NEARLY 4,000 VACANT HOMES REMAIN ACROSS SOUTH DUBLIN Sinn Féin Housing spokesperson Eoin Ó Broin TD has commented on CSO census figures which indicate that there are still nearly 4,000 homes vacant across South Dublin County Council. Deputy Ó Broin has said that while this figure is down on five years ago it is still unacceptable ‘at a time when over 200 households in the County are homeless. Deputy Ó Broin said: “Despite the census figures showing a marginal drop in the number of vacant properties nationally, 198, 358 is still an

high vacant
“‘In South Dublin County Council area there are 3,923 vacant properties. While the rate of vacancy in South Dublin is the lowest in the state it is still a shocking figure. There are more than 200 homeless families in the county. There are 9,000 families on the Council waiting list. Private sector rents remain unacceptably high and affordable housing is a dream for many. “The Housing Agency
Vacant Homes Paper published in May this year recommended a number of measures to incentivise and force owners to bring these units back into use. These measures include refurbishment grants, compulsory purchase orders and a vacant property tax.
“The Report of the Dáil Housing and Homelessness Committee endorsed the recommendations made by Housing Agency. This included recommending that the Government should develop an over arching two year strategy

which would include each local authority performing an audit and producing and empty homes strategy with clear aims and objectives. “Finding ways to return as many of these vacant properties as possible back into use would make a dent in the current severe housing deficit. The properties could be used to get families out of emergency accommodation and off the housing list. ‘South Dublin County Council is already using compulsory acquisition powers to bring some vacant sites back into use.

However the Minister for Housing must allocate more to the Council to allow them to acquire a greater number of these units. “The Minister also needs to incorporate all of these recommendations in the final version of his national Action Plan for Housing. It is not too late to improve on the draft plan and close the gap between the recommendations made by the cross party Dáil Housing and Homelessness Committee and those in the draft plan.”

Fianna Fáil TD for Dublin Mid-West John Curran calls for renewed focus on waiting lists as new figures from the National Treatment Purchase Fund show that the number of patients on treatment waiting lists has reached another new high. Commenting on the newly released figures John Curran said: “If current trends continue by the end of the year, there will be well over 80,000 on the Inpatient Day Case list and 450,000 on the Outpatient list, so the Government and the HSE really need to get a grip on the situation. In my own area of Dublin Mid-West the latest waiting list figures in Tallaght hospital show that at the end of June 2016, some 4,057 patients are now waiting for in-patient
/ day case surgery – this is a very high figure that deserves urgent attention from Government. The waiting lists for hospital procedures have been on a consistent upward trend for some two years now. The corresponding figure for June 2014 in Tallaght Hospital was 1,414 so we have an increase of almost 55% since then. Government targets on waiting times have been consistently missed, even when they were widened. An 18 month target to be achieved one year ago has again been missed and 733 people are now waiting more than a year and a half for treatment at Tallaght Hospital. The number of patients stuck on outpatient waiting lists also
continues its upward trend and again the targets continue to be missed. Some 20,498 people are waiting to see a consultant at Tallaght Hospital with 1,276 waiting more than 18 months to see a consultant. Scandalously more than 5,000 children are waiting more than a year for an outpatient appointment in the Children’s Hospital Group. Of course this figure does not include children who may be waiting for appointments in other hospitals. To reduce waiting lists and waiting times I believe that we should reactivate the National Treatment Purchase Fund (NTPF) to purchase spare capacity from the private sector in order to reduce the number of public patients
waiting for treatment in public hospitals. We should also set and achieve a target of reducing scheduled treatment waiting times to the internationally recognised standard of three to six months. To
that end a special task force must be set up to produce a plan to ensure that all scheduled day case / inpatient care is delivered within the internationally recognised target of six months,” concluded Deputy Curran.

MEDICAL CARD BILL FOR LONGTERM SICK & TERMINALLY ILL CHILDREN Dublin South West TD Seán Crowe has welcomed his party’s new Dáil legislation that he says will address the current anomaly where long term or terminally ill children do not have access to a medical card. The current Government has promised action but nothing in reality has happened and Crowe is confident that this new legislation will address
some of the financial burden facing families. Deputy Seán Crowe said: “Families with a child that has a long term illness or is terminally ill should not have the added burden and worry of trying to meet astronomical medical bills but that is the reality facing families across the state. “The current Government promised reform in this area but there is clearly no urgency or any immediate proposals
to give a card to this group of children. “Measures should be taken to alleviate this burden and that is the purpose of the new Sinn Fein legislation. “Currently to access a Domiciliary Care Allowance a child must have a severe disability which requires ongoing care and attention, substantially over and above the care and attention usually required by a child of the same age. “Our legislation proposes to introduce
and allow for medical cards to be given to children who meet that criteria. “The Government‘s Programme for Government commits to doing this in Budget 2017, which we welcome, but we believe that this should happen immediately. “These children have already been deemed by the State to have a disability so severe that the child requires substantial care. “Not being able to access the medical card
without a full financial audit of a household families undue hardship and stress. This needs to stop and extending the medical card to children in receipt of Domiciliary Care Allowance is the first step in ensuring that critically ill children who need medical cards get access to them. “New Health Minister Simon Harris has met and made commitments to many of the families affected but they need immediate help. This proposed new legislation will do just that.”
ST. MARY’S NATIONAL SCHOOL SAGGART FUNDRAISER
Kind-hearted students from St Mary’s National School in Saggart raised money for the Multiple Sclerosis Society of Ireland recently. A bake sale at the Saggart school raised a total of €795 for MS Ireland in memory of a local parent who passed away earlier this year. It was decided to hold the event after one of the students at the school lost her mother to MS. There was a great turn out for the cake sale which was held in June with a cheque for €795 presented to MS Ireland a short while later. Teacher Roisin McSweeney handed over the cheque to the organisation with student Lucy and her father Keith.
CHILDREN IN LOCAL EMERGENCY ACCOMMODATION AT CENTRE OF HOMELESS PLAN Experiences of Frontline Agencies Informed Government Plans Statement by Minister Katherine Zappone The needs of Children in emergency accommodation in the South Dublin County Council area is at the centre of the new National Action Plan on Housing and Homelessness, according to Dublin South West TD and Minister for Children and Youth Affairs, Dr Katherine Zappone.

The Independent Minister said childcentred measures in the plan were drawn from the experience of frontline agencies such as Focus Ireland which are supporting families in Tallaght and surrounding communities. She said the measures are practical, fully costed and will deliver benefits for children
in Tallaght in the short term. Minister added:

“It is wrong that children caught up in the housing crisis are feeling lonely, frightened and in some cases hungry. Since my appointment I have been fully engaged with agencies working in the frontline of this crisis and we have worked together to ensure the needs of children are addressed.

are being taken to support families who are homeless because of difficulties such as domestic violence.
Free transport schemes will be in place for those children moved to far away emergency accommodation so they are not cut off from their school and friends.
I am keenly aware of the pressure and the trauma families are going through because of the loss of a home, the uncertainty about emergency accommodation and constant pressure to make ends meet.
There will be new supports so as families can pre-book crèche places.
The National Action Plan has measures which will improve the lives of families in Tallaght and throughout the South Dublin Council area.
A review will be carried out to make sure that children are being fully nourished, while we are looking at using Domestic Science Labs in schools as well as other facilities to allow family time.

20% PRICE HIKE AT BALLYMOUNT CIVIC AMENITY AND RECYCLING CENTRE SEEMS LUDICROUS – CURRAN Fianna Fáil TD for Dublin Mid-West John Curran has called the 20% price hike in Gate Fees at Ballymount Civic Amenity and Recycling Centre by SDCC and Panda Waste as Ludicrous. Speaking on the issue John Curran said: “According to SDCC the gate fees at Ballymount will increase from Monday August 1st at the facility. Prices will increase by 20% for customers. I am calling on South Dublin County Council and Panda Waste to seriously reconsider this price hike and bring the costs down for customers who want to recycle. The management and operation of Ballymount Civic Amenity and Recycling Centre changed on April 1st 2016. The facility is now operated by Panda Waste under the terms of a service concession contract between the
Council and Panda Waste. The contract allows the operator to increase gate fees at the facility after the initial period of 3 months has elapsed. Accordingly, the gate fees will increase from Monday August 1st at the facility. “A large transit van with general waste is increasing from €70 to €84, a car with green waste is increasing from €8 to €9.50 and a car and trailer with green waste only is increasing from €25 - €30.“We are supposed to be encouraging people and households to recycle and preventing fly tipping and dumping in our area; these prices are way out of line with this and I believe that South Dublin County Council and Panda Waste are losing the plot with such prices and must re-consider as a matter of urgency,” said Deputy Curran.

AT LARGE IN EDINBURGH!
ROUND TOWER VISITOR CENTRE South Dublin County Council is pleased to announce that construction works on the Round Tower Project commenced on the 23rd of May, 2016 and are scheduled to last 12 months. The Round Tower project will include the refurbishment of the 19th century Mill Cottages at numbers 1, 2 and 3 Millview Terrace and numbers 15 and 16 Tower Road. The upgraded cottages will house a series of exhibition spaces and small specialist retail.
At Large, a Dublin based theatre group, are proud to be taking three original plays to the Edinburgh Fringe Festival this August. All three plays were written and developed by members of At Large, a theatre company which focuses on producing new writing and bringing it to stage.
circumstances, and delve- with varying degrees of reluctanceinto themselves and their pasts.
The three plays, which will run for two weeks at this year’s Edinburgh Fringe Festival, are a result of At Large Theatre’s approach to developing original work through dramaturgical process and performance feedback.
In Nowhere now, written by Daniel O’Brien, commerce, politics and international relations come together absurdly and uncomfortably in a high-energy performance.
A company of writers, directors and actors, At Large Theatre work together under the ethos of protecting and nurturing the artistic vision of a playwright through all stages of production, an ethos which has allowed each of the three pieces to develop their own individual tone. Beryl, written by Lesley-Ann Reilly, is a deeply personal, characterdriven performance. Two strangers meet under unusual
The Meeting, a fond parody of workplace dynamics written by Gráinne Curistan, will resonate with any who have experienced office life and all its inhabitants.
In the lead-up to presenting these works on the international stage, At Large Theatre are proud to offer Irish theatre-goers the opportunity to view all three pieces in a showcase style performance in Dublin this August. All three plays will be shown on 5th-6th August, at The DU players, Trinity College Dublin. A new extension to the rear of the existing cottages will contain a bright cafe and associated service areas including lift and stairs. The entrance to the centre will be from a new public plaza on Tower Road. The cafe area will have an external terrace enjoying views of the 7th century Round Tower and a new public garden of stepped landscaped spaces. This project is progressing and the Council are delighted to announce that Tandem Partners Limited have signed a contract with South Dublin County Council on 27th of June, 2016 to develop and implement an Interpretation and Learning Strategy for the Round Tower Visitor Centre and Gardens. The project should
result in the permanent exhibition to be housed in the building which will offer insight into Clondalkin’s early Christian heritage including the history of round towers and monastic centres in Ireland and will also illustrate the urban development of Clondalkin, it’s people and stories over the last 1,200 years. The project will also include temporary exhibitions on heritage and arts themes. The Centre will compliment the active local scene in Irish language, music and culture, further enriching the cultural offering of Clondalkin. As part of their remit, the first stage of the process will involve Tandem Partners Limited carrying out research and review existing understanding, materials and archives in relation to early monastic settlements and St Mochua, and to provide a report summarising the potential audiences to the interpretation and exhibition area. The second stage of the process will result in a clear interpretative and learning strategy being produced. Tandem will oversee the creation, design and installation of the plan at Centre. Fit out is expected during April 2017.
The Round Tower Centre will achieve a key South Dublin tourism strategy objective of connecting our many parks and greenways, in the form of the Corkagh Park and the Grand Canal Greenway (which links in turn into the City Centre) to local Villages, like Clondalkin. This will ultimately deliver an integrated tourism experience featuring heritage trails and interpretation, food and outdoor Park and Canal-sidewalks. The development of the Round Tower is opportune as the Council are also commissioning a study of adjoining Corkagh Park to explore options for further enhancement of recreation facilities for
locals and visitors alike. The centre will help retain many tourists staying in the nearby hotels on the N7 and indeed for the 20,000 annual visitors to Camac Camping and Caravan Park. The Visitor Centre location close to Corkagh Park and the Grand Canal Greenway should meet the need for new and different heritage experiences beyond the City Centre and close to the natural outdoors which is an inherent part of Failte Ireland’s marketing of Dublin as the vibrant capital city bursting with a variety of surprising experienceswhere city living thrives side by side with the natural outdoors. The Centre will open in 2017.

ACTIVE APPS LIKE POKÉMON GO NEED TO BE SUPPORTED AND ENCOURAGED Senator Catherine Noone has said that active apps like Pokémon Go, which combine games with fitness, need to be supported by Government. “The video game Pokémon Go is currently sweeping the mobile gaming market in the US. I’m happy to see that in contrast to most video games which encourage a sedentary lifestyle, this one is actually inspiring teens to get out of the house and walk”. “Apparently this has already had a positive effect on gamer’s health and fitness”. “It may be the novelty factor, but Pokémon Go seems to be motivating people to exercise, even those who haven’t been active for some time. There are cases
reported in the US of previously inactive people getting out and about and walking for miles, to try to increase their Pokémon stash”. “Of course there is the concern of some young people not paying enough attention to their surroundings whilst walking around the streets, but I believe safety measures to remedy this could be implemented”. “For some time now I have been campaigning for Irish people to be more active and watch what they eat. According to the World Health Organisation, Ireland is on course to become one of the fattest nations by 2030. We should be doing everything we can to remedy this. Games which encourage people to be active can help”.
“I believe we should be actively encouraging gaming companies to combine games with
fitness apps and I’m asking the Minister for Finance in the upcoming budget to
consider incentives for gaming companies to develop apps that encourage activity.“
CROWE WELCOMES NEWS ON TYMON PLAY FACILITY Dublin South West Sinn Féin TD Seán Crowe has welcomed plans to reinstate the Play facility at Tymon Park. The play facility had been extremely popular and used on a daily basis. In response to a question raised by Deputy Crowe, the Council have confirmed that the tender for the works was advertised on 25th May 2016. Following receipt of tenders, analysis of them, recommendation for the appointment of a contractor and the actual appointment of the contractor, it is expected that the commencement of work on site will begin in September 2016.
Deputy Crowe said“This is fantastic news for the residents of the area who will soon have an exciting new play area for their children and grandchildren to play in”. “The play facility had been very busy and used on a daily basis. It was a great loss to the local community, particularly local grandparents and parents who used it often as it was in walking distance from many housing estates in the area”. “It is great news that the commencement of work will start as soon as September after years of delay. This is another positive development and I look forward to the official opening later this year. ”

The Union of Students in Ireland is calling on the Government to reject the “socially regressive” loan option in the Cassells Report and instead urged that the publicly-funded option be taken. The eagerly-awaited report into the higher education funding crisis was released this month with three possibilities including publicly-fullyfunded education paid for by the exchequer, secondly increased state funding to make up for the short-
USI President, Annie Hoey, explained that the loan scheme will cost students between €22,000 and €66,000 – and warned that huge debts like this will deter young people from applying to college. This cost would be an additional barrier for students who are already struggling financially and could mean a drop in the number of people applying to colleges around the country. Ms Hoey said: “It doesn’t matter how they present it, a loan scheme is still a loan scheme and still has the major problems associated with loan schemes,
such as widening the gap between the rich and the poor, graduate emigration and social regression. “Our generation is the first generation who will be less well off than our parents – how can we possibly progress with student loan schemes becoming the norm for young people? What bank would give a mortgage to a young couple or young professional already owing tens of thousands, up to their eyes in debt because of the cost of education?” The loan option is one of three possibilities presented in the Cassells Report which looks at third level financing. The USI welcomed one of the options – a publicly-funded free education system which the organisation said is the best option in terms of “practicality,
access, participation, progression, fairness and national ambition”. Trinity College Students Union President Kieran McNulty has thrown his weight behind the campaign signing a letter to Minister Richard Bruton urging him to choose the publicly-funded option. The letter was signed by 30 Students’ Union Presidents as well as Ms Hoey, and NUSUSI President, Fergal McFerran. Mr McNulty said: “A higher educated youth means stronger future employment prospects, a better workforce, lower unemployment rates, less of a strain on social welfare and ultimately a stronger economy. “Free education funded by the exchequer benefits everyone, not just the youth or those receiving the education.”

O’CONNOR QUIZZES HSE ON MATERNITY HOSPITAL FOR TALLAGHT Local Councillor Charlie O’Connor has raised the question of a Maternity Hospital for Tallaght with HSE Management.
proposal to relocate the National Maternity Hospital to the campus of St Vincent’s Hospital at Elm Park”.
He was speaking at the July meeting of the Regional Health Forum Dublin MidLeinster and asked the HSE “if a green field site in Tallaght could be offered for the development of the proposed new National Maternity Hospital, if current talks between St Vincent’s University Hospital and the National Maternity Hospital fail and will the HSE also present a update in respect of the issue”.
In light of difficulties that have arisen between the two hospitals a mediation process has been instigated, at the request of the Minister for Health, with a view to achieving sufficient resolution to allow the project to move forward, and the early submission of a planning application for the proposed new development.
The response from the HSE stated that “Significant work has been undertaken in relation to the
This mediation process is ongoing, and the HSE remains optimistic that a resolution to the current difficulties can be found, such that the project can progress through remaining
stages of the design and planning process”. According to Charlie O’Connor he was very disappointed with the response which, despite all the detail, did not actually answer the question. He said that there was strong feeling in Tallaght that the area should have its own Maternity Hospital given its age profile. He hoped that the matter would be given some consideration in the future.

ARE WE IN THE MIDST OF AN ANXIETY EPIDEMIC?
Anxiety has become a 21st Century epidemic. Reported levels have been increasing since the end of World War II suggesting that anxiety disorders now constitutes the most prevalent mental health problems worldwide.
terrifying grip. For them, anxiety strikes unexpectedly and frequently. Sufferers imagine that things are overwhelming and beyond their control with debilitating results.
It’s a primitive response from when our ancestors had to be on constant alert, ready to call upon their fight or flight response. We have all experienced moments when everything seemed to be crashing us and most of us got over it.
Anxiety manifests as fear, uncertainty, racing thoughts and avoidance of people, places or situations. It affects the ability to function normally and sufferers often feel they are losing their minds. It can lead to related psychological conditions like substance abuse and personality difficulties.
Many unfortunately remain locked in its

Women are 60% more likely than men to experience anxiety disorder. About 8% of teenagers experience anxiety disorder. Generalized anxiety disorder (GAD) is its most common form described as a constant state of worry and anxiety that’s out of proportion to what’s actually going on in one’s life. Its symptoms include heart palpitations, “jelly legs,” hands and feet tingling, hyperventilation, dizziness, feeling sick, tension, headaches, hot flushes and shaking. Anxiety sufferers may think they’re going mad or losing control.
They feel they might die, are going to be sick, that things are speeding up or slowing down, feeling detached from their environment and people and they want to escape. GAD sufferers tend to be unsure and lack confidence. They are often perfectionists, controlling and excessively conforming. Symptoms can include restlessness, on edge, excessive tiredness, difficulty concentrating, irritability, muscle tension, and sleep disturbance. Panic Disorder Extreme anxiety includes panic disorder,
characterized by terrifying episodes of high anxiety. This, the dreaded panic attack can last from 15 to 30 minutes. Symptoms can accompany other kinds of anxiety disorder though attacks tend to be triggered by specific cues. Symptoms include heart palpitations, sweating, disorientation, breathlessness, fear of dying and even the fear of going insane. The other four major classifications of anxiety include phobias, obsessivecompulsive disorder (OCD), post-traumatic stress disorder (PTSD), and separation anxiety disorder.
Anxiety disorder sufferers tend to have their lives ruled by avoidance, subterfuge, ritualistic behaviour and self-medication. They are also at an increased suicide risk. Successful anxiety treatment Anxiety is typically treated with cognitive behavioural therapy, and antidepressants. The results are mixed and there is a great risk of creating medication dependency or addiction. Anxiety can now be treated successfully. Hypnotherapy, Neurolinguistic programming and Buteyko therapy in combination offer
the best solution with a better than 90% success rate according to therapist Tom Ryan whose clinics are now treating anxiety, successfully. Take back control of your life. For a local appointment Phone 0871917840 now.

NEW BONE FROM OLD TEETH – THE ULTIMATE IN RECYCLING. T Dental exclusively offers the latest in dental technology which allows your own recently extracted teeth to be ground down into a fine powder. This natural recycled powder is then used to augment your bone. T Dental is the first clinic in Ireland to have this technology and by using your own naturally ground tooth substance, better bone formation and socket healing are achieved. To ensure optimum stability and longevity of your new implants it is vital to have sufficient bone available. When a tooth is extracted the surrounding bone is removed by the body as a natural process. However, it is the presence of this bone which is necessary to give an implant sufficient depth and support.
The less bone present the closer the implant has to go to the underlying nerves and the greater the likelihood of post implant pain or loss of sensation to the surrounding area. The more bone available and the better quality of the healed socket, the greater the chances of success are for your new implants. Currently, bone augmentation is achieved through the use of artificial synthetic bone or bone derived from cows prepared in a way to allow it to be transplanted into your mouth. Another option is to surgically remove a piece of your own bone form either from part of your jaw or from your hip and implant this into the area that will receive your implant. Rather than face an extra surgical intervention or use a foreign
substance in your mouth, T Dental can now augment your bone at the time of extraction using your own natural teeth to promote healing and improved socket formation. Since 2009 T Dental have provided post graduate training opportunities for Irish dentists. This desire to achieve the highest possible standards for dental treatment by Irish dentists was the driving force behind the T Dental Educational Resource and Training Facility here in Tallaght. After some negotiation T Dental managed to persuade one of the UKs top Dental educators and specialist prosthodontist Professor Paul Tipton to start training Irish dentists right here In Tallaght. Professor
Tipton
is
an
internationally acclaimed Prosthodontist who has worked in private practice for more than 30 years. He is the founder of Tipton Training Ltd, one of the UK’s leading private dental training academies and the author of over 100 scientific articles for the dental press. He was voted in the Top 20 ‘most influential dentists in the UK’ by his peers in Dentistry Magazine in April 2012, the leading Prosthodontist in the poll and was voted in the top 5 dentists in Private Dentistry’s Elite 20 poll, January 2012. As the training centre grew from strength to strength it was necessary to move to larger premises and the T Dental Educational and resource centre was opened in Old Bawn.
A seminar room large enough for ten delegates was equipped the latest of training equipment including phantom heads to give Irish dentists the opportunity to achieve the highest of standards. Two fully operational dental surgeries were also provided so live implant surgeries could be taught as part of one of the many high quality courses offered. Early this year T Dental decided to open the training facility to the general public and the T Dental Clinic was created. The training facility will still carry on training the best of young Irish dentists. The opportunity for patients to participate in courses will remain open so that any patients receiving implants as part of a course will have the cost of their treatment greatly reduced.

In this edition of the paper, Romaine Scally, Principal in the Firm of Romaine Scally and Co, Solicitors, deals with Employment issues. As always please send your queries to: Romaine Scally, Solicitors, Main Street, Tallaght Village, Dublin 24. Telephone 4599506, Email legal@scally.ie. Q. I was a passenger in my brother’s car recently when he was hit from the side by an oncoming driver. My brother’s insurance company are satisfied that my brother is not in any way to blame for the accident. However, the other driver has put in a claim for the damage to his car. Would I have to sue my brother if I were to pursue a claim for personal injuries? A. Firstly, it has to be said that if you were to pursue any claim, whether it is against the other driver or indeed your brother, assuming that both parties are insured then, it is the insurance company who will pay out on foot of any claim. Naturally however, you would be reluctant to lay the finger of blame on your brother and most particularly in circumstances where his own insurance company are supporting him in denying liability to the other driver. Given that the initial process, being the application to the Injuries Board, is entirely nonconfrontational in nature then, you may wish to initiate your claim against this third party driver only. In the course of the process, the issue of liability or fault may well be decided and, if it turned out that your brother was to be held partly responsible for this accident then you would have to make a decision going forward as to whether or not you would include your brother as a named party on your Injuries Board application. Our advice is to go and see a Solicitor and discuss the matter in some detail with him/her. Q. I was returning from holiday recently and our flight was very late arriving into Dublin. Unfortunately, as I was walking along the concourse, I slipped on something and fell badly. I ended up doing quite a lot of damage to my back and had to be taken away by wheelchair and an ambulance. I do not know what I fell on but I do know that my clothes were all wet. Would I have a claim? A.
This was a most unfortunate
accident particularly coming as it did after what I assume was an enjoyable summer holiday. Nonetheless, at least it did happen on your way home and not perhaps on your way out which might have resulted in you missing your holiday altogether. To answer your question, you more than likely do have a claim for personal injuries arising out of this incident. Although you are not sure what you fell on, nonetheless, you were aware that your clothes were wet after the fall. This is consistent with something having been spilt on the concourse. Given the lateness of the hour of your arrival home, there may not have been cleaning staff on duty at the time. As the accident was obviously reported, it may well be that there is CCTV footage of your fall and this might clarify exactly how it happened. Our advice is to attend with a Solicitor to initiate a claim and most importantly, to ensure that the CCTV footage is made available to clarify the circumstances of the fall and hopefully assist you in pursuing your claim. We wish you the best of luck in this regard. Q. I was a passenger in a taxi coming home late one night recently when the taxi was hit by a car which failed to stop at lights. I was in the backseat but was not wearing my seatbelt. I was shunted quite violently forwards and was taken by ambulance to hospital where I was treated and discharged on medication. I have been having ongoing problems with my neck since the accident and am wondering if I can still sue for personal injuries even though I was not wearing a seatbelt? A. It is always very unfortunate to hear about accidents where people take such care of themselves when out socialising and then end up having an accident in a taxi. However, it happens quite a bit and bad and all as your accident was, it could probably have been a great deal worse. To answer your question, you certainly can bring a claim for personal injuries. Hopefully, this other driver stopped at the scene and gave his or her particulars. You can rest assured in any event that the taxi driver will have pursued the matter, either directly with this other driver or with the Gardaí. Hopefully, you will be able to get this information from the taxi driver. The question of not wearing a seatbelt is one which goes towards contributory negligence. In other words, although you are perfectly entitled to pursue a claim for personal injuries arising out of this accident, irrespective as to whether or not you were wearing a seatbelt, nonetheless the absence of a seatbelt will result in a percentage reduction in your damages. This so particularly in circumstances where the seatbelt would have reduced significantly the particular injury, as in
your case, a whiplash type neck injury. Generally, damages are reduced from anything between 15% and 25% for failing to wear a seatbelt. However, it will not stop you initiating a claim and you should do so immediately through a solicitor. We wish you a speedy recovery. Q. I was bringing my daughter to school recently when she tripped over an obstruction which was temporarily put down to stop a faulty door opening out more than halfway. The wooden obstruction was unfortunately partly concealed by overgrown grass. My daughter was running up to the outdoor assembly before they start school and so the impact was a severe one. She fell forward, damaging her knee but unfortunately, it looks like some of her teeth have been damaged. Our dentist is still not sure if he can save two of her teeth. As she is 12 years of age, these are her second teeth. Would we have a claim? A. This was a very unfortunate occurrence and one which seems to have far reaching consequences for your daughter. Her treatment is likely to be ongoing and costly. With regard to any claim, this certainly seems to be one of those cases where you would most certainly be able to claim and would expect to be successful. Over more recent years, the courts have been somewhat reluctant to lay the finger of blame at schools, given that ultimately, the payment out of compensation only increases the costs to schools, thus reducing money available to the school itself for educational purposes. However, in a case such as this where the school are clearly responsible for creating an obstruction and tripping hazard then, we would fully expect you to be successful in your claim on behalf of your daughter. As she is a minor, one of her parents will have to initiate the claim. As these claims involving dental treatment tend to be lengthy because a final prognosis is often not available for some years, we would strongly recommend that you start the process as soon as possible. We would advise you to attend with a Solicitor sooner rather than later and we would also urge you to take photographs of the obstruction prior to it being removed. We wish you the best of luck in this regard. Q. I was recently eating at a restaurant I had never been to before. Our seat was in a raised booth. By the time we were leaving, it was dark, and I had forgotten that the seating was raised. I therefore missed my step when I walked off the booth and ended up falling and twisting my ankle badly. The restaurant are saying it is my fault because I had successfully negotiated the step leading
up to the booth when I arrived. I feel however that they should be in some way responsible, as it is like walking off a cliff edge when you step out from the seat. The lighting was not good. Would I have a claim? A. This was a very unfortunate occurrence and one which could easily happen. The question as to whether or not you have a claim would depend to some extent on Engineering evidence. Obviously all public premises should be designed in such a way as to ensure the safety of patrons in general. It may well be that the absence of any particular lighting highlighting the difference in height, combined with poor lighting in the restaurant generally, will result in the restaurant being found liable. It is definitely a case worth pursuing, particular where the injury you sustained was a nasty one. It is likely that an inspection by an Engineer will be required to determine whether or not the step complies with Health & Safety. Initially however, the application is non-contentious through the Injuries Board and we would strongly recommend that you start the process as soon as possible. You should consult with a Solicitor to ensure that everything is done to maximise your chances of successfully bringing a claim so that vital evidence is not lost or the design of premises changed before you have a chance to arrange an Engineering Inspection. We wish you the best of luck in this regard. Q. I was shopping in a department store recently and admiring certain sale items placed on a temporary display. However, as I was walking away from the display, my foot caught in a sort of protruding leg supporting the display. I injured my leg badly and will have to go to physiotherapy for some time. Would I have a claim? A. We are sorry to hear about this accident which seems to have had long lasting consequences for you. We hope that your recovery will be speedy. In relation to your question, it is very likely that you would be successful in bringing a claim against the department store. Shoppers are naturally attracted to the items on display and their eyes are not directed to the floor to protect themselves against protruding items. It seems as if this temporary display will not comply with Health & Safety within the department store and, as such, you could expect to be successful in your claim. It is important however, that you commence a claim as soon as possible and we recommend that you attend with your Solicitor to pursue the matter further. We wish you the best of luck in this regard.
In contentious business a Solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement

VOICE OF CHILD ABSENT FROM LEGAL PROCESSES OF PARENTAL SEPARATION SAYS ISPCC The Irish Society for the Prevention of Cruelty to Children (ISPCC) has launched its annual report and accounts for 2015 and has reported a year of milestones for the charity and young people across Ireland. The ISPCC’s Childhood Support Service experienced a huge demand and worked with 439 children throughout 2015. One of the primary reasons for referral to the service was issues arising for children as a result of parental separation, with the processes surrounding this emerging as a source of anxiety for children.* The system of mediation, the courts process and legal process and the lack of the voice of the child in this system were all issues which came through in the service’s one to-one work with children. ISPCC
Chief
Executive
Grainia Long stated: “As the national child protection charity, we monitor carefully the issues that arise for children accessing our support services. Among many other issues affecting children accessing our services – including early sexualisation, drugs and alcohol, bullying and cyber safety – a growing concern for our childhood support workers is the impact on children of issues arising from parental separation. While relationship breakdown is difficult on everyone, there are ways in which changes to the legal system could reduce the impact on children. “The family courts system, custody and access processes and even mediation process are not child-centered, the voice of the child is often not heard in these situations and children’s emotional well-being can be affected. There is no early stage intervention, and so
referrals often occur late in the process when cases are at extreme stages. There is a clear need to address the deficiencies in process, in the support systems available and in the courts systems that do not enable the voice of the child to be heard in these situations.” “The legislation arising from the Children’s Rights referendum is now in place, the first step in protecting and promoting children in the legal process – we now urgently need practical supports to give effect to the constitutional rights of children, such as ensuring that their wishes and best interests are given the constitutional priority now enshrined in Article 42A. “Our central goal in our support services is to increase the child’s psychological resilience so they can cope with any issues they encounter. Issues in children’s lives such as bullying, parental

separation etc. can upset a child’s world; we help them to pick up the pieces and support them with putting them back together again.” In reviewing 2015, among its other successes, the charity pointed to the amendment to the Irish Constitution to enact the changes agreed by the Irish people in the Children’s Referendum and the recognition by the Oireachtas of their work to end corporal punishment – the amendment to outlaw the defence of reasonable chastisement was the culmination of years of campaign work. The ISPCC also supported a change to the law to enable same sex couples to marry and successfully campaigned for a ‘Yes’ vote. Grainia Long thanked all those who support the work
of the organisation: “The ISPCC would like to thank the public for their ongoing support for these services throughout the previous year. We are extremely grateful for this support and as you can see from our annual report, we couldn’t function without the generosity of the public. “As for the year ahead, we are focused on new and emerging risks to children; on ensuring the State meets its obligations to children who are homeless – ensuring physical and management standards in emergency accommodation. We will continue to press the Government to improve the lives of children in Direct Provision and focus attention on Traveller children, particularly in terms of their housing and education.”
Minister Katherine Zappone, who attended the event, stated: “I look forward to working with the ISPCC in the future on issues that directly affect children and would like to congratulate them on their achievements throughout 2015 – they provide valuable services and support to children all over the country. I have consulted with the ISPCC regarding children in emergency accommodation or affected by homelessness and their input has been extremely productive and important. I hope to continue working with the ISPCC on a whole range of important issues, to improve the lives of children in Ireland.” For further information the ISPCC Annual report is available at www.ispcc.ie

South Dublin House Prices Continue To Soar
The price of an average three bedroom semi detached house in South Dublin has risen by 2.19% to €350,000 in the last three months, according to a national survey carried out by Real Estate Alliance.
The REA Average House Price Index concentrates on the sale price of Ireland’s typical stock home, the three-bed semi, giving an up-to-date picture of the property market in towns and cities countrywide. “We feel that the Central Bank’s
restrictive lending criteria are having the continued desired effect on property values,” said Paul Grimes from REA Grimes. “However, it is clear that there are many young families seeking to purchase their family home as opposed to continue renting. “The increased rental pressures will continue until such time as these restrictive lending criteria are eased up somewhat.”
“We are seeing a slight improvement in the market, due to lack of supply prices are going up with demand. There is a lot of demand for properties around €600,000,” said Ed Dempsey from REA. “There are no 25-40 year olds in the area, only people trading up or down, with people finding it difficult to trade down,” said Rory Crerar from REA Orchard in Rathfarnham. “Many investors are looking to sell and
there is a strong firsttime buyer market, but few investors looking to buy, even with increasing residential rents,” said Anthony McGee from REA McGee in Tallaght. A nationwide supply shortage has fuelled a rise of over 2% in the price of the average house in the last three months, with the majority of counties in the State recording price increases in Quarter Two this year, the latest Real Estate Alliance Average House Price Survey found. However, it is the lack of supply of suitable properties in a scarce market that has caused these rises, exacerbated by the effect of would-be commuters moving ever further from Dublin to acquire affordable homes.
“We are seeing firms Anthony McGee and his friendly and helpful staff
who are in business for 50 years who have never experienced such a low level of supply, and this is responsible for causing sharp increases in prices in some areas over the past three months,” said REA Chairman Michael O’Connor.
The average three bed semi nationally now costs €195,361, an increase of over €4,000 (+2.18%) since the end of March. This is a rise of 4.49% against the same time last year. The REA Average House Price Survey concentrates on the sale price of Ireland’s typical stock home, the three-bed semi, giving an up-to-date picture of the property market in towns and cities countrywide to the end of Q2 this week. While prices in Dublin city and county grew by +1.4% to €363,333 since March, competition for scarce housing below the Central Bank’s €220,000 deposit
limit in both the inner and outer commuter areas is fuelling an inflationary market.
Prices in commuter counties, Cork and Galway have risen by €5,000 to €214,588 (+2.4%) while those in the rest of the country have increased by over €3,000 to €128,768 (+2.75%). Prices in Kildare (€242,500) have remained static in the four main towns, due to a low supply of suitable housing stock, combined with a relatively higher price to neighbouring counties. In contrast, Meath has now broken the €200k barrier (€201,250) following a 3.21% growth in three months, as Dublin– based commuters move out to houses they can afford under the Central Bank’s deposit guidelines. In in
Wicklow, prices Blessington have
risen from €240,000 to €265,000 in a threemonth period, a rise of 10.42%, with agent REA Murphys advising that there is a bubble in the three bed semi market. Prices in the county as a whole have gone up by 4.44% to €235,000 over the past three months.“We now need to address the roadblocks in the way of building new suitable family homes,” said REA Chairman Michael O’Connor. “We feel that the State ultimately needs to implement a 50% vat reduction on new homes, backed up by rebate schemes on local development charges on a nationwide basis. “Nama need to accelerate sales of land on the open market as well as selling through loan sales. “In conjunction, there is a need to fast track planning within the correct zoning for urban land bought within the next two years.”

MORE THAN A WINDSCREEN!
Expert care is needed to ensure today’s high-tech windscreens are fitted precisely, advises Mr Windscreen.
Like many parts of your car, your windscreen is becoming ever more advanced and complex, mostly without you even knowing it.
camera has precisely the right view of the road ahead. That takes skills and expertise, and the right equipment.
You will hear of lots of new technologies that are making our cars safer, like lane departure warning, adaptive cruise control and collision avoidance. These are known as Advanced Driver Assistance Systems, or ADAS. The windscreen is at the heart of these technologies, which operate via a tiny camera set into your windscreen. As windscreen repairer Mr Windscreen advises, if your windscreen is incorrectly fitted, even by just a few millimetres, these technologies won’t work properly!
So next time you are getting your windscreen replaced, ask whether it needs to be calibrated and then leave it to the experts. Static calibration requires precise and stable conditions and should not be carried out in car parks or on the side of the road as surface levels, wind and light can all result in an incorrect calibration. Does it apply to your car? Mrwindscreen.ie contains a list of car technologies which will indicate if your replacement windscreen will need to be calibrated.
If your car is fitted with ADAS technology, and you need a windscreen replacement, it’s a more complex job than previously. Alongside fitting the screen securely, the fitter has to ensure the screen is correctly calibrated so that the

162 HAPPYDRIVE DEALS HELP DRIVE BUYERS TO AIRTON The mid-year reg plate change has made sure car showrooms are busy at what was traditionally a very quiet time in the trade, and this year is no exception, with sales of 162 cars outpacing the same period last year. Ford and Kia dealers Airton on Airton Road are reporting brisk business this summer on foot of their array of
162 Happy Drive offers. The 162 HappyDrive offers include 0% finance on a number of Kia models, with PCP plans on the Ford Fiesta, Focus and C-MAX at a low rate of 4.25% APR. The Ford finance plans can be combined with Ford’s own Real Deal savings to make these cars more affordable than ever.
Buyers can enjoy €2,750 saving on a Fiesta Zetec, for example, while up to €4,500 in savings are available on the Ford Focus, and €3,500 on the 7-seater Grand C-MAX, each with attractive upgrade packs. The offers extend throughout the entire Ford range, right up to the range-topping Ford Galaxy.
The Kia line-up of models is especially strong this year, not least with the new Sportage and Optima. Two mainstays of the range, the Kia Rio and Cee’d are both on offer with 0% finance, as is the new sporty Cee’d GT Line. In conjunction with the HappyDrive new car offers, Airton
is running a HappyService deal from just €119, which includes a mini valet. The window of opportunity for the 162 bargain-hunter is a short one, with many of the offers set to finish at the end of this month, so buyers are advised to act swiftly. See airton.ie or call 01 4000044.

BIFFY CLYRO ANNOUNCE IRISH DATE AS ELLIPSIS REACHES NUMBER 1 Scottish rockers Biffy Clyro will return to Ireland later this year to play a series of gigs in Dublin and Belfast. Made up of singer and guitarist Simon Neil, drummer Ben Johnston and his twin brother James Johnston on bass and vocals the trio have a solid fan base in Ireland. Biffy Clyro toured here in 2010 playing the soldout Oxegen festival in the same year they won the NME Award for Best Music Video for The Captain and also earned a nomination for Best British Band. They also supported the Foo Fighters and Metallica on tour in recent years as well as touring their previous chart-topping album Opposites around the UK. The band will perform live at the 3Arena in Dublin on Saturday, November 26th and will
IRISH DRAMA RED ROCK RECEIVES MASSIVE INTERNATIONAL ACCLAIM Irish drama Red Rock – which has been described as a cross between Eastenders and The Bill in the UK – has debuted to over one million viewers on BBC One.
follow this up with a gig at the SSE Arena in Belfast on Sunday, November 27th. Their new album, Ellipsis, is currently number 1 in the Irish charts and has received rave reviews from fans so far. The trio stuck to their traditional writing habit for the album – working in the intimate environment of their practice room before heading to Los Angeles for recording sessions with producer Rich Costey (Muse, My Chemical Romance, Sigur Ros). Wolves of Winter is
the first single from the album which the band say capture Biffy Clyro’s “famous blend of angular riffs, pummelling rhythms and strident hooks”. Neil said: “Wolves of Winter is about us being wolves on a patch and if you come onto that patch, we’ll tear you limb-from-limb.” The album Ellipsis is available now and tickets for the Dublin show, which are priced from €46.05 including booking fee, are on sale from Ticketmaster and usual outlets – doors open at 6.30pm on the night.
The show is produced by Element Pictures and Angel Station for TV3 with thanks to the BAI Sound and Vision Fund and stars a host of young, local talent. Actors from Tallaght, Clondalkin and all across the city appear in the gritty cop drama which is also set to air on US screens this Summer. The first episode of Red Rock, which is being shown in the 40-minute afternoon slot usually occupied by awardwinning soap Doctors, earned an average of 1.1 million viewers in the UK – almost 20% of the viewing share.
Pat Kiely, Managing Director, TV3 Group said: “These audience numbers show that great Irish television content will travel. They also demonstrate the export potential for the Irish production industry. “We are delighted that viewers in the UK have taken to ‘Red Rock’ so quickly. This is fantastic news for TV3 as we expand the business and increase our originated output.”
Although viewers in Ireland are eagerly awaiting the third series of the hit show, which returns in September, UK and US viewers are currently watching the first series. Red Rock airs at 1.45pm on BCC One each weekday and is commissioned by Ballymount station TV3, with experienced executive producer Ed Guiney of Element Pictures and John Yorke of Angel Station
(previously Company Pictures) on board. Tallaght actor Darren Cahill plays a big part in the show as tormented teenager Davey Webb while Dublin actor Sean Mahon has received rave reviews for his portrayal of wicked cop Brian McGonigle. With an abundance of Irish talent, gripping storylines and likeable characters Red Rock looks set to remain on screens far into the future.
TOP FIVE FILMS – CHICK FLICKS Sometimes you need a girly night in – popcorn, drinks, chocolate and a great movie to help bond with your female buddies. There is something about chick flicks that is so brilliant when it is done well and can be disastrous when it goes wrong. Never fear, however, as we have some of the greatest girls’ night movies of all time lined up and ready to go in our Top Five Films – Chick Flicks…
1. Bridesmaids: If it is hilarity you are after then Bridesmaids is the film for you. Laughout-loud from start to finish this film brings together strong, funny female characters and produces one of the best films of the last 20 years. Melissa McCarthy, as always, steals the show but the whole cast is utterly hilarious.
2. Mean Girls: The classic girls’ night in movie Mean Girls is so funny, so on-point and so 90s that you will be reaching for
your favourite pink outfit immediately. Lindsay Lohan is great as Cady but Rachel McAdam turns in an outstanding and side-splittingly funny performance as the ultimate mean girl Regina George. Tina Fey and Amy Poehler as fantastic as well. 3. Miss Congeniality: Still widely regarded as one of Sandra Bullock’s best movies Miss Congeniality has a bit of everything – undercover cops, beauty pageant, mix-ups,
kidnapping and lots of action. Bullock is the least ladylike FBI agent you are likely to come across but hanging out with these wannabe beauty queens teaches her more than she thought possible.
4. He’s Just Not That Into You: We have all had that conversation with our best friend “do you think he is interested?” and this movie answers that one questions in a million different ways. A brilliant cast including Justin
Long and Bradley Cooper help trawl through all of the excuses ‘he’ offers for why he can’t see and separates the real from the imaginary. 5. Sex and the City: Although not a critics favourite there is real merit to the original Sex and the City movie, especially for fans of the TV series. Carrie finds herself about to marry Mr. Big, her Mr. Right… or so she thought. The film is the best of the series – the four friends together, laughing,
crying and putting right the wrongs of the world. Get the girls around, make some cocktails and enjoy. In reality any movie can make the cut for girls’ night but these selections are female driven, funny and thoughtful films which will bring your group even closer together. So grab your best pals, get some goodies and prepare for a good old fashioned night with the girls and any of these Top Five Films.
