What You Need to Know When Facing Divorce Later in Life It may seem unlikely that many couples married for decades would decide to split. The reality, however, is that increasing numbers of adults are deciding to divorce later in life. A variety of factors may be responsible for the increase in later-life divorce, sometimes referred to as the “gray divorce.” Potential reasons include the aging of the baby boomers, a longer life cycle, and less concern about the impact of divorce on older children. The factors contributing to seniors divorcing may also be similar to the frequent reasons younger couples separate, like developing different goals and growing apart. Since many people expect to live longer, they don’t want to waste their golden years in an empty marriage. People separating later in life should be especially aware of several issues: Division of Assets: It is likely that those over age fifty have more assets than younger couples. Older individuals usually have longer work histories, higher salaries, larger retirement accounts, and more real estate. The division of assets takes on increased importance since there is less time for individuals to recoup any losses. You should be aware of the income and investments you need to retire and live comfortably. If you are already retired, you want to consider whether the assets you will be awarded are significant enough to provide for your ongoing living expenses.
Support Payments and Life Insurance: A spouse who has been a stay-at-home parent, or out of the workforce for a number of years, may be awarded spousal support or alimony. Additionally, if children are still young, one spouse may receive child support payments from the other. You should always make sure you have an adequate life insurance policy in place for the spouse generating income and paying spousal support or child support. If you are the one receiving the support payments, you should own the life insurance policy yourself. If you are just listed as a beneficiary on your ex-spouse’s policy, there is always the chance he or she may change the designation without your knowledge. Social Security: Social Security benefits are another important consideration. After a couple is married for 10 years, at the age of 62, a spouse can collect on the other’s Social Security benefits. Therefore, the lower-earning spouse can place a claim on the higher-earning spouse’s larger benefits. If a spouse remarries, generally he or she is no longer eligible for this benefit. If your spouse may be collecting on your Social Security benefits, make sure to factor this into the division of assets or support payments. Children and Estate Planning: If a couple’s children are older, child custody may not be much of an issue. That doesn’t mean, however, that nothing needs to be addressed regarding the kids. If a couple is planning to assist their children with college tu-
ition or other expenses, they should make sure adequate resources are set aside in the division of assets to facilitate the desired contributions. If you are planning to pass down assets to your children, make sure you have your wishes expressed in a will or trust. This includes designating who you want to control the inheritance your children would receive from you if they are still minors. If you are not comfortable with your ex-spouse handling your minor children’s inheritance in your absence, make sure you specify other arrangements. Those who are impressed by words seem to think that President Barack Obama made a great speech to Congress (Sept. 8). But, when you look beyond the rhetoric, what did he say that was fundamentally different from what he has been saying and doing all along? Are we to continue doing the same kinds of things that have failed again and again, just because Obama delivers clever words with style and energy? Once we get past the glowing rhetoric, what is the president proposing? More spending! Only the words have changed – from “stimulus” to “jobs” and from “shovel-ready projects” to “jobs for construction workers.” If government spending were the answer, we would by now have a booming economy with plenty of jobs, after all the record trillions of dollars that have been poured down a bottomless pit. Are we to keep on doing the same things, just because those things have been repackaged in different words? Or just because Obama now assures us that “everything in this bill will be paid for”? This is the same man who told us that he could provide health insurance to millions more people without increasing the cost. When it comes to specific proposals, President Obama repeats the same kinds of things that have marked his past policies – more government spending for the benefit of his political allies, the construction unions and the teachers’ unions, and “thousands of transportation projects.” The fundamental fallacy in all of this is the notion that politicians can “grow the economy” by taking money out of the private sector and spending it wherever it is politically expedient to spend it – so long as they call spending “investment.” Has Obama ever grown even a potted plant, much less a business, a bank, a hospital or any of the numerous other institutions whose decisions he wants to control and override? But he can talk glibly about growing the economy. Arrogance is no substitute for experience. That is why the country is in the mess it is in now. Obama says he wants “federal housing agencies” to “help more people refinance their mortgages.” What does that amount

to in practice, except having the taxpayers be forced to bail out people who bought homes they could not afford? No doubt that is good politics, but it is lousy economics. When people pay the price of their own mistakes, that is when there is the greatest pressure to correct those mistakes. But when taxpayers who had nothing to do with those mistakes are forced to pay the costs, that is when those and other mistakes can continue to flourish – and to mess up the economy. Whatever his deficiencies in economics, Barack Obama is a master of politics – including the great political game of “Heads I win and tails you lose.” Any policy that shows any sign of achieving its goals will of course be trumpeted across the land as a success. But, in the far more frequent cases where the policy fails or turns out to be counterproductive, the political response is: “Things would have been even worse without this policy.” It’s heads I win and tails you lose. Thus, when unemployment went up after the massive spending that was supposed to bring it down, we were told that unemployment would have been far worse if it had not been for that spending. Are we really supposed to fall for ploys like this? The answer is clearly “yes,” as far as Obama and his allies in the media are concerned. Our intelligence was insulted even further in President Obama’s speech to Congress, when he set up this straw man as what his critics believe – that “the only thing we can do to restore prosperity is just dismantle government, refund everybody’s money, and let everyone write their own rules, and tell everyone they’re on their own.” Have you heard anybody in any part of the political spectrum advocate that? If not, then why was the president of the United States saying such things, unless he thought we were fools enough to buy it – and that the media would never call him on it?

To the editor: In his rush to show his concern for creating jobs President Obama established a “Jobs Council,” and on Jan. 21 of this year appointed Jeffrey Immelt, the CEO of the General Electric Company, as his “Jobs Czar” to chair this group. While the name of the “council” surely implied its mission is to create jobs just six months later Immelt moved the headquarters of GE’s 115-yearold X-ray business located in Waukesha, Wis., to Beijing, China - which leaves one to wonder just what a “Jobs Czar” and his “council” is supposed to do. Create jobs? That would appear to be the goal, but in view of his track record as head of one of America’s largest companies appointing Immelt to chair this group would leave one to wonder what the heck the president was thinking. At the start of 2010, GE employed 36,000 more workers overseas than it did in the U.S. prior to Immelt’s becoming the company’s CEO. And according to a recent annual filing with the Securities and Exchange Commission, since taking the helm of GE in 2001 the company shed 34,000 U.S. jobs but added 25,000 overseas. Oh yes, and let’s not overlook the fact that last September under Immelt’s stewardship GE closed the last light bulb manufacturing facility in this country to focus on manufacturing those compact fluorescent lamps or “green” bulbs better known as CFLs. And where are these CFLs now made under the GE brand name? If you said “China,” go to the head of the class. Given Immelt’s track record of GE’s exporting jobs two questions I’d love to pose to the president come to mind. Why did you appoint him in the first place? And why is Mr. Immelt still your Job Czar? In the private sector such a performance would result in an individual receiving a pink slip. But not Mr. Immelt, nosiree. To deflect from his Job Czar’s sorry track record the president has gone on a Mid-west tour to again show to America his dedication to improving the jobs. And how does the president propose to do this? To start with he announced he will be establishing a “Department of Jobs.” Well, that’s one way to create jobs in this country – government jobs that is. By the way Mr. President, can you tell me what the difference will be between the Jobs Council headed by Mr. Immelt and a Department of Jobs? And who do you have in mind to head up that department? Donate funds To the editor: Now is the time for our companies and our people to come to the aid of their country to ensure liberty and justice for all by reducing the national debt. We have seen the domino effect of sending jobs oversees and downsizing that has produced high unemployment, foreclosed mortgages and less money for needed government services. The Bush tax cuts were supposed to create more jobs but did nothing to discourage the wealthy from spending this money on plants in foreign countries and sending the jobs overseas. The Bush tax cuts did nothing to stop merger mania in which companies swallowed up other companies, down sizing the work force and becoming those “too big to fail companies“ in need of a bailout from the government. For free markets or capitalism to work there must be lots of competition. Merger mania reduces competition. The Bush tax cuts and two unfinished wars did nearly double the national debt. However, we do not have to wait for additional taxes or spending cuts to come to the aid of our country. In gratitude for our wonderful country, we can use the Bush tax cuts we received to make a contribution to reduce the debt. Joyce Schuetz
Congressional dysfunction
To the editor: What will it take? A Rasmussen Poll, USA Today and Standard & Poor’s all agree, our political machinery is dysfunctional. An overwhelming majority also agree that the career politicians are the root cause for the housing crisis, the bail out and our bankrupt country. Why shouldn’t we vote on the values and principles of the person, rather than the party? Solution: Replace each and every member of the House of Representative with a true citizen representative who will: 1) be contractually accountable; 2) adhere to term limits; 3) reject special interest money; and 4) follow the laws of this country as written - especially the U.S. Constitution. These four items are the core principles of GOOOH (Get Out Of Our House), a group of 100,000 like-minded people who are serious about restoring proper government function. We monitor and inspect all bridges regularly as part of our routine maintenance,” said Andrew Gates, with MoDOT. “Since the westbound bridge is an old bridge, we make sure we take a good look at it at least annually.” Crews will close westbound I-64 at Long Road in Chesterfield. Drivers will still be able to get to St. Charles County using I-70, Route 364 and Route 370 which will remain open.

First responders can quickly spot the flashing light when they turn down the street and go directly to the household that needs help.” Emergency beacons can be picked up from 10 a.m. to 11:30 a.m. on the first and third Fridays of the month at the O’Fallon Senior Center. The O’Fallon Police Department is offering a free class geared to prepare residents for the worst. O’Fallon residents, members of community organizations, and those who work in O’Fallon are invited to learn basic disaster response skills through the O’Fallon Police Department’s Community Emergency Response Team (CERT) training. “The training is geared to neighborhood organizations, parents, businesses, church groups, and individuals, too,” said Police Officer Andy Stowers, director of O’Fallon CERT. “It can help in daily emergencies, and in the event of a disaster, CERT graduates will be better able to take care of their families, help save lives in their own neighborhood, and stretch emergency resources until professional help arrives.” The 20-hour course will be taught at no charge by the O’Fallon Police Department from 6 p.m. to 10 p.m. on Sept. 23; from 8 a.m. to 5 p.m. on Sept. 24; and from 8 a.m. to 4 p.m. on Sept. 25. The hands-on training, which is only offered twice a year, includes basic medical treatment for injuries, preparing for emergencies at home and in the community, working as a team, extinguishing small fires, conducting light search and rescue, relieving survivor stress, and assisting and communicating effectively with public safety organizations during a disaster. Those completing the course will be eligible to participate in monthly follow-up training and drills to keep skills fresh. O’Fallon spokesman Tom Drabelle said keeping the city’s current rate would mean an estimated $300,000 drop in property tax revenue for the general fund this year. The city has a budget of about $80 million a year, he said. If the council reduces its original tax rate proposal, it would be required to use reserve funds to meet debt service requirements. Taxes would then have to increase further for 2012. “For the current year, there are sufficient reserves we can use to meet our debt service, but what we levy this year will affect what we have to raise in the future,” Boschert said. The rate being considered is simply the city’s portion of taxes. Other taxes are imposed by the school district, fire protection district and more. A final decision must be made prior to Oct. 1 according to State Statute.
Wentzville GM Plant anticipates expansion; more hiring By Mary Ann O’Toole Holley It’s the four-letter word everyone wants to hear - ‘jobs.’ The lull at the Wentzville General Motors Plant may soon be over, now that the Wentzville Board of Alderman have approved an intent to issue Chapter 100 bonds and to provide property tax incentives for the proposed expansion of the plant. Last week the Wentzville Board of Aldermen unanimously approved the agreement with GM officials. GM has agreed to cover all upfront costs of the project, if approved by the company. GM is seeking to add a production line at the plant, and a 500,000-square-foot expansion that would likely include production of a new truck line at the plant along Hwy. A in Wentzville. Plant officials estimate that the expansion could create 2,000 new jobs. Although the expansion is still in the proposal stage, Wentzville city officials feel good that the project will move forward in their city. According to the Wentzville City Government resolution, the city would issue the Chapter 100 bonds and provide GM with a property tax exemption of up to
75 percent for 10 years. That tax exemption decreases if GM fails to meet annual employment targets. Mayor Paul Lambi said GM would purchase bonds to provide city funds to purchase equipment and land. It would then lease the items to GM. Wentzville used a similar tax incentive a decade ago to help GM finance $400 million in machine tooling, Lambi said. On the same day of the Wentzville Council meeting to consider the tax incentives and bond agreement, the GM plant opened its doors to the public for a day-long tour of behind-the-scenes work at the plant. Wentzville Alderman Nick Guccione (Ward 3), said the ball is now in GM’s court. “Hopefully they will do this and bring these jobs to Wentzville. It would be a huge factor in improving economic conditions — jobs, housing, everything." Van Simpson, president of UAW Local 2250, worked in the painting department prior to his election as president in May. He said GM-Wentzville officials had announced in April that new robots and new equipment would be arriving. “The planned expansion is a 500,000-square-foot body shop, an upto-date facility at the back of the plant,”
Simpson said. New bays would also be added, Simpson said. That means more jobs for the skilled trades people at GM, Simpson said. Simpson said his understanding is that GM is trying to get the best deal in tax abatements to put them in a position to eliminate structural costs. The GM parent organization places new product lines at plants that can show they are at 93 percent within the company’s competitive operating agreement. “We were anticipating an announcement at the Open House, but it didn’t come through,” Simpson said. “My gut feeling is it’s going to go through. They kept saying they were close to getting it, and we kept giving up things, cutting back, because they said we had to put our plant in a position for the best consideration possible.” Simpson said the plant standardized our work to fit the competitive operating agreement and did reach the 93 percent. “We cut out rail loaders, porters and a lot of things. We cut jobs. Some things are outsourced,” Simpson said. “We did that with the anticipation that there was going to be an announcement of a product.” He added, “The new line will bring another shift and possibly a third shift.”

Davis resigns as GOP chief over China Hub legislation By Jeannie Seibert Former state legislator and now former chairman of the St. Charles County Republican Central Committee, Cynthia Davis, has resigned her chairmanship. But she didn’t stop there. Davis has completely broken with the Republican Party and thrown her weight behind the campaign to stop the China Hub. At stake is an expansion of warehouse and shipping facilities at St. Louis Lambert Field, a leading contender as the primary cargo hub for the export of Midwest products to Asia and as a receiver of inexpensive goods manufactured in China for sale in the U.S. Davis, who is making her new political home in the fledgling Constitution Party, says the China Hub is nothing more than redistribution of wealth. But County Director of Administration Chuck Gross said the China Hub is a group of regional business and government leaders who have formed a commission to promote Lambert Field’s central location in the middle of the country to serve as the primary shipping and receiving center between the Midwest and China. “It’s kind of like a chamber of commerce supporting business growth,” Gross said.
County Executive “Steve Ehlmann is on the China Hub Commission.” What small government protestors oppose is the legislation currently being debated in the General Assembly titled Aerotropolis. This bill “would be a tax break for certain entities who are being enticed to come to Lambert,” Gross said. More specifically in the form of tax credits “for the people who are called freight forwarders who move cargo from point A, say a manufacturer, along to its final destination.” Another portion of the legislation “offers tax credits to entities to build or rent space – warehouses – in gateway zones in and around Lambert,” Gross said. St. Charles County is in and around Lambert Field. “Like any tax credit, it sounds like a good idea,” Gross said. “Some don’t like it but the goal is to offer a tax break to get somebody to do something like a donation to a local charity is a tax credit.” Charging this particular issue in Missouri is likely the atmosphere emanating from Washington, D.C. Daily news developments confirm questionable government tax credits and loan guarantees to private enterprises are prompting multiple investigations of how
taxpayer dollars were used to prop up companies that are now folding or moving operations overseas. Davis said, “The best thing government can do for business is to leave it alone. Government can’t create jobs. Look at DC and our economy today. One report has proved that the government has spent $5 million per job created. That’s a tremendous expense at a time when we don’t have the money.” To demonstrate her disgust with government overreach from both sides of the aisle, Davis said she has announced her intent to file as a Constitution Party candidate for statewide office. “I was deeply involved in the Republican Party,” Davis said. “I’ve been a committee woman, a central committee chair, an elected official. It was a huge step to walk away from a position I was so involved in.” Eugene Dokes, St. Peters, elected as the vice chairman of the St. Charles County Republican Central Committee in 2009, has now assumed the chairmanshi. Dokes said he is now more than ever going to be “focused on organizing all these conservative groups to work with the Republicans by keeping us all more connected, keeping our leaders on one page.”

By Mary Ann O’Toole Holley David Brewer is a soft spoken man who has gotten fed up with the world of rough and tough business practices and inhumanity to employees. And despite these bad economic times when more businesses fail than open, Brewer opened a neighborhood hardware store. Chucking a career in construction management, his new store sits like a beacon along Jungermann Road near Willott, and after one visit, it feels a bit like being in Mr. Roger’s Neighborhood. He genuinely appreciates his employees and his employees love their jobs. Patricia Robin sports a business card with a title, “Queen of Everything Important.” Brewer introduces another employee, Justin Muench of St. Peters, saying he is young and strong and although he’s just learning, he is a huge asset to his store. He talks about Tom Ryan, his store manager who has 30 years experience in retail hardware, and says there is little he doesn’t know about hardware and what you need to fix that old garden hose or the faucet that won’t turn off. “I had to recognize what I knew and what I didn’t know, and rely on employees to fill in the middle,” Brewer said. “I believe that when you treat your employees well, they work hard and treat your customers well, and then the customers are happy. That’s my business model.” An elderly man walked through the automatic doors of the renovated Walgreen’s building where Brewer’s TrueValue operates. The man was holding a copper tube with a turn-handle on the end. No words were spoken, yet the man was scooped up and assisted as though they had read his mind. “Oh, come on in, sir,” an employee said with a smile. “We have just what you need.” Brewer, who holds a degree in mechanical engineering and a master’s degree in business administration, said the store is his chance to take his knowledge base and put it to practical use. “I’ve worked harder than I ever have in my life, but I’m having fun,” Brewer said. “In construction, I wasn’t having fun, and that’s when I decided to open the hardware store.” Brewer said he believes that with the world turning to computers and shoppers engulfed by corporate big box stores, getting an answer to what may be a simple question is like finding a needle in a haystack. Shoppers, he said, are yearning for personal service and a one-on-one shop-

ping experience. “When a customer comes in and finds something they haven’t been able to find elsewhere, you’re their hero. It makes me feel good,” Brewer said. “The customer feels good; we feel good. Then, the next time a customer comes in, my employees are happy and helpful, and it feeds on itself.” Brewers offers all the old-fashioned services like cutting keys, fixing screens, sharpening knives and tools, cutting glass and threading pipes. Last week a woman came in to pick up some cut pieces of Plexiglas to make a wedding gift “envelope box.” Brewer’s staff not only cut the Plexiglas, they screwed it together and made the box for her — at no extra charge. “People like personal attention, and I’ve got great associates that understand the customer-first concept,” Brewer said. “They drop what they’re doing to help, and are going above and beyond to make the store a success. We smile and greet everyone who comes in. I appreciate my employees and tell them often, especially as we start out.” Most of his employees live in St. Peters, and a residential community is just a stone’s throw away. “We have bargains; big boxes have bargains. We can compete on any item,” Brewer said. “We don’t have to be the absolute low cost provider. That’s not what we do. We’ve got something here the big boxes don’t. They can’t - they’re too big.” So far, customer response has been outstanding, Brewer said. “I can’t think of too many retail outlets where people tell them they’re glad you’re here,” Brewer said. Remembering: Young students are told of 9/11 On Sept. 11, Americans across the country were reminded of the 2001 terrorist attacks. Many events took place in St. Charles County. Such was the case in on local school disctrict. In honor of the 10th anniversary of the 9/11 attacks, many schools in the Wentzville School District held special events for Patriot Day. At Discovery Ridge Elementary, Principal Laura Bates spoke to the children about the importance of remembering the events of that Tuesday morning 10 years ago, and asked for a moment of silence. The assembly closed with a rousing version of “Freedom, Freedom” led by music teacher Molly Ragusky. “I was only a few month’s old, but my parents always remind me that it’s a big deal, and a lot of people have died and risked their lives to protect our country,” said Carson Brown, a fifth-grader at the school. At Prairie View Elementary, the annual Student Council election speeches are held on Patriot Day to remind students of the importance of the democratic process, and the sacrifices that individuals have made to ensure that our country remains a democracy.
At Crossroads Elementary, events included a visit by a bald eagle and World Trade Center survivor Kevin Boyer, who told the students what it was like to be in the south tower when it was hit on that fateful day. Boyer was on the 70th floor, and he described to the students how he was running down the stairs while first responders were running up, and how many of them didn’t make it out when the building collapsed. “Students try to understand, they’ve seen the video over the years, but most of these kids weren’t even born yet when it happened,” said Principal Richard Beauchamp. “I think meeting and hearing from someone who was actually there, it becomes a lot more real for them.” The activities concluded with a red, white, and blue balloon launch, an event that Crossroads also held on the first and fifth anniversary of 9/11. Students will keep track of the date and location of where the tagged balloons are found, adding a math and science curricular element to the release. In 2001, a tag was returned from a balloon that was found 20 miles off the east coast of Florida.

Volunteers at new playground
Students and staff in the Fort Zumwalt School District spent a weekend getting their hands dirty. The Fort Zumwalt North High School leadership class volunteered its services at Brendan’s Playground in O’Fallon’s Westhoff Park on Sept. 9. The students helped lay sod and plant shrubs amidst rain showers. The following morning, Fort Zumwalt School District elementary principals assisted with the landscaping duties at the playground. The unique playground will allow children of all abilities to play together and is scheduled to open this fall.
Francis Howell Partnership Becky-David Elementary has won the 2011 Partnership School Award from the National Network of Partnership Schools (NNPS) at Johns Hopkins University. The school was honored for making excellent progress in strengthening and sustaining a comprehensive program of school, family, and community partnerships. Becky-David Elementary, a member of NNPS, provided detailed descriptions of specific strategies that are helping to increase family and community involvement and that support school improvement goals for student success. Essential elements include teamwork, leadership, goallinked plans for action, implementation, evaluation and network connections. Becky-David’s Parent Involvement Team has focused on involving families of diverse backgrounds in learning with their children, educating parents with knowledge to apply with parenting at home and recruiting parents to be involved with educating one another and providing opportunities for parents and their students to learn together. “Viewing the World through the Eyes of Becky-David” was an event recruiting parents and community members to participate in displays of their heritage or cultural identity; demonstrating ethnic stories, crafts, dances, music, art and customs. The following year, the team offered an International Game Night, where families brought crafts, music, games, stories and “tastes” of the countries. Participants were guided through the stations with a game board card as the “visited countries.” Most recently, a “Parent University” was organized for both parents and students. Parents attended a session while the student attended a session on a similar topic. Sessions were offered on Internet safety, cyber bullying, 21st century learning, mathematics, literacy or reading, fitness, health, nutrition, safety and state testing (MAP).
Parking restrictions
With the ongoing construction at Francis Howell High School (FHHS) there will be a reduction in parking at all home varsity football games. In an effort to control traffic flow, FHHS will be providing a shuttle service from commuter lots located on the service roads on both sides of Hwy. 94, parallel to Hwy. 40, beginning at 5:30 p.m. on game days. Shuttles will run continuously until all spectators have left the premises following all games. FHHS anticipates limited parking on campus and will not be able to accommodate the expected crowds for this year’s schedule. Currently there is not an entrance or exit off or on Hwy. D as construction is underway. When Hwy. D reopens, and in order to keep vehicle traffic to a minimal in an area of high pedestrian traffic, it will only be used for exiting campus and will not be used as an entrance.
Pinkney wins scholarship Junius Pinkney III, a recent graduate of Francis Howell North High School, is the 2011 winner of the Dees Memorial Scholarship. The Dees Memorial Scholarship was established in memory of John and Katie Dees who were both special education teachers in the Francis Howell School District. Each year one special education student is selected to receive a $500 scholarship to further their education and to assist them in their quest in becoming an integral, productive member of society. The Dees Memorial Scholarship is awarded through Family Advocacy and Community Training (F.A.C.T.) in conjunction with the Francis Howell Dees Scholarship Committee.

Scholarship funds are donated by CREC members who participate in Operation Round Up by rounding up their electric bill payments each month to the next highest dollar. Since the program began in 1997, more than $700,000 has been awarded to help more than 1,500 area students.Students are eligible to be considered if they live in the Cuivre River Electric Cooperative service area and maintain a minimum GPA of 2.5 while attending undergraduate courses at an accredited university or technical school. Applicants are also asked to provide an official transcript and two letters of recommendation. The scholarship deadline is Saturday, Oct. 1.

Lindenwood football team is off to another strong start a mission as Lindenwood held Graceland to just 1 yard of total offense in the first half and 101 yards of offense for the day. “The defense really set the offense up with great field position and the special teams set the offense up with great field position,” Ross said. “We had a lot of short field and especially the first quarter offense took advantage of a lot of short fields to get 27 quick points. From that point on the defense really took over and stifled Graceland the entire game.”
By Jonathan Duncan Although the 2011 season is just two games old for Lindenwood University there is a definite air of another successful campaign surrounding this edition of Lions football. Lindenwood, which moved up to Division 2 this fall, followed its season-opening win over Northern Colorado two weeks ago with a resounding 67-10 victory at home over Graceland (Iowa) University to run its mark to 2-0 on the early part of their schedule. “We like the way our kids have come out so far the first couple of weeks and we’re looking to play well every game and try to win them all,” said Lindenwood head coach Patrick Ross. At Northern Colorado, the Lions were down 20-19 with just over a minute left to play when a 44-yard kick return by junior wide receiver Andrew Helmick put the Lions in position to score. Lindenwood junior quarterback John Uribe led a 46-yard drive that was culminated in the final seconds with a 21-yard game-winning field goal by James Neal. “It was the first time the school had ever played a Division I scholarship school, so to go up there and get that win was outstanding,” Ross said. “We signed up for that game to go there and win the ballgame and our guys took that challenge and really we outplayed them, outhustled them, outworked them and ended up winning the football game.” The Lions rolled up 447 yards of offense while holding Northern Colorado to just 263 yards. On Sept. 10, the Lions returned home to Harlen C. Hunter Stadium and laid a 67-10 beat down on visiting Graceland University. It was the Lions defense that came out on
Lindenwood’s 27-point first quarter easily set the Lions up for a commanding 34-0 halftime advantage. Uribe paced the Lions offense with 232 yards passing and two touchdowns while junior defensive end Jon McComb, junior defensive end Cody Reider, and junior cornerback Cody Fogle led the Lions menacing defense with seven tackles each. “(It was) another great team win for us,” Ross said. The victory over Graceland was the Lions
seventh straight and Lindenwood has won its last nine consecutive home openers. Lindenwood has come a long way in Ross’ eight-year tenure, having gone from a little known NAIA school to now a Division II powerhouse that opposing teams are starting to dread playing. “Our kids are hard-working, focused and like to have fun,” Ross said. “They expect to play hard and win every game and those expectations have not changed. We expect to win them all.”

St. Charles County offers fall hayrides at Broemmelsiek Park Enjoy an old-fashioned hayride with family and friends at Broemmelsiek Park, 1615 Schwede Rd., near Wentzville, are be offered through Nov. 20. Groups of all ages are welcome to enjoy the fun of a hayride without traveling miles from home. Two tractor-pulled wagons take guests on a 45-minute ride through tree-lined fields of the park. Afterwards, participants can enjoy sitting around a glowing bonfire for an hour to roast their own treats. Guests may also bring non-alcoholic beverages, but glass containers are prohibited on the wagons or at the campfire site. Advanced reservations are required by contacting the St. Charles County Parks Department at 949-7535. The cost is $125 a wagon with a maximum of 20 people per wagon. Hayrides may be reserved for 6 p.m., 7 p.m., and 8 p.m. on Fridays and 5 p.m., 6 p.m., 7 p.m., and 8 p.m., on Saturdays and Sundays. In addition to the group hayrides, individual families and small groups can also join in the fun of a Hayride Hoedown at Broemmelsiek Park on Saturday, Oct. 22.
Guest will experience a 45-minute wagon ride through the park, along with a light dinner, s‘mores, and the foot-stomping, knee-slapping performance of Babaloo, a one-man musical comedy act suitable for all ages. Cost for this special event is $8.50 per person, and advanced reservations before Oct. 14 are required. St. Charles County Paws in the Park free ‘dog festival’ set for Sept. 24 The St. Charles County Parks Department will host its eighth annual Paws in the Park celebration from 10 a.m. to 2 p.m., on Saturday, Sept. 24, at Broemmelsiek Park, 1615 Schwede Rd., off of Highway DD (Winghaven Blvd.) in Wentzville. This year’s event will be held inside the unique off-leash dog area of the park, which features a large pond for dogs to splash around and play in. Pet lovers from across the region may attend this fun, free off-leash dog-festival packed with contests, prizes, sponsor giveaways, and K-9 and obedience skills demonstrations. “Paws in the Park has grown to be one of our most popular programs of the year,” Parks Director Bettie Yahn-Kramer said. Joachim & Ann Catholic School don’t raise their hand to answer a question — they push a button. The grade school received a $2,000 grant from the Innovative Technology Education Fund last May. The school used the funds to purchase a set of 32 SMART Response PE System remotes with a receiver. The remotes, also called "clickers," are formatted to supplement the SMART software already being used in the classroom with the interactive SMART boards. The teacher prepares a variety of question options for the students to respond, whether it’s multiple choice, true/false, number or word answers. A wireless sensor attached to the whiteboard receives data from the student’s clicker. “The clickers are used as a formative assessment tool which serves to improve teaching and learning by measuring the students' progress,” said Principal Debbie Pecher. “With the use of this technology, the teachers can make instant adjustments during the course of their instruction based on the student feedback they collect.” Once the questions are started, students respond and submit. Roth said the teacher is able to determine if all students have responded and can view immediate results or wait until all questions have been answered. “The students are comfortable with the process because the clickers’ format is similar to texting,” Roth said. “Often, in the past, students wait for other students to answer questions and some students do not like to participate in large group settings.” Teachers can assess a class-wide percentage of understanding based on the "vote"
or answers submitted via the remotes. “The clickers have given a voice to all students with immediate feedback and often the process creates a wonderful learning environment,” Roth said. “As the teacher, the ability to focus on students that may need extra guidance is a valuable tool. There are more possibilities for future use of the clickers as more software and lessons are incorporated into this technology.” So far, Roth has utilized the clickers in the fifth and sixth grades. “They tried to use them in multiple classrooms, but the sensor that drives the receiver, has to be physically moved each time they are used in a different classroom,” Pecher said. “Due to the difficulty in moving the remotes from one classroom to another, we would like to be able to purchase additional remotes for more classrooms in the future.” Pecher said the school will re-apply for the technology grant in November this year. The clickers have also served as a great motivational tool. “Students who generally won't answer a question or give feedback, are quick to use this technological tool,” Pecher said. “The teacher is no longer looking for answers among raised hands, but from the entire group. The instructor can also determine if a certain student is having particular difficulty without them being embarrassed by being ‘incorrect’ in front of the class.” Pecher said it also helps the students know which areas they need to devote more study time or practice. “This is a very good tool for implementing the differentiated instruction techniques that the teachers have been incorporating into their daily lesson plans,” Pecher said.

Cyber stalking: Legal system struggling to keep up with techno-harassment By Mary Ann O’Toole Holley The Internet is a powerful tool, but if purposely misused, it can serve as a terrifying weapon. Advances in technology have created a new crime: cyber stalking. It’s what some say is a coward’s way of arguing or getting back at someone. They use the faceless opportunity of the Internet to badger their victims just because they can — through smart phones, laptops and a barrage of onthe-spot technological gadgets. The use of electronic technology has widened the ways stalkers can harass their victims. Whether it’s a relative that wants to intimidate you, an ex-spouse who wants to make your life miserable or a stranger who simply wants to mess with your mind, according to Missouri and most municipal laws, you do have legal recourse. But how much will that get you? There was happiness among the multitudes in 2008 when then Missouri Gov. Matt Blunt signed our first cyber harassment law, a statute most commonly referred to as Megan’s Law enacted after 13-year-old Megan Meier killed herself shortly after receiving terribly hurtful messages through the Internet. Now, three years later, people are saying the law is often overlooked, and that there aren’t enough police resources to investigate and fully enforce the law. During a recent consultation with a St. Charles County attorney was asked about pursuing charges against someone who had been harassing and threatening by e-mail. “You can try, but you’ll only end up with thousands of dollars in legal fees while the guilty party pays what is basically a $50 ticket,” the attorney said. Harassment from computers, text messages and other electronic devices are now chargeable offenses, but harassment between adults is most often a Class A misdemeanor; a ticket. It’s a Class D felony if the harassment is committed by an adult to a minor 17-years-old or less. A person can now be charged with cyber harassment if he or she “knowingly makes repeated unwanted communication to another person, or engages in any other act with the purpose to frighten, intimidate or cause emotional distress to another person.” Law enforcement officials are seeing more and more complaints and harassment charges filed, but are often sketchy about how to handle the cases, said prominent St. Louis Attorney Steven Waterkotte of Henderson & Waterkotte, P.C. Waterkotte works with managing partner Mick Henderson, a recognized author-
ity on the Missouri electronic harassment statute. Henderson has extensively studied, researched, and written about the statute, and had articles published in the Missouri Law Review. Waterkotte said he has seen a handful of cases of cyber harassment, but from a prosecutorial standpoint, he has found they are cases difficult to prove in court. “Because the law is fairly new, law enforcement is still getting a grasp on how to handle these cases,” Waterkotte said. “The law is there now to prosecute these cases, but there is also still some hesitancy in reporting them. An individual gets a threat, and ultimately it doesn’t get reported.” Waterkotte said in many situations, there are two dynamics at play. Often times
you get two parties communicating back and forth, using vile language, but the two parties are mutually engaging in this, Waterkotte said. “Do the courts believe the reporting party’s defense or the person being prosecuted?” Waterkotte said. “Often when an investigation is underway, they have to look into both sides. Often times, you look through the exchanges and find that it was a mutual deal.” Waterkotte said cyber harassment happens all the time; it’s just that now we have a law in place, but not the resources. “What do you do, pick and choose which ones you want to look at.” During a recent visit to a local police department, Smith (name withheld for security purposes) told the officer on duty
that she wanted to file a charge against someone who had been sending her threatening, offensive emails. The officer looked at the emails and said, “Well, it doesn’t say he wants to kill you.” I don’t believe this is a chargeable offense.” Smith told the officer that she had filed for a restraining order and that it was indeed an offense under the cyber harassment law. The officer went to his law book, found the description of cyber harassment and said it did appear to be covered under the new law. Waterkotte said that is not an unusual scenario. “I’m not undermining the police, but any 17-year-old girl can walk in and report some kind of cyber harassment, and if they did, police departments would be overwhelmed with investigating these types of cases,” Waterkotte said. “I don’t think it’s that high on their priority list, unless like the Megan Meier case. However, most of these cases don’t result in something that sad happening, and most police departments say they can’t do much, and shift the problem to others.” Detective Larry McClain an O’Fallon detective dispatched to the Regional Computer Crime Education and Enforcement Group of Greater St. Louis said not all police officers are as experienced in cyber crime as others. He said during study at the Police Academy, only four hours is devoted to cyber crime training. McClain said the questions now confronting police include: “How do you get more cyber training in? What do you cut? Do you reduce firearms training?” McClain said St. Charles County has some of the best cyber crime resources in the entire country, but the reports must be prioritized. “If you get a crime against a child online, that’s going to get pushed ahead. If you get someone trafficking in child pornography, or a homicide, it gets pushed ahead. It’s just like a triage some days,” McClain said. In this Eastern District of Missouri, we have very robust tools and dedicated fulltime people who deal with this issue at all levels. In this St. Charles County area, we have a satellite office at the St. Charles County Sheriff’s department with three full-time investigators and three full-time computer forensic examiners. “People don’t come directly to us, however,” McClain said. “The departments can call us or the cases get turned over to us. Then, there are the prosecutors who have to make the determination of what is free speech.” Ultimately, McClain said, if you attempt to make a police report, and you find some-

NEWSMAGAZINENETWORK.COM one who isn’t quite familiar with cyber crime, don’t hesitate to ask to speak with a supervisor. “The law can be a little tough because cyber harassment pertains to one’s average sensibility,” McClain said. McClain said he had a woman come in to report harassment on a blog site about raising kids, and someone else blogged that she was a bad mother. “She wanted that woman arrested. That’s the dilemma. The other problem is who said it, and where are they at,” McClain said. “We do deal with local cases, and in the city of O’Fallon we take them all incredibly serious. We have a full-time cyber crime unit in St. Charles County who has full-time officers in both St. Peters and O’Fallon. We are also a resource for officers in all municipal areas.”
What if you’re being harassed? Waterkotte recommends first getting an order of protection from the courts, commonly known as a restraining order. The protective order is a civil action, not a criminal action. It’s a restraining order to ask that no further communications be sent, Waterkotte said. “Protective orders are a very speedy process. If you went to the courthouse today, you’d get a court date within 15 days,” Waterkotte said. “It’s a much quicker resolution to an immediate concern, and often the better solution.” After an individual files for a protective order, the offender will be served and asked to appear in court with you. If the protection order is granted, it’s usually for six months to a year. Then, prior to the end of one year, you can go back to the courts and renew it, even if there were no new incidents, Waterkotte said. “When a protective order is in place, even if they called you on the phone to say hello, they’re in violation. If you were at the local Blockbuster and he or she is there, they have to walk out,” Waterkotte said. “Those approved for a protective order get a statement from the courts confirming the order.”
Cover your tracks Waterkotte advises anyone dealing with cyber harassment to make a police report by calling local law enforcement so you have documentation that this has taken place, but also file for the protective order. In St. Charles County, that is done at the St. Charles County Courthouse, 330 N. Second St. “The police will sort out the criminal aspect,” Waterkotte said. “Save tangible evidence,” Waterkotte said. “You’d be surprised how many delete the text message or email, and make the police report.”
‘Friend’ the Saint Charles County Cyber Crime Unit The Saint Charles County Cyber Crime Unit takes special interest in reaching out to youths and their parents to warn them of possible dangers prowling social networking sites on the Internet. A national Internet poll of teens ages 13 to 17 showed that 71 percent have established an online profile, with 47 percent making those profiles public and viewable by anyone. In addition, nearly two-thirds of teens (64 percent) post photos or videos of themselves online. Nearly one in 10 teens polled have posted their cell phone number and more than half have posted the city in which they live or their school information. The Saint Charles County Cyber Crime Unit is offering area youths who are MySpace or Facebook users a layer of protection by enabling them to make the Saint Charles County Cyber Crime Unit their “number one friend.” Parents can also discuss with their children about adding the Saint Charles County Cyber Crime Unit to their “Friends List” as a condition of having a social networking page. Once the Saint Charles County Cyber Crime Unit is added to the Friends List on the youth’s page, it displays the St. Charles County Cyber Crime Unit logo, which may act as a visual deterrent to predators. However, if a youth still receives inappropriate messages, contact the St. Charles County Cyber Crime Unit or their local law enforcement agency to report it. The St. Charles County Cyber Crime Unit serves St. Charles, Lincoln, and Warren counties, and all their municipalities. It is tasked primarily with conducting the forensic analysis of computers suspected to contain evidence of crimes and assisting detectives in conducting investigations in which computers are involved. The St. Charles County Cyber Crime Unit also conducts proactive online investigations aimed at identifying and making criminal cases against individuals who prey on children via the Internet. It is staffed by personnel from the St. Charles County Sheriff’s Department and the police departments of O’Fallon, St. Peters, and Troy, Mo.

If you’re hoping to sell your home so you can purchase a new one, here’s some good news. The National Association of Realtors announced last week that while pending home sales had declined by 1.3% following three months of gains, the number of sales contracts was still 14.4% MORE than a year before. Even better for you, July’s Case-Shiller Home Price Index indicated a 3.6% second-quarter gain in home prices. The Census Bureau said that new home sales were up 6.8% from a year ago. The average sale price was $272,300, with 6.6 months of inventory on the market. Overall U.S. home prices rose 0.9% in June, said the Federal Housing Finance Agency, making the best one-month gain since September 2005. The Home Builders Association of Eastern Missouri (HBA) reports that single-family building permits were up by 20% when comparing July 2011 to June 2011 What this means is that more people are signing contracts on homes and those who are selling are seeing an increase in the value of their home. But there’s more good news. Despite the reports regarding U.S. banks suffering huge losses and facing lawsuits over past mortgages, mortgage rates across the country are still close to all-time lows. This has sparked a boom in new loan and refinancing applications. Many experts, however, opine that the level of job creation needed for steady home price gains is still elusive. For prices to continue to rise, the market needs a steady supply of buyers and sellers. Holding people back from making purchases are factors such as unemployment and the difficulties that people with less-than stellar credit have getting mortgages. In addition, the decline in home equity caused by the real estate bust has discouraged moveup buyers, a traditional source of housingmarket oomph. There is ‘something for everyone’ at Sombreros By SUZANNE CORBETT Opening day was brisk for Sombreros, the much-anticipated Mexican restaurant and sports saloon, owned by Steve Smith, Mike Yount and Tim Maxvill. “Our first day has been exciting,” said Smith, who reported positive feedback on Sombreros’ premiere. “We have a different look than other Mexican-themed restaurants and bar places. We’ve made the dining room brighter and brought in 11-12 flat screen HD-TV’s.” Sombreros has pulled off an interesting approach by successfully crafting a décor that is best described as Mexican colonial, with the elements of a sports bar and grill. In short, Sombreros has a lot of style. The dining room has the feel of a hacienda, accented with southwestern, colonial woodwork and tile-topped tables. The patio features fire pits, fountains and flat screens, while the bar offers a classic atmosphere with TV’s strategically placed so as not to miss any game action. Smith said Sombreros’ goal is to create an inviting environment that encourages patrons to relax, enjoy the food and toast the day or the game with a margarita.
