MESSAGE CONSUMERS HOLD THE KEY

True customer service is a rarity in this world. How many times have we been stuck on hold trying to get someone to address an IT issue only to be disconnected after several minutes we’ll never get back? How many times have we left a drive-thru window only to discover that our bag contains nothing even remotely close to our order? Horrendous service is everywhere, which is why I get frustrated when I see what so many people I know in the collision repair industry go through on a daily basis. The auto body world is a place where shops put their customers’ peace of mind first and let vehicles go without receiving proper payment from an insurer for the work performed. It is a place where repairers have to shallow profits in order to restore a vehicle to an OEM-approved, preloss condition. Every day, owners and technicians wear an “S” on their chests and shield consumers from insurers that willingly put profit over safety. Although this is an admirable trait that makes me incredibly proud to cover this profession, I believe in my heart that it is time for these practices to cease. If I have any influence at all in my words this month, I’d like to encourage shops to make customers more responsible for themselves. If their insurer falls short on paying for a necessary procedure, then the customer needs to be made aware of the deficit and given the ultimate say in how the shortfall is paid. If their insurer refuses to pay for an OEMrecommended/required operation, send the position statement or OEM-documented repair procedures to that company in writing and copy the customer. Let the customer tell the insurer what is appropriate to do. If enough customers see with their own eyes that certain procedures are WMABA OFFICERS PRESIDENT

being ignored – and if they are left holding the bag when the final invoice comes around – maybe they’ll be angry enough to push carriers to do the right thing. If you keep taking the bullet during repairs, you’re going to keep depriving your customer of their rights in the process and giving the power to the wrong party. Changing your previous mindset won’t be a smooth process, and it’s certainly easy for me to sit in my office and write these words without having to deal with the stress and heartburn that will likely come when you draw a deeper line in the sand between your customers and their insurers. But after nearly 20 years covering this industry, I simply don’t see another way forward. I’ve never had a doctor take a financial loss when my health insurance provider put a cap on a service, but I’ve received plenty of bills demanding that I handle the balance. There’s a lesson to be learned in that. H&D

MESSAGE ALT-OE: YOU WOULD BE AMAZED AT THE DEBATE

The alt-OE parts debate is downplayed in the cover story. Our writing team is not allowed to take opinionated liberties above current facts, but I am. Also, what you likely don’t know is that the CIC Parts & Material Committee, which will be addressing this definition and the issues surrounding it, is now packed with more people than any other committee in recent history. That should tell you how important the subject is. There are so many interested parties; repairers are just one group.

Special interests are everywhere. There are many entities vying for position with these parts, and how they are labeled is directly connected to how they will be sold – and their volume and price. Most people think of “special interests” as lobbying that takes place in state capitals or in D.C., but it happens in many places you wouldn’t initially think of. This is certainly one of them. The cover story ends with “more to come,” and I am certain that the CIC meeting held April 17/18 in Nashville will bring much more debate on top of the committee work currently happening. As this issue comes out, the CIC meeting will be underway and the jockeying on this topic will be heavy. Why should you care, you ask? Because the types of parts that can make it into the “grey market” after the traditional dealer network are as complicated as the levels of aftermarket parts. There’s the same confusion about sourcing, legitimacy, origin, make-up/composition and overall quality and safety. What will be more interesting is the positions the OEMs take. OEs are coming down in different ways on this issue. Rumor has it that there are a few who will warranty any part in their OEM box, which then negates the OE network requirement. Others are hard on the other end of the spectrum, saying that unless you got it through the traditional route of an OEM supplier, the part is no way acknowledged by them. There is no doubt that this discussion and the resulting definition will affect the industry in ways not necessarily seen immediately, but it will send ripples and maybe even waves in the years to come. Be sure you understand the parts you’re buying and what you are saying to customers about them. If it doesn’t have the warranty of the OE behind it, is it truly an OE part? H&D

Laslie’s Auto Body, Inc. Working hard, staying optimistic and being thankful for all you have is the mantra behind Laslie’s Auto Body. The shop opened its doors on Old Forest Road in Lynchburg, VA 25 years ago, and things quickly took off from there. “We started this with no money, but we grew like a weed,” recalls the shop’s owner and namesake, Dan Laslie, who started out with just his wife, Ruth, and one helper at his side. He recalls getting credit for parts from a vendor he knew from his old shop management days, which helped him get started. “We paid ourselves last and kept investing in the building and the business.” At first, he rented the building; when the other tenants moved out and the opportunity to purchase it came along, he ran with it. Today, Laslie’s Auto Body has an additional building across the street, a second location less than a mile down the road and a crew of just under 50 members. As their business grew, so did their family. Dan and Ruth are more or less part-time these days, as their two children have taken the main reins of the business. Their son, Joe, runs the body shop side of things, while their daughter, Dianna, runs the administration. Joe’s wife, Susan, runs the parts department, and Dianna’s husband, Paul Buchanan, runs their second location. “He is such a blessing; such a good guy,” says Laslie of his sonin-law. “I consider it his shop, even though it all comes back here through the hub.” When it comes to his son and daughter, Laslie says, “I’m encouraged just watching them flourish.” A third generation is now getting involved at the industry, with grandchildren Cody Beckner and Trey Laslie overseeing C&T Auto Glass, which Laslie considers an “unrelated kissing cousin-type of company.” Going above and beyond for customers has been key to Laslie’s’ success. “We weren’t interested in just satisfying the customer. We wanted to delight the customer.” The Laslie team always strives to keep up with training and the required equipment needed to fix today’s vehicles. Where many may be discouraged by the changes happening in the automotive field, Laslie remains optimistic. “I see it as a plus. I think we are capable of putting in the new equipment, and buying things like new rivet guns that are scary expensive, in order to do the job right. I think the more you kick the can down the road, the more shops that don’t do the right thing will fall to the wayside. Eventually, this will weed out the ones that aren’t helping the image of the industry.” Working to combat industry issues is something Laslie feels strongly about. He had done his share of work by getting behind bills

for sales tax for paint materials and anti-coercion legislation, which stopped insurance companies from forcing customers to go to a particular shop, during the Governor Warner days. Of course, he stands behind WMABA and knows the value of being part of the association. “It’s good to know there’s always someone there I can call if I have a question; reading the articles [in Hammer & Dolly] and staying connected are also important. It’s great knowing there’s someone bigger than me taking to the time to represent our interests in Richmond.” Looking back at the success they have achieved all these years, Laslie is proud to have built his life’s work in the auto body scene. “America is amazing. If you are willing to work hard and put in the effort, you can do what you want. I am thankful to be in the business world.” H&D

NEWS AMi and CREF to Host Student Events at CIC On April 18, the Automotive Management Institute (AMi) and the Collision Repair Education Foundation (CREF) will join forces to host a special breakfast presentation and awards ceremony for Nashville, TN-based collision repair students. The event, which will be held prior to the start of that day’s Collision Industry Conference (CIC) at the Gaylord Opryland Resort, is the first-ever joint venture by both organizations to encourage greater dialog and interaction between young technicians and the industry that seeks to employ them. At press time, approximately 80 students had signed up to attend the gathering, which will begin with a breakfast and industry panel moderated by Jack Rodenroth of asTech. The discussion will offer insight into various industry experiences and provide student attendees with an overview of CIC’s mission and activities. From there, the students will attend a special grant/scholarship presentation at the beginning of CIC. Several students will receive awards from organizations including AMi, CREF and I-CAR. Following the award presentation, students will be encouraged to stay and experience the general session of CIC before being dismissed later that morning. AMi President Jeff Peevy, who currently serves as CIC chairman, developed the event with CREF in response to recent CIC surveys that revealed that the technician shortage was one of the major areas of concern among collision repairers across the nation. “I committed to that being one of the things that I’d like to see CIC address, discuss and push forward. We now have a new CIC committee, headed up by David Luehr [Elite Body Shop Solutions], that will [focus on] the talent pool, the technician shortage and the fact that our industry is competing with a lot of other industries for young people who would be interested in a technical-type career or trade.” Peevy is confident that the added attraction of the awards ceremony will go a long way to expose students to the benefits that await them in the auto body world. “We’re going to give these scholarships away in front of the CIC body. We want to highlight these programs and the people in them, but we also want them to go, ‘Hey, we can get scholarships, too!’ We really want to try to whet their appetite for doing positive things that will help [them] stay in our industry.” AMi and CREF plan to host similar events at other locations moving forward.

“We’re going to do it in Nashville because there’s a series of strong collision programs in that area,” Peevy says. “I would like for it to become something that we do on a regular basis tied to CIC meetings. “None of us benefit from not having enough people in our industry,” he adds. “If the shops struggle to get sufficient staff to repair cars, then the rest of the industry is going to suffer.” More information on AMi is available at amionline.org. Executive Director’s Thoughts

The industry is in a crisis to grow new technicians. There’s no shop that doesn’t feel the burden of finding good people, and there are far more retiring than entering our field. They just don’t know enough about collision repair to know that it is a solid career choice that, when done right, can be a very lucrative one! Many young people are looking at trades. There are also veterans with highly transferable skills who are looking to begin their civilian careers. Other industries are scooping them up, and we should be, too! NEWS AMi Offers New Training for FCA Certified Collision Network

The Automotive Management Institute (AMi) recently announced that it has been chosen to host the FCA Certified Collision Network’s non-technical training in conjunction with industry-leading consultant and Collision Advice owner Mike Anderson. The goals of the training program are to improve the return on investment for the FCA-certified network shop, support accurate and safe repairs and improve the FCA customer experience. The online courses will be available through AMi’s learning portal and will focus on the proper use of Tech Authority, how to leverage the FCA certification and other topics. The FCA online courses are designed for individuals involved in administrative, management, estimating and repair planning roles. Based on the topic, these courses are “highly recommended” or “recommended” by FCA to participate in their Certified Collision Network and are also available to anyone in the industry. “When Chrysler approached us, our system resonated with them, and we pursued this together and worked through this process over the course of seven months or so,” explains AMi President Jeff Peevy. “To their credit, they realize that in order to truly impact the customer experience, they need to look at customer satisfaction. That would mean an accurate repair, which requires OEM repair procedures. We have ‘How to Use Tech Authority’ for that. FCA sees the importance of cycle time efficiency, and we have courses that would impact that. In the end, the most important thing in the repair is the customer. That translates to passenger safety and customer satisfaction. Those should be the main goals of the car manufacturer, the shop and the industry as a whole.” Peevy is quick to praise Anderson for his invaluable help and input in moving the endeavor forward.

NEWS YesterWreck Gives Journey through Auto Body History

A

nyone in the collision repair industry who knows Gary Ledoux and his passion for the industry shouldn’t be surprised that the former assistant national manager at American Honda Motor Co. Inc. has remained an active part of the automotive community since retiring in 2017. The five-time author recently unveiled his latest book, YesterWreck: The History of the Collision Repair Industry in America. His first time writing a book on the industry after creating and publishing four titles on Old West history, YesterWreck presents the definitive look inside the events and people that shaped the auto body world we know today.

At nearly 900 pages, YesterWreck covers everything – body shops, associations, trade publications, the insurance side and more. The book traces the trade’s evolution from the early 1800s through December 2015 and includes a “supplement” on the more recent John Eagle case in Texas. Ledoux started researching for the book in the fall of 2009 and delivered his first printed copy in September 2018. His work led him to not only the longest-running known body shop in the country, George V. Arth and Son Auto Body of Oakland, CA (which was founded in 1877 as a blacksmith and wagon

repair shop) but also back to the days before the first car ever touched the road. “There are a number of companies that still support the industry – like PPG, SherwinWilliams and what we know today as Axalta – that have been around since way before the automobile. Sikkens goes back to 1760!” Today’s industry is a place full of diagnostic scans, sensors and (very soon) fully autonomous vehicles. While these advancements are overwhelming for some, Ledoux’s book illustrates that the automotive world has always thrived on change.

“When vehicle-building started, they were nothing more than a wagon with a motor on it. The bodies were made out of wood. When they went from wood to steel, it was a big deal. There were a lot of people back then who thought that steel was going to be a fad. It was not unlike the change with Ford from steel to aluminum. A lot of people thought that was going to be a fad as well, but I don’t think it is.” YesterWreck also explores the significance the end of World War II had on the growth of collision repair in America. After

entering the service immediately after high school, many veterans found themselves returning home to limited employment opportunities. That soon changed thanks to auto body repair. “These kids had nothing to come back to. Back then, it was pretty easy to get into the body business; the repairs were fairly simple, and you didn’t need a whole lot of tools or equipment. The Government helped out by producing booklets on how to open different businesses, including mechanical/body shops.” Although Ledoux spent years tracing collision repair’s distant past, his most impactful experience writing YesterWreck came when he spent time with someone whose influence on the field is still felt today. The day he enjoyed chatting with living industry legend and Society of Collision Repair Specialists (SCRS) founder John Loftus was something he’ll never forget. “Here’s a guy who was in it early on, and he was in it up to his eyeballs. He did a lot of travel for SCRS in support of making the industry better. He was a real pioneer, and it was a hoot to talk to him. STORY “ALTERNATIVE”? The Growing Controversy over “Opt-OE” Parts BY JOEL GAUSTEN

Keeping up with ever-evolving technological advancements in automobiles is certainly difficult, but juggling the various words, phrases and definitions that have crept into the parts world in recent years is enough to make your head spin. Just a few years ago, selecting a replacement part didn’t require a dive into alphabet soup. You had original equipment manufacturer (OEM) parts – which were fairly easy to figure out thanks to the simplicity of their name – and everything else. Although “like kind of quality” and other titles have been placed on non-OEM products over the years to perhaps soften the blow of straight-out calling them “nonOEM” or “aftermarket,” the definitive identity of genuine OEM parts had never really been called into question. But that’s been changing in recent times in major and potentially litigious ways.

The Problem with Prefixes “Opt-OE,” “Alt-OE” or “Surplus OE” are terms commonly used to identify original automaker parts that have been sourced outside of traditional OEM dealer/supplier network. While the presence of “OE” would suggest that recipients of these parts are utilizing proper, OEMapproved products, there is considerable confusion and ambiguity in regard to whether such parts truly fulfill a shop’s obligations to perform a complete OEM repair. During the final days of 2017, Hyundai Motor America, Inc. filed a lawsuit against independent parts vendor Direct Technologies International (DTI, Inc.), alleging a host of offenses including trademark infringement, false designation of origin, trademark dilution, unfair competition and violating the North Carolina Unfair and Deceptive Trade Practices Act. In its filing, the auto manufacturer contended that the “Hyundai-branded parts” sold by DTI through its website and elsewhere were not meant for sale in the United States and were not the same as Hyundai-branded products available in the American marketplace:

Hyundai Defends OEM Parts

Genuine Hyundai Parts are made to precise specifications and must meet certain quality standards to be sold in the United States. That is not true for Hyundai-branded parts meant for sale in areas of the world outside the United States. Hyundai-branded parts that are not sourced through Hyundai’s authorized chain of distribution for the United States may contain numerous material differences – including, but not limited to, packaging, labels, production methods, weight and performance characteristics – as a result of the difference in specifications to which such parts are manufactured or the actual manufacturing processes themselves, or because such parts are not “first run parts,” are “seconds,” or are defective or have been rejected during manufacturing quality control. Furthermore, Hyundai-branded parts that are sourced outside of Hyundai’s authorized chain of distribution for the United States are materially different in warranty coverage and/or protection and dealer and customer support. As such, the sale of those unauthorized Hyundaibranded parts in the United States constitutes sales of illegal grey-market goods...Plaintiffs are informed and believe and thereon allege that Defendant does not offer a warranty on the Hyundai-branded parts it sells that is equivalent to the applicable HMA warranties...By selling the non-genuine Hyundai parts in the United States, without Hyundai’s consent, DTI has deprived Hyundai of its ability to control the quality of its product and misrepresented to the dealers and/or consumers the origin and quality of the DTI parts.

Additionally, Hyundai claimed that DTI was “intentionally causing HMA’s authorized dealers to breach their dealer agreement with [the manufacturer by] soliciting dealers to purchase the illegal grey-market parts from [them] and passing them off to the public as ‘genuine’ when in fact they are not, and the dealers actually purchase these illegal grey-market parts from [DTI] believing them to be Genuine Hyundai Parts when they are not.” Although DTI admitted to “importing, promoting, offering for sale, advertising on the internet through its website […] and through other media, and/or selling Hyundai-branded parts,” the company denied having “knowledge or information sufficient to form a belief about the truth of an allegation that the parts sold by DTI were intended for sale abroad.” DTI responded to the allegations by countersuing Hyundai. One of the allegations made in the DTI suit was that the automaker created “an illegal monopoly:” continued on page 34

Hyundai has engaged in predatory and/or anticompetitive conduct by, among other things, tying its sales of replacement parts for Hyundai automobiles to its vehicle warranty and extended vehicle warranty program...On information and belief, Hyundai has also engaged in predatory and/or anticompetitive conduct by, among other things, tying its sales of replacement parts for Hyundai automobiles to its dealership franchises for new vehicles. Upon information and belief, Hyundai is exploiting its monopoly power in the Hyundai vehicle market and the threat of not covering vehicle warranties and/or the threat of less favorable treatment or termination of existing commercial relationships regarding new vehicles to force its vehicle dealers to purchase the replacement parts for Hyundai automobiles from Hyundai’s exclusive US distributor.

Hyundai and DTI each filed a motion to have the other party’s suit dismissed. After both motions were denied, a federal trial was set for June 2020 to hear both cases. This unfolding legal drama is of particular interest to Society of Collision Repair Specialists (SCRS) Executive Director Aaron Schulenburg. “I think it certainly highlights concerns repairers have about defining a part as ‘OEM’ when the manufacturer doesn’t recognize it that way. I think the content of that case has a lot of bearing on [industry] conversations and should be paid close attention to.”

Sorting It Out With the Hyundai/DTI trial still over a year away, Schulenburg suggests that a way for the inter-industry to address the issue in the interim is to collectively return to the basics. “I think the first step, before you start defining alternative variations, is defining what an OEM part is and being able to recognize it as an industry. Regardless of what state you work in, or what segment of the industry, we should all be able to point to a part and know what to call it. That should be driven by clear, easy titles and descriptions that create clarity for the consumer. I think we have to consider what a

consumer might reasonably expect if told a part were OEM. I think we need to reasonably take into consideration the variables that get introduced when exploring the alternatives and how to communicate those in both the name and the definition. I think the vast majority of repairers who have communicated with me about this have been clear that they view an OEM part as a part that was made for or by the OEM, in the original packaging, comes from an authorized supplier and is warranted by the OEM.” He’s not alone in his thinking. “Realistically, an OE part is a part that’s sold by a franchised Audi of America dealer and brought to market through the established logistical channels established by Audi of America, period. There is no such thing as ‘Alt OE,’” stresses Audi Collision Program Manager Mark Allen. “As far as we’re concerned, we have no ‘Alt OE,’ and there is only one source for OE part. That’s it. A part coming in from other markets or sources is not an OE part. It does not carry an OE warranty, and I think it’s awfully brash for someone to expect an OE to cover something that hasn’t gone through their approved franchised sales channel.”

Allen also makes it clear that the inherent differences between American and European vehicle specifications invalidate the use of nonAmerican OEM parts on American OEM vehicles. “Those are grey-market parts. I wouldn’t cover a warranty on a grey-market car; why would I cover a warranty on a grey-market part? Later this month, several industry participants will attempt to face the matter head-on during the Collision Industry Conference (CIC) Parts & Material Committee presentation in Nashville. “The CIC Parts Definitions Committee effort is to establish unambiguous part type descriptions and definitions that the collision industry can adopt nationally,” explains Schulenburg, who currently co-chairs the group. “It is an ongoing discussion, and there will certainly be more to cover from the meetings in Nashville in April. I think what has been clear in the conversation is that there is not currently a uniform agreement on what parts are and what makes them OEM or not. This becomes evident in the conversations with contrasting perspectives from repairers,

insurers, automakers and third-party resellers. Because of this, I think it is important that repairers share their real-world experiences and their perspectives and that they be present in the conversations at events like the CIC meetings coming up.” With a critical legal battle brewing and growing apprehension over terms that could potentially cloud the definition of true OEM parts, it appears that the upcoming CIC discussions this month and beyond will produce a fair amount of debate – and perhaps a few battle lines. The “alt-OE” parts definition debate has been looming for some time, with many instances of attendees bringing up the disparity during the Open Mic at CIC and other industry events. The lack of clarity gives repairers no assistance in choosing the proper part for the job. There could certainly be places these parts are useful, but with too many unknown factors (including origin and composition), we certainly ask members to take caution.
