Dublin South West representative Seán Crowe TD has described reports of up to 10,000 struggling families across Tallaght and Clondalkin being supported by St Vincent de Paul (SVP) with back-to-school cost as unprecedented but hardly surprising.

Crowe said that traditionally at this time of year with children returning to school there is huge financial pressures on parents with clearly the buzz talk of a recovery not filtering into the

mind-set families.

Deputy Seán Crowe said: “There is an unprecedented demand on the St Vincent De Paul particularly at this time of the year as more and more parents struggle and are turning the charity to meet the growing back-to-school costs. “As children return to school this week, the St Vincent De Paul is expecting to pay out over a €100,000 to assist over 10,000 hard pressed parents with the cost of fees, books,

uniforms and other ancillary costs in Tallaght and the Clondalkin area. “The talk of recovery and a new beginning is nonsensical and seems like a million miles away. The recovery buzz words have not filtered into the mindset of many of these families struggling to make ends meet. “Demands on some parents locally have been exasperated in recent weeks, as many families were left waiting for the Government’s ‘back-toschool’ grant – a

payment which covers a fraction of a child’s back-to-school costs. “The Back to School Allowance is available to a small cohort of families but many complain that aside from the delay it is not fit for purpose, with the gap between the allowance and the cost of sending a child to school growing every year. “Currently the means tested grant is available for children between 4 years - 11years is €100, between 12 years – 22 years, it is €200, with the stipulation that the student between the age of 18 years and 22 years has to be attending fulltime College. “With many families already crippled by austerity measures and increased charges, the biggest worry at this time of the year is sourcing expensive new uniforms and other additional equipment to send their children to school.

“Back to School Cost continue to rise with many families relying on charities like St Vincent De Paul for additional support. It should come as no surprise to anyone that the demands are increasing rather decreasing.”

Sinn FÉin’S coWardice oVer houSinG the homeleSS iS Beyond BelieF your Free local newspaper

"Sinn Féin's opposition to building 50 new social housing units at Lett's Field in Clondalkin for those who are on the housing list and who are homeless is an absolute disgrace and almost beyond belief.

Cllr. Eoin Ó Broin is guilty of complete political cowardice, and it is people on the housing list and living in emergency accommodation who

are going to suffer because of it." "On the one hand, Sinn Féin is saying that more action needs to be done to tackle the housing crisis. Labour has provided the money for 50 social housing units to be built at Lett's Field, to house 50 families in need. Now Sinn Féin want the number of houses being built to be reduced from 50 to 15. Once again, we are seeing Sinn Féin speaking out

of both sides of their mouth, asking for action on something, but then opposing that action once work begins." "In a recent edition of a local newspaper, Eoin Ó Broin was talking about the scale of the housing crisis in one article, and in another article proposing reducing the number of new houses being built at Lett's Field for the those on the housing list and

homeless people. That kind of hypocrisy just speaks for itself."

"Sinn Féin's opposition to the building social housing during the middle of the worst housing crisis in living memory is just shameful. I appreciate that some local people are upset that the field is being built on, and won't be available for football matches, but the scale of the housing crisis is simply too great

to do anything else. Collinstown Park is nearby and has plenty of football pitches available.

"I am calling on Eoin Ó Broin to do the right thing and stop his opposition to the 50 houses being built at Lett's Field. The housing crisis is simply desperate, and we cannot afford this sort of populist rubbish if we're going to get a handle on it."

exciSe duty increaSe iS not “the old reliaBle”

Fine Gael Senator, Catherine Noone, has backed research undertaken by Alcohol Action Ireland which highlights that, despite what alcohol companies try to spin, beer is in fact not a budget “old reliable” when it comes to increasing excise – with only three increases between 1990 and 2015, and one decrease. “I fully back the call from Alcohol Action Ireland to ensure that excise duty on alcohol is set at a level which reflects the impact and cost that alcohol has on our society – whether it’s socially, economically or in our healthcare system. “This great myth has taken root that somehow excise duty is an ‘old reliable’ when it comes to the Budget – and I really think this needs to be tackled. Between 1990 and 2015, the excise on beer was only increased three times, while actually being decreased once in the same period. Similarly, the excise on wine

was only increased four times in that 25 year period, while also being decreased once. The excise duty on beer being increased in one out of every eight budgets hardly makes it an ‘old reliable’, as the alcohol spin merchants try and make us believe. “I believe that Budget 2016 needs to go some way to tackling this issue as we have one of the highest levels of both alcohol consumption and binge drinking in the world. This costs us a huge amount between healthcare costs, crime costs and lost productivity in our workforce. “This needs to be tackled with a raise in the excise duty but, first, the myth that this is a regular budgetary mechanism also has to be tackled. There are a great many myths perpetuated by the alcohol industry, and I believe we need to make sure that the public are aware of the facts.”

Shane Moraghan, the Tallaght business man, who set an Irish record for swimming the English Channel in 1999 - a time which was only broken three year's ago - again re-wrote the record books with a fastest-ever winning time of four and a half hours exactly for the seventeen mile swim, and received a t-shirt and trophy at the finish line.. The event is in honour of Rose Pitonof - who was the first person to successfully complete this swim when she was just 17 in 1912 - and included eleven swimmers, with Moraghan being the only Irish competitor, with Americans and Australians completing the field. Shane is married and wife Andrea along with his two sons - Luke and Jack - and also parents Maura and Alec and four brothers, were all delighted with Shane's ' achievement. Maura stated how hard Shane - who is also a keen waterpolo player - had trained for the event. "I swam the English Channel many year's ago (in 1999) and I've done several swims since then, but nothing so Important", stated Moraghan. He was keen to stress that he did the event in aid of charity - for the Laura Lynne Children's Hospice to be precise - for whom he raised over €3,000. Moraghan is a member of the National Waterpolo team and was a member of the squad which finished in third place after South Africa and Denmark in an eight-team event in March. 47-year old Moraghan, has more events to come such as the Liffey Swim next month and will compete in the Manhattan Swim again in 2016, although the actual date for the latter has yet been officially decided and will take place sometime between July and September.

‘Back to School period adds to stress facing families’

The hardships now being experienced by lone parent families following social welfare changes were predicted and must immediately be addressed, according to Independent Senator and Dublin South West Election Candidate, Katherine Zappone.

Confirmation of a 50% jump in calls to the helplines of the One Family Organisation to 2,000 is an indication of the fear and uncertainty caused by the Government’s actions, according to the Senator. Senator Zappone said the fact that falls in income of up to €90 a week for lone parents were predicted makes the current situation frustrating and both unacceptable. Calling on the Government to immediately address the fall-out of the welfare changes, Senator Zappone added: “It is unacceptable that in our local communities there are families seriously out of pocket and struggling to put

bread on the table since the welfare changes for lone parents came into force at the end of June. The figures from the One Family Organisation unfortunately confirm that those of us who predicted that the impact would be harsh and in some cases devastating were correct. It is time now for the Government to take swift action to reverse the impact of the welfare changes. Immediate measures which must be taken include · Establish a special working group as a matter of urgency to include lone parent representatives, civil society as well as TDs and Senators which can contribute to preparations for the Autumn budget. · Restore income levels by immediately resetting the Income Disregard level for the Job Seekers Transition Allowance to that of the One-Parent Family Allowance · Give those families impacted by the new changes priority in

accessing quality childcare, including the provision of a special allowance when the only option is a private service"

Senator Zappone added “This back to school period is the most difficult for all families and it is wrong to let so many in our community literally struggling to make ends meet because of the Government’s failure to see the consequences of its actions. While reversing the drop in income is a priority, the changes have also reduced access to training, education and jobs so that these families can boost their household budget and that too must be addressed. Earlier this year I was proud to host a Civic Forum for lone parent families in Leinster House and it has also produced more wideranging measures which I will continue to press for from the resumption of the Oireachtas in the coming weeks.”

The work being done around the country by the Jack & Jill Foundation to provide home nursing care and end of life care to children with life limiting and life threatening conditions has been acknowledged by Mercedes-Benz in Ireland. Operating from the organisation’s headquarters in Johnstown, Kildare, the new Vito will be put to work transporting items between the Foundation’s three charity boutiques in Naas, Newbridge and Arklow and thereby providing much need support for the charity. Thanking Mercedes-Benz for their support, Jack & Jill Foundation CEO, Mr. Jonathan Irwin said: ‘We are delighted that an organisation like Mercedes-Benz would

recognise the work that we are doing and our new Vito van is invaluable, particularly as we open our third charity boutique in Arklow, with the other two up and running in Naas and Newbridge and more to come before the year is out. On behalf of the 300 children and their families nationwide who rely so much on the service we provide, I want to say a huge thank you to MercedesBenz’. Fianna Fáil outlineS neW ProPoSalS to tackle rent criSiS your Free local newspaper

Fianna Fáil has launched a comprehensive policy document aimed at tackling the growing national rent crisis. The document, entitled ‘Generation Rent - A new deal for Renters and Landlords’, outlines a clear 3 step strategy to address the rent crisis. The strategy consists of strengthening tenants’ and rent rights affordability, improving the quality of accommodation and encouraging greater investment to boost supply. Fianna Fáil Spokesperson on Environment and Local Government Barry Cowen TD launched the document alongside Dublin City Councillors Paul McAuliffe and Deirdre Heney. The policy document builds on proposals unveiled last April by Fianna Fáil through its “Supporting Home Ownership - A National

Housing Roadmap” strategy. This strategy envisages a €4.5bn social housing direct build program. Speaking following the launch Deputy Cowen commented, “The rent crisis is growing in Dublin and right across the country. We can see the crisis at its worst with the soaring level of homelessness, but also in the student accommodation problems experienced by countless young people. “Rent is becoming completely unaffordable for many and the quality of accommodation is far below standard. As it stands there are no incentives for landlords to stay in the system. "The self styled Action Man Minister Alan Kelly has talked about a 'perfect storm' but he has stood by while the storm has developed, ignoring the warnings and attacking those who tried to point out it

- Party unveils bold 3 step plan to address growing crisis was coming. The time for action is now long overdue. “The plan unveiled by Fianna Fáil outlines 3 steps to address the crisis by drawing together the needs of both renters and landlords alike, instead of crudely playing them off against each other as has been the Government's approach to date. “The proposals include specific measures to encourage long term leases to give tenants secure occupancy and to allow families to consider renting as a longer term option. We have also outlined new measures to ensure ongoing rent “A new affordable rent sector will be developed to allow key workers to live and work in the city centre. It confronts homelessness by raising the rent supplement and keeping it under review thereby ensuring new properties are opened up for

vulnerable households. Critically it addresses the central issue of and supply complements our national housing roadmap launched last April which outlined our plan to build 150,000 new homes by 2021.” Cllr Paul McAuliffe said, “Quality of accommodation is a serious issue and a major focus of our strategy. Fianna Fáil is proposing a new local authority certificate scheme and an overhauled PRTB to help ensure that tenants can enjoy decent quality homes at a fair price. “We will reduce PRTB complaint waiting times, set up a new deposit retention scheme and give it a central role in calculating allowable rent rises. The document also proposes a fast tracked eviction scheme for rogue tenants who purposely wreck homes and

create a neighbourhood nuisance. This will help landlords to deal with the rare disruptive tenant who sets out to damage property and cause stress and hassle for their neighbours.”

Cllr Deirdre Heney commented, “Ultimately, supply is the critical issue at stake here. It’s the only long term solution to this crisis. Landlords need to be encouraged to stay in the system

and attract fresh investment in the area. “We are proposing to open up more units by reducing commercial rates on units with homes on the upper floors and using the Strategic Investment Fund to target cheap loans to promote development. Measures to ensure rent affordability will be put on a 5 year sunset clause and be subject to an on-going review to ensure they do not

disrupt supply.”

Deputy Cowen concluded, "This Fianna Fáil strategy is an honest and realistic attempt to deal with housing Ireland's emergency. It is my sincere hope that Minister Kelly and his colleagues can put the party political posturing to one side and move to implement the we have solutions offered as a matter of urgency."

Ireland's human rights watchdog, the Irish Council for Civil Liberties (ICCL) has warmly welcomed the signature of the Thirty-fourth Amendment of the Constitution (Marriage Equality) Act 2015 by the President of Ireland. Together with colleagues from its partner organisations, the Gay & Lesbian Equality Network (GLEN) and Marriage Equality, the ICCL led the winning YesEquality2015 referendum campaign. ICCL Executive Director Mr Mark Kelly

said:"The President's decision to sign into law the amendment of the Constitution opening full civil marriage to same sex couples is a vindication of the clearly-expressed wish of more than 1.2 million voters to live in a more equal Ireland.

The ICCL warmly welcomes the fact that, following the recent dismissal by the Court of Appeal of spurious legal challenges to the landslide referendum result, marriage equality shall at last be the law of the land."

children’S miniSter ShirkS reSPonSiBility For SoarinG leVelS oF VulneraBle homeleSS children Govt says homelessness in itself does not give rise to child welfare concerns

The Minister for Children James Reilly has denied any responsibility for the protection of vulnerable children who have fallen into homelessness.

In response to a Parliamentary Question from Fianna Fáil’s Children’s Spokesperson Robert Troy, Minister Reilly said a child being homeless is not in itself enough to warrant concerns about their welfare. The Minister also confirmed to Deputy Troy that the Child and Family Agency, Tusla, has no statutory responsibility for homeless children. Deputy Troy explained, “The number of homeless families has doubled in less than a year. In Dublin alone, the latest figures show that there are 1,122 children who are homeless – and this

number is rising every week. Given the gravity of the child homelessness crisis, I wrote to Minister Reilly seeking clarification about what care and inreach plans are in place for children who have fallen homeless. I am shocked to learn that his answer is: none.

“The shocking truth is the Department of Children and the Child and Family Agency have absolutely no plan whatsoever to deal with the soaring numbers of homeless children in Ireland and Dublin in In fact, particular. Minister Reilly has actually dismissed the need for his department to look after these vulnerable children saying that being homeless is not enough of a reason to raise concerns about a child’s welfare. What planet is the Minister living on? Only this

week, we saw that homeless families were kicked onto the streets because the credit card used by Dublin’s Regional Homeless Executive to secure emergency accommodation maxed out. Is the Minister suggesting seriously that three children under the age of 12 who are forced to sleep in an industrial estate overnight are not vulnerable? “It is laughable to think this is the that Government that promised child welfare would be top of its agenda. In 2013 a total of 20 families were becoming homeless in Dublin every month – in the last few months this more than tripled to over 60 families becoming homeless every month. There are currently 10 homeless families for every 100,000 people Ireland. This compares to 3

homeless families for every 100,000 people in England. “It is shameful that Tusla does not have statutory responsibility for putting in place special care plans for all families and children being housed in emergency accommodation. What is the point of a Child and Family Agency that does not support the most vulnerable children and families in the State?

“Tusla should be taking a lead, front-line role in safeguarding and promoting the welfare of children. I am calling on the Minister to immediately mandate Tusla to coordinate and integrate all social services for these vulnerable families. The State must take a role in reducing the long term damage to these children’s health and development.”

lahart callS For crack doWn on caSh For Gold induStry

Fianna Fáil is calling for urgent regulation of the cash for gold sector amid fears that the gold trade is causing a surge in burglaries in Dublin’s south suburbs. South Dublin County Councillor John Lahart has raised concerns about a spate of gold robberies across south Dublin in recent months, which he says is facilitated by the booming cash for gold trade. “A number of estates across Dublin South West, from Ballyboden to Newlands Cross and in between, have been targeted in recent months by criminals who are specifically looking for cash or jewellery. Some unfortunate residents have had their homes burgled more than once in the space of six months – with all the attendant trauma and distress that this causes. The local gardaí have told me that these criminal gangs are often leaving behind larger valuables in favour of gold jewellery because it is so easy to sell,” said Cllr Lahart.

“It is far too easy for criminals to make cash by selling on gold, no questions asked. The failure to impose strict regulations on the cash for gold trade has essentially encouraged this type of criminality. At the moment gold can be sold by anybody looking for quick money, with no proof of purchase required and no regulation of the process. “It is high time to get tough on this type of crime. The latest figures show that burglaries in Dublin increased by 8% again over the last year. There is no doubt that this is down to a slash and burn of local garda resources, a reduction in the garda presence on our streets and the failure to put in place proper deterrents for criminal gangs who are targeting homes across the city. Gardaí locally are stretched beyond their limit and I know from first-hand how closely they are working with residents to try and combat these crimes. But they simply do not have the resources they

need to take the kind of pro-active approach that they would like to take. “It’s three years now since the Government made a commitment to regulating the cash for gold sector. Still nothing has been done. It is not good enough to continue to put this on the long finger, while homes across Dublin are targeted by criminals looking for quick cash. I am calling on the Justice Minister to act on this urgently.

Did you know that eating healthy fats can help you lose weight whilst diet foods can promote weight gain?

Also, did you know that eggs don’t actually raise cholesterol levels and an egg a day is ok? Want to find out more?

The Nutritional Therapists of Ireland (N.T.O.I.) has launch the nation’s first Nutritional Therapy Awareness Week. The awareness week, which takes place from the Monday 14th-Sunday 20th September, will see a number of special events, talks and promotions held across the country in a bid to raise awareness of Nutritional Therapy and inform the public about the benefits Nutritional Therapy can have on their health and vitality. The Legal Column

by Romaine Scally

Romaine Scally is the principal in the firm of ROMAINE SCALLY AND COMPANY SOLICITORS Main Street Tallaght, Dublin 24 TEL 4599506 Will. If there is no Will then, a Grant of Administration will have to be taken out. To advise you more comprehensively, you would need to instruct your Solicitor in relation to the existence or otherwise of a Will and the number of other siblings surviving your Mother. We hope that this has been helpful.

In this edition of the paper, Romaine Scally Solicitor, of Romaine Scally & Company, Solicitors, Main Street, Tallaght, Dublin 24, Telephone 014599506 email legal@scally.ie deals with the matter of Wills or the absence of, on the death of a family member. q. My Mother died in May and i looked after her in her final years. For convenience, an account was opened up in her bank, naming me as joint owner of the account. there is about €65,000.00 left in the account. i went to the bank recently to have her name removed from the account but the bank would not do this for me. are they correct?

A. Firstly, we would like to sympathise with you on the recent passing of your Mother. Secondly, in answer to your question we are unsure as to whether or not your Mother left a Will as you have not clarified this. The position with regard to money in joint accounts between parents and children differs considerably from a situation of money in a joint account between spouses or civil partners. With spouses/civil partners there is an automatic presumption that the money was jointly owned and, on production of a Death Certificate, the bank will generally transfer the money into an account in the sole name of the surviving spouse/joint owner. The situation is not so simple however when it comes to accounts in the joint names of other parties. It would be worth checking whether or not your Mother gave specific instructions to the bank at the time of setting up the joint account with regard to what would happen on her death. If she gave specific instructions that the money was to be yours on her death then, the Bank should transfer the account into your sole name but, subject to a certificate of clearance from the Revenue Commissioners for all accounts with balances over €50,000.00. If your mother left no such instructions then, it will be necessary to establish what was intended to happen to the money on the death of your Mother. You say in your letter that the account was opened up in the joint names of yourself and your Mother for convenience. This does not suggest that you contributed to the account or that the money rightfully belonged of you equally. For that reason, the Bank will need to make enquiries regarding the existence of a Will and, in particular, what instructions are in the

q. My mother died earlier this year and, as she is the surviving spouse, everything is now to be divided between her four children. Myself and my younger sister are appointed as executors. one of our brothers received a gift from my Mother of €30,000.00 approx. 4 years ago as a deposit towards buying a house. the rest of us feel that this should be deducted from his share of the estate. is this correct?

A. Firstly, may we sympathise with you on the recent passing of your Mother. To answer your question, what you are talking about is the question of an “advancement” to one of your siblings during the lifetime of your Mother. There is provision in the Succession Act, 1965 to deal with the question of any advancement to the children of a deceased and Section 63 of the Act does allow for calculation of this advancement to be taken into account when working out the child’s entitlement under the Will. I am unaware as to whether or not this is likely to be a contentious issue and, if so, the onus of proving that a child has been made an advancement shall be upon the person so asserting, unless the advancement has been expressed in writing by the deceased. In other words, did you Mother make provision for this advancement in her Will? She does not need to have done so but obviously, if she did, then the position is absolutely clear. If she made no such provision then, it is a matter for discussion between all the siblings and, if the sibling in receipt of the advance accepts that it was indeed an advancement of his share under the Estate then, the matter is simply dealt with in the Inland Revenue Affidavit and an allowance made in the final calculation. If it is to be contested then, proof of the payment of the €30,000.00 will have to be established although, given the large amount of money involved, it is likely to be easily traceable by way of a cheque or interbank transfer. Hopefully it will not come to this and we wish you the best of luck in this regard.

q. when my Father made his will over 20 years ago, he only had a house to dispose of. in his will he left the house to my Mother who has since died and, if she did not survive him, to all his children equally and his surviving two siblings, to whom he was very close. both are still alive. However, circumstances obviously improved during those intervening years and, at the time of his death last year, he had purchased two other properties and had a reasonably substantial amount of cash in

FAX 4599510 email: legal@scally.ie

the bank. none of these are mentioned in his will. there are three children living and one deceased who had three of their own children. could you advise as to the position?

A. It seems to be the case that your Father died “partially Intestate”. Section 74 of the Succession Act states: Where the Will of a Testator effectively disposes of part only of his Estate, the remainder shall be distributed as if he had died Intestate and left no other Estate. Section 74 makes it clear that the undisposed Estate must be distributed as if the Testator had died Intestate and had left no other Estate, thus rendering a partial Intestacy, independent of the provisions of the Will of the Deceased. In other words, what will happen in your particular case is that the house will be divided between his children with the children of his deceased child taking the share their parent would have inherited and his surviving siblings in the shares set out in the Will whereas, the Intestate part of his Estate will be divided equally between his children and the children of his deceased child. His siblings will not inherit any part of the Estate which will be considered to be Intestate. In short, the major difference is that his surviving siblings will only be entitled to a share of the former family home and would not be entitled to a share of the remaining Estate, which he did not deal with in his Will. It is likely to be a complicated enough application and consideration should be given to instructing a Solicitor to deal with the Estate as it is important to remember that, in every case, the Executor is liable for any errors in interpreting the Law and, in a case like this which is a partially Intestate/partially Testate Estate, it will undoubtedly lead to complications which are best avoided with the assistance of a Solicitor qualified to deal in complex Estates of this nature. We wish you the best of luck in this regard.

q. My Father died recently and he and my Mother had been living apart although were not legally separated. in his will, he appointed me as his executor. i notice from the will however that my Father makes no reference whatsoever to his cash assets which are reasonably substantial. For whatever reason there is no “mopping up” clause in the will which is very specific to property and shares. He made the will himself and this may have given rise to the mistake. in any event, in his will, he left my Mother a small pecuniary bequest from the sale of his house and everything else to be divided between the children. i am unsure as to how to advise my Mother as to her entitlement. can you give some general advice?

A. From what you have stated, your Father appears to have died partially Testate and partially Intestate. His home and his shareholdings are dealt with specifically by his Will but his cash assets

have been ignored in the Will thus rendering that part of his Estate “Intestate”. With regard to your Mother’s particular entitlement, she now has a number of options. Section 115 (2) (a) of the Succession Act 1965 states: Where a person dies partly Testate and partly Intestate, a Spouse may elect to take either: i) his/her share as a legal right or; ii) his/her share under Intestacy together with any devise or bequest to him/her under the Will of the Deceased. Your Mother’s entitlement as a legal share in circumstances where there is a Will and a Spouse with children, then she is entitled to one third of the entire Estate. If she opts for the latter, i.e. share under Intestacy then, she is entitled to two thirds of the Intestate Estate together with any devise or bequest to her under the Will of the Deceased. The latter option gives her the right to a two thirds share of whatever the value of the Estate dealt with under Intestacy together with the financial bequest under the Will. If she decides to go with the former i.e. her legal right share then, she is entitled to a total of one third of the Entire Estate. This is probably a financial question which your Mother will have to answer but you will have to present her with the facts in order for her to make an informed decision. These are her legal rights and cannot be ignored. We wish you the best of luck in this regard. q. My Mother made her will many years ago and never changed it prior to her recent death. in her will, she left everything to my Father but he predeceased her by many years. she left everything equally between her six children. one of our siblings died 10 years ago and my Mother never changed the will after that. is the estate to now be distributed amongst the remaining siblings?

A. Section 98 of the Succession Act 1965 provides an exception to the Doctrine of Lapse for Wills. In other words, if your Mother had left everything equally between her siblings and one predeceased her without having changed her Will then, everything would simply be divided between the remaining siblings. In the case of a child of a Testator however, the position is different and, for the purposes of the Succession Act, they are deemed to have died iMMediately aFter the Testator thus preserving the share for the child’s Estate. Any beneficiary dying after the Testator’s death still preserves their inheritance for their own Estate but the position is different when a beneficiary dies before the Testator. In those cases, the Beneficiary loses their entitlement as does their Estate. A special exception is made for the children of Testators however and in the circumstances which you describe, the Deceased Child’s Estate will inherit as if the said child had died after their parent. We hope that this has been helpful.

NEW KINGSWOOD SCHOOL APPLICATION

Local Councillor Charlie O’Connor has welcomed confirmation from Jan O’Sullivan TD, Minister for Education and Skills that the Planning Application for the proposed new second level school at Kingswood Heights, Tallaght was re-submitted to South Dublin County Council on 18 August last following discussions between her Department’s Design Team and senior officials of the Council. This follows a call last week from Charlie O’Connor, who represents the Kingswood Heights area, for the Minister to personally intervene in the case after South Dublin County Council had deemed invalid the earlier Planning Application lodged by the Department. He had described as a “mess” the situation where the Planning Application was invalid on a number of grounds and was most anxious to stress to the Minister how important it was that the project would not be delayed. Council Management have now confirmed to Councillor O’Connor that the re-submitted Application has been received and the Planning Department has assigned reference SD15A/0246 to the file. According to Councillor O’Connor he hoped that this new development would be welcomed in the community and he promised to continue to closely monitor the situation.

Cian Mulligan, a student at GMIT’s National Centre for Excellence in Furniture Design & Technology in Letterfrack, has been ranked 6th in the Cabinetmaking WorldSkills Competition held in São Paulo, Brazil. Cian also won a Medallion for Excellence due to his outstanding performance. Cian from Taravic, Redgap, Rathcoole, Co. Dublin is a second year student studying on the B.Sc. in Furniture and Wood Technology programme. Earlier this year he achieved first place in a rigorous selection process designed to identify the highest skilled young cabinetmaker for inclusion in an Irish team. This year 14 skilled young people we sent to compete in an array of skill areas.

Held every two years, the WorldSkills Competition is the world's largest professional education event. Competitors from over 50 countries and regions, in the Americas, Europe, Asia, South Pacific and Africa, simulate real work challenges that must be completed to international standards of quality. They demonstrate individual and collective technical skills to perform specific tasks for each of the professional skills.

The competition brings together the best young people from around the world in their chosen profession; each selected through national skills competitions for professional education. The event also provides contact and exchange of information on best practices in professional education among industry leaders, governments and education experts. In an extremely tight fought Cabinetmaking competition an unprecedented five gold medals were awarded, and one bronze. Cian was ranked in sixth place and obtained a Medallion for Excellence due to the very high quality of his work. Having just returned from Brazil this week (August 19th) Cian said: “It was an amazing experience. The competition spanned over four days with an average of five hours each day. It was intense and exciting. Now, I am ready to get back to college and see where I will end up for my 3rd year work placement.”

The IrelandSkills and WorldSkills co-ordinator for GMIT Letterfrack, lecturer Anthony Clare, said: “Cian’s work was exceptional throughout the week and we wish to congratulate him on his incredible ability and competence, to comprehensively compete in the WorldSkills competition final. In preparation for the competition an intensive training programme took place in the Dun Laoghaire Further Education Institute under the direction of Declan Barrett, the Irish WorldSkills mentor for Cabinetmaking. Michael McGuigan of Festool Ireland also kindly supported Cian’s participation in the WorldSkills competition by supplying an extensive array of power tools and equipment used.

Dermot O’Donovan, Head of Department, GMIT Letterfrack, says: “Cian’s achievement clearly demonstrates the skill level attained by students studying on our programmes. Cian’s skills and ability attained after just two years of study enabled him to earn a place, represent, and compete for Ireland on the world stage. He has proudly demonstrated the quality of education and training on offer here in GMIT Letterfrack.” “Other GMIT Letterfrack students who have participated in WorldSkills Cabinetmaking finals are Darren Barber in 2013, who was ranked 9th and P.J. Murphy in 2007, who also ranked 6th and won a Medallion for Excellence” adds Mr.O’Donovan.

GMIT Letterfrack students’ success in both national and international competitions underlies the excellence of standards in teaching and learning at the campus which has approximately 240 students registered on degree and honours degree programmes in Furniture Design & Manufacture, Furniture & Wood Technology and in Teacher Education. The college has strong links with industry with all students offered placements both in Ireland and overseas as part of their programmes.

BENEFITS OF CARDIO AND STRENGTH TRAINING By Seán Corr The days when only men lifted weights in the gym while the ladies in leotards did step aerobics in the studio next door are well and truly over.

These days’ women have a more mixed approach to exercise, because women understand that strength training isn't just for the guys. That In fact it's an essential in the battle of the flab! In this article I am going to list the benefits of both energy systems! What is Cardiovascular Exercise? Cardio for short is any exercise that elevates your heart, in turn increases oxygen in the blood and makes you sweat. Examples or cardio are class’s aerobics, Zumba and indoor cycling. Cardio is also great for not only your heart and lungs, but also strengthens tendons and ligaments found in the joints of the body. Below I have complies a list of benefits of cardiovascular Exercise: Improved Health: makes the heart stronger so improves the flow of nutrients and oxygen needed by the organs of the body. Increases metabolism:

More intense the cardio the more your Basel metabolic rate (the rate the body burns calories at rest) improves i.e. HIIT (high intensity interval training) the process of EPOC (Exercise Post oxygen Consumption Hormone Endorphins: this hormone is the happy hormone which counters stress and depression; people who exercise regularly have a better outlook on life. Improves recovery: i.e. D.O.M.S (delayed onset muscle soreness) often occurs from a heavy weight sessions where micro tears take place in the muscle fibres. The pain is felt more intensely after 48 hours cardio elevates the level of pain and gets rich oxygenated blood to speed up recovery. Helps manage health issues: i.e. diabetes, by exercising your body uses glucose (final breakdown of sugars) so in turn manages blood sugar levels in the blood. Strength Training By definition Strength training is a type of physical exercise specialising in the use of resistance to induce muscular contraction which builds the strength, anaerobic endurance, and size of skeletal muscles.

Examples of strength training are Hypertrophy, Power Lifting and Toning. Each differ in terms of rest periods, sets, volume and repetitions.

Below I have complies a list of benefits of Strength Training: Develop strong bones: By stressing your bones, strength training

increases bone density and reduces the risk of osteoporosis. Control your weight: As you gain muscle, your body begins to burn calories more efficiently. The more toned your muscles, the easier it is to control your weight. Boost your stamina: As you get stronger, you won't fatigue as easily.

Building muscle also contributes to better balance, which can help you maintain independence as you age. Manage chronic conditions: Strength training can reduce the signs and symptoms of many chronic conditions, including back pain, arthritis, obesity, heart disease

and diabetes. Sharpen your focus: Some research suggests that regular strength training helps improve attention for older adults.

Both energy systems have their benefits, but both combined works best!! Yours in wellness Seán.

o’connor WelcomeS PlanS to honour duBlin’S allireland FootBall eFFortS

Local Councillor Charlie O’Connor has welcomed confirmation from South Dublin County Council that the Council will arrange for County Hall to be decorated in the County colours and the Dublin Flag be displayed if Dublin reach the All-Ireland Football Final at Croke Park in September.

He had responded to many calls he had received asking that blue and white flags be displayed around the County in honour of the Dublin footballers and he had raised the

matter directly with Council Management.

He said he was a little disappointed that the Council had not confirmed that the colours would not be widely displayed but he did feel that decorating the County Hall and displaying the Dublin flag at Council Headquarters would at least be a start.

He added that it was now up to the Dublin team to deliver against Mayo and allow the Council to proceed with their plans.

Miracle prayer Dear Heart of Jesus in the past I have asked for many favours. This time I ask you for a very special one. Take it, dear Heart of Jesus, and place it within your own broken heart where your Father sees it. Then in His merciful eyes it will become your favour and not mine. Amen. Say this prayer for three days. Promise publication and favour will be granted no matter how impossible. Never known to fail. l.M.t.
