Kids join Clean Up By Margie TIERNEY OUR youngsters at Tea Gardens Primary School are doing their bit for the environment by joining in the ‘Clean Up Australia’ School’s Day this coming Friday. Leading the School’s effort is Isla Brumby. Isla is the School’s 2019 Minister for the Environment and School Deputy Prime Minister. “As part of Isla’s role within our student Parliament, she is responsible for the coordination and conduct of the ‘Clean Up Australia’ School’s Clean Up Day on Friday 1 March,” Principal Mark Clemson said. “Isla with other members of School Parliament are collaborating with classes
about locations in and around our school to clean up on the day.” Isla said, “I’m very enthusiastic about ‘Clean up Australia Day’.” “I’m looking forward to cleaning up the rubbish around our school so all of the rubbish can go into the correct bin and hopefully together we can make our school a cleaner place.” Isla is keen to change practices around the school. “In class we’ve been talking about “Waste Free Wednesday” and I would like to get the students at our school to use containers instead of plastics every Wednesday which is better for the environment, because rubbish that goes in the wrong place can severely

In Re Estates Croft, deceased [2018] NSWSC 1303 a couple with 6 children, made last Wills which favoured certain children rather than each other. This led to some children receiving more of the couple’s assets when they died. As a consequence the children brought legal proceedings challenging the validity of both of their parents’ last Wills. Judge Lindsay had to consider whether “unusual behaviour” by aging parents was sufficient to legally invalidate their Wills (lack of mental capacity to make a Will). The Judge was careful to consider the evidence of their behaviour at the time of the making of the Wills. In the husband’s case, for example, the Judge concluded that his Will was a “rational,
measured response to the domestic disharmony that had confronted him over the previous 11 months or so”. He noted that the Husband had been subsequently prone to hallucinations he had accused his wife, for example, of sending prostitutes to “knock on his door and to ring his doorbell late at night” but such behaviour occurred after the husband had made his Will and could be excused to a certain extent by his reaction to bad news. His wife had consulted solicitors about a divorce. The case therefore highlights that the mental capacity to make a Will is time specific and an important issue (amongst others) is whether the will-maker is capable of a ‘measured response’ to his or her family situation.

Survey result: koala habitat and activity By Gail & Ian MORPHETT LAST October, the Koala Group commissioned a survey of koala habitat and activity in the Myall Coast region. The survey was carried out over three nights by one paid professional ecologist, two volunteer ecologists and about 6 volunteer field assistants.
The survey was a great success with ten koalas found across 87 sites.
Some of the sites surveyed were on public land and the national park but many were on private land offered by landholders. The survey was a great success with ten koalas found across 87 sites. This may not seem like many, however, it is a density of about 1 koala per 20 hectares
which is actually quite high. It is very much comparable to populations with a far higher profile, that are considered to be doing very well. Koalas were spotted at Myall Lakes NP, Yagon Firetrail (1), Myall Lakes NP, Old Mining Road (2), Hawks Nest, Pelican Ave (1), Shearwater, Toonang Drive (1), Pindimar, several private properties (3) and Karuah Nature Reserve (2). Two of the animals were a breeding pair. Some high quality habitat was identified. This means that there were koalas from one end of the Myall Coast to the other and in all locations females were found, meaning there is breeding habitat, not just movement corridors throughout. This is a very important finding. We must thank the survey co-ordinator Senior Ecologist Kylie Madden, ably supported by experienced wildlife ecologists George Madani and Martin Schulz for their fantastic efforts to carry out the survey. As a result of the survey, the Koala Group has lodged a proposal with the Department of Environment and Heritage to purchase local land to be added to the National Park estate as part of the NSW Koala Strategy.

Meet Candidate: Kate Washington By Heather SHARP
NEWS Of The Area this week is featuring information on the election Candidates for 2019. Current member, Ms Kate Washington, will again contest the seat of Port Stephens in the upcoming March 23 NSW State election. Finishing her first term, and a member of the Australian Labor Party (ALP), Ms Washington is seeking to be re-elected by the voters. Kate Washington’s three priority areas for Port Stephens include, schools, hospitals and the cost of living. In an interview, Ms Washington explained her commitments to the Port Stephens electorate. Ms Washington has often focused on being a community-minded Member of Parliament, and she told News Of The Area her motivation to run as a candidate is because, “I fought hard to be in this role in 2015 because I thought our community deserved better.” “We deserved a representative who cared and who was in the job for the right reasons.”
“I’m motivated now to not only be returned as the Member for Port Stephens, but to see Labor form Government.” Responding to criticism that the long-awaited high school in Medowie has not been built, Ms Washington said, “One of the enduring, decades-long issues for Medowie residents is the local high school.” “The NSW Government has long held the parcel of land designated for a public high school.” “Whilst I’ve been able to achieve a lot from Opposition, I know I could deliver so much for our community as a Minister in a Labor Government.” “My push for a public high school in Medowie is the reason I became involved in local politics.” “The Liberals also committed to making the project ‘shovel ready’ in 2011 but have done nothing since, despite being in Government for the past eight years.” “Despite successive Governments saying a high school is not viable in Medowie, two independent providers have committed to years 7-12 high school in Medowie.”
Cost of living is a concern for Ms Washington, who told News Of The Area, “One of the policies I am most pleased Labor has announced is free OPAL card public transport for children.” “This not only helps families reduce the cost of living now, it will also increase public transport usage and justify further investments in public transport.” If re-elected, Ms Washington plans on continuing with her mobile offices across the electorate. She told News Of The Area, “I’ve learnt that one of the most important tasks is listening.” “Over the past four years, I’ve regularly held mobile offices across the electorate, at festivals and markets, shopping centres and cafes, so that I can understand the issues that are important to locals.” “What I learn from people when I’m out and about, helps me be a better representative for our community.” Asked where her favourite places in Port Stephens are, Ms Washington told News Of The Area, “There are so many places I love in Port Stephens.”

Meet the Candidate: Jaimie Abbott By Heather SHARP
PORT Stephens Councillor, Ms Jaimie Abbott is looking to add Member for Port Stephens to her political accomplishments in the upcoming March State election. News Of The Area interviewed Ms Abbott to gain an insight into her plans for the electorate if elected. She said of the three main areas of concern for Port Stephens voters, were better roads, improved health services, and increasing local job opportunities. Ms Abbott told News Of The Area, “For the past two months I have been knocking on doors across Port Stephens almost every day, listening to people’s concerns and issues.” “After numerous conversations about things that people believe are important and what they want to see Government deliver, it becomes absolutely clear that managing our State’s budget is at the foundation of being able to
deliver and improve every service that people enjoy or want.” “In 2017 I ran for the local Council, because I believed that I could be a strong voice for our community that could represent its views and help to improve local infrastructure.” Recounting some of her achievements, Ms Abbott said, “Whether it is the new playground in Nelson Bay for children with a disability, the new Koala Hospital or the Birubi Transport Interchange, I have been driven to deliver for the community.” “Having had my first child last November I am even more focused on our community’s future that we will all share – the challenges and opportunities – such as local infrastructure investment and better health and education facilities.” A long standing issue for Medowie residents has been the absence of a local, public high school despite the land for one being owned by the Department of Education for decades.
Of this issue, Ms Abbott told News Of The Area, “I have been speaking with the community around Medowie about the high school.” “If I am elected, I will be asking the Education Minister for a full briefing with the Department so that I can ensure that our local students’ needs are being met now and into the future.” “Having looked into this on their behalf, I understand that the NSW Department of Education has considered the viability of a local high school and raised concerns that an additional high school in Medowie would have a negative impact on Irrawang High School.” Conversation and consultation is a priority for Ms Abbott, telling News Of The Area, “I believe there are many ways to get local residents involved in decision-making, such as social media, street stalls and community meetings.” “I find that even just knocking on someone’s door to give them an opportunity to share their thoughts and opinions, is a great way to learn about the passion that people have to see their streets and neighbourhoods

It doesn’t have to, but people have decided they should make money, but it doesn’t need to be the case, it could be reasonably subsidised.” “Private transport companies are Government subsidised; they could stay in private hands, but there should be more services.” “In England they brought out a system where they allowed smaller companies--minibuses—to enter the market which would be worth investigating here in NSW.” “Money has to be spent on infrastructure projects, people don’t want to live in a place with bad transport options.” Involving residents in the decision making process is important to Mr Doran, who said, “I will have an open door policy.”

Greens’ Policy: It’s time to price carbon (again)

Background In recognition of the serious economic, health and environmental threat posed by climate change, the NSW Government has made an in-principle commitment to ensuring NSW reaches net zero emissions by 2050. However there is no policy currently in place to achieve the necessary rapid transition to meet this target. Total emissions for New South Wales in 2016 were 131.6 million tonnes, meaning that NSW will need to reduce net emissions by approximately 4.4 Mt per annum or 3.3% to meet the Government’s 2050 target. But emissions have remained relatively stable in recent years, down by only 0.3% from 132 Mt in 2013 just 9% of the required rate to meet the Government’s 2050 target. The Greens’ policy is to meet net zero emissions by 2040 which will require a reduction of 6.58 Mt per annum or 5% of current emissions every year across the entire economy. NSW was the first place in the world to put a price on carbon, under the Greenhouse Gas Reduction Scheme (GGAS) which commenced on 1 January 2003, closed on 1 July 2012 when the Federal carbon pricing regime was introduced. That scheme imposed obligations on all NSW electricity retailers, known as Benchmark Participants, to reduce a portion of the greenhouse gas emissions attributable to their sales/consumption of electricity in NSW.
Both the NSW and Federal schemes were a success. In 9 ½ years the NSW scheme reduced emissions by 144 million tonnes or 15 million tonnes/ year from the electricity sector. The Federal scheme resulted in a reduction of 17 million tonnes of carbon in the electricity sector in the 2 years it was in effect. Shamefully the Federal scheme was torn down by Tony Abbott, but with the direct experience of climate change in the form of drought, floods and bushfires the public is eager for a genuine climate change policy and ready to embrace a carbon price again. This is supported by companies like BHP saying it’s time to put a price back on carbon recently. Woodside Petroleum and Rio Tinto also called for a price on carbon in 2018. There is also the possibility of States taking collective action to price carbon in the absence of Federal leadership. In the USA 9 States (Connecticut, Delaware, Maine, Maryland, Massachusetts, New Hampshire, New York, Rhode Island and Vermont) jointly operate a regional CO2 cap-and-trade system known as the Regional Greenhouse Gas Initiative. States in Australia can work collectively to set up a carbon market regardless of the intransigence at a Federal level and the Greens will be pushing for this. Policy
Use the Load Based Licensing Scheme to set a state-based price on carbon.
The Load based Licensing Scheme under the Protection of the Environment Operations Act 1997 is used by the Environment Protection Authority to set “limits on the pollutant loads emitted by holders of environment protection licences and links licence fees to pollutant emissions.” The scheme is already used to impose prices on emissions of other pollutants such as nitrous oxide and particle pollution and is described by the EPA as “a powerful tool for controlling, reducing and preventing air and water pollution in NSW”. The EPA also says the scheme “provides the administrative infrastructure for wider use of emission trading schemes in NSW, through its robust calculation and annual reporting procedures, under conditions of high public accountability”. The EPA describes emissions trading as “the most cost-effective way” for established emission goals to be met “by letting the market determine the lowest-cost pollution abatement opportunities.” Set a two year fixed price of $30/tonne for large industrial emitters The proposed carbon price would be a two year fixed price of $30/tonne. This is based on the Garnaut Climate Change Review recommendation in 2008 of a price between $20 and $30 per tonne of carbon dioxide (CO2) equivalent. The carbon price would apply to large industrial emitters including power

According to the 2016 National Greenhouse Gas Inventory, together these industries account for approximately 87.8 Mt or two-thirds of CO2 emissions in NSW per annum. The scheme would not initially apply to road transport and agriculture The carbon price is expected to raise total revenue in the first two years of $5.13 billion. be linked to schemes in other states or countries if a national policy was not enacted. This would be in the form of a NSW economy wide emissions reduction target of 5% per year to reach net zero emissions by 2040. Under the Load Based Licencing Scheme, be able to buy and sell permits for emissions or credits for reductions in emissions to meet the overall state cap. Farmers and other land managers would be able to make money by storing carbon in the landscape through carbon credits under this scheme. No additional revenue would be raised once it becomes an emissions trading scheme. Money raised helps households reduce
electricity bills, industries transition The money raised from the price on carbon imposed in the first two years of the scheme would be used to assist households to reduce energy bills through installation of solar panels and batteries (see Greens Household Solar announcement) and through energy and water efficiency measures. It would also be used to assist the wider economy to transition away from carbon intensive activities, build large scale renewable energy and storage and assist carbon intensive industries such as manufacturing and aluminium smelting to reduce their emissions.

Trove, for those not familiar with the website, is an online research tool of some staggering 459,035,016 online resources, books, images, newspapers maps, music archives, the list goes on. The Family Research Members have been tasked with digitising the early copies of the NOTA dating back to 1970. “It has been in the minds of members of the Family research group since we received the papers from the Progress Association, but

it seemed like a pipe dream we would never be able to finance,” Anne Shannon told the gathering. “There are currently 22,863,264 newspaper pages and 2,026,782 gazette pages digitised and available to view in Trove, now we will add as many as we can, as we raise the funds. Nota will be in good company,” Anne said. $20,000 dollars is needed to convert the microfilm to a digital format, money that many of the community groups and individuals have been happy to donate. Among them, the Hawks Nest Tea Gardens Progress Association, Tea Gardens Country Club and Hawks Nest News Agent, Hugo
Elstermann “It’s one of those things that the community needs to do, it’s our history that could be potentially lost if we don’t,” Hugo Elstermann said. While they’ve raised a third of the amount through grants and donations there’s still a long way to go. ”This is our special project for 2019 and we ask you all to join in promoting it in our community, with publicity as well as donations,” Anne said. A GROUP of local youngsters did us proud recently at the Little Athletics Zone Championships in Newcastle. “We had a great weekend, the weather was fabulous and the kids performed to their best on the day,” Myall Coast
Little Athletics Secretary, Melisa Brown said. The youngsters, aged 15 and under, competed in a range of events, shot put, javelin, discus, high jump, long jump, triple jump, hurdles, sprints and the 800 metre run. 13 year old Gemma
Brown, came in third in the high jump at 1.25 metres. She also competed in the triple jump coming in sixth at 8.22 metres. Also at the meet, Sam Alchin, who competed in the
