Senate shifts burden of proof to INEC

By JOSES SEDE ABUJA - After initial stiff opposition by most Senators to the proposal, the Senate yesterday passed to second reading a bill seeking to amend the Electoral Act 2010, to vest the responsibility of proving the regularity of any election in the Independent National Electoral Commission, before the Electoral Tribunal or Court in Nigeria. Currently, the extant Electoral Act, in agreement with the provisions of the Evidence Act vested the responsibility of proving the irregularity of any election in the candidate,

who alleges irregularity and is the litigant or defendant in a suit before the Election Tribunal or Court in Nigeria. However, in considering the bill, entitled, “A Bill for an Act to amend the Electoral Act 2010 to give additional Powers to INEC 2014”, sponsored by Senator Hadi Abubakar Sirika (Katsina North), most of the Senators kicked against the proposal, arguing that it was not in line with the provisions of the Evidence Act and practices within the Commonwealth of nations. SSS nabs 8 kidnap, internet suspects
