Please read and observe the following:
• Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.
• All vehicles transporting livestock will be subject to a documentation check before entry to market site.
• All visitors and traders must ensure they wear clean clothing and footwear before entering market site.
• All visitors and traders using car park areas please use main entrance.
• All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office.
• Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.
• Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
• No livestock will be allowed to remain on the premises after a sale.
• Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.
• Wash hands thoroughly when leaving livestock pennage areas.
• Please observe our staff’s instructions at all times.

LOCATION: This sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave the M6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4 mile of M6.

PRE-SALE INSPECTION: All sheep forward for the sale will be subject to a Society inspection, focusing on Mouth, Testicle, excessive Black wool and peeling. Any animal which does not reach the Inspection standard will not be eligible for show or sale. The inspection decision will be final and any animal failed must be removed immediately from the sale and forfeit the entry fee. No appeal is permitted.

CONDITIONS OF SALE: Sold under the conditions of sale as displayed in the market, recommended by the Livestock Auctioneer’s Committee for England and Wales. The Pedigree and descriptions of the lots are believed to be correct, but are not intended as warranty, and therefore shall be taken with all faults and errors of description. All sheep are sold as correct in mouth unless otherwise stated.
METHOD OF SALE: All sheep will be sold in guineas (105 pence) and strictly in catalogue order, unless any alteration is announced by the Auctioneers.
A commission of 5.25% will be charged by the Auctioneers on all sales, together with sale levy of 1½%.
SUBSTITUTE ENTRIES: Up to two substitutes will be allowed per vendor and these must be notified to the Auctioneers not less than 3 days before the event. Only substitutes notified will be eligible.
UPSET PRICE: Minimum Selling Price for is Rams 350gns. Any ram failing to reach the minimum price in its category will be passed out the sale ring unsold.
COMMISSIONS: The auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions.
SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of sale. No animal may leave the sale premises without an offical ‘pass slip’ obtainable only from the Auctioneers upon settlement.
MAEDI VISNA: All sheep are MV accredited.
EXPORT TO NORTHERN IRELAND: As of 1 January 2021, the rules for exporting sheep from the United Kingdom to Northern Ireland and the European Union have changed for moving breeding stock to Northern Ireland – NO Direct Export or Vendor Returns will be available
It will be the responsibility of the purchaser and/or the vendor to make any necessary arrangements for sheep going to Northern Ireland.

CONDITONS OF SALE
1. This Sale is held under the Bye-law 16 of the Suffolk Sheep Society's Sale (as printed in volume 126 of the Society's Flock Book) The Bye-law is hereby incorporated as a Condition of Sale.
2. Vendors and purchasers are deemed to agree to these Conditions of Sale, and these Conditions of Sale are terms of any contract of sale and purchase at the sale.
3. These conditions shall be governed, construed and enforced in accordance with the law of England and the law of England shall apply to all contracts made at the Sale.
AUCTIONEER’S CONDITIONS
1. The Sheep will be exposed in lots according to the numbers in the following catalogue. The Auctioneers reserve the right to refuse any bid without assigning any reason. The highest offer on each lot will be preferred to the purchase (subject to Article 3)
2. No liability whatever is undertaken by the Auctioneers for the statements appearing in the Catalogue or made at the Sale. The exposer who supplies such statements is alone responsible for any error or mis-statement. Animals affected with any disease of an infectious nature or animals our of an infected flock are strictly prohibited from being brought to the premises occupied or used by the Auctioneers at the time and should any such be brought, The Owner or Consigner will be held responsible for all damage or loss occasioned thereby.
3. The Exposers reserve the right to fix a reserve price and to announce same before the bidding begins or during the time of the bidding or at the conclusion thereof. The right to bid by or on behalf of the seller in terms of the Sale of Goods Act 1893, is expressly reserved.
4. Immediately after each purchase is declared, the risk of the animal shall be exclusively with the Buyer, and it is declared that until a settlement shall be made in terms of these Conditions the delivery of the animal shall be suspended. The right of the property shall not pass until the price is paid.
5. Immediately after the Sale all lots must be paid for in cash to the Auctioneers. The price being paid, each lot shall be taken away at the Buyer’s expense within one day after the sale thereof. Lots shall only be removable from the Auctioneers’ possession on a written order from their clerk, and any lot removed in contravention of this condition may be recovered brevi manu by the Auctioneers.
6. If any buyer fails to pay for and remove his purchase in compliance with the above conditions, the Auctioneers in their opinion may either (a) sue the Buyer for the price and interest thereon at the current Bank Rate and for the keep of, and any other expense incurred by them in connection with such purchase, or (b) re-sell the Lot either publicly or privately and recover from the defaulting Buyer the deficiency (if any) attending such re-sale and interest thereon as aforesaid together with the keep and other expenses. In either case the Auctioneers shall have the rights to sue at their own instance without the consent of the Owner or Consignor, and no defence whatever in such action shall be competent to the Buyer who shall have recourse against the owner or Consignor alone.
7. No undertaking of the Auctioneers or their servants to take charge of any animal after the sale or to forward it to its destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions.
8. The Auctioneers is appointed Judge of the Sale, to whom are hereby submitted all disputes and differences of any kind which may arise at and in relation to the Auction, either between Exposers and Offerers or among Offerers themselves; his decision shall be final and binding on all parties.
DISPUTES
All disputes of differences of any kind, which arise at or in relation to the auction, whether between a seller and buyer or amongst bidder or otherwise shall be referred to the auctioneer and his decision shall be final and binding on all parties.
All other disputes shall be referred to an arbitrator who shall be appointed, failing agreement between the parties, by the society and the decision of the arbitrator shall be final and binding on all parties to the dispute. Any arbitration under this clause shall be subject to the Arbitration Acts for the time being in force.
GENERAL DISPUTES
In the event of a dispute arising between two or more Members of the Society any one of such Members may refer the dispute to the Society with a request that the matter be referred to an arbitrator to be appointed, failing agreement between or amongst the parties, by the Society. The decision of the arbitrator so appointed shall be final and binding on all parties to the dispute and Council has the power to ensure that the arbitrator’s decision is implemented.
Any Arbitration under this By-Law claus shall be subject to the Arbitration Acts for the time being in force.
NOTICE
Council reserve the right to take samples of tissue, hair or blood from any consignment for future use of any sort.
NEW RAM GUARANTEE
Vendors’ Warranty (Livestock Association)
The Vendors warrants that any rams sold is capable of natural service. This warranty is a 10 week warranty.
Purchaser’s rights
If the purchasers proves a breach of warranty the Purchaser may return the ram to the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions Sor avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate confirming that:
a) The rams’s inability incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and
b) The Purchaser’s breeding stock are not responsible for the ram’s inability incapacity or ineffectiveness.

As a member, employee volunteer or associate, of the Suffolk Sheep Society you are part of a renowned breeder organisation that prides itself on representing the world’s finest sheep breed, producing premium quality lamb and breeding stock
In working together all members, the Society employees and Council representatives must respect each other’s role in maintaining this pedigree within the domestic and world market.
From time to time, you may experience issues or concerns regarding your membership or services that you engage with, this code of conduct outlines the correct process a member should follow to gain a resolution to any difficulties they are experiencing.
The Code also outlines on a day-to-day basis the usual expectations that employees, members and council representatives should expect, using the adage -

All parties have the right to work for and with the Society in an environment that: -

✓ Encourages Individuals to treat each other with respect
✓ Advocates speaking politely, openly, and honestly with others
✓ Is open transparent and fair
✓ Encourages the parties to take responsibility for each other

If any party goes against any of these codes, then a full investigation will be in itiated through the Complaints Committee (Chair, Vice Chair and Secretary) with the view to addressing the situation through the Disputes and Disciplinary committee to reach an outcome. The process being duly followed, the decision of the committee is final.
For avoidance of any doubt these include but not exclusive to, written or verbal abuse, intimidation, harassment, bullying, attempted or actual physical violence, damage to property or any action that may bring the Society, director’s employees or membership into disrepute will not be tolerated.
If as a member, you wish to raise a concern or complaint please put the details in writing to, the CEO at the society office. This will be acknowledged within five working days. All cases will be dealt with on an individual basis and the receipt confirmation will specify, depending on the nature of the query, the likely length of time next steps will be taken to resolve the issue raised.
FOR THE ATTENTION OF ALL VENDORS AT SOCIETY SALES
To protect the integrity of the breed it is important that sheep presented at Society events represent the best the Suffolk can offer. With this in mind members’ attention is drawn to the following:
1.
ARTIFICIAL
COLOURING - Bye Laws
16.14 No artificial colouring of hair on heads/legs, dressing, bleaching or chemical agent (except Department of Environment, Fisheries and Rural Affairs’ approved and recognised show dip and colourless oil on the head) shall be used on or applied to sheep entered for such show. If any sheep is found by the Inspectors or veterinary surgeons to have been artificially coloured:
16.14.1 The owner shall upon being so required by the stewards forthwith remove such sheep and all other sheep in the same consignment from the Society Sale and the sale ground.
16.14.2 The matter shall be referred by the Secretary to the Disputes and Disciplinary Committee pursuant to Articles 45 and 46 of the Society’s Articles of Association
2. HAIR SAMPLES - Hair samples will be taken randomly by the veterinary surgeon(s) or Society representatives. A number of these will be selected at a later date and tested under clinical conditions for non-approved artificial colouring. Where found, the breeder will be notified in writing of the findings and banned from entry into any Society Sale or Society Show held during the next calendar year.
3. INCORRECT MOUTHS/TESTES - The veterinary surgeons will, without limitation, inspect for correct mouths and evidence of mouth tampering and, in the case of rams, testes. Any sheep which is not approved by the Inspectors and/or veterinary surgeons shall upon being so required by the stewards forthwith remove such sheep and shall not be entered at any other Society sale and cannot be registered with the Society. The decisions of the Inspectors and veterinary surgeons on all such matters are and shall be final and binding, and (in the absence of bad faith) without any responsibility or liability on their part.
PLEASE NOTE: There will be no appeal to these decisions on the day
