“Micheál Martin’s comments are another reminder that there is very little in policy difference between Fine Gael and Fianna Fáil. They both tried to peddle the myth that quality public services can be somehow delivered while hacking away at the country’s tax base.

“Last year Fianna Fáil candidates stood on an election platform that would have supposedly cut €2.64bn of the USC. “My party, Sinn Féin, said that this was not

Fine Gael MEP, Brian Hayes has called on the four Dublin Local Authorities to apply for the new EU free WIFI initiative. Speaking in the European Parliament in Brussels the Dublin MEP said that the initiative known as “WIFI4EU” will be given the green light shortly by the Parliament with the applications process opening for local authorities in midSummer.

“I am very pleased that plans by the EU to invest in thousands of public Wi-Fi access points across the EU will begin this Summer.

Local Authorities such as Dublin City Council, South Dublin County Council, Fingal County Council and Dun Laoghaire/Rathdown County Council apply for funding to equip parks, public buildings and village squares with high quality WiFi access.”

have soaked up 40% of the available fiscal space over the coming years and would have had to be replaced by some other tax.

PRESSURE MOUNTING FOR TICKET TOUTING LEGISLATION Dublin South West TD, Seán Crowe, has welcomed the comments of Peter Aiken of Aiken Promotions, one of the country’s biggest music promoters, on the need for the regulation of ticket re-selling in Ireland. Peter Akien spoke out against the use of secondary ticket selling websites, such as Seatwave and Getmein.com after tickets for concerts for U2 and Ed Sheeran were recently being touted for over €1000 on the internet.

Deputy Seán Crowe said these comments will add to the pressure on the Minister to fast track legislation in this area.

Fianna Fáil Spokesperson for Dublin, John Lahart TD has said more needs to be done to ensure the safety of cyclists using Dublin roads, following a number of recent serious accidents and fatal collisions in the city.

“Fianna Fáil has always been a party which prioritises sustainable transport and has been the party which has done the most to advance transport initiatives introducing the Bike to Work Scheme which, by any measure, has been a remarkable success drastically increasing the number of people using their bikes.

“In fact the number of cyclists in Dublin city has more than doubled over the last decade yet there has been little investment to provide safe and accessible

The Sinn Féin TD said: “Ticket touting has escalated in recent years. With advances in technology, the practice has grown from traditional touts selling counterfeit, cancelled or extortionately priced tickets outside venues, to online sites, in the grey area of regulation.

“These events are designed to give fans of music and sport the opportunity to see their heroes live, and should be a positive experience all round, but the abuse of ticket reselling is reflecting badly on the industry.

“Each time tickets go on sale for a concert or sporting event, it is usually followed by a news report that outlines how the tickets sold out in minutes and are immediately reselling online at extortionate prices.

“Despite people’s best efforts in queuing and arranging to buy tickets online the morning of a sale, most have no chance as a result of the misuse of the system by secondary resellers.

“The reselling of tickets is not benefitting the public, the music artists, or sports teams involved. Sinn Féin’s new piece of legislation, the ‘Sale of Tickets (Sporting and Cultural Events) Bill

2017’, aims to address these issues and give everyone a fair opportunity to buy tickets to these events.

“Our legislation would allow consumers who buy tickets in good faith, only to discover that they cannot attend the event, to dispose of their tickets allowing up to a 10% profit margin. It would also have the effect of being a disincentive to ticket touts by means of substantial fines.

“I believe this practice has

gone on for too long, and is making what should be an enjoyable experience for people into a nightmare trying to obtain reasonably priced legitimate tickets.

“I welcome the intervention and comments of Peter Aiken of Aiken Promotion and his comments on the need for the regulation of ticket reselling in Ireland. Hopefully this will add to the pressure on the Minister to eliminate this despicable practice.”

“It is not enough to simply

build cycle lanes; these have to be maintained to a high standard so they are effective in enhancing road safety. I have called on Minister Coveney to put in place a funding scheme which earmarks a portion of the Local Government Fund to secure the annual resurfacing and maintenance of bike lanes.

“The government’s hands off approach to improving road conditions for cyclists is just not good enough and it is putting cyclists at risk of injury and death, concluded Deputy Lahart.

RESIDENTS URGED TO APPLY FOR NEW DEEP RETROFIT HOMES SCHEME

Fianna Fáil TD for Dublin Mid-West John Curran has called on local residents in Dublin Mid-West to apply for the recently announced multi-annual scheme to provide financial support to people who want to upgrade their homes to an ‘A’ rating on the Building Energy Rating (BER) scale.

Welcoming the recent announcement from the Department of Communications, Climate Action & Environment the Dublin Mid-West TD said: The allocation of €5 million to the scheme this year will fund energy efficiency

upgrades to homes and low carbon heating systems. It will be administered by the Sustainable Energy Authority of Ireland (SEAI).

The scheme will meet up to half the cost of upgrades for individual householders.

The focus of the new scheme is on the residential sector. €5m in grant funding has been ring-fenced for people who want to bring their home up to an A on the Building Energy Rating scale.

To support Ireland’s transition from fossil fuels to renewable heating technologies there will be no grants for fossil fuel

based systems under this scheme. Deep retrofit is a significant upgrade to bring a home as close as possible to Nearly Zero Energy Building standards.

Critical as it is to reduce carbon emissions from our residential sector, it is as important to reap the additional benefits that come with making a home low carbon, such as lower energy bills and improved health and comfort.

The €5m scheme will be administered by SEAI and will make funds available on a rolling basis to community groups, to Local Authorities

USI called on the need for further supports to be made available to secondlevel guidance counsellors to support school-leavers in making the jump to third level ahead of the report published by the Higher Education Authority based on students progressing from first to second year between the 2013/14 and 2014/15 academic years which showed more than 6,000 students drop out of first year.

Research conducted in 2015

by USI and the National Forum for the Enhancement of Teaching & Learning in Higher Education showed that the adequacy of prior information was the most significant trigger factor for student withdrawal. USI noted that that teaching colleges have a significantly lower dropout rate because prospective students of teaching are well informed of vocational pathways involved in becoming a teacher.

Leahy also stated that, “criticism of “prior information” combines how prepared students are to make the transition from secondary school to a more independent third-level environment. There is an extraordinarily short period between a student accepting a CAO offer and the start of third-level. In a space

of two weeks, teenagers are expected to move out of home for the first time and become independent.

With the issue of affordable student accommodation getting worse there are plenty of students arriving to college without enough preparation to successfully transition”

HONOURING THE FLAG AT THE 1916 COMMEMORATIVE GARDEN AT NEWLANDS CROSS

The ‘Honouring the Flag’ event was hosted by the Clondalkin Tidy Towns Group, who were responsible for planning, designing, planting and maintaining the 1916 Commemorative Garden at Newlands Cross.

The garden was officially opened in 2016 by the then Mayor of South Dublin County Council Councillor Sarah Holland.

Three other local community groups came on board and supported the project, they were, Muintir Chronain, Clondalkin History Society and St Killians Group, Scouting Ireland.

The garden project was

grant aided by South Dublin County Council.

On Easter Sunday two St Killians Scouts, Jordan Ahern and Robert Kiely did the honours of flying the tricolour for the first time at the Garden.

The scout group under scoutmaster Joe Mannion paraded to the site led by Brendan Boland of the St. Josephs Pipe Band who played the National Anthem as the flag was raised while the scout troop stood to attention and saluted the flag.

YOUNG PEOPLE INVITED TO BE PART OF WORLD’S FIRST LGBTI+ YOUTH STRATEGY ‘Online consultation underway as Ireland once again leads the way on equality’

Young people are being invited to be part of history by having their say on the new LGBTI+ National Youth Strategy, according to Dublin South West TD and Independent Minister, Katherine Zappone.

The strategy is the first of its type in the world, and Minister Zappone is encouraging young people to get involved.

Social media has been mobilised to reach as many teenagers as and young adults as possible, with an online consultation being hosted on www.spunout.ie.

Minister Zappone added: “The proudest moment of a life dedicated to campaigning was when Ireland delivered a Yes vote in the Marriage Equality Referendum.

It allowed pictures of a Dublin Castle courtyard with a sea of rainbow and Irish flags to be beamed as a beacon of hope across the world.

However for many young people coming to terms with their sexuality can still be a lonely, difficult experience while homophobia is also a sad reality.

Through the LGBTI+ Youth Strategy we are confronting these difficulties and showing solidarity with young people.

The online consultation and social media are vital if we are to ensure that the voices of all young people are heard – and their views taken into account.

We are inviting all 16-25 year olds to take part – and to have their say. I encourage schools, colleges and youth organisations to get the news out to their members and get them involved.

The strategy is a world first

– and of that we can all be proud. It will feed directly into Government policy

and will ensure that Irish communities are supportive, inclusive and equal for all –

where bullies, intolerance and discrimination are not accepted.”

I have asked the Council to proactively engage with transport providers like Dublin Bus and Irish Rail to deliver an increase in public transport services for this new community.” Higgins concluded.

Ms Boylan said “The Gambling Control Bill was first published in 2013 and for the last four years very little has happened to progress it. Minister Stanton is promising legislation in the next 12 months but we do not need to wait for the legislation to introduce interim measures.

“There is a clear lack of urgency in dealing with gambling addiction in Ireland despite all the indicators showing that Ireland has a serious problem.

“A recent H2 report showed Ireland to have the third highest gambling losses per head in the world. The Public Health Institute

estimates that Ireland could have as many as 40,000 problem gamblers with gambling among adolescents 2-3 times higher than adults.

Some 50% of gambling losses in Ireland are lost through online gambling.

“Online gambling across the EU is governed by internal market rules but there is scope for a derogation to allow for Member States to enact measures that are designed to help curb gambling addiction.

“Before the minister signs off on any draft legislation, he should leave the EU Commission in no doubt that Ireland intends to seek such a derogation. Ireland is an EU outlier in the extent of its gambling losses and is therefore well placed to argue for such an exemption.

“Closer to home there are

also measures he can take.

Currently there is no ring fenced funding to tackle gambling addiction. The betting tax, already one of the lowest in the world generates €27 million euro, €6 million of this is ring fenced to support the bloodstock industry yet not a cent of it goes to supports for gambling addiction.

“Minister Stanton must now start lobbying at the cabinet table for ring fenced funding from the betting tax to go towards gambling support. This is not about banning gambling, it is not about calling for draconian measures but it is about ensuring that those who do have gambling problems get the support they need and are not vulnerable to online exploitation by betting operators.”

TRAVELLER FAMILY LEFT WITHOUT ACCESS TO SANITATION FACILITIES FOR 6 MONTHS WINS EQUALITY CASE

The Workplace Relations Commission (WRC) has found that a Traveller family was discriminated against

by Dublin City Council in accessing maintenance services.

Sallyann Berry, a member of the Traveller community resident at Labre Park, Ballyfermot, took an equality case following significant delay by Dublin City Council (DCC) to the repair of her family’s sanitation facilities.

A fire in late January 2015 destroyed the sanitation unit adjacent to their mobile accommodation. On reporting the damage to DCC, Mrs Berry was refused maintenance services due to an alleged previous ‘incident’ of anti-social behaviour by other persons on site.

It was 6 months before Mrs Berry, who was pregnant, and her young family were provided with adequate sanitation facilities.

Mrs Berry took her complaint to the WRC,

claiming that DCC failed, refused or neglected to provide a maintenance service, thereby directly discriminating against her under the Traveller status ground of Section 3 and contrary to Section 5 of the Equal Status Acts in relation to access to a service.

The WRC found that the delay in providing proper access to a sanitation unit was discriminatory against the complainant and would not have occurred in similar circumstances for a person from the settled community.

The Ballyfermot Travellers Action Project (BTAP), which advocated for the family in this matter, welcomed the ruling. “This is a very important decision for the Traveller community. All too often an entire community, whether it be Labre Park or another Traveller-specific accommodation area, is discriminated against by local authorities and other agencies as blanket policies are implemented without regard to individual need,”

said Lorraine McMahon, BTAP Coordinator.

BTAP was supported in this case by the Public Interest Law Alliance (PILA), a project of FLAC (Free Legal Advice Centres). PILA empowers groups to tackle social problems by using the law to address the needs of marginalised individuals and communities. It facilitated pro bono representation by Kevin Brophy Solicitors.

Rachel Power, PILA Coordinator, said the case highlighted the need for more accessible legal services for the Traveller community. “The queries we have been receiving from Traveller organisations has been increasing year on year. While pro bono support secured a positive outcome in this case, there are many valuable cases that go unrepresented.

INCREASE FUNDING FOR SUBSIDISED CYCLE PURCHASE SCHEMES AND CYCLE LANES

Dublin Senator, Catherine Noone, has called for increased funding for cycle lanes and subsidised cycle purchase schemes.

Senator Noone made the call following the results of a new study which found that people who cycle to work reduce their risk of cancer and heart disease by almost half.

“This report which was carried out by experts from the University of Glasgow over five years, showed that 46% of those who cycled to work lowered their risk of cardiovascular disease and 45% lower risk of developing cancer than people who drive to work or take public transport.

“The research, concluded that overall, cyclists have a 41% lower risk of premature death from any cause.

This is a hugely significant percentage.

“These findings strongly indicate that policies designed to make it easier for people to commute by bike, such as increased funding for subsidised cycle purchase schemes and cycle lanes.

“I believe that Dublin needs to be making strides towards integrating cycling more fully in the city’s transport infrastructure now.

“I believe that our city needs

to move towards dedicated cycling lanes, similar to the Grand Canal route. This makes sense from a public health and environmental perspective.

“Planning arterial cycling routes into the city is something that needs to be done immediately. As the city becomes more pedestrian friendly I believe that cycling will become the main form of transport into town and we need to start planning for that now.”

WELFARE CHEATS CHEAT US ALL

Minister for Social Protection Leo Varadkar has launched a hard-hitting publicity campaign designed to raise awareness of social welfare fraud and encourage members of the public to identify potential cheats.

The hard-hitting publicity campaign promotes the Department’s online and telephone fraud-reporting services. It’s designed to encourage debate about social welfare fraud and challenge the perceptions of those who see it as a victimless crime. It kicks off in the next few days with online, print, and broadcast advertisements and a national poster campaign.

The majority of public reports in 2016 concerned Jobseekers Schemes, Supplementary Welfare Allowance and One Parent Family Payments. The most common reports allege issues such as working while claiming, cohabiting with a partner who is making a financial contribution, or claiming while living abroad. The Department estimates that approximately one in three reports results in a payment being reduced or stopped.

Last year, the Department’s Prosecution Service considered some 300 cases of which 194 were referred to the Chief State Solicitor’s Office for proceedings to issue. A further 160 cases were referred for prosecution to the DPP by the Department’s Special Investigations Unit.

Minister Varadkar said “The Department of Social Protection has the single biggest budget of any Government Department, spending €19 billion every year. Last year, 1.4 million people received a weekly social welfare payment. Even with a budget of this size, there are still many positive changes I would like to make but have been unable to do so due to budgetary constraints. That’s why savings are so important. And that’s why the public has a vital role in ensuring that we only target resources at those who most need them.”

Confidential reports can be made using: - A confidential facility on-line on the Department’s website www.welfare.ie/cheats where concerns can be reported; - The dedicated telephone facility 01 673 45 45 staffed by trained personnel; - Reports by letter are also welcomed and encouraged (Fraud Reports, Central Control Division, DSP, Shannon Lodge, Carrick-on-Shannon,

Co Leitrim); - Reports can also be made to any of the Department’s offices nationwide.

What are the main schemes/areas that are reported on?

- Jobseekers Schemes, Supplementary Welfare Allowance and One Parent Family Payments.

What are the main allegations that are reported?: - Working & claiming: Where a person claims a payment, such as Jobseeker’s Benefit/Allowance or an Illness payment, but takes up employment and does not notify the Department.

- Cohabitation: People may be living as a “family unit” and fail to notify the Department of the situation in order to qualify for higher rates of payments, or payments to which they may not be entitled.

- Living abroad: Where a person claims a social welfare payment, and is not resident in this jurisdiction, without notifying the Department but continues to claim the payment.

- Employer Issues: Social insurance and employer non-compliance: where employers fail to maintain appropriate employment/wage records and where non-compliance or non-remittance of Pay Related Social Insurance occurs.

- Non-disclosure of means: Where a person claims a means tested payment, for example Jobseeker’s Allowance, but they do not fully disclose their means or sources of income to the Department. These sources of income might include cash earnings, inheritances, hidden savings, investments, maintenance, or compensation payments.

- Multiple claiming or personation: Where a person makes a claim for more than one social welfare payment or by assuming and falsely using the identity and PPSN of another person which would include claiming benefit for a person who is deceased or claiming for a person who is in prison or has emigrated.

- Life events: Where a person continues to claim a payment to which they are no longer entitled to such as a lone parent who marries, enters into a civil partnership or is cohabiting, or someone who continues to claim Carer’s Allowance claim where caring duties have ceased, or where a pensioner dies and no notification of death has been made and the pension continues to be collected.

ZAPPONE WELCOMES NATIONAL STREET LEAGUES TO KILTIPPER

Independent Minister and Dublin South West TD Katherine Zappone has welcomed more than 200 players in 24 teams to the Big Issues National Street League Soccer Finals at The Dublin Postal Sports & Social Club at Kiltipper.

DO E CIGARETTES HAVE MORE CANCER CAUSING INGREDIENTS THAN NORMAL CIGARETTES? As the popularity of electronic cigarettes has grown, so have concerns over the health risks they pose.

E-cigarettes have suddenly become a very controversial hot topic. Aren’t they the solution to your smoking woes? Are they a gateway to regular cigarette smoking?

What is the truth about e-cigarettes, are they safe or are they a more lethal killer than regular cigarettes? The big picture shows emerging evidence that e-cigarettes have their own dangers. It may be another generation before we have as strong scientific evidence about e-cigarettes’ as we do for tobacco smoking. Growing evidence suggests that they may have killed you long before then. CDC Director Dr. Tom Frieden says “We have seen an increase in poisoning from e-cigarettes”.

The New England Journal of Medicine recently published a letter from researchers that set off alarm bells.

They reported that some e-cigarettes release formaldehyde, a probable cancer-causing substance (or

carcinogen), when heated with batteries set at high voltages.

The California State Department of Public Health released a report declaring e-cigarettes a public health threat and calling for regulation.

Researchers found e-cigarettes contain toxic substances and nanoparticles that could kill the top layer of skin cells in the oral cavity - behind teeth and gums.

Scientists from UCLA, who was conducted the investigations on cultured cells, believe the same results could happen in a human study - increasing people’s risk of oral disease including cancer.

Researchers in North Carolina reported using the devices increases the risk of infection because it damages hundreds of genes in the immune system. The latest findings add to a growing body of evidence linking the e-cigarette stop-smoking aid to serious health risks.

Research scientists in Japan have announced that e-cigarettes contain ten times more carcinogens or

cancer causing ingredients than the chemical laden regular cigarettes. When the wire (which vaporises the liquid) which tends to get overheated, higher amounts of those harmful chemicals seem to be produced.

Because of the serious threat posed by e-cigarettes the World Health Organisation (WHO) recently urged governments to ban their sale to minors. The UN health agency said that despite the lack of evidence on the damage caused by e-cigarettes, there is enough “to caution children and adolescence, pregnant women and women of a reproductive age” about their

use, adding that they should be banned from indoor public spaces.

E-cigarettes seem to alarmingly encourage and promote regular cigarette smoking. According to the US Center for Disease Control and Prevention (CDC) “More than a quarter of a million youth who had never smoked a cigarette used electronic cigarettes in 2013, according to a CDC Study published in the journal ‘Nicotine and Tobacco Research’.

This number reflects a threefold increase from about 97,000 in 2011, to more than 263,000 in 2013.”

Can E-cigarettes Help Smokers Quit?

According to Fadio Khun, M.D. deputy director, Winship Cancer Institute, Emory University; “Studies show that e-cigarettes are about as effective as nicotine patches in helping smokers quit cigarettes. In my view that’s not a very high bar because even with those individuals who use a patch or use an e-cigarette, the likelihood of picking up a tobacco burning cigarette is still very high, higher than is acceptable”.... If we allow e-cigarettes to proceed with marketing saying that they are a safe product, they are not a gateway to the use of full tobacco burning cigarettes, then we are increasing the risk for these individuals.

What’s in Your E-Cigarette?

One FDA review of 18 different e-cigarette cartridges found toxic and carcinogenic chemicals in some but not all. Only one of the cartridges labelled “no nicotine” did not contain nicotine. The authors suggest that “quality control processes used to manufacture these products are inconsistent or non-

existent.”

E-liquid is the name for the solution that’s heated and converted to an aerosol, which e-cigarette users inhale. Here are its most common ingredients: Nicotine: The addictive ingredient in e-cigarettes and regular cigarettes, nicotine stimulates the central nervous system and raises blood pressure, respiration, and heart rate.

“People smoke because of the nicotine,” says researcher Maciej Goniewicz, PhD, PharmD. a tobacco and e-cigarette expert at the Roswell Park Cancer Institute in Buffalo, N.Y. “While it’s addictive, nicotine doesn’t cause cancer,” says Goniewicz: “What causes concern are the other chemicals (in the e-liquid).”

The question you must ask yourself is, do you want to take the known and unknown risks and become a statistic of e-cigarettes or any cigarettes.

The only safe and healthy smoker is an ex-smoker.

and will be the latest in the Public Health Education Series of presentations, organised throughout the year.

This event is part of Tallaght Hospital’s annual engagement with the Green Ribbon Campaign. The talk will take place in Killinarden Community Centre at 10am on Wednesday, 10 May. In addition to Professor Swanwick, the event is also supported by up to 20 mental health organisations and community groups who will also attend.

Among these groups are the Tallaght Rehab Project, the National Counselling Service, Counselling in Primary Care, Mojo and Mojo Men’s Shed and Teencounselling.

Age Action Ireland is also supporting the event and will be in attendance. It is hoped that the presence of these organisations will increase the awareness of the services available in the community.

Professor Greg Swanwick specialises in the psychiatry of old age and also has a special interest in dementia and medical education.

His talk is part of Tallaght Hospital’s drive to ensure continued excellence in mental healthcare. The Green Ribbon Campaign takes place throughout the month of May and comprises See Change, the National Stigma Reduction Partnership and 90 other partner organisations as part

of the month-long series of events to encourage people to start openly talking about mental health problems.

Professor Swanwick said, “Mental health challenges are common across all ages and this is also true for those of an older age. As a result it is so important to know how to mind your mental health and to know when to seek help. I am a big advocate of the Green Ribbon Campaign which does a huge amount every year to raise awareness of the challenges in this area. I am delighted that our event this year is supported by such a large number of local organisations and I hope members of the public come along to find out more about

the mind, how to look after it and find out more about mental health and what supports are available.”

On average a litre of petrol now costs 136.6c, while a litre of diesel will cost 126.0c down from March’s prices of 137.7c and 127.1c per litre respectively. The decrease marks the first time since September 2016 that the price of a litre of petrol has fallen, while diesel has now fallen to its lowest level since the beginning of 2017.

“While it may not be the most sizeable decrease, particularly when we consider that the cost of a litre of petrol or diesel is still about 5c higher than it was at the end of 2016, this does represent some overdue good news for motorists,” Conor Faughnan, AA Director of Consumer Affairs stated.

“While we don’t know what the future holds for fuel prices, after months of significant increases we will hopefully see a new trend

emerge.”

Despite the drop in fuel prices, the motoring organisation has expressed concern over the tax levels imposed on fuel spend. The AA’s fuel prices survey found that tax accounts for 63.18% of the current price of a litre of petrol, and 58.30% of the price of a litre of diesel.

“Unfortunately this decrease, while welcome, won’t do much to ease the concerns of motorists who are still paying almost 10c a litre more for fuel than they were this time last year. In response to these increases the AA continues to offer all members and customers an AA Fuel Card which will see them get 4c off per litre of fuel purchases at select garages,” Faughnan added.

“However, beyond this we would once again call on Government to assess the

extent to which petrol and diesel spend is taxed.”

“We are a largely rural country where many motorists drive out of necessity and taxing fuel spend to the extent to which it is currently taxed makes it harder and more expensive for people to get to work.

Instead of facilitating growth by making it easier for people to commute to work, the government is actually taxing fuel to the point where it becomes an anti-stimulus measure.”

While fuel prices have dropped on average nationally, the AA report noted a significant increase in the cost of a barrel of oil, a key trend in setting fuel prices. Since March 2017 the price of a barrel of Brent Crude Oil has risen from below $51 to a current level of $55.85 per barrel.

Springfield’s newest hair and beauty salon is already making huge strides within the community and aims to continue to grow alongside its customers.

Star Hair and Beauty opened six weeks ago in the Fortunestown Shopping Centre and has gone from strength to strength ever since.

Located beside Crough’s Pub, close to busy estates throughout Springfield, manager Ruth Field believes that the local setting is a huge draw for customers.

Romaine Scally, Solicitor Q. I was involved in an accident just over a year ago now. At the time I did not pursue any claim as I felt that I was alright.

Now however, I am aware that I have a fairly constant pain in my neck which is interfering with my day to day life. It was a road traffic accident I was involved in and I did take details. Is it too late to make a claim?

A. It is important to remember that in all cases of accidents causing personal injury, a claim must be initiated within two years of the date on which the accident occurred. It is also a requirement that a letter of claim be issued by a claimant to the person he or she feels is responsible for the accident within two months of the date upon which the accident occurred. Such a letter of claim will normally be drafted by a solicitor. However, there is flexibility about the letter of claim being issued within the two months but there is no flexibility about the claim being

initiated within two years from the date of the event.

In short, it is advisable that you contact your solicitor as soon as possible after an accident.

Your solicitor does not necessarily need to start a claim on your behalf if you do not feel that it is appropriate at that time. However, at least the facts are recorded and details taken so that at a later date, the claim can easily be processed. Our advice in all these situations, is to take legal advice early and give particulars. You are within the time limit to commence a claim but as it can take some time to obtain an initial medical report, which is a requirement of registering a claim then, we would suggest that you go to see your solicitor as soon as possible.

Q. I paid a deposit on a new car but, found a better deal elsewhere. The garage is refusing to return my deposit. Can they do that?

A. When you paid a deposit on the car, you created a consumer contract with the garage to buy their product. The deposit served as a guarantee on both sides that the deal would go ahead. If you back out of a contract after paying a deposit, you are not entitled to have your money returned. The garage may agree to repay or partly refund your deposit but that is entirely up to them.

They are not legally required to do so. The garage’s policy regarding deposits should be laid out in the terms and conditions of the contract or receipt you got when you paid them. If they continue to refuse to return your deposit, then, you must decide whether the ‘better deal’, is still a better one once you incorporate the loss of your deposit.

should not be treated lightly. You should never pay a deposit unless you are sure you want to go ahead with the deal, or can afford to lose the money.

Q. I had an accident at work and was out sick for about 6 months. I am back at work now but not fully recovered from the injuries yet. I have been told by colleagues that I am entitled to take a claim for personal injuries against my Employer but I am unsure of whether to do so as I am afraid that I might be let go. I have been in the job for nearly 4 years now. Could I lose my job if I take a claim?

A. Your employer will undoubtedly have recorded the accident and may already have notified the details of same to it’s insurance company. As such, a claim may well be anticipated. You do not give any details as to the circumstances of your accident or the nature of your injuries and you would need to discuss same in some detail with your solicitor. However, assuming that this was an accident which should not have happened within the workplace and has caused you personal injuries then, you do have the right to claim against your employer. You must initiate the claim within two years from the date of the accident and it is important to allow your solicitor plenty of time to take details and obtain an initial medical report.

It would be unusual if your employer decided to dismiss you simply because you initiated a claim. You are protected by the law and if your employer takes legal advice they will be so informed.

As you have been with your employers for such a long period of time, any attempt to dismiss

you could be construed as an unfair dismissal which in itself would give rise to a claim for compensation. This is quite separate and apart from any claim for personal injuries.

Our advice therefore is to go to your solicitor and give particulars and commence an action for personal injuries arising out of your accident at work.

Q. I was on a guided tour with my family recently of a historical site. The site was undergoing some major renovations and, when we moved off the temporary platform, some of the old flooring gave way underneath some of us. I lost my balance falling forward and hitting my head against a stone wall. Would I have any claim?

A. Once guided tours are offered of any historical site then, a certain responsibility is assumed by the organisation running these tours. Health and Safety is of paramount importance and it sounds as if this particular site was not ready for visitors. It would be important to ascertain in more detail how your accident actually occurred but from what you say, it sounds as if the fault was at the hands of the organisers in allowing tours to continue during the renovation work or at least before the work was completed. You should consult with your solicitor who will initiate a claim on your behalf. You should also ensure that you go to see your doctor before you go to your solicitor to ensure that the injuries are recorded. If you have details in relation to the tour including the name and address of whoever organised same, then this would be very helpful for your solicitor. It does seem however as if you have a genuine claim for personal injuries against the organisers of this event.

NUMBER OF HOMELESS CHILDREN IN IRELAND AT ALL-TIME HIGH

Dublin South West TD, Seán Crowe, has said that the number of homeless children is at an all-time high, with numbers steadily increasing every month since the Government came into office.

The Sinn Féin TD was commenting after the release of the Department of Housing’s March homelessness figures showed yet another rise in individual, family, and child homelessness. The latest figures show that 7,472 people, including 2,563 children, are now living in emergency accommodation.

Deputy Seán Crowe said: “The numbers of homeless children in Dublin, and across the State, are now at their highest rate since records began.

“Figures published by the Department of Housing shows there were 2,137 children in emergency accommodation in Dublin during the week of March 20th-26th, with a national total of 2,563 homeless children.

“The Dublin figure represents a 24 per cent increase on the March 2016 figure and there has been 11 straight months of homelessness increases.

“Minister Coveney has been

in office for 12 months and during that time adult, family and child homelessness has increased by a fifth.

“It is clear that this Government is failing homeless families despite all their announcements.

The Government is clearly violating the right of citizens’ to adequate housing, which is provided for in the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, and the European Social Charter. The right to adequate housing is an important human right.

“Minister Coveney’s polices, and grand announcements about solutions, have not stemmed the tide of families and their children falling into homelessness. Every month since he became Minister for Housing, the homeless levels have increased.

“I am calling on Minister Coveney to make a statement in the Dáil next week as to why homeless levels are continuing to rise.

He must also clearly explain how his Department plans to meet his commitment that no families would be living in hotels and B&Bs by July this year.”

ENTERPRISE IRELAND-BACKED BUSINESS MAKES INROADS INTO CAR MARKET “CAR DEALERS SITTING ON €100,000+ OF ‘DEAD’ PARTS STOCK”

An Irish company which has developed an online platform bringing together buyers and sellers of new and obsolete spare parts is making inroads into the car market in Ireland, where dealers are often sitting on considerable volumes of ‘dead’ parts stock.

For an annual subscription fee, Surplus Stock Worldwide uploads a dealer’s spare parts to its platform where buyers from around the world can view and purchase them, typically at discounted prices. Close to 20 million parts are on the site at present, with parts sold to date across over 100

countries.

A global shop window for new and obsolete parts “From talking to dealer principals, it is clear there is a need out there for this unique service,“ says founder and director Terry Reihill. “We are providing another route to market enabling dealers sell their parts with the added advantage of helping them reduce their redundant parts stocks. We’re finding it is not unusual for a car dealership to have in excess of €100,000 of obsolete spare parts, which they have no ready means of disposing of. We are creating a global

shop window for these parts.”

Reihill stumbled upon the business idea while working as a purchasing manager in the concrete industry.

“A colleague at the time suggested we dump an engine which had been lying on the shelf for some time.

It struck me there must be a way of monetising these items, rather than paying someone to get rid of them!”

Reihill successfully pursued the idea onto the Dragon’s Den, with the truck, plant and agri-machinery sectors as his initial targets.

Having gained traction in these sectors and having

recently secured High Potential Start Up funding from Enterprise Ireland, Surplus Stock Worldwide has launched a new platform which also meets the demands of the car marketplace, which it is now targeting.

Among the early adopters of the offering are Charles Hurst, Donnelly Group, Ashley Ford and the Spirit Motor Group.

“With dealers typically paying less than €10 a week, our offering is more costeffective than that of our nearest competitor, ebay, and we upload all the parts for our customers, which

is major benefit for a busy dealership,” explains Reihill.

“We also provide monthly performance reports to allow our customers to see what parts are gaining traction and so they can adjust their pricing as required. It is often the financial controller in a dealership who first recognises how our service can support the business bottom line.”

Seller turned buyer In introducing dealerships to the benefits of its service, Surplus Stock Worldwide has found many to be interested in the site as a source for parts. “Parts departments end up using our platform for selling unwanted stock but also for buying unusual parts needed to service older vehicles, for example,” says Reihill.

The company, based in the Guinness Enterprise Centre in Dublin, employs 4 staff and has set its sights on the UK as the next target market for its service.

GREEN LIGHT FOR €30M INVESTMENT INTO BALDONNELL “I am delighted that An Bord Pleanála has given the green light for a €30m investment into Baldonnell. The project being led by Mountpark will see a logistics centre built adjacent to the existing Baldonnell Business Park.

The development will create over 100 jobs during construction and will provide long term employment for up to 850 people working in the completed logistics centre. The land is in a strategic location right at the gateway to South Dublin.

It’s really well serviced by infrastructure and main roads including the M50 and the N7 and is set between an existing business park and the aerodrome. To me it’s a prime example of the type of location we need to be utilising to create enterprise and employment in our

county. I very much welcome the decision of An Bord Pleanála to grant permission for this development which will facilitate multinational multi-million euro investment in Baldonnell,” said Cllr. Emer Higgins.

“Councillors worked in collaboration to ensure this land retained its zoning ahead of the adoption of the current Development Plan. I am delighted to see plans to utilised this land to create employment for the area approved. Just this week Councillors voted to approve a new housing development of almost 800 housing units nearby and developments like this will help provide local employment and spinoff trade that will make our expanding communities sustainable,” said local Councillor Emer Higgins.

COMEBACK CREAGH FOR CELTIC CLASH

Tallaght favourite Sean Creagh will make his muchanticipated comeback on Saturday May 27th at the National Stadium on the second instalment of Boxing Ireland Promotions Celtic Clash 2, The Rising.

Creagh, whose inspiring transition from a 20-stone slouch to one of Ireland’s most popular professional fighters, has once again show amazing determination to quickly recover from a serious arm injury sustained last November.

A slight injury during a 2016 training camp proved disastrous for the Killinarden local when further aggravation ruptured his biceps tendon just two rounds into the televised Celtic Nations title fight against Belfast’s Tyrone McKenna.

Following an operation before Christmas, the one handed Creagh quickly overcame his disappointment, wasting no time in returning to the gym.

The South Dublin puncher believes staying focused and maintaining his fitness has aided his recovery.

“I was disappointed about getting the injury in such a big fight but I knew that feeling sorry for myself was pointless. I just got straight back into the gym, I could only use one hand but it didn’t matter as the important thing was to stay fit. Staying in shape and maintaining a healthy

lifestyle allowed me to recover fast from what was a serious arm injury” stated the Tallaght man.

Tallaght will be well represented on the night with Jobstown fighter Carl McDonald making his Dublin debut, having already secured his first professional win in Belfast back in October.

Trained by Eddie Hyland, one of Jobstown’s legendary trio of boxing brothers, much is expected of McDonald, who back in 2015 won the Irish Intermediate championships.

Having stepped through the ropes at the National Stadium on many occasions as an amateur, McDonald is delighted with the opportunity to now fight as a professional at the renowned South Circular Road venue.

“I’ve been lucky enough to fight in the stadium loads of times as an amateur, but it’s like a new experience to climb back through the ropes as a professional. I made my professional debut in Belfast so I’m delighted to be back in Dublin, fighting in front of my family and friends and there is no better place to box than the National Stadium”.

Dear Editor, I read your article on ‘Persistent Dumping’ on the Oldcout Road last week. I live in Hunterswood and regularly use the Oldcourt Road. The dumping here is disgusting and a disgrace.

I wanted to contact you to tell you my recent experience with another local rubbish story. I have lived in Hunterswood since the development was built 12 or so years now. When I bought my house, I had no choice but to sign up to the management company and the yearly fee. There are a variety of different types of houses and apartments in Hunterswood and your bill can vary depending on what type of property you have. In my case, the annual fee is nearly €600. As I don’t live in an apartment and don’t have common areas to be painted, lifts and fire alarms to maintain, at times I wonder where my fee goes. However I do accept that the brambles have to be cut back and the grass verges need to be mowed.

I also accept that the bin collections cost money which leads me straight to my grievance.

The bin sheds were fitted with locks last year to prevent non residents dumping at our bins and increasing the cost for everyone. This all makes sense so far, however I see our own residents dumping inappropriate items at the bins all the time. I have witnessed one neighbour dumping a Christmas tree and another dumping a sink after getting a new kitchen but that’s another day’s work.

Demand for the affordable, friendly and professional 3Dental service has been huge, leading the team to expand earlier this year to allow them to treat more patients and cut waiting times.

Over the last 12 months 3Dental has welcomed more than 5,000 individual patients to the modern, spacious clinic on the Naas Road.

These locks were combination type and the code was supplied to the residents. Last week I got an email from the management company J&S Property Management.

It stated the codes were being changed and that only members who have paid or are in a payment plan will get the new code. Normally I would just get a cheque for the management fee but due to financial issues, I had been chipping away at the balance as best as I could and had almost paid off the 2016 fee. The codes were changed at some point mid week last week and I found myself at the bin shed with a bag of rubbish and the old code. Unable to dispose of my rubbish I brought it home again. A number of other bags had collected outside the shed and I was tempted to leave it with them but didn’t.

I contacted J&S Property Management to get the code but I was refused. I was told that unless I paid up I would not be getting the code. My bags of rubbish are now piling up in the garden and will attract vermin if left for any length of time. I advised the agent in J&S that I totally disagreed with their tactics on the bin codes. I asked about paying for a bin service that they were refusing to supply. I also asked about being forced to pay elsewhere for my bins but the operator had no comment on that. I agreed to make a part payment later that day and the operator advised I would be supplied the code. My bags of rubbish are now piling up yet I still have no code.

ELITE KARATE ACADEMY CELEBRATE THEIR 6TH ANNUAL ELITE KARATE EXPO Elite Karate Academy celebrated their 6th Annual Elite Karate Expo on the 9th of April 2017 in The Green Isle Hotel, Clondalkin.

Started by Sensei Gareth FitzGerald, who says, “the aim of the Expo is to allow students demonstrate their skills and abilities to their family and friends, whilst educating parents about the aims and ethos of Elite Karate Academy, in a relaxed fun environment.”

With a huge turnout of 250 family and friends the day started with the presentation of black belt hall of fame picture to Eric Keenan who successfully graded for black belt.

After 6 years of training Eric became one of the 1st generation of Black belts in Elite Karate Academy.

Escorted into the Expo through an honour guard of all students from the club, she was presented with his framed picture by Sensei Gareth FitzGerald 6th Dan. The rest of the day consisted of student grading, sparring competition, and demonstrations by senior and junior students and an awards ceremony.

Elite Karate Academy was proud to run a bake sale in aid of Barretstown which raised over €200 for a great charity. Damien Grenham 4th Dan in Bujinkan Ninjitsu whose child attended on the day told us, “The standard of the students from white belt to senior grade has certainly jumped from last year. Well done to all!! Next year will be a hard act to follow.”

Lucy Power who’s two sons attended the Expo, and eldest is very shy says, “At the Expo the boys got to see what all the other levels

can do and they found out they’d passed their grade.”

Her eldest boy Dara said on the way home, “ This is the best day ever.”

Elite Karate Academy also crowned Analeigh Murray as ‘Student of the Year 2016’.

Analeigh a hugely dedicated and passionate student has been training for 3 years, she is currently a purple belt.

Alice McKenna won “Best Kicker” and “Best Kata” for the second year in the row. Liam Wilson won “Best Newcomer”, Jack McCarthy won “Most Improved” and Clodagh Grenham won “Exceptional Effort”.

Having opened a full time dojo (training hall) in September 2014 which had seen unprecedented growth in the club, after the event Sensei FitzGerald 6th Dan said, “Our club is about character growth and personal development with a strong self defence focus, we run programs such as ‘Word of the Week’ which teaches 16 character values such as respect, perseverance, honesty, humility etc, and we have other programs on ‘Anti Bullying’, ‘Fighting Fat’ and building self belief in our ‘Dojo Kun’ which we teach throughout the year.

Our Top Five Films – Flying will take you through some of the scariest airplane movies of all time, those that will make you buckle your seatbelt a little tighter, question the other passengers a little bit more and wonder whether a holiday is worth the risk!

1. Snakes on a Plane – This movie definitely does not take itself too seriously but after watching it you might seriously reconsidering flying anywhere for a few months. The title is pretty self-explanatory, a mob boss targets a witness being flown in to testify against him by releasing deadly snakes onto a plane full of people. An enjoyable, if uncomfortable watch.

2. Con Air – A prison plane transferring dangerous inmates, a cunning takeover plan and Nicolas Cage; this movie is what dreams are made of. A stellar cast, great plot and unbelievable one-liners make this a cult classic. Nic Cage is grabbing a list home after being freed on parole when a plane full of evil villains makes a big detour.

Entertainment of the highest order.

3. Alive – Based on the tragic true story of a Uruguayan rugby team flying to Chile

for a match when the plane crashes in the Andes Mountains, Alive is heart-wrenching and compelling viewing. The 45 people on the plane are considered dead but the crash leaves several survivors. They stay alive during the long search operation by eating the flesh of their teammates who did not survive the crash. After two months 16 people are rescued from the Andes.

4. Top Gun – One of Tom Cruise’s better roles as a top Navy fighter pilot with an attitude and some authority issues. Determined to become the best of the best, along with his R.I.O [Radar Intercept Officer], he works hard and tries to out-manoeuvre the competition, learning some hard lessons along the way.

5. Red Eye – Rachel McAdams is brilliant as a young woman who is kidnapped on a routine flight and forced into helping with an assassination attempt. She is targeted by a suave, vicious and creepy man who is coordinating an attack on a Homeland Security official. Cillian Murphy is brilliantly cast as the baddie and the movie has lots of twists and turns which will keep you guessing until the very end.

They are our top picks for this edition and perfect for your movie night in, but if you are planning on booking a flight it might be best to wait until after you watch our Top Five Films – Flying.

ASSASSINS - TV 3 WEDNESDAY 3RD MAY...TV3 A brand-new documentary series examining contract killers in Ireland – ‘Assassins’ – will air on TV3 on Wednesday, May 3rd at 9pm.

The six-part series will be co-presented by investigative journalist Donal MacIntyre and leading criminologist Professor David Wilson who produced the pioneering academic work ‘The British Hitman: 1974 – 2013’ in the Howard Journal of Criminal Justice.

The duo used court transcripts and offthe-record interviews with ex-offenders to identify recurring traits and patterns of behaviour amongst British Hitmen; now they are applying the science of criminology to Irish cases.

Assassinations and gangland hits have transformed Dublin into one of the “contractkilling capitals of the world” with over 5% of all homicides here committed by specialist killers paid specifically for the job.

In the TV3 series David and Donal reveal the anatomy of six infamous contract killings, profiling the assassins and their crimes in forensic detail.

They look at the gunning down of notorious gangland kingpin Eamon “The Don” Dunne in 2010 and Ireland’s first teenage hitman Gary Campion, giving unprecedented insight into the dark minds of ruthless assassins in the capital.

Each of the six episodes will analyse a notorious assassin, probing the personal stories behind the everyday lives of the assassins and investigating the result of these gangland hits on society.

Throughout the series, David and Donal will also be revealing the human tragedy involved by speaking to the victims’ friends and families.

They will also speak to leading professional police experts, including Garda, Scotland Yard and FBI detectives, ex-homicide, DNA and ballistic specialists as well as criminologist academics and crime journalists.

Investigative journalist Donal MacIntyre will drive the narrative of the authored documentary series while Professor David Wilson will deliver insight and analysis of the criminal minds killing for money.

During the series, David will perform a ‘Criminal Autopsy’ at the actual location of real assassinations, evaluating

the thinking behind their getaway routes and rendezvous points.

The first episode of ‘Assassins’ airs on TV3 on Wednesday, May 3rd at 9pm.
