BEHIND their smiles, there were hints of sadness as members of the Myall Coast Rotary Club closed the doors on their last ever giant book sale in Hawks Nest. Last weekend’s marathon attracted big crowds to the Hawks Nest Community hall, locals and tourists keen to pick up a bargain or a gem from the thousands of titles on offer. “We’re just so sad, you would not believe the number of people who’ve come in saying you can’t stop, but our poor old backs have had it,” Rotarian Ian Mackenzie Smith told News Of The Area.

Helmut said, “The incredible skill of the pilot and the ability of the aircraft are greatly appreciated by the Pindimar / Tea Gardens RFS and the other Brigades assisting.” Initial evidence points to a lightning strike as the cause of the New Year’s Eve blaze. Local firefights and volunteers worked for 3 long days to bring it under control and over 335 hectares were lost. With temperatures still in the 30’s and a total fire ban in place, they’re keeping a close watch to ensure it doesn’t flare again.

Holiday Bonanza By Margie TIERNEY GREAT weather, beautiful beaches, bays and rivers, no wonder the Myall Coast has been inundated with holidays makers over the Christmas/New Year season. Holiday Property Manager, Kaye Simpson from First National Hawks Nest told News Of The Area, “All of our one hundred holiday properties have been fully booked, and our guests have been very happy enjoying our laidback lifestyle.” The same story was being told at Tea Gardens Real Estate which managers over 120 holiday lets. “We’ve been fully booked over the Christmas New Year period and many of our clients have come in to book again for next year,” Sam Rowling said. Spare a thought for our local cleaners, who’ve been busy ensuring all these properties are cleaned ready for new holiday makers each week. There’s just a four hour window between 10am and 2pm on Saturdays to get hundreds of properties spick and span. “It’s a real military operation,” Kaye Simpson said, “And there’s also the linen to get washed, dried and ironed as well.” Hawks Nest and Tea Gardens, clubs and restaurants and the hotel have been doing a roaring trade. Shoppers have also battled long queues in Coles while IGA in Hawks Nest has been extra busy. For Fiona Mobbs, this was her first Christmas since taking over the Take Away café at Myall Quays Shopping Centre. “We’ve been so busy, standing room only, regulars are happy, tourists are happy, lots of return customers, I’ve had to employ more staff,” Fiona said.
On the down side, many residents have been calling on MidCoast Council to provide
more rubbish services over the holiday season with many public bins overflowing with rubbish around beach areas and shopping centres. MidCoast Council is calling for people to put their complaints in writing.

Some time ago I published an article about the case of Moore v Scenic Tours which involved a disappointed consumer taking proceedings against a cruise boat operator for compensation when the company did not ‘deliver’ the holiday experience it advertised (due to serious flooding on various rivers in Europe). One of the unusual features of the case was that the claim was brought only under the Consumer Guarantee provisions of the Australian Consumer Law (‘ACL’), and not in contract. The plaintiff was successful and, amongst other things, was awarded compensation for distress and disappointment at not receiving the holiday ‘experience’. Scenic appealed and the NSW Court of Appeal has recently delivered a very lengthy judgment. It is well beyond the scope of an article like this to cover all of it but, relevantly, it reversed the trial Judge’s decision to award damages for distress and disappointment. Although the reasoning is quite complex, the ultimate finding on this point was that the particular ACL provision under
which the trial judge ordered damages for distress, had “picked up and applied as a surrogate Federal law, a relevant law of NSW”; and the consequence of having done so was that damages should not have been awarded. Put more simply, the ‘imported’ NSW provision had the effect of limiting the power to award damages that otherwise existed. The relevant NSW law was the Civil Liability Act. Section 16, in substance, precludes the award of damages for non-economic loss (which include things like distress and disappointment) unless a person is assessed as exceeding a particular statutory threshold. Mr Moore had not proved he exceeded the relevant threshold; and was therefore not entitled to damages. The litigation is ongoing – the Court of Appeal also determined that the primary Judge had awarded damages to compensate the plaintiff for the reduction in value of the services provided to him, on an incorrect basis; and the case has been returned to the primary Judge to reconsider that issue of damages: Scenic Tours Pty Ltd v Moore [2018] NSWCA 238 (24 October 2018)

THE Community at Karuah has restored the bell stolen from St Columbas Anglican Church at Karuah. In 2018, the bell was stolen and the bell tower was destroyed in the process. A Police investigation followed. The bell was found in a laneway the following day by a local resident. It is assumed the weight of the bell, made of a bronze with high tin content, made it impossible for the thief to carry it very far without fear of being caught, so abandoned it. Dr Ilona Hudson sits down with News Of The Area to discuss ways to keep animals cool this Summer

HOT has been the answer for most lately when asked how they are doing. If they could speak, our fur babies would say the same. News Of The Area sat down with local Veterinarian Dr Ilona Hudson to discuss the best way to care for our four legged family members in the heat. If your pets are too big to bring inside with you, then an outdoor patio or Queensland style room is the next best place to provide them shelter. Dr Hudson said, “Providing your dog an area out of direct sunlight with moving air is really important.”
“Many people will place a fan on their outdoor undercover area to create a breeze.” It is common practice to wet dogs down with cool water to help them cope, however you could be making it worse. Dr Hudson told News Of The Area, “Using water to cool your dog down is fine as long as they have immediate access to a fan or continuous running cool water.” “If pets are wetted down and left to sit without a breeze, they will actually get hotter than they were previously.” Heat stroke signs to watch for are uncharacteristically lethargic behaviour, distress, and the edge of

THE New Year has heralded new changes to the age old game of Golf. It’s taken five years of research, review and feedback, but Golf’s governing bodies are hoping a change to a number of rules will make the game easier to understand and attract newcomers. Hawks Nest Club Captain Les Miller explained some of the most significant changes,
“You don’t have to take the flag out of the hole when you putt.” “Your ball is lost if not found in three minutes rather than the old rule of five minutes,” Les said. He added, “In Golf, we call penalties on ourselves, it’s an honour game, if people enforce the various initiatives, then the game will be speeded up.” A sentiment echoed by Hawks Nest Office Manager, Karen Bartlett, “We’re hoping
it will move a bit quicker on the course.” Other changes include dropping the ball from knee high and when you’re original location of your ball is not known you can replace it on its estimated spot. There’ll be no penalty for accidental movement of ball or ball marker on the putting green. Golf Australia says these are the most significant changes to the rules of golf if over 30 years.
