All prospective purchasers must register giving their full U.K address and telephone number. Additional identification may be requested. Following registration you will be given a bid card under which purchases may be made. You will be responsible for all lots purchased under your bid number. All lots will be sold ‘off the catalogue’ from the rostrum and therefore prospective purchasers are advised to inspect and satisfy themselves as to the content of each lot prior to sale.

SETTLEMENT ON DAY OF SALE all lots must be paid for on the day of sale. Purchasers unknown to the Auctioneers and wishing to pay by cheque must make one of the following arrangements BEFORE the day of sale.

Inform your own Bank Manager that you wish to pay by cheque, tell him the maximum amount you are likely to spend and ask him to instruct our Bankers that it will be in order to accept your cheque. Our Banker will then inform us.

Arrange with your Bank Manager for the issue of a guaranteed cheque to be brought with you.

Provide a letter from your Bank stating the amount up to which your cheque will be honoured. Fax and photocopies are NOT acceptable. The letter must specify which sale you are attending and date. (d) Provide an additional proof of identity (e.g. Driving Licence).

3. Buyers Premium The Buyer will pay to the Auctioneer a Premium of 10% on the “Hammer Price” of all Lots. The Premium which attracts Value Added Tax at the current rate is not negotiable and is payable by all purchasers. The Auctioneer, when acting as an Agent for the Seller, may also receive commission from the Seller.

4. Value Added Tax All Lots are subject to VAT. 5. Commission Bids For the convenience of prospective buyers who are unable to attend the Sale, the Auctioneers will arrange to bid on their behalf. Lots will be purchased as cheaply as permitted by other bids and reserves. Bids must be submitted to our office in writing (forms available from Auctioneers) 24 hours before the Sale commences. The Auctioneers shall not be liable for any neglect, default or failure in executing bids.

6. Removal of Goods Subject to payment being made ALL LOTS must be removed without fail from the premises no later than 4.00pm on Friday 15th February unless otherwise arranged with the Auctioneers. (a) Purchasers are reminded that all lots are expressly at their OWN RISK at the fall of the hammer. (b) Purchasers are further reminded the structure of the building in which the items are situated should not be damaged in any way during removal of goods and must be left in the way in which it was found. The Auctioneers will not be held liable for any damage caused to the building in removal of goods and it is the purchaser who will be solely liable for any damage incurred to the building during removal. (c) An electrician will be on site for the removal of ‘wired in’ workshop machines on the day of sale.

Purcahsers must make their own arrangements for uplift after 15th September 7. Lifting & Loading Purchasers must make their own arrangements for lifting and loading including supervision of their own loading.

8. Transfer of Lots The Auctioneer will only accept payment from and permit removal of lots purchased by the Purchaser successfully bidding at the Sale or its agent acting for the Purchaser.

9. Condition of Sale The attention of Purchasers is drawn to the Conditions of Sale included in this Catalogue.

10. Purchase of Goods The Auctioneers draw to the attention of buyers contemplating purchasing goods through a through a Finance finance company that arrangements should be made well in advance to ensure payment is made Company in accordance with the Conditions of Sale.

11. Indivisible Loads Successful Purchasers must obtain the necessary permission (i.e. Police, Ministry of Transport, Local Authority) to transport off site loads (long/wide loads) within sufficient time prior to the commencement of clearance of those items, in order to comply with the clearance period as stated in the Notice to Purchasers.

Furniture & Lots sold where they are applicable to this act are sold on the understanding that the vendor(s) Furnishings (Fire Safety) does not represent them as being purchasers are reminded that if nevertheless any of the goods Regulations 1988 or articles are intended to be supplied in due course for domestic uses the purchasers shall, before supplying them for such use, ensure that they comply with the obligations required under the Furniture & Furnishings (Fire & Safety) Regulations 1988.

13. All Road Purchasers are reminded that some of the vehicles or trailers sold at this sale may not be immediately roadworthy, or may be of such design as will not, without alterations, comply with the provisions of Acts or Regulations issued there under. It is an offence to use on a road a vehicle or trailer which does not comply with these provisions and accordingly purchasers shall undertake to comply with the Acts and Regulations relating to such vehicle or trailer.

14. Descriptions The Auctioneer has used its best endeavours to ensure that the descriptions of each lot appearing in this catalogue are accurate but the Bidder relies upon such descriptions at its own risk. The Bidder is advised to inspect any lots for which it intends to bid to verify the accuracy of the description contained in the catalogue. The Auctioneer on its own behalf and on behalf of the Vendor, hereby excludes all liabilities for any loss or damage or injury sustained by the Bidder, as a result of or in connection with a defect in any lot purchased, a misdescription thereof comprised in the catalogue, the failure thereof to fulfil the functions of which they were intended by the Bidder or any damage or loss occasioned thereof prior to the same being removed from the Vendor’s premises but after the passing of risk therein pursuant to Clause 6 (a) hereof. The Auctioneer does not warrant the Vendor’s title to any lot and the latter will be sold with such title as the Vendor may have.
