Tea Gardens man stabbed in Queensland By Margie TIERNEY A CORONIAL inquiry is now underway into the tragic death of 27 year old Tea Gardens man, Tom Davy near Townsville last week. Davy, along with 37 year old, Father of three, Corey Christensen were both stabbed to death in the small seaside village of Alva Beach, in northern Queensland. Police described the crime scene as horrific. Detectives are investigating whether self defence was a factor. It’s claimed the stabbing followed a fight breaking out at Alva Beach, witnessed by 29 year old Candice Locke, who fled the scene and ran to the house of 19 year old Dean Webber to ask for help. The 19 year old man

Urgent need for Repairs By Margie TIERNEY WITH Summer fast approaching and more holiday makers and locals taking to the water, the
community is being urged to get behind a campaign to improve our Myall Coast boat ramps. Local engineers Kurt Bowen and Andrew Sharp recently inspected four boat ramps in the Tea Gardens/ Hawks Nest area and found two of them in urgent need of repair. “The Moira Parade boat ramp
is of most concern,” Andrew Sharp said. “The lower half has broken links and is literally falling apart,” Andrew said. “Segregations are widening, leaving large gaps which are laced with razor sharp oyster snares and the entire lower section is falling into the river.” “The gap between the lower and upper sections is nearing the width of a car tyre which will render it unusable.” “The gaps in the segregations catch people’s feet and nasty cuts are common.” Andrew added, “A local boater, Rob told me of his recent fall in which he suffered deep lacerations to his foot, bruising
and loss of his iPhone.” The car park which accesses the Moira Parade boat ramp is also full of large potholes which often fill with sea water. “The Jacabba Street ramp at Winda Woppa is also crumbling and a single lane at best,” Andrew said. “Both Andrew and Kurt are well qualified to comment on the condition of our ramps, which were recommended for repair and improvement under the ‘Boating Now’ program some 4 years ago,” Gordon Grainger from the Myall River Action Group said. “We are calling on MidCoast Council to take some urgent action,” Gordon said.

Small Business Month gets underway SMALL business underpins the MidCoast region’s economy and its contribution will be highlighted during the NSW Government’s Small Business Month in October with two free workshops. Supported by the NSW Government, MidCoast Council is hosting free Place Making Masterclasses in Bulahdelah and Forster. Aligned with Council’s Vibrant Spaces Initiative, the interactive Masterclasses will provide practical information on street activation and business presentation to draw people to our town centres. When an owner sells a property that is subject to existing tenancies, it is always preferable to have the relevant leases to the tenants registered on title. This ensures that the lease automatically, by virtue of the Real Property Act (NSW) transfers to the purchaser on settlement and the tenant’s leasehold interest is preserved in the subject property.
According to Scudooda Pty Ltd v K & E Property Pty Ltd [2018] NSWSC 1397, if the Contract for the Sale of Land contains for the appropriate provisions and notifies the purchaser of the leasehold interest held by the tenant, the purchaser will be found to be on notice of the tenant’s equitable interest in the land and be “bound by the equitable interest…”

Crash closes Highway By Margie TIERNEY
EMERGENCY services rushed to the scene of a serious two car collision on the Pacific Highway at the Tea Gardens turnoff last week. Around 7 o’clock last Wednesday night, a white Mazda panel van, being driven by a 25 year old woman, was travelling south at 100 kilometres an hour as it approached the intersection of the Myall Way. Tea Gardens Senior Police Constable Dave Coyle said, “A
black Nissan X Trail turned from the northbound lanes of the Pacific Highway directly into the path of the oncoming Mazda.” “The Nissan was being driven by a 54 year male from Hawks Nest.” Senior Constable Doyle said, “Both vehicles impacted heavily, resulting in the male passenger in the front seat of the Mazda van receiving a badly broken leg and head injuries. “He was trapped in the vehicle before being freed by
Tea Gardens Fire and Rescue.” The male passenger had to be airlifted to John Hunter Hospital. A front seat passenger in the Nissan X Trail was also taken by ambulance to John Hunter. The crash closed the highway for several hours. Again, with School holidays nearing an end, Police are calling on drivers to take extra care when travelling long distances, with more rain forecast over the coming days.

New Koala Project By Margie TIERNEY
MYALL Coast koalas are the focus of an ambitious new project to discover how best to care for them to ensure their survival. Over the recent long weekend, the Myall Koala and Environment Group funded an exciting pilot survey with some encouraging results. Nine koalas were found during a survey of 87 sites between Smiths Lake and the Karuah River. “There was really strong support from the community with fifteen landholders allowing access to their land to look for koalas,” Jill Madden, from Myall Koala and Environment Group, told News Of The Area. “We had all sorts of people involved, from landholders with small one acre lots, to parcels of four-hundred acres,” Jill said. With a tiny budget from their annual stalls, raffles and donations the community group paid a koala expert to survey the region and rallied the volunteer support of two professional ecologists and six volunteer field assistants. The team worked until the early hours of the morning searching two-hectare ‘sites’ for koalas. The survey teams also found other interesting fauna including feathertail gliders, short-eared possums and greater gliders. “It was great to see such a diversity of animals despite the drought”, Ecologist, Dr Martin Schulz, said. All koalas were healthy, with numbers comparable to other parts of NSW where similar surveys have been undertaken. There were even two koalas spotted in a lover’s tryst in a gum tree on the Old Mining Road.

“This is great news for koalas in this area because we know not only are they moving through, but they are living here and breeding,” George Madani, the koala expert on the survey, said. “We would like to sincerely thank all the volunteers and landholders who gave up their time to show the surveyors around their properties.” Jill Madden said, “We hope that this is just the beginning.” Mat Bell, Ecologist with MidCoast Council said, “Council provided logistic support to the survey and is highly appreciative of the efforts of all involved.” “We would also love reports of all your koala sightings, especially those outside of the well-known hub at Hawks Nest,” Jill said. The length of the waterfront at Tea Gardens will be filled this year, with market stalls, activities and food. Take the family, spend the morning at the Festival, then head on over to the Tea Gardens Hotel for lunch and an afternoon of live music from two top acts. First up is local act ‘Paula and Owen Acoustic Duo’, covering hits from the 90’s to now, acoustic style. This duo is guaranteed to be the perfect accompaniment and ambience for a cool drink by the river to relax after a day at the Festival. TUESDAY 2nd October: Social bowls as usual. Good to bowling on the grass again. Format for play was 3 bowls Triples, 18 ends. A good win to Beverly Thrift, Dawn Jones and Wendy Brand 22 v Judi Polak, Jill McBride and Karen Green 10. The result on the next rink was 17 all. Dorothy Dallas, Pam Gilchrist and Lynne Green had a 12 shot advantage over Lily Smith, Julie Kennedy and Kayelene Pearson at the completion of the 13th end, 17 v 5. Not sure what happened but (I guess some great bowls were delivered), Kayelene’s team gained 12 shots over
the next 5 ends, result a tied game. A convincing victory to Christine Fossey, Lynda Richards and Maynie Roberts 26 v Dawn Jones, Sheril Johnson and Dale Winter 4. A very even contest between Jo Younghusband, Lorraine Murphy and Elizabeth Kelly winning by 3 shots against Lyn Nightingale, Bette Saillard and Sandra Leisemann 18 v 15. The winners on the day winning with the highest score were Christine, Lynda and Maynie. Prior to play a”spider” was held, money raised from this is donated to the Clinic Bus. The winner of this was Christine Fossey. The winner of the voucher for the Myall Bistro and Café was Lorraine Murphy, congratulations Lorraine.
Thursday 4th October: The final of the Open Consistency Competition was to be contested Maynie Roberts v Robyn Beaumont unfortunately this event has been postponed to Tuesday 9th October. FIRE crews were called not once, but three times to spot fires in the bush near Jimmy’s Caravan Park in Hawks Nest last week. Rural Fire Service Crews from Tea Gardens, Pindimar and North Arm Cove were first called last Tuesday morning to a spot fire in the scrub near the popular caravan park. It was quickly contained, but early afternoon it re-ignited. Again it was doused, but in the early evening NSW Fire and Rescue were called out again to virtually the same area. Thanks to the crews’ quick responses in all instances, the fires were quickly brought under control. It’s believed all the outbreaks were deliberately lit. Helmut Panhuber, captain of the Tea Gardens/Pindimar Rural Fire Service Brigade has once again called on locals to be ‘Fire Ready’ ahead of a long hot summer to come. The NSW RFS has a handy app which can be downloaded to your smartphone showing you the latest information on fires in the surrounding area, emergency situations and alerts.

IT’S a weird old world. A simple hello takes very little effort. Just a smile or a nod can make someone feel less alone; it can even make their day. You know, the older I get, the more I feel that this earth is divided into three main types: the ignorant, the arrogant and the compassionate.
Take holding the door open for others. If I’m entering a shop with a screen door, and someone is not too far behind me, I will stand there and hold it for them. I’m not sure who taught me, but it was ingrained from a young age. Most people say thank you to this common courtesy, but some look at me as though I’m stark raving mad, or else they walk through without a nod of recognition. Arrogant? Ignorant? Probably a fine old mix of both. The walkers who don’t reply may not have heard you. Many people walk wearing headphones. But if they did indeed hear you, I can think of no logical reason why they wouldn’t respond, unless you look like an axe murderer, which I somehow doubt. Maybe they are trying to walk off some deep-seated resentment. Instead of being in touch with nature and recalling the fine lyrics and vocals of Nina Simone’s Feeling Good, they are instead beset by the more angst-ridden version by Muse. I suggest you YouTube both versions to understand where I’m coming from. Don’t take it to heart, Mrs PA. It’s not you, it’s them. Keep saying hello, smile, nod, do whatever makes you feel good. Then, when they are a few metres away, turn around, run, crash tackle them and say: ‘Is it so god-damn hard to say hello? Are you ignorant or arrogant? Jasminda wants to know.’ Good luck. Well the 12 year old has added to her four Gold medal haul, with another Gold medal at the pinnacle event of the school athletics year, the NSW State All Schools Championships held at the home of the Sydney Olympics
