Shrill Sounds of Summer By Daniel SAHYOUN WITH the cicada season in full swing, the familiar sound of the summer symphony is echoing around the region once again. And if you think the little noise makers are much louder than usual this year you are not alone, with experts deeming the bumper season the largest since 2013. Seven-year-old Zackery Moran said the unrelenting wave of singing in the local area is deafening. “The chirping starts before the sun comes up and goes most of the day and into the night,” he said. “It’s so loud sometimes that it hurts my ears.”

News Of The Area recently recorded the insects humming at sound levels well over 100 decibels at homes near Bulahdelah’s Alum Mountain. According to cicada enthusiast Dr Nathan Emery, who is a Scientific Officer at the Australian Botanic Gardens, this level is equivalent to the sound of a chainsaw running at full speed or a rock concert. “The males often sing in synchrony, termed a cicada chorus and this can get up to around 120 decibels,” he said. “With prolonged exposure, this is enough to damage human hearing.” Dr Emery said the most commonly found species in the Myall Coast and Port Stephens region include

Senior Constable Dave Coyle had the idea of using money raised from the local Police Charity Golf Day to fund the construction of a ladder to attach to the wharf. “I’d seen the kids jumping in all the time and they couldn’t get out so I approached Steve Ellicott (Tea Gardens Engineering) and in the blink of an eye it was done,” Dave Coyle told News Of The Area. Beau Bradbury built the stainless steel ladder in a few days and Dan Aldridge from MidCoast Council didn’t hesitate to tick the box in record time to approve its installation. “This may seem to be a small thing, but it’s not, this is something that this town has needed for a long time,” MidCoast Councillor Len Roberts said. “What it does show is the responsibility of our local police,” Mr Roberts said. “They saw a need and they fixed it.” “What we have here is a magnificent set of steps.” Of course final word went to the kids, “We love it.”

On 13 December 2017 the High Court delivered a decision in a case of Regional Express Holdings Limited v Australian Federation of Air Pilots [2017] HCA55.
The central issue in dispute was whether an industrial association (such as a union, or other representative body) was entitled to represent workers who were not members of the industrial organisation. The short facts were that Regional Express (REX) had written to a number of its pilots to the effect that if they made claims for accommodation costs during layovers, they would not be given command roles. The Australian Federation of Air Pilots (AFAP), a representative body for commercial pilots, commenced proceedings alleging REX’s letter contravened a number of workplace rights. None of the individuals to whom REX had written, were actually members of AFAP. REX applied to summarily dismiss the proceedings on the
basis that AFAP was not “entitled to represent the industrial interests of” individuals who were not members of its organisation.
The summary dismissal application failed at first instance, and appeals by REX to both the Full Court of the Federal Court, and to the High Court were also unsuccessful. In essence the case determines that a person who is eligible for membership of a representative organisation (whether they are actually a member or not) can be represented by that organisation. The decision potentially has broad ramifications since, although many individual workers do not belong to unions or industrial organisations, they may well be eligible for membership. Consequently, it may be legitimate for unions, or other organisations, to bring applications “in the interests of” employees, even though the employees are not members of the organisation; and potentially even if the employees are not themselves particularly interested in bringing the application.

Rising Business Minds Buladelah Central School Student Representative Council was named a finalist at the recent Hunter Young Business Minds Awards.
BULAHDELAH Central School Student Representative Council was named a finalist at the recent Hunter Young Business Minds Awards. The ceremony celebrated the achievements, innovation and creativity of the region’s youngest entrepreneurs. As part of the judging criteria, the students were required to develop a business idea and record a video sales pitch to exhibit their project. The group proposed developing a mobile phone app, promoting Bulahdelah as a tourist destination. Their video entry highlighted the natural environment and included many images of the local area including Alum Mountain and the Myall River. Year 10 student Hunter Bramble said the team were honoured to be selected as a
finalist. “It was a great learning opportunity, and we discovered a lot about starting up a business,” he said. “We also learnt to never give up, and if you get knocked down, pull yourself up and keep trying.” The awards were an initiative of the Hunter Region Local Chambers of Commerce, providing the opportunity for business communities to develop links with their local schools. Hunter Business Chamber CEO Bob Haws said our young people are our future. “They will dream of new industries, create the new jobs and become our civic leaders,” he said. “The awards support young people by letting them know that the business community is here to help

Revitalizing Hawks Nest
PLANS to revitalise the Hawks Nest business area are one step closer after the NSW Government gazetted planning rules developed by MidCoast Council and the local community. Council’s Strategic Planning Manager Roger Busby said this is a great step forward in planning for future business growth of the village. “We’ve been working closely with the Hawks Nest community, and with the Hawks Nest Tea Gardens Progress Association since 2014 to identify and develop a plan that will meet the needs of business and the community into the future,” he said. Following extensive community consultation, a unique planning proposal was developed that provided for two separate business zones in Hawks Nest, and also provided protection for the koala colony that calls the Hawks Nest village home.
Mr Busby said two areas of land have been rezoned, which will allow more land for housing in the town centre and create greater flexibility for business opportunities near Bennetts Beach. The rezoning of certain areas to environmental protection will also assist in protecting the endangered Hawks Nest / Tea Gardens koala population by providing koala habitat alongside the existing business zone. Trevor Jennings, from Hawks Nest Tea Gardens Progress Association said there is now an opportunity for small-scale businesses, retail and food outlets to locate close to Bennetts Beach. “We’re pleased that Council listened to the community and took on their ideas and those of the Association, to create a vibrant coastal feel for this area alongside the beach,” he said. “This will enhance
the scenic and leisure opportunities available in this location and create a space for local people and visitors to enjoy together.” Mr Busby said the vision is to attract specific leisure and recreational businesses close to Bennetts Beach, quite different from the more functional service businesses of the village in the existing Hawks Nest business area. “The two rezoned areas are designed to complement each other and provide for the quite separate and specific commercial opportunities that the community has identified as crucial for the village’s future,” he said. “The community has told us they want to revitalise the business area of Hawks Nest, and they are also looking to breathe new life into the village to create a new and exciting buzz to their beautiful and unique part of the world that helps it stand apart from other north coast destinations.”

Commit to Safer Driving SHADOW Minister for the Hunter Kate Washington MP has joined with local police officers to call on drivers to commit to safer driving as their 2018 resolution. NSW’s holiday road toll has nearly doubled in 2017 and annual road fatalities have risen for the second year in a row. Locally, police officers from the Port Stephens Command and Highway Command have conducted almost 5,000 Random Breath Tests (RBTs) across the holiday period. Port Stephens has been fortunate to avoid any fatalities during
this holiday period. The Hunter saw over 70 road fatalities in 2017, a 70% increase on the 43 fatalities recorded in 2014. A breakdown of figures by council area show that Newcastle, Lake Macquarie and Port Stephens record the highest number of road fatalities. The most recent figures from 2016 recorded ten fatalities in both Newcastle, and Port Stephens, with 9 in Lake Macquarie. Across the state, 250,000 speeding fines were issued in 2017, equating to more than 680 speeding infringements
each and every day. Ms Washington said, “I am joining our local police to call on the residents of Port Stephens and the Hunter to commit to safer driving as their 2018 New Year resolution.” “Tragically, road deaths have doubled across NSW this year and no-one wants to see a repeat of that again this year.” “So it’s time for all of us to take the challenge to be a safer driver this year.” “We can all do better – we can put down our phones, drive at the speed limit and be respectful to other road users.” “The message is clear – commit to safer driving in 2018 to protect not just yourself and your family, but other families travelling on our roads,” she said.

Super moon plausible for mammouth tides NOTA 21 Dec). It was also quite the norm 55 years ago when my father owned the boatshed, but never like that! The highest tides of the year were on the 24th and 25th of June at 8 or 9am. These tides,
which I have monitored over the past 30 years at Hawks Nest were interesting in that that 24th June high tide measured exactly 2.1 metres (as predicted) but the 25ths level was over 2.2 metres (with high atmospheric pressure).
Over the last 30 years I have monitored the ocean’s advance into the fore dune from the surf club to Yacaaba. The access track for 4WD around the base of Yacaaba has been washed away and is almost impassable, despite

I have gained about seven kilograms over Christmas. Any clues on how I can lose the weight quickly? Mrs CV, Raymond Terrace MRS CV, as I am typing this, I’m polishing off the last of the hazelnut nougat I was given for Christmas, even though I promised myself I would stick to salads and green smoothies for the next six months in order to make up for the communal gluttony that occurred at my place over the festive season. It is now all a blur of deep-fried camembert, basil and pistachio dip, potato salad with full cream mayonnaise, chocolate mousse, rum balls, red wine, white wine, brunch, lunch and midnight snacks (and that was just Boxing Day). We all fall into a trap at this time of year, and that trap is thinking that we will pace ourselves over the Christmas period, eat in moderation, exercise, and start the New Year as svelte, radiant, well-rested individuals. Instead we fall into a food coma and we can’t exercise because even our stretchy activewear isn’t quite that stretchy and we all know that crop tops and muffin tops aren’t a fashion statement any of us would like to emulate. The most exercise we have done is to float around on blow-up peacocks and pull a couple of Bon Bons. Heck, even if I could see my shoelaces, I doubt I’d have the energy to actually tie them up. All this eating and nanna napping is exhausting. Acceptance is the first step, Mrs CV. There’s no point feeling bad about it. You simply have to let go of the past and embrace the future. It seems pointless to change things midweek, so as of next Monday, I want you to ask yourself this question each time you come across a tempting treat: “Should I put this inside me?” Nine times out of ten, the answer will be no. In fact, the question could extend beyond food and keep you away from doomed relationships and emergency rooms. Food for thought. Carpe diem, Jasminda

Taking Control of Wild Dogs HUNTER Local Land Services is working with landholders in the Mid-Coast region to help control the wild dog population and reduce their impact on livestock. This year’s baiting and control program will involve more than 25 groups across the Manning Great Lakes area and will run from early autumn, through winter and into spring. Chair of the Bulahdelah and District Wild Dog Control Group Art Brown said a preemptive, across tenure approach is leading to an increased number of dogs being controlled in the Bulahdelah area.
“We are covering an area of 100,000 hectares, where 65 percent of the land is managed public reserves,” Mr Brown said. “It is critical we work with both private land managers and other agencies including Forestry, National Parks and Wildlife Service, Landcare and MidCoast Council to get the best results.” Last year, 103 wild dogs were culled in the local area focusing on the autumn and spring control programs. Plans for 2018 include over 40-targeted baiting and control programs across the Manning Great Lakes region. Hunter Local Land Services Senior Biosecurity

Keeping Watch This Summer TEA Gardens-Hawks Nest Surf Lifesaving Club volunteers and Council Lifeguards will be keeping watch at Bennetts Beach during the busy holiday season. With crowds flocking to the clear waters and white sand, the red and yellow flags will be up seven days a week from 9am to 5pm. Council Lifeguards from the Australian Lifeguard Service (ALS) will be on duty Monday to Friday and the Surf Lifesaving Club will patrol on weekends and public holidays.
