But Wait…There’s More! by Kevin Walli, AASP-MN Lobbyist

Month after month, I have been writing my column about the legislative effort to amend the insurance claims process to see that shops are paid for repair procedures called for by the original vehicle manufacturer. While this is an important priority for the Association, it is not the only focus of our work at the State Capitol. There are several other legislative committees that we watch to ensure that the business interests of AASP-MN members are taken into account. We routinely follow the House and Senate Tax Committees. Over the years, we have had the opportunity to support initiatives to change the point of imposition of sales tax on shop supplies and materials – to the benefit of members – and we have supported efforts to reduce the statewide business property tax.

We also routinely follow the Environment and Natural Resources Committees which set standards for proper handling and disposal of hazardous materials. In addition to following legislative activity, we have worked with the Minnesota Pollution Control Agency (MPCA) as it drafts rules for the handling and disposal of hazardous materials. Through routine contact with the MPCA staff, we have been able to provide a more practical approach for shops to comply with pollution control standards. As we look ahead, an area where we will likely be spending more time is in the Education Committees. Both K-12 and Higher Education Committees are hearing more and more about the challenge that many sectors of the economy are facing with finding a well-trained workforce. Certainly, the

automotive repair industry is facing a shortage of technicians coming into the business with at least a working familiarity of the tasks they will be asked to undertake in either a mechanical or collision repair shop. We will be watching for opportunities to inform legislators of the types of jobs that are available in the automotive repair industry and ensure that programs remain in place in high schools and technical colleges to provide the next generation of workers for the industry. While we continue to work on our OEM repair procedures proposal, we will strive to keep you informed of developments on these other fronts, as well.

LOCAL NEWS Mech XChange Highlights On October 30, the Alliance hosted a Mech XChange event for auto service professionals at TGK Automotive in Hugo. Those in attendance were able to “talk shop” in a roundtable discussion about their knowledge and experiences with various SMS software. The in-depth discussion covered: • Major shop management systems currently in the marketplace • Features and functions • Digital vehicle inspections and other add-ons • Pros and cons

Anderson Renews Professional Designation ASAE has announced that AASP-MN Executive Director Judell Anderson has met the qualifications necessary to renew her Certified Association Executive (CAE®) designation. The CAE is the highest professional credential in the association industry and is the marker of a committed association professional who has demonstrated the wide range of knowledge essential to manage an association in today’s challenging environment. To be designated as a Certified Association Executive, an applicant must have a minimum of three years of experience with nonprofit organization management, complete a minimum of 100 hours of specialized professional development, pass a stringent examination in association management and pledge to uphold a code of ethics. To maintain the certification, individuals must undertake ongoing professional development activities in association and nonprofit management. More than 4,200 association professionals currently hold the CAE credential. The CAE Program is accredited by the National Commission for Certifying Agencies (NCCA). Congratulations, Judell!

Reporting Time: OSHA Recordkeeping and Environmental Deadlines It’s almost that time of year again. Note the deadlines detailed in the table below, through April 1, for OSHA recordkeeping, hazardous waste generators and air quality permit holders. For companies outside the Twin Cities metro area, hazardous waste reports are not due until August 1, but it is a good idea to gather your information early in the year. You can submit as early as April. *If you have an air quality permit B, C or D, you may be eligible to void your permit. If you voided your air permit, you must still maintain records of paint purchases, so continue to ask your jobber for an annual VOC report. Members in the metro area can choose one of the following options: 1. Per-Call Basis - Your bumper cores will be picked up within three-to-five business days from the time you placed the call - $89 each stop. 2. Route Based - Automatic pickup every two weeks/twice per month - $170 per month. Some pickups outside of the metro area may be available, but are subject to additional fees. SCRS Introduces the Guide to Complete Repair Planning Blueprint Optimization Tool The Society of Collision Repair Specialists (SCRS) announced it has introduced a new generation of the Guide to Complete Repair Planning at the 2019 SEMA Show. The new automated Blueprint Optimization Tool is a market-first for the national association and the collision repair industry. It was named the best new product of 2019 in the collision repair and refinish category by SEMA. “There has been a ton of design and development put into this software resource over the last year and a half, and we are all excited about the potential we believe it will deliver to collision repair shops,” shared SCRS Chairman Brett Bailey. “There are numerous legitimate repair operations and services our technicians provide that have the potential to go unrecognized on the estimate and final repair order; and we believe this tool is going to make a significant difference in helping to enhance estimate accuracy and ensure collision businesses are not missing line items and operations that are a part of the repair process.” In 2011, SCRS first published the Guide to Complete Repair Planning in a digital PDF format to aid repair facility personnel in formulating the most accurate repair plan in the estimate preparation process. The document serves as a guide to develop and maintain uniform processes performed in the repair facility, and as a reminder of steps that may need to be performed during the repair process. The item unveiled at the SEMA Show is a Software as a Service (SaaS) resource that SCRS has designed to advance the Guide to Complete Repair Planning. The new product has taken the once-static PDF document and evolved it into an intelligent, dynamic and customizable estimate analysis and optimization tool. SCRS has identified the advantages it can provide as a training mechanism for businesses seeking to grow their estimating department and as a solution for the auditing of estimates for thoroughness both before repairs commence and before final billing. It can also be used as a safeguard to ensure everyone within the business is meeting the expected goals of capturing necessary repair operations that have a high degree of impact on estimate accuracy. Equally important, this optimization tool allows the system administrator within the collision repair business to set their business practices, estimate rules and line items, based on the estimating system. The first release will be compatible with the CCC estimating product and will soon be expanded to additional estimating platforms. The SCRS Guide to Complete Repair Planning - Blueprint Optimization Tool will be available via the SCRS website, with intended installation dates starting in the first quarter of 2020. Mike Anderson Honored The Collision Industry Hall of Eagles announced its 2019 Inductee is Michael Anderson of Collision Advice. Anderson was inducted November 6 during a ceremony that was attended by over 300 industry professionals at the Westgate Las Vegas Resort & Casino in Las Vegas. The event was held in conjunction with the National Auto Body Council (NABC) Recycled Rides Luncheon and Gifting. The Hall of Eagles, the collision industry’s Hall of Fame, honors exceptional individuals whose longterm efforts have reached beyond their jobs and self-interest to make significant contributions towards the betterment of the industry. www.langmarketing.com Surging Vehicle Age Reshapes Aftermarket On January 1, 2019, light vehicles on U.S. roads reached an average age of 12.3 years. This 15 percent gain over the past 10 years was one of the largest average-age increases in more than 50 years. What makes this age growth even more remarkable is that it occurred despite a record surge in new vehicle sales between 2015 and 2018, which should have dampened the average age of vehicles. Six Major Takeaways: • The average age of cars and light trucks on U.S. roads continues to climb, reaching a record-high 12.3 years at the beginning of 2019. • The vehicle repair-age sweet-spot for cars and light trucks is being pushed into older vehicle age categories by the changing age mix of vehicles in the U.S. and longer-lasting parts on new vehicles. • The aging U.S. vehicle population is reshaping the types of aftermarket products that are sold, with value products gaining DIFM and DIY volume share. • Differences in the average age of domestic and foreign nameplates are shifting the types of products used (value versus premium) according to the vehicle nameplate. The increasing age of the vehicle population is generally positive for aftermarket (non-OE) brands since they are less expensive than OE brands. • How brands are distributed is being influenced by the changing age mix of vehicles. Aftermarket (nondealer) brands are primarily distributed by three channels: Traditional, integrated and import. • The changing age mix of vehicles is influencing where consumers have them repaired, with independent aftermarket outlets gaining a competitive advantage with their lower costs. Dealers are promoting their service bays to all makes and age categories of vehicles in order to adapt to the changing age mix of vehicles in the U.S.

Automobile Exposures

A safety checklist developed by UFG for automotive service providers

The use of vehicles can present various claim exposures. These exposures can include vehicles loaned to customers, pick-up and delivery of customer vehicles, test drives, parts runs and business errands, courtesy rides and towing services. Liability controls include, but are not limited to: – Motor vehicle driving records (MVRs) of all employee drivers should be reviewed annually. Potential new driver MVRs should be reviewed at the time of hire and annually thereafter. MVRs for drivers with marginal driving records should be reviewed more than once a year. Drivers with poor driving records should be excluded from driving company and customer vehicles. – Drug and alcohol testing should be completed on all prospective new employees. A post-incident drug and alcohol testing policy should be in place. – A fleet safety policy including no cell phone use and no texting should be in writing and reviewed with all drivers. A signed copy should be kept on file. The fleet safety policy and safe driving procedures for company or customer vehicles should be reviewed with drivers at least annually. – Non-employees should be prohibited from driving or riding in company vehicles. Personal use of company vehicles should be prohibited or limited to owners and managers. – Obtain insurance information for any employee vehicle being used for company business. Conduct at least an annual inspection of non-owned vehicles used for company business to ensure they are safe to drive.

– Towing operations, if hired out, should provide proof of insurance. – Loaner vehicles, if provided, should be limited to customers who are over 21 years old. Drivers should be required to present proof of a valid driver’s license and auto insurance. A photocopy should be made of their license and insurance information. A liability waiver should be signed. – Test drivers must have a valid driver’s license and auto insurance. A photocopy should be made of their license and insurance information. A liability waiver should be signed. – If selling vehicles, customer road tests should be limited to a predetermined route or a set time out. An employee should accompany all test drives. No overnight tests should be allowed. – Vehicles used for business errands and as courtesy vehicles should receive regular maintenance with records kept on file. – Vehicles should be inspected before each use. Audatex: Rocker Moldings/Body Side Moldings – Audatex users will not find the door body side moldings/rocker moldings in the respective location in the door or rocker group. Users will need to see the “STRIPES AND MOLDINGS” category for the correct part labor and pricing information. It is also important to ensure the correct vehicle options are selected from the vehicle options tab. Some moldings are considered “optional accessories” and will not default them unless the option is selected correctly.

Painter Training It’s time to renew training for most painters. Who this applies to Refresher training for painters is required by the 6H NESHAP every five years. The 6H NESHAP is the federal air quality rule that regulates all auto body shops in the country. Most shops certified that they were following the requirements of the 6H NESHAP in late 2010 or early 2011. Considering the five-year cycle, it may be time for painters to receive refresher training over the next year or so. Some shops filed a petition for exemption from the federal 6H NESHAP stating that they don’t spray products containing cadmium, chromium, lead, manganese, nickel or their compounds or use methylene chloride. If your shop filed a petition for exemption, you don’t have to train painters or resubmit anything. However, make sure those metals and methylene chloride haven’t crept back into the shop. Pay special attention to the SDS for new products or check with your supplier. Painter training also applies to shops that follow the Minnesota Conditionally Exempt Source rule for auto body refinishing. This rule allows auto body shops to follow the requirements of the rule rather than obtain an air permit. This rule states that painters must be trained within 180 days after they are hired and every five years after that. Training that complies with the 6H requirements satisfies the state rule. Painters who received 6H training less than five years ago don’t have to renew their training now. However, it may be easier to keep everyone on the same schedule and train all painters now.

Environmental and safety benefits The goal of the federal and state painter training requirement is to reduce the amount of air pollution that is released into the air. For that reason, refresher training must cover how to improve transfer efficiency, use the best spray gun and equipment for the situation and keep the booth and filter in good working order. Training must also include an overview of the 6H NESHAP. Painting well is a skill and all skills can be improved and updated. Well-trained painters use less paint and thinners which means more paint ends up on the customer’s car – not on masking and filters. It also means less air pollution is leaving your shop and the air outside is cleaner and healthier for everyone. Requirements Painters must receive a combination of hands-on and classroom training. Although work experience may be substituted for the hands-on part of the initial training, this cannot be done for the refresher training. Keep records of the dates of initial and refresher training for each painter. Do not submit records of the refresher training, but make sure records are stored where they can be found easily if an inspector asks for them. Painters, you may want to keep your own copy of your training records. Shops can provide refresher training themselves or have painters take a training course. Check to see if your paint or equipment vendor offers refresher training. If not, one option is the Iowa Waste Reduction Center. They provide online training at sprayitright.com. It costs about $100, takes two hours to complete and can be done at each painter’s own pace and schedule. Double-check that records for other 6H NESHAP requirements are in order, too. This includes annual usage for paint strippers containing methylene chloride and how much methylene chloride is in them, documentation that spray guns are HVLP or have HVLP-equivalent transfer efficiency, documentation that paint booth filters have 98 percent capture efficiency and the test method used to determine the capture efficiency and records of any deviations from the 6H NESHAP requirements.

AASP-MN Demonstrates MNCARS Program Success and Other Benefits at National Board Meeting By Alana Bonillo The National Board of the Alliance of Automotive Service Providers (AASP) hosted its semi-annual meeting last month in Las Vegas during the 2019 SEMA Show. State affiliate representatives and other industry professionals gathered to discuss issues and possible solutions in regard to legislation, recruitment efforts and the growing need to repair vehicles according to OEM requirements. AASP-MN Executive Director Judell Anderson was pleased to report the latest efforts with the association’s successful Minnesota Careers in Automotive Repair and Service (MNCARS) campaign, which is designed to help recruit young people into the automotive field. “MNCARS has continued to evolve. Most recently, we updated our website with some video content featuring students’ voices in hopes their messages will resonate with more young people like themselves.” The two-minute video, which can be viewed at carcareers.org, features students sharing their personal views on industry opportunities and what they enjoy most about the automotive field. During the month of October, the site had over 1,400 visitors. The MNCARS campaign includes social media activity on Facebook and Instagram as well as short 10- to 20-second snippet video ads via YouTube. Anderson shared the many resources available to members via the website’s MotorMouth toolbox, including PowerPoint presentations and display materials that members can use for Career Fairs and other events in their local communities. Visiting Career Fairs to talk to students in person is a large part of the MNCARS effort. Anderson highlighted the work of Bruce Tschida, AASP-MN member

and National Board past president, who fabricated a large model pedal car to bring to these Career Fairs as an eyecatching conversation starter. In other business, Danny Gredinberg, administrator of the Database Enhancement Gateway (DEG), reflected on the free estimating resource’s growth over the past year. Since its inception, the DEG has received 14,422 Database Inquiries — an increase of 1,977 over last year. The breakdown among the three Information Providers is 1,453 with CCC, 254 with Audatex and 270 with Mitchell. About 50 percent of inquiries to CCC have resulted in adjustments to its system, with Audatex and Mitchell having about a 28 percent change rate. Gredinberg also reported that he spent the past year working with the Society of Collision Repair Specialists (SCRS) – which supports the DEG along with AASP – to develop its new Blueprint Optimization Tool (BOT). He explained the easy-to-use estimate analysis tool immediately identifies labor operations, line items and customizable charges that could be overlooked on an estimate. With three clicks of a button it will enter items into the estimate, eliminating having to do so manually line by line. Tom Tucker of the Auto Care Association was on hand to update Board members on various legislative affairs across the country. He announced his group will not support the proposed OE repair procedures language as currently drafted, stating the organization’s belief that the measure would ultimately restrict consumer choice. “While we support the safe repair of all vehicles, we are working across multiple industry groups to find consensus language that all stakeholders can get behind while keeping consumer choice and safety at the center of the issue.”

Anderson argued that is not the case for most legislation across the nation, especially in Minnesota. The legislation AASP-MN is working to pass would make it an unfair claims practice for an insurance company to deny payment for repair operations performed in accordance with OEM procedures and would not change current state law relating to the types of parts allowed. She explained that the ultimate goal was to make sure body shops get paid for doing proper repairs. Legislative talks continued with Wayne Weikel of the Alliance of Automobile Manufacturers, who stated his belief that auto manufacturers and collision repairers have interests that align legislatively. He told the Board members he is on hand to serve as a resource if there is anything his association can do to help with their respective efforts. The Board also heard from Jennifer Maher of TechForce, whose mission is to encourage young people to join technical fields, including the mechanical and collision repair industry. Maher explained her group is reaching out to organizations like AASP to establish relationships in hopes of creating partnerships to help students “get their legs.” More information on AASP National can be found at autoserviceproviders. com.
