The Christmas Angel by THOMAS GRECO, PUBLISHER
Christmas time can bring such a range of emotions. For some, it’s a time of joy, celebration and presents. For others, it is a sad reminder of better times with loved ones no longer present. For most, I think, it is a mixture of both. At least it is for me. Last year, I wrote about Christmas dreams of my mom, dad and sister who are no longer with us. It was probably the worst Christmas of my life. I wrote that column at the end of November, as I do each year. And as December rolled in, I didn’t expect to find much joy during the first Christmas without Diane. But I guess God has a strange way of showing us that this time of year isn’t about feeling sorry for ourselves after all, because something happened to me on New Year’s Eve that was pretty amazing. As I have mentioned many times in this column, I am not very religious. I believe in God; I actually thank him
pretty frequently for all I have been blessed with. I say my prayers every night (like my mom taught me to) but I don’t go to church, and I really don’t believe in many of the “rules” of any religion. I am also not knocking it in any way. If you are a believer, God bless you. Everyone should have some kind of faith. I was driving to the bank last New Year’s Eve. It was dark, cold and raining cats and dogs. I noticed this little old man walking very slowly on Franklin Ave. He was limping with a cane and he had a tiny umbrella stuck down the back of his coat, trying unsuccessfully to keep himself dry and warm. He was stopping every five steps or so to catch his breath. Stopped at a red light, I couldn’t help but stare at him. And I couldn’t help but think that God was telling me: “Here you are feeling sorry for yourself. You’re warm and dry in your nice SUV going to the bank to make a deposit. Look at this man.”

Whether it was God or my conscience, I turned around and went back to look for the man. I didn’t see him. I went back around the block and there he was, sitting on a step gasping for air. I pulled my truck over, rolled down the window and asked, “Sir, do you need a ride?” He approached my truck warily and said, “Can I help you?” “Can I give you a ride somewhere?” “I can’t pay you.” “No. I don’t need your money. Please get in.” I got out and helped him into the truck. His umbrella got stuck on the door, but we got him in. I asked him where he was going. He told me Shop Rite. “The Shop Rite? That’s about a mile away.” “I know. I’m trying to get there before it closes.” It was 6:50. The Shop Rite was closing at 7. I asked him why he didn’t go to the corner deli, which was about a block away from where we were. He said Shop Rite was the only place that carried the kind of milk he needed for his diet. I told him not to worry. I would get him to Shop Rite in time. He then proceeded to tell me that after 40 years, he was getting evicted the next day. I asked him why. He said the owner wanted to raise the
rent on the first of the year and he couldn’t afford it. Holding back my tears, I pulled into the Shop Rite parking lot at 6:58. The doors were still open. I helped him out of the truck and walked him into the market. He thanked me and shook my hand. When he looked down, he saw the $100 bill I slipped into his hand and with a quivering voice, wished me a happy new year and called me an angel. But he was wrong. He was the angel. He made me see that even in the saddest of times, there are those who always have it worse than you. And this Christmas, I hope all of you meet an angel like I did. Clarence Odbody was right. Keywords to Live By PRESIDENT’S MESSAGE
I’m sure the majority of our members and readers know the concept of search engine optimization (SEO) and using keywords to draw people to a business’ website. I decided to use that idea in this month’s message to make a few important points. A few weeks ago, I traveled to Las Vegas to attend the 2019 SEMA Show. As both an active industry participant and the president of AASP/NJ, I’m in a unique position to connect with shop owners all over the country. My main takeaway from my recent SEMA experience is that shops in various states are trying to combat the insurance industry’s tired line about “prevailing competitive prices.” No, the sight of insurance appraisers throwing up their hands and claiming they have no power to adjust their estimate to reflect reality is not exclusive to New Jersey. Like many of us here, repairers across America feel like they’re talking to a brick wall, too. Insurance companies deny, delay and defend – and it doesn’t matter if it’s down the block or 3,000 miles away. New Jersey has a high cost of living and high insurance premiums, but our rates never increase to meet these demands. Are we not entitled to reasonable

compensation and the ability to raise our rates to legitimately reflect our expenses, equipment and training? My expenses go up every year; I can’t imagine anyone in our industry not having the same problem. At the end of the day, the insurance industry uses the words “usual and customary” or “prevailing competitive price (PCP)”. They offer no proof other than they said so, but how many times have you asked an insurer’s appraiser to drive with them to a shop that supposedly accepts this? They dictate rates. Stand up for yourself. I don’t think I’m going out on a limb by saying that a large percentage of body shops in this state are unhappy with the rates we’re receiving. Everybody feels beaten down by insurers, but perhaps it’s time that we look in the mirror and be salespeople for our services. What are you doing to sell your expertise? Do you know your expenses and true costs of doing business? Are you asking for what you need to survive and make a profit? Do you know the difference between noting a discounted rate on an invoice versus including a concessionary figure that doesn’t reflect in writing exactly what you gave up? If you

The Day that Changed My Life In This Industry by CHARLES BRYANT For as long as I can remember, the collision and insurance industries have had one of the strangest relationships I’ve ever seen. Like almost everyone else in the collision field, I learned how things work between a collision facility and an insurance appraiser from many of my older colleagues who had been in business long before I became a shop owner. My mentors told me that I should be really nice to the insurance appraisers because they had the power to either write an estimate that would allow me to make a fair and reasonable profit or one that would hardly include a profit at all. As I moved from technician to collision shop owner, I quickly learned exactly what my mentors were bracing me for. I ran into an appraiser who, for some reason, didn’t like me at all. Although I tried to be as friendly and appeasing as possible, he had an attitude right from the first moment we met. I will never forget that first experience, which reinforced what my mentors had warned me about. The estimate he wrote was so bad that, after going over it multiple times, I called and asked him to come back to go over it again. It simply did not reflect all of the procedures necessary for a safe and proper repair. Needless to say, he refused and said he had written a fair estimate. I simply did not know what to do. I reached out to one of my good friends, a shop owner who had been in the collision industry for many years. Unfortunately, his advice was to just fix the car and let it go. He said if I gave the guy a hard time, things might be a lot worse next time. He advised me to work with what I had and fix the customer’s vehicle right – even if I didn’t make any money on it. I could not understand how this could happen and, even worse, how a seasoned collision shop owner was telling me to basically let it go and still fix everything right even if it cost me money. I contacted another veteran shop owner. He listened to my story and quickly told me that I better get with the program if I wanted to be in the collision repair business for long. Basically, I was told that the insurer writes the checks and I’d better learn about the
power of the pen. Well, it didn’t take long for me to gain the mindset of so many collision shop owners across the country: “You can’t fight City Hall.” In other words, whatever the insurance industry says goes – and that is just the way things are – so you better get used to it. Even though that was a hard pill to swallow, that was what I had come to believe for the next few years. Then, along came my wife, who was a very educated lady. Because she was a teacher and did not work during the summer months, she came to help out in my office. It all began with fresh flowers in the office and comfortable seating for my customers. Then, she turned things from a body shop to a professional collision repair facility. To make a long story short, after I insulted her one day when she inquired about why I was so upset after arguing with an insurance appraiser, she taught me the best lesson of my life. She headed to the public library for three days straight. When she returned, she dumped a stack of books on my desk; each had numerous little yellow tabs sticking out. She said, “These are the laws, rules and regulations that govern the conduct of insurers during the settlement of auto property damage claims. If you are going to stay in the collision industry, start reading!” That was the day my life changed. The more I read, the more excited I became. For the first time, I started to realize that I – like so many other fellow shop owners – had been brainwashed to believe that whatever the insurance industry says goes. The mentors I had relied on had simply told me what they had been told and what they had come to believe by shop owners before them. The insurance industry had created a false impression that it had all the power and the collision shop had no choice but to go along with it. As I began to apply the newfound information, my business also changed. I began applying the rules I had learned about, and my shop started to really become a profitable, professional business. I started to assist other shop owners who had also been brainwashed. Eventually, I closed the collision shop and opened a consulting business, Bryant Associates, to assist repairers and consumers who were being shortchanged by certain unscrupulous insurance companies. I also provided other services, such as expert witness testimony in court cases and assistance with legislative issues. As the executive director of AASP/NJ, I have brought all of my experience and knowledge over to the association to aid its members. AASP/NJ now has a Hot Line to assist members with insurance claim issues, licensing issues and basically anything that affects members of the industry. We also provide a Labor Pool to assist in locating workers for shops and jobs for available employees, an Equipment Exchange where members can buy and sell used equipment, a Hit and Run Program to help police in identifying and locating hit-and-run vehicles and so much more. Over the years, I have gained a good understanding of how the relationship between shop owners and insurers started and what has made so many people in our industry simply accept whatever insurers hand them. I am also aware that “negotiating” to reach an agreed price to repair a damaged vehicle is, in reality, a game of Let’s Make a Deal. Insurers have held the

Labor Rates down by authorizing the appraisers to throw a couple of extra hours here and there that do not exist just to reach an agreed price without actually paying a fair and reasonable Labor Rate. Okay, I get it! It is easier. However, Let’s Make a Deal games are exactly what has led the industry to where it is today. Collision shops are repairing extremely complicated vehicles equipped with advanced driver-assistance system (ADAS) technology. Some of these cars cost $70,000 $100,000, and shops are repairing them for less money per hour than lawnmower and bicycle shops charge for items that only cost a few hundred dollars when brand new. HELLO? Is anybody home? Well, collision industry, it’s time to wake up and take a stand! You can no longer play Let’s Make a Deal. You can no longer get paid an hour or two here and there to compensate for artificially low Labor Rates. You can no longer prepare estimates and charge for items that you are not actually performing in order to make up for an artificially low Labor Rate. The repair procedures that automobile manufacturers are putting out in position statements must be performed. If not, people are going to die and shop owners are going to be sued for causing their deaths! Do you get that? It’s time for a drastic change! The old mindset that insurers have all the power has got to go. Enough is enough. The collision industry is charged with repairing damaged vehicles safely and properly, and insurers are charged with paying for a safe and proper repair. It is time to eliminate those very familiar lines that every collision shop has heard for years and years: “We don’t pay for that,” “We only pay X” or, “You have to buy your parts from five different states where we have found them, or that’s all we are going to pay for the parts.” Now, don’t get me wrong; insurers can dictate such things. However, this is ONLY acceptable when they choose the option in the auto policy to repair the property, which makes them liable for negligent repairs. They do not have the right to dictate, rather than negotiate, how damage vehicles are repaired, where you buy the parts from or how much they are going to pay for the repairs when they have chosen the option in the auto policy to settle the claim in dollars (which is the option they choose every time)! AASP/NJ has information to back up everything mentioned in this message, and collision shops need to be aware of this because vehicles must be repaired according to the manufacturer position statements. A Comparison of Approach: 1983 Lotus Turbo Esprit Versus 1981 Chevrolet Corvette
As an observer (and sometimes owner) of some pretty neat sports cars, I would like to compare two vehicles I have owned: A 1981 Chevrolet Corvette (American, of course) and a British 1983 Lotus Turbo Esprit. The two cars are close in model year, and I have driven both extensively. In comparing them, I think you will see a good example of the different approach between European and domestic efforts. The European sports car (Lotus) would be built much like the typical European car: Small, light and agile,
with some additional horsepower derived mostly through a more advanced small displacement engine of 132 CID. The Lotus used four-valve technology, dual overhead cams and a turbo long before it was commonplace. Colin Chapman, the founder of the Lotus Car Co., made use of his knowledge of aeronautical engineering and realized the importance of a lightweight design. He stated, “Adding power makes you faster on the straight; subtracting weight makes you faster everywhere.” This basically runs in complete opposite to the American muscle car

mantra that just about any car can go fast as long as you install a large enough engine. (Just hope the race does not include turns!) Under Colin’s guidance, Team Lotus had much success. The horsepower-to-weight ratio is pretty impressive. (See the Comparison Sheet.) From firsthand experience on the street and on the racetrack (just one-quarter mile), the Lotus is much quicker from a standstill and would certainly beat a Corvette in a one-quarter race – drivers being equal. 1983 Lotus Esprit common, old-technology 350 Chevy V8 under the (long) hood. It had almost three times the size of the Lotus engine, but it produced less horsepower (although the torque from the engine – double the cylinders – was significantly higher at 280 versus 194.) Compounding this lowhorsepower performance was an “economy” – type differential (2.72 ratio), which made the car somewhat anemic off the line. A five-speed transmission with a lower first gear would have been a gamechanger for this car, in my opinion. Other than a fiberglass body (which the Lotus also
had) and large tires, little was done to improve the performance of the Corvette. Both cars had some other things in common. They shared many parts from other cars; the Corvette used a lot of generic parts from Chevrolet, while the Lotus employed parts from other manufacturers. These included Citroen transaxle, Smith gauges, various parts from Morris (a British make) and (eventually) Bosch fuel injection. There were others as well. I thought they were great cars and fun to drive, although I have to admit that the torque in the Corvette made the car easier to drive around town and was more forgiving. The Corvette handled well (the best of any American car), but the Lotus handled better, in part due to the mid-engine and significantly lighter weight. One area that is clearly “advantage Lotus” is the ride. For example, a typical Jersey Shore trek

1981 Chevrolet Corvette in the Corvette could be somewhat painful, and attempting to drink a cup of coffee could become a very messy (or another painful) experience. The Lotus rides significantly better, and the shore trek could be enjoyed – not endured. I enjoyed both cars and still own the Lotus. I also realize it may not be fair to compare the two, as the Corvette was and still is a much more affordable vehicle and the Lotus is more of an exotic sports model. But they are good examples of the European and American pursuit of performance cars. NJA

AASP/NJ Leaders Discuss Insurance Claim Issues, Legislation and More at National Meeting
The National Board of the Alliance of Automotive Service Providers (AASP) hosted its semi-annual meeting last month in Las Vegas during the 2019 SEMA Show. State affiliate representatives and other industry professionals gathered to discuss issues and possible solutions in regard to legislation, recruitment efforts and the growing need to repair vehicles according to OEM requirements. AASP/NJ Executive Director Charles Bryant and AASP/NJ President Jerry McNee were on hand to share experiences, thoughts and developments from the Garden State. In recent months, AASP/NJ sought out legal opinions on a number of insurance-related issues. The most notable involved an issue with State Farm, which challenged the association over a notice it sent to members alerting them that the insurer agreed to pay a rate of $250 for pre- and post-repair scanning as opposed to the $25 (.5 of the Labor Rate) the carrier had previously argued was appropriate for the procedures. “During that period of time, one of our members put a complaint in, and State Farm answered it to say that the fair and reasonable cost of scans was $250. I had a copy of that answer from the Department of Insurance… I put that notice out to members; shortly thereafter, I got a call from a special investigator from the Department of Insurance telling me to retract it.” Bryant sought legal advice on the

matter after the association was threatened with a fine. “[The legal advice was], ‘You’re right, but do you want to take on that battle?’” In the end, the Department wanted Bryant to state that the answer only had to do with that particular vehicle and claim and that the cost of each claim would be handled based on each individual vehicle going forward. Success stories included great feedback from members who attended AASP/NJ’s recent events with Database Enhancement Gateway (DEG) Administrator Danny Gredinberg, who served as keynote speaker at its Annual Meeting, and Sam and Richard Valenzuela of National AutoBody Research, who addressed membership in regard to the Variable Rate System this past spring. Bryant also updated Board members on the association’s Legal Defense Fund, which was created to help aid members who are battling issues in court. Working to battle issues with steering, AASP/NJ is in the process of gathering recorded phone calls and letters from insurance companies showing “blatant steering.” On the legislative end, Bryant has been closely following a piece of legislation (S2144) that calls for a private cause of action for first-party claimants regarding certain unfair or unreasonable practices by their insurer. The bill is currently stalled in Trenton.

Gredinberg, also in attendance at the meeting, provided an update on the DEG’s growth over the past year. Since its inception, the free estimating resource has received 14,422 Database Inquiries – an increase of 1,977 over last year. Gredinberg advised that over the past year, 1,453 Inquiries were received for CCC, 270 came in for Mitchell and 254 were received regarding Audatex. About 50 percent of inquiries to CCC have resulted in adjustments to its system, with Audatex and Mitchell having about a 28 percent change rate. He also reported that he spent the past year working with the Society of Collision Repair Specialists (SCRS) – which supports the DEG along with AASP – to develop its new Blueprint Optimization Tool (BOT). He explained the easy-to-use estimate analysis tool immediately identifies labor operations, line items and customizable charges that could be overlooked on an estimate. continued on page 31

The 2019 SEMA Show once again drew more than 160,000 automotive enthusiasts from around the world to meet and interact with vendors from the Garden State area and beyond. Representatives from various local companies took the time to head west to showcase their products and services on the Las Vegas Convention Center floor November 5-8. “The first day was the busiest I had ever seen the show,” commented Nick Mattera, co-owner/sales representative for Innovative Solutions and Technology (Lincoln Park), who once again showcased a number of items at the Pro Spot booth this year. The crew debuted a number of new products, including a new riveting station and a battery-driven, wireless and mobile estimating cart that can go up to four days without charging. The ProFirst/Honda booth also attracted a great deal of traffic, as intrigued attendees came by to take a closer look at a Honda Pilot that had been modified to illustrate the vehicle’s many different body materials. Honda representatives were also on hand to demonstrate a scanning solution that is being provided to the industry in partnership with CCC. “Honda is one of the many manufacturers that has a stance where in order to do a proper repair after a collision, you must conduct a pre- and post-repair scan on the vehicle with the report and everything so that you know if there’s any trouble codes that the car came with,” explained Eli Ko of American Honda Motor Co. “Subscribing to multi-manufacturers’ tools can become quite challenging and expensive. There are some other services that offer something similar, but they are not an OE tool.” The CCC One application is part of the estimating software; it eliminates the need to plug into the car to run a scan, will put in a line item that shows the scan was done and will generate a report containing any related trouble codes. “SEMA is awesome. As in past years, Accudraft continued to impress SEMA attendees with an exhibit featuring a smaller version of its paint booth. The door to the booth very rarely stayed closed, as it easily attracted visitors eager to peek inside and explore. “People can come and touch the quality and actually feel the build of the booth. [Inside the booth], we got some pretty cool videos about some important projects that we’ve done.” “SEMA has been very busy for us,” shared Dave Gruskos, owner of Reliable Automotive Equipment (Belford). “With all of our OE-certified equipment, the actual OEs have been very involved. We introduced the MEC600, which is very efficient for taking panels off steel or aluminum cars. It’s automatically been approved by many car companies and is a tremendous hit as one of the new tools.” A well-recognized speaker and industry expert, Gruskos also had the opportunity to lend his thoughts and expertise to the Society of Collision Repair Specialists’ (SCRS) 2019 OEM Collision Repair Technology Summit on a special panel devoted to OEMs’ expectations for welding. Other educational highlights included Mike Anderson (Collision Advice), who led “Educate Consumers on Safe Repairs with Owner’s Manuals” alongside Danny Gredinberg of the Database Enhancement Gateway (DEG) and “Overcoming Objections to Scanning,” which he co-presented with Jake Rodenroth of asTech. Once again, SEMA proved to be a memorable trip, leaving all exhibitors and attendees from around the globe with a worthwhile experience. NJA

Tom Tucker of the Auto Care Association was also in attendance and updated Board members on various legislative affairs across the country. He announced his group will not support the proposed OE repair procedures language as currently drafted, stating the organization’s belief that the measure would ultimately restrict consumer choice. “While we support the safe repair of all vehicles, we are working across multiple industry groups to find consensus language that all stakeholders can get behind while keeping consumer choice and safety at the center of the issue.” Responding to Tucker, McNee spoke out in defense of the superiority and safety that lies in using only OEM parts. “When they crash study these cars with OEM parts…You can’t come back and say, ‘Our parts are good or better.’ Show us the proof.” Legislative talks continued with Wayne Weikel of the Alliance of Automobile Manufacturers, who stated his belief that auto manufacturers and collision repairs have interests that align legislatively. He told the Board members he is available to serve as a resource if there is anything his association can do to help with their respective efforts. The Board also heard from Jennifer Maher of TechForce, whose mission is to encourage young people to join technical fields, including the mechanical and collision repair industry. She shared that her group is reaching out to organizations like AASP National to establish relationships in hopes of creating partnerships to help students “get their legs.” More information on AASP National can be found at autoservice providers.com. Member Achievement Awards, DEG Keynote Address Highlight AASP/NJ Annual Meeting
During its recent Annual Meeting at Gran Centurions in Clark, AASP/NJ conducted a special awards ceremony recognizing many longtime members, held its Board of Directors election and heard an engaging presentation by keynote speaker Danny Gredinberg, administrator of the Database Enhancement Gateway (DEG). Re-elected Executive Board members include Jerry McNee (Ultimate Collision; Edison) as president, Dennis Cataldo, Jr. (D&M Auto Body; Old Bridge) as collision chairman and Keith Krehel (Krehel Automotive Repair, Inc.; Clifton) as mechanical chairman, in addition to Treasurer Tom Elder (Compact Kars, Inc.; Clarksburg) and Secretary Tom Greco (Thomas Greco Publishing; Nutley). Allied Board member Mike Kaufmann (Mike Kaufmann Dealer Group; Wayne) will return for another term. The special awards ceremony included the first-ever Lee Vetland Lifetime Achievement Award, named in honor of the New Jersey auto legend and past association president who passed away earlier this year. Elder looked back fondly on Vetland as “a great friend, a great supporter and a mentor.” The Lee Vetland Lifetime Achievement Award was created to honor a member who has been in the industry for at least 30 years and has reached the age of 60. Members of the Vetland family, including his daughter, Katie, joined Elder in presenting the award to AASP/NJ Past President Jeff McDowell (Leslie’s Auto Body; Fords).

“Jeff has given nearly 40 years of his life to this industry,” Elder said. “He was president for 12 years and treasurer for God knows how many years. He is amazing...We couldn’t have found a better person to take the first award. Jeff has given his all to this industry.” Reflecting on his friendship with Vetland, McDowell said, “We went way back to the Central Jersey Auto Body Association...When I was a young man starting my shop, we were both in Woodbridge. He told me to buy real estate. I listened to him, but maybe I didn’t listen as good as I should have [laughs]. So, thank you Lee, wherever you are. I still have that house that you made me keep.” The Stan Wilson/New Jersey Automotive Body Shop of the Year Award went to Robbie Berman of Robbie’s Automotive and Collision Repair Specialists of Dover. “This really couldn’t come at a better time, as [I will soon] celebrate my 37th year. It really seems like yesterday; it went so quick,” commented Berman, whose young son Bryce joined him at the podium to accept the award. Additional awards included the Russ Robson Scholarship Award, named in memory of the former AASP/NJ president and presented this year to Alberto Figueroa of Livingston Collision (Livingston).

Keith Krehel, AASP/NJ mechanical chairman, was inducted into the association’s Hall of Fame. “Keith has been very supportive of AASP/NJ, even when many of the mechanical shops turned away from the association. He works as hard as anyone else, even though he doesn’t have a body shop and hears us speaking mumbo jumbo,” joked McDowell upon presenting Krehel with the award. Following the ceremony, Gredinberg took the floor to give a thorough overview of the indispensable and free tool that lies in the DEG. He went over the basic steps and benefits of submitting successful Database Inquiries to the Information Providers and how to use the site’s estimating toolbox to access information on non-included and included operations to assist in building an accurate repair plan.

“The more information you give to the DEG, the better we can help you,” he suggested. “It’s not just helping you; it’s helping others industrywide.” Gredinberg reminded the technicians that their voice is critical. The more concerns they bring forward, the better chance these concerns have at being escalated up the chain and eventually getting into the hands of those who can make change happen “Don’t think that just because you didn’t get a change, it didn’t work. The Importance of Certification By Rodney Krawczyk
ARA’s recent Annual Convention & Exposition left me with some areas to focus on. The areas of certification and training were the two big takeaways. NSF is a world-recognized organization that has certification programs for many industries. Well, a couple of months ago, NSF pulled out of the auto recycling certification program (along with some other automotive programs). It was a huge disappointment. Auto recyclers that became NSF-certified would have reached the highest form of certification available. ARA stepped in and now is in the process of creating a global certification that will allow auto recyclers the ability to again reach the highest level of certification. While not every auto recycler will reach this level, it certainly will allow auto recyclers around the world to strive for continuous improvement and provide customers with a more standardized process and product. ARA has recently integrated ARA University (which is a video training tool) into its general membership benefits. This is a huge benefit, as it allows you to keep up to speed on member training to help build a stronger team. In years past, ARA University was a stand-alone product that had a separate subscription fee. Having a better-trained team will create a safer workplace environment and aid in a better product for our customers. ARA also trademarked the term ROE (Recycled Original Equipment). With that, we hope to have clarity on what type of product auto recyclers provide. It is our sincere desire to strive for continuous improvement and provide a product and service that either meets or surpasses our customer needs. With a focus on certification and training, we know we can achieve what our customers demand both today and in the future.
