How Are You Going to Get There? by Tom Archambault AASP-MN Mechanical Division Director

When my wife and I were in our 20s, we loved to take road trips. We would pick a city, choose a departure date and just go! We never worried about where we would spend the night, or about road closures and weather. Oh, to be so carefree! Now, I know some motorcycle-riding members who may still do that, but many travelers tend to make more thorough plans, as I do now. Having a plan, or goal, not only makes sense, but also helps ensure that we reach the destination and return in the allotted time. If a person would do this for a road trip, would it not be logical to do this for your career? Yes, it’s the age-old question, “If you don’t know where you are going, how will you know when you get there?” As corny as this sounds, it is true. I have made and heard statements while in the company of fellow shop owners about looking forward to a better year, wanting to hire more employees, starting to track KPIs, switching shop management systems, wanting to retire, etc. Those are all extremely important ideas for a business owner. However, they simply run the risk of staying ideas unless the question is asked: “How am I going to get there?”

By no means am I a guru, strategist, coach, or consultant telling you that I have done this perfectly and you need to follow my lead. I am a shop owner like you. I know the demands of running a shop. The following challenge I present to you, I also present to myself: Make a plan and write it down. This does not need to be fancy or sophisticated. Take out a piece of paper and a pen or fire up your computer. Start with a goal, and then write down steps you think will help you achieve it. For those of you who don’t have immediate needs within your business, I challenge you to write down future years in any increment you desire. Next, write down what you want in those future years, followed by the steps needed to achieve those goals.

AASP-MN Reaches Out to Minnesota Safety Council on OEM Procedure Legislation by Kevin Walli, AASP-MN Lobbyist

AASP-MN recently met with leaders of the Minnesota Safety Council to describe the “Satisfactory Repair” initiative we are pursuing at the State Legislature. The objective is to make it an unfair claims practice for an insurer to deny payment for scans and other operations performed in accordance with OEM specifications. Liability for satisfactory repairs has been clearly established as resting with the repair shop. There is greater urgency than ever that vehicles must be properly repaired to ensure that all systems – particularly ADAS – are fully operational when vehicle owners drive away from the repair shop. The Minnesota Safety Council expressed interest in the Satisfactory Repair proposal. They have even

indicated a willingness to participate in, or host, meetings between the repair industry and insurers. We will continue to share information

with the Safety Council regarding recent studies which indicate the extent to which properly aligned collision avoidance systems actually reduce collisions and corresponding property damage, as well as personal injuries. As we reach out to the Minnesota Safety Council, we will also renew our contacts with the Alliance of Automobile Manufacturers who have been staunchly on our side. We have also requested a meeting with the Minnesota Automobile Dealers Association to brief them on recent developments with respect to the “Satisfactory Repair” legislative proposal. We will keep you informed as we work on this issue in the months leading up to the 2020 legislative session.

Minnesota Careers in Auto Repair and Service (MNCARS) is proud to announce the release of new video resources to expand its outreach and raise awareness of career opportunities in the automotive service and collision repair industry. The new videos feature students who are currently enrolled in automotive programs telling their stories about how they got there and what they love about the industry. These students are the future of the industry and they share their passion and excitement about the opportunities in front of them. The videos and other updated materials support the 2019 campaign message of “Turn Your Passion into a Career.” In addition to refreshing the campaign’s look and feel and adding text message/SMS marketing capabilities, MNCARS will be advertising on the YouTube platform to reach students with automotive-related interests. The videos will also be utilized on MNCARS’ Instagram and Facebook pages. To see some of the student-focused videos, head to the MNCARS YouTube channel. He’s Back! After a brief hiatus, Tom Kluver has re-joined the association on a one-day-a-week basis to make shop calls to members and nonmembers. The Alliance is pleased to have Tom in the fold once again, spreading the good word about association initiatives, events and benefits. Be on the lookout for his smiling face at your door! Our best to Ben Simon, who Tom Kluver returns as served as membership coordinator membership coordinator during the summer months. Unfortunately, due to the demands of his consulting business, family life and other obligations, Ben was unable to continue in the role. Minnesota’s Minimum Wage to Increase to $10 an Hour Minnesota’s minimum-wage rates will be adjusted for inflation beginning January 1. The new rate will be $10 an hour for large employers with annual gross revenues of $500,000 or more, and $8.15 an hour for other state minimum wages, according to a statement released August 28 by the Minnesota Department of Labor and Industry. Under Minnesota law, the commissioner of the Department of Labor and Industry is required to determine and announce

the inflation-adjusted minimum-wage rate each year by August 31. The change this year represents an increase of 1.41 percent. Minneapolis’ new minimum wage rates went into effect on July 1, 2019 and are $12.25 an hour for large employers (101-plus employees) and $11 an hour for small employers (100 and under employees). In St. Paul, on July 1, 2020, businesses with more than 100 employees will be subject to an $11.50 minimum wage; for those with between five and 100 employees, the minimum will be $10; and for those with under five employees, the minimum will be $9.25. Body Shop Session Highlights On Tuesday, September 17, AASP-MN hosted a Body Shop Session at Grumpy’s Bar & Grill in Roseville. During the BS Session, Aaron Schulenburg, executive director of the Society of Collision Repair Specialists (SCRS), shared information gleaned from the national-level vantage point that addressed opportunities and challenges facing collision repairers. He shared information on trending topics from the headlines of Repairer Driven News, victories in addressing estimating data inaccuracies and omissions through the Database Enhancement Gateway, and provided an SCRS Executive overview of the market-leading work by Director Aaron SCRS. Schulenburg Highlights included notable legislation and litigation, OEM procedures, protection of data and ADAS and advanced technology. Participants also received a report on AASP-MN’s current initiatives and upcoming events. I-CAR SkillsUSA Golf Outing Highlights The Minnesota Volunteer I-CAR Committee, along with SkillsUSA, had another successful annual golf tournament at the beautiful Oak Glen Golf Club in Stillwater on September 11. The proceeds from the outing support technical schools and students with scholarships and grants to continue the successful growth of the collision repair industry. Congratulations to team Waconia 1 Collision (Chad Bijou, Chris Beckwith – Lupient Collision, Dylan Koncan and Steve Wielly – Enterprise Rent-A-Car), who won first place this year with a score of 13 under par! There were many other winners, with all the prizes and donations presented at the dinner and awards ceremony following golf. “We couldn’t do it without our sponsors! www.langmarketing.com Used Vehicle Prices Boost Aftermarket Facing higher new car and light truck prices (today’s average new vehicle has a $36,000 price tag), many buyers are turning to the used car market. However, 2019 used vehicle prices are up sharply over last year and have reached record-high levels. Six Major Takeaways: • Used vehicle prices in the U.S. were at record-high levels during the first half of 2019, up nearly 40 percent over the last 10 years. • Light trucks are leading the used market price wave, with pickups, SUVs and work-related light trucks recording the greatest value gains. Low-priced passenger cars are also in great demand, but they are getting harder to find. • Many dealers can make greater profits selling used vehicles than by selling new cars and light trucks. Aided by the internet, consumers are becoming more aware of the bargains that the used market can offer as an alternative to buying new. • Increasing used vehicle prices are positive for the aftermarket since rising used prices increase the value threshold at which vehicles are scrapped, keeping older vehicles on the road, which use more aftermarket products per mile than newer vehicles.

• Rising used vehicle prices encourage consumers to invest in the repair and maintenance of older cars and light trucks, increasing aftermarket volume. • The synergism between rising used vehicle prices, lower scrappage and the growing number of older vehicles in operation creates an algorithm positive for aftermarket growth. Final DOL Rule Announced Regarding Overtime Exemptions As you may recall, in 2016, the Department of Labor (DOL) increased the salary level required for exemption under the Fair Labor Standards Act (FLSA) from $23,660 to $47,476. However, the rule was invalidated by federal courts (because the salary level was so high as to supplant the duties analysis in the FLSA exemption criteria). The final DOL rule released last month increases the salary amount required for exemption under most of the FLSA exemptions but by substantially less than the 2016 rule. Under the final DOL rule announced on September 24, the salary that employees must earn in order to qualify for most FLSA exemptions has jumped from $455 to $684 (weekly) and from $23,660 to $35,568 (annually). This salary level is based upon the 20th percentile earnings of full-time salaried workers in the lowest-wage region (the South) and the retail industry nationwide. The DOL estimates that under this rule approximately 1.2 million workers will now become eligible for overtime. Unlike the 2016 DOL rule, the rule does not provide for automatic adjustments. However, the DOL affirmed its intent to more regularly update the compensation threshold. Additional significant points in the new DOL rule: • Under the rule, employers will be able to use nondiscretionary bonuses and incentive payments, including commissions, paid at least annually, to satisfy up to 10 percent of the new standard salary level. If an employee does not earn enough in incentive payments to reach the salary threshold, the employer may make a catch-up payment within one pay period from the end of the 52-week period; • The salary level required for the “highly compensated employee” exemption has also been raised, although less significantly, from $100,000 to $107,432 (this level equals 80 percent of full-time salaried workers nationally). • Remember: The salary test is only one component of the exemption analysis. Even if your employees meet this salary threshold for exemption, before classifying any employee as “exempt” be very careful to ensure that the job duties component of the applicable exemption is satisfied as well. And some within the legal community have suggested careful analysis before relying upon incentives to meet the salary threshold. For more information, visit dol.gov/whd/overtime2019/.

Spotlight on Safety: Votechsafety.net A new resource for business owners, technicians and collision repair instructors By Anca Bejan In 2014, HealthPartners safety experts partnered with collision repair instructors from Hennepin Technical College, St. Cloud Technical and Community College and Ridgewater College to create and test new educational materials for teaching safety and health to students. Now, these materials are available for free on the Technical Education Curricula for Health and Safety (TECHS) study website – votechsafety.net. Let’s look at some examples of how TECHS materials can help you evaluate safety in your shop and train your employees. You are required to: • Train your employees on the chemical hazards encountered in your shop. • Train your employees on the hazards of noise exposure, and how to use personal protective equipment (PPE). • Train your employees on how to use fire extinguishers and avoid electrocution. • Complete a PPE assessment form. • Inspect your shop to identify and correct hazards. • Have written rules about safety in your shop. TECHS website provides: • Modules on isocyanates, solvents, acids and bases. • Modules on hearing protection and eye protection. • Modules on fire and electrical safety. • PPE assessment form. • Checklists on a variety of topics (fire safety, compressed gas cylinder storage, emergency exits, welding safety, etc.). • List of safety rules + PowerPoint presentation.

The TECHS website (votechsafety.net) has over 200 documents related to safety, including reports, fact sheets, alerts and accident reports, in addition to 15 comprehensive safety training modules. For an overview of the materials available by

On this page you can also subscribe to the TECHS Newsletter and receive periodic TECHS study updates. TECHS study results showed that college graduates with TECHS safety instruction knew more about safety and were working more safely than their peers without TECHS instruction. The study team - Anca Bejan, CIH, Maryellen Skan, MPH and David Parker, MD - partnered with the Collision Repair Education Foundation (CREF) to disseminate information about the TECHS materials to college and high school instructors around the country. The study also found that technicians’ work practices depend in great measure on the shop environment (safety-related conditions, equipment, safety rules and supervision). Therefore, you, the business owner, have a critical role enabling - as well as requiring - that technicians work safely and maintain safe working conditions in the shop. All TECHS materials are free! Please share this resource with other shop owners, your technicians and college or high school collision repair program instructors. ESTIMATING TIPS CCC: Applying Labor Rates Retroactively – The DEG has posted a video on YouTube outlining how to apply Labor Rates retroactively to supplements and estimate of record. Check it out here: https://youtu.be/18bmCeCY2wU. All Three Systems: A/C Leak Test – Repairs involving air conditioning systems may need a leak test after the system has been recharged. The labor needed to perform a leak test using the various equipment available is NOT INCLUDED and would be an on-the-spot evaluation. Some testing kits may use a consumable product that must be injected into the system, which is also NOT included in the labor time. Audatex: Option and Accessories Impact on Labor Time – The DEG has posted a video on YouTube explaining how incorrect options and accessories can impact your estimate’s labor time. All Three Systems: Masking for Stone Guard CCC/MOTORS has updated the GTE pages to define that masking operations needed for “stone chip guard” coating is NOT INCLUDED.

Mitchell includes basic masking for “gravel guard” application using its formula: “add .5 hour for the first major panel and .3 hour for each additional panel.” Audatex (page 148 of Audatex DBRM) does not include the application of gravel guard or the process of masking in its labor times. CCC: Truck Bed/ Pickup Box Replacement Requiring Seam Sealer Application – Per DEG inquiry 14705: According to the MOTOR Guide To Estimating, duplicating the “OEM Caulk/Seam Sealer” for an OEM replacement “Hood, Door, Trunk Lid, Liftgate, Tail Gate and Pickup Box,” is Not Included in the Motor estimated work time. This is due to a variation in supplied OEM Service Parts that require “Caulk/Seam Sealer.” The “Caulk/Seam Sealer” may or may not be applied to the OEM Service Part, and if it is “Caulk/Seam Sealer” it may be Partial “Caulk/Seam Sealer” or Complete “Caulk/Seam Sealer.” MOTOR suggests using an on-the-spot evaluation to determine if duplicating the “OEM Caulk/Seam Sealer” is required, and all parties mutually agree upon an appropriate “Caulk/Seam Sealer” time.

Note: The estimating databases are all intended to be used as a GUIDE ONLY - it is important to remember that the auto body professional performing the repair is in a position to thoroughly inspect, diagnose and identify the methodology and their unique cost of the vehicle damage repair.
