Sinn Féin TD Seán Crowe has described Health Minister Leo Varadkar’s visits to Accident and Emergency wards as a “pointless public relations exercise that will frustrate and bring comfort to cold patients on trolleys and deliver little if any administrative change to the hospitals he visited”.

The Dublin South West TD said that over 4000 patients were on Accident and Emergency hospital

trolleys or chairs during the month of December and that this number would be likely to increase in the month of January, regardless of the Ministers whistlestop PR tour.

Deputy Crowe said: “In the month of December there was over 4,000 patients on Trolleys and chairs in hospital Accident and Emergency wards right across the State.

“In Dublin hospitals, there were 1,318 patients on trolleys.

Figures released to Fianna Fáil reveal a substantial cut in the number of Gardaí working to prevent and investigate drug crime.

The party’s Dublin Spokesperson Senator Darragh O’Brien has described the figures as an “appalling indictment of the Government’s attitude to drug crime”.

The figures were released by the Minister for Justice Frances Fitzgerald in response to a Parliamentary Question from Fianna Fáil. They show that the number of Gardaí assigned to divisional Garda drugs units has been slashed from 359 officers in 2011 to 257 in 2015 – a cut of 28%.

Areas in Dublin have seen a severe reduction

- Some Garda divisions left without a dedicated drug unit in resources for dedicated drugs squads, with the number of officers cut from 147 in 2011 to 115 this year.

The Dublin South division has lost almost half of its drugs Gardaí, cut from 31 to 16 over four years, while 9 Gardaí have been pulled from the Garda drugs unit in Dublin West with 7 fewer in South Dublin.

The entire CavanMonaghan Garda district has no Garda drugs unit whatsoever and Laois-Offaly has also lost the six officers it had in 2011. Wexford has only 1 Garda working in its drugs unit – down from 11 in 2011.

Limerick has seen a halving from 20 to 10 Gardaí, while Wicklow has lost almost twothirds of its 2011 complement.

Senator O’Brien, who is Chairperson of the North Dublin Regional Drugs and Alcohol Taskforce commented, “This Government has turned a blind eye to the ever increasing prevalence of drugs and drug related crime in every single community across this country.

“You only have to walk through any of our cities or towns to see that drug abuse is on the rise. The drugs racket is bigger and more profitable than ever but instead of addressing this, this Fine Gael and Labour have been pulling resources away from tackling the problem at a dramatic rate. It’s nothing short of a disgrace.

“These figures show that the Gardaí are being severely

hampered in preventing and investigating drug related crime. It is shocking that a vulnerable border region like CavanMonaghan would be without any dedicated Garda drug unit whatsoever. Meanwhile units in the capital city are seeing their numbers depleted at an alarming rate.

“The policy of ignoring Ireland’s drugs crisis has

put communities and vulnerable individuals at serious risk. We cannot accept this any longer. We need a strong programme of measures to tackle drug crime and to help the ever increasing number of victims of drugs. The first step must be the reinstatement of fully resourced dedicated drugs units in all Garda divisions,” urged Senator O’Brien.

The Tánaiste Joan Burton TD, together with the Minister of State at the Department of Social Protection Kevin Humphreys T.D., have formally launched MABS’ Dedicated Mortgage Arrears Services to assist distressed mortgage holders.

MABS is the State’s money advice service, guiding people through dealing with problem debt for more than

20 years.

The Dedicated Mortgage Arrears Services launched today will increase the supports available to people in arrears, and form part of the Government’s wider range of measures to assist people with unsustainable debt.

Speaking at the launch, the Tánaiste said: “We are providing some €10 million

of additional funding over the next three years across the MABS network to provide more targeted services to distressed homeowners. This will see MABS play a greater role in offering appropriate information, advice and assistance to mortgage holders through all stages of the Mortgage Arrears Resolution Process and beyond.”

There will be three key strands to the Dedicated Mortgage Arrears Services:

Firstly, the MABS Helpline (which operates from 9am to 8pm Monday to Friday) will provide assessment, in order to channel debtors to the most relevant source of help, based on the nature and urgency of their situation.

Secondly, specialist advisors will assist mortgage holders in assessing the extent to which the option on offer from their lender is the best and most sustainable option for them, and where required, will negotiate with their lender. Nineteen such advisors are already in place and arrangements are being finalised to ensure nationwide coverage in the coming weeks.

Thirdly, court mentors will be available to assist homeowners facing court proceedings. Working in close collaboration with the Insolvency Service of Ireland, a national network

of court mentors is now in place. This follows the successful completion of a pilot project in six court locations (Dublin, Cavan, Wexford, Trim, Castlebar and Roscommon). The court mentor service offers support and advice for borrowers on court proceedings, as well as direct referral back to MABS where a case is adjourned.

Commenting on the need for court mentors, Minister Humphreys said: “Increasingly, debtors with significant mortgage arrears are arriving at MABS on receipt of letters regarding legal proceedings, needing advice and support on going to court and the range of resolution options that may be available to them. There is now a MABS Court Mentor service at all court repossession hearings right across the country.”

The Tánaiste said: “While the most recent data available from the Central Bank shows that the number of homeowners in mortgage

arrears has fallen significantly as the economic recovery picks up, there is still a large number of borrowers in long-term arrears and the MABS services will provide vital support and assistance to them.”

Minister Humphreys said: “The combination of all these measures will enable MABS to play a greater role in assisting distressed mortgage holders by targeting its resources directly at those most in need of assistance and support. I want to thank MABS and the CIB for their extensive work over recent months to ensure that these much needed services could be made available to those in mortgage arrears as quickly as possible.”

usi launches ‘i Value higher education’ petition

The Union of Students in Ireland (USI) has joined forces with the Teachers' Union of Ireland (TUI) as part of its # EducationIs coalition to campaign against the erosion of the publicly funded higher education system, and safeguard higher education for the next generation.

“USI is proud to join with TUI on the ‘I Value Higher Education’ campaign which seeks to promote the value of higher education in Irish society.”

Kevin Donoghue, USI President, said. “The campaign acknowledges higher education as a central function within the social, cultural and economic fabrics of Irish society.

It recognises the contribution already made to the Irish

economic growth and social development through the provision of publicly-funded higher education; promotes free higher education as a public good; calls for equality of access to higher education opportunities and the provision of clear progression routes to enable lifelong learning; and advocates for the resourcing of a higher education infrastructure which can best meet contemporary national and international challenges and demands.”

The Irish state funds 14 institutes of technology, seven universities and six colleges. While the public higher education sector has expanded to meet growing demand, funding has not kept pace with this development.

Regrettably, it has decreased significantly.

In the last seven years funding in the higher education sector was

cut by 32% €428.3m).

Aidan Kenny, Assistant General Secretary at TUI, welcomed the joint campaign by USI and TUI in support of free publically funded higher education. “It is vital that students and lecturers work together to achieve the aim of free quality higher education which is accessible to all.”

Kenny said “Higher education as a public good should be funded collectively by society through general taxation, corporation tax and a higher education levy. The market model of student loan schemes is not appropriate; it places an unacceptable individual debt burden on students and commodifies higher education into a product which can be sold.”

The magnitude of the funding cut over a relatively short period

of time is having a profound impact on the sector’s capacity to function. In addition to budget cuts, the student tuition fees for undergraduate programmes have increased to €3,000 per year. The new proposed student loan scheme would deter students from applying to college and place a significant individualised debt on each student when they graduate and commence their careers.

The demand for places in the higher education sector has grown considerably, with an increase in student numbers of up 20% between 2008 and 2014. Presently, there are just over 200,000 students attending higher education programs (undergraduate and post-graduate) in the Republic of Ireland. At the same time, staffing levels have been

inCRease in diReCt pRoVision allowanCe foR ChildRen announCed

The Government has tannounced that it will increase the Direct Provision Allowance (DPA) for children by an additional €6.00 per week. This will bring the allowance to €15.60 per week for each child.

The increase to the allowance will directly benefit children and their families living in Direct Provision centres and those coming to Ireland under the Irish Refugee Protection Programme and the UNHCRled Resettlement Programme.

The Tánaiste and Minister for Social Protection, Joan Burton, T.D., said, "The Government is committed to reforming direct provision to ensure a more compassionate system at every stage that treats asylum-seekers with dignity

and improves their quality life while their of applications are being processed. The Working Group’s report is now being examined in depth with a view to ensuring all necessary supports are put in place. As an interim step that process while continues, we are increasing the rate of Direct Provision Allowance for children. This will have a positive effect on all children residing within the Direct Provision system and provides for a modest increase in the income for families, enhancing their social inclusion and integration into local communities."

An increase to the allowance had been proposed by the Working Group to Report to Government on

Improvements to the Process, Protection including Direct Provision and Supports to Asylum Seekers. The Report of the Working Group was published by Government on 30th June 2015 and its recommendations are under active consideration by the Cabinet Committee on Social Policy and Public Service Reform.

The Minister for Justice and Equality, Frances Fitzgerald, T.D. said "The Tánaiste and I believe that it is appropriate to provide for an immediate increase in the allowance payable in respect of children which the Working Group identified as a particularly vulnerable group within the system of Provision.

discretionary expenditure for children in the direct provision system."

The Minister of State with responsibility for New Communities, Culture and Equality and Drugs Strategy, Aodhán Ó Ríordáin, T.D., also welcomed the increase saying, "This is a positive first step in the implementation of the findings of the Working Group report regarding financial supports. Through engaging with the NGOs who were represented on the group and visiting Direct Provision Centres, I have witnessed first hand the issues facing those living in Direct Provision. I welcome the Government's decision today and I look forward to further decisions on the implementation of the recommendations of the

Working Group by the Cabinet Committee".

The payment is a cash supplement for personal incidental expenditure and is paid in addition to applicants for international protection being provided with all basic necessities, food and including accommodation. It is also open to any asylum seeker to seek assistance for a particular once-off need by way of an Exceptional Needs Payment as provided for under the Department of Social Protection’s Supplementary Welfare Allowance scheme.

Minister Fitzgerald also commented that the increase should not be seen as an isolated measure. It comes at a time of significant reform to our asylum system following the

signing into law of the International Protection Bill.

Minister Fitzgerald said "The reforms to our asylum system, which are being implemented under the International Protection Act, will significantly streamline and speed up our processing of protection applications, thereby reducing the amount of time that persons will spend in the Direct Provision system.

The introduction of a single application procedure will also bring Ireland in line with the arrangements for the processing of protection applications in all other EU Member States and delivers on the commitment made in the Statement of Government Priorities 20142016. It is, I believe, a reforming significant measure in our asylum system."

sinn féin Commits to 10,000 soCial and affoRdable houses foR south dublin

Sinn Féin Councillor Eoin Ó Broin has said that Sinn Féin’s new housing policy commits the party to funding 10,000 social and affordable housing units for South Dublin County Council over 15 years with 3,000 of these being delivered in the first six years .The document, Better 4 Housing, was launched by Mary Lou McDonald TD, Dessie Ellis TD and Cllr Eoin Ó Broin.

Cllr Ó Broin said:‘There are almost 9,000 families on the South Dublin County Council housing waiting list. There are 248 families living in emergency accommodation and a further 43 on a waiting list for emergency accommodation.

‘The only solution to this crisis is to provide people with homes. This means that central government must start funding large scale social and affordable housing provided by local authorities and housing associations.

‘Sinn Féin have now launched our response to the housing crisis. The 37 page policy document, Better 4 Housing, outlines Sinn Féin’s commitments on social housing, the private rental sector and the private for purchase market.

‘At the centre of our proposals is a 15 year plan to fund and build 100,000 social and affordable Council houses across the state. These houses would not only meet the need of

those families on council waiting lists. It would also reduce the pressure on the private rental and first time buyer markets resulting in reduced rents and house prices.

‘South Dublin County Council has 10% of the state’s housing need. As part of the Sinn Féin plan we believe Government should fund a programme of 10,000 social and affordable houses in the County.

‘Sinn Féin in government would initially fund a programme of 3,000 social and affordable houses in the County, to be delivered by the Council at an approximate cost of €525m.

The funding would come directly from the exchequer.

‘Fine Gael and Labour want to fritter this money away

in tax cuts for the wealthy.

Sinn Féin has a different set of priorities; we want to end the housing crisis.

‘Additional units would also be provided through Housing Associations and from private units purchased via Part V of the planning acts.

‘Our new housing policy also calls for tighter regulation of the private rental sector including the linking of rents to the Consumer Price

Index and limiting the grounds on which landlords can issue Notices to Quit.

Rent certainty and security of tenure are vital if people living in the private rental sector are to be properly protected.

‘We are also committing to increase central government funding to address the homeless crisis by €30m and to reforming all state supports for people

Fine Gael TD Mary Mitchell O’Connor, has said that bringing young people home for good is a key part of Fine Gael’s plan to keep the recovery going in 2016 and that motor insurers also have a role to play.

“This year, for the first time since the crisis began, more people will return to Ireland than leave. However many insurers are not recognising driver experience accrued abroad and are quoting those returning to Ireland to work extremely high premiums.

“Since the launch of the Action Plan for Jobs in 2012, over 135,000 jobs have been added to the economy.

Over Christmas many major employers have launched recruitment campaigns to encourage people to come back for good.

This is all very positive

but unexpected costs, such as very high insurance, could act as a deterrent.

“When Fianna Fáil wrecked the economy they destroyed the future of countless young people who were forced to emigrate in search of work and opportunity.

Five years later, thanks to the work of the Irish people, the economy is recovering and there are opportunities at home once again.

“By 2020 we expect 70,000 Irish emigrants to have come home to take up new jobs and opportunities. T he Government is working to create opportunities for these people and to reduce taxes so they can keep more of their own money.

Figures showing that the numbers of people employed in small and medium sized companies have grown by almost 4,000 in the Dublin area during 2015 show the vital role they play in the local recovery, economic according to Independent Senator and Dublin South West candidate, election Katherine Zappone.

The Independent Senator, who created over 100 local jobs in An Cosán, Fledglings and the Tallaght West Childhood Development Initiative, says every support possible must be given to people in our communities with good business ideas and to firms already delivering jobs in Dublin South West.

The Independent candidate also highlights that two out of every three jobs in local communities are provided by small

businesses.

Speaking while campaigning in Dublin South West Senator Zappone added: “The latest figures from state agency Enterprise Ireland show that right across our local areas small businesses are making a real difference by generating local jobs, local wages and local economic activity.

Many of the business people I meet are from emerging turbulent years of sleepless nights during which they were forced to make difficult and painful decisions in order to ensure their very survival.

They now deserve every possible support while people with new ideas must also be encouraged to bring them to reality. I am asking that Enterprise Ireland use its recent successes to review its entire range of supports to businesses and see

what more can be done.

We must look again at the financial incentives, research and marketing supports as well as information offered to those people who are willing to risk everything to rebuild our economy.

The role of the Dublin South County Enterprise Office as well as the research capacity of IT Tallaght will be key if we are to build on the which has growth already been achieved.

Both must work side by side with local businesses.

I would like to see Enterprise Ireland run information workshops in Dublin South West to outline existing services it offers to existing businesses which want to grow or to those who want to use their skills to start up. soCial welfaRe oVeRhaul needed to taCkle unaCCeptable appeals waiting times

Fianna Fáil councillor John Lahart is calling for a major revamp of the social welfare applications process to reduce the excessive waiting times. The latest figures released to Fianna Fáil reveal that the average processing time for social welfare appeals in 2015 was almost six months (25.7 weeks) for an oral hearing and over four months (18.2 weeks) for a summary decision.

However, people are having to wait almost a year for an oral hearing for certain payments like the Contributory State Pension.

Cllr Lahart explained, “Thousands of people across Dublin are being

forced to wait months for decisions as a result of unacceptable delays in the social welfare appeals process. This is leading to months of stress and anxiety, not to mention the financial burden that is placed on these families while they await a decision.

“The average waiting time for a summary decision on Carers Allowance is almost 21 weeks, while the waiting times for Illness Benefit and Child Benefit are 26 and 25 weeks respectively.

“These payments are a critical source of income for many families across the county and the delays they are experiencing have serious financial

implications for them.

When you consider that 1,233 nationally applicants were awarded the Carer’s Allowance on appeal in and 3,102 2015 applicants were awarded the Disability Allowance on appeal in the same period it shows the need to reform the system.

“The current system is simply not working.

Fianna Fáil wants to see the applications process for the Carer and Disability Allowance radically overhauled.

The existing system bases decisions for the Disability Allowance on medical assessment rather than examining the impact of the person’s disability on

their capacity to work.

“We would also like to see the Social Welfare Appeals Office placed on a statutory independent footing to ensure independence from the Department of Social Protection. All actions and decisions taken by Appeals Office should comply with national and international human rights standards.

“The Department of Social Protection is failing vulnerable people by forcing them to wait unacceptably long periods of time for a decision on an appeal.

The system needs to change to ensure that those in need are given a helping hand” urged Cllr Lahart.

o’ConnoR suppoRts Community on old bawn paVilion issue

Local Councillor Charlie O’Connor has once again stressed strong support for the views of the local community in respect of the proposal by South Dublin County Council to provide a Pavilion at Dodder Valley Park Old Bawn Tallaght and has called on Council Management to respond to concerns expressed.

He was commenting after a recent public meeting held to discuss the issues and sought a report at the December meeting of the Tallaght Area Committee.

The Manager reported to Charlie O’Connor as follows: “A Public Meeting was held in the County Library on the 25th November 2015 with the residents from the Old Bawn Area to discuss the proposals that are currently out for Public Consultation in connection with the proposed pavilion for Old Bawn Park, Dodder Valley. Over 430

houses were circulated in advance by leaflet drop to inform the residents of the meeting.

All of the issues raised and discussed have been noted and will be considered. The public have until 4pm on the 18th December to make formal observations or submissions on the plans. When these have been examined a report and recommendation will be prepared and brought before Council, early in 2016.”

According to Councillor Charlie O’Connor this is an important issue for the local community and he acknowledged the contacts he has had from local residents, Old Bawn Residents Association, Parkwood Residents Association, Shamrock Rovers Football Club, Thomas Davis GAA Club and Tallaght Rugby Club. He continues to represent the concerns regarding location, design and drainage directly to Council Management.

Fianna Fáil’s Dublin spokesperson Senator Darragh O’Brien is calling on the Minister for Arts & Culture to immediately halt any work on historical buildings in Moore Street and specifically to ensure that Number 18 is not demolished.

Tánaiste and Labour Leader Joan Burton visited Loreto Primary School in Rathfarnham recently with Councillor Pamela Kearns, Labour Party general election candidate for Dublin South West.

A major building project for Loreto Convent was included in the school building announcement made by Education Minister Jan O’Sullivan. It is envisaged that construction on the new Loreto school will commence in 2018 as outlined in the programme. The project, when completed, will provide accommodation for a 24 classroom school.

The Tánaiste said: “I’m delighted that the Loreto school was among the major building projects that were announced.

There was a really open, positive and friendly atmosphere in the school when I visited.

The Bill called on the Government to protect all the major landmarks associated with the Easter Rising in Dublin. “Fianna Fáil wants to create a 1916 historical quarter in Dublin city, which would encompass not only the GPO and Moore Street, but also other key locations which were linked to the 1916 Easter Rising such as Boland’s Mills, South Dublin Union (St. James’ Hospital), the Old Jacob’s Factory and the Royal College of Surgeons to name but a few.

“Eventually we would like to see all of the locations where Irish Volunteers and the Irish Citizen Army fought during Easter week preserved. The Bill provided for the establishment of an urban development

company which would oversee the creation of the 1916 historical quarter to ensure that areas of historical significance are given the prominence they deserve. Beginning with the GPO and Moore Street area, the development company would undertake major regeneration and restoration works in and around Dublin city centre, which would not only serve

to mark an important event in Ireland’s history, but would also breathe life back into areas which have fallen into disrepair. We are committed to the past and the future of the area.

“We want to create a city that respects and preserves its history, while at the same time rejuvenating those areas. Fianna Fáil is calling for the establishment of a

‘Freedom Trail’ to clearly identify all of the sites associated with the Easter Rising.

“While we support the Government’s programme of events to mark the Rising, there needs to be a lasting investment made in our history and heritage so that future generations of Irish people recognise the sacrifices made in 1916.”

Fine Gael General Election candidate for Dublin South-West, Councillor Anne-Marie Dermody, has adopted a dog in response to the news that there were 88 abandoned pups rescued by the DSPCA before Christmas. “I have little Scooby Doo in my arms here but unfortunately many dogs will be returned or abandoned over the next number of weeks”, Councillor Dermody said.

Brian Gillen, CEO of the DSPCA, is expecting an influx of dogs over the next number of weeks which is the case every year after the Christmas period.

“Thankfully we find homes for the abandoned animals and we will find a home for the dogs that will inevitably come in over the next number of weeks”, said Brian Gillen.

“We here at the DSPCA very much welcome the news that €290,000 will be given to us with immediate effect,

Sinn Féin Councillor has described as ‘shocking’ the revelation that Clondalkin and Lucan families with special needs children are left waiting years for crucial interventions including speech and language therapy, occupational therapy and psychology.

Parliamentary Questions have also revealed that the numbers of families affected and the waiting times are longer in Dublin MidWest than in neighbouring Dublin South West, Kildare West/Wicklow and Dublin South Central.

Cllr Ó Broin said: ‘For some time I have been concerned about the length of time families with special needs children in Dublin MidWest have been left waiting for diagnoses and crucial interventions for their children.

‘Leaving a child for up to two years with no speech and language therapy can have a huge impact on their development. It also places an enormous emotional and financial strain on families who are left to fend for themselves.

‘The problem is that Rosses Court Resource Centre, as with all such service providers, simply do not have the staff resources to meet the need in the local community. The same

problem applies to the provision of special needs places in local schools.

‘Without adequate funding to the HSE and to local schools families with special needs children will continue to be failed by this Government.

‘Sinn Féin’s Budget proposals for 2016 called for an increased investment in disability services of €45.89m.

This would provide for up to 600 extra occupational therapists, physiotherapists, speech and language therapists, and psychologists. It would also fund additional personal assistant hours and community based neuro-rehabilitation teams and transitional services.

‘This is the level of investment that is required to ensure that all children have the supports their need.’

Ms Tallaght Samantha Nichol recently called in to the Newsgroup offices to give us an update on her progress over the last few months. Samantha did not win the Ms Ireland crown back in November, but she did receive three awards for her participation including best interview, best evening wear and Miss Publicity. Over recent months Samantha has volunteered for numerous Tallaght organisations and been a guest at many events.

One of Samantha's ambitions was always to participate in a pageant, but more importantly was to help out and volunteer in her local community. All details were managed by Samantha in the run up to the pageant including designing her own dress and recruiting 17 sponsors.

Samantha added, 'Representing Tallaght my home town made me very proud and I would like to say a Big Big thank you to all my sponsors, Mary McLoughlin Tallaght Person of the Year 2015, Cllr. Mick Duff, my family, friends, my Mum and my Fiance Ryan Hamilton'.

Upcoming visits for Samantha will include visiting the children's section at Tallaght Hospital, some local Tallaght schools and in the new year an interview on TV3's Ireland AM. The Community Endeavour Awards aim to acknowledge, promote and recognise the work of community and voluntary organisations within the administrative area of South Dublin County Council.

There is an immense richness and variety of voluntary organisations working in South Dublin and this initiative in some small way tries to recognise the efforts of those who carry out this valuable work. All community organisations whose activities have made a difference in their community and have had a beneficial effect on the residents were eligible to enter.

140 entries were received from a wide variety of groups operating in South Dublin County.

An independent judging panel assessed each entry and the Awards were made at a function in the Red Cow Moran’s Hotel on Friday 11th December by Mayor of South Dublin ,Councillor Sarah Holland.

Speaking at the event, Mayor Holland said “Tonight is about recognising your endeavour and rewarding it but it is also a night where, as a Council, we give thanks to you for your work over the past twelve months.”

My Mother has expressed a wish to my sister and myself that she would like to set up a Power of Attorney and appoint both of us as her Attorneys. My Mother is 86 but in pretty good health and is still very alert. Is there any test she would have to do to see if she is still capable of signing a Power of Attorney.

A. Firstly, long may your Mother remain in good health. I assume that you are talking about creating an Enduring Power of Attorney (EPA) which allows the chosen Attorneys to act as Agent for the Donor (your Mother). Should the Donor go on to become incapacitated thereafter, there are certain criteria set down for a Court to consider whether the Donor had the capacity to understand what they were signing. There is one Irish case law on this subject in which capacity to create an Enduring Power of Attorney was considered. It was decided that the minimum that a Donor needed to understand for the purposes of properly creating the Enduring Power of Attorney are as follows:The Donor must understand: 1.

The range of matters in respect of which the Donee (Appointed Attorney) would have authority to act on his/her behalf.

2.

That the Power, once registered, could only be revoked by Order of the Court.

3.

The limited power of the Notice

That, subject to any limitations placed in the Instrument itself, the Donee of the Power will be able to do anything with the Donor’s property which the Donor him/ herself could have done. In addition, your Mother’s doctor would have to be involved in the decision making and he/ she does have to certify, as close in time as is possible to the signing of the Enduring Power of Attorney, that your Mother is mentally capable of understanding the document she is signing.

From what you have said, your Mother would appear to be perfectly capable of signing an Enduring Power of Attorney and, if this is her wish then, you should start the process by attending with a Solicitor to start the procedure. We wish you the best of luck in this regard.

Q. My father has recently been diagnosed with Dementia. The family are very anxious that he should sign an Enduring Power of Attorney. Is it too late?

A. This is always a devastating diagnosis for both the person themselves and for the family but, if it is an early diagnosis at least it will allow time to make preparations.

The diagnosis of Dementia itself does not automatically mean that the sufferer cannot have periods of lucidity, during which time an Enduring Power of Attorney (EPA) can be executed. The most important thing however is for the treating doctor to be able to certify that, at the time of signing the EPA, the Donor had the mental capacity to understand what he/she was signing. It would be vitally important therefore for your father to attend with this doctor to ascertain if, in the opinion of the doctor, he is capable of signing an EPA. If the doctor is supportive of such action then, you should arrange for your Father to go to a Solicitor to set the procedure in train. One of the documents UHTXLUHG LV D PHGLFDO FHUWLĂ€FDWH IURP WKH treating doctor certifying that the Donor is lucid and capable of making the decision to sign an EPA. The most important thing however is that there should be no “gapâ€? in the time between your Father signing WKH (3$ LQ WKH 6ROLFLWRU¡V 2IĂ€FH DQG WKH 'RFWRU VLJQLQJ WKH 0HGLFDO &HUWLĂ€FDWH Remember, that in order for the Doctor WR VLJQ WKH 0HGLFDO &HUWLĂ€FDWH KH KDV WR have an attendance with your father and

these dates should be as close as possible to each other. Ideally, they should both be done on the same day. In circumstances where there is any query in relation to the capacity of the Donor to create the EPA any “gapâ€? in obtaining the medical FHUWLĂ€FDWH VKRXOG EH DYRLGHG :KHUH D SHUVRQ KDV Ă XFWXDWLQJ RU GHWHULRUDWLQJ mental capacity, simultaneous or near simultaneous medical assessment is desirable and this is so because the Ă XFWXDWLQJ QDWXUH RI WKH FRQGLWLRQ LWVHOI opens the possibility that the mental capacity of the Donor may be impaired.

This is not to say that simultaneous legal and medical assessments are always required and whether this is so will depend on the circumstances of the individual Donor. However, most particularly in circumstances where a diagnosis of Dementia has already been made, it would be vitally important to ensure that the GRFWRU VLJQV RII RQ WKH 0HGLFDO &HUWLĂ€FDWH on the same day as your Father attends with the Solicitor to sign the Enduring Power of Attorney. We wish you the best of luck in this regard and hope that the above has been helpful.

Q. My brother took out a Grant of Probate in the Estate of our late Father.

He is now putting the house up for sale.

We asked him to provide us with an Estimate as to what each family member would get. He sent us a statement but LW GRHV QRW UHà HFW WKH IDFW WKDW RXU Father, 6 months before he died, lent this brother a lot of money to help him ÀQDQFH KLV KRXVH +H VD\V WKDW LW ZDV D gift and should not be taken into account in working out his share of the entire Estate. We know that it was a loan to be either repaid or deducted from his share of our Father’s Estate. Is there anything we can do as he has already taken out the Grant of Probate?

A. Section 50 of the Succession Act, 1965, sets out the powers of Personal Representatives. The Personal Representative may sell the whole of, or any part of, the Estate of the Deceased person for the purposes of not only paying debts but also for the purposes of distributing the Estate among the persons entitled thereto.

However, equally, personal representatives face a number of potential causes of action against them, all of which are dependant on individual facts and circumstances of each particular case. They can include cases where there has been a mismanagement of the Estate and Effects of the Deceased in squandering and/or misapplying the Assets, contrary to the duty imposed on them for which Executors or Administrators must answer out of their own pocket as far as they

had, or might have had, assets of the Deceased.

The primary duty of the Administrator of the Estate is to gather in the Assets and to ensure that the wishes of the Deceased are carried through. We have not seen the Will of your Father and do not NQRZ ZKHWKHU RU QRW KH PDGH D VSHFLĂ€F mention of the prior loan or gift to your brother. However, one matter is clear, on allowing the Grant of Probate to go through in the name of your brother, you have entrusted him to act honestly and in good faith. This fundamental obligation can never be departed from. Your brother LV OLDEOH WR HDFK %HQHĂ€FLDU\ IRU DQ\ breach of trust. In certain circumstances, D 7UXVWHH PD\ EH UHPRYHG IURP RIĂ€FH LI he or she has not acted in accordance with the Trust Instrument (in this case, a Will) or in circumstances where a Trustee has acted dishonestly or incompetently or is seen to be wilfully obstructing the administration of the Estate.

There are also circumstances where a Court might withdraw, on application by other interested parties, a Grant of Probate, in circumstances where there has been an REYLRXV FRQà LFW RI LQWHUHVW EHWZHHQ WKH $GPLQLVWUDWRU DQG WKH %HQHÀFLDULHV 6XFK an application however is regarded very seriously by the Court and is dealt with under Section 26 (2) of the Succession Act, ,W LV QRW MXVWLÀHG VLPSO\ EHFDXVH WKH RWKHU %HQHÀFLDU\ DSSHDUV WR IHHO H[FOXGHG or frustrated at the steps being taken by the Administrator. It must show serious misconduct and/or special circumstances on the part of the Administrator to justify such a drastic step. There is case law to support the family’s application to have your brother removed as Administrator. In the case in point (Flood –v- Flood 1999), the Defendant who was the Executor of the Estate, had borrowed monies from the Deceased which she was then UHIXVLQJ WR UHSD\ DQG WKH FRQà LFW RI interest was asserted between her role as Executor and a possible Debtor of the Estate. The overriding principle the Court must consider is the welfare of the %HQHÀFLDULHV ,W ZRXOG VHHP WR PH IURP the facts which you have disclosed that there may be a case to be made for your brother to be removed as Administrator of your Father’s Estate. However, it will be important to take proper legal advice before any such threat is made to your EURWKHU DQG SHUKDSV ZLWK WKH EHQHÀW RI a Solicitors letters, might give him the opportunity to deal with the loan from your Father by way of a deduction in the Inheritance he will take in administering the Estate. It would be preferable to avoid a lengthy legal case and high legal fees, if at all possible. We wish you the best of luck in this regard.

While people might be still recovering from their postChristmas financial hangover, according to Taxback.com there is one sure thing that will get people feeling better – a monetary windfall. The tax experts are calling on all taxpayers to make one particular New Year’s resolution this year – to get what is owed to them back from the taxman.

Barry Flanagan, Senior Tax Manager at www.taxback.com, “Every year we have the same message – get what’s owed to you in tax refunds. And while tax efficiency has become more commonplace amongst the Irish public, there are still thousands of people who will leave millions of Euro with the taxman this year – don’t be one of them!

Austerity budgets may be over but there’s no doubt that the last few years have seen people pay more in taxes and charges, stealth and otherwise, than ever before. This should really bring it home to people that they absolutely should claim

back their entitlements from these years. Although there have been a variety of cuts to tax reliefs in recent years many people are unaware that you can go back up to four years - from January 1st you can claim back any tax refund entitlements from 2012 – 2015”.

Taxback.com say that their average PAYE refund is €880 and that the effort it requires people to get this is minimal to say the least.

Barry continued, “Get your PPS number, gather your receipts, sign a form or two, wait 2 to 6 weeks – and there you have it – money for nothing essentially.

It may sound too good to be true but it’s not – if you are an Irish taxpayer who has paid medical bills on behalf of anyone – yourself, your parents, your children - in the last 4 years, then you are entitled to a refund.

And that’s just one of the categories for which you may be able to claim.

By way of advice, I would begin by telling people to be sure to keep doctors receipts, tuition fees receipts and any correspondence from

Revenue – all of these will make the tax reclaim process so much easier”.

The 3 main reliefs have changed in the last few years – but can still be claimed:

· For medical expenses, relief at 20% is still available and can be claimed on most unreimbursed expenses incurred and on qualifying non-routine dental expenses.

· Many people wrongly believe that the Home Carer Tax Credit is for those caring for other people’s children, the elderly or disabled people – they don’t realise that it can be where any claimed housewife or house-husband works in the home, caring for their own children. And with the increase from €810 to €1,000 in 2016, this credit is more valuable than ever. It is available to any jointly assessed couple with one or more child, where the non-assessable spouse has income of less than €7,000 in 2016. · The tax credit for tuition fees is still available.

apply to the first €3,000 of qualifying fees paid.

Similarly, for part time courses the first €1,500 is disregarded in respect of each claim.

As the student contribution now falls under the definition of “tuition fees” it means that any family with more than one child in college will usually qualify for a tax refund. Similarly, those paying higher fees in private colleges, above the €3,000 de minimus, will often qualify for a valuable

credit of up to €800 even where there is only one child in college.

Barry went on to say, “Overpaid tax is also an area which results in many people receiving much welcomed refunds from the Revenue.

This can occur inadvertently – especially if you have changed employment during the year or returned home from abroad. Individuals should look back on their income tax and USC payments to ensure that

they have not overpaid in prior years and should claim a refund before it’s too late”.

significant net contribution to the Irish labour market and economy; 95% of jobs attained by graduates are within Ireland itself, with nearly half of these located outside of the capital. Small too, have businesses, benefited from the programme and retention in self-employment is high – 81% of those who were selfemployed twelve months after finishing their course indicated fifteen months later that they were still self-employed.

Participants in Springboard+ have been very positive about their experience on the courses.

73% of graduates, for example, indicated that their career prospects were better after completing the course. It is not difficult to see why. In

2014, 52% of Springboard+ graduates were back in work within six months of completing their course, some as employees and a significant number as selfemployed. A survey of all graduates 2011 – 2014 indicates that within two years of completing a Springboard course, 60% of respondents are employed or self-employed, with progression to employment steadily increasing over time.

The Manifesto includes proposals such as making early year’s childcare and education a priority and working towards repealing the 8th Amendment of the Constitution.

Councillor Sarah Holland said “Sinn Féin is a progressive party with equality as one of our core principles. Women’s Rights are high on our agenda and neither Seán Crowe nor I had difficulties in signing up to these progressive proposals.

"I congratulate the National Women’s Council for kick starting this discussion, as women at the moment only make up 16% of our TD’s, and we have not had a female TD in Dublin South West for over almost 14 years.

"We have a big opportunity for real change in the upcoming election and I wish the very best to all of the female candidates.”

66% expeCting a pay Rise in 2016 but men moRe likely to ask than women

Matrix Recruitment Group's Annual Salary Expectations Survey has found that salary expectations among employees are getting higher with 66% of respondents revealing they expect a pay rise in 2016.

This figure is increased versus the 61% of respondents who said they expected a pay rise in 2015.

Matrix’s Annual salary survey examines trends in the jobs market year on year and this year's results are evidence of ongoing growth, with the having economy significantly strengthened in recent months.

When it comes to broaching the subject of money with employers, men are more confident than women as when it comes to asking for a pay rise with 26.7% of males saying they would be ‘very confident’ in asking for a pay rise in 2016 versus only 17.5% of females.

Of those respondents who

expected a pay increase in 2015, only 38.5% actually received one with almost half of employees having had to move jobs to get it (43%).

Salary increases appear to be a deal-breaker for many employees. When presented with a number of reasons for moving job in 2016, 27.8% admitted that an improved salary and benefits package would be the biggest factor in their decision. When it comes to those who expected a pay increase last year and didn't receive one, 81% admitted that they are planning on moving jobs or would consider moving jobs if the right offer came along in 2016.

Matrix Recruitment Group, founded in Ireland in 1998, with offices in Dublin, Galway, Waterford, Carlow and Athlone surveyed just under 650 people across a wide range of position types

and industries. 29.5% are in management positions and 17.8% are in senior/ specialist roles. 79.7% of respondents are earning up to €55k and 1.2% are earning over €100k.

Speaking about the survey results and what they could mean for the employment market in 2016, Kieran McKeown, Founder and Managing Director of Matrix Recruitment said “In 2015, due to the improved economy, we saw a lot more movement in the jobs market across all regions and in particular in the 2544 year age bracket. A lot of people are at the stage where they are looking to progress and in turn, increase their salaries. It is interesting to see that salary can be a deal-breaker for employees. The findings demonstrate that this year, across the board, employers will need to look at how they retain existing

employees, particularly with 81% of those who did not receive their anticipated salary increase admitting that they will look at moving roles in 2016.

He continued, “There is no doubt that employers will need to be more proactive in retaining staff for 2016 rather than waiting to counter offer a pay rise when employees receive another offer. By then it may be too late and employees may have made their already decision.”

When it comes to benefits, the survey found that employees value health insurance, performance bonus and pension as the most important benefits with an on-site gym or gym membership ranked as the least important.

The survey found that nearly 47.2% of employers are

making pension contributions versus 40% in 2015 and over 41.2% of employees receive more than the statutory annual leave versus 30% of those surveyed in 2015.

Speaking about employee benefits, Kieran McKeown, said “Across all sectors we are seeing first hand that benefits packages have dramatically improved in the past year. I think it is important for employers to be aware that salary is not the only factor to consider when looking at staff reward and retention. Benefits can be an incredibly important retention tool for staff and help to create a well-

rounded rewards package.

Health Insurance, Life Assurance, Bonuses as well as flexible work solutions like flexitime, job sharing and work from home options are all very appealing. Smart employers are now looking to reward their workforce by increasing benefits, particularly those that were really diminished during the downturn.”

The Irish Heart Foundation’s second annual On The Dry campaign supported by 2FM has attracted nearly 3,000 registrants over the Christmas period so far from people looking to make a fresh, alcohol-free start in 2016.

In a survey of last year’s participants, 62% said they had better sleep and more energy after taking part, 49% reported losing weight, 79% saved money and 82% said they felt a sense of achievement.

According to organisers the campaign is on target to more than double its participation on last year aiming to top 4,000 sign ups from individuals, teams and workplaces. January 2015 was the first time a ‘Dry January’ style campaign ran in Ireland.

Already Dublin, Cork and Galway are the counties topping the registrations to give up alcohol this January and raise money for a good cause, while registrations from Wexford are coming in as a close fourth with just five sign ups between it and

Galway.

On Christmas Day, although most visitors to onthedry.ie came from Dublin, the most serious about taking action to give up alcohol on 25th December were from Mallow, Ennis, Carlow and Bray, all of which had the highest conversion rates to sign up.

2FM’s Keith Walsh who is set to host New Year Live from Three Arena with Kathryn Thomas on 31st December, is ready to go On The Dry the next day. He said: “I like a drink but I also like to have periods where I don’t drink. Not drinking in January is a great way to start the year with a clear head. I got involved with Dry January hoping to encourage others to take down time out from drinking, ‘cause not drinking is the new drinking!”

The computer programming genius is played by Jesse Eisenberg and the film charts his success and the personal and legal costs of revolutionizing communication.

2. Girl, Interrupted Based on the memoir by Susanna Kaysen about her time in a mental hospital in the 1960s. It is a harrowing and compelling drama which earned supporting actress Angelina Jolie a trophy cabinet full of awards. Winona Ryder is also brilliant in what is a thought-provoking and mesmerizing tale.

3. The Wolf of Wall Street Stock-broker Jordan Belfort made and lost millions of dollars over and over again during his time on Wall Street. A heady mix of criminality, hard work, ambition and corruption the film is a rollercoaster ride – much like Belfort’s life.

Both lead actor Leonardo Di Caprio and supporting actor Jonah Hill were nominated for Oscars along with director Martin Scorsese but all, shockingly, went home empty handed.

4. Boys Don’t Cry Prepare to bawl your eyes out from start to finish during this true story which gripped America. Popular, sensitive and charming Brandon Teena finds himself making friends easily in a new town, until those

friends find out he was born a she, Teena Brandon, and the consequences are devastating. Hilary Swank was a much deserved Oscar winner for her portrayal of Brandon in this brilliant and heartbreaking movie.

5. The Basketball Diaries Another entry for Leonardo Di Caprio who gives what could be his best ever performance in this 1995 tale of a promising young athlete who spirals out of control. Writer Jim Carroll’s personal story of drug addiction, prostitution, teen angst and life on the street is a fantastic film and a must-see for fans of films based on true stories.

Those are our Top Five picks but there are so many amazing movies that are based on true stories; some loosely and others a more realistic account. Although they didn’t make the cut this time here are some honorable mentions for other movies which were based around real-life events.

So if five films are not enough look out for these too – Dallas Buyers Club, Cool Runnings, Alpha Dog and Saving Private Ryan.

BRING ME BACK ALIVE

A play focusing on the issue of mental health amongst young people will be staged in Bawnogue on Friday, January 22nd.

Bring Me Back Alive by Patricia McCann is set in a youth and community centre in Dublin and follows a conversation between a

group of friends.

The young adults, who have lost a friend to suicide, are struggling to come to terms with the issues that affect

their lives.

Touching on suicide, mental health, homosexuality and hope the play has been nominated for the Best Community Based Initiative award in the 2016 LAMA Community and Council Awards.

Clondalkin woman Carol Cosgrove is bringing the play to Clondalkin for the special performance in the Church of the in Transfiguration Bawnogue.

Carol lost her own son, 21year-old Daniel Dempsey, to suicide in 2014 and believes that Bring Me Back Alive can spark a conversation about

the topic of suicide amongst young people.

She said: “Mental Health is such a big issue at the moment. The play is based in a youth centre and it is a conversation between five kids who have lost a friend to suicide. There is a boy who is gay who talks about being bullied, a girl who is having some difficulties and another young person who is suicidal.

“I am hoping that it will kick off a conversation about these things amongst young people. They can come and see the play and see that other people are going through the same thing.”

Bring Me Back Alive

highlights some of the warning signs of suicide, looks at the need for more mental health services and examines the affect suicide has on family and friends.

However, the main message of the play is that there is hope for young people in crisis – that there is an alternative.

There is no entry fee to watch the play, there will be raffle tickets available on the night with money raised going towards suicide groups in Clondalkin.

All are welcome to come along on the night with space for more than 1,000 people at the Bawnogue Church.

ASLAN AT THE OLYMPIA

One of Ireland’s best loved rock bands are on the road again with Aslan announcing a St Patrick’s Day gig on March 16th.

The Dublin rockers are always in huge demand and after two sold out shows in Vicar Street last month the boys are back in a bigger venue later in the year.

Aslan will return to The Olympia Theatre for the March 16th gig and tickets are on sale now.

The group have played the venue numerous times and have been praised for their impressive live show – with the recent Vicar Street gigs

selling out before Christmas.

After the new date was announced the band revealed that they are all delighted to be back touring and playing live for their loyal fans.

In a recent statement the band said: “We are delighted to be doing the Olympia on March 16th as there were a lot of people who could not get tickets for our sold out shows in Vicar St. They now have a chance to catch us live.”

MCD will again bring Aslan to the historic Dame Street venue for the annual St

Patrick’s gig and expect the show to be another big success.

The band will be performing hits from the last 30 years and fans can expect to hear some of their outstanding tracks including This Is, Crazy World and many more.

Tickets are currently available from Ticketmaster outlets nationwide and are priced at €32.50 including booking and facility fee for standing tickets while seated tickets are priced at €34.50.

Cian mulligan fRom Redgap, RathCoole wins top awaRd in iRelandskills national Competition 2016

Cian Mulligan, a student at GMIT’s National Centre for Excellence in Furniture Design & Technology in Letterfrack, has scooped the coveted top award in this year’s IrelandSkills National Competition in Joinery, held in Cork Institute of Technology.

Cian, from Taravic, Redgap, Rathcoole, Co Dublin, is a third year student studying on the B.Sc. (Hons) in Furniture and Wood Technology programme.

In the IrelandSkills Joinery competition final, the competitors worked from a detailed set of drawings to set out and make an intricate door with a diamond shaped internal frame with crossed glazing bars, where the door sat on a sloped, elevated base frame that incorporated dovetail joints. A maximum time limit of 18 hours was set and the competitors used a combination of hand, power tools and machines to produce this piece.

Throughout the week the competition was extremely

intense and the competitors for the final were selected as being the highest scoring candidates in the preliminary stage of the competition. The Joinery skill category was one of nine other IrelandSkills competition finals that took place in CIT last week.

This is not the first time that Cian has attained success in National Skills competitions as he represented Ireland in Cabinetmaking in the WorldSkills 2015 competitions held in São Paulo, Brazil last August, where he was ranked sixth in the world and won a Medallion for Excellence for his performance.

Anthony Clare, IrelandSkills Co-ordinator for GMIT Letterfrack, says the competition was very demanding and drew on all of the competitors’ skill and stamina. “To make this challenging piece required considerable skill in combining process execution, planning and time management to

successfully complete it within the 18-hour time limit. This was Cian’s first time to compete in the IrelandSkills National Competition Joinery final and I am absolutely delighted at his success. On behalf of the students, staff and graduates of GMIT Letterfrack I wish to congratulate Cian for putting in such a huge effort to win this competition” added Mr. Clare.

Dermot O’Donovan, Head of Department, GMIT Letterfrack, says: “Cian’s achievement clearly demonstrates the skill level attained by students studying on the B.Sc. (Hons) in Furniture and Wood Technology. Cian is about to embark on his Work Placement module where he will spend the next twenty weeks in industry – he could not have any better preparation than this. His achievement will give him great confidence in dealing with the many technical challenges encountered in modern

manufacturing environments.”

R - Remove Guilt We all go off-track sometimes when it comes to making healthy lifestyle changes.

When that happens it’s easy for us to give ourselves a hard time for not being able to stick with it. However, learning to be kinder to ourselves and recognising that we re only human and all have lapses at times can make it easier to get back on track with achieving our weight loss dreams. The reason diets so often fail is because they are restrictive. By following a flexible, generous, plan that fits with normal living you’re much more likely to succeed in keeping weight off in the long term.
