed forces, his attorney said. The U.S. Court of Appeals for the Armed Forces unanimously ruled Monday that prosecutors failed to prove that any of David Gutierrez's acts were likely to transmit HIV to his partners. That decision overturns a 25-year precedent that had allowed military personnel to be convicted of aggravated assault solely on the basis of a positive HIV test, attorney Kevin McDermott said Tuesday. Gutierrez was not accused of infecting anyone with HIV. The Associated Press sent an email to prosecutors seeking comment. The court upheld a lesser conviction of assault by battery for offensive touching to which his sexual partners did not provide meaningful informed consent. It also upheld his conviction for adultery, even though his wife participated with him in the swinger lifestyle. The court said his wife's participation is "immaterial to the question" of whether the government presented sufficient evidence to sustain the conviction. Gutierrez was a sergeant at McConnell Air Force Base in Wichita in 2011 when he was stripped of his rank and sentenced to eight years behind bars. At the time, Gutierrez was found guilty of the aggravated assault charge, as well as of violating an order to notify partners about his HIV status and to use condoms. He was also convicted of indecent acts and adultery.

The appeals court on Monday upheld the lower court's decision on the other charges and sent the case back to the lower court to reassess his sentence. The airman, who has been imprisoned since his arrest in August 2010, could be released from Fort Leavenworth prison within the next couple of weeks, McDermott said. Gutierrez could still be issued a bad conduct discharge, rather than the more severe dishonorable discharge that he had previously faced. In his appeal, Gutierrez challenged whether the risk to his sexual partners was high enough to constitute aggravated assault. Defense lawyers argued the risk of infection by an HIV-positive man during sexual intercourse with a woman ranged from a 1-in-10,000 to 1-in-100,000 chance per sexual encounter, which they contend is so low that it doesn't meet the legal standard for assault. Prosecutors countered that the exposure risk was closer to 1 in 500. The court concluded that even if the risk were 1 in 500, transmission of the disease was not "likely" to occur. McDermott said in a statement late Monday that the ruling "effectively ended the prosecution of cases in the military that allege the likelihood of grievous injury merely upon the diagnosis that a service member has been diagnosed with Human Immunodeficiency Virus (HIV) and who engages in intercourse without their partner's knowledge of HIV determination." "It's not just a technicality," he told The Associated Press Tuesday. "They actually overturned two prior court precedents that supported these prosecutions."

Barber Junior High Tornadoes Boys Basketball Team are runners-up of the Heart of the Plains League Obviously results were unknown at Tournament. The boys went into the final game of the league tournament held at Attica with a record of 14-1. Playing Pretty Prairie, the Tornadoes lost 24-35, only their second loss of the season. FFA Advisor Travis Bradshaw hosted Burlington’s local stock show. He said elementary students participated with a coloring page competition. Bradshaw said the new ag equipment is almost completely installed in the new shop. The junior high basketball teams finished their seasons with the boys 10-2 and the girls 6-6. Principal Feely said they hosted a first person presentation of the life of Abe Lincoln, performed by Lee Williams. A Civil War reenactor (Sam Jerome) will come to Burlington and bring Civil War uniforms, weapons, etc. during the second week of March. Feely said Mrs. Newman will be testing a new online math and reading diagnostic program called Study Island. She will serve as administrator of the program and help to train other teachers for use next year.

When a man’s wife is dying, he belongs with her, not ... not in Georgia.” He begs Froggy, “Please. Try to understand. I can’t … talk to anyone now.” To help his friend, Froggy leads everyone at the lodge to believe that

This leads to the hilarious storyline when poor Charlie learns more about these folks at the lodge than he would ever want to which results in pure craziness sure to have the crowd with tears of laughter streaming down their cheeks. This small cast is a group of Border Line Theatre veterans who each play their part to the hilt. Alfalfa County sheriff’s log February 14, 2015 2:50 p.m. Information, respondent said that the dirt is blowing so bad you can’t see the highway, people are stopping on U.S. Highway 64 and County Road 550 in the construction area, advised Oklahoma Highway Patrol (OHP) and deputy, deputy was busy, OHP advised that there was nothing they could do. February 16, 2015 5:57 a.m. Accident, seriousness unknown, Woods County called and advised of an accident on U.S. Highway 64 six miles east of Alva, person is off in the ditch, possible chest and leg injuries, Woods sent their ambulance, requesting to send our officer, deputy and OHP advised, Woods called, they are at U.S.

the Plum Blossom Farm near Lookout to William and Annie McDaniel Knabe and passed from this life at the Cherokee Manor on February 22, 2015 from cancer. She attended school at the Moundridge School and high school at Freedom. Marty married Bethel Lee Myers at Medicine Lodge, Kansas on January 29, 1947. They lived in California and Alva, Oklahoma before moving to Cherokee in 1957. Marty worked as a waitress at various restaurants and later as a bookkeeper for the Home Appliance Store for twelve years. She served as Director/ Librarian at the Cherokee City and County Library and resigned in 1997. She was a member of the Business and Professional Women, Alfalfa County Democrat Women, the Salt Plains Bowling Association, the Alfalfa County Historical Society and charter member of the Salty Sam’s Camping Club. She volunteered at the Senior Citizens Site, Alfalfa County Museum, Cherokee Main Street/Chamber of Commerce and Friends of the Library. Marty was preceded in death by

her husband, Bethel Lee Myers in 2012; her parents; sister, Viola Knabe; brother, Gilbert Knabe; granddaughter, Shay Leah Myers and daughter-in-law, Trina Kay Myers. Marty leaves to mourn, her three sons and their wives, Monty Myers and wife, Dottie of Fresno, California, Jack Myers of Cherokee, Randy Myers and wife, Mary C. of Las Vegas, Nevada; three grandchildren, Kimmy Myers Dotterer and husband, Tim of Norman, Amber Beth Myers Smith and husband, Aaron of Ponca City and Greg Myers of Elk City; two step grandchildren, John Greggs and Ning and Jamie Jones of Fresno, California; three great grandchildren, Tate Christopher Davis and Nickson James Davis of Norman and Ethan Ray Smith of Ponca City; eight step great grandchildren, Jimmy Greggs, Timothy Greggs, Brittney Greggs, Trinity Jordan, Kayla Rapp, David Ray Rapp, Addison Rapp and Ivan Bousana, all of Fresno, California. In lieu of flowers, memorials may be made to the Riverside Church of Christ or Friends of the Library in Cherokee.
