South Dublin County Councillor John Lahart has proposed a crackdown on knife crime, which includes a minimum 12 month jail sentence for anyone found illegally carrying a knife in a public place.

According to the Dublin South West Councillor, the scourge of knife crime is destroying lives and putting local communities at risk.

He has demanded that the Government send a message loud and clear that anyone who

illegally carries a knife is committing a major crime.

Cllr Lahart is calling on all TDs in Dublin South West to back a Fianna Fáil Bill that will be moved in the Dáil this week to introduce mandatory minimum jail sentences for those convicted of carrying knives in public places.

The local Councillor explained, “Unfortunately we have become all too familiar with stories of stabbings and knife attacks in our local

communities.

New figures show that crime involving knives has escalated rapidly over the past decade. Last year 19 people died as a result of a knife attack in Ireland and there were 35 incidents where people’s lives were threatened with a knife. That’s a huge increase on the year. previous Burglaries involving knives rocketed last year, as did car-jackings and other thefts.

knives in public places with little consequences. Knives have become the weapon of choice for many criminals. And we have seen other incidents where altercations escalate out of control when a knife is involved and the consequences are devastating.

“Knife crime is a scourge in Dublin and it needs an unequivocal response. The message needs to go out that if you carry a knife illegally in Ireland, you are committing a major crime and it will not be tolerated. At the very least we need to make it a specific crime involving mandatory jail time for anyone to carry a knife illegally.

“I am proposing a 12 month jail term for those caught carrying a knife in public places.

It’s one step that the Government can take in the fight against knife crime. Hopefully this will make people think twice before carrying these dangerous weapons. Fianna Fáil will introduce a Bill in the Dáil this week to crack down on knife crime. It will be debated in the coming weeks. I am calling on all TDs in Dublin South West to back this Bill.”

Dublin South West Fianna Fáil Councillor John Lahart has warned the Minister for Justice Frances Fitzgerald not to drag her heels on promised regulation of the Cash for Gold sector.

Lahart, who has Cllr highlighted the link between the out of control Cash for Gold industry and the surge of burglaries in Dublin, has welcomed the Minister’s confirmation that she is considering regulation of the sector. However, he has warned that a ‘consultation document’ falls far short of the immediate action that is required.

“The Government is coming to this issue far too late. The Cash for Gold sector is completely out of control and there is no doubt that this has fuelled the surge in burglaries across south and west Dublin.

While I am glad that the Minister has finally realised that this is a problem, having reviewed her announcement, the promise of a consultation process is not enough.

However I do welcome this late realisation from Government that there is in fact a connection between burglaries and cash for gold and cash for jewellery sales.

“Unfortunately communities across Rathfarnham, Templeogue, Knocklyon and Tallaght have seen the impact of the Government’s disinterest in tackling the spate of burglaries and thefts in this area. They’ve heard many promises from the Government but have seen absolutely no action, except the removal of yet more garda local garda resources.

“The Government spent four years of denying the fact that burglaries in Dublin have been a serious crime issue, and are continuing to rise. During that period, our local garda resources were slashed. The last thing we need now is lip service, or yet another empty promise aimed at buying time until the election.

“It is no secret that there has been a huge increase in the criminal trade of stolen jewellery, gold and scrap

metal. Local gardaí have told me that the gangs carrying out burglaries in the area in recent months and years are focused on taking jewellery and gold as they are easy to sell on with no questions asked. By failing to regulate the sale of such metals, we are encouraging more burglaries.

“The Government doesn’t need a ‘consultation’ to deal with this issue. They could introduce controls right now.

This should include a register to identify the seller of items to gold outlets, a retention period before the item can be resold and a record of transactions at gold outlets.”

The Mayor of South Dublin Sarah Holland has welcomed the council’s vote to reduce the property tax by 15%.

She said “This reduction will put on average €50 back into the pockets of South Dublin families like mine.

“We had a meaningful discussion on our proposal among the progressive alliance, which includes Sinn Féin, Independents, Greens and Labour.

“The bulk of the budget is ring fenced already for public service provision, including housing, and the 40 councillors

only have a say over a small amount. It is within our power to make this small change to benefit families, so we almost unanimously agreed to do that.

“The decision to reduce the amount of property tax payable by the maximum allowable was hard thought out – all pros and cons were considered, and we know this is best for our county.

“That extra €50 or so for each family will now be spent in our local businesses which gives our county the boost it needs.”

Sinn Féin Councillor Eoin Ó Broin has called on the Minister for Education Jan O’Sullivan and the Dublin and Dun Laoghaire Education and Training Board to ‘immediately reverse the cuts to the CEEDS Local Training Initiative that were announced earlier this month’ Cllr Ó Broin said:

‘The Local Training Initiative has been run for the last 18 years from Aras Rualach on the Neilstown Road. It provides training to young people and was due to start with 17 trainees on Monday September 2nd. It also employs two people full time.

‘However on Wednesday September 2nd the Education and Training

Board informed the management of the Local Training Initiative that the funding was being pulled and the trainees would have to travel to Tallaght if they wanted to access the course.

‘The Local Training Initiative has long track record of providing an invaluable service to the community in North Clondalkin. It is run by

CEEDS from Aras Rualach which has a strong reputation with the local community.

‘The decision to cut this service makes no sense.

North Clondalkin has high levels of unemployment, youth unemployment and social disadvantage. We need more services to get people back to work not less.

’17 young people were due to start this course on Monday September 7th.

Many of them will now drop out of training. The funding cut will also result in the loss of two full time jobs.

‘Given that this six month course costs only €50,000 to run and is run twice a year clearly the savings being made by the ETB are minimal. However the loss

to the local community are enormous.

‘I have written to the Minister for education and to the Education and Training Board urging them to reverse this cut immediately. They also need to ensure into discussions with the Management and staff and the North Clondalkin Local Training Initiative.

Local Councillor Charlie O’Connor has welcomed confirmation from the project team of the New National Children’s Hospital that an information campaign is being arranged to inform the community in Tallaght of plans for the National Children’s Hospital and the Urgent Care Centre at Tallaght Hospital.

He had first raised this question at a special session in the Council Chamber at County Hall which had been arranged to inform local Councillors of plans in respect of the new

development.

He had pointed out to Eilish Hardiman, CEO Children’s Hospital Group and John Pollock, Project Director, the importance of people in the catchment area of Tallaght Hospital being fully informed of the plans.

The project team has now told Charlie O’Connor that an information display of the plans is being arranged for the Square in Tallaght and details will be formally announced shortly.

He has also been told that each home in Tallaght is to receive a copy of the newly

published National Children’s Hospital Connect newsletter which highlights plans for the project and answers a number of questions which are regularly posed in respect of the plans which were recently submitted to An Bord Pleanala.

According to Charlie O’Connor there will, of course, be particular interest in the area with regard to the proposed Urgent Care Satellite Centre at Tallaght hospital and he expects that local residents will have questions in that

regard.

The new National Children’s Hospital team has also given confirmation regarding two other issues which are of interest to the people of Tallaght and which had been raised with them by Charlie O’Connor.

They have confirmed that as part of the new Satellite Centre project the Creche which currently operates in

Tallaght Hospital will be relocated to another location on the Tallaght Hospital Campus. They add that the new Creche will be of equivalent capacity of the existing facility but will be designed and built to current standards for a modern child care facility.

On the question of the gateway entrance from the Luas Hospital stop into the

hospital, Charlie O’Connor has again been told that this development will be included in the planning application for the Creche and other elements of the project and this will be lodged in the coming months. They also say that Tallaght Hospital will then assume responsibility for the works associated with this entrance.

councillor urGes Homeowwners to consider tHe rent-aroom relief scHeme and earn uP to €12,000 a year, tax-free

With third-level institutions now returned after the summer break, Councillor and Dublin South West General Election Candidate, Anne-Marie Dermody,

has welcomed back students and urges to homeowners consider the rent-aroom relief scheme, a scheme that many residents of Tallaght are not aware of, which

could benefit both students and homeowners.

For students looking to find accommodation, it can be a daunting experience, but with numbers of students in

further education increasing it is adding to the lack of suitable student accommodation, which is adding unnecessary extra panic and pressure to students.

Students need to focus on their studies but the of student lack accommodation is distracting students who are still looking for accommodation, even though the semester

has begun.

Councillor Dermody has therefore called on homeowners to consider renting out any spare room they may have, to students.

This will help to provide accommodation to students who are to find struggling suitable accommodation, while also having a benefit to the homeowners who do decide to rent out any spare rooms that they may have in their house.

“Many homeowners of Tallaght are unaware of the rent-a-room relief scheme that could not just help students in finding accommodation, but provide also homeowners that have a spare room, with up to €12,000 a year, tax free”, Councillor Dermody said.

The criteria for being entitled to this scheme is simply that the homeowners’ house must be located in Ireland and that it is occupied as a sole residence. The relief applies only to residential tenancies, not to short-term guest arrangements.

long-term basis, which includes renting a room to a student for the academic year.

However, taking in guests for short-term breaks is not.

From the tax year 2015 onward, the total (gross) rent that homeowners get, which includes sums that the tenant pays for food, utilities, laundry or goods and similar services, cannot exceed €12,000 in the tax year.

Rent-a-room relief will not affect a persons mortgage interest relief or their exemption from Capital Gains Tax (CGT) if they sell their home.

For interested homeowners, further information and how to apply is available on the Revenue website www.revenue.ie, where they will find all relevant information regarding the rent-aroom scheme.

“I believe that homeowners should take advantage of this relief scheme where possible.

It’s an opportunity for them to earn up to €12,000 a year, tax free, which furthermore eases the pressure for students still struggling to find suitable accommodation. “

revised lett’s field HousinG ProPosal ‘a fair comPromise’

Sinn Féin Councillor Eoin Ó Broin has described the revised Lett’s Field Housing proposal as a ‘fair compromise’.

The revised proposal was passed by South Dublin County Council on Monday 21 September.

Ó Broin said ‘South Dublin County Council originally proposed building 48 Council homes on Lett’s Field, North Clondalkin. The proposal would have removed the existing soccer pitch, had a negative impact on St Peter Apostles Senior and Junior schools special autism units and resulted in the loss of the majority of the green space amenity currently used by the

surrounding estates.

‘Sinn Féin engaged in an extensive consultation with residents in Moorefield and Woodavens and the principles and staff of both schools. We made a detailed submission to the Council asking them to revise the proposal to take account of these three issues.

‘I am pleased to say that the revised proposal from the Council adequately addresses all of the key concerns highlighted by Sinn Féin in our submission.

‘The revised proposal has 37 units. They are designed in such a way as to avoid having any negative impact on the existing and future special autism units in

‘On the basis of the significant revisions to the original proposed plan Sinn Féin Councillors supported the revised proposal when it came to the full Council on Monday 21 September.

No Councillor from Clondalkin or the rest of the County voted against the proposal, all but one voting in favour a single with abstention.

‘The revised proposal is a fair compromise between the need to protect amenities in our community and the need to provide housing for people on our waiting lists. However there is clearly a limit to the amount of infill housing that North Clondalkin can take and Sinn Féin will continue

welfare decision on lucan site raises issues

Dublin South West Seán representative Crowe TD has claimed that a landmark decision by the Department of Social Protection that JJ Rattigan workers involved in the construction of a Department of Education school in the Kishoge site in Lucan are employees rather than self-employed is a welcome development but raises other serious questions regarding state policy in this area of employment.

Deputy Seán Crowe said “For a long time the small amount of available jobs for workers in the construction sector was in the building of schools and campuses authorised by the Department of Education.

“Building workers continually claim that the vast majority of these jobs were filled by the ‘black economy’ or by workers having to

“Currently it is estimated that there are 365,000 RTCs (Relevent Contract Tax) or Subcontractor certificates in the state and it is reasonable to assume that many of them, if not the majority of them are produced for bogus reasons. “you have the crazy situation that now exists where the bulk of the work is being stimulated by state contracts and for some bizarre reasons various state entities are turning a blind eye to contractors subletting work out to contractors who ignore and break employment laws ‘willy nilly’.

“Workers who should be employed directly in the traditional way are being forced into subcontracting by employers, to allow contractors shirk their responsibilities such as the minimum wage, employer PRSI, illness

benefit and jobseekers benefit.

“On the Kishoge Building site in Lucan it is reported that workers were being paid a miserly €5 an hour.

“RCTs are being so flagrantly abused that some recruitment agencies actually advertise that normal workers entitlements do not apply.

“Some within the Department of Social Protection even go as far to admit that they cannot police the current system which encourages fraud, tax defaulting, and rogue employers.

The Department of Education seem happy to get the schools and campuses built and delivered regardless of the social cost.

“The chaos in which the Irish construction industry is in with regards to widespread bogus self-employment has serious consequences for workers and legitimate employers who are

being priced out of contracts.

“Workers are left high and dry with regards to basic workers’ rights, the state is also cheated out of considerable amounts of tax and PRSI and decent employers who employ directly have a huge competitive disadvantage over these cowboy and ‘fly by night’ builders.

“The government and its various Departments are complicit in allowing these illegal activities expand and multiply across the construction sector.

“The tax authorities and Department of Social and Family Affairs seem slow to respond to workers and their representatives that claim there is widespread abuse

occurring in the sector.

“The Department of Education would appear to be content to ignore what is happening on sites educational appearing powerless to prevent and stop the practice of forced and bogus sub-contracting.

“The government need to introduce urgent regulation to ensure that direct employment is the default position

not the norm for in the workers construction industry.

There also needs to be greater penalties put into place where a person is falsely reported as selfemployed and the practice of state tenders need to put under greater controls and prohibit abuse of bogus self-employment practices”

Dublin Senator Catherine Noone, has said that a recent report in the US raises fears that some young people could be using e-cigarettes to disguise cannabis use.

“This report, published this month in the health journal ‘Pediatrics’, has found that one in five American students are using e-cigarettes to inhale cannabis in a vaporised form. This is

obviously far from their intended purpose.

“This report raises fears that Irish teenagers are doing the same and is surely a concern for both parents and medical professionals alike. In my view it poses a real health risk, while also completely disguising the use of cannabis. The research is worrying, especially against the backdrop of the rapidly accelerating

use of e-cigarettes in Ireland.

“I welcome new rules for e-cigarette advertisements which have been announced today by the Advertising Standards Authority for Ireland (ASAI). The new rules mean that marketing for ecigarettes should be socially responsible and should contain nothing which promotes the use of tobacco products, or

shows the use of a tobacco product in a positive light.

“It’s clear that clarity and regulations are needed soon in relation to e-cigarettes, as this has gone unchecked for too long. It’s also clear that people need to be aware of this potential secondary use for ecigarettes for inhaling cannabis, and it is this awareness which I wish to raise.”

Dr. Lydia Foy was presented with the European Citizens’ Prize at a ceremony which took place in Dublin last week. The European Citizens’ Prize was launched by the European Parliament to recognise exceptional achievements by Europeans. Dr. Foy was awarded the prize for her exceptional work over many decades for Transgender Rights.

Lydia Foy began her long battle in 1997 when, represented by FLAC (Free Legal Advice Centres), she took legal action for the right to have her female gender legally recognised in Ireland.

Speaking at the ceremony in Dublin, Lydia said: “I am both proud and thrilled to accept this European award. The award is being presented to me but I accept it on behalf of

all those who have worked with me over the decades on Transgender Rights. In particular I would like to thank FLAC for all its advice, support and very difficult legal work through the years.

Today is an acknowledgement of all of that work.

“It is a great day for me and for the Trans community in Ireland.

With this piece of paper and after 22 years of struggle, my country has finally recognised me for who I really am, not for what other people think I should be. I am especially pleased for young Trans people – that they will not have to go through the pain, the isolation, the lack of understanding and the abuse that my generation had to endure.

“I am deeply honoured to be given the Medal of

Honour by the European Parliament and I regard it as a tribute to all those who have helped us to become equal citizens of this State. I would also like to thank MEPs Martina Anderson, Boylan, Matt Lynn Carthy and Liadh Ni Riada who proposed me for this honour.”

Also speaking at the ceremony, Dublin MEP Lynn Boylan said: “This ceremony is a terrific occasion as it at last recognised Lydia Foy’s work on Transgender Rights through the decades. It was never an easy battle for Lydia and she had to overcome many

Four Educate Together national schools in Lucan have come together in an effort to improve, systematically, the way pupils are enrolled in their schools.

From October 1st, Adamstown Castle ETNS, Esker ETNS, Griffeen Valley ETNS and Lucan East ETNS operate a will coordinated admissions system: the Lucan Common Enrolment System (LCES).

The aim of this common enrolment system is to promote inclusive, integrated schools that serve the needs of local families. Essentially, children in Lucan will be able to access their most conveniently located Educate Together school on a fair, transparent and equal basis. The LCES aims to end the situation in which children are forced to crisscross all over Lucan to attend a school that is not necessarily their nearest one.

By default, current enrolment policies are creating segregation in

the school system, most notably in rapidly developing urban areas.

The Lucan Common Enrolment System aims to address this by levelling the playing field and giving every child equality of access to the most conveniently located Educate Together school in Lucan.

Under the new system, which prioritises students based on age, newcomer families will no longer be disproportionally disadvantaged in accessing schools.

Prioritising siblings and proximity to school will help foster local friendships and contribute towards a greater sense of community in the school.

council must Play a role in cleaninG Graffiti on Private ProPerty facinG onto Public areas

Fianna Fáil Councillor Paul Foley has secured agreement from South Dublin County Council to change its protocol on removing graffiti on private property that faces onto public areas.

The Templeogue Councillor tabled a motion demanding the change, saying it is completely unfair that homeowners are left

with the sole responsibility for on their graffiti property even if they share a wall with a laneway, park or other public area.

“I know of several houses, schools or churches in my own area that have a laneway running alongside them or that back onto a public

green or public area.

These are prime targets for vandals and they inevitably end up defaced with graffiti.

Until now the walls or side entrances have been treated as the sole private property of the homeowner and the has no Council responsibility in cleaning up the mess,” said Cllr Foley.

“This is very unfair given that many of these property owners don’t have the means or expertise required to clean the graffiti themselves. I believe that just as the Council is liable to clean up graffiti in public areas, it should also play a role in cleaning up graffiti on private property that faces a

strategic public area.

The whole community suffers when a public area is left unsightly and the Council must play a role in addressing this.

“I am delighted that the Council, on foot of my motion, has now agreed to work with property owners to agree a means of removing this graffiti.”

The official launch of the LCES takes place in Finnstown Castle Hotel, Lucan, on October 1st 2015 at 11:00 am.

Members of the school communities will outline the rationale and the mechanism of the new system at this launch.

q. i have worked in a restaurant kitchen for over 5 years. i was dismissed recently because i was taking scraps of food home to my dog. i was just called into the office and told that i was being let go. this seems very unfair to me.

Would i have any right of action?

a. If you were simply called in to the office and advised that you had been dismissed as a result of some apparent misdemeanour and, there was no formal investigation then, without a doubt, the Employment Appeals Tribunal would consider your dismissal to be unfair and you would be entitled to compensation or reinstatement if that is an option. All Employers are obliged to have a written disciplinary process and provide Employees with a copy of that process. It is always understood that every Employer must act fairly, consistently and objectively by adhering to Natural Justice and Fair Procedures at all times. An Employees right to fair procedures and Natural Justice stem from the Constitution and the Employment Contract. This being the case, even if you have no written Contract. At the very least, this provides the following minimum rights to all Employees: -

i) The right of the Employee to be informed of the allegations in writing against him/her; ii) The right to be heard and to respond to those allegations; iii) The right to representation in presenting that response; iv) The right to a fair and impartial hearing and determination of the issues;

If none of these rights were afforded to you then you should immediately lodge a claim with the Employment Appeals Tribunal as you have 6 months only from the date of dismissal in which to lodge a claim. In addition, you should contact your Employer and try to speak to a senior member of management to ensure that a more junior member of staff did not act

without authority.

This would be important if you would like to have your job back. If this route is successful then, you should insist and indeed are entitled to be paid for the time you have been out since the dismissal. Remember that the action you took is only one aspect of an Employment Appeals hearing. your Employer is obliged to operate fair procedures and irrespective as to the alleged wrongdoing, you can succeed in your case if your Employer failed to follow those fair procedures.

q. i work in a hairdressers and have been working there for over 3 years. i was sick on a Monday recently and did not show up for work. unfortunately, i did not get a chance to notify my employer until nearly lunchtime. i received a text in response saying that i was dismissed. is there anything i can do? a. you do not say whether or not you have a written Contract of Employment. In addition, it would be important to ascertain whether or not you have any previous record with your Employers regarding unauthorised absences.

Assuming however that you have a good HR record then, it would appear as if your Employer has acted fair too hastily and is likely to be found in breach of their obligations under Employment Legislation.

There are strict guidelines to be followed for Employers when considering any disciplinary action against an Employee.

It would appear from your letter that your Employer did not follow any acceptable procedure in dismissing you. you are entitled to a hearing and to be represented by a fellow worker or friend during that hearing. Clearly, you were not made aware of the seriousness of your action and, as such, should have been given the opportunity to be represented.

It is completely inappropriate for an Employee to be dismissed by text and it is hard to envisage any circumstances where an Employer would succeed in an action taken by an Employee for Unfair Dismissal in those circumstances. Given the very harsh action of your Employer, we would suggest that you immediately lodge a claim with the Employment Appeals Tribunal for Unfair Dismissal.

q. We operate a small business and have concerns about the performance of one of our employees. He travels for us in sales but we think spends a lot of time on personal business. We are nervous about starting any investigation without legal advice. Could you please advise as to what we can do?

a. It is extremely important to follow fair procedures when commencing any investigation into the behaviour of an Employee. Firstly, you should check your Employee’s Contract of Employment and ensure that it contains a Grievance & Disciplinary Procedure or Process. If so,

this must be followed. It is important that all Employees are entitled to Natural Justice and fair procedures.

If the grievance procedure does not include details as to how a disciplinary process should commence, you should nonetheless ensure that the procedure encompasses the following steps. a) b) c)

d) e)

Investigation; The provision of information to the Employee; The right to representation by the Employee; That the conduct of the disciplinary hearing is transparent and fair; That the Employee is afforded the opportunity to appeal any disciplinary sanction.

Firstly, you have the Investigation. This needs to be a thorough fact-finding investigation where all the information is gathered on the allegations being made, potential witnesses interviewed and documentary evidence must be prepared by the Employer. This then allows the Employer to make a decision as to whether there are grounds to hold a disciplinary hearing. An investigation report should be complied and a decision made by way of a recommendation or otherwise that the matter should proceed to a disciplinary hearing. It is vitally important that the person who conducts the Disciplinary Investigation or makes the recommendation as to what follow on procedures should flow from that investigation should have no further input into the matter as it needs to be impartial.

If there is sufficient evidence following the investigation to merit an investigation into the Employees actions then, the Employee should be advised that the matter under investigation is to proceed to a disciplinary action. A letter of invitation should be issued to the Employee of the Disciplinary hearing, with full details of all allegations being made against the Employee together with copies of all documentation which the Employer will be seeking to rely upon at the Disciplinary Hearing. The investigation report should be furnished with that letter. Remember that the Employee is entitled to be accompanied and represented at that hearing and this should also be outlined in the letter to the Employee. The Employer must permit the companion of the Employee to address the hearing in order to put forward the Employee’s case. Adequate time must be afforded to the Employee to prepare their case for the Disciplinary Hearing. It is also important that an objective person must be present during the hearing whose duty is solely to take notes and who should not be involved with the hearing in any other way. In the event that any new matter is raised during the hearing then, this must be thoroughly investigated and an

opportunity afforded to the Employee to deal with this new evidence outside of the hearing. Following the hearing, and any resumed hearing, the Employer should consider the evidence and response from the Employee in full and make an informed determination of the disciplinary sanction to be imposed.

When the findings are being notified to the Employee in writing, the Employee should also be notified of the right of appeal.

Written notification should state to whom the appeal should be addressed and the deadline by which an appeal must be lodged (5 days is usual). The opportunity to appeal against a decision is essential to Natural Justice. Employees may choose to raise appeals on a number of grounds which could include the perceived unfairness of the judgment, the severity of the penalty, new evidence coming to light or procedural irregularities. The Employer must consider the grounds when deciding the extent of any new investigation or rehearing in order to remedy previous defects (if any) in the disciplinary process.

Appeals should be dealt with as promptly as possible. A time limit should be set within which appeals should be lodged.

The time limit may vary between organisations but 5 working days is average for lodging an appeal. A time limit should also be set for the hearing of the appeal.

Wherever possible, the appeal should be heard by an appropriate individual, usually a Senior Manager not previously involved in the procedure.

In writing to the Employee, he or she must be informed of the arrangements for the appeal hearing and also of their Statutory right to be accompanied at those hearings. Where new evidence arises during the appeal, the Employee and their representative should be given the opportunity to consider this additional information before any determination is made. The appeal may be adjourned to investigate or consider such points. An Employee must be informed of the results of the Appeal and the reasons for the decision as soon as possible and this should be confirmed in writing. If the decision constitutes the final stage of the organisation’s appeal procedure, this should be made clear to the Employee.

Remember that all dismissals of Employees are deemed to be Unfair under the Unfair Dismissals Act. The onus is at all times on the Employer to justify the dismissal. The Employer must be able to demonstrate that the Employee’s right to natural justice and fair procedure was adhered to throughout the process. At least 70% of Unfair Dismissal cases are lost

by Employers, not often for the reason giving rise to the dismissal or the disciplinary sanction, but more usually because of a failure on the part of the Employer to follow fair procedures.

Any children or adults in the South West Dublin area, who fancy themselves on the dancefloor, could do a lot worse then make their way to Spin Dance and Fitness located at Walkinstown Cross, near Spin Roller Disco.

Brian Redmond, who is the founder and managing director of Spin Dance and Fitness since it's opening in 2007, is keen to stress that they are keen to promote three upcoming classes 'Children's Ballroom and Latin Dance (firmly of the Strictly Come Dancing variety'!, 'Children's Stage School' and 'Aldo Children's Freestyle'.

The stage school, which runs every Saturday from mid-day to 5.30 pm, and caters for children as young as six, involves five classes - including singing, drama and musical theatre classes. There are also children's classes - available in Ballroom and Latin, Hip-Hop and Street, Classical Ballet and also Cheer and Gymnastics.

Adults, meanwhile, can enrol in Zumba - a dance aerobics class which includes Hip-Hop, Latin, Lunges and Squats, Pole Fitness - which develops muscle tone and flexibility whilst also helping to improve self-esteem, Ballroom and Latin with Brian, Sandra and Tom and also Wedding Dance.

Let’s Go Mental is a nationwide campaign to promote positive mental health in young people. This campaign has been developed by teenagers for teenagers and involves a series of 31 events in every local authority area to promote positive

mental health through music, sport, the arts and other fun activities.

The Let’s Go Mental events are being organised and run by the 31 Comhairle na nÓg and will take place all over the country from May to October 2015.

Leinster Rugby and the FAI will encourage young people to ‘Get Moving’ on the day, there will be yoga and Mindfulness to help Be Aware’, ‘connecting’ through art and local organisations, An opportunity to Give and a number of organisations encouraging people to ‘Get Involved’.

Lunch will be provided, with entertainment from local bands!!

Comhairle na nÓg AGM will also take place during the event offering young people an opportunity to get involved in local policy, and tell us what young people would like us to work on during 2016!!

South Dublin County Council awards contract to study feasibility of developing a flagship tourist attraction in the Dublin Mountains

The Council has recently awarded a contract for the development of a feasibility study and for a masterplan proposed flagship tourism related facility for the Dublin Mountains. The facility will act as a key tourist attraction to the Dublin Mountains and is aimed at making the great outdoors on Dublin’s doorstep, a must see part of the visitor experience to Dublin.

Chief Executive of South Dublin County Council, Daniel McLoughlin signed a contract with Paul Keogh of Paul Keogh Architects to carry out the study and to identify a preferred option for the location of the facility in order to recognise the role

the mountains can play in attracting visitors to the region.

South Dublin County Tourism Council’s Strategy positions the outdoors as part of the visitor experience of Dublin and is aimed at making the experience of Dublin’s outdoors accessible and enjoyable for all. The rivers, parks and mountains of the County play an important role in attracting visitors to the region and a facility in the Dublin Mountains has the potential to act as a flagship destination for tourists and a great amenity for Dubliners too.”

The feasibility study will examine the requirements for core facilities and services/activities

required by visitors the including interpretation of the history and heritage of the locality, a possible offering, food reservation and booking opportunities, along with reception and orientation facilities for walkers and visitors to interpret the landscape and experience the currently routes available to them in the Dublin Mountains. One such walking route is the Dublin Mountains Way which was recently included in an international travel guide setting out the 1,001 most scenic walks in the world.

€250,000 for new cHild care facility in deansratH ‘Let’s Talk About Childcare’ campaign seeks parents’ views

Labour TD Robert Dowds has welcomed news that around a dozen childcare facilities in Clondalkin, Lucan, Palmerstown and surrounding areas have been awarded grants as part of a €7m scheme for early years services.

The grants announced include €250,000 to build a new childcare facility on the grounds of St. Ronan's Primary School in Deansrath, where the existing childcare facility in St. Ronan's Community Centre will move to.

Some of the other childcare facilities which will benefit from grants include Naoínra Tír na nÓg in Palmerstown, Dublin West Limetree Childcare on the Bawnogue Road in Clondalkin, St. Finian's Childcare Services in Lucan and many others.

“These grants will help facilities keep up with the demands of a busy modern childcare service,” said Robert Dowds.

The news comes as Labour launched their new ‘Let’s Talk About Childcare’ campaign.

Parents are being encouraged to fill out a short online survey on labour.ie/childcare.

The results of the survey will feed into the party’s election manifesto process.

A working group has also been set up within the Labour Parliamentary Party to help examine the issues surrounding childcare, while other elements of

the campaign include public meetings, online videos and local literature.

Speaking about the campaign, Deputy Dowds said: “We want to hear from parents about their childcare arrangements, what works and what doesn’t and more importantly how things could be made easier for parents across Ireland.

“There is no one-size fits all solution to the

issue of childcare. It is clear however that we need to ensure that our children are provided with the best quality childcare and our campaign is a sincere attempt to achieve in a way that enables parents to have a real input.

“In view of this, I’d strongly urge parents in Clondalkin and Lucan to participate in our simple questionnaire, which is at labour.ie/childcare "

conGrats Goes out to GranGe minister Ged nasH announces tHe details Golf club's sHeena mcelroy of national women’s enterPrise day Congrats goes out to Grange Golf Club's Sheena McElroy who finished in tenth place in Rosslare's Irish Senior Women's Open Strokeplay Championship.

The title went to Marilyn Henderson, with McElroy twelve shots off the pace with a threeround total of 248. It came hot on the heels of her participation in the Irish Senior Ladies Squad that won bronze for the second consecutive year in the European Senior Ladies Team Championships, which took place between September 1st-5th.

Ireland won the title in 2013.

McElroy,partnered by team-mate Mary MacLaren of Royal Portrush, finished as third-highest Irish qualifier after shooting 162 over the two rounds. Suzanne Corcoran (Portuma), Gertie McMullen (The Laura Webb (East Island), Berkshire), Carol Wickham (Laytown & Bettystown) were also on the team, which was captained by Mary Madden (Ballinasloe) and managed by Valerie Hassett (ILGU President/Ennis). Pat Doran of Donabate and Mallow's Mary Dowling were first and second reserves respectively.

Ireland narrowly ran out winners over Belgium in the quarter-finals,

before losing to France in the last four and comfortably beating Germany 4-1 in the third place playoff.

Well done also to Lucan's Mervyn Eager, who put in a commanding display before ultimately having to settle for a fourth place finish in the Leinster Veterans Amateur Open Championship in Seafield Golf Club.

Eager's two-round total of 159 left him nine shots of the pace set by victor Billy Donlon (Birr).

Donlon shot 77 on the opening day before a more impressive secondround 73 handed him the title, with Peter Cowley of Cork Golf Club finishing in second place. Cowley, who won the Connacht Veterans Amateur Open Championship the previous week at Tuam Golf Club, was hoping to make it a double success but had to settle for the runners-up position after finishing three shots off the pace.

On a related note, AMA Ireland will be holding a golf classic at Castlewarden Golf Club this week as they bid to raise funds for the staging of the WUKF World Karate Championship at Citywest in 2016.

Have you ever heard any of the above before? A variety of diets and tools are available, but beware their quality may vary.

This article may help.

I am going to help myth bust and provide facts and tips about weight loss, nutrition, and physical activity. This information may help you make healthy changes in your daily habits and also help to give you advice on a healthy eating plans and safe ways to lose weight and keep it off!!

MytH: Fad diets will help me lose weight and keep it off.

FaCt: Fad diets are not the best way to lose weight and keep it off.

These diets often promise quick weight

loss if you strictly reduce what you eat or avoid some types of foods. Some of these diets may help you lose weight at first. But these diets are hard to follow. Most people quickly get tired of them and regain any lost weight.

Fad diets may be unhealthy. They may not provide all of the nutrients your body needs. Also, losing more than 3 pounds a week after the first few weeks may increase your chances of developing gallstones (solid matter in the gallbladder that can cause pain). Being on a diet of fewer than 800 calories a day for a long time may lead to serious heart problems.

tip: Research suggests that safe weight loss involves combining a reduced-calorie diet with physical activity to lose 1/2 to 2 pounds a week (after the first few weeks of weight loss). Make healthy

food choices. Eat small portions. Build exercise into your daily life.

Combined, these habits may be a healthy way to lose weight and keep it off. These habits may also lower your chances of developing heart disease, high blood pressure, and type 2 diabetes.

MytH: Grain products such as bread, pasta, and rice are fattening. I should avoid them when trying to lose weight.

FaCt: A grain product is any food made from wheat, rice, oats, cornmeal, barley, or another cereal grain.

Grains are divided into two subgroups, whole grains and refined grains. Whole grains contain the entire grain kernel—the bran, germ, and endosperm.

Examples include brown rice and wholewheat bread, cereal, and pasta. Refined grains have been milled, a process that

removes the bran and germ. This is done to give grains a finer texture and improve their shelf life, but it also removes dietary fiber, iron, and many B vitamins.

People who eat whole grains as part of a healthy diet may lower their chances of developing some chronic diseases.

Government dietary guidelines advise making half your grains grains.

For whole example, choose 100 percent whole-wheat bread instead of white bread, and brown rice instead of white rice.

tHe new me at 41 ..... witH a fantastic future aHead

Caroline is aged 41, Married, Mother of 2 children and lives in Tallaght.

Like most people Caroline struggled to lose weight and found it difficult to manage her family’s meals around her busy life. Caroline is now 21lbs lighter and feels healthier than she has ever been. Caroline can now see a fantastic future ahead.

Caroline joined Slimming World in January 2015 a week before her 41st birthday. Caroline wanted to learn how to eat healthier and lose weight and get the whole family involved.

She couldn’t believe the simplicity of the eating plan and the way you could eat so much!!.

Once she got used to it, she loved it.

What she really loved about the Optimising Plan was the recipes and the fact that her family really loves the food that she cooks for them. Before she used to cook at least two different

meals everyday but now they all eat the same. The family favourites are BBQ chicken and Spaghetti Bolognese.

When she started in January 2015 she weighed 11.14lbs and now she weighs 10.07lbs. A total loss of 21lbs.She feels like a new woman and best of all looks and feels great.

Caroline is also a sufferer of coeliac disease and has to be careful to follow a strict gluten free regime. Following the plan has not been a problem for her even with the restrictions that her condition places on her. Her husband loves the fact that she has an in depth knowledge of what ingredients is in each meal and her daughter(14) and son(21) are very proud of how much weight she has lost in such a short space of time.

the time and she is living proof of the plan working Caroline attends her group on a Thursday morning and her consultant is called Pauline. She is like a lifeline to her and is always helpful anytime of the day. Her support has been great from day one and when Caroline lost just ½ pound the first week Pauline said “that was ok and small steps at a time” are alright. She was so right!! .

Caroline stays in group every week as she finds this helps her out with lots of tips and new recipe ideas from everyone that’s there and has a lovely cup of tea and a chat with the other members. Caroline loves the fact that she has made great friends some of whom are now her best friends. This has been a huge help with her own weight loss.

Caroline has embraced the plan so well she has won Slimmer of the week, Slimmer of the month and Woman of the year!!!!!

News that Matchbox Twenty frontman Rob Thomas was releasing his third studio album was music to our ears with The Great Unknown hitting shops earlier this month.

Although the new album does not quite reach the heights of the American singer’s debut Something To Be it is well worth a listen – especially for the brilliant cameo by Dublin singer Ruth-Anne Cunningham.

The 27-year-old songstress sings backing vocals throughout the album and also shares the lead with Thomas on Paper Dolls.

1. i think We’d Feel good together – An upbeat track with a dance rhythm kicks off the new album. A beat that will have you tapping your toes and nodding your head 3/5 2. trust you – The first single from the album has already received plenty of airplay stateside so expect to hear it on Irish stations very soon. The radio friendly chorus will have you singing along as soon as you hear it 3/5 3. Hold on Forever – There is a real old school, folk vibe to this track. Brilliantly showcasing Thomas’ voice this song is very catchy. A definite finger clicker 4/5 4. Wind it up – A throwback to older stuff from Thomas,

this song is a little stunted.

The melody is chopped and changed from one moment to the next, making it tough to give in to the music 2/5 5. one shot – A great guitarbased song which will have people singing in the aisles.

Anthemic and positive, an uplifting and bright track 4/5 6. the great unknown – The title track from the album will pull you in and mesmerise you. The dark melody and questioning tone will bring you along and make you think 3/4 7. absence of affection – An upbeat tune with a disco sound. This is not what Thomas does best, yet it is very radio friendly and catchy 2/5 8. things you said – This song showcases Thomas’ great talent for storytelling.

He sings the song with the urgency of someone who wants you to know what he is saying 3/5 9. paper Dolls – Another haunting story from the Matchbox Twenty frontman and a contender for best song on the album. In this edition we will take a look at some of the best vacation movies to watch with the kids or as an escape from the dark skies of winter which is fast approaching.

4. We’re the Millers – A hilarious comedy about a small time drug dealer who gets his neighbours to pretend to be his so as he can smuggle product for his boss.

The murderous ‘family’ take their RV on a trip to Mexico and getting themselves into all sorts of dodgy situations with hilarious results. Jason Sudeikis and Jennifer Aniston are outstandingly funny.

5. in bruges – Possibly Colin Farrell’s best ever role, this movie will instantly make

you want to take a trip to Belgium. The story of two hitmen who have to lie low in Bruges after an innocent bystander is killed on the job. There are twists and turns as well as fantastic acting by Farrell and Brendan Gleeson but Bruges is the real star of the piece and looks beautifully welcoming.

Laughter really is the best medicine so if you are planning a big night out why not make sure that it comes with a healthy dose of comedy.

There are so many options for people heading out on the town but going to a comedy show ensures that you really get your money’s worth.

We all feel better about life after a good belly laugh and there are plenty of those in shows taking place across the county over the next couple of months.

The Civic Theatre in Tallaght and Draíocht in Blanchardstown have some of the countries most talented comics performing in fantastic intimate venues – PJ Gallagher, Jason Byrne, The Nualas, Al Porter, Des Bishop, Jarlath Regan, David O’Doherty and Colm O’Regan have all graced local stages over the years.

The winter/autumn schedule for these venues offer stand-up comedy, hilarious shows and plenty of big names from October to January.

Draíocht will welcome Sam Brady’s one man comedy show on October 1 while PJ Gallagher and Joanne McNally will bring their show, Separated At Birth, to the venue on October 16.

The show is an eclectic style of funny from the hilarious duo who both happen to be adopted and will also visit the Civic Theatre on October 29.

The Tallaght venue will also host The Nualas on October

10 with their own special brand of comedy as well as a range of comedy shows including How To Keep An Alien and Wrapped, both taking place in November.

Earlier next year Irish comedy talent Jason Byrne will bring his brand new show – Twenty years A Clown – to Draíocht and tickets are on sale now.

If you are after a laugh and want to travel a bit further afield outstandingly funny Tallaght comedian Al Porter will bring his show to Vicar Street on October 17 while Dara O’Briain will return to the venue in November.

Meanwhile December will see Mrs Brown’s Boys take the 3Arena by storm in what looks to be more sell-out pre-Christmas gigs.

American funnyman Kevin Hart will also perform at the same venue in January – expect strong language and controversial opinions from the Roast host.

So if you are staying in and wishing or hoping for a vacation these movies should keep you going until you have the time to plan the real thing.
