No criminal wrongdoing by Norway House RCMP officer who may have caused man’s broken ribs and punctured lung A Norway House RCMP officer who may have broken a fleeing suspect’s ribs by lying on top of him in October 2017 has been found not to have used excessive force and no charges were recommended against the officer following an investigation by the Independent Investigation Unit of Manitoba (IIU), which looks into serious incidents involving on- or off-duty police officers in the province. The unnamed suspect, whose mother had called police on him because he was intoxicated, ran from the front of the residence

police responded to and into the bush. The officer who was the subject of the inquiry pursued him and then laid on top of the suspect after the man fell down on the rough terrain. The suspect was then transported to cells and awoke the next day complaining of chest pain. He was taken to the Norway House Cree Nation Hospital where it was determined that he had suffered broken ribs and a punctured lung. The injured man told the IIU he was drunk and ran from police in hopes of finding somewhere to sleep. He fell and landed

on his chest on a rock, after which he said the RCMP officer fell on top of him before grabbing his arm and handcuffing him and taking him to a police truck. The officer being investigated said he prevented the man from running again after he fell by lying on top of him with a knee between his legs until two other responding officers arrived. One of these officers said he found the officer who was under investigation lying on top of the suspect after catching up with them. Another officer said the man who got injured

was already handcuffed and on the ground by the time he arrived. “No evidence exists that any officer, and in particular SO [subject officer], punched, kicked or otherwise applied excessive force to AP [affected person],” said IIU civilian director Zane Tessler in his final report. “Therefore, on careful review of the available evidence and material facts obtained in this investigation, I am not satisfied that the requisite reasonable and probable grounds exist to justify any Criminal Code or other charge against SO.”

$37K in fines and multi-year licence suspensions for hunting violations in Northern Manitoba A lodge operator and guide from Manitoba as well as a unlicensed guide from Alberta received fines of $2,000 to $25,000 and two- to five-year licence suspensions after pleading guilty to hunting infractions uncovered by Manitoba conservation officers. Dustan George Budd pleaded guilty to possessing illegally taken wildlife and failing to report the killing of a wild animal in defence of property last October and was given a $25,000 fine and a twoyear hunting suspension. Dustin Quinn Alexander pleaded guilty to possessing illegally taken wildlife

and was fined $2,000 and suspended from hunting for two years. On June 27, Adrian Michael Warden of Alberta pleaded guilty to two counts each of guiding and hunting without a licence and three counts each of hunting out of season and possessing illegally taken wildlife. He was fined $10,000 and received a five-year hunting suspension. The infractions were uncovered through a multi-jurisdictional investigation by Manitoba, Alberta and the U.S. Fish and Wildlife Service, which determined that American, Albertan and Manitoban

hunters had been hunting illegally in Manitoba and using licences, documents and tags to cover up these activities. The investigation began with a conservation officer examining records from Budd’s Gunisao Lake Lodge, located east of Norway House, which showed that American hunters had bought foreign resident black bear licences but had been guided by a guide with an expired licence in 2015. These records turned out not be accurate, as the hunters had actually been guided by an unlicensed guide from Alberta. Stories regarding the hunt had dis-

crepancies, including that the lodge owner had shot a bear in defence of his property, and it was also discovered that another employee of the lodge illegally obtained a licence, which was then used to cover up the killing of another bear by the unlicensed Alberta guide. During the course of the investigation, three bear hides and a skull were also seized. Lewis concurs that addictions are an underlying cause of crime. “Addictions-related offences are the real driv er in Thompson, and as the police we deal with the symptoms of a big ger problem,” he said. “This is why it is critical that all partner agencies pull together to provide a sliver of the solution that can lead to an overall effective solution when each agency provides a contribution. Thompson is in need of multi-level support system for those with addictions.”

The City of Thompson’s recreation and community services committee considered fee waiver requests from three community organizations at a special July 24 meeting. The committee changed the fee waiver policy for non-profit groups and events to allow a maximum rebate of 50 per cent of facility and equipment rental fees earlier this year rather than all of the fees. First up was a request from representatives of CHTM Radio and the Rotary Club of Thompson, who wanted the city to forgive half of the $535.72 that they spent to rent out Centennial Park July 11−14 for the 2018 Million Dollar Hole-inOne competition. The committee decided in the groups’ favour, since they had submitted all the necessary paperwork 60 days before the event, as the policy requires. New Canadian Tire owners Mike and Jackie Howell didn’t send the request to waive fees for their July 8 Jumpstart barbecue two months in advance. H o w e v e r, s e v e r a l committee members still wanted to waive half of the $1,193 in fees that the Howells paid for this event, since the pair is new to Thompson and went out of their way to keep funds they raised for Jumpstart within the community. “I think given … the

fact that it was a community event with the money staying in Thompson for the kids, and because we want to show people that we are supportive of business initiatives and community initiatives, I think it’s in our best interests to waive 50 per cent of the fees,” said member Penny Byer. Judy Kolada saw it differently, since she didn’t want to start making exceptions that would render this entire policy moot. “I think as soon as we’ve waived for one party we’re going to have to follow up on a lot more requests,” she said. “We’re not just slamming the door in their face, but we’re not opening the door to more requests and putting ourselves in a situation where if we pass this then we have to pass [them all].” In the end, the committee compromised by allowing the recreation department to waive a maximum of $250 in fees. The committee also came to this same understanding when discussing the Thompson Golf Club, which asked the city to donate tents and a platform stage for their 50th anniversary celebration Aug. 3−5. Their request was sent on June 16, outside of the 60-day deadline, and committee chairperson Dennis Foley said it didn’t even contain all the necessary information, including the total cost of the event. Committee member Ryan Land pointed out

Manitoba ranks in the middle of the pack for Canadian provinces and territories when it comes to receiving mineral exploration permits in less than six months, according to a recent report by the Fraser Institute. Manitoba ranks sixth overall among 23 jurisdictions in Canada, the United States, Australia and Scandinavia for necessary permits being issued within six months, says the think-tank’s Permit Times for Mining Exploration in 2017 report released July 24. That was lower than Newfoundland and Labrador, Yukon, Quebec and Saskatchewan but ahead of Ontario, B.C., Northwest Territories and Nunavut. The only non-Canadian jurisdiction ranked higher than Manitoba was Alaska

The general perception among mining executives is that the time it takes to receive permits has increased in Canada over the past decade and Manitoba was ranked 10th in the survey for the percentage of respondents who said permit approval times had lengthened. Manitoba was 19th in the number of survey respondents who indicated that the government’s own timelines for permit approval were met at least 60 per cent of the time. It was next to last in both the number of respondents who said transparency in the process encouraged or was not a deterrent to investment as well as in the percentage of respondents who were confident or highly confident that they would receive the necessary permits to proceed with mineral exploration
