What a Result! Hawks Nest’s Keira ahead of the Pack By Margie TIERNEY NEWS Of The Area readers will have noted last week that young Hawks Nest athlete, Keira McGregor, was Sydney bound to compete in a major school’s competition at Olympic Park. We’re thrilled to report this week that she performed brilliantly. The 12 year old came first in the 100m, just 0.03 seconds outside the record. She won the 200m in a race record. Took out the long jump with another record breaking distance. And brought home the last leg of the 4 x 100m relay for a second place for her Medowie Christian School. But wait there’s more. First in discus, third in shotput and Overall Age Champion. “It’s been a lot of hard work to get to this level and I want to thank my coaches for all their help.” Keira said. There’s no rest for Keira. She’s now in training ahead of more NSW State events being held in Sydney throughout September.

Name Drama FROM Page 1 an ordinary meeting in Council Chambers and item 19 was listed as Rescission Motion regarding the destination brand of Barrington Coast. Being somewhat ambivalent, however aware of the passion shown by a large number of the community in opposition to the name, I elected to attend as an observer. We were treated to a spectacle in the
best tradition of Shakespearean theatre. There were moments of passion, high drama and pure comedy. We heard from 7 speakers in support of the motion, backed by a phalanx of cheering spectators waving NO signs and one brave speaker against the motion, who received mainly jeers. We heard from one emotional Councillor in support of the motion and another clinical Councillor calling for a vote. Comedy was provided in the form
of points of order. We heard references to a Govt. issued handbook on Council rules and regulations. High drama was centre stage when the 3 Councillors supporting the motion, elected to vacate their chairs and left the meeting The vote resulted in the rescission motion overturned and the Shire will now become a destination name called Barrington Coast. Driving home allowed me some reflection.
newsofthearea.com.au The brand name has no impact on me or mine. I continue to be within the Myall Coast. I continue to reside in Tea Gardens and marvel at the Myall River. I will continue to visit the wonderful Hawks Nest beach and walk along the picturesque Jimmys’ foreshore. There is no change and if the brand brings in extra tourists I will be pleased on their behalf. Gordon Grainger Tea Gardens

By Margie TIERNEY AFTER much debate, and quite a lot of criticism from some members of Myall Community, MidCoast Council has voted in favour of the destination branding ‘Barrington Coast’ to be used in a marketing campaign to attract more tourists to the region. The decision was agreed to at a meeting of Council last week after the initial agreement became the subject of a rescission motion. Mayor David West said, “This is not a new name for Council, and that several destination names had been considered over a period of time.” “Our aim is to ensure the whole region benefits and this means encouraging people to see more of the region, yearround.” Myall River Action Group’s Gordon Grainger attended the meeting. “On reflection it means little to us.” “We will still be called the Myall Coast and we will still have Tea Gardens
and marvel at the Myall River,” Mr Grainger said. “We will still reside and visit the magnificent Hawks Nest beach and wander the picturesque Jimmy’s foreshore.” “The Myall Lakes will remain the heritage wilderness.” The Winda Woppa Association’s Patricia
Garrard said, “It is simply a clever collective name, forensically analyzed to identify our region as a major part of a bigger and unique ‘burger with the works’ destination for tourism.” The President of the Myall Coast Chamber of Commerce and Tourism Graham

THE Winda Woppa Association has just been granted membership to the Port Stephens / Myall Lakes Estuary and Coastal Zone Consultative Committee. The Committee is the single body that provides advice to Port Stephens and MidCoast Councils with regard to management of the estuary and stakeholder input on broader coastal management
issues. Patricia Garrard is the Association’s nominated representative. “We hope members will be pleased to learn that we have been confirmed as members for up to four years (but within the term of Council) as one of three community advisers from MidCoast Council area,” Patricia said. The Winda Woppa Association
was selected on a wide range of criteria. “Membership of the Committee is a direct result of nearly two years of persistence engaging various parts of the community,” President of the Association, Ken Garrard said. Apart from community representation, other members of the committee include representatives of all Government agencies and industry groups that
have some interest or influence on the management of the estuary. “We see our membership of the Estuary Committee as a significant step forward in our ability to engage and influence all the key stakeholders with regard to Jimmy’s Beach, Port Stephens, The Myall River and the Myall Lakes.” The first meeting of the new Committee will be held on Monday 24 September.
Koalas Returning to Tea Gardens By Gail & Ian MORPHETT AFTER a few years of absence perhaps koalas are returning to Tea Gardens or perhaps they are just retiring there. Recently there have been sightings that give hope of permanent residence. Recently koala activity was detected in the remnant koala food tree corridor at the rear of Coolabah Close. Last year a koala came knocking on the screen door of one of the
retirement homes in Willow Court, the Grange. In July a koala was hit by a car in Kingfisher Avenue. The young couple in the car stopped to render assistance as the animal shot across the road and up a tree. Eventually he climbed down and headed for the Koala Reserve. The Koala Group has been planning for years to establish an avenue of koala food trees in Sanderling Avenue in the memory of John Davis, a well-
respected Tree Management Officer from Great Lakes Council. Last year we purchased a number of different species of Eucalypts that are known to be koala food trees. We then paid a bush regenerator to grown these tube-stock trees up to a suitable size for planting. They were to be planted in separate stands along Sanderling Avenue to showcase the different types so that residents who may wish to select a tree for planting
can see an example. Two weeks ago they were ready and were planted along the street, surrounded with woodchips and watered. Sadly, last week vandals ripped out 12 of the freshly planted trees. What is even more galling to us is that this is the second time that vandals have destroyed our plantings in Sanderling Avenue. It is hard to understand the mentality of people who vandalise the hard work of others.

A cautionary tale for directors who might think they can hide behind a “corporate veil” and avoid personal exposure. Parties to a complicated dispute settled the dispute and entered into consent orders. Subsequently, an application was made against one plaintiff company to enforce the consent orders. The company had failed to execute all necessary documents. When the plaintiff company continued to fail to comply, the Supreme Court (Tasmania) made an order under section 169 Supreme Court Civil Procedure Act 1932 (Tas) empowering the Registrar of the Court to execute the documents instead. The Defendant then sought a costs order for the cost of enforcing the orders. The director of the plaintiff company was not a party to the proceedings. The
Judge noted that he had power to make costs orders against nonparties but also noted that he should be cautious before doing so. In particular, in accordance with case-law, it was usual to require a party to warn a nonparty of an intention to seek costs orders against them. Here, however, it was clear that the director had been a sole director at the time the consent orders were made and therefore had clearly authorised the consent orders to be signed. In addition, it was unlikely any warning would have made a difference to the director’s conduct in failing to comply with the consent orders. In those circumstances, the Judge made the order for indemnity costs against the director. See ACN 125 152 310 Pty Ltd v Joseph [2018] TASSC 26

By Margie TIERNEY
EMERGENCY crews were quick to respond to a multiple car crash in Tea Gardens last week. The crash, near the entrance to the Myall Quays Shopping complex, involved three vehicles. Police say the 91 year old driver of a Ford Festiva was leaving the centre, when he put his foot on the accelerator instead of the brake. The crash, sandwiched and flipped a Suzuki between the other two vehicles. Bystanders were quick to lend a hand. Luckily, the driver of the Festiva suffered only a few minor cuts. The drivers of the other two vehicles escaped injury. The Pindimar/Tea Gardens Rural Fire Service attended the crash. Noel Quince from the RFS said, “Our major concern was to ensure there was no leaking fuel.” Police have yet to lay any charges.

made by so many Australians.” The Battle of Long Tan, on the 18 August 1966, was one of the fiercest battles fought by Australian soldiers in the Vietnam War. A total of 17 Australians were killed in action and 25 were wounded, one of whom died a few days later. Mr Mick Young from Karuah placed a wreath in memory of his mates he served with in 103 Field Battery in Vietnam in 196667. “Tributes were also placed on the Vietnam Memorial by
the Presidents of Karuah and Tea Gardens Sub Branches Mr Peter Fidden and Mr Terry Munright along with the member for Port Stephens Kate Washington and Port Stephens Council Cr Arnott.” Mr French said. Mrs Margaret Kennett paid tribute to the New Zealand Vietnam Veterans in memory of her husband Kevin who passed away last year. Next year the combined Service will be held at the Tea Gardens Memorial in Anzac Park.

Dale Winter and Col Amos had a similar win in their match against Jill McBride and Noel Jackson 25-8, and Karen McPhie and Ron Webster recorded a good win over Judi Polak and Ron James 26-17. 26 August There was no Sunday Bowls today as the weather deterred any start. Similarly there will be no Sunday Bowls next Sunday, Father’s Day, but the following week, 9 September, the Sunday bowlers are planning a visit to the Belmont “Sporties” Club. Nominations are on the board. There were some interesting results today in the second round of the Club Mixed Pairs competition played in almost perfect conditions after the rain cleared away. Bette and Colin Saillard had a narrow win over Jeannette and Brian Emmett, 14-13.
Robyn and Scott Beaumont continued their winning form defeating Dale Winter and Col Amos 23-9. Liz and Graham Kelly disposed of the Karen McPhie and Ron Webster challenge winning 14-9, and in the remaining game, Sandra Leisemann and Merv Mills managed a close 15-14 win over Lon and Lynda Richards. As it is the Father’s Day weekend next week there may be some delay in playing the semi-finals. Watch this space! In other news; Club Major Pairs champions, Peter Gurney and John Parkinson will be playing in the Newcastle District Champion of Champion Pairs on Saturday 1st September at 1.15 Pm at Hamilton North Bowling Club. We wish them all the best!

I have very much enjoyed the work I have been able to do in these portfolios, particularly in the Health portfolio where I was able to put together a number of important initiatives in the Health Workforce space, that will have long lasting benefits to health delivery in regional Australia in the years ahead. In the Children and Families portfolio, our work in implementing the 3rd action plan for the protection of Australia’s Children, the development of a fourth action plan and securing further progress on permanency and adoption with my State and Territory counterparts have been highlights, as well as the work we have been doing in the Settlement Services space to improve integration among our humanitarian entrants. In moving on to a new chapter in this Parliament, I am very focused on continuing to deliver for our community. At present, I’m working on a Vision 2030 Plan for our electorate and I’m looking forward to seeing many more surveys come in over the coming weeks as we take many of your ideas forward. Tea Gardens Men’s Bowling Club By The JAFFA
22 AUGUST The usual Wednesday Nominated Triples was played today in cold and windy conditions. Forty-eight players braved the cold playing on both surfaces. The Club welcomed visitors, Ken Eldridge from Donvale Victoria and Wayne Croker from Goulbourn. A new member also joined our club this week; a big welcome to Colin Cameron transferring from Valentine. Also returning to our Bowls were Geoff Fowler, Ian Baker and Gary Porter, welcome back. Five teams managed to win both their matches but scores in the low fifties were not going to get a look in. Peter King, David Garcia and Peter Gurney turned in a magnificent 57 to take the money. 25 August The first round of the Club Mixed Pairs competition commenced today with a good field of 13 teams competing overall with three teams having byes. The results were as follows:Brian and Jeannette Emmett held on to beat Wendy Brand and Ross Barry 16-15. Bette and Col Saillard won over Lily Smith and John Slater 15-12. Robyn and Scott Beaumont won comfortably over Peter Gurney and Kayelene Pearson, 28-8.

I’ve noticed a lot of people in the local supermarket with quite overwhelming body odour. I’ve also noticed a lot of swearing, with young mums saying things like ‘crap’. What is the world coming to? Mrs UL, Raymond Terrace Dear Mrs UL, WE have two problems here and one seems a lot easier to deal with than the other. If ‘crap’ is the most offensive thing mums are saying, I wouldn’t be heading along the path of complete moral panic at this stage. In the upward spiral of bad language, ‘crap’ is probably at the bottom end of the spectrum along with ‘drat’ or ‘dang’ or ‘darn’. My mother would always say ‘sugar’, which was such a sweet and innocent expression of agitation, that it was hardly worth the effort. I think this one is a first-world problem that you should just let go of. The next issue, body odour, is one of those things that I guess we have all experienced from time to time. I used to have a boxing partner at the gym and he didn’t need to give me an uppercut or a left jab to wind me, his odour was enough to knock me out in the first round. Morning breath is another problem. One of my friends had this issue with her husband and found it very hard to be amorous when his breath was so foul she wondered if he had licked the bottom layer of the budgie cage during the night. You can, of course, leave subtle hints, like tongue scrapers and mouth wash and heavy duty deodorant, but not with complete strangers in the supermarket. Sweat is virtually odourless, so it is the buildup of bacteria that is causing the revolting smell. You could hold a hankie infused with lavender or eucalyptus to your nose and just allow your sweet scent to infuse the supermarket, Mrs UL. Or you could make little hygiene packs, and hand them out at the entrance. I think people would appreciate receiving something other than useless plastic groceries. Carpe diem, Jasminda NOTA Graphics - PSLA2017_081618_neni
